Girlfriend in an at-fault accident, they're saying the car is totaled and we owe $55,000? (Texas)

    Posted: 30 Mar 2018 05:48 PM PDT

Hey all, using a throwaway and avoiding personally identifiable information, but hopefully this community can help us out here. This story occurs in Texas, where all drivers/cars live and are insured. As I'm sure you'll quickly be able to tell, I am not an insurance expert, and this is the first time that I've ever had to deal with something like this. Happy to x-post if you think this would be more appropriate in a different sub...

    The accident:

My girlfriend was picking me up from the airport after a long work trip. On the way home, we rear-ended another car at a pretty decent speed. 100% at fault, that was never in dispute. All drivers and passengers were okay, called the police/exchanged info/took photos, did all the things you're supposed to do, and both cars drove away. We were pretty rattled, and frankly our car was in worse shape than the one we hit, but we tried to shake it off and wait for the insurance companies do their thing.

    The claim(s):

The damage estimate for the other car originally came in around $5,000. Well within her $30,000 coverage, so we thought that (and a spike on the insurance premiums) would be the end of it. This was about 4 months ago. Well, she just received a call from her insurance company that once the other driver started undergoing repairs to their car, they supposedly uncovered over $45,000 of "hidden" damage. They are now considering the car (worth $85,000) a total loss, and holding her responsible for the $55,000 above the $30,000 that her insurance covered.

    What to do now?

This is a completely shocking and life-altering bill. Maybe it's just the denial stage, but I can't even wrap my head around the possibility that she may have to actually pay this amount. Isn't that supposed to be the whole point of insurance, to help when things like this happen?

I know the only evidence here is anecdotal, but it is also inconceivable that this car is totaled. It's an $85,000 car that did not have airbags deploy, that drove away from the accident just fine, that originally had a simple $5,000 body shop diagnosis. We took photos of the accident, I'm not going to post them here, but it really just looked like rear body damage.

So, we're at a loss. What are the options here? Can we request an investigation of their claim that it's totaled, and why it took 4 months for them to claim that? How on earth are we supposed to pay this bill or respond to the insurance company? If she sells everything she owns, and I sell everything I own, it won't cover $55,000... We both try to be relatively financially responsible in our day-to-day, have stable jobs and mild savings, but no "emergency fund" can prepare you for this. Is she just in debt for the rest of her life now? How do you even begin to approach something like this?

Hit by motorcycle today. Need insurance advice/help.

    Posted: 31 Mar 2018 12:19 AM PDT

I live in Austin, TX. I was driving to a friend's house today. To get onto his street, you have to take a left turn across 2 lanes from a merging lane. This is rush hour and thus stop and go traffic. The cars eventually stop and the closest one allows room to make my left turn. I could see there was nobody coming in the additional right lane and began my turn.

As soon as I do, this motorcycle comes gunning through about 40mph to catch up to the next car (even though it was stopped 10 feet away from me). Because I was already mid-turn, he ended up sliding his bike and running into my side panel for my F150.

After checking health and getting everything off the main street, we go through the normal process (insurance, etc). The guy has a couple of small quarter-size road rashes because he was wearing a shirt while driving. I ended up getting a ticket for "Failed to Yield - Left Turn Lane" even though I was waiting my turn for nearly 2 minutes at a dead stop. There was also no cop or witness to corroborate this charge. Just gave it from what the guy told him. This guy was clearly going too fast and did not have time to stop before impact, thus having to lay his bike down, sliding into my car. None of the damages were severe except for his handlebars. We had cops/paramedics show up to do the report and health assessment. Everything was fine and he passed everything just fine. Afterwards, he started complaining about his scrape being on his "bad knee" and his wrist hurt from when falling with the handlebars. I will pictures of the "injuries" below. There was no swelling in the wrist for the record and the EMT gave a pass on a the field test.

    https://imgur.com/a/OOZEm

My question lies in the fault and insurance depending upon that fault. I found a witness on the side of the street who can corroborate my story about him going to fast, but somehow I still got the ticket (his dad was an ex cop - showed up and began talking with them before giving me the ticket). Can anyone provide advice on how I can avoid this turning into my fault from an insurance standpoint (if it is indeed) or avoiding this guy lying to try and get unnecessary medical treatments causing premiums to skyrocket (currently only paying $450 for 6 months on a 2008 F-150)?

I've been told that because he laid the bike down that he was going to fast or not paying attention until too late. Otherwise, he would've hit me head-on if I had truly pulled out without time.

Additionally, anything I should avoid saying or include to the claims agent when speaking to them? Any advice would be appreciated as it has been 12 years since I've been in a wreck. Thanks.

Insurance asking me to provide a recorded statement, a few months after a minor car accident with no injuries

    Posted: 30 Mar 2018 04:29 PM PDT

I was at fault of a minor car accident due to slippery roads. I am reading online that any recorded statement made by me to my insurance can only be used against me. They already have a police report, and the damages have been fixed. I did not file a claim for my damages, but I am sure that the other driver obviously used my insurance to pay for their damages. What is the best course of action as far as whether/how I respond to my insurance company or not?

    How to interpret auto coverage

    Posted: 30 Mar 2018 11:29 PM PDT

Quick question, my auto coverage reads bodily injury and personal property damage $50,000 per person/$100,000 per accident/$50,000 per accident. I'm assuming this means bodily coverage is up to $50,000 for one person, $100,000 for 2+ people, and up to $50,000 for damage to a vehicle? If so, I'm assuming this coverage is a little low?

I called USAA to ask how to better insure my truck accessories... and they said I have 5000 in coverage.

    Posted: 30 Mar 2018 11:20 PM PDT

My 2016 truck was stolen back around September last year. I know I said I had receipts for the items Bed cover and brake controller and I don't recall them asking for them, they said they just add the accessories to the "value" of the truck. Which ended up adding about 100 bucks I think. When I go to KBB and add a "Hard Tonneau Cover" it adds 193 bucks. Not the 1200 to replace the cover.

But the guy I got ahold of in the insurance department said I have coverage for up to 5000 in accessories, I never changed my policy other than adding the same truck a year newer.

So Monday im going to clarify. What does this accessory coverage usually cover? replacement value of the accessory on a new truck? exactly what I paid for it? or what I might be able to sell it for If I still had it.

Side note I couldn't understand why I would tell them the cover was on the truck if I was only going to get 100 bucks for it. I should have just left it out entirely and then hope to take it off if the truck had ever been found. but since the insurance gave me an extra 100 Bucks I would have to leave it on.

Received an offer in exchange for full and final release of any and all claims?

    Posted: 30 Mar 2018 11:35 AM PDT

My wife was hit from behind on the highway and taken to the hospital (she is back to 100% now) and the persons insurance sent us a letter with an offer for "full and final release of any and all claims against person that hit her and Permanent General. Seems sketchy. They want to settle for double of what they actually owe us. Seems too good to be true. Will they then not pay for the medical bills which would put us in a worse position? The wreck was about 8 months ago, we have been told that all medical bills have been paid, the car is now fixed. They paid us the deductible. Can someone explain why they would send this? Thanks!

I live in Columbus, Ohio. I have Geico. I heard that insurance companies fix the cracks for no hike in policy premium. is this true? Also, my deductibles for Collision and Comprehensive coverage are $500.

    Update to Root insurance claim

    Posted: 30 Mar 2018 04:58 AM PDT

After my accident (February 4th) it took about two weeks for the adjuster to Dean my car was totaled. Went and got a new car I waited for my checks until yesterday (3/29) they paid out and I couldn't be happier. I will note that it did take so long to receive the checks because of writing addresses but my claims rep was not mad that I called every Friday to check up on things and make sure everything was being taken care of. Like I said both my bank and me received our checks!

Will post link to original post Edit: https://www.reddit.com/r/Insurance/comments/7wi9gx/anyone_familiar_with_claims_with_root_insurance/?st=JFDWAA4N&sh=c3af0cea

Anthem PPO to Regence PPO (WA state)

    Posted: 30 Mar 2018 11:00 AM PDT

I have my family on an Anthem PPO plan and am considering a job change to a very similar plan on Regence. They are both under BCBS network and have pretty similar numbers. I've been very happy with my existing plan, they pay things and don't make me jump through hoops for my coverage.

So on paper the new plan is very similar, but as they say, what the bold print giveth, the fine print taketh away.

How do I find any sort of ratings? Even if the two plans are identical in terms of coverage and policy (they probably aren't) an insurance company can really make your life difficult if they are trying to save money by making things hard.

Both drivers backing up? How will this play out?

    Posted: 30 Mar 2018 03:53 PM PDT

Today as I was backing out of a parking spot another lady pulled out and hit me. (I say she hit me bacuse I was putting my car into drive while she was still half in her spot.)

I got her name and number (called it and it's not in service). Insurance card. Pictures of the vehicle. Then I found out she wasn't the owner of the car, or insured. And didn't have her drivers license. Saying it was a borrowed car.

I called the police, but they wouldn't come because it was private property and no one was injured.

I made a claim with the insurance on the car.

With no witnesses or real proof, how do I know this won't come back on me? What steps do I need to take?

    Edit: I am in Missouri

    Ontario Insurance Absurdly High

    Posted: 30 Mar 2018 06:01 AM PDT

I'm 36, in Ontario, and I've been driving insured for 7 years with only a single speeding ticket for 19km/h over. I drive a 2006 Volvo, probably worth about $2,000 now.
I'm paying MORE than the value of my car every year with Bel-Air, at $233/mo. Even with the bundled (and separate cost) home and identity insurance, winter tires, high deductible, 1mil liability, etc. Lowest it can go.

They told me that it's because I live in an area where claims happen often. So I moved to an area where they don't.
But my rates didn't change, at all. My contract with them is up at the end of the month, so I might start looking around for another broker.

Why are my rates so absurdly high? I have friends that have had at-fault accidents and written off cars and they pay half as much as me.

Diminished value against uninsured motorist? [WA]

    Posted: 30 Mar 2018 03:29 PM PDT

My vehicle was rear-ended about a month ago and I was deemed, per the police report, to be not at fault. The other driver was driving on a suspended license and had no insurance to speak of so it was claimed against my own policy as a not-at-fault accident. I've followed up with the police department that took the statement and confirmed both that the driver was driving without insurance and on a suspended license.

I've contacted State Farm and they claim that the police report states "No insurance collected from at-fault driver at the time of the accident" but I know that to be untrue based on the police report that I have in my hands. I've been told that State Farm's hands are tied until they are able to confirm that the at-fault driver was uninsured.

The vehicle was estimated at a value of ~$17,000 and approximately $12,000 worth of repairs were made to the vehicle and have been completed. Any reports that I can locate and any comparables show the value to be in the $11,000-$14,000 range. I brought this concern up before authorizing the repairs but State Farm insisted that they were unable to reappraise the vehicle because it's done based on book prices. When I mentioned this to state farm today their claims representative said that the estimates are made on a case by case basis and book value is no longer used.

I've gone through all of my documents since the origination of the policy and there is no exclusion listed absolving the company of responsibility against diminution in uninsured motorists claims. Is it worth my time to seek out a third party estimate to file a claim for diminished value against State Farm or will I be wasting my time and money doing so?

Ding on Door Requiring Paint - File Police Report?

    Posted: 30 Mar 2018 03:05 PM PDT

    State of Ohio

I recently purchased a new car, and to my dismay, I recently found a dime-sized "ding" on my door with paint chipped away. It appears that someone opened their door into my car without and didn't leave a note.

I got some ballpark quotes from local body shops, and it's looking like it's going to be a $1500 repair.

I'd like to file a claim, and I'm concerned about my rates going up, but my question is - should I file a police report?

I seem to recall someone telling me that if I report it to the police as a "hit and run", my rates won't increase. Obviously I don't expect the cops to find the asshole, but if it would save me some money in the long run, I'd gladly file a report.

College student looking for good value insurance

    Posted: 30 Mar 2018 03:04 PM PDT

I'm a recently licensed female college student who has above a B average. I've had my permit for over 4 years now just because I don't want to pay insurance to drive, and neither do my parents. Every quote I've gotten has been $700+ a month. I need a car for this summer due to off campus jobs, and I was planning on financing a 2015-2016 Honda Civic. I have no idea how much insurance usually costs, and all of my friends have their insurance paid for them by their parents. I would be paying my own insurance and car payment. Is there any way I can get a quote for something way less than the amount I've been given so far? Please help!

Insurance Adjuster approved an appearance allowance, but said there is no diminishment of value.

    Posted: 30 Mar 2018 06:57 AM PDT

So to start things off, i live in Georgia and Geico is my who i insure my car through. There have been 3 claims on my car, 2 accidents with other vehicles (both scenarios the other driver was at fault) and 1 "animal" accident because i hit a deer.

This most recent accident occurred last week where someone merged into the side of my car. The damage is ultimately cosmetic, some scratches to the top coat and what looks like some mild friction burn on the edge of wheel well which they are attempting to buff and polish away the best they can at the auto shop. They approved an appearance allowance of $250 which from my understanding is the insurance company saying... we're paying you to let us leave minor blemishes on the car.

When i asked about diminished value he said thats really only for first accidents against a car and that there is no diminishment of value in this case. The idea that they are leaving scratches on the car but saying the value of the car isnt decreased by that or that fact that theres another accident/police report/claim on the vehicle seems wrong to me. Am i right/wrong? Any advice moving forward? Thanks!

Considering my options about settling an auto claim

    Posted: 30 Mar 2018 08:25 AM PDT

I totaled my car last week and think my valuation of my car is low (doesn't everyone) but I don't know if I should fight it or concede. After wrestling with the appraiser/ agent, he says I could file it as unsatisfied with settlement but I don't know what that means going forth. I have a high millage car, not the greatest shape but ran great. They deducted about a grand from my car's value for dings, dents and cigarette burns. I have All state and I'm definitely not going to renew my policy with them if I get this settlement as is. Should I fight them longer or should I throw in the towel ?

Alerts and notifications via text from your insurance company

    Posted: 30 Mar 2018 06:31 AM PDT

I'm at a Loss. Any legitimate advice please.

    Posted: 29 Mar 2018 10:11 PM PDT

Backstory short: I was sitting at a red light completely stopped. I got rear ended by a driver due to him supposedly passing out because of a medical condition. I was pushed into the car in front of me as well. My vehicle trunk is crushed and my C pillar is bent. My front end is smashed in, but it doesn't look like it got smashed in all the way to the engine. My frustration mainly comes from not being able to get a hold of my adjuster, which is Geico. My adjuster never keeps me updated and I have refused to pay my deductible so my vehicle is still sitting at the tow yard. My adjuster has said the other parties insurance is currently investigating because the driver had a medical condition, which my adjuster followed up by saying that it could be my fault. I don't feel like I have been taken care of, not like when I was with Progressive. With Progressive, I got constant updates and my adjuster kept me constantly updated. I spoke to my adjuster's boss and he made me feel like I was being taken care of, but he would not change my adjuster. I tried calling Geico, but I'm automatically forwarded to my adjuster's number, which my adjuster never picks up anyways. I guess I'm basically asking if should I just pay my deductible so that my adjuster will look at my vehicle or just wait it out?

tldr: Sitting at a stop light completely stopped. Got rear ended due to driver passing out. My insurance is saying that his insurance is investigating and that he may not be at fault because of a medical condition. My adjuster hasn't looked at my vehicle yet because I haven't agreed to pay my deductible. Should I pay my deductible so that my car can get looked at or wait until the insurance companies settle everything?
