I have a driveway that runs beside the front yard. There's a divider between the driveway and lawn made of thick wood that's both decorative and prevents people from driving on the grass. My neighbours have a bad habit of driving on our lawn as they maneuver their vehicles on their property (renters). They did this all throughout the winter and despite asking them to stop, they continued to do so. I have also reached out to their landlord and the city. The landlord (according to the city) is supposed to fix our dead grass, but has yet to do so. They're just as bad with their own yard, today I witnessed them drive onto their grass and around another vehicle parked on the driveway. I guess getting him to move his vehicle was too hard. Since the grass is dead, I would like to move the wood liner from our driveway to the other side of the yard. It would still be on my property, but line the neighbours' driveway. I anticipate they will hit the wood liner until they learn to compensate. My question is: if they hit the wood liner and it ends up hitting another vehicle parked on their driveway, will I be liable? I am also posting on mobile so please forgive any typos. On the 11th of April I purchased a new vehicle (Honda Civic Type R) trading in my old scion tC as down payment. In order to proceed with the deal we needed my policy number (standard) to move forward. I was insured through QBE formerly known as General Causality. I apparently lost my insurance card and contacted my agent (who is an independent agent) to email me a copy of my policy. He did right away and told me to email him the VIN of the new car and he would update my policy. I did so after I got home. I have not heard from him in anyway shape or form since. He has never responded to my initial email. I've called his agency dozens of times and left many messages. Voicemail every time. I've driven down to his office. Door is locked and no one is there. He could be on vacation or abducted by aliens. I have no idea and no way to contact him personally. I contacted QBE directly multiple times and they apparently can do nothing for me and have told me all policy changes must be made through my agent. They were able to verify my payment which was the exact same as it was for my Scion which leads me to believe the policy was never update Finally fed up with all the bullshit I contacted my credit union on the 30th and told them to block the automatic withdrawal as I have no interest paying insurance for a car I no longer own and no interest working with an agency who won't work with me or an agent who won't communicate. Unfortunately my credit union said the automatic payment was all ready pending and I might have waited too long to block it. Sure enough the payment was withdrawn on the 1st. Fantastic. I've all ready gone about securing insurance with another agency (All State). In a bit of irony my policy is significantly cheaper with higher coverage limits for the new vehicle (which is significantly more sporty than my old one) which only makes this situation more frustrating. At the very least I have my vehicle insured but it still doesn't solve the problem of me being unable to cancel my previous policy, and losing 180$ monthly payment for insuring a vehicle I no longer own. My credit union said I could permantly block QBE from ever withdrawing from my account going forward for a small fee, but they warned me the bill would likely be forwarded to a collection agency if so I'm pretty lost at the moment and have no idea what to do. I was afraid to tell my mom what happened so I told her it was a hit and run when my car was parked. I told the insurance company it was a hit and run and they approved the claim but recently just stopped payment on the repairs and rental car because they're investigating it now because the pictures of the car seems like it was in motion. They are sending a claim adjuster to take a recorded statement from me this week. I want to call them tomorrow and tell them what happened but am afraid as to what they can do to me. I drifted to the left lane and hit the guardrail, a patch of grass, and the curb. No one saw it. A police report was not made. It was pitch black out and no other cars were around. I panicked and called my insurance company to tell them that my car was parked on the street and involved in a hit and run and that there were no witnesses. The auto body shop I brought my car to took pictures of the damage and sent it to the insurance company. I got a rental car and they approved the claim. Parts were ordered and work had begun on the car. A few days ago I got a call from the adjuster saying that they need to come take a recorded statement from me because it looked like the car was in motion when the damage happened based on the scrapes on the tires (which it was). They stopped payment and put the car on hold till they finish their investigation. I don't know what to do! My parents tell me to stick to my made up story but I don't want to go to jail or have something bad happen to me. I'm scared and have never done this before. Please advise! Posted: 01 May 2018 08:56 PM PDT Hi, trying to figure out what my options going forward trying to find reasonably priced insurance may be, who the best providers may be, and how I may be able to lower my premiums. Back in early September '16 I was involved in an accident where I fell asleep at the wheel and swiped a box truck, and my car went into a divider, totaling it, no injuries. I was living in Ohio at the time and I bought a new car and was able to continue with my provider, State Farm without much of a premium increase. I also received a <10 speeding ticket in May 17, again without any noticeable insurance increases. Fast forward a bit, and I moved to Los Angeles in October of 17. Finding new insurance at this time proved to be a challenge as State Farm would not insure me in CA with the two incidents. I ended getting insured through National General in December about when I switched my license over. Unfortunately, in late January of this year, I was involved in another accident. Traffic was blocking my view at an intersection with a 2 way stop, and I ended up involved in a slow speed accident while crossing through the intersection, my car was again totaled, though again there were no injuries. For the past couple months I have used public transit to get around and it wasn't too bad, but recently my work opened a new office which is not on a rail line, and relying on the bus has increased my commute to 2+ hours. I'd like to get back to driving but am afraid of the premiums that I would likely face with my history. I heard motorcycle insurance can sometime be cheaper, so I did take an MSF safety course, which I passed and could now get my endorsement with just doing the written test at the DMV. I've been playing around with online motorcycle insurance quotes and have gotten everything from $600/year (great) up to $32,000/year. (Obviously not so great) I'm not really sure what to believe here and I don't want to end up in a situation where a buy a vehicle, motorcycle or car, and end up in a situation where I can't afford the insurance payments. So it's not a great situation I've put myself in. Am I completely screwed here? Is there no way for me to reduce my premiums other than waiting another 16-24 months for the first accident and speeding ticket to stop effecting my insurance rates? Are there any other options? My doctor is new to me, I have new health insurance, and like I stated in my title, I forgot my lab work wasn't covered by it. I saw my new doctor yesterday and he said he was going to order lab work done since I'm a new patient. I'm over here being dumb and forgot until right now that my new health insurance doesn't cover lab work. Great. So after the doctor was finished the nurse took me to the in office lab. There the lady drew my blood and I was set to check out. The never showed me what labs were ordered or the prices of them. I don't even have a list so I'm expecting some crazy high bill that I can't afford. Right now I'm unemployed still living off of my savings and tax return. Getting a job is something I'm looking into but I know I won't have one until June at the earliest due to some events. GEICO refusing to pay out motorcycle Posted: 01 May 2018 03:49 PM PDT I got into a motorcycle accident while the other party involved was clearly at fault (cited and everything). There were disputes regarding liability, ended up going through litigation and was settled outside of court. I received a medical settlement for injuries sustained and property damage was going to be settled as well. The adjuster told me in order to get my payout I had to get a salvage title on the bike. This was on a Thursday. I get down to the DMV, salvage out the bike and provide him proof of salvage title 10 days later on a Monday, he then claims that the property damage was settled within the medical settlement upon following up Tuesday the day after over phone, as he ignored my message on the Monday. He basically tells me there is nothing he can do. Is there anything I can do here? I would not have gotten a salvage title here if I knew I was responsible for selling the bike myself. Had my lawyer follow up with him, my paralegal and he's deflected saying he can't help us we need to talk to the lawyer that was on the case for GEICO. She told us that it's exclusively the adjusters responsibility and their supervisor. Things that particularly anger me is that the adjuster a) took out like 20 mins prior to me salvaging the bike to explain why he needed it, how it's the only way I'll get my payout b) failed to inform me about the medical settlement ordeal until AFTER I salvaged out the bike 10 days later c) basically is telling me and my legal council "sorry sucks to be you" or deflecting blame on others. Some other things that might be relevant: I had to sign 2 different settlement agreements, one for medical and one for property. The property settlement was what me and the adjuster were talking about and what he mentioned he needed a salvage title for. It had the agreed amount for my payout and everything. Other insurance company denying liability and asking for statement- car accident Posted: 01 May 2018 07:03 PM PDT I got in a minor fender bender a few days ago. While I was mid-changing lanes, a car hit me on my rear left. I know for lane change collisions normally the one who is changing lanes is at fault, but my case is that I had determined it was a safe lane change (they were over 2 car spaces behind me and the other car), signaled way ahead, checked mirror+blindspot, and the other driver was speeding. What they have against me is that I changed lanes over a solid white line, but from my research it seems that this is not illegal (I'm in California). We did not report the accident to the police (mistakes were made, this was my first accident). I know this accident is a very gray area with things not looking too well for my side. The other insurance company is denying liability and says that I can give a statement to make them potentially reconsider their liability decision. From what I've read, it seems like giving the other insurance company a recorded statement is almost never a good idea. What would be the best thing for me to do here? Should I give the other insurance company my statement? Would it be a better idea for me to give them a written statement/is that possible? Didn't call cops until after the fact (My first accident, lesson learned big time). Spoke to a cop and said he would file an event report. Now, my claim has been filed with allstate, my insurer, and my car has been repaired. However, it appears the event report was never filed, and has no information from the other driver. The other driver was not there when the cops were there. His insurance also does not have his policy number on it, insure on the spot. I got a report from the police department in IL where it happened, as did my claim adjuster. None of his information besides his name is on it. Claim adjuster said to send her picture of his license plate, which I did. I have event report and officer name still. Do I have any place in calling the police department and asking for his information? Or why a claim was not formally filed? Claim adjuster has all of this information as well, and was only able to get call log and driver's name. Of course the driver will not answer her calls. Should I call him? Or just let her handle it? Beginning of April 2018, my brother was driving the car and got into a wreck(supposed to be other guys fault, but apparently they are blaming him). He stopped his insurance(same company as me) 1 month before the wreck(he's an idiot).So now, I am getting the threatening letter saying there's "a claim against you" from my own insurance company. Posted: 01 May 2018 06:59 PM PDT Back in late February, I rented a car from Enterprise, and ended up scratching and putting some minor dents in the front quarter panel. I didn't get the CDW, because between my primary liability insurance and my secondary coverage via my credit card I have no need for it, and the one other time I damaged a rental car everything went smoothly. Anyway, there have been some hiccups, and my primary insurance provider has initially denied coverage (for reasons I don't understand since it's not clear to me that there are any relevant differences in either the situation or in the terms of my policy, and I'm working with them to at least understand it so I know going forward, if not actually get them to cover it), but I spoke with the credit card company and they said they if that doesn't go through then, yes, they'll cover the remaining charges (they've already refunded my deductible, which I paid the rental company when I returned the car). Problem is, the rental car company called and emailed today demanding payment (the last time they contacted me, I responded explaining that my insurance companies were still sorting things out--as they still are right now, in fact--but have heard nothing back until today's demand), saying that if there's no payment in 10 days they'll turn it over to collections. The outstanding balance is only a few hundred dollars, and I'll have no problem paying it out of pocket up-front (in fact, I'd probably put it on my credit card to get the points, and then log in to my credit card account and pay it off so I don't have to pay the interest). My concerns are, however, is that if I do so I'm afraid I might forfeit any right to coverage for this incident. If by paying myself I'd forfeit any right to coverage, then maybe I should wait a few days, but if doing that wouldn't change anything then I can go ahead and pay Enterprise right now and be done with that end of it. Posted: 01 May 2018 12:12 PM PDT My doctor pulled me from work when I was pregnant due to two conditions: anxiety and threatened abortion (potential miscarriage). Doctor submitted the claim as anxiety since the form only allowed one diagnosis, but made clear that the threatened abortion was also a concern. Short Term Disability (STD) claim was denied saying anxiety was "due to a situation at work" and I appealed with a 4 page letter from my doctor rebutting what they claimed in my case file, along with a letter from my midwife and my coworker, all affirming my case. They have now written back and it is clear they are posturing to deny the case but have not outright done so, giving me one last chance to submit any additional documentation/letters. They have all but said they are ignoring the threatened abortion diagnosis since the reason I was taken out of work was the anxiety. The whole picture paints a disability and the threatened abortion clearly indicates I needed rest/removal from work but they are clearly cherry picking and addressing only one diagnosis in order to deny the claim. They say the standard of care is medications, which my doctor didn't feel were appropriate given the pregnancy and said so in the appeal letter. No matter what we say, they either ignore it, or rebut it. I can't believe that this is being denied, given the literal life or death situation I was presented from both my doctor and midwife. Am I supposed to choose between my unborn baby's life and my income?? That is what the insurance is supposed to be for in the first place! My questions are these: 1. Is there anything I can do that might result in getting this claim approved? It seems like they just want to deny, deny, deny regardless of the evidence presented by my medical providers or others. 2. Is it legal for them to just ignore the second diagnosis? Posted: 01 May 2018 01:41 PM PDT Posting for my girlfriend who is pretty stressed out about this. What happened: She had an IUD that was causing pain. Had that one taken out, and had another one put in. That one also hurt. They took that one out. She had mysterious issues that at least one doc thought may be PID (pelvic inflammatory disease) caused by the IUD (we both came back clean for any STDs, so it wasn't STD related PID). That was treated, but she still had pelvic pain -- like a 4-6 level of pain, daily, all the time. She's been seeing a lot of physical therapists -- one for her shoulder (unrelated to this), but the same one also did some pelvic floor physical therapy to help address the pelvic pain. She also saw a dedicated pelvic floor therapist, and a uterine massage therapist, for the pelvic pain. So, a lot of different physical therapists to try and get to the bottom of this issue that western doctors seem to be clueless on. Likely some form of adhesions based on trauma from the IUD insertion. We got a letter (similar to the one described in this post) asking for her to weigh in on if she thinks another party may be responsible for whatever is causing her to need all this physical therapy. The truth is, she thinks the OB clinic that put the IUD in in the first place made mistakes. And that the IUD insertion or removal caused some damage, likely the PID, perhaps the continued chronic pain. She hasn't decided if this is something she wants to litigate. We don't know yet, but what happened could also impact her fertility. Now we have this letter, and she's concerned that there may be gotchas in responding. She wants her insurance to cover this, and wants to reserve the right to sue the OB clinic down the road if she feels she has the emotional energy for it. What's our best course of action? We both moved to the shoulder of the highway and he immediately began blaming me for the accident. I take pictures of the damage (very minor) and within a few seconds he recommends that we should get off the highway and meet at a nearby gas station. I said no and took a picture of his license plate. He had temp plates so I was able to get the year, make, vin, and temp license plate number. He took off so I called the cops. The operator recommended not to follow him but to get off the highway and meet the officer at a public place close by. The officer filed a report and this morning I submitted a claim with my insurance. I've never been in a situation like this before so what's my best play? One night I had to to brake quite suddenly and was rear-ended shortly after I had come to a complete stop in my lane. I exchanged information with the other driver. Police were also called but the officer only took our information and statements, he said no report would be made (I believe the reason stated was the damage not being big enough). About a month after returning the car, I received an email from the rental company's claims handling company asking me for a recorded statement over the phone. I called them and stated what happened. After I finished my statement, the rep informed me that the other party had reported that I had made an unsafe lane change into the other driver's lane right before (or during, it was not clear to me) the collision and I was therefore partially at fault. I stated again that this was absolutely not true; there was no unsafe lane change prior to the collision and I had already been traveling in that lane for about 30 seconds minimum prior to the impact. She said an investigation would be carried out. Fast forward another month and I receive a recovery letter indicating that I had been found 25% at fault, seeking about $400 in damages that had been paid to the other insurance carrier. I was never consulted again before this decision was made, not even by the other insurance carrier. I have emailed the claims company saying that this is incorrect, as the other driver should be 100% liable in a classic rear end collision. My emails were not further answered except that I received another reminder that the amount must be paid by this date or it would go to collections. My questions are: 1) Do I have any recourse against this 25% liability decision? Since the accusation that I had cut the other driver off is completely false, they must have taken their word for it and not believe my recorded statement. How would I go about disputing the decision? 2) Is it normal that the insurance companies settle for their shares of liability without further consulting with the parties involved, even when the decision clearly contradicts one party's verbal statement and they have no proof that this party was lying (which would be me in this case, and I was stating the truth)? New driver with a car insurance question. Posted: 01 May 2018 10:57 AM PDT I just passed my drivers test and my girlfriend and I want me to be able to drive her car (I have been driving it with a learners permit for over a year and am very confident and capable behind the wheel). We are 26 and 27 years old and the two of us are currently living together (that may change in the near future). As I understand it, in that situation I would have to be added as a driver covered under her insurance policy, but there's a problem there. She is insured under her Dad's insurance policy with USAA; her father buys and insures all the family's cars under his policy and then adds each family member as covered drivers while they gradually pay him back for the cars. I presume once they finish paying him for the car they will then be the sole owner of the car and will get their own policies (I think that's how it works). I have a good relationship with my girlfriend's parents, but I don't think they would be comfortable adding me to a family policy/I wouldn't be comfortable asking and I don't know if it's even possible since I'm technically not a family member, I'm just living with the policy owner's daughter. I was hoping it would just be possible to get separate insurance allowing me to drive her car, but it doesn't seem like that's possible? I've read that living together means I can't just drive it as someone with permission to drive it (I need to be added to the policy), but I don't live with the policy owner (the father), just one of the covered drivers. Posted: 01 May 2018 08:04 AM PDT On Sunday I was at work and we heard a big boom, I ran outside and saw what I thought was a two car accident as my manager and I were walking toward the accident we notice a truck that was on its side about 75 feet down the road I ran down and convinced the guy to stop kicking his window because his truck was on a hill. We got his door open and he has a dog stuck in the truck with him. He handed out his dog and she stood next to the truck. I had her collar as everyone started to arrive she got spooked. She bit me pretty bad. I went to the er and had to get it cleaned and looked at, there's no broken bones but I could have some nerve damage. As I was at the er the cops came in and notified me that it was actually a puppy. A cane corso and I was lucky that it wasn't full grown. When I was being discharged they went over everything and with me and I found out the guy who's dog bit me was at fault for the accident and he was drunk. I work two jobs, one of which I cook and the other I type all day. I can't wear gloves and typing enough to keep up my quota hurts.
