Final Update: (Oregon) Can I sue my business partner in small claims court? Posted: 03 Jul 2018 08:48 AM PDT Hello again, r/legaladvice. I understand you appreciate updates. I posted several questions and updates throughout my saga, but here is the (most relevant) OP. The important points:
That was scary and frustrating, so I got lawyer. Now the update: After spending months trying to peacefully resolve everything and getting stonewalled, we filed a document inspection lawsuit in November to compel my partner to produce all our agreements and financial documents so we could at least understand what the heck he was doing and to figure out just how bad he was screwing me. My lawyer (who's practiced for 30+ years) said he's never had to file an inspection suit before because, in Oregon, it comes with attorney fees. No one allows themselves to be sued for that because it's a big liability. My partner dodged service for 2 months, so we weren't able to get the ball rolling until January. He had a lawyer this whole time, but they never agreed to accept service. And then... more stonewalling. We ended up filing notice of intent to take default. The next day, they filed an answer to the suit denying everything and countersuing for attorney fees (which, apparently, they can't actually get). In March, my lawyer's assistant was doing some routine research and just happened to find that the business filed amended documents with the state that completely omitted me as a member / owner. He was trying to erase me. My lawyer decided the best thing to do was to continue the inspection suit and file a new suit naming my partner personally for breach of fiduciary duty. That way, he could try to do as much useful discovery as possible under the inspection suit where we could get attorney fees back and use all that discovery again in the individual suit where we couldn't. This is also the point at which he offered to represent me on contingency, which was a huge relief for me because he's expensive and things were escalating. He also credited the fees I'd already paid towards future costs/expenses, which helped a lot. Even though the other side was making no effort to resolve the problem, that really felt like a positive turning point because I think getting a lawyer on contingency for a business / contract dispute is pretty unusual. I later learned my lawyer offered contingency because my partner pissed him off and he wanted to keep turning the screws on him. He didn't want me to bail. I get the impression he's getting towards the end of his career and just likes to work on cases that interest him now. Fast forward a few months, and we depose my partner. That experience pissed my lawyer off even more. I wasn't there, but reading the transcript was both sad and hilarious. My lawyer said it was the "3rd most frustrating deposition" he's ever taken. Oh well, guess you can't be 1st at everything. After the deposition, partner's attorney got in touch to offer a settlement (he was on his 3rd lawyer at this point, btw). It was a terrible offer so we said "no thanks, but we'll do mediation if you want." They agreed, which is tragically comical to me. Mediation was my partner's idea that I agreed to before any of this insanity ever started. But he changed his mind at the last minute and I never heard from him again. We spent a FULL day in mediation and, at the end, accepted a "mediated settlement" when negotiations broke down. The settlement, once the contingency fee was subtracted, was not far from what I thought I was owed, so I was happy to accept it and put an end to an emotionally draining 2-year saga. I often second guessed myself throughout this process and felt guilty for suing someone I once cared so much about but, really, he brought it upon himself. And I'm happy that I stood up for myself and am not spending the rest of my life asking, "Why did I let him get away with that?" My ex-partner has a very strong cult of personality that's served him well—he's very charming and can convince most people to do what he wants. I don't think anyone's ever stood up to him like that before, and it caught him flat footed. The whole process was confusing because he never made a logical move until he was truly backed into a corner and was facing trial. At every turn, I wondered, "Is this a trap? Do they have some epic strategy I can't see?" The longer things dragged on, the more I realized they didn't. There was no strategy beyond ignoring me until they couldn't anymore. Though my bank account is much healthier today, I have to say the money really rings hollow. I lost a friend and a partner in this debacle. But it was obvious I was going to lose that anyway, so better to have the money than not have it I guess! And I'm very thankful I found the lawyer I did. I probably could not have sustained the fight all the way through trial without a contingency agreement. When he called they company, they said it was because someone defecated in the hot tub (not remotely true) and the charge for cleaning and repair. My friend said he would be fighting the charge and asked for a receipt for the charge. The water in the hot tub was dirty after we left but it was not because someone defecated in the tub or misuse. In dash cam you can see her nose pointed in the other direction as she came out. It was a parking lot. Very low speeds. It was left in excellent condition, nothing hung on the wall so no nail holes, and tile floor so no issues with carpet. Many times he has asked for us to post the apartment on our school website and we have numerous times beginning three months prior to us moving out. About a week before the lease ends, he says that if we find him a tenant that he will give us our deposit plus $200. Well fast forward a week, he does the walk through and signs off on everything but says that he is going through a divorce and doesn't have the deposit money. This obviously raises some concerns for us but we try to be understanding of his hard times. As the weeks pass, we ask again for the deposit back and he says he drained his entire 401k on the divorce and needs the deposit money to live on. He says this while still driving around an $82K truck (which he proudly informed me of the cost of it when I told him he should consider downsizing if he is financially unable to pay us) and living in a 3,000 sq foot house. As the conversations continue, we are then told that he is not legally required to return our deposit and that he can keep it if he wants to. He says that he has been a landlord for years and we don't have a case. While I do not believe what he is telling me to be honest or true, I am seeking confirmation from this community that he is incorrect. It turns out she does coke (I had no idea) and my dog got into her stash and ate some of it. It was enough that she was rushed to the vet Saturday night and is still there today, though she is going to be okay. My "friend" and I (we are not friends anymore after this) have been arguing over the vet bill. I have pet insurance but it will only cover a portion of this bill. I've been arguing she should at least help pay, because my dog wasn't being watched and the drugs weren't hidden well enough if she ate them. We received no payment from her insurance company and eventually found that her insurance issued her a check and she has kept the money without paying. She was hospitalized for approximately 4 weeks and the bill amounts to approximately ~$4500. I have used a collection agency very rarely in the past because I don't like to make a habit of doing that to my patients, but even then they have not collected money from anyone. At this point I am interested in going above and beyond collections. Can I take her to court? Small claims? The services were rendered here in Maine - do I take her to court here or in New Hampshire? Today received a recall notice saying the software needs an update at it has been found to be faulty, that it may not reverse when some instructions are detected and this could cause injury. I just received a letter in the mail from a law office representing the HOA demanding that my rent now be paid to the HOA through the law offices. The HOA has apparently placed a lien on the property (which I found the record for online) because the owner has not been paying fees and now this debt collection law firm is demanding our rent. The letter references section 720.3085(8)(a) of the Florida statute which essentially describes the situation: "If the parcel is occupied by a tenant and the parcel owner is delinquent in paying any monetary obligation due to the association, the association may demand that the tenant pay to the association the subsequent rental payments and continue to make such payments until all the monetary obligations of the parcel owner related to the parcel have been paid in full to the association and the association releases the tenant or until the tenant discontinues tenancy in the parcel." I did call and speak to the lawyer who sent the letter and they confirmed this is accurate and this is how we should proceed. However, we pay our rent to a property management company and when I informed them about this they said that because our lease agreement is with them and the owner, we still need to pay our rent to the owner and not the HOA. A real estate friend of mine also told me there needs to be a clause in our lease that allows the HOA to take over the rent. The law seems legit but I'm afraid if we don't pay the landlord we will incur the $100+ late fee for not paying and be in breach of our contract. I'm also concerned if we stop paying the landlord he will stop providing maintenance services. Does anybody have an experience with this or advice? I'm not sure who to listen to. Thanks! In the lease we had clearly prohibited smoking of any kind. She now claims that she smokes due to a medical condition. The previous main floor tenant vacated because of the odor and smoke issue which is even reaching the main floor. The new tenants in the main floor are now threatening to leave as they have smoke allergies. We have warned the basement tenant many times but she has not stopped smoking. Basically, I just (2 days ago) moved into a 2000sqft. home and while the home had no electric, water or utilities set up when I before in and was viewing it, I managed to set electric and internet before I moved in and just got internet today. The issue has been the water.. the previous tenant left a $568.72 water bill (HOW???????? Is there a huge underground aquarium I don't know about????) This house doesn't even have a pool. There are sprinklers for the lawn and like I said 2000 sq ft but even so I don't think sprinklers at the frequency they've been at would rack up that much. Most of our neighbors pay between $65-80-90 in water and use sprinklers as well, I asked around. My landlord never mentioned this to me before I signed the lease with them (they claim ignorance to the matter but I'm hesitant to believe this) and they're saying they're willing to pay the bulk of the bill but my mom and I need to help out with $150 which is absolutely not possible right now. We just came back from Brazil (vacation to see my moms family, she's terminally ill and wanted to see them) and spend $1,500 on each of our tickets that we'd saved up the rent + an extra $1,250 second month (they call it first month but ok), an $800 deposit and $240 in motels while we waited for the house to be "move-in ready". Once we moved in everything was great but now there's this. Not sure where to go legally from here but I can't afford $150 due to my moms' meds that need to be paid for (she has cancer), along with food, special urinary food for my cat since he has a history of urethral obstructions, utilities, and just general stuff, you know, etc. I don't see how I'm responsible for this ex-tenants water bill but they won't let me form my own account on it with a $0.00 balance because as they explained it, "it's not only the ex-tenant that owes this money, but this address itself owes it. Anyone who moves here would have to pay this bill before having water services restored." If anything, the landlord should take care of this, the ex-tenant, let's call him Joe, was her tenant, I don't know him, or anything about him. I've seen the bill and spoken to the water people so it's legit, but part of me thinks she knew about this, kept part of his deposit to pay for it fully and now is trying to squeeze extra $ out of my mom and myself. She's just one of those money grubby people that you can spot from a mile away. Due to the move, we can't responsibly spend this $ so it's just not possible. Any other month $150 would be a piece of cake but with all we paid to move stuff out of storage, a guy to help carry the stuff, a UHAUL truck, etc, it's not doable. My only other recourse is taking out a payday loan on my moms retirement $ since I don't have a fixed job with a monthly check and I feel that that's ridiculous considering we'd pay $200 probably for the $150 borrowed and this isn't our responsibility It's also not possible to live in a home without water. In April of 2017, the house was sold and the new owners ended the relationship with FS, because they planned to move in at the end of our lease. We moved out a month early for our and our landlords' convenience. They cut a personal check for our deposit within a week of us moving out—we're excellent renters. At the beginning of June we got our first "friendly rental reminder" email saying we owe them $2400 for May + $530 late fees ($80 per day for days 4 and 5, then $15 a day). I immediately respond to our former Fucking Shitty property management company via email. No answer for a day. Another email saying 1) the house sold and you didn't manage it during the time in question, 2) we moved out May 1st (before the time in question) after giving the landlords proper notice, 3) we do not owe FS any money. I also explained that we were concerned about our credit if their automated billing system tried to make a negative report, and that I wanted a statement from FS stating how much money we owe them. No answer. Then I called the general number instead of her direct number and make my complaint to the billing department who assure me they'll look into it and that it's a simple misunderstanding with their fucking shitty billing software. I finally get an email response back from our Fucking Shitty account manager stating the same. No zeroed out statement. Here we are in July doing the same dance. We got a late notice asking for $2400 for July and a $75 late fee for June directly from their shitty billing software. I've emailed Fucking Shitty account manager. No reply. I've started calling her directly twice a day, leaving courteous messages asking for an ASAP response. No reply. I'm 19 now, I'm no longer a child, I have an 11 year old brother and toddler twin sisters that have a disability. I love them so so much. About two months ago I finally left and moved out of my family home, it was forced/my choice to leave after my dad had put his hands on me. It was the first time it had ever happened, but it happened. In the past he has only broken things, and it happened a lot. I don't live there anymore, but the problems of him drinking and breaking things have not gotten better. My brother told me how he broke something last night and had made my stepmom cry all day today because of how mean he was being and he took her phone. That was today but there were other arguments that I know of that have happened since I've been gone. The legal part that I'm questioning right now that's really hard for me to figure out is whether or not I should call cps. I want my siblings to live a happy life and I do want my stepmom be able to get away too, but at the same time I don't know what would happen if I call. What if he just gets mad and things get worse? What if cps comes and my siblings have to go to foster homes? (My sisters have a disability so this worries me a lot) What if things just get better in time? Would my mom lose her job? Despite everything, I'm also scared of what would happen to my dad. He's still my dad. I have been living in a townhouse in an apartment complex. I've been here for three years and for the most part any maintenance issues I've had have been dealt with swiftly. This past year we've gotten new management at the complex and along with them new maintenance staff (as far as I can tell a single staff member). Early in June my upstairs bathtub began to back up and become clogged and I quickly called my apartment staff for them to send maintenance. Maintenance did come out but we're unable to resolve the issue over the course of several days trying different methods like snaking and Draino. This entire time my fiancé and I have had to shower wading in our own filth. I also quickly discovered that our adjacent neighbors' tub is having the same issue and when they use the shower our tub backs up and vise versa. Maintenance eventually came to the conclusion that the drain plug has dislodged and somehow got caught between the shared drain between my neighbor and me and to fix it would require opening up the drain to fish out this plug. Last week on Monday, maintenance came by and exposed the drain pipes also bringing their tools and a step stool. However they told me that they would have to wait for the tub to drain completely before opening up the pipes unless I wanted my living room to flood. This process I noticed can take a few days. Keep in mind when my neighbors use their shower the tub also fills up. This past week maintenance comes by maybe once a day (if I'm lucky) takes a look to see if the tub has water in it. Every time they inspect there is some water inside and they leave saying it needs to drain. They do not make any effort to scoop out the water or get a hold of a pump to remove the excess water. This past Friday after 5 days of maintenance leaving their tools in my living room I became fed up and emailed my apartment maintenance sending pictures and let them know my patience has run out. I told them in the email they either need to send maintenance to resolve this over the weekend or on Monday and if by Tuesday it was not fixed I would be calling a professional plumber myself to fix this. I would either deduct the cost of the plumbing bill from my rent for the month or take them to civil court. The email I got in response was dismissive saying my neighbor and I have not complied with their mandate not to use the shower and they would be shutting off the water to our units until the issue is fixed. I called management yesterday (maintenance did not come that day) and they told me they would send someone out today or tomorrow to fix it. When I asked about a professional plumber to come out they told me that "wasn't an option". It is now Tuesday and closing in on a month this issues is unresolved. Maintenance's tools are still in my lives big room with the drain panel exposed. I don't know where to go from here or what steps I need to take to make sure I have a solid case if I need to go to court. [Arkansas] My dog was killed at a dog boarder last night Posted: 02 Jul 2018 01:43 PM PDT Hi there, I'm not really sure if I have any options at all but my I was informed that my dog had passed away as the result of being attacked by another dog at the dog boarder we were boarding at. The attack happened on Saturday night around 5pm, she was bandaged after discovering a puncture wound to her chest and went out again at 8pm and apparently drank water. The following morning she woke up and drank water again and walked around but did not eat her food. Around 10am they discovered her in distress in the yard and took her to the ER where they questioned why she hadn't been brought in sooner. She had 4 fractured ribs, no detectable blood pressure, and was septic. They worked with her until 5pm when she went into cardiac arrest and passed away. I was never notified during this process and found out she had passed 5 minutes later. I'm very angry that I was not consulted at all and I'm just lost. If there is nothing I can do so be it but I'm incredibly hurt and distraught over this. My dog was incredibly timid and sweet, had been boarded at several other places without incident, and regularly goes to the dog park for socialization. At the time, my then 11 year old, who suffers from mental illness, was taking Risperdal and the DCF worker actually told me (in my son's presence) that that particular medication "causes boys to grow boobs". This would send any boy into panic mode, however my son suffers from DMDD, ODD and OCD and he completely lost it and refused to continue taking the medication. My reluctance to cooperate with them is because they did absolutely nothing to help us, in fact, they made matters 100x's worse. It's also important to preface that my employer has an Employee Assistance Program that allows me to have a free 30 minute consult with a lawyer who specializes in divorce law. I'm hoping to speak with him later today, and would like that conversation to be as effective as possible. I'd be especially grateful for your advice for making that conversation as easy as possible for him. I want to be a good client. Context My ex-wife moved out of our house in mid-December 2017 (we were still married at the time) to a one bedroom apartment. I stayed in the house because I could afford the payments, though we both remained on the mortgage. Before this time we split the mortgage payment 50/50. Since December 2017, I have paid the full mortgage, tax, and insurance payments for the house every month. No one else has lived in the house except me. I also assumed payments for the security system she had procured when we moved in. Had we sold in November 2017, which is when she made her last half mortgage payment, we would have lost money on the house. The house did not become equitable until March 2018, after I had made four additional full payments. My ex-wife and I finalized our divorce in February 2018. We were not separated a full year, but she wanted her maiden name back by the time she started a new job, so I acquiesced. Neither of us had attorneys. We did not have a separation agreement. We have no children. Our cars were in our own names, neither of us made any claims for the other's savings/retirement/assets during divorce, and we have a spreadsheet outlining who gets what of the furniture when she moves to a larger place. In mid-March, my ex suggested during an in-person conversation that she take Sophie on a long-term basis until she moved and was able to take Spike back. Her rationale was that they were "our" dogs. I told her I was uncomfortable with that arrangement, and that I did not want Sophie to go. The issue dropped. My ex continued to come over and do laundry on Wednesdays while I was in class, and would take both dogs out and feed them that afternoon. Last night just after 9:30pm, she texted to bring up the subject again. She said she wanted to pick up Sophie today while I was at work, and bring Sophie to her apartment for a few days. I told her that was too short of notice, that I was uncomfortable with the idea, and that I'd need a few days to think it over. My ex replied that that was silly, that I didn't need a few days to process, and that Sophie was partially her dog too. I reiterated that though we had discussed it four months ago, I was still uncomfortable with the idea, that I was concerned about how Spike would respond, and that it felt like too short of notice. She replied with "Okay. I'll grab her Wednesday morning." To me, this escalated the situation. I had been clear that I was not okay with her taking Sophie, and instead of talking about it, she instead declared what would happen. At this point I became very uncomfortable with her access to the house, and was concerned that she might show up and just take Sophie when I'm not home, all without my consent. I attempted to change the security system code online. The service notified her I was doing this, which escalated the situation further. She is now concerned I will lock her out of the house, which she feels she has a right to access, and I'm concerned she'll show up and simply take Sophie while I'm at work. I managed to de-escalate the situation for now, but she wants to have an in-person conversation about this today. She's still pushing very hard to take Sophie for a few days. I'm secretly worried this is just a "trial run" to prove that she could have Sophie at her apartment without upsetting the neighbors. This would be a prelude for her attempting to take Sophie on a longer term basis. My simple questions are: Just to verify, she conceivably could get a court order compelling me to sell the house? If the house is sold, am I required to evenly split the proceeds with her since she hasn't contributed to the mortgage payments since before the house became equitable? My deeper questions are: My ex-wife is on the mortgage, but I've been paying it exclusively for several months while I've been the sole person living there. What sort of access am I required to provide to her? Can I change the security code and locks to restrict access to the house? What legal standing does she have with respect to the dogs? We had a verbal agreement about who gets which dog, and the mutual understanding is that this was a permanent arrangement. She's only asking for Sophie because Spike isn't an option, and I'm unwilling to give up Sophie. In your professional opinion, should I let her take Sophie for a few days? Under what conditions if so? What can I do if she doesn't give her back? Like I mentioned earlier, my ex-wife wants to discuss this in person today. What do you suggest as next steps? Should I insist on meeting in a neutral public space? Should I record the conversation (we're a one party consent state)? My job still hasn’t actually hired me after 6 months of working there. Posted: 02 Jul 2018 05:32 PM PDT This is in Oklahoma. In January, I started working for a company as a subcontractor. I was told they wanted to hire me on as an employee with benefits and that this would happen in March. I was also given a Monday-Friday 9-5 schedule and was expected to come to work inevitably. I was given a set of keys, a parking pass, and a company credit card to use to purchase things I needed to do my job. In March, I was informed that I would not be able to be hired until there was a "hiring manager" and that they had just posted the job opening and were waiting for someone to fill it. I was given a $1 pay increase for my patience. In April, the position was finally filled, and the woman didn't start working until May because she was moving from the other side of the country. The hiring manager said there was a lot she needed to do before I could be hired, told me that my official date of hire would be July 2nd. She also told me that I would receive the salary equivalent of an additional $2 pay bump, health insurance, and the title of "Assistant Facilities Manager." I would also need to pass a background check and drug screen. Last week, I inquired about the hiring process, what all I needed to do on my end by today. The hiring manager was out of town (she still hasn't fully moved apparently.) The Facilities Manager who is my immediate supervisor emailed her to ask. The hiring manager emailed back that she just learned that I would not be able to be hired until the position was posted on the company website for 30 days. So now, I won't be able to officially be hired until August 1st. She said she felt bad that I had been waiting so long, and said that my $2 pay increase will go in effect today. It also comes with the stipulation that I now have to work this Friday evening from 6pm-1am, providing security for a concert that is being held in one of the company's buildings, which is very different from the work I normally do (overseeing maintenance to the building, repairing the things I can, making service calls when I can't, HVAC, inventories, alarms, etc.) So... I'm tired of waiting. I'm tired of not having health insurance. I'm tired of having to pay the extra taxes. I'm tired of giving them all the benefits of being an employee, without actually being an employee. I'm tired of the constantly expanding list of duties without the benefits that everyone else I work with has. I actually really enjoy the work that I do for them, but I feel that I'm really not being treated properly. I've never dealt with this in my life and I could really use some advice. Thanks.
