At-fault driver refusing to give statement to her insurance company Posted: 03 Oct 2018 02:27 PM PDT Hello 6 months after having my beautiful Subaru totaled due to an uninsured, hit-and-run driver I find myself dealing with insurance again. Long story short, a lady was cutting across a bunch of lanes trying to make a U-Turn and hit the area by my passenger tire, causing a crease and dents. Not too bad. I took pictures, exchanged insurance, etc. One week later, her insurance still has not gotten in touch with her and they say they will deny my claim after another week if she does not contact them with her statement. Should I go ahead and file with my insurance and have them go to arbitration? Sue her for my deductible in small claims? I feel like I am getting screwed over. Where my car was damaged it's basically impossible for me to have hit her. If all she needs to do is keep quiet and the claim is gone, that seems kinda sketchy. [link] [comments] |

Posted: 03 Oct 2018 12:48 PM PDT We are looking into switching from my employer's insurance (plan year runs January through December) to my husband's (open enrollment is in February or March, so coverage likely starts a month after that). We have a small child and I don't want to go for 3+ months without health insurance coverage. What, if anything, can we do? Enroll in an ACA plan for a few months? Qualify for a special enrollment period with husband's insurance in January? We really need to switch due to medical needs, but I don't know what to do about the gap and would appreciate any help. Would insurance companies prefer their clients to live longer, healthier lives? Posted: 03 Oct 2018 08:13 PM PDT Let's say there are a new breed of medicinal products which help to lengthen a person's lifespan & healthspan. So a person who would get sick at 75 and die at 82 would now get sick at 90 and die at 92. I assume this would be in the insurance companies' interests since they collect more premiums while paying out less for the fewers years of medical costs. Am i right? Posted: 03 Oct 2018 07:50 PM PDT So to begin, my wife and I got married July 28th 2018. She was a long-term substitute teacher in NJ for a couple of years so it's been a temporary job so to speak. We get back from our honeymoon and she lands a job and started on Sept 3rd (or 4th, i forget). She was given health care paperwork to complete for her health care benefits through her school district but sat on it for a week and a half or so. I got on her case and she finally moved on it. She submitted it around Sept 15th. We get no communication from anyone and I finally asked her again on Oct 1st after work. I looked down at our mail and there it was, a letter from Cigna. It contained our health insurance cards and no other letter confirming anything else. Coverage effective date: 9/1/18 Fast forward to today, 10/3/18, I asked my HR manager to see if i can drop my healthcare. She mentioned that I can't until our open enrollment, which is in June. Then she corrected her self and said, "unless there are life changing events". She knew i got married and said "you have 30 days to change anything". Well, that was pointless because we got married in late July. So that's pointless now. I mentioned "I literally just got my insurance ID cards from my wife's Cigna plan on monday 10/1/18, tried to reach you on Tuesday but you were out. And here we are 10/3/18. She seemed unsure and said she would reach out to our health care representative. I've read that because my wife just got the job recently and was very recently enrolled in her healthcare (and enrolled me too) it also means we have a special enrollment period. For 30 days. (I think?) (we also have vision and dental under her name as well) I'm worried that it is 30 days from "effective coverage date of 9/1/18". When we submitted paperwork, it was around Sept 15th. Kicked off my parents insurance a few months before my 26th birthday Posted: 03 Oct 2018 02:02 PM PDT I went to the doctors today for a follow up visit and they informed me that my health insurance says inactive. Weird. I looked on the anthem app and it also says inactive. I call and they tell me it was terminated September 10. My 26th birthday isn't until January 27th. I asked my mom (I'm a dependent on my step dads insurance through his employer) and she said that since it was open enrollment at my step dads work they automatically kick dependents off the enrollment before they turn 26. From my understanding the insurance should have covered right until my birthday. Does this make sense? Could my mom be lying and they just chose to drop me without notifying me? I wouldn't put it past them. Another thing, for my work they said I could enroll within 30 days but they need a letter from my step dads work saying the date I was dropped. Not Sure If I'm Getting Good Service From My Insurance Company Posted: 03 Oct 2018 05:10 PM PDT Basic facts: I'm a homeowner whose single-family house was destroyed by fire in mid-May. Fire is thought to have started from an electrical short in the wall. It's a total loss including contents, open to the elements (roof caved in, no windows/back door) and was condemned immediately due the right half of the interior collapsing. I have homeowner's insurance with depreciated value replacement and a personal insurance adjuster. My questions: My insurance company still has not released the site to me so I can demo the house and prepare the land to rebuild. I'm in the Northeast, and bad weather is approaching. Is 4.5 months a normal amount of time for them to hold the site from demolition (once again, it's exposed to the elements, so I'm not sure what they hope to see if they go to the site now)? Or am I right in feeling like they should release it now? Also, if someone from the insurance company goes into the house and gets hurt, am I liable? The insurance company is currently paying the lease on the house I am living in out of my displaced living expenses. They have informed me that they will stop paying for my lease (which for a similar size house/neighborhood costs twice what my mortgage was) at the end of Feb 2019. Because I can't demo my house and it's October now, there's no way I can rebuild before the end of Feb. My policy's displaced living expenses would easily be able to cover me until my new house is realistically completed. My personal insurance adjuster will be requesting them to continue to pay my lease until at least next June. Should I expect any issues? Do I have any recourse if they say no? The insurance rep responsible for valuing my contents is doing things like depreciating unopened food 80% and slashing the value of an oriental rug that I provided a recent assessment for in half, then depreciating it. I understand that I have depreciated value replacement, but I've given them proof that the rug is a collectible antique with the recent assessment, and they were in my kitchen (just smoke and water damage) right after the fire. Is this level of devaluing/depreciation standard/ethical? Other than fighting them line by line on my contents, what can I do? Am I having a bad experience with my insurance company, or is this type of treatment the norm with a total loss like mine? I will definitely be changing insurance companies after this. What sorts of things (aside from the obvious replacement value) should I have in my new policy? When is the right time to change my insurance provider? I'm talking to the bank about a construction loan this Friday. Posted: 03 Oct 2018 04:30 PM PDT I have Geico. My car went through a deep pothole during the recent flash flood and water got into the engine and carpets. They decided to total the car and sent me the offered amount. I looked at the detailed comparables and decided to look them up. I have a 2011 Dodge Avenger Heat trim which is one of the top 2 trims. The three comparables were listed as Dodge Avenger Heat trims but when I looked it up, I only could find one comparable that was still listed for sale and that had the most basic trim level (Mainstreet). The other two comparables, I decided to look up the Vin and they were both the lower trim level. Keep in mind that the report had them all listed as the Heat trim. I called the agent and he looked it up also and was surprised. Said he will talk to his manager. A few days later, he called me and said that since they can't find a comparable in that trim, they are ended up using the NADA and the Kelly blackbook(?). The price listed on those is actually LOWER than what they offered me using the basic trim comparables. He made it sound like he was doing me a favor and convinced his boss to give me the original quote. I tried explaining to him, that logically, if the price you offered for the basic trim was $7,000, then logically since I have the higher trim, it should be higher than $7,000. Dodge has this frustrating practice of having 6-8 different trim levels and changing or discontinuing the trim names every few years. (1 year in the 2011 models). I have a few clients who are older and not quite understanding of the no-fault system, and I think they were taken advantage of by doctors offices and their no-fault adjuster in general. They weren't aware they could be billing their medical treatments through nofault because the doctors office just said "well you have private insurance so we'll just go through that." I understand that medical treatments are a lost cause, they have to be submitted within like 90 days, right? Please let me know if I'm wrong on that. Are wages the same thing? Im not super familiar with the no-fault side of thing, but wage verification is based on your previous income. So lets say our client got in an accident on 3/3/16 and has NOT been getting wage benefits because she wasn't understanding of how it worked. Is there any way to either retroactively get those benefits, OR, at the very least make sure she gets them in the future? Is there any special process if the person is self employed? Like an independent real estate agent? We have a handful of clients whose files are closed, and I have left a message with their adjusters and am waiting to hear back, but I was wondering if there is any process I can do to help them out. (MA) divorce and health insurance Posted: 03 Oct 2018 11:15 AM PDT Husband and wife get a divorce. Divorce agreement says ex-husband must provide ex-wife with health insurance until she remarries. So ex-husband left ex-wife on his employer sponsored health insurance plan. Ex-wife got remarried and is going on medicare and needs a letter from ex-husband's work saying she is losing coverage so that she can enroll ("a qualifying event"). She cannot continue to use her ex-husband's insurance because her last name is different and obviously that is wrong. There was no malicious intent in the ex-husband leaving the ex-wife on his insurance, more like ignorance. Turns out, ex-husband should've taken her off his plan but elected COBRA for her (since his work only subsidizes the premium for a single plan, his net out of pocket wouldn't have changed). Any suggestions on how to fix this? If ex-husband provides his employer with the divorce agreement that is dated back in January 2018, can he retroactively pay COBRA (I know you can do Cobra 90 days retro) using the premiums his employer withheld from his pay? Need help figuring some stuff out Posted: 03 Oct 2018 02:40 PM PDT Hey everyone, so I recently got into a car accident where the other car ran a stop sign and got t-boned by my car. He had some damage on the passenger side doors and my front got hit pretty badly. I have damage on the front bumper, hood and near the wheel arches. Now just to be clear, I didn't have any signs that said I needed to stop or even slow down. The police accident report states that Vehicle#1 (The one I hit) has a stop sign, and that's about it. Now my question is: 1. Will it be considered 100% his fault, since there was a stop sign and he disobeyed it? I also have dash cam footage proving my point but would rather present it later if I feel like it's not going my way. Thoughts?

Two months ago, I was hit by a ride-share driver who ran a red light. I filed a claim with the driver's insurance, and received my settlement for damages about two weeks ago. The police report is very straightforward about who was at fault (the other driver) and now the passenger's medical insurance company is contacting me for a statement about the incident. I feel like I am being overly-cautious/paranoid, but is it best to just refer the insurance company to the police report for any information about the accident, like I did with the driver's insurance company? My car was totaled and I was ticketed with failure to yield and 3 points were put on my license. I'm pretty inexperienced at driving, I'm 18 and I started driving roughly 7-8 months ago. From what we were told, the points can't be taken off, but we're going to get a lawyer anyways to get the ticket dismissed. Our insurance is also supposed to double from around $1600 to $3200. Is there anything we can do in this situation to save money or am I stuck paying astronomical insurance for 3 years? Edit: Also, I'm on my mom's policy and she told me that it would be $3200 for insurance for ONE vehicle, and that her insurance would also increase since it's her policy the accident was on. I have a $5000 medical coverage policy on my insurance, and I have a $25,000 uninsured motorist bodily injury coverage. Will that cover me needing to go to the doctor dealing with this beyond the $5000 medical coverage limit? I have State Farm and I am in Arkansas, not sure if that is relevant. I really need to go back to the doctor, but I am terrified of going over that $5000 limit and getting stuck with a ton of medical bills just because the person who hit me had no insurance. How does auto insurance know when someone is driving for food-delivery app? Posted: 03 Oct 2018 12:40 PM PDT How do insurance companies find out when someone is driving for a food-delivery app (i.e. Postmates)? I'd guess the majority of these drivers only do it part-time and even sporadically to supplement their main income and getting commercial insurance is often cost-prohibitive. These delivery networks usually have an excess liability policy, but they don't cover the driver's vehicle. So, here's a hypothetical situation: The driver logs on to the app after work and gets into a fender-bender while using their personal vehicle to deliver food. The driver does not wear a uniform. The car doesn't have any stickers, light-up displays, logos or indicate food delivery in any way, and is completely unremarkable in that regard. At the time of the accident, the driver simply closes/logs off the app and does not disclose that he/she was delivering food or logged on. If asked by the insurance company, the driver just says he/she was going to meet with a friend nearby or something of the sort. I understand this is NOT the right way to handle such a situation! I'm just curious to know what kind of information is made available to the driver's insurer from the get-go, or what can tip off the insurer that the driver was using the vehicle to deliver food. Do delivery networks share driver information with insurance companies when they sign up? Will the network's excess coverage policy somehow be linked to the driver's profile or vice versa, thus flagging the driver as possibly using their car for delivery? Do insurance companies automatically check with the delivery/rideshare networks when a claim is filed? Could an insurance company have access to a driver's 1099 information? Or would an insurer likely never find out about the driver using the vehicle for delivery unless the driver reports it? With so many people joining these food-delivery services in order to make ends meet, I wonder if they go into it oblivious that their personal auto policy won't cover them during a delivery, or if they do so knowing that if they DO get into a fender-bender, they should just not disclose that they were delivering. Posted: 03 Oct 2018 12:28 PM PDT Hi guys, not sure if this is the right place to ask on health insurance but I'm getting worried after reading online complaints made to Better Business Bureau (BBB) online. Has anyone heard of this private healthcare insurance called "Health Insurance Innovations" / HII ? Had just purchase a plan from them as I needed for doctor's visit and bloodwork done. So far the doctor have not heard of them but since billings are done end of the month, there is no issue yet. - online reviews says they are scams and advertisement scams on plans that did not cover anything, etc. Additionally, I needed long term medications and Health Insurance Innovations had recommended Prescription Hope (PH). So, I had signed on for it and just waiting for them to liaise with my doctor to confirm my prescription. Then, I would need to wait for PH to send me a card so I would be able to get my prescriptions from walmart. But these takes like 4 weeks. Meanwhile, I did the same search on BBB and I've been feeling uneasy due to the complaints of possible scams from PH. Many thanks for any inputs, if any one knows f these 2 companies. Question about Insuring a Property in an LLC Posted: 03 Oct 2018 10:37 AM PDT Background: My family and I were split owners of a rental property (I owned 33%). After renting the property out for 3 years, I decided that I would like to buy out my family members and purchase the house to live in as my primary residence. The title of the house is filed under the name of the LLC (say 123 Fake Street LLC). I decided to keep the title in the name of the LLC and simply buy out my family members so that I am the 100% sole proprietor of the LLC, thus treating me as a single entity and the owner of the house. I did this because I plan to eventually move out of this house in about 3 years and begin renting it out again so I want the protection and anonymity that the LLC provides. Question: I opened up a Homeowners policy with Statefarm for the property and was told by my agent that the fact that the title is listed as 123 Fake Street LLC should not be a problem. She wrote me the policy with my name listed as the Name Insured and then listed 123 Fake Street LLC as the Mortgagee and my father (who holds my private mortgage) as Named Additional Insured. Does this sound legitimate? I want to make sure that if my house were to burn down, the insurance company cannot turn around and say "Well technically 123 Fake Street LLC is not the primary policy holder so we cannot process your claim, we can only pay for your personal belongings" or something along those lines. Renter's Insurance Policy - Claim Inventory Question for Gifted Items Posted: 03 Oct 2018 06:04 AM PDT We recently (Monday) suffered some property damage due to a leak in the upstairs neighbor's apartment. The water was running long enough that it seeped through our ceiling and soaked our bed through as well as nearby items. Our adjuster has asked us to put together a list of damage items and include: purchase price, age, and purchase location. However, a majority of these items were gifted to us, either new, or gently used, and I don't have a way of finding out the price or purchase location. I have done some web searches to find the products, but I haven't had luck finding the specific items. Specifically for one of the gifted items, the model is no longer made, but the manufacturer did give us the name of the newer model version, but as the item is a mattress, pricing is variable store to store, so that has been a challenge as well. What is the best way to fill out my claims spreadsheet with this information. Will we be dinged if we notate that they were gifts? Car Insurance Canceled With No Notice? Posted: 03 Oct 2018 08:27 AM PDT I was in a wreck last week. I believe I was technically at fault since I got a ticket. When I gave the officer my insurance info, he told me it had lapsed. I called my insurance company and they told me that it had been canceled due to nonpayment. It was supposed to automatically draft it from my account, and I can prove that I had the money in my account when it was due and 4 days after that. I got my bank statement which says they didn't attempt to take it out until the next week, and that is when the payment failed. I talked to someone at the bank regarding their policy on taking out automatic draft payments. She told me they take them out as soon as they are requested. On top of all of this the insurance company told me that they sent out a letter and I never received it. I asked everyone in my house and they never saw it either. I asked them why they didn't call or email me as I would have immediately transferred funds and taken care of the problem. The lady at my insurance office told me that was a "mistake on our end." I have been with this company for 6 years and I have never missed a payment. What should I do? Ask for a tracking number for the letter? Threaten to call NAIC? Give up and accept defeat? Help. Posted: 03 Oct 2018 04:52 AM PDT Last week we were driving down 85 south near Atlanta and as usual traffic started building up. As I slowed down the driver behind me hit me, rear ending me damaging my bumper, tail light and part of the lift gate. We went through the whole process of calling the police and have a report created. Officer gave the other driver a citation and officer gave me his information and where I can get the police report and we moved on. The next day I called my insurance company to start the process of the claim. They got my statement and understand that it is the other drivers fault through the report. When the adjuster came out to look at my car she said I was still going to be responsible for the deductible I have on my insurance plan. My question is since the accident is not my fault would I still need to pay the deductible? Is there something I can do to get my deductible back if I pay? The reason I didn't want to go through the other drivers insurance is because the last time something similar happened the other insurance would not allow me to repair the vehicle where I wanted and I didn't want to go through that ordeal again.
