Legal Advice A couple is trying to trick me into impregnating the wife.

A couple is trying to trick me into impregnating the wife.

    Posted: 22 Dec 2018 07:26 AM PST

This is a very long and complicated story, but I'm going to summarize it shortly here and hopefully get some legal advice on what to do.

I met this girl on a dating app and we hit it off. She basically told me over text that she has something like a fetish for some aspects of my physical appearance. We go on a date or two and it's going well.

Things seem a little off though at times during our texting conversations, so I find her Facebook and there's a lot of weird stuff there. Turns out she is actually married to a guy that looks like a 20 year older version of me, and she actually brings him on a date with me as her "best friend."

Long story short, I have discovered that they want me to impregnate her (they don't know that I have found out). I'm not 100% sure why, but I assume it is due to fertility issues and lack of funds for artificial insemination. Are there legal repercussions to their behavior here? It feels really scummy to lie about all this, but I'm not sure it's illegal. I'd rather they not move on to the next guy and possibly really mess up someone else's life because they aren't being upfront about what they want.

Edit: this is in Virginia by the way.

Daughter was followed from a store from someone claiming to be loss prevention who accused her of shoplifting. They continued to follow her down the street, even after she showed them her bags, which had nothing but the items she purchased from that store. What can I do legally?

    Posted: 22 Dec 2018 07:15 AM PST

My daughter went shopping yesterday, and bought some clothing at a store. When she left, someone claiming to be loss prevention followed her out, accused her of shoplifting a shirt. She denied it, and offered to show him her bag, but he insisted on getting a shirt back. The only items she had with her were the items she just purchased from the store, with the receipt for it. He continued to follow her after that, even as she tried to walk down the sidewalk. It was already late out, and she felt threatened by him following her, so she tried to prove to him that everything in her bag was on the receipt. When he saw the shirt (that she had purchased), he grabbed it from her and left. Was what he did legal, and should I consult with a lawyer regarding this? My location is in Ontario Canada.

edit: Thank you for all the help, I've been in contact with the police, and they'll be following through on Monday morning when the store opens.

Google keeps marking our business as closed and we’ve lost a lot of business, is there any recourse?

    Posted: 21 Dec 2018 12:55 PM PST

36 year old man from Michigan here. Google keeps marking our business as "permanently closed". This has happened twice and it's been during our busiest season. We're an Army Navy Surplus store and when we weren't getting customers during hunting season and Halloween we suspected something was wrong. Our customers kept saying we're were marked as closed and I'd tell them "no, that was the store an hour away not us". Eventually a woman let me know it was us and upon checking I saw our address marked "permanently closed".

I called Google and it was changed back and they weren't able to give me any info as to how or why it happened. Then today I was made aware that apparently it's said we were closed for weeks. When I called Google again the guy said he'd send me an email and he never did. The next guy said he couldn't help me. We did get it fixed but that isn't my concern.

My question is whether we can do anything about Google marking us closed when we're open. We've lost a great deal of money because people thought we weren't open. With Halloween, opening of hunting season, and Christmas compromised we've not be able to make as much money as we usually would. Can anything be done?

My employer switches to paying a flat rate during the holidays (our busiest time of the year) and I suspect this is in someway to get out of paying overtime. Can I have some clarification?

    Posted: 22 Dec 2018 09:05 AM PST

Super awkward title, but I couldn't think of a better one.

I'm a part time, non-exempt employee in Pennsylvania. Really I just want to know if what my employer is doing is allowed and/or if there's anything I can do to better my situation.

Normally I get paid hourly and since I'm part time, never have to really think about overtime. But from the day after Christmas through January 2nd, we are absolutely booked and working like crazy. In that time (8 consecutive days) I'm scheduled to work 61 hours total. Originally I thought great, tons of overtime then. But then I learned from my employer that instead of getting paid by the hour, all employees will get a flat $150 or $200 per day depending on which day it is.

I haven't been told yet whether or not to even log my hours for the days I work, and I have a feeling they might tell me not to bother clocking in or out. I could jump to more conclusions but I don't want to speculate too much.

The tricky part is that our workweek is Monday to Sunday and since my first shift of the week (the 26th) is on a Wednesday, technically I'm only scheduled 38 hours for that workweek, and then 23 hours the next. Keep in mind, in my line of work it's very common to go way over scheduled hours so that first week could easily go closer to 45 hours, which I would think make a difference.

So my questions I guess are 1.) Can an employer just switch up how they pay you whenever and for whatever reason they want? And 2.) Is there anything I should do to either cover my ass in case there is something I can do or might want to be careful of?

Thank you so much for taking the time to read this and for any responses given.

Got hit by a car as a pedestrian ; insurance won't pay for PT because I don't have car insurance?

    Posted: 22 Dec 2018 07:44 AM PST

    *I'm in New Jersey *

Last Tuesday I was involved in a car accident ; while in a crosswalk, a driver went through a stop sign and hit me. Luckily a police officer was in a coffee shop across the street, and was there to take the woman's contact info. Long story short, I went to the hospital, the woman was arrested for careless driving, etc. Since then, I've Ben having a very rough time getting things situated.

My uncle got me in contact with the family lawyer who usually deals on accidents ; he's seemed kindve uninterested in general, and has only told me to send him all receipts of financial costs. He also hasn't been answering his phone this week.

My main issue involves me getting into Physical Therapy. I talked to a few, and they've told me that my insurance (Aetna) won't cover the physical therapy because I don't have auto insurance. But I don't have a car? I don't see what that has to do with it.

Furthermore my insurance has a copay (?) of 1,000$ for the PT, which I can't pay. I don't know why the person who hit me isn't liable from this bill.

I'm sorry if this is disjointed, but I've been stressed this entire week and I could use some guidance.

Brother was in Car Wreck with an Off-Duty Police Officer - We Believe the Investigation is being Mishandled

    Posted: 22 Dec 2018 11:39 AM PST

Yesterday, my brother (MB) was in an accident with an off-duty police officer. The officer was turning right on red and is claiming that MB ran a red light. MB is saying that he did not run the light. When the wreck happened, MB got out of the vehicle and began to look around it and wanted to take pictures. The officer did not identify himself as a police officer, but instead told MB to sit on the curb. MB said no and the he wanted to look at the vehicle, at this point the officer lifted his shirt showing his badge and said get on the curb.

Additional police officers showed up after a short time where MB was still not allowed to look at the vehicle. The newly arriving officers told him to stay there while the original officer involved in the wreck was allowed to look around the vehicles and take pictures.

They also refused to give MB any information on the other officer. No name, phone number, insurance information or anything. The police ended up giving my brother a ticket for running a red light (again, we believe by only word of mouth by the original officer).

Our insurance company told us that if the officer involved in the wreck was a police officer of the city where the accident took place, they should have called another surrounding city to come and investigate the accident. We do not know if the city of the involved police officer due to them not giving us any information.

Any advice on how to handle this?

    Edit: location is Texas

I’m afraid my stepdad will kill my mother

    Posted: 22 Dec 2018 03:44 AM PST

Well, how do I even start...

My mom met this man few years ago, now they live together (i also live w/ them) and everyday they have really bad fights.

He has a criminal past, was in jail already (I don't know the reason, but has something to do with theft), he's an awful person. Once (as far as I know) he hit her, she got lots of purple bruises. And every fight he says he's gonna kill her... and he has nothing to lose (no own house, no family, no job, no car)

I don't know what to do, I can call police, but he has friends in there (One time neighbors called the cops, they showed up at the door to verify and they where all friends and left without checking up on my mom....) and I'm afraid my mom will turn up against me, since our relationship has lots of issues (I thought se was gonna kill me the other day for trying to leave home, i got a awful bruise on my arms)

Well, what can I do besides calling the cops?

Stepsister told me items willed to me were stolen, but they’re currently at an estate sale at my dead mother’s house (out of state) what can I do?

    Posted: 22 Dec 2018 02:40 AM PST

My mother died 2.5 years ago with a will that was notarized. She willed me real estate she wasn't legally able to will me (due to JTWROS on the house and my stepfather surviving her), but she also willed me several expensive pieces of jewelry, antique hutches and silver, and various paintings.

My stepfather in his grief told me to never speak to him again but that everything she gave me would be mine upon his death. He died three months ago.

My stepsister contacted me shortly after he died and told me all of the stuff my mother gave me had been stolen by my stepfather's new girlfriend. "She even took all the paintings off the walls, it's only dust and hooks now." She said.

Fast forward to today where I discover an online listing for an estate sale at my mother's house complete with pictures of everything (minus the jewelry) my stepsister claimed was stolen. All of my precious memories for sale.

Do I have any legal recourse? Should I contact the police? I fear I may even be in my stepfather's will but that she somehow said I died or forfeited any rights. I'm in WA state and he died in NV.

    Help me please. I'm devastated.

Neighbor steals box usps left on porch just to throw it out of his car window a few blocks away

    Posted: 22 Dec 2018 06:08 AM PST

A nice man saw him do it and returned my box of Christmas presents from Mom. it but the Yuba city Sheriff department said it was a misdemeanor and did nothing at all. Wont even give a report. How can it be ok to steal my whole X-mass box and not even keep the presents? He threw them out just to be evil. He has terrorized all year. Vandalized my Mini Cooper s beyond belief. Yet police do nothing. Apartment managers wont even make the guy follow rules let alone evict with more than 50 complaints. How is it that he is not arrested on felony charge?

Is there any law or rule for putting a different name than your legal name on mail?

    Posted: 22 Dec 2018 09:40 AM PST

My landlord has always been a fucking bitch and she always tries to make up shit to get us in trouble and she always ruins everything for us. I have recently been putting a different name than my legal name because I'm going to court to legally change it in the next few months. My landlord has been telling me and my mom that it's against the law to do this and I've tried to look things up on this but.... I can't find any law or rule on it. Many people say that it shouldn't matter if there's a different name on it, I've seen someone go by "Princess Sexy" on their mail and they've had no issues.

I'm not changing my name because I'm running from the law or anything of that sort, I'm changing my name because

    1. I don't like my first name.

2.Both my mother and I think it's a good decision to change my last name so it matches my dads last name because of reasons I'd rather not say here because it's personal to my mom.

BTW, I am 14 years old! Also, I live in Minnesota if that helps. Is there anything illegal that I'm doing here? Can I get into any major trouble for doing this? I've told my landlord that I'm legally changing my name in the new year but she still says that I cannot put my new name on my mail.

(sorry for formatting issues, on mobile and in a hurry.)

    Skis meet concrete

    Posted: 22 Dec 2018 07:18 AM PST

Hello all. So my girlfriend and I bought new skis for the season and are on our way up to Breckinridge to get in our first ski trip. We are riding a shuttle up and about thirty minutes ago both of our skis went flying off the roof. They haven't been completely destroyed but a brief inspection showed significant damage. The driver offered to fix at the ski lodge but they would only be able to do minor repairs like waxing and such. There's also pretty heavy damage to the bindings which cannot be repaired. I don't want to accept this offer since it won't really fix the damage and I'm not sure if it would prevent me from getting some sort of coverage down the line. I also have pictures of the skis from the websites showing what they looked like before the accident. We payed about $1000 for the two sets of skis. I really don't want to spend our first ski trip the weekend before Christmas getting our skis haphazardly repaired and then only have a short period of time to ski. Please help.

    Edit- Location: Breckinridge, CO

Update: Got to the chalet and the skis are not usable in their current state. Bindings broken on one set and the other has been pretty badly damaged. Going to rent skis and save receipt.

ATT just dug up our back yard

    Posted: 22 Dec 2018 10:17 AM PST

They came in to fix a line for other people in our neighborhood. When they "refilled" the hole, it is now a huge mound. They did not bury a line. Just shittily hung it over our fence. They also installed the skinny plastic post. Where can I find out if they have the authority to do this? We don't have any ATT services.

HOA Law and Cigarette Smoking - Georgia

    Posted: 22 Dec 2018 05:58 AM PST

Good morning! I live in a small condo building, less than 20 units. A resident just sent a cease and desist letter to the HOA board demanding that all residents stop smoking in the common space located outside of their unit. I am part of the HOA board.

For some background, before I moved here several years ago, there was a vote taken regarding smoking on the property. The residents agreed that smoking out front of the building and in the parking lot would result in making all residents have to walk through the smoke (and could lower resale value), so they all agreed that smoking should be limited to the common area in the back. This was voted on, but was not documented in the CCRs. However, everyone voluntarily smokes in the back common area. The back common area is covered but not enclosed, so the smoke filters outside and isn't trapped in the common area. There are 3 units that have doors that open to the back common area, including mine and the resident that sent the cease and desist.

The resident that send the C&D was told before they bought they unit where they smoking area was. They have not spoken to any of the neighbors asking them not to smoke and hasn't attended any HOA meetings. Because they have never attended the meetings, they haven't asked for a vote to change the smoking rule, which would be much more welcome than a C&D or lawsuit.

So my question is, what is the next appropriate legal step for the HOA board? I assume we have to notify all residents of the cease and desist. The C&D cited part of the CCRs which states, "Noxious, destructive or offensive activity shall not be carried on within the condominium." My researching of case law has shown that smoking hasn't been banned in HOAs on this type of ground, but we want everything to be on the up and up. How do we handle this?

Edit: Is is appropriate to notify all residents, including the sender, of the cease and desist and to let them all know that the condo building will jointly have to hire a lawyer to reply? Does the sender of the C&D also have to pay into the cost for the HOA's lawyer?

Can I still get a restraining order during a government shutdown?

    Posted: 22 Dec 2018 05:07 AM PST

    I am in Califronia***

My ex boyfriend will not stop contacting me after I have repeatedly asked him to stop since we broke up— 3 years ago! I know I probably should have done this sooner but I was honestly just scared and didn't know how to go about it. But now I am more fearful for my life! I have him blocked on every social media platform, my email, linked in, etc. but just realized I failed to block him on a Facebook Public Figure page designated for my Youtube channel.

We broke up because he peed on my things and bleached my clothes. He's also broken laptops and cameras etc. This was all years ago so I have no proof of it, but he openly talks about it in his messages.

Since I do make Youtube videos, I made a video explaining what he did to me — replacing his name and everything. I have not once revealed his name and have the right to tell stories on my Youtube channel.

This has obviously upset him and for the past few months it's been nonstop. I know I can get a restraining order now and plan on doing so, BUT will I be able to during this government shutdown??? Anything will help. Thank you!

I get $966 from my dads SSDI every month, but my mother has kicked me out and won’t let me recieve any of the money. What are my options?

    Posted: 22 Dec 2018 12:02 PM PST

I'm currently in a homeless shelter 40 minutes from my previous home. I go to court on January 2nd to figure out what to do about my situation (I have a protective order against my brother, my mom wouldn't make him leave even though he's 25, so I had to leave). I've tried to talk to my mom about how to receive my money and she refuses to give me any of it. So I was wondering what my options are with this, so I can bring them up to my CPS worker or at least ask about them in court on the 2nd. Ive been thinking about emancipation but I'm about 3 months from turning 18, I feel like it would be pointless to do that because the process would take a while. Please help, and I apologize if this is a mess. I'm really scrambled right now. I'm in West Virginia, by the way

Can landlord prevent tenants from having alcohol on the premise in California?

    Posted: 22 Dec 2018 10:06 AM PST

    State: California City: Los Angeles

My question is regards to an individual lease for a bedroom in an apartment. The apartment is leased by bedrooms and we all share a common space. Attached to the lease, we were given a document called "House Rules". Coming from NY, I have never seen house rules as part of a lease, but that's besides the point.

One of the house rules states the following:

"Any resident who drinks excessively, uses premises for illegal activity or commits a nuisance will be subject to eviction."

The landlord came into the apartment last night in order to show a prospective tenant a vacant bedroom and stumbled upon two bottles of alcohol. The landlord then took pictures of the bottles and attached it to an email that stated this:

"Attached 2 pictures I got from last night, as you know, we asked all of you : alcohol, smoking and parties can not be held inside the apartment and this is your final warning."

Now from my interpretation, I don't believe the house rules has anything to do with having alcohol, but instead using it in a disruptive manner. Now my housemates and I believe the landlord is overstepping the boundaries of the lease by preventing the consumption or having alcohol on the premise when the "House Rules" that were attached to the lease do not mention that.

Am I viewing this incorrectly and is the landlord able to prevent the consumption/having alcohol based on what I signed?

CA - Arrest for noise complaint, but no noise?

    Posted: 22 Dec 2018 12:16 PM PST

Location - Los Angeles County, CA

My fiance and I live in a condo on the second floor of a two story building. Our downstairs neighbors are an older couple. One night a few months ago, they called the police on us saying we were making an unreasonable amount of noise late at night. I was asleep, my fiance was listening to music with headphones while studying. There was no noise. The neighbors never came up and confronted us about any of this, our first contact was with the officer who was called out. The officer came up once and let my fiance know of the complaint and said if he came back, he'd have to wite a ticket. About an hour later, he's back. The downstairs neighbors have now requested a private person's arrest be carried out. My fiance is placed under "Private Person's Arrest" and given a ticket stating regarding the noise complaint marked as a misdemeanor. The officer informed my fiance that he didn't hear any noise from the street, courtyard, or our front door and would testify to that. My fiance went to the court date on the ticket and nothing had been filed in regards to the incident or ticket. He got documentation that he showed up and we hoped it was done with. Fastroward to today, we get a letter in the mail stating he has to show up in March regarding it.

Some important info: -There was another neighbor up at the time, he also let us known he heard no noise. - This neighbor had been know to complain about nosie even when we're not home. - The previous owners of the condo (my finances sister and her husband) also had issues with this neighbor complaining constantly. - We gathered some letters from other neighbors, including the HOA president (who lived across the hall from us for a while), stating we are not noisy and have actually added items to our condo to prevent noise.

Additional questions aside from the general advice request: - We were told that the burden of proof is on us, why are we guilty until we prove innocent? - My fiance is thinking about perusing false arrest charges, is this feasible?

Can xMIL be held in contempt on xDHs court order? FL

    Posted: 22 Dec 2018 09:37 AM PST

Myexhusband has broken basically every aspect of our divorce agreement, so we have a hearing for his contempt of court coming up. Last night he left my kids with his mother overnight (contempt) and told me I cannot contact them at all(contempt). I contacted his mother to talk to the kids on the phone, as is my right, and she ignored me. She has seen the divorce agreement/court order and I informed her that keeping the kids from me was contempt of court.

Am I able to file a motion of contempt against her? She knew she was breaking a court order on behalf of her son and she did it anyway. But the court order is between he and I, so I don't know how that works.

My lawyer is out of the office for holidays. I do have a great lawyer. I would probably file it pro se to begin with, however. I will certainly call him later but I'm trying to get an idea now of what I can do.

Neighbors built a fence over my property line in FL

    Posted: 22 Dec 2018 01:22 PM PST

I just got home from work and a fence has suddenly appeared not only in my neighbor's yard, but crossing my property line by 4-5 feet. It's roughly 25-30 feet long (assuming I'm good at eyeballing distance). The residents of the property are renters, so I'm certain it would have been the landlord's doing. The "flat side" is also facing the interior of their yard as opposed to the exterior (mine) - I'm not sure if there's codes about that but I've never seen a fence built that way. I'm not too personally bothered by this, it's less yard for me to mow, but I'm not interested in lowering my property value or having them legally claim some portion of my yard as theirs. I can't imagine this not becoming an issue if I sell my home or want to build my own fence. Any thoughts or ideas about how I should handle this? Time frames to be concerned about? I spoke to the contractor and got their information. I didn't lead on to being concerned, I just played it like I might be interested in them. Like I said, I'm not personally bothered by it, but if it's lowering my property value or I'm forfeiting land then I'm going to want to handle it (as late as possible frankly, I've got other things to do with my time).

Employees not taking lunch breaks. IN

    Posted: 22 Dec 2018 07:55 AM PST

    Indiana because the bot...

We tell our employees they need to take a 30 minute break daily for lunch. They're working unsupervised at remote job sites driving company vehicles. I'm also doing the same all day and can't babysit them. When they fail to take a lunch break it does not inconvenience me, but I want to avoid any compliance situation.

We discussed writing them up each pay day, but this would strongly counter our company morale efforts. We also thought about simply adding a reminder to take lunch on each stub. We also discussed having a missed lunch form where on pay day they have to fill in why they didn't take lunch for each date and sign.

Bottom line, they're grown ups, I'm not their mom, I'm also not denying them their lunch breaks. I want to know the least impactful thing I can do to make sure I'm not held responsible if it were looked into for any reason.

What are the exceptions to confidentiality with a therapist?

    Posted: 22 Dec 2018 11:53 AM PST

Edit: I am in the United States of America. Not sure how I am supposed to format location.

I heard that admitting to having pedophilia is required to be reported by the therapist, but are there any other similar exceptions to things being confidential?

Specifically, if I were to tell therapist about inappropriate sexual feelings about animals, would that be entirely confidential? Is it still confidential if I also talk about past actions relating to it?

Obviously I want to get help for this, but I don't particularly want to be labeled as a sex offender for the rest of my life.

    This is in the U.S.

Sorry for using a throwaway, but I don't particularly want this on my main account.

Fired real estate agent wants a conference call-Now what? PA

    Posted: 22 Dec 2018 07:38 AM PST

PA resident here. We cancelled a buyer's agreement contract with a realtor 9/30/16. Before cancelling the arrangement, we spoke with a realtor relative that said cancellations happen all of the time and there's no need to worry - just to request the cancellation form. On 2/21/17, we signed an agreement to buy new construction with another agent. Original realtor did meet us and the builder at this development in late August 2016, but we weren't financially or logistically ready to buy. This week, we received an email from the original agent that she and her manager want a 10 minute phone call with us regarding the buyers agreement. I'm concerned that they're trying to have us compensate original agent since she was with us for one meeting at the new home location.
Do we do this call? Do we need an attorney? Do they even have any recourse when it's been over 2 years?

Airline messed up my visa on their system and I ended up stranded in a foreign airport

    Posted: 22 Dec 2018 12:49 AM PST

Not sure if this is the right flair so I'm sorry in advance.

I was travelling from the United States to the United Arab Emirates. I had to stop at Munich (Germany) before my final flight to the United Arab Emirates. I was taking Etihad Airways which is a United Arab Emirates airline. For some reason their system refused to recognize my visa which is 100% valid. This is the third time this issue happened to me and my family over the past year and it is ALWAYS Etihad Airways. One of my family members even had to pay their own replacement ticket despite Etihad being at fault. The staff members, managers, and everyone at the airport admitted that this was an issue on Etihad's system and had nothing to do with my visa being invalid or otherwise. I reached out to them and filed a complaint. After being transferred from department to department they finally "compensated" me with $150 in Etihad points that I can use on their flights. Not to mention, they insisted that they already compensated me in the airport by giving me meal vouchers (never happened). This is a flight that cost me approximately $2,500. I have limited vacation days and I lost 2 full days with my family due to their failure. Their compensation is nowhere near what I think is appropriate simply because this has happened 3 times before. This tells me that they simply refuse to fix whatever error they have. I'm not sure if I have a case here and I'm not even sure if I'm able to file a complaint on an airline based in the United Arab Emirates (I live in the United States). Is there anything I can do here?

[Washington State] Landlord didn't deposit rent check, was served with "3 day pay rent or vacate" notice.

    Posted: 22 Dec 2018 11:01 AM PST

Disclosure: I have a lawyer and I am awaiting a conversation with him later today. In the interim, I am trying to do as much research as I can so I can understand the issues at play.

    Background:

    - I am 18 months into a 2 year lease. At start of lease, landlord requested I pay with post-dated checks delivered in 6-month increments.

    - In December of 2017, the septic system started backing up into yard. System was original from 1960 and determined to need replacement.

    - We have completely lost use of the back yard since May, but have continued to pay rent in full through the duration.

    - In June, our 6 month bank of checks had exhausted, meaning we owed a new batch starting July 1. We were notified of this by the landlord, but were travelling on vacation. I offered to send a money transfer for July, and deliver the remaining 5 checks when we returned. However, he said not to worry about it, and that I could deliver all 6 checks when I returned. (I have text messages that show this.)

    - On July 4th, I met him at his house and hand-delivered 6 checks, for July through December. (I have copies of each of these checks.) He deposited the July check on July 5, and every subsequent check on the 1st of the respective month.

    - In September, he told me he wanted to sell the house to fund a project, and offered to sell it to me off-market. Given the state of the septic system, I declined the offer. From that point on, the dynamic of our relationship changed. He went from being a nice guy that I had a good relationship with, to what can only be be described as hostile.

    - My wife and I are were no longer comfortable living in the house in its current state, given his change in demeanor. I retained a lawyer to handle communications with him in an effort to get out of the lease.

    - Yesterday at 7pm my wife and I were served with a 3 day pay rent or vacate notice. The notice claims that we did not pay December rent. (However, I have the ledger showing the December check in the block of 6 sequential checks.) It is my belief that the landlord intentionally did not cash the check in order to build an eviction case against us so that he can force us out in order to sell the property. Further, I believe he served us just prior to Christmas in order to inflict maximum stress.

    - Most troubling: he has provided a ledger documenting a late fee that he is retroactively applying to July's payment, and it appears he has rolled this over to every subsequent month, causing a cascade effect, whereby every month's rent was only "partially paid", and compounding a $50 late fee per day. He is now demanding more that $18,000(!) in fees to be paid in three days.

    Here is my question:

    - For argument's sake, let's assume I am liable for a late fee from July. Does the landlord have a duty to inform me of this assessed late fee and make a demand for said fee in a timely manner? If not, it seems like a situation ripe for abuse (as evidenced above.) Until yesterday, at no point were we ever notified of a late fee, or the resulting impartial rent payments.

Thanks for your insight. As you can imagine, this is causing a considerable amount of stress to us around the holidays.
