UPDATE: Neighbors kid fell of trampoline into our yard (NY)

    original post: https://www.reddit.com/r/legaladvice/comments/8wyn3f/ny_neighbors_kid_fell_off_their_trampoline_into/

Thank you to everyone who shared their advice. I contacted my HOI and the representative laughed at the fact that we were getting sued. Long story short she said not to worry and they would handle it. I contacted a few lawyers in my family and they said the neighbors have no bounds to sue since trampolines are apparently illegal in my town.

Turns out the neighbors do not own the house and that they rent it, the owner and landlord of that house was miffed since he is the one that will have to pay the fines for the trampoline. Turns out that the renters don't have renters insurance (which is why they asked for a cash payment from me). Last I heard was that the landlord gave them a 30 day notice. As for me? I'm buying exterior cameras so this doesn't happen anymore.

UPDATE: Evicting psychotic brother in law.

    Posted: 09 Jul 2018 10:07 AM PDT

Hey guys, posted this a couple weeks ago:

    https://www.reddit.com/r/legaladvice/comments/8udadw/or_evicting_psychotic_brother_in_law/?utm_source=reddit-android

So, the update. On Friday he had another episode, only this time he called the cops saying he was being threatened. They got here pretty fast. After about an hour talking with them, he was told he needed to leave for the night. Surprise though, he came back. Since then he's been trying to stir up shit any chance he can. This morning my parents went to the courthouse to file a restraining order against him, and by God's grace it was granted! He'll have to stay 150ft away from the property, and he'll have 15 minutes to gather whatever he wants to take with him.

Since it just came through he has yet to be served, and knowing his past he'll probably flip his shit and leave in cuffs. I want to thank everyone who commented on my last post, you helped my mom understand that we can take control and we can get him out. We were on the road to an eviction, but his freak out and the restraining order just sped that process up.

    Thank you.

(Interstate) My brother gutted our mom's Estate Account via online transfer after the court had transferred the estate executorship away from him. Is this criminal embezzlement?

    Posted: 09 Jul 2018 10:43 AM PDT

I'm a little riled up about this and hope you all will bear with me if some editorializing makes it's way in... I'll try to keep it bare bones...

My mother (in VT) passed away a few years ago and set my brother (based in CA) as the executor of her Estate which was worth a few hundred grand plus some other assets that required liquidating like stocks and jewelry. After two years of not filing needed paperwork with the Probate Court for various reasons, my brother agreed to transfer the executorship to me (based in CO) so I could close the Estate.

After the Executorship transfer I tried ineffectually for a year to obtain all of the account, property, and tax documents I needed from my brother- which I take partial responsibility for, as I was at that point giving him every benefit of the doubt and making my requests verbally by phone and then repeatedly accepted the myriad reasons he was never able to come through.

After almost exactly a year, at a follow up hearing by phone, the Probate judge explicitly told him to send me the info I needed. That same day my brother texted the account info for the Estate Account he'd set up and I went in to take it over later that week. Upon accessing the account I immediately learned two things had happened over the prior years:

    • My brother had utterly drained the Estate account (my mom's life savings plus her freshly sold property), direct depositing 1-3K to what I assume was his personal account every week or two via online transfer.

    • He continued doing so even after the transfer of Executorship, logging into the Estate Account and initiating further transfers at a noticeably accelerated pace and bringing the account balance to less than a dollar 3 months prior to that hearing and sending me the account info.

Honestly, the whole thing threw me into a real depressed tailspin. I've now spent the last year agonizing over what to do next and feeling as though it's my family duty to protect my brother from the consequences of his actions though it means eating them myself. However during a recent (recorded) conversation with him, he was very clear in saying that he consciously and malevolently put me in this position as vengeance for years-old resentments he's held over an argument with my wife. He further stated that he turned the executorship over to me to begin with because I "couldn't do it" (which I believe means bring myself to document with the probate court his misuse of his position).

At this point I'm done. I'm done waiting and stalling the Probate court and I'm done trying to rationalize his actions into my problem to fix. Obviously he have our issues but it never occurred to me that his apparent lack of integrity around money was consciously malicious. If he wants to argue or even fight with me he can always do so- he's my brother for chrissake- but to use my inheritance and my mom's last wishes as a weapon to attack me with is just too much. I'm now looking to bring whatever consequences he's earned home to roost and close the Estate along with this embarrassing chapter in our family's history. I'm hoping, but not expecting, that when the dust has settled he may even be willing to give being brothers another go.

I'm fairly confident that the way he handled the money in the account while he was Executor is civilly actionable. However, my big questions is this: By accessing the Estate Account and transferring tens of thousands from it into his private account after stepping down as Executor/Administrator, did he also cross the line into criminally actionable? If so, what crime would this be considered?

Just submitted my 2 weeks notice. Employer saying I owe them final weeks pay.

    Posted: 09 Jul 2018 08:01 AM PDT

So as the title suggests, I recently got a new job which I will be starting early next month. Today I was notified by the head of our HR department that they will be witholding my last weeks pay. About 4 years ago we were acquired by a larger company, and all of our employees were given a 1 week advance to help synchronize payroll schedules. I am a salaried employee who decided to leave because the work load and hours just became way too much, often times working 70+ hour weeks with no additional compensatory considerations. I am wondering if this is even legal by my employer since I am making almost double what I was back in 2014. The state of employment is NY, any advice on this issue would be much appreciated.

EDIT: Thanks for the responses all! For some clarifications we are not paid in advance, every other friday we are paid for the 2 week period ending the prior friday. Also, back in 2014 every employee had to sign a document acknowledging that "this is an advance and company reserves the right to collect in the event of employee's status is terminated" or something to that effect, I've asked HR for my copy...

Dad hit a worker at the car wash. Now he is being sued. Is it time to hire a private attorney?

    Posted: 09 Jul 2018 08:58 AM PDT

My elderly dad hit a gal that was working at the car wash. His foot accidentally hit the gas as he was pulling forward out of the drive through wash. She was standing directly in the lane motioning him forward. He immediately put on the brakes, but she was knocked down. We heard that she was kept overnight in the hospital, but have no info on the extent of her injuries. This happened over two years ago. Dad lost his license, hasn't driven since, and now is 84 and in failing health with limited memory. My dad was served with a summons recently and he is frightened. We have no experience with lawyers or legal problems. Since the event, she has collected $50k from Workers Comp, his liability coverage is $50k. His insurance lawyer (AAA) can not get the girls attorney to reply to requests for more info. We don't know how much she is seeking, or what her injuries were. We are in California. My parents have a small savings but are not wealthy. Are they in jeopardy of losing their savings? Are her attorneys required to respond to our requests? Should we hire our own private lawyer? Is it likely that she is going for more than the $50k his insurance will pay?

MIL Trying To Retire- But Finds Out She Can’t

    Posted: 09 Jul 2018 03:31 AM PDT

This is in Idaho. In 1998 my mother in law was reassigned to a new position by the local school district she works for. During the transition she was assured by the hiring principal that she would keep the full benefits of her old position, including retirement vesting. She was in that part time job for two years and then moved into her current full time role with the same district.

She is planning on retiring next year and while reviewing her paperwork in preparation found that the district did not in fact contribute to her retirement for those two years as promised, which now leaves her the option of retiring two years later than planned or missing out on $700 worth of monthly retirement benefits (the retirement is based on the rule of 90: age + years worked = full retirement). All documentation she was given at the time indicates that she would be eligible those two years for her retirement vesting- she would not have accepted the job if this was not the case. She has contacted the school district, the retirement account people, and her union. All three say that because at the time she was moved from a 20 hour a week position (which is the cut off for retirement benefits) to a 19.5 hour a week position she was ineligible for benefits no matter what she was told by her supervisor.

They did not have her sign a contract for this position switch, but she does have copies of faxes, emails and other documents from both between her and the principal and the principal and the district that strongly support her version of events. So, my question is where do we go from here? Is there enough here to involve a lawyer, and if so, which sort of lawyer should we be looking for?

I drive to customers homes all over the city for a company. Shouldn’t I be paid hourly for drive time ?

    Posted: 09 Jul 2018 08:59 AM PDT

Texas location. Company HQ in Washington state.

Using personal vehicle, I drive to customers homes. I am hourly 8-5 and claim mileage based off the location from our office to the customers home and back.

If it takes me 30 minutes to get to the office, but it takes me 1 hour and 30 minutes to get to a customers home to where I have to leave my home at 6:30 for an 8am appointment, shouldn't I get paid hourly for the difference of 1 hour?

They claim I can't clock hours until 8am because "you don't get paid to drive to work"

Same thing where I may have an appointment that ends at 5pm (my scheduled end of day), and I don't get home until 6:30pm. Shouldn't I be paid for that as well (minus the 30 minute different from the normal office to home). I feel like I am being cheated out of 2 labor hours per day.

Called state police to ask about filing a police report about my husband getting rear-ended, was told they would have a warrant for his arrest for fleeing scene of an accident and/or failing to report an accident. Wtf?

    Posted: 09 Jul 2018 07:02 AM PDT

So this is in rural-ish SW Louisiana:

Husband was driving to airport to catch flight to work. He got rear ended by some lady. His bumper was crunched but no one was hurt. They exchanged all the info, and he went to catch his flight. When something similar had happened, he was told to come in to police station to fill out a report there and asked me to call and see if it can wait until he gets back from trip.

I call state police (the jurisdiction where accident was) and explain what happened and what we could do, like if they wanted to come see the car, etc. The officer I spoke with became really aggressive with me and told me: "If I come to look at the car I'll come with a warrant for your husband's arrest for fleeing the scene of an accident!!!" I had about a 5 minute conversation with this guy who kept threatening to arrest my husband (for getting rear-ended) who told me it's illegal to not fill out a police report in less than 24 hours, but then they'd arrest him for fleeing, then he said he couldn't do anything and to just call insurance but they'll just ask for a police report and then husband will get arrested, etc etc etc. At one point the officer kinda threateningly told me I should come in to the station so he could "explain this to me better", I told him I was 8 months pregnant and he didn't want me there, and he backed down a bit.

My husband has been joking that he's going to turn himself in and our baby will just have to grow up not knowing her daddy.

From this encounter I have two questions: -I get it that they should have called the police while they were at the accident scene, but is there anything my husband or I can do now to document this somehow with the police? -Was this officer justifiably insane or just some "local color" that I'm supposed to accept? Is it worth it at all to report him to somebody? There are many issues in our city about police being overly-aggressive and I hate to just shrug and let it go. I'm 8 months pregnant damn it, I'm supposed to make a big stink about trivial issues!!!

I appreciate all info! He's calling his insurance today regardless of his life of crime.

    [FL] Support from Untouchable money

    Posted: 09 Jul 2018 06:56 AM PDT

I have a very close friend who is leaving her husband after he became abusive. She is filing a report with the police and packing up a bag each for her and her 3 kids. She has been with her husband for 12+ years (that's the age of the oldest kid. Also a 7 year old and almost 3 year old). She has supported him through his military career having only menial jobs, currently unemployed while supporting him through his struggles with PTSD. She is listed as his caregiver on all of his documents and maintains all communication for him with his care providers. Currently she is in school, one semester from graduation, but had planned to go to law School after graduation.

I can provide any more information needed, but she took the kids and left on Saturday to her mom's after they feared for their safety. She went back to gather a few things and he got violent with her, punching, headbutting, shoving. She turned around and left. As a mom of 3, as far as we know, she won't be able to get child support or spouse support or anything from him. His money is military pay, disability and social security. Right now he gets additional benefits for the wife and kids.

Does anyone know anything about getting any type of support under a situation like this? She basically has nothing, and is looking for a job, but she can't even take the kids furniture or anything. She's going today to grab whatever she can in the trunk of her car. I'm worried about her being able to maintain. This woman has given up her life for her husband. She isn't a money grabber, but can she get any type of support?

[California] S.O. Demoted, told that men preform better at job and command more confidence in workers, also personal appearance mentioned. Discrimination?

    Posted: 09 Jul 2018 09:02 AM PDT

Hello. A million thank yous in advance. Sorry if this is just nothing.

My S.O. Works for a large dog boarding and day care facility. Two months ago she was "promoted" to a shift lead position, but was told she would not get her raise until she proved herself good at the job. During the next two months she bust her ass, preforming all new responsibilities, but is always given excuses about getting her raise because she looked too "stressed", which was never the case

Anyways, Fast forward to last Friday, as she was clocking out she was told that she wasn't getting a raise and she was going to be demoted back to her old position. She was told by her manager that "she didn't seem confident in the yard. Men do better at the job and command more respect and confidence amongst workers". Then the manager goes on to mention that her hair and appearance is messy (she works with dogs, outdoors and it's been 90+ In CA so anyone would be frizzy).

Is there any ground here for her to do anything? Even a co-worker in ear shot said that the manager was being sexist.

Neighbor refuses to share cost of replacing fence, but still makes demands.

    Posted: 09 Jul 2018 10:27 AM PDT

We are in California (Bay Area). The property next door to us is a rental - the owner lives a few cities away and is pretty much an absentee landlord. There is a dilapidated chainlink fence between our properties. We want to replace the fence to add more privacy and improve the look of our yard. Over the past year we have obtained bids from various contractors and sent them to our neighbor, who has been minimally responsive.

This spring we began a major renovation of our back yard, and we really want to build this new fence, since other projects are dependent on its completion. We sent our neighbor an email expressing our desire to replace the fence and asked for his approval and willingness to share the cost.

He replied that he would not be willing to share any costs, because he does not think that the current fence needs replacing (and he's cheap). However, he also claims that if we build a fence on our own, the "good side" of the new fence must face his property, because that is how the current chainlink fence is constructed (I don't see how there is really a "good side" of a chainlink fence, but I suppose that officially he is correct in that the chainlink fencing faces his side of the property and the posts are on our side).

I am wondering what the best move forward is. Obviously we would prefer to share the costs of this fence, but I don't know how to make an argument that the current fence requires replacement. Do I take photos? What is the best process?

If we end up paying for the entire cost of building a new fence ourselves, I certainly don't want to give him the benefit of the more attractive side, but I also want to make sure that I don't get into any legal trouble.

    Any advice would be appreciated!

Copyright on an old vhs tape

    Posted: 09 Jul 2018 08:41 AM PDT

    (Connecticut)

    Hi Legal Advice!

My friend was in a music video for the B-52's in 1978 when she was a toddler. We unearthed the old vhs tape while cleaning out her mom's place. It looks like it was a demo reel for the videographer with a music video of the Kinks, some newsreel footage of New Haven, and this epic 10 min B-52s video.

I've looked online and I can't find either of these old music videos anywhere. According to my friend's mom, the videographer was a friend of her's who died of a drug overdose. The video's are really incredible and a piece of rock history, I think. I am wondering if I can convert them to digital, if it is legal for me to post these online. I think they're really cool and I'd love to release them to the world somehow but I want to do it the right way.

Advice? Hope this is the right sub! Thank you!

Can my boss take away pay that I’ve earned?

    Posted: 09 Jul 2018 09:56 AM PDT

Apologies in advance if this sort of question has been covered before.

I work an hourly job in Savannah, Georgia. Today, my boss decided not only to demote me, but to remove an hour (that I have already worked) from my pay for this week.

The premise is that I was not doing what I was supposed to be for that hour. Specifically I was supposed to stay in the office rather than joining a tour group on their tour (that is part of my job, we are a tour company)

Obviously I'm seeking new employment, but meanwhile I want to be petty about this one hours pay.

So my question is- is this strictly illegal as I imagine it ought to be? If so, could someone point me to a federal or state law that I can print out and show to my employer?

Could I take them to court and milk this somehow? That's probably pushing it over one hours pay, but hey 🤷🏻‍♀️

Or if it is legal for them to take away money for an hour that I worked, could you explain how and why.

Edit: thanks for all the replies, my question was thoroughly answered. I won't go after the one hours pay, I'll let it slide as they might have a leg to stand on and it's a small battle to pick anyway. I just really wanted to know that they are in the wrong and breaking the law, thank you.

[AR] People tried kicking down my door, cop arrested me & left my kids home alone.

    Posted: 08 Jul 2018 08:17 PM PDT

My sister and I share a residence in Prescott, Arkansas. She has 5 kids (13, 7, 5, & twin 1 yr olds). Friday night my neice had a few neighborhood friends stay over. In the morning the kids left to go home like they usually do.

About an hour later a woman and three others showed up looking for their 17 year old girl. My sister informed her that she left to go home and the lady became irate and demanded my sister get in her car to go find her. The lady yelled and threatened some more because she said she did not give her daughter permission to stay the night here and said she ran away from home. After more threats my sister tells the lady to call the police and then she comes back inside the house.

The lady begins screaming and kicking our door repeatedly while the other people go to the back door trying to kick that one in as well. This wakes me up as well as all the children who are now crying and terrified. I rush to the door to see what is going on and the woman cusses me and tries to take a swing at me. Again she kicks our door another ten or so times. I yell through the door for her to stop because she is scaring my kids. Her response, "I don't give an F about yo cryin ass kids, I'll cap dey asses too". I mistakenly call 911 as she still is banging on the door.

The officer shows up and the woman meets him at his car. Apparently they know each other based on the smiles on their faces. My sister and I try to explain to the officer what is going on but he keeps interrupting us and just keeps asking why we let the 17 yr old stay the night. He allows the other people to continue to yell and insult us. We even insist that he can look in our house which he then says that we probably snuck her out the back door and were helping her runaway.

I said to my sister that we needed an assiting officer here if he is not going to let us speak. The officer says, "What? Another officer? I don't think so. And you know what I think y'all's stories keep changing.". Then he slaps handcuffs on me, puts me in his car and then does the same to my sister. While our 5 kids are crying on the porch. The people are still standing in my yard. He then begins to start to drive off and my sister and I beg him to let us call someone so the kids won't be alone. He says, "The kids can watch they self." before making a call to DHS on his radio. Giggling and then humming to himself on the way to the jail.

At the station he comes up to me and says that he knows I am a criminal and wants to know my prior arrests. I told him I was not a crimal and my past arrest were irrelevant but he had the paper in front of him. He says, "When an officer asks you a question you need to answer if you know what's good for you.". I then give in and tell him about my arrest 12 years ago for a miniscule amount of marajuana. I paid my fine way back then. He says, "Oh. So drugs. So when I asked you if you were a criminal and you said no you just lied. You just proved to me you are a liar."

We are cited and released a few hours later. Charged with contributing to the delinquency of a minor and are given a court date. When I ask if I can press charges on the people who tried to break in I was told it would be a waste of my time.

I am so livid at this response and want to know if there is anything I can do against this officer. I know the charges are bogus. They brought the 17 yr old into the jail as we were leaving. We later hear from my niece that the 17 yr old claims her parents abused her and kicked her out 4 days ago. We did not know about this.

Not sure if this is relevant but we had a prior run in with this officer. Long story short, neighborhood lady had a bat and a group of friends wanting to fight me and my sister in the road because of a dispute between her kids and my niece. This particular officer shows up and hugs this neighbor lady because they were old school pals. Even tells her to be quiet when she says she will kill our asses (exact words). He accuses us of being racist and threatens to take me to jail. I am not racist nor did I say anything race related but the lady loved to call me a fag any chance she had.

He referred to me as an "effiminate male", an "it", and wrote my sex as female on my ticket.

I want to know what actions I can take against this officer for his refusal to help in the situation. Am I wrong that this was handled poorly?

Tl;Dr:. Dirty cop arrests my sister and I without getting all the facts of the situation and left my kids home alone. The only thing we did wrong was let our child have a sleepover with her friends. Nothing is done to the aggressors. III

[MA] House is shaking because of construction across the street

    Posted: 09 Jul 2018 11:14 AM PDT

I apologise if this isn't the right place for this I'm just not sure where to ask for any kind of advice.

So I live across the street from a school and they have strarted doing construction on the school yard. The school yard is below the level of my house and there is a very short hill that slopes down to the yard. Everyday now they have been using several heavy machines to dig out the asphalt from the yard and so forth. I'm not 100% on what they are doing but it makes my house shake quite alot to the point where I have plants on top of cabinets moving (mostly on the first floor but some stuff on the second floor) I have no idea if there is any other damage to the house, for all I know it is fine and I am just overreacting. But the house is older and I'm worried there maybe things that I cannot see that are impacted. Is there anyone I should contact about this ? Does it even make sense to do so ?

Again thank you for any advice and apologies if this isnt the correct place to ask!

The woman I rented a room from is not returning my security deposit or rent money collected from months where I did not live in her house due to the fact that she got her house taken away

    Posted: 09 Jul 2018 09:32 AM PDT

This lady owes me $1,000 and has been promising to pay since January. I do have a couple photos of written contacts made between us and a few text messages, but beyond that I don't have any more proof as all other text messages have been deleted. She is well aware of the amount of money she owes me and has promised to pay, but never has. The room rented was located on Long Island where I still currently live, but my former landlord has moved to Pennsylvania. I just need a way to obtain the money.

[Oregon] Father got 3rd DUI in 10 years, and is looking at 18 months minimum after he's out of the hospital. He wants to go to a different state to skip his court date.

    Posted: 08 Jul 2018 11:16 PM PDT

Two days ago, my father got into a serious motorcycle crash that involved nobody else. He broke his pelvis, leg and hand, and cracked a few ribs.

He was also shitfaced drunk. (Sorry for profanity but I've got no better term. )

He's had 10 DUI's in the last 10 years, which means he is looking at a minimum of 18 months in prison if he's convicted. I imagine he will be, he was found to be drunk via blood test at the hospital.

My father was informed about all of this once he sobered up. Now, he is saying he wants to drive to Minnesota six days before his hearing to avoid it. I tried to tell him that was an incredibly stupid idea, but he won't listen.

I'm 17, I have an 11 year old brother. What can I do to prevent my father from running, can I be punished alongside him, and if I can't stop him and get dragged along, what should I do?

    A death and property.

    Posted: 09 Jul 2018 09:52 AM PDT

Posting for a friend in need.

I got into a relationship about 6 months ago. We decided to buy a home in Colorado. Both of our names are on the paperwork, well my girlfriend end up dying a few days later after we closed. Unsure what to do because her family is now coming after me for money. We had a joint account and property. She has no will and now her family wants the money we have built together in the bank. Also I am unsure about the property we just bought. Will I have too sell it? Do they own a portion of it? I'm already crushed from the loss and now I have to deal with this. Could use some advice in steps to protect myself from money hungry vultures.

My grandma is being stalked and harassed.

    Posted: 09 Jul 2018 07:52 AM PDT

Can we do anything even though we don't know who it is? She's blocked the number before, but they always text using a different one.

This person has sent her pictures of her car at her place at work, I'm pretty sure followed her home, and constantly texts about how she's sleeping with her husband. Just last week she stopped at my mom's and the person told her that she gave my pap oral while she was gone. She's always messaged about how she's a fat cow and told that they wish she dies during her surgery she has to get soon. It's horrible and none of us are sure what to do at this point. Any advice would really help!

Edit: I live in West Virginia

Real Estate not transferred into trust as the will instructed after relative died years ago. Just finding out now. Bad blood with Executors / Trustees - Should beneficiaries be concerned? Ohio

    Posted: 09 Jul 2018 10:11 AM PDT

A deceased relative owned a chunk of real estate. They had a will that instructed that the real estate was to be transferred into an existing trust when they died - until the youngest of the beneficiaries reached 21 years. At that point the real estate was supposed to be sold and the proceeds distributed equally among the beneficiaries.

Turns out the real estate was never transferred into the trust. The executors of the will (who are also the named trustees of the Trust) have refused to update any of the beneficiaries as to what is going on with the will or the trust as they are not on speaking terms with the beneficiaries (a lot of bad blood). Additionally, the executors do not speak with each other.

Just found out that there has been a motion to remove one of the co-executors (there are two, and the one possibly being removed at least speaks occasionally with the beneficiaries - but doesn't comply with requests for updates).

If and when sold, the real estate could be worth 250-500k.

As a beneficiary, should I be concerned that the executors / trustees could screw over the beneficiaries? I.e. is it time to consult an attorney, or are there generally enough legal safeguards with an established will and trust in place that they would have to comply?

[CA] I was not hired at a business because I "Lied on my application"

    Posted: 08 Jul 2018 08:59 PM PDT

Title is a bit loaded against me but let me explain. My mother was born in Costa Rica, while my father was born in Italy. The two had me in America (both immigrated legally) and I obtained a citizenship in Italy, Costa Rica and USA, having lived in the latter most of my life.

As I went to apply to a chain store, I clicked that I was hispanic. The place offered me a interview but I felt like something was off during the questions as the interviewer didn't look at me most of the time while I was speaking, and kept asking me to say what I wrote on the application.

I didn't get the job, but I called and asked anyways so I can prepare better for future interviews. The person who answered said it was because I lied on my application and therefore I could not work there. I was confused when I was told this as I have all documentation from a diploma, birth certificate, and passports. That is when the person said it was because I wrote I was hispanic when they deemed I was not.

What do I do in this situation? I can't afford a lawyer, and even if the lawyer were to get the business to offer me a job, I would not want to work there after what they did to me.

    Park it Right Boot/Fines

    Posted: 09 Jul 2018 11:34 AM PDT

Two weeks ago I was visiting a friend at their new apartment complex. I was parked in an unmarked spot, no signage on the asphalt and no sign in front of my truck. I came out at midnight or so and found a boot on my truck from Park It Right. Turns out that I drove past a sign on my way in that said resident permit parking only; my fault, I missed the sign and parked in a permit parking only spot. Never mind the fact that there were 20+ empty spots (complex is new and not to capacity just yet). As irritating as THAT is, it's my fault for missing the sign, regardless of the vacancy. My issue is this, they charged me $340 that night in order to get the combination to remove the boot. Once I paid the fine, they told me the code, I removed the boot, and then they had me drop it off at their return location located on the premises. I was told that if it was undamaged, I'd be getting my "deposit" back of $170 within 3-5 days. That hasn't happened. Emails to the company have gone without replies, phone calls have been transferred and disconnected. This is infuriating. Is there anything I can do here? I'd like to recoup the funds. I'd also love to know that it's illegal to boot guests or use one sign to police the entire parking lot, but I think that's asking too much. Thanks in advance.

Note: boot was returned completely undamaged and fastened to their return box like they had asked.

    Located in Colorado.

Can employer change my pay whenever they want?

    Posted: 09 Jul 2018 09:11 AM PDT

In WA. I work for a large flight school as an instructor. We are labeled independent contractors, but are treated like employees (set schedule, they provide materials, hourly pay/salary, required uniforms, all without the benefits of employer paid taxes and work related injury pay if something were to happen).

Two weeks ago the company restructured the pay from $7.50 per flight hour (with $1000/mo guaranteed) to $20 per flight hour, plus many new bonuses for various student accomplishments. Many people complained due to the minimum pay being redacted so the company on Friday changed the pay again back to $7.50 per hour plus a 15% bonus every paycheck now.

Among the illegal classification of independent, and other illegal labor practices, can they change our pay like that, twice in one pay period, leading to a raise, then a reduction in pay? Any advice in this situation? Thank you.
