I was in a car accident, my insurance said the liability is on the other driver, now the other driver’s insurance is calling me?

    Posted: 01 Dec 2021 06:39 AM PST

[NJ, US] I was in a car accident 11/15. My car is totaled. This Monday I gave a statement to my car insurance about the details of the accident, and the representative of my insurance said based on my statement and the police report, the liability is on the other driver. (I found out after I gave my statement that the other driver is claiming that I swerved into him, which is untrue and doesn't make sense given the accident details).

For the past two days, representatives of the other driver's insurance have been calling me and leaving voicemails asking for a callback. Any idea why this might be? I have not and do not plan to call them back — from my perspective, they should be going through my insurance and I can't see any way that speaking to them would benefit me.

Insurance Agency never took the Vehicle off my insurance after it was sold.

    Posted: 01 Dec 2021 01:09 PM PST

Insurance Agency never took my old vehicle I sold, off my insurance when I called to add the new car I purchased. We had discussed it because I needed to know when I could sell it, and purchase a new car due to having a intermission lock on my old car. When I got the call about my new insurance quote it was more then what I had been paying on my old vehicle. I just assumed because I bought a newer vehicle that the insurance would be higher. This was in March.

So in October I was told I would not be considered a at risk driver anymore and would get enrolled into a new insurance policy. During that conversation. He gave a quote on both vehicles and I said I don't own that vehicle anymore. He said oh I'll take it off the new policy. It never clicked with me that I was still paying for it.

In November we were having issues with with auto pay. One of the insurance agents representives told me I had been paying for the old vehicle since March to October. Had no idea until they said something. They made it seem like it was the insurance I was with and not them who didn't take it off. They said that they would see if they could get me a refund. I got a email saying it was never brought to their attention that I had sold the car. So when I asked for them to pull the conversation to listen to it to show that it had been talked about. They said we don't record the phone calls, and only go based off notes.

So I called back one more time, and talked to rep who set this all up in the first place, and I said look you're going off notes in a account. I worked at a call center once I know that sometimes you don't note everything you talked about on a phone call stuff gets missed all the time. This is why recording of phone calls help in these situations. I was calm cool and collected. Thats when she said let me check one thing real quick put me on hold... she patched me to the owners son who went on the defensive saying this is no one's fault but your own. I just stated look all I'm saying is that we are going off notes on the account, and I don't know how I'm held accountable based off one of your representatives notes. He said I'll try and figure something out and hung up.

    Any advice?

Edit: also I should state on my receipts from March to October it doesn't say how many cars I was paying for it only showed the price. Also I don't even know how much money I'm fighting to get back.

Cars hit each other backing out in parking lot - how do you think the claim will turn out?

    Posted: 01 Dec 2021 11:16 AM PST

    location: WA

The other car was backing out from a parking space behind me on the right (in my blindspot) - we were both steering right as we backed up - we both didn't realize the other car until we hit each other - neither car honked, neither was distracted, both cars were in motion.

The damage was similar on each car and wasn't extensive.

I thought this was a scenario where we both pay for our own vehicles damages out of pocket and not involve insurance. But if the other party wants to file a claim (and I don't), what will happen? Are all 'back up while both cars moving' scenarios 50/50 fault? If one can claim that they started backing out first - will their fault be less?

We already did the regular exchanges (insurance info and photos). Neither admitted fault.

Any insights (esp. by people who've been through the same) appreciated. Thanks!

Damage from water escape from a sump system - am I covered?

    Posted: 01 Dec 2021 01:59 PM PST

I have two sump pumps installed in my basement, one of which was seemingly starting to fail because it began working non-stop as opposed to the regular cycling every several hours. I called a plumbing company and a plumber arrived to replace the pump.

The plumber replaced the pump (with a lower HP model) and appeared to have been working. At 2AM my water alarm went off and unfortunately by the time that it did, there was significant flooding already. I mopped up the bulk of the water on the surface of the flooring then began to try to find an emergency plumber. The same plumber ended up coming back during the night. Apparently some debris found its way to the check valve and because of that, the pump wasn't able to pump it up with enough pressure through the existing piping. He removed some piping and added a hose and removed the check valve and now it's working fine.

My home policy has optional coverage for sewer backup which includes accidental water escape from a sump system. The policy excludes poor workmanship. Because I am not a plumber it's hard for me to tell whether this is a result of poor workmanship or whether it is in fact accidental since the pump would have worked fine, had debree not become lodged in the check valve.

    Policy wording:

"Sewer backup coverage This extends your coverage to include loss or damage caused by the backing up or escape of water from a sewer, sump, interior floor drain, or septic tank."

I've had to tear up a significant amount of laminate and underlayment to remove water. I would really appreciate some insight into what would be considered accidental escape vs workmanship issue. Thank you in advance.

Former Allstate employee but can't get verification of past employment

    Posted: 01 Dec 2021 01:57 PM PST

I have called every number i can find, and the only one that seems close wants me to sign up for a third party site. I don't want to make my new potential employer sign up for this and possibly pay a fee. Is there any way to talk to an actual person that I can give the potential new employer?

Insurance took over 3 months to settle a claim, and then said no one was at fault. Won’t reimburse us for anything. What can we do legally to be compensated?

    Posted: 01 Dec 2021 01:48 PM PST

Had an auto accident in mid-august where another car sped through a red and we clipped them (we had the green) because they were going so fast that we didn't even see them coming.

Both of our cars were wrecked. They claimed they had the yellow, but we claimed we had the green, so police wrote the report saying that our stories were conflicting and didn't identify us at fault.

We both have the same insurance provider, so the matter was handled internally.

We just got our call today from a random person saying both sides settled and they declare no one is at fault. So, no money for us— that's an expected outcome of a typical claim. But this one is not typical. It feels like they strung us out intentionally.

We got video evidence through the police of the incident, but since we couldn't see the other car's red light, the adjusters wouldn't accept it as valid. In our area, it's technically illegal to proceed through a yellow, but they didn't consider that as valid either. Our adjuster got the timing of the lights and matched them with the time stamp of the video to PROVE the light was red and our was green. That also wasn't accepted.

Deliberating the claim took MONTHS. One adjuster was out, the other was out, their supervisor was out, the other supervisor was out. Our adjuster screened our calls for a solid month.

Our insurance person kept saying that we had a compelling case and when the other driver was found at fault, they would be able to reimburse us for the car, rental, public transit… but now they are off the hook for all of it since there is no fault.

We wouldn't have waited for f-ing months and would have repaired the car a week after the accident, had they just managed the claim in an appropriate time frame. But now we're out thousands more with all the transport costs from the meantime.

What else can we do? Is there some path I can take where I hire a lawyer and get some pain and suffering money, at least!? Has anyone tried this, or heard of cases like this?

Thanks. I can answer specific questions as well.

Word against word car insurance claim

    Posted: 01 Dec 2021 01:46 PM PST

I recently took a trip to California and let my mother borrow my vehicle (manual transmission). She was on the I-15 north with stop and go traffic (stopped at the time of the accident) and got rear ended. The other person said that my vehicle rolled back and hit him (my car has anti-roll features). He told me over the phone that he has dash cam footage he would give me, but then refused to (understandably). He has not given it to his insurance and now his insurance refuses liability and said that it is a word for word case and that nothing is going to happen. Is there anything I can do about this?

Recent car accident deemed total loss, lowball offer

    Posted: 01 Dec 2021 01:46 PM PST

Hello, after a quick search I found this sub and I feel it might be the best fit. 16 days ago my wife totaled our 2018 Kia Rio S with 50,000 miles on it. To replace it with another that is the same make, model, Mileage, the magic number appears to be around $16k. My insurance company is offering a few dollars above $12k, I didn't accept the offer and informed the gentleman $12k isn't enough to put me in a similar model with the same mileage. How do I navigate this from here?

    Pet insurance?

    Posted: 01 Dec 2021 12:21 PM PST

Hello, one of the pet insurance plan I was looking at has a deductible of $250 if I go ahead with this plan I would add the preventative care package. My question is if I take my cat for preventative care will the cost of the visit be covered by submitting a claim or will my total go towards the deductible? Thanks in advance!

Is Bind insurance actually good? What's the catch?

    Posted: 01 Dec 2021 12:08 PM PST

My husband started an new job in Indiana and we are in the enrollment process for health care coverage. I have several prescription meds and high end of moderate healthcare needs. The insurance provider is UnitedHealth Group and they offer traditional coverage and the Bind "pay as you go" coverage. The $0 deductible is sooo tempting. And the overall premium is less than the traditional plan. I feel like it's too good...I understand the general concept, but I had many unexpected (and expensive) medical procedures and tests this year. I am very skeptical and don't trust anything that seems this awesome lately because there is ALWAYS a catch.

TLDR: Does any have personal experience with a Bind healthcare plan? What are general pros and cons? It's been difficult to find unbiased reviews not through Bind sponsored resources.

Interstate wreck going at roughly 75MPH; whiplash and concussion for 1-2 weeks and ~$14,000 in medical bills; the adjuster is offering $2,500 as a "final offer" for "pain and suffering" - - is this a fair offer?

    Amazon hit and run

(MA) Other party’s insurance won’t pay for my rental car

    Posted: 01 Dec 2021 10:58 AM PST

    Hi there,

I (24 F in MA) got rear ended on Monday morning. There is a police report and the driver assumed liability for the accident. I have liberty mutual as my insurance, the guy who hit me has Amica. I tried calling multiple collision centers to see where to get my car repaired, they all told me they're not booking out until January at this point. I told Amica this and they said they will not cover a rental during the interim and told me to call other places that can take my car sooner, they will only pay for when my car is being actively repaired. My car is not drivable and I have no other way of getting to work easily. Naturally I'm starting to get frustrated dealing with Amica.

On top of this, I've been diagnosed with a concussion and using LM's PIP for my health visits. I'm just wondering, what are my options in terms of getting a rental while my car gets repaired? And other general insurance tips I should know to deal with this situation? Ideally I'd like to not have to go through my insurance (LM)and have Amica take care of this since it was their driver's fault.

    Thanks!

    Which medi-cal options to choose?

    Posted: 01 Dec 2021 10:43 AM PST

I am approved for medical but need to send in my choice ASAP or else they'll choose for me. For health the options are: Health Net Comm Solutions, Aetna Better Health of CA, Anthem Blue Cross Partnership, KP Cal (Kaiser) LLC, and Molina Healthcare Partner. For dentistry, there is: Healthnet of CA, Liberty Dental Plan of CA, and Access Dental Plan.

About me…I wear glasses/contacts, have had dental issues in the past with cavities and almost developing gum disease. I take adderall for ADHD and need that perception easily filled every month. I take birth control as well and sometimes get UTI's that require medication. No other health concerns other than that.

From your experience/what you've heard, which one would be the best to get? Or what are the ones to avoid?

I also travel around and do not have a home base in California yet, so I'd like one that is covered all around California so I have better chances of getting care wherever I am.

    Thanks in advance!

Auto insurance for a small group of people

    Posted: 01 Dec 2021 10:37 AM PST

For context I'm a UK resident who visits the US a couple of times a year purely for vacation purposes.

As the price of rental cars seems to have gone crazy I've been thinking of buying a used car for when I'm in town. I know there's a few other non residents in the local area who are in the same position and wondered whether there's an auto insurance policy that we could buy so that we could share the car and costs. Is this possible with US auto insurance? In the UK I'd probably buy the vehicle as a business and purchase auto insurance for anyone to be able to drive the vehicle but not sure if there's an equivalent in the US? Thanks I'm advance

    Insuring a Storage Unit's Contents

    Posted: 01 Dec 2021 10:17 AM PST

I recently put all my possessions into two different storage units in two different states and have been doing the nomadic life since covid, more by circumstance than choice. As I do not have renter's or homeowner's insurance, let alone a permanent address, how can I get adequate coverage for my storage units? The facilities do not offer policies themselves and only suggest getting one for myself independently. Any suggestions on how to proceed?

Determining diminished value from 3 yr old claim

    Posted: 01 Dec 2021 09:45 AM PST

My husband was rear-ended almost 3 yrs ago in a 2016 Corolla (12/20/18). Other person at fault, no injuries, State Farm paid to repair $3000 worth of damage.

In late 2019 we looked at trading in that vehicle twice, but were offered less because of the accident. ($2000 less at one dealer, $3000 at another). They cited the CarFax accident report. We opted to not purchase a new vehicle because of this.

Since then the car has had two more accidents - my husband hit a raccoon in early 2020 ($2500 damage), and someone backed into it in a parking lot in late 2020 ($3000 damage). Both basically no fault and our insurance covered it.

I recently totaled my own car and in the process of researching FMV I learned about diminished value and the three year statute. I contacted State Farm and they reopened the 2018 claim for the Corolla and asked me to email a formal request for DV along with supporting documents.

    My questions are:

    1) Am I calculating DV as of 2018 when the accident occurred? Obviously the 2 other damage incidents shouldn't factor in so am I looking at it's current value or it's 2018 value? Talking to a friend at a dealership, they are paying so much for used cars right now that the damage today would not be considered as heavily as it was when we tried to trade it in in 2019 so we might only be dinged $1500 now.

    2) What can I use as supporting documents? I don't think this would warrant using a paid service because we're talking hundreds not thousands in DV.

    TIA

Doctor’s office claims no diagnostic codes

    Posted: 01 Dec 2021 08:03 AM PST

I went for annual physical. I have depression and am vegan. I asked doctor to run thyroid, vitamin b, and vitamin d levels. I've had b12 checked in the past and tsh without being charged. I called my insurance and they said it was not coded as diagnostic and if refiled as diagnostic it will be covered. I contacted my doctor's office with this info and the billing office is saying they have no diagnostic codes for these tests and therefore are not refiling. How can I fight this?

I have liability insurance, so I know I'm screwed out of a car. But my question is, if the damage to the other car exceeds my coverage(it is more than likely totaled) what could happen? Upon doing research for similar cars on the market that I damaged, its possible the damage may exceed my coverage by a couple thousand dollars.. Will my insurance company try to settle? What exactly will happen in this kind of situation?

    Dog bite

    Posted: 01 Dec 2021 06:44 AM PST

In Ohio so that should help clear up some questions.

We recently moved to a new city, have a rental home, had our insurance modified to cover the rental while also maintaining coverage on our home in old city while it's on the market.

At the rental, work is being done to modernize it a bit. (Hadn't had renovations for 30 years ish). My father was at the home and opened the garage door to allow for contractors to move equipment into the house when they arrived. We're talking hours in advance of their arrival. My father then began going about his remote work and didn't think anything more of it.

Hours later, flooring contractor without notice of arrival let's himself into the house. My dog already stressed from the move growls and barks at the contractor. The contractor then decides it's an appropriate time to reach out and pet my dog. The dog bites the contractor and then retreats back away from him still growling and barking. My father gains control of my dog and puts him in a back room.

We go through the appropriate bite protocol and open a claim with our home insurance, etc.

Our insurance is dropping us due to the dog bite.

Questions: I know we are the responsible party in Ohio. Technically, the contractor was trespassing. Not sure breaking and entering is the correct term. Had this been a burglary would we still have been the responsible party? Would insurance have dropped us anyways due to the bite?

Also what kind of trouble are we going to have finding new insurance and what kind of rate should we be expecting? We were paying less than $250 a month for home and auto bundled.

    Breed is Australian Shepherd.

I'll probably cross post with legal advice as well.

Thank you all for any insight you can pass along.

    Lemonade Homeowners Insurance Question

    Posted: 01 Dec 2021 06:43 AM PST

    Hi All,

Ive read through alot of threads in here stating they hate Lemonade Insurance and you 'pay what you get for'. Well I read through the Lemonade Homeowners policy, who Im insured with now, along with the prior policy I had on my house that was with Liberty Mutual. They seem very similar and to cover the same items. please note I also work in insurance for a carrier in Risk Modeling so im somewhat familiar with how these things are written. Can someone please explain why Lemonade is bad? What about their policy isnt good? Specfici examples of what they wouldnt cover vs what a traditional carrier would, would be great!

    Thanks.
