    My friend in New Jersey came home about a week ago to find a notice of sale taped to her letterbox. Her home has been foreclosed on about a year ago. She had no idea. She has phoned an attorney who said the "creditors" filed an affidavit of service to say they have mailed the notice to her (she didn't get it), and the judge found against her all without her being aware. She doesn't have a mortgage on her house. It was all paid out years ago. This notice says she owes over $600k, but she doesn't even have a credit card.

    No one seems to be listening to her that she doesn't have any debts and that this seems to be a massive scam or fraud.

    Does anyone have any idea what she could do?

    Edited to add: she has no income and is in incredibly poor health.

    My partners landlord has been lying to her for years, what are our options?

    We are a younger (29M 28F) couple. My partner began renting the house we live in currently roughly 7-8 years ago when she first moved to the town for college. I have been living with her here for 2 years now and this will be my second winter in the house. The first year she told me the house didn't have heat and that the landlord had told her it wasn't included with the house. So all this time she has been living with no heat whatsoever in the winter and using little space heaters and etc. We live in north central Florida so it's not dangerously cold or anything but it does get miserable for a few months and has gotten so cold in our house that our fridge kept having issues because it was colder in the house than in the fridge. The first year I just kind of took her word for it and suffered through the winter with her but this second year I looked into it and it turns out florida law requires the landlord to provide heat. We are not vindictive people or anything but have always been great tenants, especially my partner. She lived alone in the house for 6ish years and has never been late on rent or caused any issues. She is a plant science major and has done thousands of dollars in landscaping around the house. I come from a former career in construction and have done small repairs around the house (new outlets/light switches, kitchen sink, sanded/painted the windowsills and etc.) We are good honest college students and feel we have been taken advantage of for years and years by the landlord. Is there any legal recourse we can take besides asking them to install/fix the heat?

    [PA]My Ex is dating a registered sex offender. Can I find out what his legal restrictions are?

    My ex started dating a lifetime registered sex offender. We have two daughters under the age of 10. My ex is trying to get 50/50 custody. My oldest told me after her last visit with her mother that my ex is planning on moving in with the sex offender. This guy just got out after more than 30 years in jail for rape. All I can find out is what's on the registry. 30 years seems like a very long sentence for rape. So I assume it was really bad.

    Can I find out what his parole and other restrictions are? Is it legal for me to dig into this?

    Neighbor's dogs killed my livestock. I want to file a small claim petition in Texas, but do not know where to start.

    Animal husbandry is the main source of income for me. I raise show quality and rare breed rabbits and exotic poultry that I intend to sell chicks from. I have other animals that are strictly pets. Sunday night, around 10:30p, I caught two large dogs on my property attempting to tear through the fence of my goat pen. It is goat fencing on the exterior with electric fencing on the interior to keep the goats from climbing the sides and getting out when penned at night. I yelled at the two dogs and ran inside to grab shoes and a flashlight. When I came back out, one dog was trying to get through a fence surrounding the open sides of my loafing barn (a horse stable-style barn with an open front and partially open sides) and the other was trying to jump over. That barn houses my senior laying hens and my herd of rabbits (approximately 80 valued at $100-350 each). My husband was threatening to shoot the dogs so I ran them off our property. IMO, the dogs are just being dogs and their owners should have kept them on their property. I began checking fencing and making sure everyone was okay when I found that they had torn open the side of one of my coops and killed my 24 exotic birds. I bought them as chicks in May (they were not cheap) and they were to begin laying in November at which point I would have sold the chicks to supplement my income. The Ayam Cemanis are valued at $150-200 each when mature and the BLRWs are typically in the $60-100 range for a mature bird depending on which farms have them available. Additionally, the coop that was destroyed was purchased pre-covid for $450 +tax and is now listed for $1163.66 (tax included). In total, damages were $3,748.66 not included the upcoming loss of income. Police came out to my home and we told them what happened, we took a ton of photos, and gave them a description of the dogs. For those wondering, I am in the process of buying a donkey to live with my animals and investing in outdoor cameras.

    Then, around 1am, the dogs came back. One was on my back porch and another was trying to get through the fence into our rabbit barn again. This time, I was able to round them up with treats and secure them both to my dog's outdoor lead that keeps him from running off when we take him outside. They matched the description I had given to the original officers and I took photos of them and their tags with the owner's contact information. The officers attempted to reach the owners, but could not so the dogs were impounded and I was told to try to settle things with the dogs' owners on my own, but if they were uncooperative I could take them to Small Claims Court.

    I reached out to the owner to explain my account of what happened, share the photos, and explain the financial hit her dogs caused my family. I told her I did not want to go to SCC and would prefer to settle things on our own. I also told her that I understood that it was a lot of money so I could work with her if she was willing to come to an agreement. I sent her links to where the items were being sold and told her she could purchase replacements from anywhere she wanted so long that it was the same coop and the birds were the same breed, sexes, and at least the age of the ones lost. I also told her that as long as she could have the birds replaced by November she could take her time on the coop. In a nutshell, she told me I was SOL and she had no money.

    So, I want to move forward with SCC, but have no idea where to start. I live in Panola County, Texas. I filed two police reports and have numerous photos, the officers saw the damage and the dogs. Please give me any advice you can!

    Brother was an assault victim, not sure where to go from here. (US - MI)

    In february, my brother was a pizza delivery driver and long story short he was assaulted by three people, they stole his car, they got caught. He is doing better but not well enough to work, he sustained a massive head injury.

    Right now he is at a loss. He's getting accident compensation through Accident Fund, but they might cut off payments. His case worker is not very much help. The prosecuter's office can't give any information because they were minors, and right now it's allegedly being handled by juvenile court but they're not giving us any time frame. The compensation is barely enough to pay rent.
    We've contacted multiple lawyers and they won't take the case or help out at all.

    Let my friend borrow my car for a job interview and they ghosted me when they said they were driving it bsck

    So I let my friend borrow my car yesterday at 10AM (Sep 28). They told me they were going to a job interview, then said they were driving it back around 7PM (Sep 29). I really thought nothing of it because this friend has several miscellaneous errands to run on a daily basis. I gave them my spare key because I need my keys to come in and out of my place. I've called and texted them since and nothing. I'm not sure what to do at this point- I have no way of tracking my car or anything. Not sure if it's appropriate to report it stolen or not. I called a 911 non emergency and they pretty much told me to fuck off. Obviously I feel stupid because I was genuinely just trying to be a good friend but it clearly bit me in the ass. Im in San Diego if that makes any difference. Edit: they didn't actually tell me to fuck off I was just too flustered and panicking at the time UPDATE: he told me he took his anti anxiety medication and passed out in my car. His other friend told me that he told her he was stranded in LA. So it's obvious he did whatever the fuck in LA and didn't tell me. His timeline does not add up so I'm done with him.     I am in an abusive relationship, I have a plan but I'm concerned I might be breaking the law

    I am an American that is married to a Korean and we had a baby together. During my pregnancy my husband started becoming abusive, he gets frustrated and hits me. He also has started to abuse my cat as well. He's also become very controlling. I live in Korea

    I've spoken to his mom about this, she told me that I need to be strong for my son and just put up with it. I also suspect she gets treated the same by his dad at home. His dad works for the police, and even if he didn't calling the police really doesn't do me any good. Korean police don't take domestic violence seriously. Also I'm scared if I try and divorce him in Korea the Korean courts will side with him and gave him custody of my son. He has also refused to go with me to the US Embassy to get my son his American passport and I cannot leave Korean without him or a letter stating I can travel with my son.

    I thought about running away to a friends place who said they will let my son and I stay with them. But I would still be stuck in Korea, and if I wanted to get a job I would need to register my address and my husband would be able to find us.

    So after talking with a friend of mine, along with my mom I have come with a plan. My husband and I have never been to America together and he knows my parents want to see their grandson. I got my husband to buy plane tickets to visit my parents for this Christmas. My husband does not speak very good English.

    The plan is we will travel to visit my family during Christmas. My dad will pick me up along with several male family members. We will then grab dinner before heading home. At the dinner we will abandon my husband and I'll take my son along with my dad and go home. What my husband does after this is his problem. He does not know where we live. My husband is not a very large man and my dad and family members are more then capable of preventing him from causing us any harm. My husband only real option will be to return to Korea.

    At which point I imagine the legal battle will start. My single biggest fear is that this will be seen as kidnapping. However if I start a legal battle in Korea I am confident I'll lose because I am not Korean, and the courts will likely side with my husband especially considering his dad is a cop, and they have resources. I can prove the abuse, his alcoholism, and the fact that Korean govt does not take domestic violence seriously in an American court far easier then a Korean court. I really don't see a way out of this unless I get my both my son and I to the states first.

    I will be traveling to Texas, so that is where my Husband will be abandoned at.

    Some thoughts I have, I do have his Korean birth certificate I am an American citizen therefore he should be an American citizen as well. I can get his SSN/Passport in America after I arrive in America. I have to prove I lived in America for 5 years which is easy considering I went to high school + college.

    My family doesn't have a lot of money, but my parents have offered to take out a mortgage on their home if we need to hire a lawyer to defend my parental rights/deal with the divorce.

    Can you be legally considered a caretaker against your will? (NC)

    My stepdad is elderly and divorced from my mom. I moved back in with him a few years ago so he wouldn't be alone, and he was largely self sufficient up until recently. Before, I'd occasionally help lift him in and out of bed since he could still slowly walk using a walker. After a fall a couple months ago, he was taken to the hospital for an injured shoulder and then taken to a nursing home.

    He left the nursing home early against medical advice. I asked him to stay for a bit longer because an employee there told me he'd need to stay in order for a physician to assign him home care through his insurance, but he called someone else and had them pick him up and bring him home.

    Ever since then, he can't really get out of bed anymore. He doesn't have the strength, so I just check on him every few hours and help him takes his meds or give him something to eat or drink. Sometimes I'll run errands for him if he needs me to, like picking up prescriptions or groceries for him.

    A few weeks ago, a social worker came over and asked him some questions alone. She already knew his name and my name. She then asked me some questions and left. She asked me if I was his caretaker and I said yes, being unaware that's a legal term and simply thought she was asking if I take care of him. She asked if I leave the house, and I said sometimes, yes, and that I was trying to find a job. She also asked if I wash him or change his diaper, and I said no, he has two nurses that come over in the morning and he pays out of pocket for them. She asked how he pays his bills and I said I don't know.

    She questioned me, asking how he'd be able to escape if the house is on fire and I'm not here. She said a caretaker is responsible for that, and questioned how I don't even know how he pays his bills. I told her if those are the requirements and obligations of a caretaker then I'm not an official caretaker, I'm just living with him and doing what I can to help. I then explained his trip to the nursing home and how he left early and how I want him to be able to get 24/7 home care through his insurance but I don't know how to do it.

    Then, Sunday evening, I went to check on him and he was asleep. I couldn't get him to take his meds and he wouldn't seem to wake up. His breathing didn't seem irregular or anything to me, but I'd gently shake him and talk to him and he wasn't being very responsive. I called an ambulance and the fire department/paramedics took him to the hospital. He's still in the hospital now, but yesterday the social worker came back and told me the fire department said they're willing to testify that I claimed to be his caretaker.

    I reiterated to her what I said last time, that I don't want to have any legal obligation or responsibility to fully take care of him on my own as I'm trying to find a job and get my life started. She said "You know we're going to court, right?" and I said "okay." She then checked his bedroom to see if anything was taken and then left.

    My concerns: Why does it seem like she's trying to establish me as his caretaker? And when she said "we're going to court," did she mean I'm going to court or she's going to court to try and put my stepdad in a nursing home? I guess I'm just confused - Am I going to get harassed or punished simply because I'm trying to make his life a little easier?

    ASSAULTED

    long story short i was beaten damn near to death by my exes family i saw their faces and heard them before i was knocked out. the attorney says the parents said they were home so it's a he said she said. the parents themselves tried jumping me prior to this. i have text messages threats and them saying how they jumped me the first time. would the attorney be able to proceed or should i just give up and move on

    [CA - Los Angeles] can we now evict people from back house?

    Roughly three years ago, my parent found a member of their church on the sidewalk with all their belongings. They'd been evicted. They took pity and offered the small back room/house on their property temporarily until they found other living arrangements and got back on their feet. The expectation then was that this would last for a few months. Obviously, that did not happen. Instead, a few months into this person's residency, they invited their sibling to move in with them (without my parent's permission) and so the situation has continued on since then.

    My parent is too soft, and so although they wanted them to move out, they never confronted the tenants or argued with them. The tenants are low income and disabled, but working with the church they earned some money, they paid a rent of roughly 300-500 per month. Some months, they would not be able to pay this rent and so my parent forgave the rent that month, in the hopes that giving them the month free would free them to look for living elsewhere (just dumb).

    This arrangement was uncomfortable but bearable before covid. But they submitted a letter saying that they would not be paying three months of rent because covid had impacted their income and then a few months ago, they linked with a tenant rights group and held a protest outside my parent's home. They accused my parents of elder abuse. They read out my parent's name and phone number on an intercom and recorded it on video. The protest was featured on the news. My parent still gets random texts and calls to stop their "abuse". My parent is older than the tenants and works hard every day to afford the home these people have invaded. We had to watch this baseless slander unfold and my parent had to hide behind the curtains the day of the protest (they had no idea wtf was happening until afterwards, they just saw a lot of people outside yelling and people wandering into the back yard). (I believe a law has since been passed against this. This is happy news, my parent feared a return.)

    My parent now finally agrees with me that these people must go. The eviction moratorium has stayed our hand, but is it finally done? Can we finally give them notice and begin the legal process? I read online something about relocation assistance and it boils my blood that we might have to give them money after the years of hosting them beyond the agreement and then their actions frightening my family with the protest and doxing.

    Workplace stating enforcing company policy on masks in illegal. (Butte County, CA)

    I recently started at a new company and they have been really bad about wearing masks and keeping distance these last few months. I reached out to HR to express my concerns and was then met with a call from VP stating they cannot enforce any mask mandates because they go off of CDC guidelines. He stated, due to going off of CDC guidelines, that it is illegal for him to take any action against individuals who break those guidelines. My question is, even though the guidelines at the company are based on CDC guidelines, couldn't the company policy be enforced still? Like, sure, the policy is BASED on CDC policy, but that doesn't mean it can't be enforced in a private organization, right? If you aren't wearing a mask and you are unvaccinated, that goes against CDC guidelines, but if it also went against company policy, couldn't that be enforced?

    A lot of anti maskers here and I just want to keep my family safe…

    [USA-NJ] Kids waiting on my property in the morning at their school bus stop. Any liability here for me?

    I live on the corner of a suburban street (4way intersection btw) in central NJ where there are no sidewalks. The town has conveniently set my corner, of the 4, up as the middle school bus stop. Being that there are no sidewalks, the kids casually stroll onto my lawn and the walkway of my home to wait instead of standing the mildly trafficked street . I've even seen them sit on the stoop and wait for the bus on really hot days since that's where the trees cover in the morning.

    Now I'm no get off my lawn grump. They're kids, it's fine, I told them once not to leave garbage and they don't so it's been ok with me.

    Problem is, about 20 minutes ago, two of them got into a fight on my grass.. luckily I'm working from home today and in the kitchen so I saw the buildup and ran outside to break it up before it got all too physical. The bus came and got them all shortly after.

    I've been thinking now about what if I wasn't here and one of these kids got serious hurt. Would/could I be held liable in any way? Could I be sued by the parents if a kid trips on the curb and loses a tooth on my walkway or falls on the stairs and breaks an ankle?

    Hello I am sorry for the stupid question...I live in London during the pandemic I loaned my sister 4k paunds but now she refuses to pay me back ,like the total IDIOT I am I didn't ask her to sign anything,(no loan agreement,no promissory note)The only" proof"I have are the numerous what's app messages where she admits that she owes me money?(in turkish language) so would any of these messages hold any power in court?Thank you

    I was sent a cease a desist letter from someone I haven’t spoken to in nearly 4 years.

    I live in Illinois. This person is an immigrant, who I and my roommate invited into our apartment after an abusive situation with his own roommates. He soon moved out and blocked me on all social media accounts and proceeded to tell people I do sex work, which I do not. I made one post (back in 2019) to disregard this information if he came to anyone about it. I have kept this post up and never received request to take it down. His mother reached out on Instagram and video called me endlessly until I picked up. Proceeded to yell over me and didn't let me get a word in. Said I harassed her son during 2019 when there was a war in his region and he couldn't contact her which motivated me to further my abuse (he moved out of our apartment in 2018) and have been harassing him for years even after he changed his number (I didn't and again I have not spoken to him in years)

    Today a lawyer reached out on Instagram to send me a copy of the cease and desist letter (though I should note it does not have my real legal name, it uses my old Facebook name which is not my legal name) detailing everything above and asked me to stop and delete any posts (I have privated them. I don't want them to follow with a lawsuit and try to claim that I tried to destroy the evidence) and to cut contact with the "victim" and his mother entirely (again i have not spoke to him in years and his mother was the one who reached out to harass me) I did not respond nor give notice that I had opened the message.

    What can I do about this? I know cease and desist letters don't legally require a response but I also know a lawsuit could follow if there is none, and I am counting on them to do so. I cannot afford a lawyer.

    (CA) How to sue my neighbors?

    My neighbor hit my car in the middle of the night ( he was being reckless) and totaled my car. The kid was 17 but I believe his aunt (not sure) said she will take responsibility as she was responsible for him. Cop showed up but had to leave abruptly due to emergency. I think he gave them a ticket.

    She first gave me a check about a week or two after they hit my car but it bounced and left me with a check return fee. She said she would ask her husband and bank. About another week later I asked for an update and she said that she was still trying to figure it out.

    Now I'm about a month in and her last excuse was she needed to split the checks because the first one was too big and that she would pay me cash for the rest. That was about 4 days ago. 3 days ago I asked if we could meet up but she ignored me.

    Now I'm here. How should I go about suing the people I need to sue? Please let me know if you need more information.

    Got taken by a Fly-By-Night Asphalt company, making sure I'm doing all this right. (Oh)

    So last week the wife and I were leaving for an appointment when a man in a Hi-Vis approached us about having our driveway re-paved. This begins the "Ignore all the red flags" event of my lifetime.

    Said he had a bunch of left over hot-mix that would just go to waste and would give us a great deal. Said they'd been in business for a long time, etc. Classic Irish Traveller scam, now I know this, but at the time we were caught off-guard. We agreed to a price to grade, level, and install asphalt to the garage. Left for the appointment and came back to find they'd already started work. Kept telling us they'd give us invoice and warranty in a minute, then evolved to "We'll e-mail that in the morning". Work was completed at dusk, and to their credit it looked decent. They did not go all the way to the garage, but they knocked a bit off because of that.

    Went to make a check out to the company, but they wanted it to an individual instead. Ignored that red flag. Kept asking for business cards, a yard sign to advertise their great work, to only get brushed off. Ignored that one too. Woke up the next morning to find that by looking at it in full light changed our outlook.

    Several humps had developed, there were drainage issues, low spots, spots where a "chunk" was missing, etc. Started googling, and found a whole bunch of warnings about similar scams, we felt immensely duped, and cancelled the check post haste.

    So my question(s), all you fine NAL's and "attorney but not yours" of /r/legaladvice, is what should I expect my next steps to be? They should be figuring out soon that the check will come back stopped, what kind of retaliation can I expect? Just mainly, what should a person do in my situation? I don't really feel comfortable having them back on my property at all, so offering them an opportunity to fix it before I release payment - to an actual business name, and only after proof of bond and contractor's license, wouldn't be my favorite option. I mean, at this point, I'm only out the future cost of having someone rip that crap out and replace it with gravel. I'd like to keep it that way if possible. Thank you all in advance.

    Hospital bill stays the same no matter what I pay or who I talk to you

    I started a payment plan in February that should've ended last month on a hospital bill. It was a 6 month plan , however after sending me to collections in July due to an "error with their system" and they told me I still owed the same amount as I started start and that the original amount I saw I owed was wrong. I've now paid twice that amount and I check my account with them and it's back to the "wrong" original amount and all of the payments I've made have disappeared. I have no idea where to even start on getting my money back, I'm certain at this point I had paid it off and the original amount was correct. I left them a voicemail earlier at the billing department detailing what's going on and requesting to meet with someone in person so I can collect documents from them showing what I owe and my payments I've made and the remaining balance.

    I have no idea what other steps I should take but I am 100% certain this bill is paid off and they still keep charging me. I want the money they're over charging me back and I want them to credit what I've paid onto the account because it's nearly twice what it says I owed( basically they owe me what I originally owed them)

    How does one go about getting a lawyer with experience in a niche sector if you don't have connections to anyone in the biz?

    I'm looking for a lawyer with experience in a fairly small corner of the medical malpractice world. The contracting involved mandates arbitration only and an NDA, so I can't just search for similar cases online.

    I just don't know where to start. The local Bar Association will just refer me to whoever is next up that lists malpractice in their repertoire. Any suggestions

    Landlord has left heater broken for past 3 weeks

    I live in PA. I rent a 2 bedroom apartment that's the second floor of a house.

    3 weeks ago 2 guys from the gas company knocked on my door to let me know they were turning off the gas to do maintenance on the meters on the side of the house. They told me it wouldn't take long and they'd come relight my heater when they were done.

    They knocked and i let them up into the attic, where the heater is. Not even a minute later one of them asks if i can go up and talk to his coworker about my heater. I said ok and went up.

    He pointed to the part of the duct near the wall where it was busted and drooping. Under the break in the duct is a pile of straw big enough to make a bail of hay with. He said there's a big rodent living in it. He told me we can't use our heat until the LL fixes it because it will likely catch on fire.

    Right away i text LL with a picture and what i was told by the gas company. He said he would be out to fix it within a week and would call me the day before. That was 3 weeks ago and i haven't heard another word. Its in the 40s at night now and i have 2 toddlers, so not ok.

    What should my steps be? I already bought 2 space heaters and we aren't too uncomfortable. But its getting colder and I have nowhere to stay with my kids besides here. I've been looking to move for awhile because he has been a problem LL, but no luck finding anything yet. Also, I'm not ready financially to move, but trying everything i can to somehow make it work.

    Any suggestions would be appreciated, thanks!

    refinance issues

    My husband and I purchase a second home last year. we only put the loan under his name because he has better credit than me. we have the investment house and our primary house (New) we try to refinance the investment property to lower the interest and take money to add a pool to our primary home. he had some issues with one guy from work who happen to be the hr/supervisor from his department and when request the verification of previous employment he lie and says he only worked commission but I have my husband's w2 form where it shows his hr and commission. and this person refuses to give any other information. so at the time of closing our refinance process was denied and I lost the appraisal fee I had pay already. so now I'm trying again and the same issue is happening with my husband's previous employment he refuses this time to provide any information. I know they could refuse and they are not legally obligated to provide any information. But I have my Husband's w2 forms from his previous employment is that enough? he does have a job and his present job did approve his employment verification so the issue is if I could just refinance with the w2 form from his previous employment? without the verification letter?
