Turns out her story about picking holes in condoms and resealing them was a fabrication. Her best friend (who actually hated me) told me that she has confessed to her that she's been cheating on me to get pregnant and lock me into a relationship or marriage with her or at the very least get child support from me. The friend said she couldn't live with herself if she didn't tell me the truth even though she hates me. She also says she's no longer friends with my ex. We've broken up and while she denies cheating I told her that she's free to sue for child support once the child is born and at that time I'll get a lawyer to contest and will ask for a paternity test. I can take a pretty good guess who it's from. Background: I live in a unit near one of the pools. During the summer, this group (half live here, half used to live here) puts on full on ragers all day. And I understand noise and music by the pool, but the volume of the music is insane. We're talking rattling glasses in my cupboards and audibly discernible lyrics. I've complained to the complex management, asked them personally to turn it down, and have twice made noise complaints to the police when the office was closed. Here is what the letter read: Neighbor, Just a heads up that the pool and volleyball are back on again this summer, just like it has been for at least the past 11 summers. You pissed off a lot of your neighbors last summer by calling the cops, the office, and just complaining in general. So this is a fair warning that if you cause any problems for any of your neighbors this year, we're going to cause more problems for you. Please heed this warning, I can't stress that enough. A lot of us work very hard and the pool is the only thing we have to look forward to at the end of the week. We don't care if you work from home; your "home office" is located next to OUR recreation area, so either deal with it or MOVE OUT. This is your only warning. Posted: 28 Mar 2018 09:49 AM PDT Since the last time I posted, my landlord said he would fix the middle gate and told us to brace the front gate with a rope. While it definitely stayed close, that wasn't good enough for the woman, who I will call Marsha, who got into a heated argument with one of my other roommates over the gate. It all came to a head last night when we were woken up by blaring car alarms. We went outside to see Marsha, high on some sort of drug, slamming on my roommate A's car with a baseball bat. My own car just had a broken window but roommate B's car was pretty fucked up too. We called the cops and they took her away and they were able to confirm she does live 3 houses down with her family and is some sort of distant relative of theirs. Obviously we are a bit shaken up but I do have some questions.

Posted: 27 Mar 2018 11:14 PM PDT Michigan, USA. I just had the most horrific day of my life on Friday. I found out my ex-wife's boyfriend has been beating our children (7 and 10). I split up from my wife about six months ago and she started seeing someone seriously about a month after that. Three or four weeks ago he unofficially moved in. I never liked him, but I never had reason to believe he was violent. My custody arrangement is such that I get the kids for a week then she gets the kids for a week, back and forth. I didn't try to sue for full custody at any time because this is totally unprecedented and I've never known her to be an unfit parent. Raising the children had nothing to do with why we split up, and nothing related to anger, violence, or general carelessness. Friday night she dropped the kids off and, as usual, she barely made eye contact or spoke to me. (I tried to organize an amicable split for the kids' sake, and it went well at first, then after the papers were signed and assets divided she wasn't having it.) So usually the routine when she drops the kids off on Fridays (around 7:00 or whenever they finish dinner) is we watch the game or play some video games, get a jump start on weekend homework, and then head to bed. My younger son was really despondent when she dropped him off and my older was hyper and fidgety. Unlike both of them. Usually they're perfectly well tempered. If anything my younger son is normally the fidgety one, he has. ADHD, and I've never seen him as still and affectless as that day. I asked if everything was ok and they said yes. So the boys head up to shower then go to their room to change and I come in to say goodnight and see my younger son's back and chest are covered in bruises. I was half paying attention at first and only caught a glimpse, checking my email and catching it out of the corner of my eye. I asked him to take his shirt off and he panicked. Not like them at all. I was still helping this one in the bath until earlier in the year and they both would walk around in their boxers all day if we let them. So that raised a flag right away. To make a long story short he was covered in bruises on top. I had to step out of the room for a second because I didn't want to break down in front of him. And his legs had prominent lacerations and welts. I asked him what happened and he kept telling me he fell. He was definitely coached because he hasn't lied to me that blatantly since he was like four. I didn't want to press him. My older son finally told me in private what happened. Younger son did poorly on some test and ex's boyfriend whipped him with a belt. When he cried, the boyfriend just started wailing on him, because "men don't cry." I am shuddering even typing that last part, it is the exact opposite of everything I (and my ex!!) had been teaching them their whole lives. And the most traumatic part to both of them was not even the violence of the boyfriend but that my ex was sitting in the room and did nothing. Without going to into detail, because I would just get too upset, this was not an isolated incident. Just the first time he left noticeable marks. He'd been hitting both of them, the younger one much more frequently and aggressively than the older one, and told them if they said anything they'd never see their mother again because she would lose custody. And my ex backed him on this. I haven't let on to my ex at all because I don't want her to know before I can get to court and sue for full custody. I took photos of every injury. I am so livid. I don't know if I'm more mad at him for attacking my children, my ex for not doing anything, or myself for not putting the pieces together sooner and doing a deeper dive into the man living with my kids. I contacted a lawyer that next morning but he said since the guy technically doesn't live with them we might not be able to take custody from my ex (he kept his apartment, but according to the kids, he brought a bunch of boxes with clothes over three or four weeks ago and has stayed over every night since). He also said once my wife catches wind of my suit that she might just take out a restraining order on the guy and swear they're broken up while still seeing him on the side once she keeps custody. Knowing that it isn't certain I'll win full custody, it's taking all I have to not load them into a car, change our names, and never come back. Is there anything else I can do in the meantime? My lawyer says at the end of the week I'll have no choice but to send them back to her house. Our court date isn't until Wednesday of next week. They've barely slept the last two days. The younger one is afraid to sleep alone and keeps getting into bed with his brother, who is so guilt ridden he didn't do anything to stop it or speak up sooner than he just gets into bed with me and cries all night. (They're both in counseling starting two days from now.) I did not see this coming at all. My ex wife was so against violence she wouldn't even kill a spider in the kitchen and spend hours trapping it in a glass to release. She found out a teacher had yelled at one of our kids and had a meeting with the principal the same day. It has occurred to me this man is abusing her too and she's under some sort of spell with him and needs help of her own. Once it effects my kids, I don't care about her problems. Only they matter. There is no excuse that will justify her sitting and watching a grown man brutalize my seven year old. So, basically, What do I do when the end of the week comes and I'm supposed to give them back? I don't want to be charged with kidnapping, however, I'm not bringing them back even if I'm mandated to. UPDATE: He's up and we're on our way to the hospital. I'm having both kids examined just to remain on the safe side. I called CPS and said I'm bringing the kids to the hospital and am scared to return them to their mothers care. Fingers crossed. As she was packing her stuff Mom revealed to me (with enough detail that I couldn't not report it) that daughter had likely been inappropriately touched/raped at a sleepover some years ago. I immediately contacted the detective once they left and the case is becoming moree serious now. She stated that's enough to get a cps intervention interview for kiddo, so hopefully with my gently telling her to tell someone if anything is wrong, if she isnt fed, clean, safe etc....she will speak up. I made the unfortunate decision to move through a broker and now have some terrible/scam company that came and picked up my shipment up and is now past the estimated spread and getting close to the 30 days guaranteed in the bill of lading. From reading around it doesn't look like there's really anything I can do legally, their "claims" website is a joke but I can at least file a claim to the federal motor carrier safety administration and hope something happens to the company. The actual value of the stuff they have is tiny, like less than $1000, and it's nothing important. I sunk around $1200 in total payment to them for service so far. Now, I'm wondering what will happen if I just say screw the order and don't bother delivering? If they show up 3 months later do I have to legally pay them even if they didn't hold up to their bill of lading? I'm sure they will tack on fees that they caused by exceeding the delivery date. I'm willing to chalk it up as a life lesson and call it a loss but I'm worried they can just show up down the road and now I'm on the hook for some ridiculous bill they make up. We had executed a company agreement and suddenly he wants it amended to show the following text: "ACQUITTED and FOREVER DISCHARGED, and by these presents do for NAME OF MY PARTNER and for and on behalf of my heirs, executors, administrators, and assigns, hereby ACQUIT, RELEASE, and Forever discharge NAME OF MY PARTNER and any and all other entities in which NAME OF MY PARTNER owns an interest, his agents, servants, and employees, hereinafter called Parties Released; and any other persons, firms, and corporations, of and from any and all claims, demands, debts, liens, causes of action, or liabilities, at law or in equity, in the which NAME OF THE COMPANY and MY NAME's involvement with in the past, present and future." Two of my roommates stay up late playing video games and while not loud, the walls are thin and he can hear them. It has now escalated into him leaving knives outside our bedroom doors. I'm getting really worried he's going to hurt our cat or one of us. What can we do? Over the last couple of months she's had a driver repeatedly threaten her for asking him to move out of the crosswalk or stop when he's supposed to. The last time, he got out of the vehicle and screamed at her inches from her face while she had children in the crosswalk. She notified her supervisor, asking to report it, but the supervisor refused because she claims her department is "the black sheep of the county". My mom called the police on her own and the officer that came out merely took down the plates of the driver and left. She's emailed her supervisor's boss to no avail. Thanks everyone. Hi /r/legaladvice. On Sunday, a massive tree fell on my complex, damaging the roofs and cars of a few residents and cutting off power. I was lucky to not be impacted besides the power. It's now Wednesday and we still don't have power. Management has worked quickly to get electricians and roofers out to repair the damage. The utility company should be coming out today to inspect and approve the repairs so we should have power later today. The complex didn't put us in hotels (I asked), but they provided pizza on Monday so we wouldn't have to open our refrigerators. They said they plan on giving us some gift cards to the grocery store to make up for the food that we lost. I'm not sure the dollar value yet, but I did lose a considerable amount of food because I had just gone grocery shopping on Sunday. No hot water, because we have electrical water heaters. No air, internet, etc. This isn't the biggest deal ever. It's hard to anticipate a tree falling (it looked like it was healthy, and may have fallen due to a storm that knocked out dozens of trees across town earlier last week). They reacted quickly and honestly besides the hot water and charging my phone I haven't been that impacted. But I would like to know my rights. Can I pay less rent next month, deducting the days without power? Does the amount of food lost matter at all? Or does this all fall under renters insurance (I don't have renters insurance because this is a temporary home and I have very little of value here--I only anticipated the threat of fire or theft in my decision)? We pay rent and buy our own food (big house). We were waiting for a three-bedroom to open up. My brother and sister, also adults, live here too. Brother works for my dad and sister goes to college. My brother owns the dog. The dog has free reign of the house, which was perfectly fine. He was a dopey dog with no issues before. Last week, we had over our friend's daughter (5) to play with our kids (6, 5, 3) like we normally do. Brother, sister, father are at work. Little girl walks up the stairs behind my boyfriend and the dog is sitting at the top of the steps. She doesn't make it to the top step before the dog barks and bites her face all in a flash. We immediately took pictures while the other called her parents all while rushing her to the ER. The right side of her face got bloodied up. Six stitches in her lip, two in her chin, and then the rest of the puncture wounds were glued shut. Her parents met my boyfriend at the hospital. They're trying to tell us that it's not our fault legally. They took the pictures and forwarded it to their lawyer. They also filed a police report, which I got to speak with the officer when they came here for questioning. My dad and brother stand firm on the idea that they are not legally responsible at all. My brother says he's not because he wasn't here. My dad says I am responsible for everything because the bite would not have happened if no one was here. So now he's pissed the dog had to finally get registered with the state, the dog is on house quarantine (which they are not taking seriously), he's pissed he has to put up signs, and thinks it's beyond ridiculous my friends reported the bite to the police. My dad says he will never believe the bite was unprovoked or believe the dog can do any wrong (literally his words) unless he bites again. So we're moving out as we speak, but my dad did also say that if he gets sued that his insurance will come after me to get back their money because my dad now says that the girl was not welcome in the home at the time of the bite. He also says that if I'm smart I wouldn't tell my friends that bit of information if they do plan to sue. I'm not without guilt. I've offered to my friends to pay for their daughter's medical bills. We're very close. She's practically my niece. I feel awful it happened. My dad and brother, eh, not so much. In fact, he came down and laid a guilt trip on us about how his home owner's insurance will drop him, he's going to lose the house, and how he doesn't have the piles of money everyone assumes he has. Discrepancy with HOA management company Posted: 28 Mar 2018 09:31 AM PDT Two weeks ago I received a late fee notice from my HOA management company, with a notice of intent to place a lien against the property. To my knowledge, my account was up to date, so I contacted them to find out why I received the notice. They told me that I had not paid quarterly dues in April 2017. Backstory I moved in to my house February of last year, and in March the current management company took over. They sent out a notice that all residents would be required to set up an online account for submitting payments. I paid something around $110 to setup the account and pay dues (quarterly dues were $38.41). So since I had just paid that amount in March, I thought I was good until July. In August I recieved a late notice saying I didnt pay in April, and they had tacked on over 100 dollars in fees and penalties. After 2 weeks of trying to contact them via email and phone, and not getting a reply, I went into their office in person. I sat down with one of their people, explained the situation and my confusion about the missed April payment, and their person agreed to waive several of the fees and I agreed to pay the adjusted balance (which I paid that same afternoon). Before I left, I got a copy of the statement with the waive markups and it was initialed by the person that I sat with. I didnt have any issues for the rest of the year. Back to the story Now, I'm getting a notice that I owe $217 on my account, which includes an $85 fee just to send me a notice that they intend to place a lien in 45 days if the account is not brought up to date. When I contacted them this time, I found out the person that adjusted my balance last year left the company in October and they claimed to not have any record of the adjustment, until I told them I had an initialed document. They asked that I send a copy of the document to them, which I did same day. They told me it would have to be submitted to the board for review. This was over a week ago. I feel like because I have documentation and confirmation receipts on my payment(s) there really isnt anything to review. Meanwhile I am not able to use any of my community amenities, and I am afraid that they will try to drag this out the full 45 days, at which point they will try to go through with the lien, all while tacking on more late fees with interest and legal fees. I painted three rooms in the house, so I know I have to paint them back before the lease ends, which I plan to do. She suggested that she share the cost to have the place professionally painted, which I am more than ok with. She wants to paint more than what I had painted, as we've been there for several years so there has been some wear and tear. We still have three months left on our lease and it would be a huge inconvenience to have to move all our art and furniture to prepare for painting. I told her that I would be ok with the painting being done closer to out move out date, as by then we'd already be packed, but she wants to do it within the next few weeks so that the place looks better for upcoming showings. [Ontario Labour law] Disciplining employees for using their emergency leave Posted: 28 Mar 2018 07:16 AM PDT Hey folks, I haven't been an "employee" in over 10 years as I'm an independent contractor, so pardon my ignorance. My wife works for this employer who, as a policy, will fire you the moment you are more than 3 minutes late or call in sick after your 10 days of emergency leave is exhausted. They do this by writing you up every time you use 2 of these days. Their policy is when more than 5 of these "write-ups" exist, you're frogmarched out the door. The cool thing is they label the first 5 write-ups "as a friendly chat", "it's not an official write-up," "you're not in trouble," etc. but then those 5 write-ups threaten your employment standing. There is no employment contract involved, but there are employee "guidelines" listed on an intranet document space. So, my legal question: Can an Ontario employer discipline you for taking a lawfully-entitled emergency leave day, and use the fact you've exhausted that entitlement to meet the standard of gross negligence for an at-fault no-notice termination? PS. Her industry classification is technical support (call center). PS #2: Their 5-strikes-you're-out policy isn't just for taking emergency leave against company policy, but is also cumulative with other write-ups. So:

Posted: 28 Mar 2018 08:48 AM PDT I agreed to rent out my extra underground parking stall at my condo to another resident but they missed their payment and are not responding to my texts now. I do legally own the spot, I have a title for it and pay property taxes separately from my condo unit. Unfortunately I didn't bother getting a contract/agreement for the rental, nor did I get a security deposit. The agreement was all done via text and the payments done via e-transfer (Which I still have all records of). I've met him once to hand over a garage door opener to use, which he still has. He has only made one payment and it's been a headache the whole time (I really should have seen the red flags earlier). I get this wasn't done very professionally but I guess I wrongly assumed this whole thing would be pain free. What options can I take at this point? Do I go to the police? Find a lawyer? (California) Posted: 28 Mar 2018 01:19 PM PDT I (24f) got carbon monoxide poisoning at my apartment building, my cat is dying and the property manager refuses to give me the insurance information. I'm, going to try to keep this concise as possible. I live at an apartment complex. Sometime around Sunday February 25th I came home to my carbon monoxide alarm going off. (I do not know how long it had been going off before I arrived home.) I know it was a carbon monoxide alarm because a robotic voice would repeat "WARNING CARBON MONOXIDE" every few beeps. I alerted the onsite property manager, he came and looked at the alarm and said it was working. He said he did not smell any gas and shrugged and left. He did not investigate it any further or alert anyone to the alarm going off. The alarm continued to go off for weeks, and I continued to get sicker. Not sick with a flu or virus, but nauseated, a throbbing headache, weak and dizzy, just not feeling right. I was confused and mentally "out of it". I thought maybe I was just about to get sick and needed to rest, then I thought it was food poisoning, but didn't understand the headache. On the morning of March 13th I posted a video of waking up to my carbon monoxide alarm going off. That night, my friend responded to the video telling me that his buddy had just passed away from carbon monoxide poisoning and that this was serious and I needed to alert my property manager. This was the first time that the pieces came together in my brain and I realized...sick....alarm going off...ohhhh. I told my friend that I had alerted my property manager and that he had done nothing. Friend told me to call 911. The firefighters came out told me to alert my property manager and that PM would call the gas company. I let the PM know, he said he would call the gas company, and I went to class. In class I felt so bad and out of it that I started crying and knew I had to go to urgent care. A friend drove me to urgent care, urgent care told me I needed to go to the emergency room, and after hours in the emergency room and blood work I was given nausea and dizziness medication for carbon monoxide poisoning and told the symptoms would still be there for another few days. (This was all going on during final exams). I called my PM in the lyft home from the emergency room and told him I had carbon monoxide poisoning. It was THEN that he finally called the gas company. The gas company technician #1 came out (PM was present) and found that the heater and the oven in my unit were both leaking carbon monoxide. The gas was shut off to my unit with danger stickers until the repairs were made. I dealt with trouble of my PM denying that any carbon monoxide was found and that the gas company man was "making up stories". I had to call the gas company myself to hear the report to get peace of mind in knowing that there WAS IN FACT A CARBON MONOXIDE LEAK despite the PM's lies. The "repairs" were made by clearly not licensed technicians, the danger stickers were ripped away and the appliances were turned back on. I continued to not feel well and ordered my own carbon monoxide alarm online, since the gas company technician told me that by the time my carbon monoxide alarm was going off (due to its placement) my whole apartment was flooded with carbon monoxide. The alarm that I ordered was delivered on March 17th, and picked up a reading of 41PPM in my apartment. I immediately alerted my PM and he told me no gas company technician would come out because they didn't find any carbon monoxide the first time (untrue). I told him I was in the ER and would get to the bottom of this. Finally, after pressuring the PM, a gas company technician #2 came out. He found that NONE of the repairs were made and both appliances were leaking high amounts of carbon monoxide STILL. So I (and my cats) had continued to be exposed to it. I went to the ER again. I then had to drive 2 hours away to see my primary doctor. Both appliances were then replaced but I insisted the gas be left off until a gas company technician came out to inspect them again, as directed to do by the gas company technician #2. Gas company technician #2 also told PM to order saftey checks for apartment complex with the gas company. I asked PM for the owners name and information. PM told me that the gas company was coming on Monday the 26th. On the 26th, PM came with "Larry" who claimed to be the owner but did not fit the part. He came with a cheap carbon monoxide alarm and claimed to be testing things. I began asking PM for the insurance information, and he ignored my requests and claimed not to know it. "Larry" told me he was representing the owner and pleaded with me not to involve anyone else and that he would cover my and my pet's medical bills. I then realized that "Larry" and PM were going around doing a "safety check". (I am not sure if he was trying to pass "Larry" off to me as the gas company at first, and then as the owner) That day I asked PM when the gas company was coming to do safety check. He told me that gas company was coming "I don't know Wednesday or Thursday" and that I had to wait until the downstairs unit had their new appliance? I called the gas company myself and technician #3 came out. Gas company technician #3 found that the new heater was still leaking excess carbon monoxide and the oven was not venting and creating excess carbon monoxide leakage. I again had all gas turned off. That (yesterday) evening I took my cats to the vet and was told that while the younger female was ok and just needed medication to deal with symptoms of the carbon monoxide, my old male cat was not going to survive. Vet said that the carbon monoxide likely sent his body over the edge, his body was not able to bounce back like younger cat's was, that he wasn't getting enough oxygen and that he would not survive. Vet suggested he be put down then and there. After much crying I made the decision to take him home and let him die at home with me as I always planned. PM still refuses to give me insurance information and claims to not know "Larry"'s last name. I finally got in contact with his supervisor, who also refuses to give me insurance information and claims not to know "Larry"'s last name either. Supervisor has been calling me trying to get me to tell her what I'm asking for out of "good will" but says she isn't allowed to give me the owner or insurance company's information. What can I do? Is this right? Supervisor claims I have no basis for claim with insurance company even if I could give it to her. Please help! TL;DR Carbon monoxide leak in my apartment went ignored and unfixed for weeks. I got carbon monoxide poisoning, it killed my cat. Cousin is serving on the navy, currently on restriction, he is now UA and is in Virginia Posted: 28 Mar 2018 08:03 AM PDT Cousin is currently under investigation by NCIS, he says they were going to give him more restriction and he decided to leave, but claims that he wouldn't be deemed a fugitive if the UA is longer than 30 days. Despite how shitty of the situation is, he is my cousin and we grew up together, I'm also a civilian and in Uni. My question is, is he lying? Did just just make a run for it? [NY] Uncle selling a house that was given to me by my grandparents. Posted: 28 Mar 2018 07:45 AM PDT My grandparents raised me after taking me out of foster care. I've lived with them for years, taking care of them and their property, investing a lot of time and money into it. It still has a long way to go, but I was getting there. Since none of their children wanted the property, (my Grandfather was a hoarder, and the mess was extensive) it was decided that it would go to me. Recently, my Grandfather passed away. When he did, my Grandmother told me the house was mine to do with as I wanted. My Uncle, who has power of attorney, told me he was putting my name on the deed to their house. He said this was so that when my Grandmother passes, the house will go directly to me. I believed him. I shouldn't have. When I went away on a business trip, he used his power of attorney to cash in my Grandfather's pension, which was supposed to help subsidize my Grandmother's living costs. He used that money to remodel the house and he is now trying to sell it before I get back home. I don't know what he plans on doing with my Grandmother. Another reason the house was "given" to me is because, for as long as I can remember, she has always said that she wants to die in her home of over fifty years. I don't have this agreement in writing, and my Grandmother isn't really "all there" as much anymore.
