My mom decided to get mad and told me to give her my phone. I was confused obviously. She came up last night, took it, and got mad that I wiped the information before she got to it. (not sure why she wanted to go through my stuff...) I spent months paying it off and they claimed it as their own. I live away from them on my own and have for months. I'm ready to cry. Not because I lost my phone but because that was the first thing I ever paid for by myself as an adult. Is there ANYTHING I can do to get my money or phone back? I don't even have my new work number or banking information anywhere. [IN] I’ve been subpoenaed and I may lose my job because of it. Posted: 28 Sep 2021 10:39 PM PDT I was on a ride along with a cop. The officer made a traffic stop, gave the driver a ticket, and the driver is now trying to fight the ticket in court. I have been subpoenaed, with the court date being set for the end of November. At my job the holiday season is our busiest time of the year, so from mid November until the end of the year my company refuses to approve any time off for any reason. I asked HR what I needed to do as far as bringing in paperwork for them, and was told I will still have to take a point for missing work. That being said, this point will be enough for me to be terminated. If I am fired over this subpoena, can I sue for wrongful termination since I have no option but to miss work for this court date that I had no control over? EDIT: for those asking, the subpoena is from the prosecutor. I am almost guaranteed to have to testify, for reasons I don't care to explain right now. Before this came up I only planned on staying with my company through the holiday season anyway, so if they do try to fire me it's not the end of the world. A safe that he had inside his apartment is missing. As his next of kin I requested to view the video footage of the security camera situated directly outside his apartment door inside of the building on the hallway ceiling. The management became very unhelpful when I requested that and said the only way to aquire the footage is through court order. Is that true? Help - car accident third party pretending they weren’t driving Posted: 29 Sep 2021 03:45 AM PDT I need help. Someone hit my car in July, I got their details and it's going through my insurance. My car is a write off and I am waiting for it to be settled. However the third party is saying that they were not driving at the time and their insurers are standing by this statement. I have shown pictures we took that have the driver in them, the piece of paper they wrote their details on (which happen to be false information). Is this ever going to be sorted?? I'm left out of a car all because this driver wants to pretend they weren't driving! Surely it's a criminal offence to not only give false information at an accident but also to lie and say you weren't driving when you were?? Can a landlord cut lines and deny access to internet/cable? [LA] Posted: 29 Sep 2021 06:35 AM PDT On mobile sorry for formatting ect. Located in Louisiana. Without any warning last night my landlord decided to cut all the internet lines running into our buildings. When we asked him about it he said "We don't want any lines anymore they're ugly" and suggested getting a hotspot. We pay for our own internet and the hardware outside has been installed for several years. The wires run from the box outside on the side of the building to both the living room and an upstairs bedroom. I understand why they would want them gone as they are a bit of an eye sore but the ones on the bottom floor could easily buried. I am an artist and have made some designs of combining popular game character designs and I have posted them online. I did not sell them myself or intend on selling them, since that would be copyright infringement towards the game developers. Recently it was brought into my attention that an online clothing store is selling T-shirts with my designs and my designs are all over their front page and shop. This is a new situation for me and I am not sure what my next steps should be. Should I first contact the store and ask them to take my designs down? The judge denied my request due to a lack of a paternity test. My ex and I finally got together and did a paternity test. Surprise surprise the child isn't mine. The judge still denied my request due to the Attorney General needs to be involved to establish support on behalf of the mother. My ex doesn't want the support due to the baby daddy being a POS and doesn't even play for his other kids. She also doesn't want him in her child's life. The Attorney General is asking why am I opening a case if I have nothing to do with the child and the mother doesn't want support. I'm not even on the Birth Certificate. In August I got an email from my HR stating I'm eligible to sign up for benefits (there was a probation period) and I replied to this email the same day asking how to sign up. She responded and told me I wasn't actually eligible to sign up because I'm still in my probation period and I must wait for September 1st. She also told me I have the entire month of September to sign up for benefits online. Fast forward to 9/27 and I tried to sign up online but the portal didn't allow me to do so. I texted my HR and she ignored me. On 9/28 I went to speak with HR and she had left early that day. Today on 9/29 I texted her again letting her know the deadline is 9/30 and asked her to help me sign up. She told me I missed the deadline and had to sign up the first week of September. I forwarded her own email explaining to me I had the whole month of September to sign up and I let her know I did not miss the deadline according to her. She responded by saying that because she sent the email in august that she meant I had the whole month of august. I forwarded her another email that she sent stating I am not eligible in august and that I have to wait for September. She told me that she contacted corporate and there's nothing that can be done. After the last incident, he called our landlord who stated if we complain to her about them she will evict us. This is illegal in the state of Oregon, but I don't know how to go forward without being evicted. "It is illegal to retaliate against a tenant by raising the rent, shutting off utilities, or trying to evict the tenant because they complained to you or a public agency about habitability conditions, discrimination or other violations of the law, or because the tenant joined or formed a tenants organization." We have pride flags, which I believe is why he so strongly hates us from the start. We haven't taken them down, and he's gotten weirder and more aggressive. Told me he has had the cops called on him before by women. I am 23f and live alone. The other day I came home and heard him screaming and banging stuff. He lives on first floor, I live on 3rd. I was super scared! Another thing he does is enter when I'm not home. He's only done this for "emergencies" (beeping smoke detector). But when I moved in, he went out of his way to let me know he's allowed to enter any time without my permission which doesn't feel great. Finally, my fridge isn't working. I live in MA. He told me most landlords here don't provide refrigerators but gave me a number to call to get it serviced, "being nice" in his own words. Anyways it's been a week. The company is a used appliance company and really mean customer service with low ratings. Besides moving out, what can I do? Turns out he was receiving SSI benefits for his three kids (all three do have disabilities) even though he definitely made/makes plenty of income. To be clear I believe he did actually qualify at some point after the first child was born (I think the oldest is 11?), but otherwise hasn't met the criteria for several years. I think SSA requested a bank statement or something and he submitted that and that's when he was exposed? So he's been contacted by SSA and owes something over $32k. He absolutely has the money to pay for this (it would have a negligible on his financial situation as I understand it), but he is saying that he's going to fight it. How do I convince him to just friggin' pay it?? Not only is he fortunate enough that this wouldn't hurt him financially, but what about potential jail time and things like that? Does anyone know what SSA will do if he continues to fight this? Is it possible he can win, he seems to think so? Pisses me off that people do this, why does anyone need this kind of stress? She has been isolating at home with our mother and other young siblings since the pandemic started due to high risk in the household. In short, everyone in the household usually interacts with few people outside the home and social media / SMS is the best medium of communication with the outside. My missing sister who we'll mention as Anna only talked with a older guy who she met at school a couple of years ago. Because of his age, my mother strictly prohibited them dating and all interactions in person (occurred very seldomnly) required supervision. This is now more the case since the boyfriend is 18. One night, she decided to pack a small bag and disappeared from home. Our mother is very strict regarding the excessive use of electronics, social media, etc. and usually puts up their phones for the night; however, she found her phone and took it. It has been turned off since and we cannot get into contact with her and her whereabouts. The boyfriend in question was believed to be the last person to speak to her over a discreet phone conversation overheard by our other sibling. A police report was filed through our local sherrifs office and they were explained the details surrounding the relationship of the two. Allegedly, the police reached out to the boyfreind to ask about the whereabouts of Anna and he asserted he had not had contact with Anna in several months despite the converstation overheard the night of her disappearance. Though the police were able to contact him via phone, he has been evading anyone attempting to reach him in person. Two days after Anna's disappearance, the boyfriend also turned off his phone and hasn't been seen according to the family. They ignored our cries for help in trying to find him (and her since we believe she might be with him) and demanded contact to be ceased surrounding the situation. While we have given the reporting officer all relevant evidence as they arise, they haven't gotten anywhere. They suggested contacting the phone carrier for call logs but they refused without a subpeona/warrant. Basically, the agency is trying to offer other resources for missing persons and runaways. The truth is, they are treating this as a runaway situation and the longer things are being dragged out, the colder the trail is getting. Our mother wishes to press charges on the boyfriend for alleged engaging in sexaul acts with a minor, possession of child pornography (she is believed to have sent him nudes) and habouring a runaway/kidnapping. After hours of phone calls, social media searches and information an estranged family member has shared, we have reason to believe that Anna and the boyfriend are either in a cabin or small apartment in a wooded area of town or have made it to a friend's house in Georgia (This friend's father could be working for the agency as well). With all this, the agency, who claims they can't assign a detective until after 20 days have passed. has not provided any moire information about the search. We've contacted the FBI who said the investigating agency has to formally request assistance before they can intervene. It has now been 11 days since Anna has been heard from. If she is truly not with the boyfriend as claimed, we have no clue where she might be or if she is safe. She has processing problems that can cause her to make irratinal decisions, have poor judgement and she also has ADHD. A city councilman has reached out after coming across a social media post, but so far nothing has happened. Therefore, what actions must be taken for this matter to be investigated instead of brushed off as a runaway. The only agency we haven't talked to is the State Attorney General's Office. Should we try to file other charges to have the police try to contact the boyfriend in person instead of over the phone. With the possiblity of her crossing state lines, shouldn't this be a federal matter now? We have a 24hr guard who will also unlock the front door, but they are not always there (I've checked the building rules and regulations documentation and it does in fact state that the guard will take breaks). My landlord will not provide a fob because they would have purchase one from the building, and they do not want to spend the money. Therefore they just say that the guard can let me in. I figured that they forgot to take the barricades away after the floods that happened the day before. When I got pulled over, the officer told me that he reduced the ticket to a non moving violation that carries no points. I called many times to pay the ticket but they said it wasn't in the system. Today, I received a court appearance notice in the mail. I called the court today and they confirmed that this isn't a mistake and I have to show up to a zoom meeting court room. It had solar panels from Sunrun installed already and we decided to take on the lease. We called Sunrun 2 weeks prior to closing. They dragged their feet, messed up the form and began to ignore our emails and calls. They actually caused our closing to delay. We had title call them and it was sorted out. We got the transfer agreement and signed it but then nothing. We didn't hear anything and couldn't log in or create an account to view our bill. We called dozens of times and finally discovered they never changed the name on the account. In fact they transferred the account back to the previous owners instead of us. We asked them to remedy this and they told us 48 hours. Then 5-7 days, then another 5-7 days. Still nothing! They actually hung up on us today when I asked to speak to our case manager. Do I have any recourse to sue to exit the contract since they aren't holding up their end of the deal? We actually don't even have a specific contract, but I know the title agency has us as the owners and the lease transfer can act as one. Any advice is helpful! This was really the only reason I bought it. Needed a cheap reliable car with low miles, and I got what I thought was a killer deal. Last week I took it in to the mechanic for a problem, and he told me that someone had definitely rolled back the odometer, showing 275K on the Odometer a few years ago. It magically changed to 130K once the last guy who owned it bought it (looked at carfax). Is there anything I can do to get some restitution? I'd really just like to get my money back for the vehicle, registration, insurance, and repairs I've made to it so far + legal fees. So a few days ago somebody reached out informing me there's a discussion on Reddit https://www.reddit.com/r/GlobalOffensive/comments/pw3f2v/comment/heeze03/ adressing a material generator I am selling for 5 dollars which was beeing used inside of a asset in the steam workshop of a pretty famous video game. The creator of the asset is making some good money out of it. People there stated stuff like this happened before and the steam terms of service prohibit this. So I was trying to read these terms of service but tbh I don't understand half of it. Also I don't know if any of this counts for this particular case. I mean, from my original point of view, I sold something for commercial purpose, so this guy can basically do whatever he wants with it. Since it could also be used in video game development and beeing sold that way. On the other hand, the fact that the guy just bought this material, changed some little things, slapped it on a gun and puts it into the workshop is very minimal effort and ofc leaves a bad taste in the mouth. Posted: 29 Sep 2021 12:50 PM PDT Hi all. I'm a lawyer but not well versed in this area. I work as a prosecutor for a county in NJ. I was fully vaccinated for covid-19 in April. At that time, I submitted proof of vaccination to my department's HR liaison to be exempt from our mandatory weekly testing. That was received because I was never asked for test results from that day forward. In August, the county announced the requirement to either be vaccinated or to submit to further weekly testing beginning mid September. It established a date by which employees needed to submit proof of vaccination. The memo says "employees who have submitted proof of a completed covid-19 vaccination prior to the date of this memorandum in lieu of participating in their departments mandatory testing do not need to resubmit this information." My dog of nearly 16 years died a couple of days before the memo was sent out so I don't think I read it as carefully as I normally would have; but, after seeing that sentence, I figured I was fine. The memo also says that if you do not submit either proof of vaccination or test results each week, you will not be permitted to come to work the next day or until the day after you submit those results, and you cannot use any PTO for that time - your pay for those days will be docked. This becomes relevant later. When the policy went into effect 2 weeks ago, I got locked out of our portal for failure to submit proof of vaccine or a negative test. I emailed our liaison and learned that there was a specific email address set up for this purpose where I was supposed to send a copy of my card. I sent a copy of my card to that address immediately after - it ended up being 2 business days after the deadline. I mentioned to our liaison the portion of the memo I quoted above, but she insisted that there was an additional separate email address at that time that I did not send a copy of it to. Looking back at that memo from April, that doesn't seem to be the case - it just says to let HR know and provide them with proof of vaccination. I got cc'ed on what I assume is a group email today informing me that because I did not submit my card to the proper email address by the deadline, my salary would be docked for one day's pay on my next paycheck. (Edit: this was a group email, I just found out another person on my team also received it and has literally identical circumstances to me). Because of the way this panned out, where I had been vaccinated all along and thought it was properly submitted, I did not miss any work at all during the pay period. They are attempting to not pay me for a day that I did report to work as a penalty. Thankfully, my boss fully has my back and after I forwarded him the email, he replied with a lot of the information above and saying that this would be ridiculous and unfair. Carmax sold me a title with a lien Posted: 28 Sep 2021 03:29 PM PDT Update 3: CarMax called me back, said that the lien release form was included in my initial paperwork packet after purchase. I can't speak to this since they were supposed to directly interface with the OK DMV to help me register. I never put my hands on this packet. They said they'd notarize their copy of the letter and overnight it to me. Update 2: I contacted the top level CarMax office and got connected with their customer relations department. Complained about this process and they said they would get back to me in 48 hours. Update: I contacted CarMax again and they transferred me a bunch. Got to the financing department and they said their title office was going to reach out to the Washington DMV to resolve this. I told the rep that this wouldn't work, as the DMV had already told me I need a lien release and there's nothing else to do. She told me that she didn't know enough and I didn't either. Asked to speak with the title office and she said I couldn't and that they'd get back to me in 5-7 business days after contacting WA DMV. smh I purchased a used vehicle from CarMax in 2017 in Oklahoma. I bought this car right out of college and it was my first car purchase. I moved to Washington state in 2018 and finally paid off my vehicle in February of this year. Today I went to a local vehicle licensing office to officially confirm that my car is mine. However, the office found that the car had a lien on it from 2014, prior to when I bought it. Lien holder is JP Morgan Chase. CarMax gave me the runaround when I called them, and told me to "partner with chase" to figure it out. Chase can't release the lien without the previous owner's information, which I don't have. Nissan Held Money For A Car Payoff While Claiming They Did Not Have It Posted: 29 Sep 2021 12:39 PM PDT I am located in GA. I have a car financed through Nissan. I had about 3.5k left on it and decided to pay it off. I went to the website got the payoff quote and paid it September 10th. The money left my wells fargo account on September 13th. When I saw nothing was updated on the website I called Nissan. I called on the 15th, 16th, and 17th. All the representatives said that Nissan did not have the money and never received the money. They created tickets for the supervisor to call me (no one ever called) and created payment investigation tickets. I also called wells fargo who told me there was no way the money could have been taken out of the account unless the vendor took it. On September 20th, I created a claim through Wells Fargo because they said they did not have the money and Nissan said they did not have the money. On September 22nd, Nissan showed that they had the money (never said when or how they got it) and the website reflected my car had been paid off. I even received an email saying the title would be sent to me. On September 23rd, the money was returned by wells fargo due to the claim I had filed. Nissan also updated the website to show I still owe that money. I was happy that my money was not gone and still owed on the car and obviously I still owe them now, but I have the money back, which is fine. I was a little frustrated with how I could never speak to a supervisor and their lack of communication. However, the main question I have is that I had also filed a complaint with the CFPB and Nissan's response to the complaint is untrue. I posted some of what they said below. "On September 20, (thes0ft) called in inquiring about their payoff not being received. NMAC advised the payoff was applied and then reversed, and provided a copy of their payment history by email." - They claimed the payment was not received and gave me a copy showing that they had credited the money back (which was not the case). "On September 21, 2021, the $3,XXX.XX payment was applied" - which doesnt make sense, how could it be applied on the 21st if they had really reversed it on the 20th?? "On September 23, 2021, NMAC received notice from (thes0ft)'s financial institution that the $3,XXX.XX payment received on September 10, 2021 was returned due to insufficient funds. Due to the insufficient funds, the payment of $3,XXX.XX applied on September 21, 2021 was reversed." - Clearly not the case as I had the money taken from my account on the 13th and then returned on the 23rd. I have the bank statements that show my account was in the positive and would not have been declined as a result of insufficient funds. The money was returned because I had to file a claim because Nissan said they had never received the money. Is there anything I can do here?
