    Big thanks to you all!

I posted here about a week ago about a theft. My roommate had stolen over 1000$ of stuff from me and I had no proof yet but was obviously very upset. You guys talked me out of doing some dumb shit that would get me in trouble. I filed the police report and within 12 hours they called and found all my items in pawnshops within 2 hours of me. I got my rent paid for 2 months, all items returned, and roommate is looking at 2.5 years.

I feel like so much anxiety has been lifted off my chest and I'm just so surprised i actually got everything back!

    Tow truck driver punched me

    Posted: 28 Nov 2017 03:24 AM PST

My car was being towed out of my private apartment complex. I noticed it while it was happening so I went up to the tow truck driver to try to get him to stop. If I'm not mistaken CA law states that if a tow truck is still on private property then one can insist that they drop it. (AB 2210) I got in between him and the car and he punched me in the face and groin. He then called the police, who arrived and charged us both with misdemeanor battery. He then towed my car.

The car is under my mom's name. The tow truck company is insisting that she must be the person to retrieve it, despite me having a notarized letter granting me permission as agent of the owner to retrieve the car. But she's located hundreds of miles away..

The tow truck company also is trying to charge me for the time the tow truck driver spent talking to police. It's been in the lot for 2 days so far. They want to charge me $820.

My neighbors have also had run-ins with the same driver. He grabbed a woman earlier last year and dragged her out of her car. Also I found a neighbor who witnessed me being struck repeatedly. My court date for the battery is 1/18. What should I do? I feel like I'm out of options here...

[SC] Threatened by Aunt's Assited Living Home Part 2

    Posted: 28 Nov 2017 05:27 AM PST

    Part 1 is here https://www.reddit.com/r/legaladvice/comments/7e2m7d/sc_threatened_by_aunts_assited_living_home/

So it's been a week since my last post and the situation has escalated. Yesterday the assisted living home my aunt was in took her to a homeless shelter rather than try and get her into a mental health facility and then informed us after it happened. My aunt doesn't have any of her medication or even a winter coat and the shelter doesn't allow anyone to stay in the building after 7:30 am. Now my aunt with brain damage has to fend for herself in the middle of winter until she can go into the shelter, if she even remembers to go back. The Assited living home is trying to say that she is evicted but she is still well within the thirty day notice. Local police are tired of even dealing with the situation so I'm assumeing there will be no help from them. I have a few questions about what we can do.

1). Are they legally allowed to just move her to a homeless shelter even though she is disabled and they control her money.

2). Who can I call to report this Assited living facility?

3). How can my family go about getting my Aunt into a mental health facility?

Roommate is claiming partial ownership of my dog, wants to keep her when I move out.

    Posted: 28 Nov 2017 08:55 AM PST

I adopted a dog bone months ago, posted an ad on Craigslist looking for a dog, someone responded and I adopted their dog. My friend/roommate lent me money to purchase the dog and I paid her back. Also at the time we did not live together, but then became roommates. She is claiming that because she takes care of the dog and has assumed responsibility of the dog she has some ownership right to the dog. Unfortunately, it was an individual to individual transaction, so there are no adoption papers created.

I live in Arizona, please help me understand what I can do to show ownership of my dog, and ensure she has no legal claim to try and take my dog.

Please let me know if you need additional details, I will provide them. I want to cover all my bases, really scared she is going to take my dog from me.

Hit and Run victim, vehicle in repair, driver has been found and wants to settle without insurance [NY]

    Posted: 28 Nov 2017 05:07 AM PST

About two weeks ago my vehicle was hit in a parking lot and significant damage was done - this vehicle was a commercial truck. The person driving the vehicle that hit mine left the scene. A near by store had video surveillance, and yesterday the business that owned the vehicle and the driver were found. In the interim, I already had submitted a claim, and my vehicle is in the process of being repaired with an estimated completion date of 12/07. The driver was charged with operating on a suspended license and leaving the scene of an accident.

The owner of the company would like to not go through insurance, which I would have obliged had they been found earlier. Given the current state of repair, insurance is already well involved.

That said, what are my options to pursue reimbursement?I'll be without vehicle for nearly a month, be forced to pay my deductible, my vehicle is now worth less on resale due to the collision being on its vehicle history report, and my insurance rates will go up.

I'm not looking to sue anyone into the ground, the business owner doesn't deserve that nor is it right. I also feel there is some middle ground where they compensate for the significant burden put on me for simply parking a car. As I just got the information on the driver and their request, I've yet to pass it along to my insurer and wanted to request your (communal) guidance prior to proceeding.

    Thanks.

Ohio landlord took extra month rent from me then refused to refund it, instead added it to security deposit. Do I have a case?

    Posted: 28 Nov 2017 10:12 AM PST

Edit: thepatman pointed out technically they refunded me by adding that as a credit. That it was obtained in error is a moot point then. Going to try and challenge some of their items but I doubt they'll budge. If anyone has any experience/advice on challenging move out charges that would be much appreciated.

I moved out of a rented house on October 31st. A few days prior, the company we rented it from apparently failed to program their payment system to be aware of lease end dates, so they charged me 1.2k for the next month's rent. I caught it too late, so I couldn't cancel it at my bank's end. After a week of calling them daily, they finally told me that I would have to wait until the move out report was done to get my money refunded.

Today we finally get that report and lo and behold my money is now listed as "additional deposit" under our security deposit for a total of 2.4k in deposits. The itemized list added up to about 2.2k in damages, which I've since broken down into valid claims ($845) or bunk ($975 and $400 in "maybe"). I took photos of every room before leaving to prove some of them are bunk.

Just now noticed some of the items' prices are not in line with the move out checklist they provided us. It specified $25 to replace window blinds, but 2/3 items regarding blinds has $30 listed. It specified $5 per light bulb replacement, but has one item that says 1 bulb for $10, another that's 2 bulbs for $15, and yet another that's 2 bulbs for $40. It sure seems like they made an effort to total up damages to be able to keep all 2.4k in deposits.

Referring to this source, some of the itemized list seems questionable, like "The house will need to be thoroughly cleaned once all work is completed" for $300. They also didn't include interest on the security deposit, which we're entitled to as we signed a 2 year lease.

Can anyone tell me if I'd have a case in small claims court to at the very least get my 1.2k back that they took in error, then refused to refund? I'm typing out comments for some of the claims I felt were bunk now. I plan to send it to them in hopes they voluntarily remove some of them, but I have no idea if my pictures would hold up in court if they refuse. Any advice is greatly appreciated. I can provide the report, my comments, and photos if they would help.

6 months ago I fucked up... by helping out a friend in need

    Posted: 28 Nov 2017 10:54 AM PST

So! First of all, I'll start by saying I'm Canadian and am feeling incredibly stupid for "paying it forward." Because now I'm here, needing legal advice.

Hate to give a story but it needs some explaining.

Seven months ago, a family friend came to us and said he had to move out of his parents place (and months prior kicked out of his gf's place) and he would be on the street if we didn't help him out. My husband said, "No." Saying that (let's call him D), moving in would be a horrible idea. I convinced him otherwise... only because I know what's it's like to be on the verge of homelessness and have someone take you in and give you a chance to get on your feet. Besides, when hubby broke his leg and was immobile, D was there for him.

At first it wasn't so bad. It was only supposed to be 3-6 months. Enough time to save money and find a place. I said he didn't have to clean around the house but to clean up after himself (aka, his room, the bathroom, dishes... just pick up after himself and be a generally clean human being). I even cleared out my art room to give him a toddler free space to video game.

    Well...

During these seven months, he's turned into an absolute pig. His room is disgusting. He doesn't clean at all. He never does dishes. I find mouldy beer bottles filled ash and cigarette butts, coffee cups, food bags, weed trimmings and other gross things in both the gaming room and his room. He keeps moving boxes of his stuff into our garage without asking. He takes my husband's personal items and uses them as he pleases (even after he's told not too). When his car broke down, I dropped all my plans and drove him around for the week (work, to the auto shop)... and all he gave me was $10 for gas. My husband has even broken down and bought D things just so he'll stop using his. I even came home on Sunday and my house stunk of cigarettes!

That was my last straw. I will NOT have cigarettes smoked in my house!

He came home last night and we told him he had to move all his stuff to his room right now as he has lost the privilege of using anything else but the kitchen, bathroom and his room. We also told him he had 30 days to move out. His response? I was making it up and being unreasonable... classic D victim mentality. Everyone is always against him for no reason.

So he waits until we're in bed to come home... and he goes to the room, moves all his stuff back in my art room and video games until 3am. I go downstairs, aka him what he's doing and why is his stuff in there. He says, "Oh, I didn't understand. You weren't clear." I told him I didn't know how much clearer I could be and to move his stuff. I leave. He tells his friends he's not moving his stuff. So I took the internet modem to my bedroom. He went to bed. Wake up this morning and his stuff is still there.

    So now we're here.

I'm 9 weeks pregnant and a high risk pregnancy. So I'm supposed to avoid stressors but I've been stressed beyond belief. Plus I have a two year old in the house and am hosting Christmas this year. I can't play these games for the next 30 days. We don't have a contract agreement as he was just supposed to be a guest (he pays us $125 a week to use the bedroom, so he's week to week). I wanted to be nice and give him 30 days... but if he's going to continue acting like this, I just want him gone. I've resorted video taping all our interactions as he's lying to people about how I speak to him. Also, I have been taking pictures of all the filth and mould.

If he continues this behaviour, do I have to give him a full 30 days? He's week to week so does that mean I only have to give him seven days? He's not a tenant... not a roommate... just someone we're helping out. I honestly want to kick him out this Friday as we're going away for the weekend and I'm terrified about what he's going to do while we're gone.

So... what can I legally do here? Any advice would be helpful and appreciated!

EDIT: and side note is, we own our own home

EDIT: So! I called a lawyer and the police and they both agree that people who rent rooms are not covered under the landlord and tenant act (a common mistake people make). Month to month renting only applies to apartments: aka, a separate dwelling with their own entrance. So! The police will enforce our rights when he shows up. I want to thank anyone and everyone who took the time to post. I will update after tonight's big "move."

[KY] Gym sold and closed, won't refund me

    Posted: 28 Nov 2017 06:37 AM PST

I tried posting this before but I believe I was too wordy and I didn't get any responses. Here is the post.

Long story short, my gym (Gym A) closed and I had about 6 months of membership remaining. They did not call, email, or send out mailings announcing that they were going to do so but they did post notice on the doors of the gym.

I took about a month and a half off due to a crazy work schedule and this all happened while I was off. I heard from a coworker that it wasn't actually closing but was moving to a new location (Gym B). When I spoke with an employee at Gym B (before it opened), I was told that it was under new ownership and that I would have to reach out to the previous owners of Gym A for refund questions.

I found the Facebook page for Gym A/Gym B and it noted that my membership to Gym A would be valid for the rest of the term at Gym C (a standard, big box gym unlike Gym A/B). They also offered refunds for a period of one month and would not honor refunds requested outside of that window. I have no desire to attend Gym C and would like to attend Gym B since they have all the same equipment and it's actually more convenient for me.

Do they have any legal requirement to refund me? I haven't put much pressure on them yet because I'd like to know where I stand legally before I start giving them a hard time.

EDIT: As a note, Gyms A & B have no signed contracts. You either pay a month at a time, for six months, or for one year. My remaining membership was part of a 1-year purchase.

EDIT 2: Tried to clear which gym is which.

Texas ambulance showed up 30 minutes late when 911 was called. There was a delay in getting critical help to my carer who has since passed away. Do I have any liability?

    Posted: 28 Nov 2017 10:41 AM PST

I am legally blind and am not legally allowed to drive. I have some sight but not enough to be able to safely drive a vehicle. I do receive help from a private pay agency so I have a care worker who comes in to help with some things (mostly transportation).

He recently had a medical emergency during his shift at my house. I called 911 twice. Each time they said an ambulance would come. I wait roughly 15 minutes after the two calls (about 5 minutes apart) before walking over to my neighbors house and asking him if he would drive us to the hospital. I am a small woman and can't lift my carer and my neighbor is also small so we had to get a third neighbor to help us lift my semi unconscious carer (he needed help standing but was awake - he did slump over in the car and was unable to be revived) into the car. We called 911 a third time and they said an ambulance hadn't been dispatched but they would do that. We are 20 minutes in by this point so my neighbor and I just drove the 5 minutes down to the hospital really quickly.

My third neighbor said that the ambulance did come by at a certain time which would have been roughly 30 minutes after we made the initial call.

I have since heard from the family that about a week later my care worker passed away. I am not sure of the exact cause of death.

Obviously I have no medical training and as I couldn't legally drive I could not have driven him to the hospital myself.

I have talked to the family and they said that the first two 911 operators or it might have been the same operator ( I am not sure) had failed to dispatch an ambulance and that my calls were logged as hang ups ( I am hearing this as second hand so I am not sure of the details).

I am 100% didn't hang up. my call log on my phone says we talked for 2 minutes and that I called twice (talked the second time for about 1 minute). I definitely requested an ambulance. Both my neighbors were there for the 3rd 911 call where an ambulance was dispatched.

We did wait 20 minutes to take him to the hospital but I made the first call as soon as the emergency occurred. I was unsure if an ambulance was actually coming or not.

I have some money and a liability umbrella policy but I am wondering if I need to even do anything yet. Would I be at all liable for waiting for an ambulance? What is my responsibility for medical emergencies that occur in my house (yes I have home owners and an umbrella insurance policy)?

[NY] my family's old estate lawyer has been disbarred and thrown in jail in for theft from clients. Is there any way to tell if he stole from my family?

    Posted: 28 Nov 2017 09:17 AM PST

This is not recent. My mother died in 2001. Her estate was not completed until a couple years later. This particular attorney was recommended to us by a friend who interned under him in manhattan. There were only three surviving children and all young and in college at the time, so we did not know better and took the friends recommendation to heart. He did an awful job and kept on prolonging the competition of the estate. This took over 4 years to complete and he kept on waving us away when we went to look for answers. We were also told it wasn't wise to switch lawyers so far into the estate process and we were also told it was extremely difficult to sue an attorney for malpractice. The estate was so badly bungled my siblings and I were later audited by the IRS as he botched the taxes.

In 2012, the same attorney was sentenced after pleading guilty to second-degree grand larceny and first-degree scheme to defraud. He stole $140,000 combined from three clients from 2007-2008. My family by then was not surprised to hear the news. He currently is serving roughly four to six years in prison.

So my question is there any type of "legal forensics" to investigate if he did the same to my family long ago? Or should we just let this go? The estate was so badly mishandled and we just want closure much more than any potential compensation.

Wrongful dismissal - Construction site - Canada, BC

    Posted: 28 Nov 2017 05:39 AM PST

I'm an apprentice electrician with a company based out of Alberta, working in the area of Kelowna BC. I raised some Health and safety concerns on site regarding spray foam insulation and working in proximity to it. Other employees also made inquiries on site for this and other reasons on this particular site. After getting very little information from my boss, the people doing the spray foaming, and the general contractor on site I called worksafe.bc to find out how close I was able to work to the areas being spray foamed.

Worksafe asked me if I knew what type of spray foam it was, I said no and that the foamer's hadn't given me any information when asked. He asked me to get the MSDS/SDS for it and that it might say on there.

The MSDS which I still have, says that the area must be ventilated or Oxygen delivered respirators must be used. Niether of these were options at site, or provided. I continued working ( in the effected area ) until 2:45pm which about 30 mins to the end of the day when I was approached by the general contractor of the site along with 1 of the 2 safety officers on site.

He told me I was being kicked off site for raising the health and safety concern. I mentioned to him that I had pictures proving said safety concerns were valid * something I don't have to do, and probably shouldn't have mentioned in the heat of things* He escorted me to the entrance of the building where my boss caught up with and *seemed frazzled about the situation and was going to call me later that night to try and work things out, no call came. I called worksafe.BC when I got home explained what had happened, and they setup an officer to call me when they had an opening.

This all happened in the last 24 hours, I have no information on if they think I quit, if I was fired or written reasons. I have been looking into legal advice for when the morning arrives and I can start calling people. If anyone has any information on how I can report them for poor work practices, or get someone to warn the other people on site that the whole building should be ventilated or that they should have respirators on that would be great!

Found out via a parking ticket that someone else has a car registered in my name -- help

    Posted: 28 Nov 2017 09:43 AM PST

Long story short -- I got a parking ticket for a location I have never been to (but in the same state -- I live in Washington). I was at work at the time, and I have text messages to prove it. Upon contacting the administrative office for this location, they provided me a license plate number and a vehicle model of a car I don't own -- but it supposedly is under my name/address.

How do I proceed in this situation? Call the police? Freeze my credit? Is this identity theft? Please help.

[hawaii] 19 years old; parents stole passport/social security card, has somehow used the police to prevent me from flying so that I can move away to escape them

    Posted: 28 Nov 2017 11:47 AM PST

Basically; I want to move away from my abusive family. I only had a passport, my mom will not give me my social security card (its locked away). I still got my plane ticket, got my boarding pass, was waiting in the terminal when (deep breath)

My mom consistently threatened to call the police on me, to cancel my ticket, to freeze my bank account (i own the account fully). Eventually, a sheriff shows up and tells me he can't make me stay or leave, but that my ticket might be canceled, and I'll have to go to the front desk to make sure.

I was being stupid and figured he was right, I needed to check, and I didn't know where to anyway. So I follow him, and he gets me up to the front desk of the airlines, which has me call UA. I pull out my passport for information or w/e, which has my ticket there in my hand as well. My mom sneaks up on me and takes my passport and ticket, rips up my ticket, and says I can't leave now.

Airport security and personal ignore this and say 'yep you can't leave now'. Sheriff says that they set me to 'flight risk' because my mother flagged me as someone being human trafficked, airport says they can't get me a new ticket/boarding pass because of this as well. I'm stuck outside the airport with nothing. My mom also apparently had been keeping tabs on my personal bank information, and froze it all.

So now I am stuck in my house with basically just this phone, which she might take away soon. She stole my account info to my bank and locked me out of it, she stole my only 2 forms of identity, she's harassing the people I was going to move in with, and I don't know if I can take the next flight because I could still be 'flight risk'.

What the hell do I do? I plan to go out and get my own personal ID and bank account, and I have another flight that leaves monday a friend got me. But I have no idea how she was able to manipulate the events before hand or what the hell I do to combat that. Can she always just tag me as flight risk if I try to leave?

    Pig Invades Garage

    Posted: 28 Nov 2017 09:21 AM PST

    Location: Brevard County, FL

Last night we had a fun visit from a pig from a neighboring farm. This pig has been visiting many homes within our community recent. What makes this more difficult, while our community is within the city limits, the back end of our community which borders a road with this farm is the line between the city and unincorporated county.

The farmer in question allows all the animals to roam free and does not fence them in at all. This has always been the case but has recently become an issue for us as our fence along that road was damaged in many areas in the recent hurricane and repair companies are backed up for months still.

In our specific case, the pig came into our garage (we had it open to allow a nice breeze into the house) and began eating some food we had stored out there. Knowing this had been occurring to others and the pig at times had been difficult to catch we called the local police and closed the garage door. We did not approach the pig as it has been reported to be a biter from others in the community.

The police came and captured the pig with the intentions of taking it back to the farm again. We have been told the owner of the farm has been approached by the county sherrif and animal control many times, but the rules of what are allowed in the county are different than in the city, so while it would be illegal on this side of the road, many things are not on the other.

That all said, I have a few questions.

    1. Even if the farmer is allowed to have the animals roam free on the county property, does that mean they are off the hook if they then roam into city property?

    2. Does the farmer have any responsibility for damage caused by the animals if they leave their property?

    3. While our damage was minimal, I was thinking of sending a simple demand letter asking for the cost of the damaged food, and perhaps a token amount for the cleanup from the mess the animal left. Not looking for a windfall here, would not be asking for more than probably $50-$100. Just enough to try and drive some change and put a little sting in it.

I have a pre-paid legal service through work I think I would use to have the letter written, though I have not reached out to them yet.

Any thoughts and or help would be greatly appreciated.

[PA] I'm a "fugitive" from a now years-old misdemeanor marijuana case thousands of miles away. Lawyer nonresponsive. What now?

    Posted: 28 Nov 2017 06:04 AM PST

I was busted with some weed in my car on a PA highway a little over 3 years ago, and charged with possession (small amount), as well as paraphernalia for the rolling papers and speeding (<15 over). (I did attempt to refuse the search of my vehicle, but the PA courts had just recently decided that didn't matter, cop smelled it and that was sufficient to search anyway.)

At the time, I lived in NYC, about 2 hours away. I thought my best bet was to find a local attorney, and after a fruitless internet search, I ended up going with one of the bunch who sent letters to my home address. I picked the one that seemed by far the most well-written and professional, but in hindsight, it does not appear that I chose wisely...

Even more unwisely, I failed to make a court date just over a year later (so just over two years ago now) and have had a warrant out ever since. I also moved to Utah, over 2,000 miles away. My attorney also doesn't return my phone calls anymore. I only tried twice in the two years since, but both times the secretary tells me she'll call me back and never did.

This hasn't actually affected my life one bit, but maybe it's just a matter of time. The lawyer warned me that I'd get arrested on the warrant in any state. However, a couple of months later I was stopped in NY and assume I was checked out, but no warrant was mentioned. That was the only police interaction I've had since. Regardless, I would prefer to resolve this rather than be a fugitive, if it's still somehow possible.

The first thing I will need is a new lawyer, but how can I find a decent one when I am now on the other side of the country? Even at the beginning, before this one stopped responding, there was a huge red flag:

At the first court date, she showed up a half hour late. This courtroom was literally in a strip mall, and the judge, arresting officer and myself were the only three people there, just sitting and awkwardly waiting for her for 30 minutes with me occasionally apologizing. The judge clowned her lame excuse about traffic ("Really? I'm there every day including earlier today and it's clear...") but didn't push it, and thankfully neither he nor the cop seemed to hold it against me personally. They both agreed without a second thought to allow me to apply for the conditional discharge program, and basically just seemed pleased that I bothered to come back to court. At the time I had a demanding (and high paying) full time job to take off from for this.

Oh yeah, by applying for that program I waived my right to a speedy trial, so there's also that.

Anyway, unfortunately I screwed up and failed to mail the application in on time. It was just a couple of days late but apparently the new judge, now at a "real" courthouse wasn't pleased and demanded I show up in person immediately, work and distance be damned. This is the date that I missed, and no progress has been made since.

At this point my lawyer also decides to inform me that I will need to see a probation officer, and ever so helpfully that I can do it on the same day. She somehow neglected to mention that entirely at any earlier point, even though I asked about any future trips to PA I'd have to make. (I think the court appearance would have been avoidable if I'd mailed in the application on time, but not the probation visit.) Honestly I wouldn't have passed the drug test on such short notice...

Well, that was the last time I was able to speak with the lawyer, and the last update of any kind on this case. Except of course for my call to the sheriff, who simply told me that I "would need to come in." I'm not considering flying all the way over there just to do that without new legal representation, though. I obviously violated the terms of my agreement, and the maximum penalty does include some months in jail, so as bad as it sounds, continuing to avoid the state of PA seems safer than doing that...

Is there any point in seeking help from an attorney in my new home state? If not... do I have any decent options here? Picking a random local one didn't seem to work out great, but this is a poor rural county, is it still a better bet than one from Philadelphia or something?

BTW, I agreed to pay a total of $2,500 to handle the whole process which I felt was way excessive but just wanted it done. The only payment they ever asked for was the $500 up front. I made two more $500 payments that were entirely my initiative (trying to be a "good client"), never heard about the rest.

Also, this probably won't help me but I no longer work full-time ... I fully support myself without any assistance, but that only takes very few hours of freelancing work and, well, trading. There have been some annoying and long-running medical issues, but also quite a lot of free time and a fraction in terms of taxes paid, compared to before. How worried should I be about how this appears?

Any opinions on anything else I should do or just how far up the creek I am?

[TX] Homeless people keep stealing packages from my friend's front door. What can she do?

    Posted: 28 Nov 2017 09:25 AM PST

Different homeless people keep coming by and stealing my packages from my friend's front porch. What can she do (legally) to stop it from happening? The police don't tend to take calls like this seriously, so she may have to take it into her own hands. We're in Texas, and UPS is the person delivering the packages.

Someone stole my wife's mail with credit card and spent $1500 yesterday

    Posted: 28 Nov 2017 07:23 AM PST

    EDIT: NY

My wife replaced her CC with a new one and the bank said it was shipped out on 11/20 to be delivered in 3-5 business days. The card was never delivered and she noticed strange charges yesterday and got a text that they stopped a suspicious charge. She checked her account and saw $1500 in pending charges at 3 different department stores which are 3-5 miles away from our house.

I enrolled USPS Informed Delivery and found the "unmarked" envelope was supposed to be delivered on 11/24. She never received that mail but we got 4 other mail that day.

I was home working on the front garden on 11/24 and saw the mailman deliver the mail. I took it in 10-20 minutes so no one could have stolen the mail from the mailbox and it was probably done internally.

The bank is investigating and they are reversing the charges. I told my wife to report it to the post office. Should we file a police report? Anything else we should do?

Will they be able to catch the suspect easily with cameras since all the charges were within 1 day at the mall?

Suffolk County, NY: Tenant cut wires to house cameras, breaching other (not on camera)verbal agreements. Can I press charges/call police?

    Posted: 28 Nov 2017 08:59 AM PST

My mother rents a house out in Suffolk County. She lives in a different state, leaving me to deal with the tenant issues/collect rent/etc. A tenant, which lives in the side studio of a Ranch, is breaching verbal agreement such as smoking weed/cigarettes in the apartment as well as kicking other Tenants cars, smearing drinks (and on one occasion) feces on their cars. Upon reviewing the 4 cameras placed on the property, there is video showing the tenant in question walking up to the camera, moving it and the feed cutting off for good. The wire is cut and currently dangling by the roof of his side studio. All of this is occurring in the span of two weeks. My mother does not have written lease with this particular tenant. I told him to leave by Friday(it's been a week since I've told him in voicemail/message that he has yet to respond), if not I will call the police for destruction of property. Do I have merit to do this? Thanks in advance!

Can a company or firm sue someone abusing their free trial system?

    Posted: 28 Nov 2017 06:44 AM PST

I've been resetting a 5 dollar weekly trial for around 5 weeks now, and just recently I noticed that any new accounts I make won't go through, and I received a warning saying "Rejected: GateWay Fraud". I want to contact the company, apologizing for this, promising that I will purchase their full service with the next purchase on my card, but I'm afraid that I'd be leaving myself open to legal damages. How fucked am I?

American Airlines delayed my wife, charger her $330 for an unused ticket, refuse to refund us. (USA, TX/NM)

    Posted: 28 Nov 2017 01:42 AM PST

My wife was flying the return flight on a roundtrip ticket, DFW ---> ABQ, with American Airlines. The ticket was a Basic Economy ticket, nonrefundable and non changeable. She had a single bag to check and needed her boarding pass, already purchased her ticket.

She arrived at DFW approximately 75 minutes before the scheduled departure of her flight, and immediately got in the curb-side check in line. According to American Airlines, you must check in at least 45 minutes before your scheduled departure. When she finally reached the front of the line (approximately 20 minutes later, or 55 minutes before departure) she was told she was too late and was unable to be checked in. To me this seems like a refusal to carry on their part and not a failure on my wife's part, since she was there 10 minutes earlier than the only posted "cut-off" time for check in.

She then went upstairs and waited in line at the ticket counter. She was in line waiting until 15 minutes past her flights departure, or for a total of approximately 60 minutes. At the ticket counter they told her that she was required to buy a new, $330 ticket for a flight scheduled 2 hours after her first flight and that the original ticket could not be used or changed in any way. However, after she had purchased the new ticket and checked her bag, they printed the boarding pass using the original ticket number and no records show that the new ticket was used at all. Her return flight boarding pass also shows her original ticket number.

When I contacted them on my wife's behalf and explained the situation I was told that because the new ticket was also nonrefundable they are unable to refund us directly, however they have waived the change fee and we can use the $330 credit towards a different flight within 1 year of the purchase date of the ticket (but she and I hardly ever fly, so this would go entirely unused). They also claim that the $330 ticket purchased was required for her to board the new flight. After multiple emails back and forth they have shown they are unwilling to cooperate further or accept any form of blame for unreasonable delay of my wife leading to her missing her flight.

Both tickets were purchased via a MasterCard debit card with our credit union. Is this the point at which we should contact the bank and ask for their intervention on our behalf?

Is it unreasonable to expect American Airlines they refund in full the $330 ticket regardless of its status as nonrefundable since it was their initial mistake that caused the sale of the second ticket to take place?

Signed a lease with our landlord saying that the water bill is included in our rent. Now landlord is saying that she didn't mean to include that in the contract and wants us to pay for water bill. What should our next action be?

    Posted: 27 Nov 2017 04:08 PM PST

Signed a one year lease back in August for an apartment and it said that water is included in rent. Both the lease and her online ad said that water was included. She then contacted us last week (3 months later) saying that she didn't mean to include that in the contract. She wants us to sign a new contract saying that we will pay for the water bill. We don't want to do that because we were both under the impression that it was included in rent. What should our next action(s) be? I think she is trying to write up a new contract and get us to sign it so that we now have to pay for the water bill. She can't do that correct? We're located in Ontario, Canada if that makes a difference.

Any advice would be greatly appreciated.

    Laptop taken for "evidence"

    Posted: 28 Nov 2017 11:18 AM PST

There was an over dose at my apartment and I called an ambulance and the police showed up as well. They spotted a laptop that had a bit of drug residue on it (heroin) not a measurable amount just a bit of dust. They took the whole laptop and put it in a garbage bag and left me with nothing. No case report, number. Nothing at all. This happened in August. I tried calling the precinct and they simply said "it is in evidence you don't get that back" and hung up. Is this true? If there was residue on the floor would they take the whole floor as evidence? Something doesn't seem right here. Any input or suggestions would be awesome. Anyone have experience with something like this in the past? Also as a note there were no chargers or anything. The cop mentioned good Samaritan law or w. e.. And there would be no charges.
