Itinerary: leave from NYC, stop in Florida, go to Bahamas, return to NYC We left from NYC, and went on an excursion in Florida. We missed the boat in Florida, and never went back on the boat. We just picked up our items in New York when it returned. Now Norwegian is charging us over $1400 stating it's a fee from US Customs citing the "Jones Act". From what I've read it supposedly applies to cargo going to non-US soil. But I could be wrong. Are we liable for this fee? We missed the whole vacation, and just went from NYC to Port Canaveral in Florida. We never even got on the boat again (the crew brought our baggage to the port"). This seems ridiculous. Power company caused a surge which caused $1000's in damage Posted: 01 May 2018 01:46 AM PDT So we had a large storm here, lots of trees fell. One of them fell on the power line leading to our house, not actually disabling it, but the power line was down to the ground with a tree on top of it. So we call the power company up to fix this and some contractors come over, they fix that, and they also chainsaw down this post that was holding up the power line near our house. I only include this detail because I have no idea why they did it, but they might have had a reason. This is annoying though because we're having difficulty getting them to reinstall it, which needs to be done. At any rate, at some point in what they were doing, they caused a massive power surge to the house. Lightbulbs that were off sparked. There was a smell of burning everywhere. Fire alarms went off. We were fortunate in how many devices survived, but we suffered a fair bit of damage that I feel would have been mitigated if they just told us to shut off the power first. We lost a drier that's easily worth over $1000, an expensive sound bar, tons of lightbulbs. They killed a box on the furnace which was $700 to replace on top of installation fees. They killed our security system. They killed our internet/phone which also required having someone come in to replace parts. TX eviction - tenant leaves 2 tons of dirt? Posted: 01 May 2018 08:37 AM PDT I let a construction worker stay on my property for free for a month. He refused to leave after 3 months and I was forced to evict him. Now he has 5 days to remove his things from the premises. Problem is, one of his "things" is 2 tons of dirt. He is saying he can't remove it before Sunday. What do I do here? If I file a writ of possession, I have to move his things. Am I really responsible for paying someone with a frontloader to move 2 tons of dirt into a public right of way? I will use this dirt if he leaves it, it's a fairly large property. Babysitter left daughter in car (Update) Posted: 30 Apr 2018 10:16 PM PDT Hello! Sorry I hadn't updated sooner. The sitter was charged with Child abuse(after being allowed to go back to Taiwan for a couple of months before the trial started) She got 6 months of probation. It wasn't a lot but it's better than a slap on the hand. Last I heard she went back to Taiwan after fulfilling her legal obligations. Which is good, since I worried about the other children she was watching. She did try to text me after to apologize/ make excuses but I blocked her on all social accounts and communications. Thanks for all your kind words! Little Miss is very happy and healthy! Original post below: As the title says, my babysitter left my daughter on her car today for 2 hours. Fortunately a passerby called the police. The worst part is that she has a daughter the same age and only left mine in the car. She is being charged with child abuse. The officer said if it had been any hotter today my daughter would have died within the hour. She was flushed red and screaming her head off when the officer got there, fortunately one door was unlocked. They checked her out with the ambulance and she is okay. The worse part is that she admitted to the officers she has done this before with her/my children. CPS is investigating her home. Can anyone tell me how this process works? The police officer explained vaguely. What do I do if she contacts me about payment or in general?? Where do I i find out information about court, pleas, etc. I'm sorry if this is a mess. Landlord says I am terminating my rent controlled apt early Posted: 01 May 2018 07:33 AM PDT Good morning r/legal advice. I signed a lease for an apt in Los Angeles California in late 2015. The lease states that after living in the apt for 12 months you are paying month to month until termination of lease. Well I need to move for work and notified my landlord of I will be moving and he informed me that I would be breaking my lease and would owe him $1825. He says that in oct 2017 they posted a "30 day notice" on my door stating that there will be a rent controlled rental increase and by staying in the apartment your rent will increase for 1 year. We did not sign anything. At the time we understood this as meaning our rent will be higher for the next year, and we thought we would be paying month to month still like our lease says. However our ladlord says that by staying in the apartment we agreed to lease for another year and if terminating that agreement we owe $1825 for an early termination fee. My question is: is this legal and standard landlord practice? Where do I start in arguing this? I have 30 days and enough time to seek legal advice edit: The exact words on the lease I signed in 2015 are " [Checked box]: Resident has been granted an EARLY TERMINATION OPTION. To exercise this option Resident must pay and Early Termination Option Fee of $1825 and give notice of Resident's election to exercise this option at least 30 days before the Early Termination Date. The Early Termination Date must be between 11/30/2015 and 73116.00. (typo?) Landlord may require Resident to sign additional documentation if Resident elects to exercise Resident's early termination option. AFTER THE TERMINATION DATE, this agreement will continue on a month-to-month basis until terminated as specified elsewhere in this agreement. On pg 6 this is continued under Term primary agreement terms: If the variable lease term section IS checked to indicate an automatic continuance of the agreement on a month-to-month basis after the Termination date, the agreement will continue after the Termination Date until either party terminates the agreement by giving the other party at least 30 days written notice, or as otherwise specified by law. The exact words on the 30 day notice given in 2017 are: "Dear Resident(s): We want to thank you for calling x your home! As the community falls under the Los Angeles Rent Stabilization Ordinance, the City allows the Landlord to adjust rental rates on an annual basis. The rent increase for the current year is 3.0% of your current rent. Mom stole my identity, have tons of debt Posted: 01 May 2018 12:09 AM PDT Hi all, I went to download my annual credit score for the first time (I'm a youngin) and my mothers name popped up along with tons of various loans and bills that were left with unpaid balances. I have no idea where to possibly proceed from here. I don't want my mother to face legal repercussions, but my own name isn't even associated with my ssn, along with the fact that there's no 20k in debt associated with it. I haven't confronted her yet, help. Im in Michigan btw tl;dr Mom used her name but my ssn, have acquired tons of debts, don't necessarily want her to face criminal charges, what do i do/what should i expect? Update: My mom is playing dumb, and pretending she has no idea what happened. Saying that she used it for 1 job as a mistake once and had her identity stolen once and maybe they got my ssn. Have no idea what to even say, because theres no way. Update: I guess more information I should include; this happened from 2011 to 2014, before I was even 18. Theres been nothing since then, so I'm not concerned about it happening again. This is going to sound really atrange, but a couple of nights ago my family noticed that two of our very shaggy dogs had been shaven down. We asked everyone we knew whether they had done it, but everyone said no. We asked our renter if she knew anything about it, and she claimed that she saw the backyard gate slightly open the night before we noticed our dogs hair had been cut. We haven't asked any of neighbors about the incident yet. To add to the weirdness, there was no hair left behind-- not one hair. One of our dogs is especially squirmy, and I find it difficult to imagine anyone cutting his hair. The hair cuts were fairly well done-- whoever did it, knows what they're doing. Phone company says we owe $3000 in cancellation fees, but we finished our contract. Please help! Posted: 01 May 2018 07:53 AM PDT For context, we live in Ontario, Canada. So, my parents are small business owners and they signed a contract with Bell Canada 5 years ago (for a five-year contract). They finished this contract, and then went to move their business to another building unit. Upon doing so, they registered with another telecommunications company (unsure of which one exactly). A few hours ago, my mom received a phone call from Bell saying that they owed $5000 in cancellation fees, but she was willing to give them credit and they only had to pay $3000. My mom was very confused because as per her knowledge, they finished their contract. However, the lady on the phone said they "sent a letter" to her in February stating that their contract would be renewed. My mom never received this letter. She is very organized and meticulous with every piece of mail that comes through the office, because she's the main office admin and she interacts with every courier right at the door. She is 100% sure she never received mail. She also never received any phone calls about this renewal of contract. The lady on the phone was very short/rude to my mom, stating that "We have thousands of customers, you can't expect us to call and chat with every single one, you owe $3000." and other things of the like. [LA] Stolen iphone found in vehicle Posted: 01 May 2018 02:42 AM PDT This afternoon I was arrested at my workplace after a stolen iphone was found in my glovebox. I really have no idea how it got there and the only explanation that I can think of is that my 10 year old daughter found it and placed it in there this morning and forgot to tell me. The story is this morning we were waiting for the bus. My daughter has a bus stop at a local cafe and we drive there as it is a few miles from our house. While we were there waiting a paramedic asked if we had seen his iphone. I had not so that is what I told him. Later on the guy shows up to my workplace with the police, at first the police say that I am lucky as he won't be pressing charges since he just wants his phone back. When I go outside to open my car he changes his mind and now wants to press charges. I was arrested and the charge they are pursuing is "[14:69 (FELONY)] POSSESSION OF STOLEN THINGS." I am mostly wondering how difficult would it be to dispute the charge and hopefully not have to deal with any of the repercussions of a felony charge. Like everyone else I cannot afford to go to jail and lose my job. My wife is 5 months pregnant and cannot work at the moment. I really have no clue how it got in there. Posted: 01 May 2018 01:16 PM PDT I'll try to keep this as straight to the point as possible, but it has been suggested that I post here owing to a situation that has occurred regarding my college work. If you're interested in why this may have happened and the person behind it, feel free to check my post history. I am a student in Pennsylvania who recently submitted their final piece of work for a final grade. I was contacted by my college department regarding an issue with my project, presenting it as an administrative issue that I would need to correct in person. When I actually arrived for this face-to-face meeting, I was taken to the head of my department who told me that the college had reason to believe that I had paid for someone to complete my entire project; they had received an anonymous tip off from the supposed writer themselves. Now of course I did not pay for someone to do anything of the sort, and explained that I had hours and hours of work (eg. citation notes, rough notes, tickets for travel to research locations etc.) that I would gladly present this to them. I was told that the anonymous 'writer' had explained that they had sent me 'evidence' to use in case I was caught, right down to old bus tickets. I asked why they were choosing to believe the word of a stranger, and I was told that when the anonymous person was asked that same question they were able to recite word for word my opening paragraph to my project. I was then pressured into 'confessing' for a more lenient punishment, which provoked a panic attack. I excused myself to go to the bathroom to compose myself, when it was more luck that judgement that my partner contacted me to say that he had received a message from someone who had recently been harassing us both saying that they had heard about my plagiarism and were disgusted at my apparently deceptiveness. I don't want to go into detail here, but this person is my partner's mother, and my 'mother in law'. I should explain that I occasionally used my partner's computer when completing my project out of convenience - he also had a finished, saved copy of my project saved for if my computer/flash drives/online storage all deleted it. It is now clear that her mother had gained access to my final project and saved it or sent it to herself. However, it was impossible for his mother to have known about my 'plagiarism' as I had not had the chance to mention it to anyone, and she knows no one who would have mentioned it to her eg. college staff. I returned to the office, showed the message to my department staff, and asked if the number that had contacted them about my 'plagiarism' was the same as the number I had for my mother in law. Unsurprisingly, it was (she is not smart enough to have used an untraceable number). I asked if anyone had told my mother in law before me about these accusations, which of course no one had, and then explained that this woman had been harassing myself and my partner, and it was clear that this was just the next step for her. Apologies were quickly made by my department, who said that they would take into consideration the reasons for apparent 'anonymous' callers in the future. While I am annoyed with how my department handled this, I understand that this was their job, and that their presented 'evidence' was rather clear, though obviously not valid. My issue is with my mother in law - we have had to contact the police before as she has reported that I am keeping my partner at my property against his will (I am not, he is an adult who made the decision to leave his parent's house and move in with his long-term partner), however I am well aware that 'lied about someone faking their work' is not a crime. First time ever posting in any major sub like this, so I'm sorry if this breaks any rules or anything. This is an insane situation and we just need some kind of guidance on where to start. Long story incoming... Our home went on the market back in January. We got an offer fairly quickly, but during the inspection there was allegations of termite damage. Very common in the state we live in, home is 30 years old. We called a pest company, and they were out within 3 hours. An inspection is completed, and they tell us the damage is old, but will treat anyway. A termite bond is given. Buyer backs out anyway. Fast forward to March. We get a new offer, this time financed through the VA (first mistake). We are not informed of the strict requirements set forth by the VA, and accept the deal. Inspection is completed 3/19 (within the 7 days) , and comes back with a list of repairs that will cost us around $2.000... This includes visible damage from a recent storm. We accept the repairs. Termite bond is also provided, as well as an explanation of the situation. Inspector report notes that a WDO inspection will need to be done. Septic system is inspected, house is appraised. Buyer then submits an addendum to move closing from 4/25 to 4/18. Buyer is being deployed to a military training. We agree, but let it be known that we cannot guarantee storm damage will be repaired. Our agent says no problem, I as the seller will just continue to maintain that company contract and get the repair done. Easy peasy. Appraisal comes back fine. Storm damage is noted as needing repair. It's also noted that they understand the circumstances and will just need an estimated completion date. We move out and into the apartment we've rented on 4/14. Storm damage is repaired on 4/17. At 5pm on 4/17 we are informed that the VA will not allow us to close the next day due to the repair taking so long. An addendum is submitted to us on 4/21 which will move the closing to 5/1. The buyer would also like to arrange a pre-occupancy agreement so she can move in before training. She agrees to pay us $500 and switch utilities to her name. We agree. Major mistake. Buyer allegedly now arranges the WDO inspection on 4/25, after taking occupancy. They did not inform us this was taking place. Inspector alleges to find live termites and rips a baseboard off our wall in the garage. Termite company comes out, finds 1 dead termite. No structural damage, dry mud. Termite company treats the area anyway and calls the buyer's agent to inform them of the findings. 4/27 our agent coordinates a meeting between termite company and the buyer's agent to explain the situation and provide them with a clear WDO. Buyer's agent cancels the meeting with no notice, just doesn't show up. Buyer submits a release and cancelation of the contract for purchase. They cite the now denied approval of financing (loan approval period ended on 4/13), a failed inspection (inspection period ended on 3/30), and failure to disclose termite issues (bond and treatment paperwork was provided on 3/20). Submitted with the cancelation was a disclosure that the buyer's mother and dogs were residing in the home. They cannot leave the home until 5/15. They also state they "feel it's only fair" that the buyer be refunded all their earnest money due to expenses related to inspections and moving. We state that they can stay until 5/15 with a payment of $1,000 and a security deposit that will be refunded after an inspection on 5/16. We also state that we will not agree for the release of 100% of the earnest money back to the buyer. Buyer's agent stops returning communication. This morning (4/30) my agent reaches out to the buyer's agent's broker due to lack of agent communication. Buyer's agent gets pissed. We explain that we know there are now dogs present (heard them during termite thing), have no information about whether or not occupants are smokers, no way to know what they've done in the house, etc. Also state that if they are unable to produce all keys, garage door openers, etc. then we will request they pay to replace and rekey everything. Buyer's agent finally responds with a bullet list of things discounting any of our concerns regarding the condition of our home. Agent also states that mother now will not leave until 5/25, when buyer returns from training, and the buyer is only willing to pay $500. Also demand a time frame of notice for showings, etc required to sell the house to take place. All this is only valid with immediate release of earnest money back to the buyer. I called the sheriff's department and they cannot trespass the mother because we willingly gave someone the keys to our home. So, here we are. Someone is essentially squatting in our house seemingly under the protection of the military and military training. We don't even know where to begin to get these people out of our house. Obviously a lot of mistakes were made on our part and our agents were not 100% honest with us about the implications and risks in each of the things we agreed to. We cannot change that now. Ex girlfriend threatening legal action Posted: 01 May 2018 07:14 AM PDT My ex girlfriend whom I dated for approx 9 months is threatening me with legal action for something that she refuses to divulge in nature. She threatened me about a month ago with lawyers and nothing happened, and has now threatened me again. She has stated that I should look forward to a specific day this month because my "life wiill be forever changed." Then she emailed me again asking for my new address so that paperwork can be sent to me or else she will have it delivered to my work and claimed that it will probably get me fired. I cannot think of anything illegal that I have done to/with her that would constitute such claims. I also have emails from her apologizing for everything and stating that the ending of our relationship was her fault and not mine, yet she continues to threaten me. She also claims to have been pregnant, after our break up, and had an abortion. I offered to pay for my half if I was provided with a billing statement, but have yet to receive one. I also told her I would go with her to have it done but I could not that week because of work. She claimed that she was going to have it done before telling me about it in the beginning. And also was going to try and force a miscarriage by starting back on birth control. She has stated that she just wants me to be as miserable as her and will do whatever it takes to make that happen. I have blocked her on all social media and her phone number. I also have not replied to any of her emails since the last time I spoke to her via text, which was a month ago. How much say does a 16 year old have over custody? (CA) Posted: 01 May 2018 12:44 AM PDT My ex husband and I have joint custody of our son. He gets majority physical custody, I have him summers and we switch off on holidays. We live a long way apart. Due to some changes in his dad's household (new fiance and her 4 kids moved in with them), my son't relationship with his father is crumbling and he wants to move out. Example issue just to give an idea; a few months ago my son's dog died. He'd had that dog since he was 4. He was absolutely crushed. He called me in tears when it happened and then again a week later because he kept having dreams about his dog. He would be searching for the dog, and just as he'd find his dog, the dog would vanish. It was horrible. Well, a week and a half after the dog passed, his dad pulled him aside. He told my son to stop being so negative. The if he didn't stop it, the fiance would leave. He told him that this was his last chance for happiness and if she left, it would be my son's fault. He was crushed. At that point in time, he told me that he wanted to come live with me. I talked to him at length about it ( I would be VERY happy to have him here) and after talking he decided he would stay at his dad's for the rest of the school year and take that time to decide if he still wants to leave. It's a few months later now, and he's more sure than ever that he doesn't want to be there anymore. Given the distance and the circumstances, how good of a shot do I have at getting him? I'm going to try no matter what, but I'm also frightened that this will end badly. Today: Looking disheveled from 48 hours of studying, operating on four hours of sleep and a crushed will due to (probably) failing my trig final I was making my way out to my bike when I man with a badge came up to me. I joking said "Oh no, what am I in trouble for" he asked me if I should be in trouble for something. I pointed to the fact I was illegally parked. He identified himself as FBI and wanted to ask me about what happened on Thursday. Made a joke about "how'd security describe me, the bike or the beard?". He didn't appreciate my humor so I nipped that in the butt real fast. He said the security chief said I was acting strange on Thursday about the graffiti. I repeated to him what was said on the wall. He explained that it was a dumb idea to erase it. I told him hindsight is 20/20 but he knew why I did it, I didn't think it was credible at the time. I told him I didn't want to be involved anymore since it was the next week and I didn't appreciate being ambushed in a parking lot. He asked me why I didn't want to talk [Mistake #3], I told him I didn't do anything and didn't want to be bothered he made a big deal about how "I never said you did anything, why do you think you did something" (repeated over and over every time I told him I didn't want to be involved) he persisted on why I didn't want to talk so I basically said "look man, I'm from Philly. I don't like talking to cops, it rattles me". He told me I can leave any time I want. I decided it would be mad sketchy for me to jump on my bike and peace so I asked him if their was anything else he wanted to know. He asked a couple more questions about the graffiti and then started getting confrontational. He talked about how stupid it was to erase it, I asked him if it made a difference since I gave them a verbatim write up of what it said. He said they like to do fingerprinting and pictures, I told him it was a bathroom wall, he wouldn't have got anything from it and apologized for erasing it again. He said it was weird I wasn't taking it seriously and I wouldn't go find security when I saw it. I repeated why I didn't think it was credible and told him nothing was going to come of it. He asked why I was so sure, I told him it's finals week, theirs a million cops on campus and nothing had happened. He said the date on the wall hadn't come yet, I told him the only thing I saw is "finals week" on the graffiti. I told him I wanted to leave so he went away. I have to admit here that I didn't keep my cool at all, the guy kept pushing and I lack a filter sometimes so their was some cursing. Nothing at the cop himself, but I may have used terms like "bullshit" and "fucking" a few times. I was visibly nervous during this whole exchange, which he kept pointing out, but in my defense "Hey I'm from the FBI we need to talk" is like liquid nitrogen when it comes to breaking the ice. After he left I called up campus security in an attempt to remove myself from all this. They asked me to come down so I did. I met with the security chief and told him I was as cooperative as possible on Thursday, it was finals week and I didn't need all this shit stressing me out. Security chief said he was just doing his job and said [Neon Red Flag With Blinking Lights] "I won't lie to you, its extremely suspicious that you'd erase something so serious". Ignoring the fact that the security officer let slip on Thursday that their is a history of this type of graffiti and nothing ever came of it I told him I understand, but I don't want to be involved. He thanked me for being cooperative. The FBI guy came in (with a noticeably less abrasive demeanor now that he was in front of his peers) and explained that "During big investigations we can call people in dozens of times" in response to me getting annoyed at being hassled. At that point it dawned on me I wasn't doing myself any favors talking to campus security, so I basically put on a "whatever you say, man" act and left. Closed on a home while it was flooding (Missouri) Posted: 01 May 2018 10:34 AM PDT I purchased my first home today, but when I arrived at the home 4 hours after closing, there was water streaming through the ceiling. The floater in the upstairs toilet was disconnected due to poor a connection/pressure build up. A steady stream of water was running down to my basement, through the floor below. Immediately after I called my insurance thinking this would be on me, however, it was clear that water had been running for quite some time. My loan processor reached out and said she forgot a signature on the ALTA, which means financing has not gone through... do I legally own the house? Am I liable even though it may have started prior to me taking ownership... do I even have ownership at this point? Should it go on my insurance? Welcome to homeownership! Neighbor fighting with me about the property line. Posted: 01 May 2018 09:54 AM PDT My great-grandfather built the building I live in currently(Chicago, IL), and the building next door. He put up a fence to separate the two buildings, and at the time we owned both so, to him, it did not matter where the fence went. Today, we only own one of the buildings but we kept the fence in the same place. I wanted to redo my backyard, and someone suggested getting a surveyor so I did and my backyard extends about 2 extra feet. The people who are redoing the concrete in my backyard were scheduled last summer, but we couldn't get a surveyor until now. I let my neighbor know that I was going to be extending and she is fighting with me and telling me I have to wait until she can find her drawings and she can get her own surveyor. I can't postpone because I had to wait so long to get an open spot with the construction workers and this was the only time that worked for them. She has a week to find her drawings before they come, do I have to wait for her to start or should I just go ahead with it? Do I have a legal responsibility to wait for her? It is my property. They have a much larger backyard than I do and my extension won't be interfering with anything in their yard. I am a 1099 employee with enough saved up, but is there legal recourse for the accountant not informing me of this deduction he assumed? I in no way, shape, or form mentioned paying quarterly taxes last year. When he originally filed he called me to tell me the great news about my original tax bill being lower than anticipated. Dentist broke jaw and did bone graft without record Posted: 01 May 2018 11:15 AM PDT My fiance recently got dental implants done. During the procedure the dentist, from what I gather, fractured his jaw and had to do a bone graft. He mentioned the graft would cost 1700 but he would do it and not charge us. My fiance is too nervous to ask for a report on what work they've done and not done and my worry is that this dentist didnt report the bone graft. When I first asked my partner he said the dentist said not to tell the front desk because this is free work being done. If anything goes wrong here we have no ground to stand on without proof. My partner doesn't want to start anything because he has a lot of work coming up for his dentures. The dentist also didnt sign the prescription label with a name and birthday which caused a big issue with the pharmacy as you could guess. I had to go back and get a new prescription. That gives me the impression this dentist is overworked and not paying much attention to detail. Seeing as a jaw fracture can happen, I'm also assuming if he studied the x ray more carefully it could have been avoided. I want to know what I need to protect my partner if this comes down to a legal issue. My land lady is trying to have her realtors show our apartment to sell with "as much notice as possible" that she says can be anywhere from 30 minutes to 24 hours. I am NOT ok with this as I work nights, which she says sleeping during the day is "an unacceptable reason to turn the realtors away." Our lease just says "with reasonable notice" and my state (Louisiana) has no minimum listed in state Law. What are my rights here? Edit: For background, this is what went down (sorry, it's very lengthy, and if you read it you'll understand why I loathe my landlord with a passion): Text from my landlord: Ladies, I am copying [realtor 1 ]and [realtor 2] on this text so he has all of your phone numbers and so there is no confusion about what my expectations are. I have put the condo on the market to sell and it is part of your lease that you have to make it available to be shown. It is unacceptable that you would turn lou away for any reason including having an overnight guest in one of the rooms. As a courtesy I have asked the realtor to give you as much notice as possible but I fully anticipate that when they call, you will do whatever necessary to make the apartment available within the hour. I would anticipate that the apartment will be shown every weekend until it is sold so please make sure that you are prepared for this and we will make an effort to limit the showings to the afternoon when at all possible. My reply: What exactly does making the apartment available entail? Are showings limited to weekends? Landlord: Making the apartment available means that a realtor can come into the apartment and it is not presented with dirty dishes all over or trash overflowing. It means that all rooms will be open for viewing and if someone decides to "sleep in" they will be up and out of their room for the showing. Being told that someone works nights and is sleeping all day is unacceptable. We will try to make appointments after noon so if someone is sleeping in, they will have time to get up and dressed before a showing. The showings are not limited to weekends but will most likely be more concentrated during that time since parents are coming to view the property. Thanks for your cooperation My reply: [landlord's name], I understand that you are trying to sell the condo and we are all more than willing to be accommodating and are aware that it is in our lease to do so. However, I feel like it needs to be stated that we are paying rent to live here and have a purely professional relationship. Saying that it is unacceptable for us to request notice if we are working nights is unreasonable in itself. I feel like there might have been some sort of miscommunication. I told [realtor 1] that I might be working nights during surgery in June. I understand that you are anxious to sell the place but jeopardizing my own performance and likewise patient safety during my surgery rotation is not something I am willing to do. I can tell [realtor 1] and [realtor 2] if/when I am working nights when I find that information out but I think it would just be easier if we had 24 hours notice. If we are home and able to clean within an hour's notice, we can absolutely accommodate that but can't guarantee that it will happen as we can't guarantee we can be home at all times on the weekends to be able to do this. Landlord: They will absolutely give you as much notice as possible. I was told that "someone" was possibly working nights their room would be off limits. That is not acceptable. We are happy to do everything we can to accommodate your schedule when possible but if an out of town parent wants to see the place and they don't know it is for sale until they are in the community looking at other places then they are going to call you with short notice. If you give the guys your schedule they will work with you whenever possible and do their best not to disturb you. As far as being home or "able to clean within an hour's notice" my point is not that the place needs to be spotless. Just keep the sink and garbage at bay. Everyone knows it is a college apartment, not architectural digest. Please send your schedule to [realtor 1] and [realtor 2] when you get it. As far as patient safety is concerned [my name], I understand your desire to maintain peak performance during your rotation. May I remind you that you are not actually performing surgery or responsible for patient safety until you are licensed. Also, we are not saying that we are going to deprive you of sleep on a regular basis. It may happen, it may not. The point is that the condo will need to be shown when people are able to see it. I am not saying you will not get notice. You WILL get notice but there may be times when it is short notice due to circumstances and you can not just tell the realtors that rooms are off limits. When the inspector asked to look in the garage, the owner informed us there was someone living in an office in the garage. I do not believe there is a signed lease involved. Posted: 01 May 2018 09:49 AM PDT I contracted with a tree service to remove several downed, dying, and invasive trees on my property. The business owner and I did a walk through in the days prior to service during which he marked all trees to be removed with orange tape and developed a written estimate that specified which trees were to be removed. I agreed to those terms verbally and in text. On the day of service, the business owner, the crew, and I again discussed which trees were to be removed and those to be left in place. While in the presence of the crew, the owner asked if a specific species of shrub should be removed. I said no and he turned to the crew and said, OK, don't remove the chamisa. When I returned home in the evening, five ten-year-old shrubs of that species and another species had been cut down and removed. They weren't especially valuable, but I planted them myself as tiny nursery plants and they were, until yesterday, taller than I. They were part of my efforts to reclaim a denuded property with native plants. This is a challenging growing environment (my soil is clay and rocks) and they required annual pruning, water, etc. They provided habitat for native birds, which I care a lot about. I could see them from my living room couch and the space is bare now. I feel quite sad about it. I've read several of the other tree posts but this is slightly different in that I contracted to have some work done, which they did, but they exceeded that agreement and my plants were not especially valuable, unlike a 150-year-old sequoia or a mature producing pecan. Also, technically I owe them money as I haven't received their invoice yet. Does their over-reach void our agreement entirely? If not, what are my options for seeking compensation for shrub replacement and planting costs? Are there other damages I could seek, given that they required significant time and effort to cultivate and any replacement plants will likely be a fraction of their size? How do I proceed? Given different degree than promised Posted: 30 Apr 2018 05:53 PM PDT I am a Canadian and applied for a course in the Netherlands that was titled an MFA. I have various screen shots of the website, and once I was accepted, the course was always called an MFA, the professors and instructors had "MFA instructor" in their email signatures etc. The degree portal showed MFA. I graduated last June, and though my degree says the "stream" is an MFA it says the actual designation is an MA. This is a huge problem for me as an MFA is a terminal degree in my field, allowing me to teach in a university, whereas an MA does not. Sure enough, when I just logged onto their website, I noticed they have changed all the branding to an MA. Is there a possibility I may be entitled to anything? I essentially feel like I wasted two years of my life and a whole lot of money pursuing what I thought was an MFA. [link] [comments] |
