Posted: 19 Sep 2021 08:28 AM PDT Starting to really love living here. We live in New Jersey. About twice a month our hallway fire alarms go off repeatedly. So like, they'll start going off, beep for five straight minutes and then silence, then go off again 30 minutes to an hour later. Rinse and repeat for several hours until disgruntled tenants remove the smoke detectors from the common areas or maintenance comes to do whatever. This has been happening twice a month since February before we moved in. According to other tenants, his had been common for at least 3+ years. So this morning at 4 am it started and woke us up. At 4 am my husband finally lost it and called the fire department. They responded almost immediately and couldn't get maintenance on the phone, so they busted into the basement under our wing of the complex to check the fire panel. Apparently sheet rock was falling from the ceiling and the panel itself was water logged and completely faulty and a fire hazard in and of itself. Horrified, the fire department spammed the emergency maintenance line until someone answered and demanded they come out to remedy this. My husband is actually the fire inspector of a nearby town and talked with them for a while. They're fining the apartment complex and giving them a short window of time before they fine again. They also cited them for extreme, condemn level conditions in some of the common areas and basements. Later today we got a call from the front office stating that they knew we called. And because we didn't wait to call the office when they were going to be open on Monday, and called the fire department instead, they are requiring us to pay these fines via check to the owner of the complex directly or we risk eviction. I think I know the answer to whether or not this is legal. But where to I begin here and what kind of lawyer should I contact? Should I reach back out to the fire department to let them know we've been demanded to pay these fines? Thank you. [link] [comments] |

Downstairs neighbor submits 311 noise complaints almost daily (NY) Posted: 18 Sep 2021 09:24 PM PDT We moved into a large pre war building a few years ago with our very young baby. Our downstairs neighbor began complaining about our noise since even before our child learned to walk. The previous tenant in our apt was a single elderly person for 30+ yrs (in a large 2BR). We bought extra rugs, put 1/4 in padding under the rugs, don't allow shoes in the house, took away wooden toys from our child, but the neighbor just kept complaining. The landlord checked our rugs a few times and confirmed they meet the 80% stipulated on our lease. Fast forward a year and the neighbor has been making 311 noise complaints of "banging and pounding" almost daily, sometimes 2-3x a day. The complaints are always during the day and always have to do with our child running around and/or playing. She has called at least 200x, cops have probably come a dozen times, always apologize for coming and tell us we are not doing anything wrong, no citations, no warnings, etc. They always talk to her and she cries them how awful it is and they basically tell her they can't do anything. Anyway, because we live in a rent stabilized, she sued the landlord in housing court, saying that them not doing enough to abate the noise constitutes harassment. She lost the case and the judge basically said she just doesn't like living underneath a toddler and that actions have clearly been taken to try to mitigate the noise. I don't believe the landlord will try to evict her for being a nuisance. Now, she keeps making the 311 noise complaints and it's just a matter of time before the police come to my home again. I'm annoyed and embarrassed to have cops coming to my home every weekend, whenever we have guests, playdates etc. Besides the inconvenience, it becomes this whole thing where it's a topic we have to talk about whenever we see those friends/family members, neighbors on our floor wondering what is going on, and also it just gives me anxiety (she called them again?!?!!!) Do I have any legal recourse here? To get her to stop sending the police to my home for frivolous reasons during they day? Can I file a criminal complaint? Restraining order? Especially given that she lost the lawsuit already. I am totally confident this is not a scam. Sorry if this isn't the right place to post this, but idk where to start so I started here. My friend traveled to Alaska to visit family, and ended up having all of her things stolen from her. Her purse, which contained her driver's license, debit card, and many other important personal effects was stolen from her by a person she knows. They are demanding money for it back, but they are probably untrustworthy. Her primary phone was stolen by a different person, and there is no way to get it back. It's gone. All she has left is her old phone which barely works, and is highly unreliable. This is her only means of communication with me. Her family are all either untrustworthy or can't be contacted, so I'm pretty much the only person she's got and I'm thousands of miles away. She is adamant that she is going to bring her mom with her. Her mom is living in a homeless shelter and has a state ID, but it may have been lost. She is going to check on her and look into that. She had bought plane tickets home for both herself and her mom, but she had to get them refunded for vouchers from the airline. She is now having trouble accessing the vouchers on the airline's website. She's been basically couch surfing and living off of whatever food and drink she can get. She sounds malnourished and stressed. It is difficult for her to keep her things safe because the people she stays with are likely to steal her stuff when she gets it. She had her bank mail her a new debit card, but it's been sent to her home address back here. It is possible to get a replacement driver's license mailed to her as well, but for both things she would need a place to have them mailed. She likely can't trust anyone to use their mailbox. A PO Box is out of the question because that requires an ID to rent. I'm thousands of miles away in the lower 48, and I can't go there to get her. I'm at a loss on what to do, I would greatly appreciate any ideas or advice on how to help her. Don't want to go into all the drama for the reasons for me having to leave other than She got arrested for felony domestic violence towards me. Yeah, I know, real Jerry Springer stuff. When I left she got with another man and about 10 days later she was pregnant. The other mans DNA test came up negative, he left her a long time ago and the baby looks just like me. I keep reading over the laws and I can't find a definitive answer. As far as I'm aware, nobody signed the birth certificate. She hid his birth from me and he's probably 3 months old now I'd guess. I moved 2 hours away and she has a NCO so she can't talk to me. What are my rights as a potential father? Are there certain stipulations? A time frame to where I have to petition that I am the father? Do I have to drive to her jurisdiction to take a DNA test? It just hurts my heart not to be able to see my son as a toddler. Basically, I saw a dog come from this house on the side of the state highway going full sprint, took me a second to realize this dog isn't going to stop, I tried to slow down but knew I wouldn't make it. US (VA) - therapist didn't report to court Posted: 19 Sep 2021 09:11 AM PDT I have been in therapy since April because of a suicidal threat. When I first hired my therapist he agreed he would report to the court as to my progress on our next trial date. I gave him all contact info for my attorney and the guardian ad litem in the case, and asked him multiple times to talk to them. Not only did he not communicate with them, he also failed to write the mandatory report that I needed to get custody of my kids back. The attorneys subpoenaed him and the judge issued a failure to appear. He will not release my records to me, will not provide me with a report, and will not return my phone calls. Do I have any recourse here? Our trial was continued and I have lost another month with my kids, not to mention child support I owe and time I've missed from work. All professional parties involved are shocked by his behavior. My trust in him is completely broken and to make matters worse, my ex has agreed to discuss settling out of court, he just wants the facts from the counselor. [link] [comments] |

However, I sent my info to the social security office, and have my new SS card that shows my new name. As the title says, despite being unable to get the new ID card, can I legally use my last name for everything, including legal documents? When there are no customers, my coworkers and I will occasionally vent about our bosses and some of their neglectful (and sometimes shady) business practices. We (boss and I) recently were discussing scheduling issues and they kept trying to pry into my personal reasons for taking days off. Then they became combatitive and started accusing me of being secretive and mentioned things I said in private to my coworkers. I thought it was suspicious, but didn't think much of it until a work colleague (from another business) pointed out to me that the new camera has a microphone installed and that they have been recording our conversations in secret without our consent. They (colleague) personally witnessed the audio recording because one of our bosses showed off the system to them. I know I was wrong to talk about them, but this makes me feel violated and don't know what to do. I've noticed I've been scheduled less and another coworker is off the schedule completely. My family and I are on annual lease that ends in December, and we've lived in an apartment for over 4 years. We received a notice Late-August the rent is going up by $500 by October. They are asking us to sign a new lease agreement by the end of the month. We live solely off my income and also we live in a Low-Income community but I make a little too much for us to qualify for assistance, therefore, we are paying the full market value. Some things to note, the complex was built in the 1980s, and my family and I are rather good tenants, never defaulted on a payment, no loud music, no drugs, no destruction of property, no criminal history. The only official complaints we have had against us are the one time we had a bicycle on the balcony and another for drying my kids' swimsuit on the balcony. I need to know, does my management have to honor our contract until December, when our lease ends? Is my rental agreement protected under AB-1482 or 1947.12 of the Civil Code for the time being? As an homage to Charlie Brown, my husband & I thought it would be cute to dress up like the peanuts gang (their Halloween costumes) from It's The Great Pumpkin, Charlie Brown - complete with handing out rocks to trick-or-treaters. Specifically, handing out geodes. How do we do this safely (and legally)? I was thinking of placing each geode in a clear bag with a sticker that says something like "Not Food! Break me open!" We don't get many trick-or-treaters in our neighborhood, and very few under the age of 7 or 8, but what other things could we do to prevent liability if a kid tries to eat a rock? I applied for Texas State Technical College and decided to go for Business Management Technologies. Everything went smoothly until well, it came to disperse my loans and aid. I just moved from Washington so of course I am paying out of state tuition for a year. I only had about 280 dollars left after everything to use for textbooks. I was okay with that. Now, apparently, my address on file was a previous Texas address with my old city and state. I would never enter it like that. I just moved to Texas when I applied and I can never imagine putting it in that way. I immediately caught it after signed a form and requested for it to be changed. Apparently, the card they send out with the funds (I guess to further gatekeep it, idk) went to this mixed up address. I fixed this before I applied and did my student ID (which also never got processed). All the while, I am trying to contact the school and figure out what is going on. I get different numbers and emails all giving me other people's numbers and emails which no leg way and no response. My enrollment coach has been very insensitive about the matter and completely does not read the email. I was explaining to her the situation and all she was doing was giving me instructions how to activate the card in which I don't have and display the amount of my FA. I finally get through to someone on the phone and they just used the funds that they still had to purchase a couple of classes except for one. That one I had to pay out of pocket until I got my FA. Okay... Whatever. By then, I am locked out of that course and I can't even do anything with that course because all the assignments are there. After a certain amount of days this class freezes your account and you just can not do exams or modules. Cool. I sent an email asking what I can do to withdrawal from the school at this point because... WOW. I'll get a cold response Monday, I am sure. Anyone had a similar experience with a college like this? And if I do pull out what do I expect? what can be done legally? Ill provide more updates as this grows but I read on their site in very poor grammar that I would have to pay fees but I could not understand exactly what because it was so poorly written. In my research for this book I have done interviews with many family and friends of the missing, and retired police officers/private investigators who previously worked on the case. I have even had an extensive number of files shared with me by the private investigator. In my research I have now uncovered names of people who have had various accusations put against them, or were investigated by the police, for either killing and kidnapping the missing, or possibly knowing what has happened. In all of these cases they were not charged with any wrongdoing and if they are still alive I have reached out to them for comment (and as expected, been ignored). Let's take the example of "Jane Doe was at the location where John Doe disappeared, and his parents believe she was not truthful in her police testimony." Question 1: where would I stand legally, if I were to name this Jane Doe, while emphasising that those views are of those of those who I interviewed, and said Jane Doe has never been found guilty of any wrongdoing? Question 2: do I need to stick strictly to the facts "the parents stated in my interview that they believe Jane Doe wasn't truthful"? ie would comments such as "she had a reputation for getting into trouble in the community" be overstepping into speculation? Question 3: would I be wiser to only give initials and not names? Question 4: would it make any difference if said Jane Doe was a minor (say 17) at the time but is now of course a lot older? This disappearance is in the US and I am in the UK if that makes any difference. I want to break this case as wide-open as I can in my limited capacity, but also keep my ass from getting sued. Posted: 19 Sep 2021 11:52 AM PDT Is there legal grounds to sue for retaliating or for wrongful termination in California if i was fired for writing a letter to the owner and talking to him about a person that spread covid and lied about being vaccinated. I was a bartender working 4-5 shifts a week. The bar I was working at has about 15-20 people on staff and is located in San Francisco. The staff was concerned about the Barback asking other barbacks for fake vaccine cards while claiming medical exemption despite not actually having a medical exemption. Owner called a an all staff meeting and slammed me over it. He verbally belittled everyone and threatened everyone's jobs because of our concern. Due to covid and needing the job no one quit. He fired me by text the next day after my shit saying "the wounds i caused were too deep to heal"... My significant other is the bar manager and hes been sending suggestive texts to her and the staff saying theyd hate to lose her but would understand id she couldn't take the pressure and quit. She has a contract with him for profit sharing through till next March. Any suggestions, should I seek legal council? I've already applied for unemployment and have part time work for another week. From my understanding, I have not acquired any unlawful presence up to my 18th birthday. I had DACA at 17 and currently still have it now (I'm 25). There was a short 2 week period I was not under DACA in between expiration and renewal but all in all I should not qualify for the 3 or 10 year bar if I were to up and leave without advance parole which would allow me to return lawfully. I'm planning to return as an international PhD student and eventually work my way to residency…. Is there a flaw in this ? I feel like I'm idealizing this plan way too much. I'm aware there's the whole reconciliation bill & immigration but I'm honestly tired of politics dangling the carrot in front of me. I'm planning to do this if this bill fails. The apartment is 625 sqft. I have had the same tenant since I bought the house and I originally lived in the house side. The guy will have been with me for 8 years in January and NEVER calls me with a problem, never has friends over, never causes trouble, and pays rent on time. I have not raised his rent one single time because he gives me zero problems. I could get $400/mo more for his unit right now and have it rented within a week but I'm not greedy. The tenants in the other unit called me to tell me that water is backing up out of the downstairs shower. I called a rooter. He came and did his thing, and asked if I could flush the toilet in the other unit to make sure there wasn't a clog there, too. I called my tenant who wasn't home (I speak to him once a year when his lease is due) and asked if I could go in, it was very important and I explained the situation, he reluctantly said I could go in with my own key. Currently my sister is letting our uncle live in the house and our cousins to live in a camper in the yard. There is no rent being paid to us or a lease of any kind. The house is paid off so only the property taxes have to be paid once a year. I want to sell the property but my sister does not. We do not have a good relationship and I've tried multiple times to speak with her about it but she will not agree to sell it. What options do I have? Uninsured will be offered free testing and follow up care will be managed through our financial assistance and charity program…" I'm being billed $230 for the non-rapid COVID test, that was suppose to be free. The bill I received says if I don't pay within 30 days, they're going to send my information to a collections agency. I left a voicemail with the number listed on my bill but I never received a call back. It's incredibly deceiving that they're advertising their testing as 'free' then billing you for it. Driveway encroaching on neighbors property Posted: 19 Sep 2021 08:17 AM PDT Hey all, seeking some guidance here. Yesterday we got this demand letter from our next door neighbors lawyer concerning a bit of our driveway that encroaches on their property. There was no attached survey and we had to dig ours out to confirm this. Some back story, Basically we have been living here for now almost 2 years at this point and up until recently have had 0 interaction with the neighbors next door. They never introduced themselves nor have said anything to us. We have no idea who lives in the house as it appears to be like 5 or 6 different people. Well recently they had their driveway redone and I believe this is where the underlying reason for pettiness comes into play. Ultimately the entire day they had their driveway being redone, the cement truck was blocking my entire driveway. I work from home but my wife does not. I asked what I perceived to be the foreman to move the truck as my wife was expected to be back soon and the truck was moved. Overall I asked in a nice way and it was moved timely. About a week later they were having some follow up work being done with one of those steamroller trucks and once again my driveway was being almost completely blocked again by this vehicle as I was coming home to park. That day was a very stressful day at work, It was like 730 at night at that point and I was pretty annoyed that now my driveway was being blocked a 2nd time. In hindsight I agree I could have been a bit nicer about the situation. I asked the guy doing the workin a nice tone "if it was customary for when work is being done on someone's house to block their neighbors driveway" and the guy let out an exhausted "wow". This was rather annoying as there he was, blocking my driveway so I responding saying "what do you mean wow, you're blocking my driveway" guy says he's just trying to help out a friend (next door neighbor) and I tell him "I understand but you don't have to block someone's driveway to do it." Then walked away. Then over a week later I get confronted by one of the occupants asking me if I had a problem with them making their house (that they own and don't rent) look nice and telling me that if I had a problem with anything, that I should have called him. He came over in a pretty hostile manner so it put me in defense mode. I told him "I've been living here almost 2 years and have no clue who lives in your home, much less who to contact" the guy walked off then now a month later we got the demand letter. There's no disputing the encroachment however this was something that was done prior to us buying the house. Truth be told, until we dug our survey out, we had no idea.
