I work a landscaping design job in Florida. We're paid with a handwritten check and under-the-table. I got a long splinter under my fingernail all the way to the end of the nail bed while pulling weeds on the job. It was only my 5th shift (although second week) working there. I ended up having to go to the ER to get it surgically removed, lots of fun getting multiple shots in my finger.

I'm given a "workers compensation verification form" to bring to my employer. I was supposed to work the next morning, so I went ahead and contacted her, telling her I'd bring the form. She starts telling me that I never signed a W9 so I'm not actually an employee and she's not actually liable. I've already been paid by her once. She goes on to say I never told her and that I'm just making accusations, even though I had told her about it the morning after it occurred, and she had acknowledged it multiple times throughout the day.

After searching a few state databases, the only business license she has under her name is one for real estate, and no record of workers comp coverage. Looking back on it, I think the hospital staff discovered this as well but were going to let me figure that out.

Is there anything I can do about this, or am I just stuck with the bill?

[UPDATE] Does a child who didn't see one parent because the other parent stole them despite custody orders in place have to repay that time debt after age 18? Oregon

    Posted: 27 Oct 2018 02:12 PM PDT

Previous post a month ago over here.

    I'm safe, and I'm out.

I organised a place to stay with a coworker. I have new bank accounts and all my paperwork. My dad has some regular sport meetings on Saturdays that go for hours so I prepared everything the week before, found where my paperwork was and walked out. I've been approved for a rental and I move there soon.

I contacted two police stations near us beforehand who both understood dad's nature straight away when I told them he'd been telling me I couldn't move out because of a time debt and they told me it wasn't a thing.

I took copies of all of his paperwork too because while I was getting ready to move I found most of what I knew about my parents separating was a lie. There was never a 50/50 custody agreement and my mother never ran off with me in violation to that. My dad had been held for several domestic violence incidents when I was a child and he was only to see me on special holidays and only under strict supervision. He's never been violent to me, but in the papers he had hidden was evidence of a trust available to me when I'm 21. Some of the specific wording is it can go to me as an individual or to my carer if that is required. I think my dad was trying to make himself up as my carer without me knowing. I did not find the letter I read when I was a kid from dad's lawyer but like you all said that was probably fake.

After I moved out my dad did try to contact the police. They came to my coworker's address because they had to, but also let me know that yes my dad was trying to say I couldn't look after myself. His words were that I was "borderline retarded and being abused".

I've been back to Canada to visit my aunts and uncle, and found the aunt who was named to manage my trust died very soon after my mother. We're still working out the details with a Canadian lawyer about some confusion over who handles what and how now but I have the full support of my remaining aunt and uncle who are the same great people I remember. They were really worried about me when I went to live with dad and had tried to contact me so many times.

Thanks for all your help, your comments gave me the confidence to act.

    Landlord requesting guests sign in

    Posted: 28 Oct 2018 08:14 AM PDT

I live in Massachusetts. My landlord recently sent out a mass email (I live in a huge complex) explaining that guests will, from now, be required to sign in and present their ID when entering the building with me. They also intend to have a hard cap on the number of guests I can bring into my apartment. They went as far as to try to scare us with "security patrols" and police checkups.

There is nothing about this in my lease. Am I actually required to comply with this out of left field request three months into my lease? Thanks everyone!

My aunt is in the process of leaving her extremely abusive husband. Boost Mobile just gave him full access to her account (NJ)

    Posted: 28 Oct 2018 08:57 AM PDT

    Location: New Jersey

    Throwaway for obvious reasons.

My aunt has been in the process of leaving her husband for several months now. He's physically abusive, an alcoholic, and has had his firearms seized by police on at least one occasion due to making violent threats. There are a number of factors complicating her situation; they have two kids together, plus she's unemployed, has a severe anxiety disorder, did not attend high school, and can't drive. They aren't officially divorced, but he's not living with her anymore. She recently began seeing another person, and her husband has been harassing her relentlessly as a result.

The phone that she was using was under her husband's name, so she bought a second phone and phone plan from Boost Mobile. Her husband somehow found out, went into the store, and convinced an employee to give him access to her account. He used this information to call every single number she'd been in contact with, and now knows everyone she's been talking to.

The first step seems pretty obvious: file a police report regarding the husband's behavior. My question is more about Boost Mobile's actions. Was what they did... well... legal? The employee who gave him access has since been fired, but this kind of screw up can get people killed. My aunt is extremely upset, and we're not sure where (if anywhere) to go from here.

My uncle is playing legal games to buy my dad out of my grandfather’s will. Any advice? (AZ)

    Posted: 28 Oct 2018 06:03 AM PDT

My uncle (I'll call him S) was my grandfather's power of attorney (maybe? He was allowed to file legal claims on the house and my grandfather's health, but my dad and other uncle needed to sign in agreement) before he passed away last December. This is when it started.

In short: My grandfather lived in a run-down Mobile home. S was reaching out to my grandfather's homeowner's insurance to pay for significant repairs on the home. My dad received a call from the bank asking for confirmation that he endorsed a check. He hadn't. It turns out my uncle received two checks from the homeowner's insurance: one for $7,000 and one for $14,000. My dad and my other uncle (I'll call him J) didn't know about these checks and their signatures were forged on them. No charges were filed.

According to my dad, there were never workers at my grandfather's house. My uncle would be over there fixing the floors and roof himself. Currently, he's refusing to show my dad and J the paperwork proving that a contractor fixed the house.

When my grandfather passed, S spent all his time at the house. My dad and J have no idea what was fixed or upgraded. They just know S claims he spent a certain large amount of money fixing up the place.

In my grandfather's will, the house is to be sold and the profits split between S, my dad, and J, S put the house on the market without consulting with my dad and J. Dad found out and called the realtor, advising that only one of the three owners has agreed to sell the house and the agent took it off the market. I should note this is after S offered my dad $15,000 and J $10,000 to buy them out of the will. When they declined, things got worse.

Dad and J agreed that S deserves more than 1/3 of the house since he fixed the place up. They agreed that they'll give him back any money he spent on the house as long as he provides proof of the money he spent, which he won't do. He can't prove the insurance money was spent on contractors (because it likely wasn't) and he is refusing to provide any other paperwork. My dad has been running to courts and taking legal paths to get copies of the will, copies of my grandfather's final expenses, and he learned that the house and my grandfather's bank accounts are still under the names of both grandparents. (Grandma passed around 2010.) He also learned that there has been suspicious money movement into and out of the accounts. Withdrawals and deposits in cash about twice a month, like there was some form of money laundering or other money floating happening. (I used to work in this division in a bank and agreed the activity was suspicious.)

Now, a year later, my dad is paying taxes on the house. Dad and J are trying to get all the paperwork but J is in some legal trouble (alcoholic) and can only do some things on borrowed time. While dad was waiting for J to notarize an affidavit agreeing to waive certain rights regarding his consent on the house (he lives across the country and trusts my dad to do the right thing), they both received a summons.

S is trying to get the house on the market and sold to allow the court to hang onto this money until the issue is settled.

It sounds like a great idea, but it's not. S is "missing" court dates and other appointments. This forces my dad to reschedule and pay for a layer's retainer longer. Dad doesn't have. Retirement account and doesn't make much. The $1,000 biweekly is draining him quickly and he might have to give in just so he doesn't go broke. S owned his own business and has more than enough money to spare.

The problem is that S is doing illegal things to get more out of my grandfather's will and I want him to pay for it. Forging signatures, lying to the insurance company, potential money laundering. I don't know how to help my dad from here, but I want to be able to. He just wants the will to be honored and honest.

    Neighbor Salting the Earth

    Posted: 28 Oct 2018 12:57 PM PDT

Our Neighbor dislikes a tree on our property and claims it has caused damage to her sewer and water pipes. She has decided to dig a trench along our property line and fill it with salt. We asked her not to proceed with this plan and instead we would work to install a physical root barrier along the property line. Last night I discovered she has moved forward with her plan to burry salt.

We are concerned that this is going to injure / kill / damage our tree and landscaping. I don't even know where to start with solving this problem. Honestly who salts the earth??? Looking for advice on ways to solve this. Hopefully without our tree dying.

FL- I have a recording of a conversation with my property manager..

    Posted: 28 Oct 2018 08:18 AM PDT

So my property manager and i were coming to an agreement because I've been going through a rough patch and due to a family emergency had to leave the state and was not able to cover rent for October. The recording is basically him saying "that you are releasing the apartment today with condition that i spoke to Mr. X, thats me, that he will not evict you as long as you make the partial payment on November 2nd and this way we wont be able to take your stuff out and we can remove the note on the door that says eviction 3 days notice that way i can tell the owner to stop it".

So today october 28 get a call from him saying they threw out all of my belongings. Literally everything is just gone. Is there anything i can legally do about this??

My dog is being held hostage from me?

    Posted: 28 Oct 2018 10:39 AM PDT

I live in the California, seeking advice. Basically about 3 months ago I was living with family friends, I had a small dog with me whom I raised and cared for and was very attached. The family friends told me I couldn't keep my dog in their home anymore and that I needed to get rid of him, I didn't want to do that so I had posted on my Snapchat if someone would be willing to take my dog in until I could get into a stable home. A boy I knew offered to take my dog in and whenever I was ready I could take him back. Fast forward to today and I've recently moved into my grandmothers and when I asked the boy if I could have my dog back he refused. I've asked multiple times, I've run out of options. What should I do now? That's my baby and I really want him back but I can't just go into their home and take him, should I call the cops? If I do how will they help? Will they even do anything if they think im wasting their time? If anyone has any advice please tell me. I miss my dog so much and its breaking my heart the longer were apart. I just want him to come home to me. I have proof he was my dog such as his medical records and his name was under my grandmothers name in the vets system. As well as multiple pictures of him as a baby.

My manager is saying that they are going to take money out of all managers checks because someone is stealing from the store.

    Posted: 28 Oct 2018 09:14 AM PDT

So I work for a popular fast food chain and we are pretty much busy 24/7. Recently the registers have been short 50-70 dollars for the past week or so. Since we cant find out who is doing it my manager said they'll have to take money out of all of the managers checks to make up for the money that was short. Im pretty sure that is illegal, but i want to make sure.

US- I am an American and I want to sell my property to an American citizen living in the States. My question (primarily his) is, is there any way that he can get protected through the courts in America if something goes wrong with the sale of that property or would the Mexican courts be responsible for that if something goes wrong?

[USA-CA] Drunk driver hit my parked car last night.

    Posted: 28 Oct 2018 10:16 AM PDT

My neighbor had two people (guy and girl) over yesterday. They were drinking all day and getting in to fights. I called the landlord to complain about the noise. He took care of it and they dispersed for sometime. They came back again and continued drinking and fighting.

The girl got into her car to go buy cigarettes. She came back and drove through a fence, ran over her boyfriend, and crashed into my parked car. I was in bed when all this happened.

My dad tells me I should get a lawyer and sue the driver, but I don't know what to do. I've never been in an accident before or had anything like this happen.

[USA-FL] My boss has a weird BDSM obsession, also my boyfriend might have made it worse with potential blackmail?

    Posted: 27 Oct 2018 07:31 PM PDT

Okay, so I work at a very small company Boss(owner), Clerical/Receptionist(me), "Warehouse"(two employees that are not involved at all). I work in an extremely niche "industry" getting LTLs(Little tiny loads) onto trucks with spare room and time heading in the same direction that the LTL needs to go. I am 24F and my boss is 56M.

I started working here two months ago because the pay was very decent with little to no experience needed ($14/h and 55 hours a week). I did 2 interviews then started. It all was pretty good, it's kind of slow work with a decent amount of downtime but it pays so well and I get paid about 1/3 of the time to be surfing the net or playing games on my switch so I can't really complain. It's pretty much just me and the boss all day and until recently he just sat in his office by himself watching Netflix/Amazon in the downtime and we didn't speak much besides work when we had to.

That all changed a week ago when he started talking and talking and talking throughout the entire day, it didn't really bother me and I figured it just took him a while to get comfortable with me. I learned about his life, family and he learned a bit about mine but he kept steering it towards my boyfriend, sex life, and really focuses on fetishes. I told him several times that's not appropriate and he dropped it for at least an hour before brining it up again focusing pretty heavily on BDSM. I'm not a stranger to kinks but I'm not going down that road discussing it with my boss, whom I spend almost 60 hours a week with entirely alone with the rare in office visitors (a person comes by maybe once a week for 15-30 minutes).

It got to the point 3 days ago I finally told my boyfriend and I was trying to not tell him because he would of course be upset and probably want to speak to my boss. He's not the super jealous type or the macho man go hit him type but with how far my boss was taking it he probably would. The day I finally told my boyfriend what my boss was doing is when I left work early because my boss sat me down with his laptop and starting playing the movie "The Secretary", I've seen this movie before and if you haven't it's a BDSM movie where a boss makes his secretary his slave. (NSFW obviously, don't Google it if you can get in trouble). While he sat there expecting me to watch this movie he showed me his briefcase that had handcuffs, a crop, rope etc in it like he fully expected me to be his sexual slave after watching the movie. I noped out of there and called my boyfriend as I was leaving, he left work early also and then went to my work to pickup the things I left on my desk because I was not going back.

My boyfriend assured me he wasn't going to hit him or do anything stupid except get my stuff and tell him I quit. Fast forward to today and I got an email from my boss telling me I have been given a raise, $24/h and I can work from home just putting the info from the emails into the Google doc spreadsheet like before.... Obviously I'm thinking wtf why did he just give me a 100% raise and I can work from home? I just had an interview scheduled through a friend for Monday.

I talked to my boyfriend after he got home from work and asked him wth happened at my job when he went to get my stuff and quit for me. Turns out my boyfriend in his infinite wisdom told this old pervert if he didn't pay me a severance he was going to tell his wife what he tried to do... I wasn't expecting a severance because I barely worked there and just wanted my last check. I guess the old guy took it a bit further and doubled my pay and let me work from home to keep his crazy movie fantasy a secret??

Where do I even begin here to fix all this crap? I don't want to work for this guy but I don't know the legalities of what my boyfriend may have inadvertently just did.

Landlord told me I have to move out by the end of this week. (Tx)

    Posted: 28 Oct 2018 11:04 AM PDT

I have been having serious issues with the family who's spare house my boyfriend and I rent. We used to be very close, and I worked for them for a number of years. However, in recent months I have realized that they are shady, unethical business owners and just all around terrible people, so I decided to cut ties. I quit working for them and got two (awesome) new jobs. I mind my business, we keep our part of the property clean and maintained, and we always pay rent on time. However, the landlord recently came to my new workplace, and basically slandered me to my co-workers. I sent her a message asking her to refrain from doing that, and said to expect the rent in her mailbox the morning of Nov. 1. She waited a full day to reply and then said she expects me, my boyfriend, and all of our pets off the property by the end of this week. Her exact words were "The lease is not executed and is therefore invalid, and that we have been staying on the property as guests." I really don't know what this means. For advice - we have a signed copy of the lease agreement, and I plan on going by the local courthouse for advice in the morning. Is what she is doing legal? Is there any legal precedent that would make my lease void, in such a way that I'm evicted with one week's notice? I have no proof of paying rent, because she was also my employer and held it from my checks, which I never received stubs for, but if we are staying as guests, would I be entitled to the rent I've already paid?

I'm really scared, I don't know what to do, any advice helps.

Fired from babysitting job, worried about getting sued?

    Posted: 27 Oct 2018 08:39 PM PDT

Ok so I work (worked?) for this lady who lives near my high school, babysitting her kid from 2:30-9:30 because she works late at a hospital. Well since I'm there late with her daughter I help her with her homework, heat up some dinner, put on a Netflix show for her/ let her watch YouTube afterward(if she's allowed to that day, it alternates). I usually do homework when she's off doing something by herself.

Here comes the issue: The other day I was doing Spanish homework. The daughter was being a bit restless so I'd figure I'd have some fun and teach her a little Spanish. No harm done here right???? Wrong. I guess the daughter showed off her newfound ability to say caballo and peces to her mom. Her mom then proceeded to yell at me (not in front of the girl) yesterday for teaching her "these things". She told me: 1. I was fired 2. She was going to tell my school that I "did this" (?) 3. And she'll see me soon in court (??) because she's going to sue me (????)

Ok so, first things first, I haven't said anything to my parents yet because I think they still might be pissed about me popping a car tire earlier this week. But WTF did I do wrong here? Did she think I was trying to ruin her kid?

I'm most terrified about what she's going to tell the school. She could make something up and it could really screw me up for college. What can I possibly do in this situation? (I'm 18 btw)

And can she actually sue me? Doesn't she need a reason? Could she make something up and god forbid bankrupt my family in court?? This woman is both insane and wealthy. She used to pay me way above minimum wage and has a real nice house, so she must be making a lot.

I do not have a way to access my original social security card, and I have no idea how to get a new one.

    Posted: 28 Oct 2018 11:04 AM PDT

I'm 18, from Indiana. My mother has always had my social security card locked up in boxes at her house. When I was 17, she got arrested, and she spent 10 months in jail and is now in a state hospital. She won't let anybody have her keys and she will probably be in there for a long time. I need to get a new card because I need to be able to get my license, open a bank account, etc, like a normal person, but you can't do that without a photo ID. It's a stupid situation because I also need a social security card to get any form of photo ID. I need each to get the other and I have no idea where to start. Google says they don't make any exceptions for "excuses" so I doubt they'll work with me on this. What are my options?

Lease has miscalculated info - Landlord could try to take security deposit?

    Posted: 28 Oct 2018 08:07 AM PDT

I am renting a studio apartment in Rhode Island. I am coming to the end of my initial lease term and am planning to move away. I was reviewing the lease recently and discovered that something wasn't right. I think - can someone confirm - that the total amount indicated in the document is wrong, and $925 short of what it should be. That total does not include security deposit.

I find it easier to look at the lease itself rather than explain it.

Here is the portion of the lease I am talking about:

    https://imgur.com/a/QCVsk8J

What I am thinking: I am not responsible for paying the last month of rent AND they will need to refund my security deposit as agreed to in the security deposit form.

Do I have a responsibility to pay the $925 for the month of December?

If I don't, can they keep my security deposit?

    Marijuana On Federal Grounds

    Posted: 28 Oct 2018 11:07 AM PDT

I wont get too far into the details, but I was driving back from Colorado and I noticed my girlfriend left a bag in my car, I didn't think twice about it, because I was going back to Sheppard AFB (Texas), and I knew I was only going to be there for a few weeks, while attending a class, and then I would go back to Colorado whenever I was finished. I took the bags out of my vehicle and placed them in my room, and the next day I went to class as normal. I was then pulled out of class, to be told that Marijuana edibles (gummies) were found in my room, and that I was going to be questioned by OSI about them, OSI questioned me for days about them, drug tested me and confirmed with the girlfriend that they were indeed hers. I was still, however arrested with felony possession with attempt to distribute, a felony charge.

So my question to everyone is, with a passing drug test, offer to do a polygraph and the ever changing and passive marijuana laws, what do you believe my options are? Are they fact that they were gummies a valid reason for not noticing them? Does the clean drug test serve as evidence that I was indeed using them?

Any thoughts are welcomed on this subject.

I also forgot to mention that this my first offense, I am 31 years old and have never been in trouble with the law before and a 14 year veteran.

Can anyone find examples of such a crime that were thrown out or removed, so that they can be cited?

edit: I have a JAG officer, but im considering also hiring a law firm to represent me, and increasing my chances of success. They believe the case maybe dismissed due to an illegal search, but were not for certain yet, and they aren't going to mess with me until I pay their 3k retaining fee.

Refused service due to service animal

    Posted: 28 Oct 2018 11:37 AM PDT

    Locaiton: Washington.

Good morning. This happened to someone I know, not me.

Last week someone I know with a service animal went in to a locally owned pizza shop with his wife and service animal.

The owner of the shop told him no animals allowed in.

He explained it was a service animal.

She asked the two legal questions, and he answered.

She told him to sit outside and it would work.

He said it was too cold, and refused.

She still sold him the pizza, but made it to go, and insisted he leave.

He said he was going to call the police if he wasn't allowed to sit inside, and file a complaint with the Department of Justice.

She again asked him to leave, and stop making a scene.

He continued insisting he be allowed to stay and eat, for about 90 seconds (this was all videoed by him, assumably since she asked about the animal until he left.).

He eventually did leave, after his wife kept asking him to let it go, and told him she felt a panic attack coming on.

This was shared on social media, and people are buzzing about it. As a blind man, I have a question.

Obviously she violated the ADA be refusing to allow his service animal inside, but once she did violate it, was he violating any "trespassing" laws by not leaving? It's my understanding that even if for an illegal reason, a store owner has the right to refuse service to anyone, for any reason. There will be consequences for doing so, but she wouldn't be forced to allow him in.

    Who's right?

Could she be forced to allow him in and to eat? Some people went as far as to say the police would force her to.

Or, would she be slapped with a heavy fine for the discrimination, but not forced to allow him in? But of course be slapped with repeated fines every time she refused service to someone with a service animal?

Also, is turning a dining in order to a to go order considered reasonable accommodation if the owner has a reason for not allowing the animal inside, such as religion or allergies?

    Thank you.

Edit to ad: Before switching the order to a to go order, the owner offered use of the outdoor, heated and lit, patio.

Can life insurance money given to a minor be withheld ever after they turn 18?

    Posted: 28 Oct 2018 01:09 PM PDT

IOWA - My younger step-sister inherited half of a life insurance policy when her mother died when she was younger, and the other half was given to her sister. It is a significant sum, but due to some odd circumstances and because their parents were divorced at the time, the money was put into an account for each and has been managed by their paternal grandmother.

When the older sister turned 18 the grandmother stayed in "control" of the account and would give money to that sister when she needed it. My younger step-sister is treated very poorly by her family, especially the grandmother. She is 17 right now, but we have two concerns. The first is that her dad and the grandmother keep talking about how the younger sister "owes" the older one (not sure why) and that they are going to pay the older one back with the money in her account. Is this allowed? We are worried they are going to take money out of the account before she turns 18 and hide it.

The second concern is that the grandmother keeps talking about how even when my younger sister turns 18 she will not be allowed to access the money in the account, and that the grandmother will "keep control" of it. We have no trust in her as an account manager, and I know while my sister is a minor there are at least hoops grandma has to jump through to withdraw money. Those will go away when my sister turns 18.

TL;DR To sum up, my legal questions are 1. Can we do anything now or retroactively to make sure money was not withdrawn to "pay" the older sister back? and 2. Can the grandmother actually withhold my sister from taking control of the account when she turns 18?

Job lowered my pay without telling me

    Posted: 28 Oct 2018 11:32 AM PDT

I currently attend college and work a Student job for the University student center. I've been in my current position since 2015 and started making $9.75 an hr (it's a flat rate and not performance based- so no raises or reductions). However, I just looked at a pay stub and realize there's been a change and I've been making $9.25 since September 2017. I was never notified about the reduction. I do direct deposit so I don't normally look at my paychecks, and I work sporadic hours so it would've been hard to notice the change in my payment amounts. I checked with my coworkers and they still make the $9.75 that we were promised when getting the position.

If everyone received a reduction I wouldn't care as much but it's definitely not fair that I was the only one to receive the reduction, especially since Im the most tenured employee.

I obviously want my rate put back up to $9.75 and a full reimbursement for the months I worked making less than what was promised. Am I entitled to any of this? Does it matter that I caught it a year after it started? What should I do here?

    Fostering siblings

    Posted: 28 Oct 2018 09:18 AM PDT

Hello. I live in Illinois, but this question pertains to both IL and Tennessee. My mother passed away last year, and my stepdad is currently facing 4 charges which he is likely going to do jailtime over. (Leaving the scene, evading arrest, dui and child endangerment) I have two half siblings who live with him down in TN, and I am worried they will be taken from him and placed into foster care. We have no family down by them and no other family up here willing to take them in. What steps can I start taking immediately to try to become my siblings foster? I'm 26 years old, work part time, have a 2.5 yr old son and we live with my grandparents (dad's side, no relation to my half siblings.) Do I call social services in my state? In Tennessee? Would my stepdad have to agree to give me legal custody? Would this qualify as an emergency for Section 8 Housing so I could have my own home to provide for them? I'm so sorry but I'm terrified and have so many questions.
