I wanted to give one last update to my situation since so many of you reached out to me. My previous posts are here,here, and the most recent one here. My location is Ohio. This has been a whirlwind few weeks. A lot of change, a lot of stress and a lot of hard work. As difficult as all this has been and will still be to go through, I am feeling more positive than I have in months. the legal issues are being dealt with as best they can for the moment and we are looking at filing bankruptcy early next year. It is scary to think about, but I do know it is our best option and things will work out in the end. We moved out of our house almost a week ago. It feels very bittersweet and the girls are having a difficult time but I know they will adjust and I really do think a fresh start will be the best thing for us. The girls are in individual grief counseling and we began family therapy. I will be making an appointment for myself as well, something so many of you encouraged me to do. Some of my good news now. We were able to find a permanent place to live, with a very sweet landlord who is sympathetic to my situation and has previous experience with the welfare system AND has bent over backwards to help me through all of the red tape. We will be moving, (again!), into the new place at the end of this month. Hopefully that will be the last time we have to move for a very long time! My second huge piece of good news to update with is that I got a job! I am now working full time in an office of a company that is owned by someone I met through my posts here. She contacted me after my last update and offered me a trial run with her company. I started this past Monday and so far, so good! I am incredibly humbled and grateful to her for giving me a chance. That brings me to my third point and really the reason I am making this update. I wasn't sure what to expect when I first reached out for advice here. I just felt so overwhelmed with the situation and I think I was just mostly wanting to not feel alone and to connect with and talk to people who had some understanding of what I was dealing with. The response I got from all of you has been astonishing. The advice, the stories of dealing with similar circumstances, the encouraging messages, the fact that you all literally saved Christmas for me and my kids, A NEW FREAKING JOB, and just the empathy and kindness you all have shown to me and my family is so far beyond anything I expected that I don't even know the words to express how grateful and humbled and loved it has made me feel. It is going to be a long, tough road, but I have total faith that things will be okay and that is in large part due to the r/legaladvice community. So in closing, I want to say THANK YOU to every single person who reached out me in any way, shape or form. Thank you for lifting us up and helping us through this. It was brought to my attention that a much larger national brand has started using the image for one of their products. I contacted the artist, and yes- the bigger company paid to get exclusive rights, and I was not informed. I am now in the position of recalling my product. We had an appointment with an allergist last week. We found someone we both could agree on and was highly reputable. My ex and I both went with my son, and the allergist isn't sure what caused his allergic reaction. She did several skin tests of all varying things, including some injections of ones she thought would cause trouble like the dog/cat dander with no severe reactions to anything, and just mild irritation to others. I asked if it could have been a combination of allergens that caused it, which the Dr said that typically isn't the case but it could have factored into it, especially since his immune system was dealing with a flu shot. I also found out at this appointment that my son had nearly fainted again when he was dehydrated from getting sick. Dr said that it is highly probable that he got the hives from something else (cold hives) and he was dehydrated and that was what caused him to collapse. Ex asked several times that she's sure it isn't the cat and tried to work out a way that the cat may have been a factor. Luckily, the doctor probably sees stuff like this a lot, because she navigated it beautifully and cut her off at the pass each time. Ex is still trying to blame the cat and is making it difficult to handle visitation and is getting in my son's head. For example, finally had him over after the allergist appointment and he avoided the cat by about a 5 foot radius for the first hour saying that his mom is still worried thats what caused him to pass out. Being a 9 year old, he quickly forgot about it and was playing with the cat about an hour later. It worries me that she is getting in his head about this when the professional has stated that its not the problem. I'm keeping our collective head down for now, but I'm planning on bringing my son to my therapist in the future to talk about this stuff, as I'm worried about him. [link] [comments] |

(New York State) Long Story: Searching for an answer With the advise from the previous thread, I contacted the local Bar Association for a referal to an estate attorney. A very nice local attorney advised me his fees would be costly in research alone, and that I should "shop around" a little more. Looking around more, I got the same answer, and was directed to the same piece of law that I linked to in the previous post. I even tried a couple Gun Rights focused Attorneys with out much luck. The solution that worked In the end, feeling I had exausted my options, and not wanting to commit a felony in NY, I called and surrendered the firearm to local PD, and made a quick statement. The attending officer even said he works with these types of situations all the time. I was provided a receipt and used that to file the necessary paperwork. Now, a month later, I have a what I can only describe as a priceless family heirloom in my legal possession. If they do fire me do I have a chance? I have evidence that the formal warning she gave me is completely false. She said I had been using work computer to use non-work related websites which in turn would lock my computer up. Except that my computer has no such mechanism. I also have evidence of me telling her about the nurse asking me on a date and the nurse getting angry. My computer by default locks when you turn it off (apparently she tried to use it while I was away). I also have evidence of me telling this very fact to her few months back along with me giving her my own password. I see me being fired soon because this nurse has been harassing me and touching me all over for months. It was a very weird and cringe worthy experience but I put up with it to keep my job. Her parents were always kinda assholes to me and i was reluctant to send my daughter over there at first. I started letting her go over there but have been seeing negative regression in my daughters mourning process in the lost of her mother. Her grandma sits there talking about her dead mom all day (even tho i told her thats not the best interest or healthy for my daughter). The grandma tells my daughter to lie to me and all sorts of messed up things. So now im debating not sending her there anymore. Last time I didnt let the grand parents see her the grandma got super drunk and left me a bunch of voicemails saying she was going to take me to court for grandparent rights and stuff. Im wondering if this is even a thing they can do? We live in Wisconsin and from what I saw online it looks like there is no such thing but I'm just posting here to see what you guys think. Can I Get a Restraining Order Against a Student Who Said He Would Blow My Daughter's Head Off? Posted: 05 Dec 2018 08:56 PM PST WA State Yesterday a 9th grader said he had a gun while riding the bus with my 7th and 8th grade daughters. He sent messages to another student via Instagram (my daughter's best friend's older brother) asking for the name of the girl who was in front of him on the bus (my daughter). He said he was going to shoot her. He was going to blow her head off. She is going to die today. A police report has been filed, he is emergency expelled while they investigate. Unfortunately, they can't tell us the outcome of the investigation and the precautions they will take. He could be back on the bus in a day or two. We will not find out, due to privacy concerns. Since he didn't specifically name my daughter (what's the name of the girl in front of me, he asked in the Instagram) the school is saying it's a vague threat. As I am the only one in the family with a finance degree (I'm an accountant for a small company in MD), gramps made me the executor of his modest estate a few years ago. Everyone in the family is fine with this. Thus far, nothing has been a challenge with respect to shutting off or switching things into my name: Utilities, killing the cable TV, etc. Home is under contract and will be sold next Friday. Except for one recurring bill, all is well - His gym membership. His membership is set for another ~10 months @ $39/month. I took the death certificate to the gym and asked to cancel the membership. The manager said that I also needed another form of proof that grandpa is dead. His reasoning is that over the years they have had a handful of forged death certificates used to get out of memberships. I'm not buying it, smells like greedy bullshit to me. Per the contract, which they showed me a copy of, it states that in the event of death, two items are needed in order to cancel said membership:
We did not publish an obit in a news paper. Gramps was cremated, all was prepaid in advance. I offered to show him the urn, the paperwork we got from the funeral home, and even the little paper we handed out at the funeral. Nope, they are unwilling to budge on the matter. I am not really sure what to do here. I am considering heading to the bank and discussing with them this problem and see about blocking the gym's charges, but there is an agreement in place. What has me frustrated is that the gym has now been shown that grandpa is indeed dead, but their ridged cancellation rules are preventing me from closing the account. I am not really sure what to do from here. I feel hiring a lawyer may end up being more costly than the total remaining cost to the agreement. She ran off before I could find out what house she came from, so I called the police, who basically told me they'd keep an eye out and good luck. The next day, I saw a kid riding a scooter and asked if she'd seen the crash the night before. She admitted it was her and told me which house she lived at and then followed my car back to my house and asked if she'd damaged the door, I said yes and she apologized. I called the police again, but the officer told me it was not a criminal matter, but agreed to talk to them for me to let them know they needed to compensate me for the damage to my door as my insurance company had already come earlier that day and said they wouldn't pay for it since my deductible is so high. He gave me the name and number for the girl's mother, who lives in another city and once again told me good luck. I called a company to come do an estimate of the damage to fix it and then called the girl's mother, who was agreeable to pay, but said she could only do it in smaller amounts each payday. I said fine and agreed to call her the next week when she told me she would be getting paid. So, I called that next week and she told me that her uncle "does that type of shit" for cheaper than the company was quoting me and he was supposed to have come to my house and left his information. She would have given him my number, but she'd lost it, supposedly. Immediately after getting off the phone, this uncle calls me, and tells me he's going to come the next day and measure my garage. I'm apprehensive, since I have no idea whether or not he knows what he's doing, but I really just want my door fixed, so I say fine. He doesn't show up. I call him and he says he got busy with work, and that he's an electrician for a contracting company in town, but he would definitely be out the next day. He actually did show up this time, measured and said he would order the panels. He texted me a couple days later to let me know he'd ordered them. Great. About a month later, I still hadn't heard from him, so I texted him and asked if the panels had come in. He replied that they'd come in the past week, but that he was currently on vacation. That's fine, I can wait. He called that weekend and said he was home and he wanted to go ahead and get this done, because the company he had ordered the panels for couldn't store them much longer and wanted to know if he could come leave them at my house on Tuesday and then install them on either Thursday or Friday. I said sure, and sure enough, Tuesday came and went and I hadn't heard a thing from him. I thought perhaps the company had agreed to store them for longer and held out to see what Thursday and Friday would bring. Didn't show up either day. No call, nothing. So Friday afternoon, I called the company he said he had ordered the panels from and asked them to come do an estimate, because I'm getting my damn door fixed. In addition to this, I texted the girl's mother to let her know it had now been almost two months since the damage occurred and my door had still not been fixed, was she aware. She never messaged me back. The uncle did try to call me the next day, but I was so done at that point, I figured I would get it fixed and then sue them for the money. So I didn't answer his call and he didn't leave a message. The estimate was done on Monday, and they told me the office would call me with the amount, but they never did. I waited two days and then called them to ask why they hadn't called and they told me that they had given the estimate to "the grandfather of the little girl who damaged the door". The grandfather is my neighbor who I believe the girl lives with. I asked how they gave them the estimate when I'd never given them their information, and I don't even know the grandfather's number. She admitted she didn't know, but we set up a date to get my door fixed. After this, the uncle texted me and told me to please call him so we could set up a date for him to pay me for my door. I called him back and he claimed that he had shown up to pick up the panels and they were the wrong color so he went to the company's office in our city and they told him that they'd just done an estimate on my house. He was really pretty rude about it, telling me how busy he was with his job, but I mean, I feel like at this point, I had been unbelievably accommodating with their bs. He said that he would be in my neighborhood the next week and he'd pay me the amount the company quoted me. Obviously he didn't...shocker. And that was three weeks ago. I've not attempted to call him, and he's not attempted to call me. I had the door finally fixed yesterday and paid the amount myself. My question is, I have no idea who to name in the warrant when I file for a civil suit. The girl seemingly lives with the grandfather (my neighbor), not the mother, and he was supposedly who the company gave the estimate to, but the uncle is the one I've been dealing with this whole time, and he's the one I actually have a text from stating that he was supposed to pay me for this door. I already planned a trip around this schedule, which is booked and paid for upfront. He's now demanding that I either switch him halves of the break (which is impossible) or that I give him make-up time for the next 2-3 months for the time he's losing due to his schedule conflict. He travels for work the first week of every month, but has before scheduled around parenting time, such as events like this. Do I have to give up the next 6 weekends because he can't plan ahead? I have about $600 cash, and $3500 in bank but my mum's cosigned on my account so I probably can't access any of it. I pretty much have no life skills but I'm a fast learner, and physically fit so I can probably cover a large distance with that $600. I need to get my birth certificate replaced, then I can get a TFN and a job, then I should be alright. If possible I'd like to get out of the state, maybe get to Melbourne or Adelaide. Problem is I've got basically nothing in the way of proof of ID, just my student ID from school, mum took my medicare card and I never could apply for a driver's license. Donated School Supplies to Local School and Found Out They're Selling The Donations back to Kids Posted: 06 Dec 2018 10:37 AM PST I live in SW Ohio I have a kid that goes to a local elementary school. The school has always asked for donations of school supplies for years and my family has generously donated all sorts of supplies: erasers, pencils, pens, binders, etc. My family always thought it was for the kids to use in class, however, I found out (through my wife) that the kids can take money to school and purchase the donated items. The money they get is mainly from parents because elementary school students don't have jobs. To make matters worse, the school sells them for more than what the parents paid for. For example: loose leaf note book sells for $0.67 at Walmart, and they sell them for $1.00 at the school. I have contacted the school and they don't give me a straight answer onto if the money is non-profit or for a profit. They always change the subject when I ask. I have contacted the PTA and they didn't know this was going on. I also asked some of our friends who have kids going to the same school, they had no idea. What can I do to find out if they are keeping the money for profit or if the proceeds go to the school? Edit 1: This is a public school, and when the donations were asked for, the school did not mention the fact they would be sold to fund an event. It was a dam good rock, I have many childhood memories of playing outside and sitting/leaning/playing on it. Everytime anyone did yard work the rock became a table for drinks, I also have fond memories of my father resting a bottle of coke and tools on it while teaching me how to work on cars. Now our devious neighbors are doing some renovations in there backyard, installing a pool I think. So they have had heavy equipment going in and out, and then one day, our rock was gone. Wth? What did they do to our rock. Appearently they thought we wanted it gone because of something my father said and they thought they were doing us a favor. Appearently my dad complained about how it's hard to mow and rack around the rock or something, when talking to them. So they just assumed we wanted it gone, but didn't want to pay the heavy price to move it. So they had some of the guys take it away, again without asking for consent at all. We complained to them, asked them to fix/return it. They say, "nope sorry it's gone. We don't know where it is." A replacment rock of similar size is expensive, why is installing a rock so god dam expensive anyway. The heavy equipment I guess. Anyway, just recently, we discovered the bitches put the rock in their own backyard next to there pool. What the utter fuck they told us it was gone. We talked to them about it and they admitted they lied, but they wanted a rock in their backyard next to their new pool, and thought we wanted ours gone. And they said they are not going to return it, or pay for another one. We even threatend to sue, because we want the rock and it's expensive to replace. They essentially said "yeah good luck with that, nobody will take you seriously and you have no evidence it ever belonged to you." They said they would deny stealing it, also all our communication to them has been verbal so no documentation of them admitting they stole it, and would lie to the law. It's true, we have no documentation of the rock, or even photos of it. I checked. Can they do this? How do I proceed? Location edit: very Northern CA. UPDATE: We have photos of the rock being on our property now. Both google earth, and appearently my distant aunt who moved away had the family albums she can send us. I did stop by police station to report a threat, there were some giggles but I made it clear that it's worth several thousand probably, and that I will probably be going through small claims. Not having to pay taxes as a handyman Posted: 06 Dec 2018 05:00 AM PST My brother in law has been working as a handyman in NJ for over 15 years. A conversation recently turned to taxes. He said he is not required to pay any taxes (Fed, State, sales, social security...) because the jobs are always billed at under 5000$. He has never filed taxes based on this logic. IANAL, but this just doesn't seem right. For me, it flies in the face of logic. However, I just heard an electrician say the same thing. Thoughts? EDIT He has zero records, how could they even begin to say how much he made? No receipts, no invoices. Said he didnt need to keep them. A lot of jobs handed in cash. He used to have a personal bank account, where he would deposit checks, but he got upset with the bank over a charge or something and closed his account. He now cashes the checks he gets on the bank they are drawn on. That is how this whole thing came up. He was trying to find a way to cash a check that was drawn on an out of the area bank. He isn't interested in getting this straightened out. He thinks he is on the right, and after 15 years with no contact from taxing authorities, he feels that makes his point. I'm just flabergasted. One of my classmates asked me about a paper in October that I had done three months earlier. I shared it with her to show her how I worked it out. The stupid girl submits it word for word. Of course she gets caught. She gets in trouble and accepts responsibility (or so she said) in her hearing. They are making her retake the class. Fast forward two months later and I just found out they are now asking me to have a meeting regarding this next week. I'm supposed to graduate in ten days! I'm freaking out. I did the work and submitted the paper legit. Can they come after me even if I didn't plagiarize anything? I just wonder if they would punish me so close to graduation. I know I technically broke the rules on sharing my work. What are my rights? Do I have a good defense saying I didn't know she was going to take advantage of me helping her. Thanks in advance. I recently placed an order on Walmart.com, to have some items delivered in store that I would pick up. (Google home minis). I prepayed, card was charged, etc. I get an email a few days later that my order is ready, and go to the store to pick it up. When I arrive, I give them my name/order number, and they pull out a box that has been delivered to the store, addressed to me, and open the box and give it to me. In my view, our transaction is over at this point. I've paid for the items and taken possession, have an email receipt, etc. However, the associate then proceeds to tell me that they're sorry, but there was a pricing error, and they can't let me take them and have to refund me. I say that I don't agree, I've already paid for them and I'm sorry that they made a mistake, but I don't agree to a return and would like to take my items. At that point, they take the items back (I'm not about to wrestle a store employee for doing what they are told by manager, obviously) and tell me I don't need to agree and they will be initiating a return. I went back and forth with a manager, customer call in line, etc., with no resolution, but is this legal? How is this different than coming and taking items from my house because they retroactively decide they don't like the price they sold them at? Like I said, I see it as once I took possession of the items I already paid for, our transaction was finished. My "friend" let his dog starve, and today it died. Posted: 06 Dec 2018 10:49 AM PST So I had a roomate who I have known for years and this guy was a diabetic who had gone throug the process about 5ish years ago to get a diabetic alert dog. Nothing really to unusual. He and his mom move states for a bit but he wanted to move back last year. So i go get a house and he moves in and turns out to be the worst roomate I've ever had. During that time I notice he has been forgetting to feed, walk, or just take care of the dog in general. I feed and walk the dog but eventually I just move out. I have been keeping tabs on the dog whenever I see them. (We did hang out a bit still.) Last time I saw the dog I went home and called animal control because the dog was so skinny. According to the new roomate (who I know well) animal control came by and waited for the owner to get home and get the dog. (He works down the street) The owner put the dog's vest on to hide the malnourishment. Animal control said nothing and left. Today I saw on Facebook, 2 weeks from the animal control visit, that the dog has died. I want to report this, but I'm not sure who to. Any advice would help. I should point out, not that it matters, I don't think the dog died due to malice, but sheer laziness. The reason I moved out to begin with. I'll do whatever I need to to push this matter forward. (Legally of course) I just dont know where to start. This is in Fort Worth Texas. Tldr: Old roomate was to lazy to consistently feed or water his dog and it died. [Singapore] Parent beating me for "Embarassing Family" Posted: 06 Dec 2018 05:57 AM PST Hello Reddit (Im 15 years old) Recently my grandfather was in the ICU (you can send me condolences later) and i went to visit there with my father and grandmother today. He told me to talk with him. I felt that there wasn't a point (not in a rude way) because I rarely get to see him and it would feel weird to talk to him. But my father slowly got angry that I was not talking to him so he forced me to talk 10 sentences to him. I tried to and in the meantime my father is complaining about my "bad behavior" like listening to bad music (tell me whether ambiance is bad) and watching youtube. So after a while, we went home, and my father start screaming at why I did not talk to him and why I was "embarrassing" my grandparents. I tried explaining that I did try talking to him but he said that he could not hear it, therefore it doesn't count (like is he expecting me to talk loudly in the ICU?) Roommate threatening to let my indoor cat outside so it will runaway. I don't really do drugs, but we will be in Michigan for Christmas and I thought it might be fun to try legal pot. I know he can't smoke any, but if I tried it, could he get in trouble/lose his CJO? Posted: 05 Dec 2018 02:36 PM PST I am an adult entertainer and a website that I sell my content through ran a contest for the winner to have a lifelike "sex clone" of them. Models had the fans pay for votes and then picked the winner from the top 5 earners. I made around $15,000 during the course of the contest and I was chosen as the winner. At first, I spoke with the owner of the company who makes the doll and he tried to pressure me into signing my name away for a line of sex toys with 0 money up front. He also wanted me to pay for the travel to have them made. None of this was mentioned anywhere in the contest information. (I attached two photos of the only contest details listed anywhere) He said it was either sign the contract or no doll. So I contacted the website that hosted the contest. They told me none of that was discussed beforehand and that they would take care of it. Time passed and they recently told me told me that they don't think the sex doll company will follow through and produce the doll so they offered me $500. When I originally spoke to the owner of the company he told me the body scans and producing the doll would be close to $10,000. The cheapest doll they sell on their website is $2500. This doesn't seem right to me, is this worth contacting a lawyer over and what type would be best dealing with a situation like this? It seems like they bait and switched the contest prize for my fans to pay for votes and then not deliver the prize they advertised. I never would have entered the contest if the prize was just $500. I am in California, the website hosting the giveaway is in Canada and the doll producer is in Georgia. [link] [comments] |
