Police entered my home after my 5yr old let them in and questioned her while I was in the shower, then left without ever speaking to me.

This morning, while I was in the shower and my five year old daughter was watching television, I could make out the sound of men talking to my daughter in our living room. I was sure I had locked the front door of our small newly rented house so I was alarmed. Although my daughter had been told to never open the door for strangers, she understandably let two uniformed police officers into my house. I could only hear the muffled sound of talking and the sound of a walkie-talkie. I began to hurriedly exit the shower and a moment later my daughter came in to tell me the police came in the house and said they were looking for someone. She said they asked who was in the house with her and then left.

They didn't leave a card or any evidence of their intent to make it known to me that they had been there.

I asked my daughter if they had asked to talk to me or if they had asked her to give Mommy a message but she said no. If my daughter had not told me, and if I had not heard them and their radio, I would have never known they were in my living room questioning my daughter. The whole thing was unnerving to say the least. I thought to call the police station to get an explanation but wanted to equip myself with any legal insight before voicing my concern. We have only lived at this new address since the first of the month and my daughter and I live alone as we had at our prior address in a town 30 miles away.

Mechanic took my car apart then abandoned my project and expects to be paid.

    Posted: 19 Nov 2021 06:26 AM PST

My car engine blew and I had a one man shop start working on it to prep for a new engine. I didn't sign anything and the closest I got to official record was a picture of a half assed quote. He is leaving the state with no notice to me for months and won't be back til spring 2022. I now have to pay to get the engine rerouted and the car towed to a different shop. This guy wants me to pay him for taking my car apart and then abandoning the project after directly telling g me he would be able to do it within a week of getting the engine. All I know to even do is take him to small claims for it.

Any advice would be great and ask any questions. I'm in Ohio.

A close relative was harassed/bullied until they committed suicide. Is the harasser liable?

    Posted: 19 Nov 2021 09:46 AM PST

I want to know whether the harasser is liable and what charges can be filed against them. I'm looking for general advice here as I don't want to reveal my location.

Starting in October, for a period of 5 days a close relative was accused of sexually abusing a girl in his family. He received dozens of text messages and phone calls from the girl's mother calling him a pedophile and so on. They disturbed him greatly although he completely denied the allegations. He went to the police who advised him to keep the messages as evidence. Eventually he blocked the person from messaging when the abuse got too much. The person then started writing letters and delivering them to his relatives, texting his friends accusing them of 'protecting' him and so on. There were disguised threats to some people with things like 'you may lose your job' but there was no direct calls for him to commit suicide. After 5 days of torment he took his life. He didn't leave a note mentioning the harassment as a cause for his suicide although the entire family is sure that's what the reason was, as he wasn't depressed. He never had any suicidal thoughts that the family are aware of.

The day after his suicide the girl who he was accused of abusing confirmed to his immediate family that there was no abuse at all and the allegations were made up. She's the daughter of the person who was harassing him. She wasn't even aware that her mother was harassing the person. She was really upset about what happened and that she was used to target him. She has since given a statement to the police and has stopped speaking to her mother.

It's worth noting that another family member committed suicide after being harassed and accused of similar things by the same person. That person is also accusing several other members of abuse also.

To me it seems like coercion. That she knew that these accusations and this level of harassment could end up with someone committing suicide as it has happened before. Does this simply go down as harassment? I feel like this seems unjust. After the first suicide I'd understand that the harasser can't easily be blamed for the person taking their own life, but given the fact that there's precedent and the person was aware of the severity of the allegations and where they may lead could there be grounds for something like manslaughter? I also believe this person is a serious threat to others and I know other families who have expressed fear of what this person might do.

[US, MN] Cops have been called to our apartment multiple times for domestic disturbances that didn't happen. Apartment management is threatening eviction for unfounded noise complaints. What can we do to protect ourselves?

    Posted: 19 Nov 2021 10:15 AM PST

My wife and I have received two visits from police officers responding to reports of domestic violence at our apartment. The first time was around 10 AM a month or two ago. My wife and I both work from home, and I had just gotten out of a meeting when they knocked on our door. The officers said someone reported a woman on our balcony shouting that she wanted to hurt someone. We heard no shouting at all, so it's hard to assume they just had the wrong apartment. The officers asked if we knew anyone who had "beef" with us (their words). We said no, and no one has come to speak with us about being too loud. They assured us there must have been some mistake and left.

This morning, at 4 AM, while my wife and I are asleep, we get another visit. Four officers outside our door responding to a report of screaming and pounding from our apartment. As I said, we were sleeping during this time, and we did not hear any of this noise ourselves. The officers could tell nothing was wrong and left after only a minute or so.

This morning at 10 AM, we got a call from the management office for our apartment building. They mentioned the police being called to our apartment and mentioned there have been a number of noise complaints made against us. These complaints constitute a lease violation, and, if they continue, we can be evicted. We explained our encounters with the police (which they seemed to accept) and mentioned that nobody has talked to us about noise before. They reiterated that, regardless of our statement, if the complaints continue we will be evicted. They would not tell us who has been making the complaints.

My wife and I live quiet lives. We work boring office jobs from home. At night we watch movies or play video games. We do not party or go out on weekends. We do not get into large arguments. We actually have a solid process (developed through some time in couples counseling) to resolve disagreements in a healthy way when they arise. We lived in our last apartment for nine years without a single complaint levied against us. I have a hard time believing that we are causing enough noise in our lives to be an annoyance to our neighbors. At this point, it is starting to feel like harassment, and it is endangering our family stability with the threat of eviction. What can we do to protect ourselves legally? Both my wife and I are really upset about all this.

As a final note, my wife and I have been looking at houses for the last couple weeks. We do not like the building we are in and are preparing to break our lease early just to get out. However, anyone paying any attention to the housing market knows we can't rely on getting a house any time soon, and we are afraid that we will face eviction before we can secure housing.

I appreciate any advice you all might offer. Thanks.

A cop gave me a “lawful order” to not call him again for harassment. Is that even a thing?

    Posted: 18 Nov 2021 06:51 PM PST

This is in the United States, New Mexico. For context, I live deep in the woods and there is only one road to where my few neighbors and I live. About less than a quarter mile from my house, a woman has been living in an unregistered camper with no electricity for over 4 weeks. She's in a spot designated for campers/hikers, and the law is that she can be there for 14 days. Normally this kind of thing really wouldn't bother me, however she is using propane and candles for warmth, which could end up burning down my entire home and I would have no way out since she is parked by my only exit. After getting the runaround by many government officials for the last 4 weeks, I got the number of the police officer who has jurisdiction over this specific part of the forest. I called him and was informed that many of my neighbors have already complained and he was already upset. We were both frustrated and had a fine conversation for about 10 minutes but when I suggested that he cite her for being in an unregistered vehicle he got pretty upset with me. In turn, I got upset with him and said "why don't we park her outside your driveway and see how you feel" he then told me I should take her in and I told him that he already knows her so it should be him that does it. I immediately regretted saying this and wanted to deescalate but he raised his voice and said that he is giving me a lawful order to never call him again because I was harassing him. After this he asked me how I even got his number, which really pissed me off since he is a public servant and I shouldn't even have to answer that. Still, I apologized and tried to deescalate 3 times. After he was still yelling at me I just told him to have a good day and hung up. Even though he's a jerk, I still need to call him if I have an emergency or police related issue. Am I really not allowed to call him back? I only gave him my first name and no other info.

I just realized my 401k contributions on my paystub are less than what my retirement website says my contributions are. Goes back 5+ years (CA). Over 50K of compounded losses.

    Posted: 19 Nov 2021 09:31 AM PST

Yes. I know I should have checked this whole time. It's a Fortune 500 company and I thought they knew what they were doing. I started from the bottom and always told myself, "I'm lucky to be working for such a great company. I'll be happy with whatever they decide to pay me."

Fast forward 5+ years, several promotions, and starting a new family. Let this be a lesson, do the quick math check on all your paystubs. You might screw over future you if you don't.

I checked my retirement site and realized I wasn't even halfway of meeting the "save X amount of money by the time you're 35" goal. Odd. Since my annual salary has been over 100k for a while and my contributions are always at least 15% with employer matching.

The contribution % number is as I selected, but the calculated amounts are low for my salary. I selected this contribution % when I started with the company and have not changed it since.

Example: I choose 15% contribution on 100k salary
    Expect to see: 15%, $575/paycheck
    Retirement site says: 15%, $250/paycheck
Paystub says: <$250/paycheck (Regular 80 hours)

I checked an old paystub from 2018 and that number is low too. Due to the compounding nature of the 401k, I've lost out on tens of thousands of dollars.

I called HR, which routed me to the retirement site's call center. They said "You didn't check until now? Hm... well we can fix this on a go forward basis." And I'm sitting here wanting to punch myself in the face because I've been over working myself all these years to be shrugged off like this. They said they'd call me back, haven't heard back yet.

I'm not asking for anything out of the ordinary or for something I haven't earned. I'm just asking for the math to be fixed to make me whole again because somebody messed up somewhere, and it wasn't me.

I'm aware I'm also to blame for not checking, but it's giving me anxiety thinking the most realistic outcome is that they'll fix it going forward and too bad so sad. Is this true? Or is it normal for these types of mistakes to be retroactively corrected? How/how far back? Do I need an attorney?

[UT] Is it considered discrimination to pay a native speaker of a language more than a non native speaker to perform the same tasks?

    Posted: 19 Nov 2021 05:29 AM PST

I work in a call center for an international business, which is shit pay to begin with. But it's come to light recently that native speakers of my assigned language get better pay then I do, even though I clearly speak the language more than well enough to perform assigned tasks.

Edit: for clarification, it's not just an issue with my specific language, but this is the case with all foreign languages.

My logic being that if I had a language evaluation and was deemed component enough to do the job just as well as a native speaker, we should get the same starting pay, where as what's actually happening is that native speakers start with an average of $2/hr more than non natives.

Sold Car 9/4/2021 - Title was never processed at courthouse and the insurance has run out. How fucked are we, as the sellers?

    Posted: 19 Nov 2021 05:29 AM PST

Leaving identifying details out as much as possible, but here is the quick gist:

We are in Tennessee. Sold our vehicle on the morning of September 4th, signed and dated the Title and everything. We told the buyers that the insurance ran out mid to end of October, and that they needed to get the Title in their name(s). I just found out that the Title is still not in their name; they never went to the courthouse to do so. There is no insurance on the car currently- it ran out in October. I explicitly told them this before it ran out and after as well, yet because there was a new card in the glove box they chose to believe that it was covered despite me saying it wasn't.

I briefly googled and had a panic attack. You are not supposed to sell a car without insurance on it because there are all kinds of issues and questions of liability... But our case is a bit more complex because it was covered when we sold it and had more than enough time(2-3 weeks) to go get everything changed over.

Questions: They have a signed and dated Title... Who is liable for any accidents or if anything happens? What should our next steps be, if any? How fucked are we in this situation? What should we expect?

Body Shop lit my Audi S5 on fire and wants to remediate without using insurance

    Posted: 19 Nov 2021 06:56 AM PST

Brought my Audi S5 coupe to a reputable local body shop for rocker panels and a dent below and behind the passenger's door. As of Wednesday evening they had finished the body work and had it taped off ready to paint.

They called and left a message the following morning at 9:30am sounding anxious and asking me to contact them. When I got in touch they told me that they had accidentally ignited the speaker foam around my rear passenger side speaker and that it went up fast. The Fire Dep came and ultimately got control of the situation. The shop owner told me that the speaker is burnt up but that the fire damage was limited there. He told me the car had filled with smoke and that it smelled "like a campfire that someone's been throwing plastic cups in all night". He said he was having a hard time sourcing a replacement speaker but that he would reach out to the dealership. He said his reconditioning guys are all super backed up but that he was figuring out how to get the car reconditioned. It seems clear that he doesn't want to go through his insurance.

I'm pretty shocked and wondering if any Reddit friends have advice on how to handle this. The shop is reputable but I've never heard of them being involved with or mitigating something like this. I'm at least a little worried about the quality of the remediation, let alone the down time on my car.

I called my primary mechanic (who doesn't do body work) and he was shocked too. He suggested that I insist on the insurance company getting involved. I'm having a lot of anxiety about this so any jokes or advice are super appreciated

    UPDATE:

I've just returned from inspecting the S5. The damage is less than I would have expected but not at all negligee. I've uploaded a video for your interest: https://vimeo.com/647864691. I also have an image of the no longer functioning speaker https://imgur.com/a/5lfBgxD.

The owner of the shop was unavailable when I visited but has since called me. He's been reasonable to speak to on the phone, although falling short of giving me a complete assurance that remediation will be 100%, or a timeline on the reconditioning, or offering additional compensation for either my time or more importantly my rental. I'm planning to take those issues up with him, as necessary, when I hear back about the timeline for recon… hopefully before the end of business today.

At this time I'm inclined to let him try to solve this. Although most advice has directed me to try to involve insurance and although I'm worried about the lack of complete assurance and details, it feels like the reasonable thing to do…

USA. NC My elderly friend is taken care of by her niece, how does she arrange her will so that after she passes the niece can stay in the house and the estate not split until she decides to sell?

    Posted: 19 Nov 2021 11:04 AM PST

My friend is ten years older than me and in their 80's. They have a young niece that lives with them, cares for them (cooking, etc).

My friend wants the house to be split among the inheritants only when the niece sells the home, when she is ready, without the interference of the other parties. This is to prevent immediate sale making the niece homeless.

How does she word her will that the house will be split when sold, but the niece has the right to live in the house as long as she needs?

The other parties are already making it known they want immediate sale, kicking the niece out to get the money.

My employer pays bonuses in "points" that I am taxed on but claims I am not able to redeem them for cash. Is that true? [CA]

    Posted: 19 Nov 2021 01:36 PM PST

Hello, so I work for a large lender here in the US, my job is 100% remote, they are based in AZ and I am in CA. As part of my job I receive "points" in recognition for things I've done. These have cash value and are taxed and labeled on my paycheck as "recognition". These points can be redeemed for various items on a company site that is managed by a third party.

Now, for the most part, I would just occasionally cash these points out for a Visa gift card and didn't really think much about it. However, recently the cards have disappeared from the site, leaving me no way to get the raw value of the card. I reached out and asked how I can redeem these points for cash and was told that is not allowed, you can only redeem points for items in the store.

I was under the impression that taxed wages had to be available in actual cash, similar to how you must be able to Cash out PTO when you leave your job. Digging into it further I also found that was not the case, and if I left the company, my "points" would always be available but would not be in cash. Am I wrong in thinking that they need to provide a way for me to redeem the cash value of these wages/bonuses?

Buying a home - Nightmare - Please Help

    Posted: 19 Nov 2021 01:23 PM PST

If this isn't the right subreddit, let me know. Sort of desperate right now.

I'm deep into the process of buying a home. We are set to close in just over 2 weeks. Everything has gone relatively smoothly up to this point.

I get on the phone with the title company today to ask generic questions about the city tax breakdown they sent. After we talk, she brings up something that is completely new to me.

She tells me the sellers of the home are non US citizens. Unsure if they have their green card or not. And that this means a bit to me as the buyer. She broke the news that I could be liable for about 10% of the sell of the house to cover sales taxes for the property. The seller, being a non citizen, does not pay the IRS the sell tax of the home. She mentioned that she reached out to the seller a few times to tell them they should work with a CPA to work on "exemptions" that would allow us to not need to pay for the taxes. But is unsuccessful so far.

I am shook. This is the second house that has fallen through for us so far in our home buying process. I'm also livid that I am finding this out 2 weeks before we are scheduled to close. I don't have the extra cash laying around to give the title company an extra 55K In cash to cover the sales tax of the home. I have no idea what to do. Any help/advice/insight or another subreddit to ask would be tremendously helpful.

At what point does home improvement contractor not doing any work become failure to perform?

    Posted: 19 Nov 2021 12:10 PM PST

    This is in Maryland.

A few months ago, signed a proposal (which was countersigned by contractor, not a small company/fly by night) for getting a deck built. Was told that after exterior measurements were done, drawings would be worked up for pulling permits. Have been told verbally (not in writing) that applications were submitted, then 6ish weeks after applications were supposedly submitted, was told we needed survey drawings and this was a 'new requirement.'

Checked the permitting web site, no application exists. So no visible or documented work (that I have seen) has been done in 2 full months since signing the contract. Company is currently sitting on ~16k of a $50k job.

In addition, project lead has literally lied about the status of this project on several occasions. So zero trust in this company at this point.

Options? Demand a refund and cut ties? Submit a chargeback on credit card I used to pay the deposit? Other?

Landlord charging 2 years back payment for a utility we were told we didn't have to pay

    Posted: 19 Nov 2021 10:39 AM PST

When the current management company took over the apartment complex in Madison, WI, where we live, the new lease mentioned a utility which we had not previously been paying. When we asked the representative, we were told via email (which we still have) that nothing would change with our billing and we wouldn't have to pay anything we weren't paying before, but that they didn't have the authority to strike it out on the lease.

We signed and crossed our fingers, but no bill came, so we figured all was well. That was two years ago, and a different representative is handling our building now, and they just notified us that we need to pay them 2 years of back payments on that utility.

From our perspective, this whole thing obviously seems pretty unreasonable. We were told in (digital) writing that we would not be charged for that utility, and weren't billed for 2 years. Now they want a significant sum of back payment because of their mistake. The email means we technically signed under false pretenses (one party misrepresenting the terms of a contract really should be some form of fraud), but at the same time, I realize that it's unlikely an email would trump a signed lease. I also realize businesses are entitled to make corrections to their past billing mistakes, and while 2 years seems like an inordinately long time to me as an individual, it's probably not considered such by the law. Also, the bill is in the upper 3-digits, which I realize is probably less than it would cost to fight this even if we do have options.

So, I know the answer here is probably "suck it up, buttercup." But I wouldn't feel right about just bending over without at least asking if we have any recourse first.

[California] Boss put $18,000 into my bank account as backdated pay but I wasn't even in the US then as a citizen, complained, but she won't do a thing.

    Posted: 19 Nov 2021 02:40 AM PST

    Throwaway account.

Canadian woman, 44/F, here on a TN-1 visa since 2009, as a computer systems analyst.

I was checking my online banking and surprised to see an $18,000 payment from my boss and also an email from her which said:

Backdated your payment from November 2003.

    This wasn't on payday either.

But I wasn't even working here in November 2003, I was in Saskatchewan working in a McDonald's!

I emailed my boss about it, she insisted I did, but I told her she must have got confused, but insisted:

No, you're that same Jill with the Polish surname I find difficult to spell.

I told her it was mistaken identity, but she refused to believe me. Kept insisting I worked for her in November 2003; I didn't come to the US until 2009 after much of 2008 applying for a TN visa and interviews etc.

I've worked from home most of the pandemic, it sucks, really.

I'm still on a green card, haven't yet got citizenship.

I've reported it, but the boss is doing nothing. Nobody above the boss, no shareholders, she's the owner.

What to do legally about her depositing $18k into my bank account alongside my salary?

I feel embarrassed and concerned. Am I right to be?

Immigrant parents refusing to give financial information for FAFSA

    Posted: 19 Nov 2021 11:48 AM PST

Hey so I'm posting this on the behalf of my boyfriend (19 year old legal resident of the US born in Mexico) to try and help him out with the troubles he's been experiencing. Basically his stepdad (born in Mexico and now a US citizen) brought him, his mom, and his two younger siblings to the US in 2019.

He recently applied to community college to study nursing and we tried to fill out FAFSA so he could seek financial aid. Because he's a first generation and low income student, he could receive a lot of aid from FAFSA and it could literally change his life but neither his mom or his stepdad will give their SSID's nor their tax returns to FAFSA for a bunch of reasons (none of which make any sense to me). His stepdad is claiming that they'll take away my BF's residency if he receives federal student aid. We told him that wasn't true and then he shifted the goal posts saying that he wouldn't give out his information because my boyfriend isn't on his tax returns and doesn't live with us and claims he is "independent". We sent him the resources explicitly stating that P (my BF) is still a dependent because he is under 24, unmarried, etc. But he won't budge. Then he tried to claim that FAFSA won't give him any money because their family doesn't qualify as "poor". We tried to explain that lots of middle class people receive financial aid. He then said he didn't want to have anything to do with "student loans". We told him that P isn't applying for a loan, but rather a federal aid grant .

We also tried to get his mom to provide her information but she is being controlled by my BF's stepdad and is not allowed access to any finances or tax returns. We told her that she can apply to independently access their family's tax returns but she doesn't do anything without her husband's permission.

We honestly don't know what to do and are wondering how to convince them to provide their information. If that still doesn't work we would like legal advice on how to get my BF legally declared "independent" or really any resources on other types of aid he may be eligible for.

    Thanks

Is it illegal to get someone sick by blowing in their face?

    Posted: 19 Nov 2021 06:06 PM PST

My friend, a senior in high school, got sick from underclassmen blowing in their face. The underclassman knew and stated she had a 'cold'. My friend was eating and asked her to stop but they weren't taken seriously. They're seriously ill now- throwing up, fever, etc. My friend is thinking they might have to go to the er. I'm really concerned for them. How much trouble can the underclassmen get into? I'm telling them to email the principal but is there a better course of action? They're saying it might be covid but we don't know for sure.

Roommate put in her 30 day notice without telling me.

    Posted: 19 Nov 2021 03:54 PM PST

    Location: California

My roommate let me know she put in her 30 day notice last week so I am wondering how this affects me. The landlord at the apartment complex said I have to put in a notice as well, meaning I would be on the hook for an extra however many days of full rent on my own. My roommate and I both signed one lease, not separate ones. Even on move in day I had paid all the deposits and signed but was not allowed to move in since my roommate didn't show up to sign. Our lease only mentions "renter" and nothing about being two separate people. Would this mean her 30 day notice is also mine and I can move out at the same time or do I have to provide a separate notice as well. Thank you

[US] My dad was shot and killed by the cops and it may have been a wrongful death/excessive force. I don’t even know where/how to start the legal process

    Hello,

I have recently been thrust into a nightmare and I have no idea how to even start the legal process to potentially get justice for my dad. I have 0% knowledge of legal proceedings and could use some help. Basically, I just need to know 1) what kind of lawsuit this would be considered, 2) how I go about finding an appropriate and good lawyer to represent his case (not looking for law firm recommendations, just how to assess and measure the quality of an attorney), and 3) is this even a case a lawyer would even want to pursue given at this point I have no solid evidence to provide?

Thank you in advance for taking the time to give your advice! [US, MI]

Unsure what my options are or if i have a case at all.

So i'm a Store Manager for a Hampton Roads Convenience Store and i was robbed at gun point while on the clock. They never contacted my wife who is my emergency contact. My boss tried to get me to stay afterwards, and i was given no time off and no security for either me or my employees. I ended up having to go to the vice president of my company on Thursday and threaten a lawyer to get any time off and was only given three days time off to clear my head. I requested security and my direct boss only got it for one day and that is this upcoming sunday. Now that i wont be there i'm almost 100% sure they won't have security for my employees. They still expect me to work by myself for a majority of my shifts, and we aren't allowed to have anything to protect ourselves. I was also told to not use labor hours to have somebody there with me. I'm also diagnosed with PTSD from a childhood accident and my supervisors were made aware of that. Sorry for the run-on sentences but my mind hasn't been right since this happened. Any advice would be appreciated. There's more details but i'm unsure if they are important or not.

What are the possible outcomes of two people that both were granted temporary restraining orders? Already have an attorney/court date.

My job's been underpaying me and the union can't get all I'm owed. What can I do?

I'm a cake decorator in a grocery store; I've worked there since 2015. I started out as a clerk, became the "assistant cake decorator" (not an official position but that's what they called me) and in 2019, the previous cake decorator retired so I became the cake decorator. I did not sign any paperwork but the manager said that was my position to me, other employees, customers, and to corporate. I was doing all the duties that the cake decorator would do; cake orders, filling the cases, coming in early on holidays, distress, etc.. However he did not change my position in the system from clerk to cake decorator, so I never got a pay raise. I received pay raises over time just because I worked there for a certain amount of time so I didn't notice.

We got a new manager in October and within the first week she told me about this and informed the store manager to fix it. However, the store manger couldn't because someone they hired after me to be an "assistant cake decorator" and clerk was made the cake decorator and each store can only have one. He contacted the district manager and she never responded; he said he'd contact HR but I haven't heard anything. I talked to my union rep to file a grievance and he said that I can only get back pay for 120 days, but that would only be around 1/3 of what I'm owed.

What can I do to get everything I'm owed? I live in Arizona. Thanks for your help!
