Posted: 29 Oct 2021 06:07 AM PDT I figure it may not be worth fighting over as other tire shops will fix that for free, but it's the principle of the matter, and the idea that other customers could avoid having this shop do something similar. [link] [comments] |
How do I pay my student loans? Posted: 29 Oct 2021 05:02 AM PDT I'm American. Did the whole normal college thing complete with student loans. Graduated 2013. First year after I was paying them no problem. Then I moved overseas. I've lived in France since 2014 and I'm here permanently. I've got permanent residency, I'm married, I've got a French kid. Did you know the US government won't accept payments from foreign bank accounts? And my US bank won't let me maintain an account since I don't live in the US. So what do you do when you actually want to pay your student loans but they literally won't take your dirty European money? [link] [comments] |
New job alters my hours so that I don’t make overtime Posted: 29 Oct 2021 06:40 AM PDT About a month ago I started working as a delivery driver for a DSP of Amazon. I work 4 days per week 10 hours per day. A lot of the time I am delivering around 300 packages which results in me working slightly more than 10 hours on certain days. My first paycheck (after two partial checks for training) I logged 41.20 hours. When my stub came available (we use paycom), I noticed that they only paid me for 40.10 hours. Sketchy but maybe I missed something or made a mistake in some way. Next week I log 41.39 hours. Stub becomes available and they only paid me for 38.94 hours. It seems to me that they are obviously altering my time punches to avoid paying me over time. There is an option to report an issue with my check but when I click it it simply says that this company has not set up the button. Other sketchy stuff: They insist we don't wear our seatbelts during our delivery routes because it wastes time. They insist we don't report any damage our vehicles have because they would have to ground the vehicle until repairs are made (has resulted in driving trucks with no lights, broken doors, broken rear view cameras, no wipers, deflated tires… etc. Job is listed as paying $20 dollars per hour with a $3000 sign on bonus but when you get hired they tell you that that doesn't apply to your particular station. TLDR: My company skims my pay checks and insists we break driving laws while working. What actions would you take in a situation like this? Honestly I've been pretty desperate for work and can't afford to quit at the moment but I also can't afford to not be paid for the hours i'm working. [link] [comments] |
Posted: 28 Oct 2021 04:41 PM PDT I am an early childhood preschool teacher. Today I learned that one of my kids has tested positive for COVID. This kid, like most three-year-olds, has a problem with keeping his hands to himself, and a problem keeping his mask on throughout the day. Which means likely everybody in the class has been exposed. He is also in my after school care group, so a total of 34 children aged 3 and 4 have been exposed as a result. However, the lady in charge of deciding who quarantines and who doesn't has only decided to send three kids from my main class home and none from my aftercare group. This lady, as far as I understand, works with HR. I asked today about what further measures would be taken to ensure that all of our kiddos are safe, and asked about informing parents that their kids have been exposed, and I was told that only the parents of the three kids selected for quarantine are to know that their kids have been exposed, and that I would not be permitted to tell other parents. I was confused and thought maybe I misunderstood, so I said "But all of the kids have been exposed. Shouldn't parents know this so they can test their kids?" I was told that I "can't assume everyone has been exposed" and that telling other parents would cause "unnecessary panic" and I wouldn't be staying with the school for much longer. (perhaps this is irrelevant speculation but I suspect that the lady in charge of deciding who quarantines is worried about having to reimburse parents for preschool tuition and aftercare costs if all of them were made to quarantine). Anyways, I feel as if this is a huge liability to which I am now an accomplice. I'm not a parent myself but if I was I would want to know if my child was exposed to COVID. However, I don't get paid for shit, to be frank, and I cannot afford to lose my job. Is there someone I can report this to? What is my best course of action here? [link] [comments] |
Posted: 29 Oct 2021 11:50 AM PDT UPDATE: I have contacted the DA and AG, both offices say anything other that abuse committed by medical providers or managed care facilities needs to go through APS. APS tells me the same thing as the police and the court… no victim, no crime. I feel so hopeless. My dad has dual US/Danish citizenship and owns a small vacation house in Denmark where he is currently staying. He has lived with his girlfriend in her home in California for the last 20 years. She has isolated him from me since 2017 when he was diagnosed. Recently she decided she could no longer care for him and instead of accepting my request to take over, she bought him a one way ticket to Denmark and sent him off. She even got him a wheelchair escort and wrote instructions how to pay his bills. She told me it was a "short trip" but come to find out there was no return ticket. He got scared after a few weeks and came back, so she had her attorney write to me refusing all responsibility for him, denying him entry into her home and telling me he is my problem only. They never had a lease, there was no eviction process. He showed up at her door, she temporarily took him in, and then sent him off AGAIN! This tome after having him sign a "mutual release of claims" without witness or notary. I am unable to bring him home because I have nowhere to put him. Fortunately his dual citizenship allows him access to stay there and have healthcare, but neither of them did the proper paperwork so he was in limbo, wandering, without meds, police incidents etc. so I made an emergency trip to get the situation under control. We had POA notarized at the US Embassy, he has a Danish social worker now and the Danish doctor strongly recommended he be appointed a legal guardian through the municipality. I got him a new phone and blocked her number, but she just calls and texts him from different phones. She continues to harass and direct him from afar. She tells him to go to the bank and take out all his money or climb on his roof to fix the antenna, or take long train trips. He has already been robbed and missing for days trying to complete her quest. Yesterday I was denied an elder abuse restraining order against her by our local probate court because the "protected person" is not "living" in the US. I explained to the judge that the postal service, social security administration, IRS, State tax board, and several financial institutions would all disagree, and that he is only in Denmark because his abuser sent him there and I'm unable to retrieve him. I had so much proof. She wouldn't even hear my statement and dismissed us. Assuming my father will not be able to return to the US, and I hold POA, what are my options for legal recourse against the girlfriend for this abuse? She needs to be held responsible. DCFS And My Child Soon To Be Born Posted: 29 Oct 2021 06:56 AM PDT To create understanding of my legal situation let me first explain the story. I met a girl online almost a year ago and I found out she lived in Chicago and I lived in Maine, we hit things off well online so I met up with her in Chicago and I lived with her for several months. I found out she was a heroin addict and was a active user. She did give me hints that she had a drug problem in the past but did go to rehab and at the time I honestly believed that drugs where a thing of the past. Due to her drug problem are relationship deteriated and we separated, she stayed in Chicago and I went back to Maine. The problem im having is that I got her pregnant so I'm dealing with DCFS and legal matters. My baby is due to be born soon. The mother of my child is currently in rehab seeking treatment, the problem is that DCFS is planning on taking my child in to child protective services immediately they told me, and everything is decided by a judge which I don't understand why when I'm the father, I don't understand why they just don't give the child to me and give me legal custody right away. DCFS is reviewing my background right now and will see its clean themselves but still are taking it into protective custody at birth anyways. The mother has agreed she wants me to have the baby and take it with me into my legal custody in Maine. The thing I don't get is I have a clean background and had a job and worked for the past 8 years and was responsible. I feel I did nothing wrong and am having my baby taking away from me and feel it's morally wrong. They just want to put it in foster care and make the court deal with it and a judge decides the fate of whether my child will be in my life or not. What legal advice can you give me to help me out? [TX] Car got towed. Went to tow hearing. Won by default judgement. Tow company appealed judgement. Posted: 28 Oct 2021 06:16 PM PDT My question is from Houston, TX. My car got non-consent towed from where I live. I went to a tow hearing but no one showed up. The judge entered a default judgement awarding me all the court costs and the tow and storage fees. Then a lawyer representing the tow company filed a Notice of Appeal. I did some research by looking at the Justice of the Peace court docket and it seems that this is the MO of the towing company and lawyer, they rarely show up to the tow hearings and just file appeals to the county civil court. Is it possible to get the county civil court to dismiss the case because no one showed up to the tow hearing? [link] [comments] |
Posted: 28 Oct 2021 05:03 PM PDT So my dad has been talking about buying rental properties for a while and the opportunity has come to him to purchase one off market for a discount with tenants already residing at the property. I (22M) have never owned anything never signed my name on any contract for a lease, car, or rental anything. My dad says this is the first step to build wealth. He wants me to sign on as a first time homeowner for financial reasons (lower down payment). So as I know it all i have to do is sign my name on a piece of paper, my dad claims "i'm taking all the financial risk here" so me personally I don't have to worry about anything other than my signature. But I am worried, I don't know if I should let him venture this on his own or sign on and become a homeowner with him. If i do sign on I would absolutely want a percentage of any profits gained from the property. Do I need an attorney to make a contract for that? I'm so clueless and i'm sorry if i sound silly but I don't want to be taken advantage of in this situation, my dads has always been pretty smart financially and trustworthy but something doesn't feel right. Please help me out here or give me some advice on how to approach this. Thank you all who took time to read this. [link] [comments] |
Can I be sure my cousin’s ex-husband was informed of her arrest? Posted: 29 Oct 2021 05:11 AM PDT My cousin has had some issues with the law, and was recently arrested for assaulting her current boyfriend but has since been let out on bail and I believe the boyfriend is dropping charges. She has a child with her ex, who has main custody. The child was with her ex the week she was arrested, and as far as I know nobody in my family will tell her ex what happened for fear that he will get full custody. I think this is really messed up and I want to tell the ex, but I don't know his number or address, I could reach out on social media but my family said if I say anything they will not speak to me. Is there any way to confirm that the ex does in fact know about the arrest? I reached out my local police department but they didn't get back to me. I want someone to tell him because I believe my cousin shouldn't have custody for the sake of the child, even though the child has never been harmed by her as far as I know, but I know my family is hiding that drugs were somehow involved somehow in the assault and I believe this could affect the child negatively. I don't know how to get in touch with the ex, and even if I did I don't want to be cut off by my family if they find out I told him, so is there any way to have an agency inform him, or should he have been informed already? Posted: 29 Oct 2021 01:37 PM PDT (IL) I recently left my job at a car dealership, and I'm wondering whether or not I can report them to the department of labor. Employees are forced to pay out of pocket for any and all mistakes. Some of the charges that I've witnessed include:
Are these instances legal, or a violation? Everyone there is too scared to speak up for fear of losing their job. [link] [comments] |
Car was stolen and cops wrecked it Posted: 29 Oct 2021 09:07 AM PDT As the title says, my car was stolen and in the process of chasing the people who stole it completely trashed my car. They blew the tires and smashed it into a concrete median. Now on top of having absolutely no transportation it is sitting in a tow yard accumulating more fees while I try and get my insurance to do their jobs. My question is since the cops trashed it, can I sue them along with my insurance for the lost wages, loss of my property and other costs incurred with this whole situation? [link] [comments] |
Fair Housing complaint HOA sent me a cease and desist notice Posted: 29 Oct 2021 05:56 AM PDT I have an issue with my HOA they are not allowing my kids to use facilities. They refused to do anything and I filed a fair housing complaint. They started sending me emails that I was violating petty rules so I told them that I consider this retaliation which is not legal. I then get a letter from to cease and desist talking to anyone including board members or I will be sued. I wasn't sure if I should get an attorney but I did turn it over to the investigator who is looking to add retaliation to my complaint. I also found out there attorney is appointed to the local fair housing board. Should I report him to the bar for even taking on the case or just wait and see what happens and bring it up if they don't do anything. [link] [comments] |

Doctor double charged HSA and Credit card. Nobody knows where my HSA’s money went. Posted: 29 Oct 2021 12:17 PM PDT Hi legal advice, I went to a Virginia doctor in October 2020 for a procedure and was essentially double charge. I paid the copay on my credit card upfront and paid the rest through my healthcare provider (UHC) via my HSA with OptumBank when they issued a bill. Nearly a year later, I see a huge credit card charge from the doctor's office to a credit card that I don't remember putting on file. I call the doctor and they said it was to cover my bill and that I should call my insurance if I believe it was a mistake. I call my insurance and they say their records show that I paid, but I need to contact my HSA. My HSA says their records show that I paid, they provided me with the payment number and said to call the doctor. Then I call the doctor with the payment number and they say it isn't in their system. I call back the HSA and they say I need to call OptumPay to figure out where the payment went. I call OptumPay and they say that they can only speak with my doctor's office to validate a payment, and they can't speak with patients directly. So my doctor calls them and verifies that there was no payment to their account. Fuck. So nobody knows where my money is and nobody seems to be taking responsibility, but now I'm out a ton of $$$ with no clear way to figure out where it went. I could issue a chargeback through my credit card, but my HSA also informed me that the doctor also charged my HSA for the copay, so technically I should getting that refunded too. What other options do I have? If I took anybody to small claims court, would that be the Dr, HSA, or Optum bank? I now live in Mass and have a different job/insurance provider/HSA which might complicate things. [link] [comments] |
Paying debts for insolvent estate... Posted: 29 Oct 2021 09:14 AM PDT Hi!, Im stressed beyond belief... my mom passed away January and it has crushed me but i also have to deal with this stuff. To get to the point, she didnt have enough assets to pay her debts. We are at the bottom rung of debts to pay... the credit cards, one card has a much bigger balance than the others, phone bill, internet etc. How do I split whats left between these? There isn't enough for everything. Very confused and just need an answer. I don't want to make a mistake and have anyone come after the administrator or me. Also, i believe some of these were sent to collections. Btw, we notified them all of her passing right away. No one has contacted us to collect as of yet... So to pay debts for these do we reach out to the collections people or the original company? Thank you so much for guidance on this. Im lost... [link] [comments] |
Can a landlord make a tenant remove a political sign from their yard? [OH] Posted: 29 Oct 2021 08:25 AM PDT I am in Ohio. Can a landlord make their tenant remove a political sign from the yard because they don't like it? Or can they make a tenant get permission to put up a sign? I would assume this has to be written into the lease if so. In this exact example, the tenant pays for the yard to be mowed, so I would assume the tenant then has all rights to the yard. If possible, I'd like to cite the actual law if there is one. Thanks in advance. [link] [comments] |

Is it legal for HOA to leave gates open? Posted: 29 Oct 2021 01:23 PM PDT I purchased a house in a gated community. The HOA Board has has trouble with the gates but they have now been repaired. They have recently decided to leave the gates always open during the daytime hours. We purchased this expensive home here because it was gated. Is it legal for them to just decide to leave the gates open now or are there some legal ramifications that may occur because of this for the HOA? [link] [comments] |
Posted: 29 Oct 2021 01:22 PM PDT First of all, this is in California. My friend had moved a couple months ago to California for university and was looking for a place to live outside campus. One of the property managers for a place he was looking at first asked for a separate $25 credit check and then asked for a $1000 security deposit before giving any consideration. It took a week or so for approval and by that point my friend was back home and told the man over the phone that he wasn't in town to sign any papers so he could only come by to sign papers in a few days. My friend had been looking at many places however and decided to sign with a different agent and landlord. My friend called the guy back the next day to say that it wasn't going to work out. The property manager told him that since he was holding the property for him, he would have to pay rent on the date of approval and the day of the last phone call, so he would be deducting two days worth of rent when returning the security deposit and he should receive it within 21 days. At this point, it has been a month and a half with no deposit return and the property manager has been dodging calls from me and my friend. We asked a couple other friends and they informed us that because no lease was signed, the property manager must return the full amount of the security deposit. I would love any second opinions on what our legal rights are and what actions my friend should take. [link] [comments] |
Trying to help save a state park Posted: 29 Oct 2021 01:20 PM PDT Developer wants to bulldoze and blowup a bunch of land directly bordering a state park and river in order to install high density town homes. This spells disaster for the state park in terms of polluting the river and hurting the environment. What the heck do you do in this situation when the developer has a bunch of money to push their agenda? I'm feeling heartbroken over this, honestly. City council almost seems to side with the developer despite uproar from the community. [link] [comments] |
