At the beginning of the fall semester, I was walking out to run a few errands. I walked into the parking garage and noticed my truck was not where I left it. I told myself I must have parked on another floor and checked every level until I reached the roof. I double-checked the entire garage, triple-checked it, and quadruple-checked it. I had already called my apartment's towing company, and they told me that they hadn't picked it up. I believed it was stolen, so I called the police to file a report and prepared to make the police report for the insurance claim (Another nightmare). Eventually, the police found my truck was under a lien. The thing is that my truck was paid off, and the title was under my name. I called the "lien holder "/ loan holder, and a manager said the truck was sent to auction. After a bit of back and forth, they finally relented with the information and evidence I provided. My truck was delivered to one of their loan branches from another city. I got to the branch, and they told me they had no idea the truck about this mess (I highly doubt it). The loan branch also did not have any documents regarding this. I was only given a key to my truck, so I went to inspect it. As I opened the driver's door, I noticed a foul stench, grease stains all over the truck cloth, a hanging dashboard, and the brakes were feeling off. I called back the manager I spoke to earlier, and they said I would receive documents regarding this ordeal, but they never did arrive and stopped answering my calls. This ordeal infuriated me because I missed classes for a week, got in trouble at my job because I had to call in, and was put under a heavy financial strain. I want to do something about this, but I don't know where to start or who to contact. I'm also broke, so I don't know if I could even consult a lawyer. At her second visit they did neither. My wife had her first appointment with our OBGYN almost three weeks ago. They did blood work and told us they would contact us with any news from the results. My wife started experiencing back pain about a week ago. It has gotten worse every day, and we chalked it up to sciatica. This morning was her second appointment. The doctor told her that her first blood test results (from nearly three weeks ago) showed a UTI, and a prescription would be called in for her. She then found that the fetus had no heartbeat. We were at week 10 of pregnancy. We are scheduling surgery now for removal. I would like to know if there are any tests during/after removal that can show if the UTI caused the miscarriage, and, if so, if we have a case for malpractice. [link] [comments] |

He's a few years away from being able to draw social security, but has decided to retire early and indicated on the FL-100 that he is requesting spousal support. I've been making a dedicated effort to find employment (not the easiest thing in your 50s with a 20-yr employment gap) and I know I'll find something, but I'll be lucky to even make half of what he's currently making and will be on a very tight budget. The thought of having to tighten up that budget even more to pay him so he can retire early and run off with his much younger girlfriend is galling. Is there much likelihood of my having to support him or is this a delusional fantasy on his part? Someone hired lawyer to stop hospice care. Posted: 27 Jan 2022 06:12 AM PST My spouse has been ill for 6 years and in a nursing home for 3 months. This week after meeting with doctors and nurses I decided to end his dialysis and place him under hospice care. He is 64 years old. This morning we where to remove him from dialysis and place him under hospice when a lawyer called the doctor and demanded to told about his treatments. I have POA and POA of Health Care. The doctors office said they are not allowed to give me the name of the attorney. How do I find out what is going on? How can I protect myself? Why would some lawyer be calling a doctor? I'm confused and not sure what is going on? Any advice please EDIT: to add some more to the situation, dialysis runs $125,000 a month. His back surgery last year was over 500,000. I became her POA a couple years ago after she withdrew thousands of dollars in cash from her bank account and mailed it in an envelope overseas to a scammer who tricked her into believing he was in the US military and in love with her. We have decided to sell my mom's home to help pay for the costs of moving her into Assisted Living because I work full-time, my sister lives out of state and the caregiving agency is not able to provide the medication management and round-the-clock supervision she needs. She has not yet completed the application process and they are currently experiencing a COVID outbreak so we are not 100% sure when/if she will be moving there. We discussed having a few realtors give an estimation of value on her house and then choosing one together. My mom misunderstood and contacted a realtor on her own. I was unaware that this was happening and when I went to her house there was a lady there taking pictures and talking about listing the house this very evening. When I told her we wanted to get other opinions she told me, rudely, that my mom had already signed a legally-binding agreement to list the house with her company exclusively. The house is a mess, smells like cat urine, and does not have a functioning oven because my mom left it on one night and it caught fire. I explained to the woman that I was my mother's POA, but she didn't really seem to care. She also wanted to list it for only $10k more than my mom purchased it for even though she has put about $30k worth of work into it. She has only owned the home for 2 years so I understand if we can't list it for more but I want to know for sure first. My mother does not immediately come across as cognitively impaired in casual conversation and owned her own real estate company as well as other businesses years ago, so I understand why the realtor didn't immediately catch on. My mom is also really polite and can't say no to people, so she is very easily manipulated into things. She told me, in front of the agent, that she wanted this woman to sell her house and it was her choice. It was an extremely uncomfortable situation. We may ultimately chose to go with this realtor, but I want at least one other opinion first and need time to get her home looking acceptable so we can get the best possible price. Posted: 27 Jan 2022 11:16 PM PST Around Dec. 28th my landlord told me he was going to have a company do an energy assessment to see where we could all save on energy. On January 10th he asked which day he could schedule the assessment for. I had just tested positive for COVID that day so I told him and we postponed the assessment. I just tested negative this past Wednesday and so I messaged him asking to let me know when he wants to come with the company for the assessment. My partner and I noticed our water isn't getting as hot as it used to just a few days ago. In fact, it's not really hot at all… it feels about 95°, so warm but almost hot… and that's with the knob turned all the way to the end of the hot side! Our landlord didn't say anything about this to us. We pay for electricity and gas so I'm not sure why he needs an assessment to see where they can save if we pay those bills. My partner and I think it's a water assessment of some sort since he keeps saying we don't need to be in the apartment when it happens and they have asked 2 times if we would be present. I am wondering if maybe they turned down something so that we would spend less time in the shower… but he already increased rent by $100 because, "prices of garbage disposal and other stuff change yearly." So I'm currently having some trouble with my former employer refusing to pay me because they are angry with me for quitting without notice. and I just would like to hear some advice and feedback on the correct next steps to take. I'm going to try and keep the post as short as possible but please feel free to ask any questions or for any clarification. I began working for this employer in the beginning of 2020 working from home just managing customer service. As time goes, my paychecks were never issued to me on the dates that my offer letter stated or the dates that were mentioned in my training. When mentioned to my employer they just brushed it off. In February 2021 I noticed that money was being taken out of my check. When I asked my employer he told me it was automatically taken out for my 30 minute break regardless of if I took my break or not and most of the time I did not take a 30 minute break due to being the only person employed in my department. November 2021, I do not receive my pay check by payday which has become normal at this point and when I began questioning my employer on this, I was told it would be late/the company didn't have funding/they were going to the bank/ etc. There was an excuse every single day that I asked about it. Second payday in the month comes around and I am still waiting for the first paycheck of the month as well as now the second. I am paid both paychecks on Thanksgiving day. Due to the entire month of November being unpaid, I had a few bills shut off from not being able to pay them on time so I was unable to continue working. Once I was able to get everything settled with this, I began contacting my employer for my final check starting in December 2021. I was immediately being told to call them but when I would try I'd get no answer or no response on a best time to contact. I begin to reach out to them daily asking when we can resolve it and when I can expect my check. I was given a date twice of when I would receive it only to not receive it. As I continue to contact them, I was only met with the same excuses from why I was not paid all of November (funding/more important people to pay off etc.) and then they began questioning my sudden departure with no notice. I explained the situation only to not get a response. Yesterday, I reached out again and once again I was told that it was my choice to leave without notice and that I have to wait for whenever they are able to pay me since I left with no notice. Upon explaining my situation again, I was told that it was no excuse and they'd get to me when they get to me. It has been almost 2 months now since what the technical date I was supposed to receive the final paycheck according to the offer letter and training book. I have tried contacting their states wage department (the company is located in a different state than I reside in) but they said they couldn't help me because my employer would not speak to them. Update to my daughter being shot with air soft gun. Posted: 28 Jan 2022 04:26 AM PST My lawyer was able to get me an ex parte so my daughter doesn't have to go over there till court. Her mother can only see her through supervised visits. I spoke with the detective read the report of the officer and he basically said the air soft gun is a toy. His 8 year old has one. The mother and step dad were playing so he sees no reason to arrest anyone. My lawyer warned me this might happen because this particular town loves guns and the detective did seem like a gun lover. My dad did call the actual sheriff and pitched a fit. He didn't seem to agree with the detective and said he doesn't care if it's a toy. That he would make sure it's investigated thoroughly. When I spoke with the detective he hadn't done any investigating himself. Just read the report from the officer that night where the mother said it was her son that shot the wall and it hit my daughter. I sent the detective texts where my daughters mother's mom asked her why "his name" shot her. She said he didn't shoot her it was an accident. So she kinda admitted. I purchased a pair of glasses (frames and lenses) from my eye doctor three years ago. Today, I brought the frames back to have new lenses put in. I ordered the new lenses at the optometrist's recommendation; they did not mention anything about the possibility of damage or who would be responsible in the case of damage. They also remarked that my frames were in "good shape" and they "didn't see any issues," though this was not in writing. I did not sign any paperwork or waivers. While switching out the new lenses, the optometrist broke the frames. They snapped at the bottom of where the lenses go. These frames are designer brand and over $200 new, but my doctor is only offering a $30 discount and is saying that I am responsible for purchasing new frames. I know this is a smaller issue than this sub usually deals with, so thanks for reading! This is the type of tow company where clients call us to move there cars from place to place not the type that repossesses or impounds cars. Often, we get calls from people who have crashed and need their car towed from the crash site. Several times now, we have arrived to pick up the car only to be threatened with arrest by the police and told we cannot touch the car. Only the company that is contracted to work for them may touch the car. Is this legal even though the owner of the car has asked to use our service instead? The other tow company then proceeds to also not allow the person to have a say where their car gets taken. They immediately take the cars to their own lots to be able to charge more. I pay a million different fees to be able to work in this city as a tow truck driver and I feel like myself and more importantly the citizens of my city are being cheated by corrupt police that are taking kickbacks from a major company. I come back from my vacation to see i now have -17 vacation hours. my manager is just as confused as me but we speak with his boss and he tells me that our company ended the term on December 14th, and that's actually when my hours expired. First question is this legal? am i entitled to my hours until the end of the year? Art critique and Curator stole my work Posted: 28 Jan 2022 05:55 AM PST Hi folks, this is set in Canada. I do have a few ideas on how to proceed but would love advice. I am an emerging contemporary artist in and I met this man claiming to be an art critique and curator at my vernissage in November. He seemed impressed with the work and was an overall great conversation, asking me specific questions about my intentions and inspiration, telling me how he organizes independent artist's show in the city, name dropping a few big shots in the city's art game that he collaborated with, all verifiable through articles and videos posted online going back a few years (which he shared with me in over 35 seperate emails, first red flag). I did my own research and everything I was able to find about him was legit enough so I decided to proceed with caution. From the very beggining, I felt I was being a bit love bombed by this stranger as he excitetly said that my work deserves to be known and that he'd love the opportunity to do some videos where he has Academic like conversations in front of and about my work, and that it would greatly help to have "a famous art critique" to review my stuff. I can't tell too much about his video projects as the name he gives them would be a dead giveaway of his identity. I was invited to one of the shows he was organizing downtown and I went, met with other artists that were showing there and had another lovely conversation where he described in more depth what a collaboration with him would look like. Now I won't dive in the shady details of it all because it would be a long post, but he did come over my studio, twice, for almost 4 hours each time, and not before making sure I had beer for him (another red flag, he drank 4 at each one of our meetings). He asked to see everything I did, my old portfolios and the new stuff, the sketches and studies, he saw every single piece of work in there (making a big show of not wanting to touch them with his bare hands, stating knowledge on how to handle sensitive archive material). He had unsupervised access to it all while I went to the bathroom, or outside for a cigarette. He promised me a solo show within my studio where he would invite an impressive list of art collectors and museologists as well as journalists he knew, build up a press release and send strong recommendations to other galleries he regularly worked with (again, verifiable information). I had previously asked him what his motivations were and he stated a lifelong passion for research and curiosity, a calling for spreading the art of artists he considers need to be seen. At the end of the second meeting, he finally disclosed a 1200$ fee for him to complete what we had already spent over 10 hours organizing. When I asked for a contract, he said that artists usually just pay his price without a written agreement or invoice. He left still trying to convince me he gives his 100% once agreement is reached and that the people he would bring were *very important people that would take time off their busy schedule just to met me* and might buy some paintings. I obviously refused, sending him an email a few days later where I stated that his methods aren't up to the standard of business I wished to conduct and that I never agree to anything regarding my art without a contract, but not before he sent me three more emails promoting his services. We are a few more days later, and he never replied. I was back in the studio and noticed that at least 3 of my most recent on going drawings were missing. As they are in progress, I don't have any documentation of them and because my practice is a bit chaotic, I'm not sure how many or which ones exactly are missing. All I know is that he showed the biggest interest in them, they were left in front of him while I stepped outside for 5 minutes, and that I heard a shuffling of papers when I came back in. I'm beginning to think that long seduction show was not just to get a few dollars out of me and that his plan was to gain enough of my trust to have access to my art, because it seemed odd to only disclose it so late in the game, it's almost as if he purposefully wanted me to be super emotionally invested in the project before disclosing a breaking factor that of course I would refuse. I do not have an address or a phone number, we have communicated by email or in person only. I don't know how I could even prove it, although I do have all the emails where we arranged the meeting as well as some of his empty promises. I am certain that he was the only one here in the past month. He is somewhat of a public figure in the art world and I'm afraid of the implications an accusation with no proof would bring to the advancement of my career. I don't even know if the Police would take a few splotches of paint on small pieces of paper very seriously. While I'm angry to have been played this way, I'm mostly concerned for other artists who have been and will be taken advantage of by this man. Now I thought of trying to contact him again, saying that surveillance cameras were installed (lie) and to bring back the stolen pieces but I have a feeling I'll only be ghosted. What should I do? My bank won't complete an ACH transfer traced to them Posted: 27 Jan 2022 03:22 PM PST So, I'm a freelancer, based in DC. I did work for an out of town client back in September 2021, who paid me (a little over $1k) via direct deposit. However, the money never arrived in my account. I asked about it a month later, and my client told me he had paid me, but paid me again via Venmo when I showed him my records from when he sent the payment, showing that it never arrived (we've worked together several times, and we trust each other pretty well). Both of us reached out to our banks' support teams - my bank said they had no record of the transaction, but a few months later (in December 2021), my client's bank was able to trace that the ACH transfer had successfully occurred from his bank to my bank, and that the problem was somewhere with my bank. My client sent an angry e-mail to my bank's CEO in January 2022, and within hours, the missing $1k+ ended up deposited in my account. I sent my client the same amount back via Venmo, because he'd paid me twice at that point, but the next day, my bank withdrew the $1k+ BACK OUT of my account, and now I'm out that payment again. I contacted both my bank's support team, and the CEO again…and both seem to be dragging their feet at getting this resolved. Posted: 27 Jan 2022 05:49 PM PST I went to an eye doctor (ophthalmologist) today and was sold a bottle of RX eye drops with a RX label that had a "dummy" patient name on it with the doctor's office as the home address. Not mine. I was told because the RX is compounded and not available at the local pharmacy this is how they get it to patients faster by filling them in a dummy patient name and then selling you the RX instead of sending it the pharmacy and making you wait a few days for them to directly mail it to you. Landlord keeps shutting off water to make repairs without proper notice Posted: 28 Jan 2022 04:34 AM PST This is in Montgomery County MD I recieved notice of water shut off a week before the first day of repairs (tuesday). Then every single day this week the leasing office send an email saying they didn't complete the repairs and will shut the water back off the next day. They turn the water on for the evening and then back off during the day. This doesn't appear to be an emergency because the water keeps being cut back on for the evening. I believe in my county you need to give tenants 24 hr notice in between non emergency repairs, but I'm not sure [link] [comments] |
