Posted: 01 Dec 2021 12:33 PM PST The day before thanks giving a family friend daughter (f16) got pulled over for going 20-39 over the speed limit she was going 61 in a 40 zone , she doesn't have her permit and she got scared and out of childish behavior used my name (f21) and said she forgot her license . The cop not doing his job correctly didn't even question it and gave her a ticket taking 6 points off my license with a mandatory court hearing ( don't know if it's if the ticket isn't paid or not ) I had a talk with her mom and she told me it's my choice on what I want to do , that they don't have the funds right now to get a lawyer but I know the girl has had a hard time so I don't want her to get any jail time or really bad punishment , what do y'all suggest . I own a lot in The Preserve of Texas and the owner of the Preserve is in debt and owes back taxes on most of his lots. About 5 years ago, the board (in which he appointed) voted to charge the lot owners (except for the owner of the Preserve) a "special assessment" that would go to fixing the roads (tons of potholes) and the upkeep of the property. Fast forward to today, roads are worse and he just started to keep up with the mowing. Yesterday, there was a meeting in which we were allowed to attend, but could not ask questions or request documents like the P&L statement, budget for next year and a breakdown of what the new special assessment will be used for. As owners, we represent about 1,500 votes, while the owner (and the board) has about 20,000 votes. So whatever they want to do, they can out vote us easily. (Meeting was recorded by an owner in the Preserve to prove that they didn't allow us to speak) You would think that because he owns those lots and votes that the owner would need to pay those assessments as well... Nope. He is exempt under his own by-laws. If we do not pay by December 31, 2021, then he can evict us (not verified by me). We are currently writing the AG and looking for a lawyer to help us, but it seems nobody wants or can take our case. Of the lawyers we have talked to, they say there are "special lawyers" that handle these kinds of things. My question is, do you feel this is worth pursuing or should we cut our losses and sell? They said that no matter the worth of the vehicle, they can only give out 10k for a total loss, even when their insurer was deemed at full liability for the accident. My then-wife decided on her own that she would be going back to school and taking out a student loan worth approximately $11,000. I returned home from work one day and was told that I needed to co-sign since her credit/income was not enough on its own. I relented, with the understanding that this loan would be an investment into our future as a family. A few months later, completely unexpectedly to me, my then-wife woke up one morning and told me that she was divorcing me. Since we had no children and basically no assets, I did not hire a lawyer (this was my biggest mistake) and we did a collaborative divorce. In the divorce, she agreed to stay current on these loan payments since there was no way to release me as the co-signer. Flash forward to present day: My now ex-wife has stopped making payments on this loan. The last payment was made in August. She did not communicate to me that she would be stopping payment; the only way I was made aware was through a letter in the mail from the loan company stating that the account was 60 days past due. If the loan is not made current within the next 30 days, the entirety of the loan will be due. If not paid within 30 days after that, it will be sent to collections - thus, damaging my credit. When I contacted my ex-wife asking her to resolve this, she told me that she did not have the money to make the payments, and that she was unemployed. This is verifiably false; her public social media accounts contain text and video of her discussing her job as a retail clerk. I am going to begrudgingly make the $1200 payment to make the loan current to stave off the entirety of the loan being due, but what I'm wondering is this: Do I have the legal grounds to sue her for the money I spend paying back her loan? Or is there any legal option for me to force her to refinance the loan to remove me as the co-signer? I tell Company A and B i am starting my own business, but that i can support through the acquisition to make sure it runs smoothly. Company B says they wont keep me on after the acquisition and wants me to sign a no poach agreement. Keep in mind, i do not work for Company B yet, nor will i, ever. Is this even legal? This would normally be a small claims issue, but there are other funds in play, and I'm not sure how to handle that. Before arrival, the guests had booked for a certain number of nights, paid the amount for that, and then later decided to cut down by one day. I was planning to refund this amount (roughly $400) after their stay, but it seems pointless to refund that amount just to take them to small claims court to cover the rest, and I'm fairly certain I can't legally keep it even if I'm taking them to court. Paid cash and signed a contract with sales person and the finance dept. Car needed to go through their safety inspection prior to me getting the keys. During the inspection, they found repairs that need to be made. Received a call on 11/29/21 that they weren't going to pay for the repairs as it's too expensive and they are voiding the contract. They relisted the car today on their site (same price). Can they sell a car I have a contract on and me not having received my cash payment back? I love the car and would like them to honor the contract with the repairs done. It turns out my mom did in fact open an account in my name about 9 months after I had turned 18. The customer service representative I spoke to said that the way their fraud prevention services work, if there is a new account opened by someone who has shared residence at the same address for a long duration, the debt is carried over onto the new account. However, I was a minor for a majority of the billing periods this debt was incurred. Would I be liable to pay the lump sum despite being a minor at the time of the original billing? I approved my timecard yesterday that had 6 meal penalties (done by HR) and today I noticed that my timecard punches have been altered to show me clocking out before the 6th hour of the day, and all meal penalties were removed. One of the days I had a working lunch (with my boss) so I worked through it but that day shows 8 hours worked instead of 9. My boss sent me an email telling me to adjust my hours to not get meal penalties but I cannot since the system doesn't let me and the only way I can punch in/out is on the phone app or my computer. Only HR or she can alter my timecard. I'm currently applying for a new jobs and have a phone interview. But do I have a case with the labor board? “Inherited” a Utility Service Contract? Posted: 01 Dec 2021 07:24 AM PST TL;DR: Is it possible for an annual (HVAC?) service contact to be "inherited" from one homeowner to the next? I purchased a house to flip. Now, I'm trying to pay my final gas bill and they're charging me the remaining monthly balances on a service contract I did not take out. The company is saying that because the previous owner had one (she had to pay in full too) that it automatically goes to me. They say it goes by house, not owner. They also say it was incumbent on me to read my "Welcome Packet" because that was supposedly my only notice that I inherited this contract. Now, because I did not know I had one to decline, they have auto renewed it. I did not receive notification of auto renew either. I'm in New Jersey. Who regulates these service providers? I can't seem to find that anywhere. It is not the board of public utilities because they are contracting a service, not a utility. Letter from neighbor requesting compensation for tree damage (CT) Posted: 01 Dec 2021 07:58 AM PST I received a certified letter (which was very likely crafted by a lawyer, judging by the language used) from my neighbor today. A few months ago, a tree on our property fell over on to the power lines and knocked out power to the street. In the process, it pulled the lines and their meter off of their house. They are requesting I cover their insurance deductible due to "my failure to maintain or remove this obviously dangerous tree". Now, I had some other tree work done over the summer, and had three different tree companies assess the tree in question, and none of them recommended maintenance or removal. Of course, that's not documented, it was all verbal during the property walk-around while getting quotes. As far as I can tell in CT, the homeowner can be considered at fault due to negligence if the tree was knowingly hazardous. Barring that knowledge, I don't think I would be held responsible for damage to their property. I have a feeling I am at minimum going to need to speak to a lawyer (what kind....property/real estate?), and possibly end up in small claims court if they decide to pursue it that far, but wanted to see if anyone had good advice on how to proceed. Posted: 01 Dec 2021 05:01 PM PST Colorado for state I rent an apartment in northern Colorado where I live with my brother who is permanently disabled, in a wheelchair on oxygen. Because of this, he requires the passenger seat of my car and a handicapped parking spot that is slotted on the right of a vehicle so I can get his oxygenator and wheelchair out of my car and set up for him. Our parking lot is shared between 3 different 6 unit building and there is one handicapped spot, with left sided slots and a ramp up the left. An elderly woman always and I mean always has her car parked there, and has left the building one time since I have lived there ( I am home 24/7 caring for my brother ). Management said they could make us a new spot but alas, they still haven't which means we often have to use the road to load and unload my brother which is dangerous, and I have to lift him and his chair and oxygenator over the curbs and I have recently acquired shin splints from doing so. I attempted to contact management today but they gave me the standard "we will call you back" and they still have not. They also said that this spot would be free use and they couldn't guarantee us use of it. What are our rights here? I can legally double park until they resolve the situation? Should I attempt to get a lawyer? It snows very much here and I'm worried we will be trapped at home soon without a ramp to shovel. Yesterday we got a bill for $583, when we called our borough they said that it was due to our toilet running and leaking back into the sewage. We were informed that our landlord had been notified twice, and that he fixed it the second time they contacted him. We had no clue about this leak the entire time, we weren't told by the borough, or by our landlord. We didnt even know he came to the house to fix it. When we asked the landlord about our bill he told us we'd have to figure it out ourselves. To make things even worse, for around 15 days we weren't even able to wash our clothes, dishes, or shower because of a lack of hot water. I just want to know if there is some way to legally have him help us pay this bill, or if we could get a form of credit from our borough because we weren't informed of the issue? Posted: 01 Dec 2021 02:29 PM PST I started a new job as a night custodian. In addition to my normal duties like emptying trash and sweeping floors, I also have to make sure all windows are closed, as sometimes staff leave them open when they leave for the day. There is one room where this presents a problem. The room in question was renovated some time ago, and they added a "new" wall about 2 feet back from the original one. As a result, there is a roughly 1.5 foot wide gap between the original wall and the new wall, that runs the length of the room. Both the new and old walls have windows in them. The windows in the old wall open by swinging outward, such that your can open them from inside the room by first opening the window in the new wall and then reaching through it with a broom or stick to push the old window open, but can't close them in the same way, because they have a racheting mechanism that keeps them open. In order to close them, you have to climb out though a window in the new wall, into the narrow gap between the walls, and sidle along maybe 12 to 15 feet until you reach the open window. Then you can close it by pushing it out, then pulling it in. When I started, my employers told me I would have to close the old windows in that room one it started getting cold. I thought they meant just once per year, as in, once it gets cold I would close the outside window and it would stay closed until spring. Now I have learned that the staff member in that room opens both sets of windows every day. I am not comfortable with crawling out a window and squeezing through that tiny gap every single day. It's filthy and claustrophobic in there, the walls are unfinished on that side and there's pipes and such sticking out and it looks like I could easily cut myself in something, it's difficult to climb in and out through the window, and I already have enough work to do already without having to spend an extra few minutes to close one window. I told them they should simply tell the staff member that they are no longer allowed to open the outer windows, and must make do with the inner widows in the "new" wall during the winter. They basically told me "shut up and do it, it's part of your job." Is it legal for my employer to require this? Surely it's at least an OSHA violation, right? It would be one thing if there was a door, but the window I have to crawl out of it's nearly 3 feet off the floor, there's no railing, no steps, no safety anything of any kind. Literally just climbing out a window. And on top of that, the space I have to squeeze through is so tiny; surely theres some kind of minimum standard for how wide a hallway or passage way must be? He was shopping at Walmart with his daughter a couple of days ago and today the local police department calling him a person of interest. About 300 people have commented and 600 have shared the post. He has called the local police and they are refusing to give him the reason why they are looking for him, are refusing to take down the post, and are instead asking him for his address. He denies doing anything other than buying flowers for his wife who is due to give birth in 2 days. My friend is very concerned about his face being posted by the police on local social media especially as he is a doctor in the community and this this might affect his reputation. Earlier this year I went to a new primary care physician. I am not hurt in any kind of way - moved to a new city and was referred to his services. Everything is fine but a few weeks later I received a bill from a medical lab company for charges my health insurance didn't cover, which stuck me as odd being that I did not get treatment for anything out of the usual. I called my insurance and they gave me a list of codes of the lab work performed. I referred the list to my new physician and he called back a couple days later saying I was mistakenly charged for labs I never took and he would get it corrected. About a month later I received a collection notice for the lab work. I called the health clinic to discover that my physician left the clinic. I spoke to the new physician about it and he is clearly disregarding me on this. What do I do? Posted: 01 Dec 2021 06:54 AM PST We bought our appliances as a set from Lowe's. The last appliance to be installed was our over the range microwave. The installation was supposed to take place Monday, but they stood us up after communicating delays all day until 6:16pm and they just ghosted us. The following day, after making several complaints to Lowe's installation and the 3rd party company they were hiring for the installation, they finally sent someone for the installation. We had specifically requested they not send the technician that was communicating with us the previous day as he stood us up and was rude, but they sent the same guy anyways. We had a predrilled hole for the microwave cord. This guy waited for my husband to step outside and he drilled a hole in the middle of the cabinet, literally dead center of the cabinet, for the cord. The cord now travels literally through the middle of the cabinet up to where the outlet is. He also measured incorrectly and had to drill two sets of holes for the bolts that hold the microwave to the cabinet. These were not cheap cabinets and he butchered them. Now, the actual microwave was installed with a forward tilt. This means that when opened barely, the door swings all the way open. When things are set in the microwave, they slide out. When my husband had stepped back inside (he was outside with our dogs) the guy was already at our front door trying to leave without a word. My husband confronted him about the tilt and the technician became defensive and rude. He refused to fix it making false statements about why it "had to be like that" when there is not a valid reason, and started arguing with my husband and physically advancing towards him. My husband then told the guy to get out of our house, as he clearly had no intention to fix what he knew he had done incorrectly. We're quite positive he did this on purpose. We now have multiple holes in our kitchen cabinet that should not be there and a microwave that I'm not sure is structurally sound and is very clearly installed incorrectly. It wanted me to contact a number that was not associated with TD Bank. It seems to be by the same scammers detailed in u/mchltang's post here. For him they opened an actual TD Bank account. However I have contacted TD Bank (through the official phone number!) and they have assured me that there is not an account open with my SSN. Because of this I cannot identify if an actual account was opened in my name as I would need the full account number. What I'm trying to figure out is if this poses a threat to me in any way? My ex landlord wanted me out by December 5th 2021 I decided to move out November 19th 2021 as he was coming back from Costa Rica November 20th 2021. He gave me the 30 days notice over Facebook messenger with no paperwork completely out of the blue. He is now saying I left holes in the walls, I gouged the countertops, I burnt all his pots and pans I left cat pee on his bath matts and cat poo downstairs. He also brought up the fact that my cats scratched up the carpet and the couches (not mine) which he verbally told me many times not to worry about because "Cat's are assholes and he understands". He now wants to take me to court for the damages however I cleaned the place before I left and I have a witness to corroborate my story and how I left things as well as text messages and facebook messenger messages to back my self up. He regularly said I was messy which I have been told by everyone that comes over that it is "so clean". Firstly I'll talk about my hours on my paystubs which are from every two weeks it says I work 50 hours when I actually work 60. Any given day I will work 15 hours that's a normal shift for me. My employer has been reporting as if I work only 10 hours a day. My work does not have an HR, so I've talked to my supervisor about this and she seems to think there nothing I can do. Secondly I'm supposed to be a salaried employee, my understanding of that is my paychecks should always be the same if I work that week. My pay has been fluctuating in conjunction with the report of different hours. Is that something they can do? My position requires me to be on-site for two nights and two and a half days. I'm not allowed to leave the property at anypoint during my shift. Should I be getting compensation for being on call over night? Lastly I got this position through promotion, I started as a housekeeper. When I was first hired I signed paperwork, but my promotion was all verbal agreements. Long story short, I have a contract with the builder on this 2 family unit. The house is supposed finished long time ago (by long i mean at least 2 years) but its still not done, and no progress has been made on it for close to a year. I did ask for a refund on my deposit. The developer agreed by signing a termination agreement with me, to refund with 90 days. Lo and behold, 90 days gone by and I did not see a dime. And just now I found out that there is a foreclosure action on the property by the lender. I am already working with a lawyer to sue for the contract but would like some 3rd party opinion.
