Legal Advice My boss is trying to sabotage my new job opportunity

My boss is trying to sabotage my new job opportunity

    Posted: 18 Sep 2021 03:10 AM PDT

I just got hired with another company pending a background check. I work in aircraft maintenance. My hopefully soon to be previous employer is well known around my industry as being awful to its employees especially recently, so everyone is leaving as soon as possible. Our manager is very upset about this mass exodus and is doing every he can to sabotage employee's chances at new employment since he can't just hire anyone, employees need to be certified by the FAA and are not easy to find. Our HR rep is currently on leave due to a pending legal issue with the company. When I submitted my info for a background check with my new company I put down the HR rep's info not knowing she wouldn't be with the company by the time they conducted the background check. When they called to verify my employment the call was forwarded to my manager and he said no one by that name has every worked for the company. The hiring manager with the new company told me they could not verify that I was employed by this company for the last 5 years and that they would not continue the hiring process. I told them I had W2s and paystubs to prove my employment and am currently waiting on a response. If my manager has successfully sabotaged my chances of employment with this new company what legal action could I take against him?

[Arkansas]My mom is on the vent and they are trying to get her to have them turn it off or go to a vent facility in Oklahoma.

    Posted: 18 Sep 2021 07:52 AM PDT

My mom has Medicare and has been on the vent for her allotted 90 days. She went in with COPD and Heart failure and ended up with pneumonia as well. They have been trying to get her Medicaid so that this facility all the way in Oklahoma will take her. But she never qualified. They also contacted palliative care because she wasn't doing as well a couple of weeks ago, but now she is feeling a lot better. She is very aware of everything and is "with it". Anyway, palliative care was supposed to call me and never did, instead went and talked to her alone and tried to convince her to let them turn off the vent and let her pass!!!! My mom of course told her no, she isn't done fighting!

So now they are really pushing for her to go to the other facility..where we won't really be able to make it there often since it's out of state. Medicare will only pay for 20 days there, then it's nearly $200 a day and the hospital told her she can just dip into her very small amount of savings to pay for that.

I guess I am just wondering if all of this sounds right? I'm sure the facility part is right, but dang...she worked at this same hospital for 30 years and retired from there. But I am also wondering if it was okay what the palliative care said to her as well?

I'm just confused about all of this I suppose and I hope this is the right place to post. I am also her power of attorney since she can't speak right now and I am wondering if that changes when she gets moved to Oklahoma? We are trying to be careful because her husband is a gambling addict and she does not want him getting ahold of any of her money.

    Thanks!

Threatened to report our fb/insta pages if we don’t surrender the pages

    Posted: 18 Sep 2021 12:32 PM PDT

My wife and I own a small business we run out of our home in North Carolina, it started as a way for her to sell artwork online during last year's shut down and it grew in a couple other directions. She created business facebook and instagram pages last July, and 99% of our sales are through those pages. If it's relevant, our monthly sales are between $1,000 to $1,500 a month. so, nothing large just a hobby business.

About 2 weeks ago, we received messages on both accounts within 5 minutes of each other from personal accounts asking if we could surrender our accounts or change the names because they would like to use that name for their business. We politely declined, as the name is personal to my wife. Early this past week we received another message on the FB account from the same personal account asking if they could purchase the name for $100. Again we politely declined, stating the name had sentimental value and we had no interest in starting a negotiation.

Yesterday (last night, about 10pm really) we received a message stating how we were ruining their great business idea and what happened to supporting women owned business, and then they threatened to not only review bomb our pages, but also begin reporting us to facebook and instagram for violations. At that point, we then just blocked that account on both platforms and did not respond. I have screen shots of everything.

Sure enough, this morning we received our first 1 star review on both pages, and then we received an email from facebook that the account had been reported for human trafficking.

We have no idea who this person is or where they are located. Is there any value to having our lawyer write a preemptive cease and desist to Facebook or Instagram to not have them take down our page over the false claims? Is there any legal defense that applies here so we don't lose our customer base because of some invisible person? I have no problem going back to our lawyer, but I don't want to go in wasting time throwing darts at a wall. Thanks!

When being asked on an application whether I've been convicted of a criminal offence, do I have to say yes even if it was expunged from my record?

    Posted: 18 Sep 2021 06:12 AM PDT

I'm applying to grad school where they ask me this. Got arrested for minor dui which resulted in being convicted of a gross misdemeanor. It was expunged due to good behavior 2 years after the conviction.

Not sure whether to say if I was convicted or not.

[AL] shared cash drawer was ~$60 short at the end of the night. GM informed us that we had to cover the shortage with our tips. Is that legal?

    Posted: 18 Sep 2021 10:25 AM PDT

Like the title says. I'm fairly sure it's NOT legal, but would like a specific law or statute to cover my bases.

Guy hasnt left after selling his home.

    Posted: 18 Sep 2021 12:54 AM PDT

I bought a house in AZ this month and the guy we bought it from hasnt left. I closed today and received the keypad entry for the home but wasnt given the keys because the guy insists he has til the end of the night to move all his things. I figured that if I bought the home and closed on the property and that hed be out before or right at the point I get the key pad entry.

Cut to 12:23 am when we find his stuff all over the house and he telling us hes cleaning up his house but we are telling him we have a professional cleaner coming at 6am, leave now. He says unknowing its already past 12 at night and the front door swings open. Hes still not done and its 1 am.

Is it legal to stay in a home that another person finalized payments for? What is considered overnight stay? Can i get 50 dollars for the uhaul i bought thinking i was moving today and tomorrow and not just tomorrow.

Item paid for, shipped, now invoiced for more money.

    Posted: 18 Sep 2021 04:38 AM PDT

    Hello,

I bought a bicycle in March 2021. They took payment immediately, though it was back ordered on the site I purchased it from as well as everywhere else. The bike finally became available and has been shipped, it will be here in a few days.

I bought the bike from this particular shop because it was 100$ cheaper then anywhere else but now the shop just invoiced me the 100$ saying "With the new shipment of bikes come increased MSRP pricing. Your bike cost X when you purchased it in March. The cost as delivered is now Y. The difference in price is 100, which I am invoicing you now."

The shop is in California, I am in Pennsylvania.

    Thank you.

AZ - Gas pump shot gasoline in my eye, soaked my clothes, car, phone.

    Posted: 18 Sep 2021 09:19 AM PDT

In AZ. Yesterday evening a gas pump shot gas out of the joint below the handle straight into my eye then sprayed all over myself, our car, the ground, and my phone wont charge now as it got soaked as well. Went into tell attendant who gave me a paper towel for my eye and ran back and forth panicking for about 5 minutes until I told him to call the manager and fill out an incident report. I tried to wash my eye out in the bathroom. He called someone who showed up and told him to call 911. Paramedics and fire showed up and helped me flush my eye at the scene as they have no eye wash station at the gas station. The medics suggested having the hospital continue to flush it as it was(is) still burning.

They transported me to the hospital where I sat in the er for 2 hours with my eye burning and my right side itching and burning. Soaked in gasoline. I finally went home so that I could flush my eye in the shower and get the gas soaked clothing off.

This morning my eye still burns. My vision is going in and out from blurry to cloudy also in and out of focus. Just in the right eye. It's also leaking (tearing)pretty constantly.

I need to know if I should just go to the station and talk to the manager (or whoever is there) or should I contact a lawyer to make sure that I don't say something wrong? We most certainly can't afford the ambulance/er visit (there will be a bill as they did check me in between the ambulance and the lobby).

The cashier mentioned during his idiocy that they had had issues previously in the day as well.

What should I do at this point?

Dog attacked my dog and owner won’t take responsibility

    Posted: 18 Sep 2021 01:55 PM PDT

    Hi there -

I just moved into a complex about 3 weeks Ago. Located in Orange County, California, USA. I am renting a room from someone whose lived here for a few months already. He owns a golden retriever. There is a little dog park here in our community that we take both the dogs to. I own a 14lb Chihuahua mix.

One morning I'm in there with both the dogs (my roommate is out of town). There were a total of about 5 dogs running around inside the park. I noticed the golden want to take a poop so I walk over to his end getting ready to pick it up. At the other end of the dog park, a new owner and dog were entering. Which always means all the dogs run to the fence to greet the new one, including mine.

Next thing I know I hear a scream, look over, see my little guy getting attacked and run over as quick as possible.

I picked him up as soon as the other dog, a husky, let go of him. He has a bleeding gash I could see. I immediately started to panic. Only thing I could think of was taking him to the ER immediately.

The other guy finally got his husky under control, someone else grabbed the golden and gave me his lease to grab while I carried my Chihuahua, Rocket, in my arms.

I just ran to my apartment to leave the golden and run to my car with Rocket to bring him to the ER.

Keep in mind all I'm thinking about is my dog - I figured since the other guy lived in the complex we could get it squared away. I figured wrong. Of course the complex is not liable for anything. AND they won't give me his information.

When I confronted him the first day I saw him after the attack….. he was so defensive and threatening.

Longer story short - the dog whom attacked mine - well the owner is not taking any responsibility. The bill totaled to be $3200 after my little Rocket got surgery, drain and meds. He blames my small dog for it.

So I guess. What can I do here? I haven't called the cops or animal control in hopes he would come to senses but nothing yet. Any advice would be great!

Can custom home builder video and use my home for promotional purposes without my consent?

    Posted: 18 Sep 2021 12:38 AM PDT

Hello! I live in NC (in case anyone in that jurisdiction sees this) and we are just wrapping up construction on our beautiful new custom built home. To say that this has been the worse, most abysmal experience and year of my life would be an understatement.

I won't bore you with the details of why I loathe this company and why I don't want to help them as it's not relevant here.

We technically "closed" yesterday (construction to perm loan, but haven't actually converted it yet), and we aren't physically moving in until next Friday. It is NOT builder financed and we've technically owned the land and everything since last December at the first close.

Yesterday, our construction manager told my husband that they are filming a video of our home on Thursday. I have seen their past videos and they go on YouTube, Facebook, Instagram, Vimeo, etc. These are definitely used for advertising and promotional purposes and include both external shots (that anyone from the street could get), our backyard oasis (can not see from street and would not be able to get without coming into our fenced backyard) and the interior.

Bottom line: I don't want them filming my home and using/benefiting from the photos. There is absolutely nothing in my building contract where I released rights or anything like that.

What do I do? Can I prevent them from videoing my home and posting it online?

    Non-Dental Texts From a Dentist

    Posted: 18 Sep 2021 01:17 PM PDT

    Simple, but unusual situation:

My former dentist's wife (she runs the front desk, but I don't know if she's got any kind of medical training/education) is running for local school board, I know this because I started receiving campaign ads as texts and emails from their office.

The only way they would be able to contact me that way is with info from my patient records.

I personally consider this conduct to be unethical, but is it something I can/should report? And if so, to whom?

Edit: (A bot was kind enough to remind me that I forgot to mention that I'm in North Carolina, USA)

    Mother abandoned child

    Posted: 18 Sep 2021 10:24 AM PDT

NEW MEXICO - So a woman I know has a 10 year old daughter, for Most of the child's life the fathers mother was taking care of her but now she is too old and can't. The father recently went to prison for 3rd degree murder, and attempted murder on the child's mom. They are both drug addicts and have been for all their lives. The mom (T) left her daughter with my sister, since they are close friends. She hasn't been checking in or giving my sister any money. And my sister has had her for over a month. T is out prostituting herself and getting high. Her mom and my sister have been the only ones taking care of her daughter since then. T never enrolled her daughter in school , it's almost October and school started in august. I told My sister to ask for temporary custody that way she can enroll her in school , and get food stamps for her. But the mom refused. She said she would give her power of attorney but not temporary custody. I would tell my sister to just go to court but she does drugs as well and does not have a job or her own place. The thought of calling CPS has crossed my mind but I don't know the mother's address. I also feel bad because I know how traumatizing foster care can be. My sister brought the kid over to my house the other day to give her a bath, and the kid kept begging to stay. What would you do in this situation? The grandparents on the fathers side are too old, and the grandparents on the mother's side are on drugs too. So there's really nowhere for the kid to go other than in foster care.

Neighbors Threatening Me For Parking Truck on Street

    Posted: 18 Sep 2021 12:11 PM PDT

I have an F-150 that I street park in my neighborhood since it doesn't fit in my carport.

Anywhere I park it I have gotten threats and confrontations from my neighbors. They have left notes on the car threatening to find out which house is mine to call the landlord to find a way to evict me. They have waited at their window for me to go to the truck so they can yell at me and tell me to never park near them again and if I do they will vandalize my truck or find a way to get it towed. These are 3 separate people at 3 separate instances. I just tell them it is a public street and I have no where else to park.

Is there anything I can do to prevent them from damaging my car or continuing to harass me? It is not an oversized vehicle, it is a public street with no permit required to park in California.

I will also note, my truck is clean, free of bumper stickers, free of flags, free of anything possible deemed offensive or politically charged in any way. I need my truck since I use it for work and transporting large animals. I live in a nice suburb, with the average home costing over $3m. But my apartment stands out as not being as nice as the surrounding area.

Warranty Company placed our warranty into "cancel Pending" status. Do we have legal recourse?

    Posted: 18 Sep 2021 02:25 PM PDT

My wife has a ridiculous warranty on her 2014 Jeep Cherokee through Mopar. The car is covered for almost 1,000,000 Miles until 2097. It's called the "Life-time maximum care plan."

On 8/14/21, the car began to overheat and we had it towed to the dealership work because the warranty only covers work through a dealer. On 9/1, almost 3 weeks later, we are told that the warranty has been placed on "cancel pending" status due for "fraud protection." Apparently, they did this to all of their clients as some kind of safety measure without any kind of notification. When my wife called Mopar on 9/1 they stated that they could "escalate" the reactivation of the warranty in 24-48 hrs if we provided current registration and photo ID, which we did that day. 48 hours later, on 9/3, the warranty still was not activated, at which point they told us that they had failed to escalate and said that they would "re-escalate" and that in another 24-48 hrs it would be active.

Our next call was on 9/7, and guess what, still not active. On this day, they said they needed a copy of our marriage license (her name has changed since she bought the car) and that whoever had told us 24-48 hrs was incorrect. It actually will take up to 14 business days. The 14th business day is coming up on Tuesay, 9/21. The warranty was still not active as of Friday, 9/17.

My wife paid a decent bit extra for this warranty, and we feel like none of this is our fault or justifiable on the part of Mopar. We have now been without the car for over a month. Do we have any legal recourse against Mopar? If they did this to all of their clients, are the any grounds for a class action suit?

Can my boyfriend take his son out of school for an appointment when it's not his designated time?

    Posted: 18 Sep 2021 09:37 AM PDT

Follow-up to my previous post: My boyfriend has applied for emergency custody, they go to court on Wednesday, and he has a very good lawyer helping him on short notice. He will also be taking CPS to court for negligence, per the lawyer's advice.

One of CPS's slip-ups from the previous post is that they told the mother to drug test their son when she's been accused of drugging him with THC. She ranted and raved about what a liar my boyfriend was, waited over a week and got a pee test. There are ways to beat pee tests and her long hesitation and other incriminating texts she has sent imply that she probably flushed it out of his system and obviously waited long enough for it to turn up negative. We are sure that she has done her best to cover up the truth from investigators, which is why we don't trust her results.

CPS has told us we can get him tested in my boyfriend's possession but again, because they tipped her off she has refused to hand him over for three weekends in a row. We want to do a follicle test because 1. They are very hard to beat and 2. They show up to 90 days of use. They will not help us retrieve him, claiming it's kidnapping even on his designated time and even though this drug test would be a huge piece of evidence for this case.

I was wondering if my boyfriend can schedule an appointment for his son during school hours on Monday, take him, get a follicle test as well, and drop him back off at school. From what I have read, there's nothing illegal about a custodial parent taking a child to an appointment and the school also will not interject because he's a parent. He's been talking about taking him to the doctor anyways for bruises and marks that may be occurring. My question is, would this hurt him in court, even though he has a real reason? If he tells his ex, we know she'll interfere. Can we keep this from her without intervention?

    We are in Michigan.

Neighbors fireworks exploded in my face (NY)

    Posted: 18 Sep 2021 01:53 PM PDT

Our neighbor decided to have a late season fireworks display (of out of State illegal fireworks)

They invited my wife and I to watch but since they had their entire family over, we opted to watch from our front porch so as not to barge in to their family gathering

It's doubtful our neighbors knew we were sitting on our porch watching

They were lighting them off on the street in front of their house. Large batteries of professional fireworks.

One tipped over and shot into our neighbors yard exploding on their lawn and the next shot in the battery came flying down our path and exploded in our faces. My face and I saw it coming and doc out of the way but it blew up probably 10 feet in front of us.

Ever since, I've had ringing in my left ear. Going to see a doctor about it this week because it's been 3 weeks. I was hoping it would go away

We have video evidence of the whole thing from our ring doorbell

Edit - added actual question 😂. Do I have grounds for personal injury lawsuit even if medical tests show no conclusive damage to my ear/hearing (despite ringing in left ear )

My subleasee broke $1000 worth of items in my unit, left before i came back, blocked me on all platforms. No contracts were signed, have recorded proof of conversations. denver, co

    Posted: 18 Sep 2021 12:11 PM PDT

so i live in a 1 bed apartment in denver, co, and i sublet my place out to someone i've known for a couple of years for the month of august while i did some traveling. the first red flag was me noticing she brought 3 dogs with her when she didn't ask (she also had a baby she was bringing so i thought that would be enough to keep her hands full). i asked if the dogs were staying, she responded "where else would they go?" and assured me they're old and well-behaved.

the first and second week i'm gone she tells me she and her baby are sick with something. tells me she has a fever, and they feel awful. i asked if she were vaccinated and she said "oh nooooo, i'm not doing that". i asked why, and that this could possibly be covid you're sick with if not vaccinated. she said she's read enough about it and doesn't "trust" it. she says she went to the hospital but refused medicine recommended for her and her baby by the doctor then left. asked for a pic of covid test results, she said she "threw the paper out already, but it's negative!" the third week they start to feel better.

the third week is also the week she unexpectedly tells me she needs to leave early and go back home to "make money" and not just any money, like "$20,000" ??? the way she said everything was very shady. she almost left my housekey with a "trusted friend" of hers named "blue" that i've never met. i tell my friend who lives down the street from me to pose as maintenance and go check out my apartment (run some faucets and stuff). he said he's never been more disgusted walking into a home, it felt like an episode of hoarders. there was dog piss and shit on the floor just not picked up, a babys poopy diaper sitting open-face on the counter next to some fast food. my trash can was overflowed and hasn't been emptied all month. another liner was thrown over a door as a new makeshift trashcan. there was shit unflushed in the toilet. the dogs chewed up my cabinets and coffee table. my friend couldn't believe his eyes.

i just get back in town today to see my apartment smells like a barn still. my DYSON VACCUM CLEANER is broken because i realized she VACCUMED GORILLA GLUE- yes you read that right. who the fuck does that?! i tried calling her and discussing this on the phone with her today. she laughed at the gorilla glue thing, patronized me, then when i asked if anything else was broken at my apartment she hung up on me and proceeded to block me on all platforms.

TLDR; My question is simply: How much leverage do I have over her if i try to lawyer up and take it to small claims? I didn't have her sign a contract because she was a friend. But- I have Tapeacall and recorded phone conversations with her, as well as text proof. My friend who posed as maintenance can vouch for me in court he said. But the anti-vax, and dishonesty is a big one as well. i found out about her dogs chewing my shit from an IG story, she commented how "beautiful the view was at this home depot" and i knew something bad happened if she were there. any advice is welcomed. i apologize this isn't formatted better- i drove 14 hours yesterday excited to sleep in my own bed after a month of sleeping in my car only to just sleep in my car again. thanks guys.

Edit: Googling has been cryptic as hell when it comes to finding what i have to do or what numbers to call for a small claims case.

Should I sue or get a lien?

    Posted: 18 Sep 2021 09:52 AM PDT

I invested 50k into a long time family friend's business in South Carolina that they've been running for years. They said they needed capital for inventory and we had set contracts that basically said as sections of the inventory were sold I would receive my money + interest.

We did several contracts ranging from 4k-6k for the various types of inventory, each with its own payment date. So far most of the contracts are over 3 months late, and I've only been repaid for 2 of them.

I know they own a couple of properties, and I'm wondering if I can put a lien on them, or if it'd be better to sue them directly?

My emotionally abusive mother who I have no contact with keeps trying to contact me, at what point can it legally be considered 'harassment'?

    Posted: 18 Sep 2021 08:09 AM PDT

Posting here since I live in Norway and my mother lives in England.

I cut contact with my mom almost a year ago when I moved abroad, making it very clear I didn't want anything to do with her. She continued trying to have contact with me through my dad's phone (I have contact with him still), as well as sending birthday cards to me in the mail after I asked her not to send anything to my address. She has also emailed me on an almost-monthly basis over the past year, using different email addresses. I finally gave in and made myself a new email account the other day. But I still have contact with family members who I regularly email with, and there's a good chance she could get her hands on the new one anyway.

I don't have much in the way of 'evidence' - it's not like I've been trying to build a case against my mom. Typically I would delete the emails etc. because I just wanted to forget about them. But now I realise that she isn't going to stop, and the amount of stress it's causing me having her keep trying to contact me in various ways is getting too much.

I'm just wondering what my options are here. I don't want to get her in trouble, but I have asked her multiple times and made it extremely clear that I do not want any contact with her, and she has blatantly ignored my request.

I know my situation is complicated by the fact that I live in a different country to my mom. Any advice would be truly appreciated.

    Thank you!
