    My family member passed away in August 2020. A few weeks later I was contacted by the executor of the estate notifying me I was named in the will. The executor confirmed my social security number and basic contact info.

    I have received no other communication, no other information of the will, etc.

    Is it normal for such little communication? Does it always take this long?

    If this seems out of the norm, what can I do to get more information on the status and try to push to move the process along? Do I need a lawyer?

    Moving company lost everything my sister owned, what can be done?

    In short, my sister hired a moving company in Kansas to ship her possessions to Virginia. And none of it ever arrived. The company claims a third party company was supposed to do the final delivery, but the truck arrived back at the lot empty.

    The company has made no effort to find what happened to the shipment, only directing my sister to make a claim. After a week they finally submitted a police report at my sister's insistence because her insurance required one.

    Initially my sister contacted the Virginia bar, but the person she talked to on the phone said she should be talking to a Kansas lawyer.

    So here is my question, is there something a family member can do to assist this issue, like hire a lawyer? Between all the stress of the move, the new job, and losing everything she ever owned, my sister has completely checked out and is just burying herself in work instead of proactively working the problem. I want to help her, but I am not sure if there is anything I can do given that I am not the one who signed a contract or lost anything.

    My boyfriend asked me and my two kids to move in with him seven months ago, I put them in school there, now he wants his space. Do I have any legal right to stay there until I can better my situation in order to be able to move out?

    As the title says, my 38 year old boyfriend asked me, (28 years old), and my two kids, (who are a boy and girl age 6 and 11), to move in with him seven months ago. I ended my rental house contract and moved an hour to live with him. My kids went from being in school online through distant learning from Covid, to being in school at the town he lives in. They are happy and have lots of friends I mean they've been there since April and started the new school year in August. Now he decided he wants his space back and expects me to get out with the kids TONIGHT. Like told me this afternoon and wants us gone by tonight! The thing is is that we have no where to move to this suddenly. My only family here is my mom who lives about 45 minutes away but I can't just drive almost an hour both ways, twice a day, to take the kids to and from school from there. That would be almost four hours of driving A DAY. My crappy 2006 mercury mariner has 268,000 somewhat miles on it and it has a misfire on cylinder 2 AND 4 according to the computer at Advance Auto when they did the check engine light test. It shakes so bad when it gets to 40 mph and tries to stall until I let off the gas and just press it slowly. I am a waitress at the local Mexican restaurant like my bf knows I can't just up and move out and afford what it's going to take. It's so disheartening. Do I have any legal grounds to stay here for just a little longer until I can get my kids and I into a better situation financially? I'm not on any bills although I pay half of each one with him. And we don't have any kind of "rental" agreement because he asked us to move in with him.

    [CA] I work 8+ hours with no breaks. Is this legal? Where do I go from here?

    I work at a restaurant that's open 24/7. I've only been working here for a few weeks. They told me straight up, there are no breaks. On occasion, they do give the daytime employees breaks, (I've seen it), but since I've switched to the overnight shift, the night manager told me we have zero breaks. I worked 8 hours yesterday with no food, no sitting down, no cigarettes, no coffee, just......nothing to energize me or keep me going. I worked from 1am to 9am without eating or sitting down. Tonight I worked another 8 hours without sitting or eating food, and by the end of my shift I dropped plates on the ground and cut myself while chopping vegetables. I just can't focus without eating or sitting. A ten minute break is fine, I can survive without a 30 minute break if I really had to. But no break at all is absolutely killing me. Is this legal? What do I do from here?

    Bought house - fake documentation

    I bought my house in april. There were some concerns about the roof age and quality, so the seller provided paperwork stating the roof was replaced in 2012. Several months later some shingles flew off and I discovered that there were two layers of shingles on the roof, which didnt match the paperwork which states all the shingles were removed and it was fully replaced.

    One of the main reasons I was questioning the purchase of the house was because the inspector said it looked kinda old and I didn't want to have to replace a roof so soon after buying the house. After the paperwork indicated it was 10 years old I assumed it was just some sporadic damage/wear.

    I sent a inquiry to my realtor back in july but he never responded to me. Ive been busy with other stuff but started stewing over this again. Is there anything I can do or should I just cut my losses and replace the roof myself?

    [USA, FL] We have no lease for the place we've been renting for 6 years. How can we move out? Do we have any legal ground?

    So yeah I know we got ourselves into this situation when we shouldn't have and it's very stupid. 6 years ago we signed a 1 year lease with this landlord, it's been great with no issues. When our lease ran up we just continued staying and paying via gentleman's agreement pretty much, never actually signed anything, which yes I know was stupid.

    Anyway landlord wants us out by end of NEXT year so he can sell the place, cool, whatever, but what if we want to exit sooner? We're now looking for a place to buy ASAP. Can the landlord legally be like "Uhhh no you can't leave yet" and make us continue to pay rent?

    My college is sending my money to my parents, although they are not listed on my account nor has my tuition ever come from them.

    When it comes to refunds, my college has a protocol that any amount over $20,000 must be sent to a parent. This means they sent a check to my parents, with their names on it, without my permission, for the tuition money that came from MY bank account. Literally nothing has ever been paid by anyone but myself.

    I have told them my parents are estranged from me and have nothing to do with any of this, and that it's a huge issue for them to do so when I live nearby and can come get a check. I do not understand how this could be allowed. Why can't they break my refund into smaller amounts to get around this insane protocol? I assume if it were something I could get around with some changes to my account they would let me know as I've complained a few times since they did it the first time. Seems it will happen again soon as my medical leave has been extended.

    Is this common? Is there anything I can do to stop them?

    How to collect wage theft claim that was awarded in my favor against my previous employer?

    My previous employer 0'd out my finally two paychecks. I reported this with the Colorado labor department and recently won my case. The judgement is against the company AND the owner personally. Both are equally liable for the debts. Unfortunately I don't have their account number but know who they bank with. They also have physical assists that could be sold but this seems like it could be a harder process than going after the bank accounts. I don't think I could garnish her wage as her and her business is already refusing to pay. What is my best course of action in collecting my wages?

    Step father withholding child because of restraining order against him.

    My friend recently left an abusive relationship, filed for divorce, custody, restraining order etc... he is avoiding being served. The step father was in custody of the child when the restraining order took effect. They had a written and agreed to custody agreement for the next few weeks while it was being sorted out, and a plan for him to drop the child at daycare where the mother would pick up after work so they did not come into contact. (All in writing) the step father did not drop the child off stating he could not because of the restraining order, he then withdrew the child from daycare with out concent of the mother. She asked his parents to bring her the baby and the grandmother refused, saying the mother could only come visit the baby under her supervision at the stepfathers house if she came alone. The police say they can not get the child because it is an active custody battle. Is there anything else she can do to try to get her baby. She is meeting with a lawyer next week, has made reports, and filed for status quo (granted but he hasn't been served) what else can she do?

    What should I expect if I advise employees to file a wage claim?

    I'm just an assistant manager in a big retail store. We have caught them changing our hours to make sure we dont hit overtime, most employees still have to write their times on paper even after being employed over a month. Upper management thinks they're being sly, because the people dont know their rights. They laughed about firing half the employees when the store was done being built, after hiring them under the impression it was a long term job for 40 hours a week. Only management gets more than 15-20 hours a week. Now I'm hearing alot of employees say they dont think they got paid for how many hours they worked or got called in for, but they dont stand up for themselves. Would it be a bad idea to write the steps out for them and suggest that whoever truly believes they didnt get fully paid to file a claim?

    I dont know law stuff very much but this must be breaking some law. Maybe I'm wrong. This is in Texas, USA and I can provide any other information needed to help give me an answer as to what I should do.

    [USA-MI] I want to report my former employer for ongoing tip theft. One issue that's keeping me is that they inflated our hours worked during the pandemic to "make up for the loss of tips".

    During the pandemic my former employer lost most of the staff, from 20 to 5. Those of us that remained got a boost in pay, and we were all working part-time but the owner paid and recorded us down on the books as if we worked 40 hours/week.

    During this time, our tips were kept from us and used to contribute towards a free meal program for those affected by the pandemic, and there was strong pressure to not be "petty".

    A year and a half later, and even up through me leaving, the tips were still being kept for this program, and our hours and wages were still inflated.

    I guess what I'm asking is, would we have to pay back wages for hours not truly worked if I reported the employer for wage theft? I'm of the mind that we would have been earning more money had we been allowed to keep the VERY generous tips throughout the pandemic.

    Brothers girlfriend and mother of kids drained their bank accounts and won't stop spending money (MA)

    Looking for advice for a family member. The situation is that his live in girlfriend and mother of his 3 kids has spent all of their money. Collectively they make good money (200K/year where she probably makes 60% of that) but she never learned financial responsibility and has emptied their joint accounts and is taking money or charging accounts that belong solely to my brother through whatever access she might have to those cards.

    Now he's working 2 jobs and she's still spending money they don't have. He said she told him her expenses outweigh her income.

    I think at this point he wants out before she financially ruins him for good. Not sure if it's relevant but he does the majority of the household duties and seems to be the most involved in the kids lives. Almost everything is in his name.. house, utilities, cars.

    What direction should I steer him in? Who does he need to talk to? Lawyer, financial advisor..? He needs help and he needs an advocate. Shes a train wreck but I fear her parents will make every attempt to screw him out of assets and child custody. He states her father has already proposed buying the house from him but I fear he will buy it so his daughter can keep it with the kids and they will evict him.

    My employer is reducing my last paycheck to minimum wage

    Is it legal for an employee to reduce your last paycheck if it is a policy in the company handbook that you signed? The policy reads:

    "8.3 Resignation Any employee who chooses to resign must provide a two-week notice. As permitted by law, any money due to the Company for services rendered will be deducted from the employee's final paycheck if payment has not been made prior to the last date of employment. Any member of the Management team who chooses to resign must provide a four-week notice. Failure to provide proper notice may result in the Company, at its sole discretion, paying the employee at the State mandated minimum wage rate for hours worked during the last two (2) weeks prior to the employee leaving the Company." I wasnt sure if this is allowed in the state of Florida. It probably is but I wanted to check to be sure.

    This guy has no money left because after he scammed everyone, he went out and spent it all on himself.

    So they issue an execution on his bank account. It is returned unsatisfied. They issue another execution, also unsatisfied.

    Then what? After the maximum number of execution attempts (I've heard there's only so many times they can do this in Connecticut), what happens? Do they just give up and the defendant goes on his merry way? What happens to the defendant's LIFE? In what ways is not paying the judgment going to negatively affect them?

    California. I'm trying to be patient on a workers comp denial case. I punched out, and got hurt at work in August. Exactly what step is my attorney waiting for?

    I'm a hotel maint tech. I punched out, went to the hotel room I was working on to remove my tools and start organizing them into a new tool cart my company gave me. I was going to be off the next day, so my tools had to be out of the room so another worker could complete it.

    Long story short, I damn near cut a finger in half, and had to let my local ER stitch it up. It really needed to be put back together by a specialist, but my claim was denied due to me getting hurt after I punched out. https://imgur.com/a/HYIb0a0

    Speeding ticket w/ incorrect info

    I got a speeding ticket and my last name is misspelled, and the DL number is wrong. The address is also wrong but the cop took it from the old address my vehicle is registered under. I went to the court house to take care of it but they say it hasn't even showed up in their system yet (4 months later). My question is, should I even worry about this ticket? I'll never receive the courtesy notice bc of the incorrect address. And if they look up my name and DL number from the cop's copy of the ticket they're both incorrect. My only concern is that he actually put the correct license plate number. Anyone have a clue? This is my first speeding ticket ever (69 mph in a 55)

    Pool flew over my neighbors fence. He's claiming damage to his windshield.

    Hey everyone so as the title says I have a kids pool that flew over our fence after a bad wind storm 2 weeks ago. When my girlfriend went to talk to him about it to get it he didn't even know it was back there. She said that before they made it into the back yard he was saying he hoped it didn't cause any damage to one of his vehicles. With the logistics of everything from what I saw and what my gf told me I don't believe in the slightest that my pool caused the cracked windshield he wants me to pay for. I told him to get into contact with his insurance and we can go from there. There were no pictures taken and he has since moved all his vehicles around so putting together information could be tricky. My question is if he takes me to court if I don't pay am I likely to have to pay more? This is in California.

    Estate Law help/advice needed. Mother died in May, had no will, divorced and 3 adult children. Did I pick a bad lawyer?

    I am the daughter in this situation, and like the title says she unfortunately passed on May 31st this year at 64 years of age. I have an older brother who has been struggling with serious addiction issues his entire adult life and has chosen to be homeless in order to continue his drug addiction. My younger brother lives out state in GA and is active duty military currently.
    My mother (as well as older brother & I) live in TN and that is where she passed away. She had no will, or power of attorney/guardianship or anything like that. My brothers and I are in agreement that the house must be sold as none of us are in any position to be able to maintain it or assume ownership of the property. I am in college trying to complete my bachelors degree and working 35 hrs a week making $15 an hour. Younger brother already has a house with his wife in GA he's paying a mortgage on and they're expecting their first child May 2022. Older brother is not responsible enough for the reasons I've mentioned before and knows it.

    The following week after she pasted away (May 31st - June 8th), in order for her to be cremated, it was required that at least 2 of her immediate surviving relatives sign paper work for the funeral home.
    My family was able to get a hold of my older brother to come sign, as younger brother was stationed in Afghanistan on tour at that time. He (older bro) has no phone or reliable form of communication that anyone can reach him on. The only way we were able to get a hold of him was via another homeless friend of his that did have an active phone and was kind enough to go track him down to deliver the news. My older brother and I talked a bit and he hung around for about 3-4 days before taking/stealing my mother's vehicle and leaving (Had to go find/get another fix so he didn't begin going into withdraws.) Younger brother arrived about a week later, we talked,

    In August I began the process of putting the property into probate so it could be sold. I found a lawyer that was local to my mothers' house and property and explained my family's situation as best as I could with all the previous information included.
    August 31st I signed the paper work & began the process of putting the property put into probate so it could be sold. I was named Administrator/ Adminstratrix of my mothers estate as well. My lawyer explained to me that the house/property could be sold without my brothers' involvement being necessary and that once it was, they would just have to individually come and collect their portion/share of the sale. He also explained that her passing & the estate changing ownership/being sold must be made public & listed in the newspaper for 4 months so that anyone my mother had debt with could come and collect it. He said that the house & property could be sold before those 4 months had passed, and in that event the money from the sale would just be put into escrow for the remaining time.

    I was asked to give him an inventory of my mother's belongings/ valuable items and explained that the only things of significant worth she had was the house & property itself, her vehicle (a 97 Buick), and the appliances she furnished the house with. Most of which were second hand/used appliances with the exception of 1 refrigerator, 1 electric stove, and a washer/dryer pair that were all purchased new in 2018. There are 2 other refrigerators, and another stove that were purchased from goodwill/ second hand/thrift stores by her (her house has 2 kitchens as it was renovated by the previous owners to hold 2 families/be separate living quarters). This was my fuck up as I completely forgot to email him that list since classes started and I returned to work this fall, but I remember telling him that verbally.

    At the beginning of October I met with a realtor who my father and step-mom worked with twice before when selling their homes in TN before they moved to NY (step-mom is originally from there). She tasked me with cleaning the entire house out, as in emptying it entirely and getting the yard landscaped nicely so she could have "professional photos" taken for the listing. She explained that her son was a lawyer who has experience in estate law would be willing to take this on/be my lawyer. I explained that I had already met with one and worked with him to be made Adminstratrix and put the property into probate so I felt it would just be easier on me to keep him/stay with him (I have no idea what all you have to go through to switch lawyers but I imagine it involves more time/paperwork).

    My younger brother and his wife didn't want anything of my mom's besides a few small items they took the week they were here after her passing. Everything of sentimental value I packed up and is in storage right now, which includes anything I thought my older brother would want of her's to keep AND all of his clothing, tools, and personal belongings he was keeping there. I spent my entire fall break and the week after emptying the house which was getting close to hoarder level of stuff. All her furniture was purchased 2nd hand/previously used from thrift stores and since she was a heavy cigarette smoker and smoked in her house I threw away instead of donating. The realtor's husband helped me physically move all the heavy/big furniture items, which there were a lot of.

    She, the realtor, wanted it all to be done asap so she could list the property online since the market is really good here right now to sell. The farther into the holidays and winter weather we go, the chances of it being sold are reduced b/c nobody wants to move or has time to during holiday season. Well, I emptied the house entirely, had the yard landscaped and cleaned up and signed the realtor's paperwork for it to be put on the market on Oct 22nd.

    Later that day, Oct 22nd, the realtor calls me and informs me she spoke to my lawyer and he straight up told her she could not legally list/put the house on the market without both of my brother's signatures & consent. I sent her a picture of the document I signed naming me Admin, and she got back with me after speaking with her lawyer son, saying he explained that my lawyer is 100% correct. I was livid and am still very frustrated as I am now back to square 1 in this ordeal of needing my brothers' involvement. The younger one is no problem (unless he is sent back out on tour/duty) .
    I can not and will not go looking for my older brother as that puts not only my mental health but my physical safety at risk and in danger. I also do not have the time for that with work and school going on.

    I do not understand why there is no way to go around needing my older brother's consent/approval to sell the house, or why my lawyer would tell me that it could be done without either of them when we first met. My lawyer is still asking for the "inventory list" and I will send him one but the realtor said the appliances should stay/be included with the sale of the house (which I agree). I currently posses the title to my moms vehicle but my older brother still has it somewhere and expressed that was all he wanted (he helped her pick out/ find it last summer in 2020 after her previous vehicle was t-boned and totaled out by another driver).

    Reddit can you help me or give me any advice to deal with this stupid ass situation?

    TLDR: My mom died without any kind of will. She has 3 kids, I am the only kid who can and is willing to deal with settling her estate because the other 2 are not as available. One lives out of state and is active duty military, the other is a serious drug addict who is homeless & can not be contacted or found. My lawyer said originally that her house/property could be sold without them being involved but now says the opposite and that their signatures & consent is legally required. I am confused and very frustrated about what to do now.

    Extend Car Warranty

    I have been trying to cancel my car warranty for eight months, I started cancelling before the 30 day prorated fees. I came in to check on it but he made me wait tell an hour and a half after closing. Then I came in again about five months ago and I got a physical copy, the financial manager has been giving me the run around. I didn't even realize how much this guy was scamming me. He didn't even put the date on it. After that I had enough and I talked to a new hire Financial manager about that same issue. He said it would be taken off within 6-8 weeks, but no refund for tire and wheel protection I got with it. Basically I was curious if I could put my own date on the cancellation paper. I have not used any of the services provided, and due to negligence and disregard for me as a customer I want to do it. I just don't want to face legal repressions if I did, on top of exploring my legal options it's a lot of money and I'm kind of broke. I doubt he kept the copy, he probably threw it away because of the commissions .

    [USA-FL] Friend's condo HoA treasurer may be stealing money, they have hired a lawyer to take my friend's condo.

    Last year my friend physically handed their HoA dues to the treasurer. Fast forward one year later and they're saying she didn't pay it. They're requesting proof that she's given them that money but say that a statement is not enough proof and they need almost like a picture of the check from her bank saying that it was cashed. The bank is BB&T. Through lots of effort today we found out that the check was deposited in NC somehow. The treasurer has family there. They however did not cash the check there, but rather here in Clearwater FL. What can we do? The local branches of the bank have really not been able to help. The lawyer has been very persistent and my friend is losing sleep over the fact that they want to take their over 20 year investment. The amount is less than $500 but for them to try to take that condo and be so aggressive about it is pretty surprising.

    Ex-boss arrested for sexual assault. Would my story help the victim’s case?

    Throwaway account for obvious reasons.

    My old boss was just arrested for sexual assault of an employee in the office of the company he owns. I can't get into the details, but the victim has proof. I worked for this man years ago and am wondering if my story would help the case against him.

    There was a ton of sexual harassment and bullying while I worked there. I can remember specific examples, but none of them are things that the owner did or said directly… he was always just in on the jokes and encouraged that kind of environment. I know he did say things that would be considered harassment, it's just been too long to remember specifics.

    I think my story would be too vague to help the case against him. My friend thinks I should contact the state's attorney and let them decide if there is any value in it. She says my story is an example of his company being a hostile work environment, which might help the case.

    Is there any point in me coming forward?

    Neighbors property is dangerous

    I live in a small rural town where the houses are maybe 50 feet apart with the town itself being only about a square mile, bounded on every side by farmland and woodlands. My next-door neighbor is an incredibly skinny and very old women whos property has fallen so far into disrepair that I am worried about my animals' (and maybe my own) safety.

    She has no heat or running water. Two winters ago the pipes froze and burst causing the siding on the house to rot away. The porch has rotted to splinters and the roof is about 10-20% totally gone. There is a homeless man living in the house, he just showed up one day and lives in the upstairs; she doesn't know who he is. There was once an in-ground pool in the back that has now become a swamp full of a few dozen trees and a healthy bullfrog population. There is a secondary building, a barn, on the backside of the property that is probably about 60 years past being salvageable and is filled to the ceiling with horded garbage and mold. Her basement is thick with black mold that you can smell from my house whenever she opens her door. On top of this, many different animals have taken up residence inside her house. Quite a few racoons live in her walls and often spill out into my yard. The only reason this bothers me is becausue I have cats.

    There are many other issues with the property, though I'm only really concerned with the ones that affect me. Mainly, the mosquitos from her pool, the black mold smell, and the animals living inside of her house. I have two indoor/outdoor cats that sometimes get into her old barn and now one of them has been missing for several days. Normally I would clean out the racoons with a 12 gauge, but seeing as it's not my property and I'm in town, I can't just enter someone else's building and fire a gun.

    We've already spoken to the town mayor about this and no action has been taken. Who can I call about this?

    I also want to say that I am not someone who supports any kind of HOA. I think the idea of telling someone what to do with their property is absurd, however I also don't think that these hazards should be allowed to persist this close to my home while the law prevents be from being able to do anything about it myself. If she refuses to fix the issues that affect me, then I should be able to fix them myself.

    Suing neighbor for hospital bills after a dog bite (TN)

    My wife was recently bit by a neighbors dog. Her dogs got out of the fence and were running free. One of them barged into our house when another neighbor knocked on our door thinking they were ours. My wife went to get a hold on its collar and she was bit. It wasn't an aggressive grab or anything of that nature. The bite wasn't bad but it broke skin and drew blood.

    Fast forward 15 minutes and we knock on the owners door to inform her that her dogs got out. We ask if the dog is vaccinated and she says, "yes, but I don't know where the paperwork is." We ask her to find it and show us by the following day.

    Fast forward to the next day. She says she was mistaken and that the dogs shots are out of date. We tell her my wife is going to the hospital and she will be responsible for any bills. She agrees to pay us back. My wife goes to the hospital and calls animal control. Doctor gives rabies shots, dog does a quarantine, etc.

    Fast forward a few weeks. She's now avoiding door knocks and refusing to face us over a $500 bill. A retired lawyer friend is going to help us file a claim, but is unsure of a few things:

    -Can we ask for more for our time, process fees, etc? If so, what should we seek and how do we assign dollar amounts?

    -Can we call her landlord and have her evicted (they're renting a house)?

    -What are the best ways to collect a judgment assuming the judge rules in our favor?
