My mother gave my cats away. Is there anything I can do?

    Posted: 25 Feb 2018 03:07 AM PST

So the situation is my mother who is disa

bled from a work injury iis currently living with me had decided the other day while I was at work to give my two cats away to this rescue through Facebook because she didn't like them. I've only had that a little under a year and was about to get them spayed and neutered. This rescue apparently does that as soon as they get them before re homing them. I've sent them a message, but haven't gotten anything back yet. I guess I'm just wondering if they just flat out tell me no or start demanding money from me because they got them spayed and neutered if I should be getting the police involved.

    I'm in Kansas

Edit: Called the rescue they are going to bring them back. They are going to charge me $100 though, but that's because they took them to the vet and got them their updated shots.

Edit 2: They just got home and are happy to see me. Gonna go them them food, litter and treats now.

[UK] Unchipped cat went missing for 3 months, turned up a week a go but we are now being contacted by the “new owners” who got him chipped & neutered

    Posted: 25 Feb 2018 04:44 AM PST

So our 4 year old indoor car escaped 3 months ago, never been chipped due to being an indoorsy cat we felt no real need to do so (I see the impending irony throughout the remainder of this post) When he went missing we put up various flyers around our area, made social media posts appealing his return etc. We got a call at the back end of last week from a lady only 8 doors down saying she had found him, she bought him over, he was reunited with his mother who we also own and all was well.

Since then a new social media post has gone up for our missing cat by his "new owners". They claim to have picked him up weeks before he went missing and have foot a £500 bill for his chipping and neutering. The lady who returned him to us has sooken with him, she advised he was extremely aggressive about the situation however we agreed it best that he be passed on our details, however we have not yet answered his calls.

We have numerous photos going back years with proof of him being our cat, I have already made contact with the local vets about a DNA testing kit (ridiculous I know) however I'm worried about the potential civil matter this could raise which quite frankly I could not afford if it was taken to court.

    What can I do?

An update to the legality of a police report on my own property

    Posted: 25 Feb 2018 10:15 AM PST

    Original: https://www.reddit.com/r/legaladvice/comments/7p1hyl/i_got_a_police_report_filed_on_me_earlier_on/?st=JE33XXUM&sh=0e38439b

I got a phone call about three days after this post asking my side of whatever story was said. I just said I quit my job, my boss was mad and wanted to be a douche. The truck is in my name, his name was never on any title. The cop said okay, he'd get back to me if anything else came up and hung up.

I read in the paper about four weeks later that he got in trouble for filing a false police report though so that brought a smile to my face.

I haven't heard anything since the end of November so I guess I'm in the clear.

My buddy who is suing him is gonna be getting about ~8,500 from him though. For back pay and some other settlement thing. So this is a positive update at least.

Tl;dr boss man in trouble, I have a smile on my face

Friend dropped by insurance for getting pregnant.

    Posted: 25 Feb 2018 11:37 AM PST

My friend in Austin, TX had medical insurance (AmBetter) and got pregnant. She was 6 months along when it became time to renew her policy and they refused to renew her (no reason given, but presumably because she's about to give birth) but they would renew her husband no problem. Now she's about to pop with twins and has no medical insurance. Is this legal? If it's not, what kind of lawyer should she obtain?

Kicked out of all you can eat buffet. (Ohio)

    Posted: 24 Feb 2018 05:44 PM PST

Today I went with a few friends to an all you can eat Chinese buffet for lunch. There were 6 of us, me and one other person are both overweight. When we came in the waitstaff seated us, but when we said we'd be doing the buffet she told us that he and I specifically weren't allowed to have it. She didn't speak much English and had to bring a manager over to explain. It turned out that they don't let large people (or "Your People" as they charmingly called it) eat the buffet because "Restaurant Lose money. You people pay ten dollars, eat hundred dollars. Your friends pay ten dollar, eat normal ten dollars." (Pretty much direct quote.) Then they said we had to order from the regular menu if we wanted to stay.

We got into an argument because this was completely ridiculous and discriminatory. Then they asked me to leave.

Are businesses allowed to refuse certain services on the basis of weight? If this is illegal what is my next step?

Pet adoption contract says dog can NEVER be off leash: is this legally enforceable in Canada?

    Posted: 25 Feb 2018 12:24 PM PST

2 years ago Me and my GF adopted a dog from a privately owned kennel. The dog is fantastic. The kennel and associated group not so much. They have a fairly large, and toxic, social media following who act as a network of spies who like to call in complaints about other members and accuse them of breaking their adoption contract. For instance: we received several phone calls from different kennel workers who said they received complaints about us having our dog off leash and there was an implied threat that they would take the dog if it were true. Now in this instance, the complaint was of a photo we took of our dog off leash in a big fenced in field where you just couldn't see the fence in the photo. They've done this several times and with other people. They are incredibly over bearing and act as though they own the dog and we are just borrowing him and they could take him back if we displease them.

My question is about the validity of this pet adoption contract.

The contract stated the dog was not to be "turned loose to run free" (what they mean is: you can't have them off leash unless in a fenced area). It is my understanding, when you adopt a dog, you become the legal owner as they're considered property. So, if you are not breaking leash laws/the dog is not in any danger, could that clause be enforceable ? If a dog is under verbal control, is that really being turned loose to run free?

We've since completely disassociated ourselves with the kennel/group, blocked them and their members on social media (which is a bit of shame because we really liked volunteering with the dogs).

These people have a history of vindictive behavior and we really don't want them having the ability to take our boy from us.

    Divorce + Spying Husband

"Husband's background: ex-military, now works for gov.

I'm in the process of divorce and I'm 98% sure that he's spying on my phone. He's bought Raspberry Pi's, new routers, setup a VPN, and something about a Kali Linux.

He's sitting on the couch saying he can see the data packets on my phone while he's accessing something command line based in his phone.

What can I do to protect myself? How can I prove that he's accessing my phone and laptop without consent?"

We're located in Georgia. Is this legal? If I had gotten proof that he is doing this- would it hold up to anything in court?

My dad’s ex-wife is trying to put a halt to the installation of his Headstone (GA)

    Posted: 25 Feb 2018 05:44 AM PST

Let me start by saying.....he had no will. I was sworn in as "Administrator" of his estate. The only "heirs" he has is my half-sister (dad's ex-wife's daughter) and myself. I used funds from the estate to purchase the headstone. My half-sister signed a document before receiving her payout on the estate basically agreeing to the way I handled everything. Now, her mother has called the company I am purchasing the headstone from and claiming to be his wife (totally false...they divorced in 2008 and never remarried). Does she have any legal recourse at all or am I in the clear since I am the next-of-kin and legal administrator of his estate? Thanks!!

Who owns vehicles of the deceased?

    Posted: 25 Feb 2018 09:24 AM PST

My partner of 15 years passed away. We were never married and have two small children. Both of our family cars were in his name. The registration just expired on both. How do I register the vehicles? Who officially owns the vehicles now he has pasted away? I think it would be the children but how do I claim this with the DMV in California? Can a minor own a vehicle? I currently have no way to transport our children around.

He had no will. His dad is the executor of the estate.

[OH] Incorrect Lottery Sales by Cashier

My wife has been working at a nearby gas station while finishing her degree. Last night, a guy came in and attempted to buy a lottery ticket that ended up costing $30. He said it was supposed to only cost $20 so he doesn't want the ticket. Now, the gas station is saying that my wife has to pay for the ticket since the lottery machine printed it. Is that legal?

[UK & USA] Some questions regarding asylum for religious persecution

    Posted: 25 Feb 2018 11:19 AM PST

I'm a 19 year old ex-muslim living in Pakistan. Pakistan holds death penalty for apostasy and blasphemy. I'm safe at the moment as I haven't told anyone of my apostasy. I have some questions regarding asylum standards in USA and UK:

    1. Do I need to be in the country to apply for asylum for religious persecution?

    2. Does my situation need to be life and death for asylum to be a possibility? Or would the simple fact that my country holds death penalty for apostasy be enough (if I haven't revealed myself)?

    3. Would I be provided food and shelter for some time after I apply for asylum?

    4. Is there a legal age limit to apply for asylum?

    5. Is it possible for me to find work while my asylum status is still pending?

    6. Suppose I have a decent amount of money and fly to UK or USA with a visitor visa, would I be able to apply for asylum then (with the last point I mentioned in question-2)?

    7. If my application for asylum gets approved, does that mean I can remain in the country permanently?

Etsy Cross Stitch Intellectual Property Infringement

    Posted: 25 Feb 2018 12:31 PM PST

    Hello all.

Recently I've received a notice through Etsy that one of my works infringes on someone's copyright, specifically a small arrangement of simple leaves and flowers that border a quote. The infringing pattern is less than 100 stitches, and is only part of the overall design, both on my and the accuser's design. I'm located within Canada, and they accuser is within the US.

The accuser's pattern matches our identically, and they have had theirs publicly visible for several years. However, my design was inspired by an old instructional book, and created completely independently. The pattern only coincidentally matches the other's design.

I've reached out to gain some more information, but have not received a response back. I would not imagine that their design is registered, and am unaware if it's even able to be patented. If this matter gets resolved, I plan on adjusting my pattern slightly to alleviate future issues.

I would like to file a counter claim in an attempt to remove the notices, but would like to get an idea of the potential risks involved in fighting this. Is there substance behind their claims? If so, what kind of legal action could they file against me? How substantial could damages possibly be, seeing as my product has only sold a couple of times, and couldn't possibly affect their store.

    Thanks

Cop talking to DA about charges?

    Posted: 25 Feb 2018 07:58 AM PST

I was accused of something that is not true. Someone filed a police report. I was not arrested. The police called me in and i lawyered up not knowing what it was about. This was almost a month after alleged incident. The officer said she would forward report immediately to DA for potential charges earlier this week. We asked her to follow up if she did that to keep us updated. We never expected that would happen.

Surprisingly she responded that she had not had the chance to call the DA And would call them this week.

Thought it was odd she contacted me. I have not responded until I can talk to my lawyer. Also thought it was odd she originally said she would just send report and now she is calling directly. Maybe it is just semantics but I thought it was odd, why would she have to call personally? Wouldn't she just send them the report and they would determine if any charges are to be filed?

Just wondering if anybody had thoughts/ideas about this. Does that sound right for a cop to call DA office directly about potential charges to be filed?

Dog was abandoned by previous owner, now they are trying to intimidate to get dog back.

    Posted: 25 Feb 2018 09:30 AM PST

I am posting for my new roommate. We are located in Saint Paul Minnesota.

My roommate recently moved in and brought a sweet and timid dog into my house. She (I'll refer to her as K) has been taking care of this dog for a over a month now solely. His previous owner left in the middle of the night and moved to Kentucky and did not inform K that she was leaving and leaving her dog at the apartment. The dog was left crated for at least 12 hours a day, fed once a day, never walked, she would get mad at him for going to the bathroom in his kennel.

Since then K has purchased toys, food, has been walking, and arranging play dates with other dogs. She has not been compensated in any way from the previous owner.

Originally the previous owner has stated that it would be in the best interest for the dog to stay with K, even though it would be emotionally hard for her. This was done through text messages. Since then she has gone back on what she had said and has been harassing her. She has gotten her younger sister involved as well. The sister has been sending text messages also harassing and threatening K.

Her previous owner has now since moved to Ohio where there is a pit bull breed restriction I believe. She has moved in with her parents who does not want her to have the dog. K's former roommate and the dogs previous owner was evicted from their apartment ( K was not on the lease) for none payment so she is in town for a few days and demanding the dog be at the apartment when she arrives.

K has responded that at this point it is a civil court matter and if it comes down to it she will see her there. She has saved all the text messages received. Is there anything more she needs to do? Is she in violation of any animal laws here in Minnesota?

    Any advice will be welcomed.

TL:DR Dog was left behind when previous roommate moved to a new state over night, and was mistreated before hand. Previous owner texted that my roommate can have the dog and has since gone back on that and has been harassing her. Current roommate has been taking care of the dog for over a month now and has fallen in love. She is just nervous about the laws with the previous owner.

My friend was just assaulted by a woman with a bottle at a nightclub (CA)

    Posted: 25 Feb 2018 03:43 AM PST

He was just assaulted and the security hustled us out of the club even after I asked them to call the police. We went straight to the ER and are now filing a report with the police. What else does my friend need to do to protect himself and seek fair recompense?

Edit: I spoke to the police, they claimed they were having trouble getting surveillance from the club, and since all parties involved and witnessing the assault (I was entirely sober and did not) were pretty inebriated, no one could give reliable testimony last night. I was told to come to the station tomorrow when everyone was sober.

    [KY] Subway employer being sketchy

    Posted: 24 Feb 2018 10:54 PM PST

My little brother just quit his first job which was at Subway. When I asked him why, the things he told me really concerned me.

First of all, they weren't allowed to bring outside food for their lunch breaks. They get 30 min unpaid and my brother said that a manager said they had to buy their meals there (no discount but I'm not worried about that part).

In addition, the owner (I think?) also started enforcing a parking pass for the employees to pay for. This is exceptionally weird as their parking lot is pretty big, there's no paid parking at all in that town, not even meters. Customers don't pay to park there either. My brother also said that he never signed anything on paper that agreed to pay for a parking pass. This Subway only has 10 employees. With the meals having to be bought plus the parking pass, it was costing my brother $15+/week to work there.

He has a new job lined up but it really worries me the kind of shady business that is going on at that Subway. Should I report it to corporate? Is there anything even illegal or wrong happening or am I reading too much into it?

EDIT: I called Corporate and told them what was happening. Like someone mentioned, owners are allowed to set their own policies for their stores and they can't really tell them what they can and cannot do (unless it is illegal obv). This store is a one-off franchisee. However, the person on the phone agreed with me that situation is very strange and concerning, and that they would be contacting the regional manager to look into what is going on.

Thanks for the replies. I just wanted to be sure before calling higher-ups that there was something odd happening, since I think it is unfair for the other teens working at that place.

(PA) After a violent breakup, a PFA, and him awaiting sentencing, his mother is circulating the video of me after my beating on social media.

    Posted: 24 Feb 2018 02:40 PM PST

I wasn't aware I was being recorded after my ex punched me in the face several times. I'm covered in blood and definitely saying god knows what.

I haven't seen the video, but my DV advocate did and says it's not flattering. Believe me, I don't care about how I acted at that point.

What I do care about, is that it's now allegedly being shared by his mother with the caption, there's two sides to every story.

I went to the hearing, with progressive pics and all our texts printed.

He got 3 years, which is the max in my state.

After the temp pfa was set in place, she kept trying to relay messages from my ex, begging me not to show up to the hearing.

My DV advocate said that some of the texts from her can result in witness intimidation and stalking?

I have no idea what avenue to take at this point.

This video was circulated between the temp and perm pfa period.

Paying rent with no access to unit [MI]

    Posted: 25 Feb 2018 06:56 AM PST

We bought a house in December. The lease on our current apartment runs until May. Because of the timing, early termination fee, etc, it ended up being marginally cheaper to finish out our lease and pay both mortgage and rent through the remainder of the lease.

We sent our move-out notice to the leasing company but also mentioned that we were no longer living in the unit. This place usually has a waitlist for the type of apartment we're currently renting so we also mentioned in the notice that we would be willing to turn over possession of the apartment in exchange for walking away from the lease free and clear if they happened to need a unit to lease out.

Their response was to stipulate that they would be willing to agree to this but only if we turn over all the keys now. We would continue to pay rent and whatever utilities and also be required to maintain renter's insurance on the unit until such time that they found a new tenant.

Something about asking us to continue to pay rent on a unit we can't even access seems off to me and I'm wondering whether we have any leverage here, aside from just saying "no thanks" and finishing out the lease as we'd planned.

[IA] Sheriff wanted to talk to me about possible automatic weapons

    Posted: 25 Feb 2018 12:23 PM PST

    I'll keep it short.

    Location is Iowa

Was at a public DNR range. Me and a friend shooting my AR and WASR 10 AK.

Put the rifles away, move to the pistol range.

Sheriffs deputy pulls up, walks straight to us. Says someone called reporting someone had a fully automatic AK47.

I replied that I had an AK but it was semi. He just kinda stood there. I asked him if he would like to see it. He says yes. I state that I am doing it as a courteousy and he says thank you.

We go to my car, show him the AK and that it's semi. He runs the serial number, my license and my plates. Says to have a good day.

What would my rights really be in this situation? I wanted to show courteousy but if this happens again I want to be within my rights as a citizen.

Under what circumstances can private correspondence be exposed in a divorce in Texas?

    Posted: 25 Feb 2018 07:24 AM PST

Planning to undertake a contentious divorce. 15 year marriage in Texas. My spouse has been the breadwinner our entire marriage, I have been a homemaker. We have several children. It's what I would consider a "soft" abuse situation, which will be difficult to prove.

My spouse's behavior has become erratic over the last year as he senses me pulling away from him. He is paranoid and makes lots of unfounded accusations against me. I believe he will make a divorce as difficult as possible. And I think he will be looking for things he can use against me, to maintain a better financial position.

I know sometimes in divorce trials, things like text messages and emails can be exposed as evidence. My question is, under what circumstances does this happen? I don't have anything specific to hide. But it's very frightening to me to imagine all of my private conversations with friends about marriage, sex, kids, etc being made public. When communication is made available as evidence, what is the scope? Do they go back months? Years?

[Mpls, MN] Is there a law that allows the city to force your landlord to evict you?

    Posted: 25 Feb 2018 10:55 AM PST

Recently, my partner and I were sent a letter from the city that said we are a public nuisance and that there were complaints about us. I don't know for sure why this letter was sent, but I think it might be retaliation from a neighbor whose dogs bark constantly and about whom I called animal control numerous times. Otherwise I literally can't think of any reason why this would happen - we are very quiet, we always shovel our sidewalks, we follow the law.

Someone from the city also contacted our landlord and said that the landlord needed to evict us due to this public nuisance complaint. She did not evict us, but did give us a 45 day notice to leave. We have found another apartment and are in the process of packing to move.

Just this weekend our landlord received a citation from the city that said we have not been shoveling. We have shoveled down to the pavement every single time it snows, within the 24-hour period required by the city. I have no idea where this came from. I think the dog owner has been going through every possible channel to complain about us. Alternately, the city may be harassing us.

We are going to move soon, and my biggest concern is that this will follow us to our new home (in the same city.) I don't want to spend time fighting citations or getting warnings, and I don't want my new landlord to have to deal with this as well.

So, does anyone know if this is legal - for the city to tell your landlord that they need to evict you? I couldn't find anything in a Google search. Can we file a motion with the city to make this stop?

I am heartbroken, sick with pneumonia, stressed, and anxiety-ridden about this entire situation and I just want to move and start fresh in my new house, but I don't want the harassment to follow me there.

Can I get in trouble for being with friends who are drinking underage if I'm not drinking?

    Posted: 25 Feb 2018 10:38 AM PST

My friends and I range from 18-23, with most being 19-20. I myself am 20 (all in NC, US) and a lot of them drink underage. I don't drink, so they want me to be the designated driver when they go out, or just come over to hang out with them when they are drinking.

I've been told that if they get caught, I'll get in legal trouble along with them since I knew about it and didn't report it. Is this true? Is it any different if marijuana is involved? I don't smoke, but one or two of them do.

I just want to know what I'd be getting into before agreeing to go hang out with them or drive and have been finding a lot of conflicting information, especially since campus security and campus police tend to not go by the book.
