Posted: 01 Nov 2021 04:56 AM PDT I had a verbal agreement with a lawyer for my criminal DUI case, 6th case and it is 20 years old, I am from Philadelphia and returned to the state of New Jersey recently which triggered dormant legal action against me. Obviously this is an extremely serious charge I do not deny and want to work with the court on a sentencing plea. I communicated I wanted to take a plea deal to my lawyer when he agreed to take me on as a client and he verbally accepted. I attempted to work with him to be sure I was making payments in a form that was acceptable, and I offered to switch formats if preferred, I did not hear anything else from him and began the payment plan that we agreed on with him saying if I could pay in full by last week he would represent me. The judge also at my arraignment told me she knew my lawyer and to tell him to "get to work". The question I have is, could I reasonably ask for more time to get new representation, and if so, how? My lawyer did not make any effort to communicate his last minute decision to me, he left me to find out when I noticed my payment sitting unclaimed for an unusual amount of time. The fact that the judge expressed first-name familiarity with the attorney also felt like a form of reassurance his reputation was adequate. I want to explain this matter in an appropriate and tactful manner and I have payment receipts and text messages to verify my situation. The judge had previously stated at the arraignment that since I had 20 years to resolve this, no more extensions would be granted. I feel I made it clear through my actions I took her comment seriously want to resolve this ASAP once I am adequately represented. I am trying very hard to conduct myself properly and show a desire to change through my actions and words. I also have the money saved to be able to get another lawyer formally on retainer quickly so this issue does not arise again. [link] [comments] |
Neighborhood Kid tormenting house Posted: 01 Nov 2021 07:16 AM PDT To start off, yes I have cameras across my house. Last year this kid who lives on another street started coming to my house and literally running into my garage door at full force, he did this twice. I have footage saved from our cameras. After the second time I confronted him (very nicely.) and it never happened again. Well just recently this kid has started throwing his basketball at my door and the other day ran and head butted it. Yet again, I have these videos saved. I confront him, AGAIN. Now he's just being a little shit and running up to my cameras and calling me and bitch and flipping them off. My husband keeps saying he's going to handle it and he thinks I'm being "hormonal" cause I'm 9 months pregnant. I'm worried this kid will damage my garage door and if he does, I will be going to the police station and giving them the video footage. I haven't talked to his parents because I THINK I know which house they live in but I'm not 100% sure. Please help me save this child!! Posted: 01 Nov 2021 10:57 AM PDT My niece is 14, has a friend the same age who last night (Halloween Night) was beaten and kicked out of her home by her father. My niece had her friend come to her house because this child's parents took her phone, glasses, jacket and shoes and kicked her out in 30° weather. A little about this child and her family, the father (the abuser) is retired police who is very well connected so this girl has not been able to get the proper help she needs. She is terrified, she doesn't want to go back home. When the police were involved this morning, her parents came and told them that she is a problem child and ran away.... and what I find the most disturbing is when her father came to talk to the cop, he pointed, smiled and said, "Hey! I know you!" And then the cops said her parents want her back. She can go home with them or to "link" with him. A juvenile center. She begged the cop to take her and the officer called her father on his (the cops) cell phone to tell him that he was taking her to link. I don't know much about the law. Or about cops and how they do things, but this situation does not seem right and this little girl is clearly terrified of her own father... What can she, or we do to save her if we can?? P.s. So I've been looking for resources for a restraining order, obviously this is criminal but most DAs decline to file against their establishment, so an abuse order is the way to go for me. The buyer paid the seller the deposit they agreed on. The seller is now feeling remorse or perhaps found a better price. Now the seller is refusing to sell the car or even return the deposit. I had child support against him, i stopped it. He then went to try to get child support against me, claiming he had full custody & i only had my son every other weekend. (Which was false) He started flashing around those papers and only allowed me to get my son every weekend. He recently just changed it to every other weekend. So that original agreement was broke. Went to court to find out that our original agreement is still out agreement. Took the sheriffs to his house and there was nothing that they could do. They couldn't let me take my son. Went to court to get an emergency hearing as well as his father but they were both denied, because myself and the other party were present they're sending us to mediation in November. Court orders were to remain the same (which is our original agreement) Took my papers and called sheriffs department so that i can get my son and once again they couldn't do anything "because our original agreement was broken" My sons father isn't allowing me to see him, it's been 3 weeks. She just last weekend got an email saying she would have a new roommate. On Saturday her new roommate moved in with a cat. My gf is allergic to cats. She went to the office to explain and the office said that until she can prove she is seriously allergic to cats they do not care. She tried to supply proof from her home country of Japan but they said they would only accept approval from a US doctor. That is totally understandable, but my question is, what qualifies as "SERIOUSLY ALLERGIC" to cats? The way the landlord was talking to us made it seem like she would only force the new roommate to switch units if my gf was deathly allergic to cats. She is very allergic but I am afraid the US doctor evidence will not be enough based on the behavior of the landlord. Right now she is forcing my gf to live with the girl and her allergies are bothering her quite a bit but she is locked in her room so it's not seriously affecting her yet. The cat itself hasn't been moved into her apartment yet, I think she said her roommate was going to hold off on moving it in for a few days and my gf is worried, but the dander/hair on her new roommates clothes are affecting her already. He just settled for this 50/50 parenting agreement after a 2 yr long court case. Nothing special about the case, both of us have clean records, he was trying to get one extra day of the week with them. It only went to trial because he was unwilling to agree to anything until the last minute. He wants to follow a ladyfriend to Denver and start a new life, go to grad school, buy a house etc. Only thing he has on me is better financial security, but I've proven to do just as well for myself and our kids with less to spend. I am filing a modification for support as he stopped paying almost 2 years ago. But I know that's a separate case and shouldn't effect custody matters. Family vacation plus my fiancée and I are getting married on the cruise. I sent My ex a text asking if it would work, she said she would need to think it over but thought it would be ok so long as the kids were supervised and either in the same room or very nearby. One week later I messaged and said "planning the cruise, the kids room will be directly next door to mine." She responded "so long as they're right next door, that is fine" Flash to last week. She said the kids will need to be home the day before the cruise is over (March 24) due to a dance competition that was scheduled in August. I have tried to make the case that she already approved the time and the trip is already paid for and she's not budging. She also said "you should have waited to book the trip" and "In my mind planning and booking are not the same thing". What can I do? The money is not refundable for their trip. We are just two person living in the apartment and after the first call we have been careful not to even talk in a loud voice. We don't have a TV, nor a pet and we only cook during the day. During weekends we are mostly out, and during weekdays, mostly there is only one person inside. Now, the landlord wants me to sign and addneum on my lease about disturbing neighbors. I asked the landlord about the details of the complaint like the time, type of noise, is the noise constant and they said they haven't found out. Isn't it their duty to fully investigate the complaint before telling me to sign anything? Now, it's just odd to live in my apartment thinking if I am making noise or not. What do I do in this case? Possible false rape accusation Posted: 01 Nov 2021 08:57 AM PDT So the other night me and my friends went out to a concert about 2 hours away. After that we went to an 18+ bar because we are under the age of 21. After the bar I was talking to some girl and ended up leaving with her and a couple of my friends were with her friends following us. We get to the house and at some point she brought me to a bedroom and we made out on the bed. At some point she then told me she didn't want to have sex so I said alright that's fine and just rolled over to go to sleep. A dude who I guess lived in this house comes in and tells me I have to leave. Me and my friends do. Several minutes later two cops pull up next to me and 2 of my friends walking on the street. They start asking us the basic questions. We ended up being detained there for nearly 3 hours. At some point a detective comes up and questions all of us separately. At first I was very hesitant to tell the cops anything, I was pretty drunk at the moment. But I was tired and figured since I hadn't done anything wrong telling them what happened wouldn't be bad. After this the detective told me he needed DNA samples from me. He took me down the station and read me my rights before asking me more questions about what happened, and then took DNA swabs of my mouth and hands. I had no choice in refusing these as he said he'd keep me detained until he got a warrant to get the samples. He then let me go saying someone would contact me within a week or so about all this. So, how fucked am I here? Some other points I remember from this that are kinda scaring me about what might happen… The detective kept pushing me to admit to fingering the girl The two original cops said "at least you and your friends will be sober now" when they knew we were underaged The girl wasn't even the one who called it in on me, at least I'm 99% sure. According to the detective he told me he had "several witness who heard me say I need to put clothes on before leaving" But my friend said he walked in on me and I was fully clothed… In the state of Texas if that helps. And I will not be talking to anyone again without a lawyer present. I cannot afford a lawyer right now so I will have to ask for a public defense when they call me again I'm assuming. There's a fire lane sign posted on the side of my apartment and my neighbor has been parking there and even leaving it over night. Iv contacted my property manager several times about this issue and at first he would come out and have them move their car. Recently the project manager just says they'll take care of it so they can't park there anymore but my neighbor keeps parking there. Fed up with how it was being handled I told my manager if it happens again I'll call the tow truck myself. They responded saying they would take care of it and make sure it doesn't happens again. 4 days later and same thing happened so I called the tow truck. During the tow my neighbor came out and paid the driver to lower their car. They then ripped the fire lane sign off my wall which I believe is illegal? A week later I got a letter in my mail box from the neighbor demanding I pay the amount they spent to lower their car ($50) or they will take me to small claims. I took a picture of the car parked in front of the sign before they ripped the sign off and texts to and from my manager about the situation as proof that this wasn't a one time thing. I'm pretty confident they are just saying that to make me pay their fee but I'm curious what will happen if they actually do take me to small claims? Fake account is impersonating me and posting offensive content Posted: 01 Nov 2021 01:22 PM PDT PA, USA These past few weeks, I noticed that I've been losing followers on Instagram. I figured that something must be wrong, but I never had any idea what it was until now. My friend texted me this morning, asking what the hell I'm thinking when I post on Instagram. He told me to take all those posts down and release a public apology before shit happens to me. I asked what he was talking about, and he informed me that there was a meme page in my name posting offensive content. He sent me the link to an Instagram account pretending to be me. They were pretending to be a spam/meme account of mine. The page started out with posting innocent and funny memes. Within about a month of posting, the posts started to become racist, islamophobic, and transphobic. I looked through those posts, and some of them were EXTREMELY offensive. Offensive enough that this could get me expelled from high school, or mess up my chances at college/a job in the future. I've already filed a report for impersonation on Instagram. Hopefully, the account gets taken down before more people find out about this. Before irreparable damage is done to my life. I have no idea who created that account, or how to track them down. They pushed it hard last year during COVID, especially for mental health treatment. After a number of phone calls, the EAP provider generated treatment authorization codes for 2020 and 2021. Base insurance provider changed from UHC in 2020 to BCBS in 2021 but the EAP provider remained the same. After the codes were generated (after providing my medical providers information), and only AFTER the codes had been used to bill for the alloted amount of EAP-provided treatment sessions, ALL of the pre-authorized 2021 claims were denied. The 2020 claims were not denied. I have spent the last 6 months trying to resolve this issue with both the EAP provider and my Employers HR/Benefits team. No resolution has been found and communication seems to be alluding to my employer washing their hands with the situation and not providing any sort of solution. I'm trying to understand what my legal grounds here are. The outstanding medical balances is really not as much of a concern as is my employer claiming to provide a benefit and then dropping the ball when their contracted benefit provider has a hiccup. If my employer refuses to somehow compensate for the medical benefit that is currently essentially being denied - what are my legal grounds of remedy? They work as a nurse at a very huge health insurance company and used they're access as a nurse to steal/print out over 20 pages worth of medical information on me dating back to 2007. I found out when a doctor, not related to the insurance company this nurse works for, told me about the papers and gave me copies of every last piece. This doctor told me this person hand delivered the paper to them. I called and started an investigation with my insurance provider and that started last week. Car parked in front of their garage in townhouse Posted: 01 Nov 2021 12:14 PM PDT So I live in a townhouse in Southern California where the garages are next to or in front of each other. If the neighbor whose garage is directly in front of ours parks their car in front of their garage, it makes it extremely difficult for my family and me to park our car in our garage. However, you cannot even park your car in front of your garage in the first place since it's a fire lane. I complained to my home management company around 8-9 instances within the past month alone with photographic evidence that my neighbor have clearly violated the parking rules. This is what they had to say "The Association is following any and all legal avenues to force compliance with the renters at that address. The Association continues to attempting towing, but unfortunately the renters have learned to abuse the process. The Association understands and agrees with the frustration and will not stop until the issue is corrected." This is a direct copy and paste of their words. I don't know what to do to make them stop. Am I allowed to call a towing company to tow their car? Is there a process to that like calling to police first? I've been renting a room from a person for the last 2 years who I thought owned the house we are staying in and I've been paying her cash, it's a verbal month to month agreement. I've become behind on rent due to getting layed off during the beginning of the pandemic. I just got approved for rental assistance from covid relief funds. I went and told my landlord this info and she looked, well, annoyed. Said that she doesn't think that program would apply to her because she only rents a room to me. I tell her that as long as she can prove she owns the property and that I owe her rent, she qualifies. At this point she reveals to me that she doesn't own this house, her dad does. So basically she's just been pocketing my money without keeping any records this entire time, and while I never directly asked if she owned the place, I figured she did because I was never informed otherwise. I said I would talk to the case worker about the situation when they get in touch with me. I've done my part, I applied to the program, I got approved. Now I learn that I may not be able to take advantage of the only resource I have. She seemed careful not to say much, but I get the feeling that she may not want her father involved. Which is odd, because her father knows I live here. I just want to know, do I even have any recourse here or am I just screwed? Was what she did legal? Do I have to turn down this opportunity just because she doesn't wanna lift a finger? I'm really worried. My STBXH had some shares of mine (the shares are in his account in his name) we bought the shares before we got married and it is basically my savings for my schooling since I am a foreign person. We had a "mutual fund" with him and his family (I have a note he added before and the group that he created) but since the divorce will go more bitter than better they decided to tell me by phone "nothing is in your name so if you want to play nasty we can play nasty" I didn't expected that phone call from his dad so I didn't recorded the phone. I have a couple of conversations proving that i have gave him money, and the zelle transactions. Plus in all the conversations he (STBXH) mentioned what is mine. Is there anything I can do? His family is wealthy and they are citizens they also mentioned work with a expensive lawyer (I don't have money to pay lawyers. They threatened me with my immigration status (I am putting the VAWA). The trade group I'm in typically doesn't do business with a particular large consolidator owned by a venture capital firm called Fenix Parts. When Fenix bought one of my customers out I stopped dealing with them. It is part of a long back and forth. They currently owe me like $35,000 for their August invoice that they haven't paid yet. They are giving me and a few other yards that I work with the runaround. What is the best way to proceed? I don't really want to send it to collections and only get a fraction of the money but it wouldn't kill me. I am not sure if I should threaten that or if they wouldn't care. She keeps parking her car next to mine because I can't go within 100 feet of her vehicle. She lives about an hour and a half away. She can't check out anything from the library or use the computers. She just tells me that if I don't leave she's going to call the police. I can't eat at any of my usual restaurants or go to any where I used to go without her being there. Once she makes me leave she stays where ever it was for a couple minutes before looking for me again. It's been 3 days of this.
