I was sexually assaulted, the assailant was still on my property when the police arrived, & he was arrested. The police took me to the station and asked me to give them my phone. I thought that was a ridiculous request, so I said no. They got a search warrant and took my phone the next day for 24 hours. How were the police able to get a search warrant for the victims cell phone? They also wanted me to come back to the station so they could interrogate me again, I politely declined. I'm going to start a job in fast food, probably for minimum wage, and my parents have made it clear that they're going to try to force me to tithe 10% of my earnings to my church. I'm not religious, and even if I was, want nothing to do with giving up 10% of the money that I earned to anyone. I already know that I can't own personal property until I'm 18, but is there any information you can give me on whether earned wages are different? When I originally signed my lease, my landlord had a realtor managing his rent collection and maintenance for the building. In the middle of my lease, I was notified by both the realtor and my landlord that my landlord had re-purchased the managing rights for the building and that all rent payments/maintenance requests should go to him from now on. Cut to last month when I get an email from my landlord saying he's not renewing anyone's leases AND that the realtor never transferred over the last month's rent/deposits over to him for any of the tenants, and that he's been "trying to get in contact" with them via email for months and hasn't heard anything. He tells all of the tenants in the building to call the realtor and ask where our money is because apparently he's getting no where, but as soon as I call the realtor, they tell me he's lying and that what he's saying isn't true. Some more emails go back and forth between my landlord and the realtor (with all the tenants cc'd) and the realtor sends out a legal notice saying that on my lease, my landlord is the listed person I'm in contract with during my lease, and that it's his obligation to pay us the money and that they gave it to him as a legal requirement of him buying back the rights to manage the property himself. During this time, I secure a new place to live and make plans to move out. August is my last month and now he's demanding that I'm responsible for this months rent because he doesn't have the money, and that I need to get into contact with the realtor to get it back or I'm on the hook for it AND won't get my deposit back. I have a strong feeling that this isn't legal but NO idea what to do. It's a large chunk of money for me and I don't know if I have the money to retain a lawyer over something like this. Backyard church has been using part of dad's property for years, do we have any claim to it? Posted: 05 Aug 2021 10:50 AM PDT My dad purchased his house about 5 years ago, in 2016. He has a size-able piece of property, and it is located on a triangle shaped area surrounded by three roads. In his backyard, there is a church, to the right of the house is the church's community building, and to the left is the pastor's house. The previous owner of the home was not associated with the church at all, nor is my father. He has developed a good relationship with the pastor of the church since he moved in, and hasn't had any major issues with them. My dad owns a small construction business, and has plans to tear down the small, dilapidated shed that lies to the left of the house. The shed has a driveway leading up to it. His plan is to replace the shed with a larger garage that he can better run his business out of, and expand the driveway so there is more parking for his work truck and trailers. As he mapped out his plans, he looked at the property lines to make sure he did not do anything on the church's property. When he looked closer into it, he discovered that a decent amount of property that we assumed belonged to the church, actually falls within his property lines. This includes a sidewalk leading from the church to the community building, a pavilion that they use for small events, as well as a small portion of their parking lot. He found the property lines mapped out on the original documents he received when purchasing the house, and the same lines are outlined on our county's "Property Viewer" website. When I look at the house on Google Maps, the same lines appear, placing the property used by the church on my dad's land. We hadn't brought this up to the church until today. My dad is starting to expand the driveway, and the first step of his process is building a retaining wall next to it, on the edge of his property. He was out today clearing a flower bush and other stuff, when a member of the church's board came out and said that the bush was theirs, and they kept up with it, and just kinda questioned what he was doing. He explained his intentions, and showed the man the photo of the property lines. Nothing else has happened since this, but how should he proceed? I feel as though having the parking lot and pavilion on his property may present a liability issue, if someone were to get hurt would that fall back on my dad somehow? And, even though they use it and assume it belongs to them, is my dad still the one paying property taxes on it? Do squatters laws play any part in this since they have maintained the land thus far? I woke up at 1 am last night to the door opening and some guy walking into my hotel room carrying nothing but a trash bag. I tried asking him who he was and what he was doing there, but he only spoke Spanish and kept gesturing to the other bed in the room. He didn't seem like a threat, so I just wrapped the covers around me, got up, and started gesturing and ushering him out of the room. He looked confused, but complied and left. I got dressed and went down to the front desk and explained what had happened. According to them, they had asked the guy what his room number was and he told them my room number, so they issued him a key card for it (without checking for ID, presumably) and they blame the language barrier for the miscommunication. Earlier this week, I needed a new key card and they didn't ID me, but I just kinda brushed it off as them recognizing me since I've been staying here a while. Well, they offered to comp me for the night, but I'm planning on going to talk to the manager today, and I want to know what sort of legal ground I can stand on to try to negotiate cancelling and refunding the rest of my reservation so I can go to another hotel, at least. Posted: 05 Aug 2021 01:51 PM PDT I witnessed an incident earlier this year when I was working in Maryland and had to identify the individual involved from a lineup. I was told by the police that the evidence was pretty irrefutable and that a plea deal would most likely follow. I finished my job in Maryland and now live in California. I suppose the defendant elected to go to trial because I just received a subpoena to testify in his trial. Is it on me financially to bring myself from California to Maryland and back, lodge myself in a tourist city in the peak of the summer, and eat lost wages from work? Or does the DA pay for some/all of that? I've been trying to get in contact with the DA for a good week now and I either get an answering machine or a secretary. I also have my termination letter along with my final check, a letter from bank of america stating my 401k account is closed, and a letter from my health insurance provider stating all my benefits have ended. Her boyfriend was in jail for the same reason when she gave birth but has just been released. I do not believe that the baby is safe with her or her boyfriend. I was told that she keeps leaving through the window to get high and that her child is suffering from withdrawals. I was also told that she well not be able to leave with her baby due to him being born addicted to heroine but her boyfriend is allowed to take him home. They live in same house, I do not understand how this is better? He posted a picture of himself holding his son and you can see how swollen his hands are and the track marks on his arm. The baby is absolutely beautiful and perfect in every way and should be in the care of people who actually have the ability to love and nurture him. What will the hospital/CPS/police do about this? Landlord saying we “forfeit” our security deposit Posted: 05 Aug 2021 08:33 AM PDT We are breaking our lease and understand that under our lease we have to pay a liquidated damages amount of two months rent. We have no objection to that. However we had also paid a security deposit. The lease doesn't say anything about "forfeiting" the security deposit for breaking the lease early However the landlord keeps saying that we forfeit that and owe the LD amount. But then I'm the next sentence says it will "go toward" the liquidated damages amount. I asked for clarification on how she was using the word forfeiture. Bc my understanding is that term would mean we lose the security deposit altogether (they keep) and also pay the LD amount. I also asked that she send me where in the lease it says we "forfeit" that. I made clear we do NOT agree to forfeiting it but would agree to it being deducted from the LD we owe. She just repeated the exact same thing. Saying we forfeit the security deposit and it goes toward LD. I don't want to get bogged down in something if I'm misinterpreting but I didn't want to agree to forfeiting the security deposit under my understanding of the word forfeit. But does it sound like she is using that term to mean we just don't receive a check from them and it gets credited towards the LD? I hope that is what she is saying. But I'm hung up on her choice of the word "forfeit ". Should I keep asking her to clarify ? No way do they get to keep BOTH. The security deposit and LD but maybe I'm making a mountain of A mole hill if she clearly is just meaning something else. [NJ] Car dealer crashed my car Posted: 05 Aug 2021 01:23 PM PDT I left my car at a dealership to have minor service and recall work done. The dealer calls me a few days later telling me that my car was done, however an accident occurred where an employee hit my car with their personal vehicle while leaving work. The dealership implied they would be resolving the issue and stringed me along for a few weeks while they arranged for the body shop to do the work. After many calls and visits after them not calling me back, they finally started saying that I would need to file a claim against the individual employee who crashed their personal vehicle into mine while it was on the dealer's lot. They refused to provide a loaner car saying that was the insurance company's responsibility to arrange. The service manager basically implied that while the accident occurred on their lot, it is not their responsibility and I would need to work with the individual employee to resolve the issue. Do I have grounds to sue the dealership for the cost of repairs and costs of a rental car? Is this damage the dealer's responsibility since the car was in their possession when they damaged it or is it the responsibility of the individual employee? edit: I'm also concerned about the resale value of the vehicle being diminished due to an accident on the record if it goes through insurance. Posted: 05 Aug 2021 12:30 AM PDT Did I mention it was during a procedure to extract broken tip of dental drill from previous root canal? Honestly the entire experience has been a nightmare. Happened in Texas . I'm a 43 yr old Army veteran with neuropathy in my back and legs from a terrible.back surgery and a lifetime of treating my body like a 2nd hand took box... but this was the most painful thing I've ever experienced. I never knew what a'10' on the pain scale felt like until this. Went in for a root canal and was told 2 hrs into a very painful and stressful experience that the drill tip they were using had broken and that the bit was still lodged into my gums. And this is after they finished the procedure. I was told that they'd have to go back in and start over and undo everything they'd done to this point. I was in so much discomfort and pain plus I had to leave to pick up.my daughter from school soon...had no time to do it then and was told that I probably would never know it was there and if it bothered me to come back and they'd deal w it then. Well, about 3 weeks later the pain began. And got worse and worse. I called, made the appointment, and after a prolonged exam and way too much hedging and hand wringing the dentist admitted that it was the bit that had infected the surrounding tissue. Now FF to the extraction date and it was at the end of the day, after hours and from jump I could tell he was NOT happy about having to do this. No hello . No "how are you feeling ". No pre shot numbing of injection site as he always had done before. Just GO. The shots were brutal and his technique was rough and rushed. But we got started. About an hour and a half in and they can't get to it. They take several sets of x-rays throughout the proceedure but towards the end they take me to the back to do another xray. Only this one took a full 360 pan of my whole mouth so they could get a good look. When I get back to the chair he starts working again and I feel pain from the work site and I tell him (this is the 3rd time he has had to re apply novacane for the same reason ) he reaches abruptly for the needle sitting on the tray and plunges it in my open tooth and sends a searing white hot dose of lava right into the nerve. The world went white. My ears rang. My eyes streamed w tears. I couldn't see. I couldn't hear. All I could do was gasp for air and then I screamed as I arched my back off of the chair. And all I could hear is him muttering under his breath: "You don't have to hurt people... you shouldn't have to hurt people. " He never apologized. He never asked if I was ok. He just sat there... muttering to himself until the dental assistant checked on me and wiped away 2 streams of grown man tears from my face. After this he decided he'd had his fill of working around my tooth to get to the bit and filed my molar down to NOTHING to get to it. Like... the tooth is gone. All but a shallow sliver that he intend to put a crown on. But I didn't want or need the crown. I couldn't afford to do it after the 1st root canal and still cannot. However he justified this by saying that tooth was going to need a crown anyway so he just "shaved it down". When my wife picked me up and I got in the car, all I could do was cry. I sobbed for the pain and the agony, of what had happened but also for the humiliation and violation of losing a piece of my body that I had paid hundreds of dollars just weeks ago to keep whole. I was never asked if it was OK to take my tooth. He just did. Today I experience nerve pain every time I eat. I always feel like I had a brutal root canal 2 days ago after every meal.. Even if I'm careful. Plus if I apply any pressure to the side of my face where he injected me it's as if it is happening all over again... the nerve is still white hot, and fear it always will be. Want your honest opinion, not as a grandma but as a 3rd party. a Does it make sense for me to provide equally for Atlas, have him half the time, and still send AB money every month, and in addition to this give her nearly all of my belongings and Atlas' things? Many of which were gifts from my family? Only ask because AB is being bloody awful! I know I have a hero complex but getting tired of it, but also don't want this to become a legal issue. Aggressive Dog Attacked My Puppy, Apartment Won't Do Anything Posted: 05 Aug 2021 12:13 PM PDT This is TX. My 8 month old at the time lab puppy was attacked by a pitbull during our first week at our new apartment. Luckily my dog wasn't bit, but it was extremely scary and went on for a few minutes before the other owner was able to get her dog and leave the park. We weren't able to talk to the owner before she left. My puppy was terrified and was visibly shaking after the dog left, he is working on being comfortable outside again but is timid and afraid of other dogs. Sometimes he needs to be coaxed outside with food. I saw the other owner on many occasions but when I tried to speak with her she would run away. We would see the other dog often on walks (small complex) and since she didn't want to talk to me I informed the office that my dog was attacked by an aggressive dog. After almost a month the office said they had no way to know where the resident lived even though they are supposed to keep a registry of all the dogs. I told them the building she lived in and the dog's name and they still claimed they couldn't locate the dog or its owner. Finally I saw the dog growling and barking on its balcony so I was able to report the unit number to the office. I also asked the office why a pitbull was allowed in the complex since the lease clearly says no pitbulls are allowed, the office claimed the dog was an "emotional support animal." When I said the dog was aggressive and still acting aggressive anytime he saw my dog they said there was nothing they could do about it since its an ESA. Since the dog wasn't registered they told me they would give them a lease violation and let me know if the dog's ESA is legitimate. I haven't heard from them since. Every time we see the dog it acts extremely aggressive, to the point the owner has had to bear hug the dog to stop it since its out of control. My wife is scared to walk our dog around and we need to turn the other direction or even go back inside since they walk the dog right in front of our unit at times. Last night my wife got scared since the dog again started barking and growling and lunging toward my dog while the owner walked it (we didn't see them since we went through the back.) I reported to the office today that I am sick of the situation and can't even walk my dog around in peace, and that the dog still acts extremely aggressively every time it sees my dog. They still tried to claim the dog was an ESA so it couldn't be removed but later informed me the dog isn't an ESA. It's also a pitbull and one of the reasons we chose this complex is because of the no pitbull policy. The office offered to let me out of the lease, and I said it isn't fair for me to incur moving expenses when my dog is the one that was attacked and they're the ones not enforcing their policies. At this point I want to move but am wondering if the landlord should have to cover my moving expenses. They already offered to let us out of the lease. Our lease application states: " PETS. Suspended Indefinitely from Work due to "workplace violence" (Louisiana) Posted: 05 Aug 2021 11:47 AM PDT I'm going to keep this as short and simple as I can because I'd rather not have the chance of this info getting back to my job. I've been getting harassed by a coworker for months. This morning he started his stuff again and I asked him what his problem was. He stepped up to me like he was going to physically assault me but another manager currently in the area stepped between us. I reported him for this. And for this I and the other individual got suspended until further notice. I asked why I was being suspended when I didn't even do anything and was because "two individuals are required for a physical confrontation". This isn't even his first time attempting to physically inflict harm where I'd reported him for it. They did nothing about it. We were to write statements and they are sending them to corporate to be reviewed by ethics. During this entire period of months I'd report him to supervisor, their supervisor, try to ignore him as best as I can, report him again to their supervisor, and finally today the top dog. I was told this suspension may or may not be with pay and that either nothing happens, I lose my job, he loses his job, or we both lose our jobs. I plan on contacting ethics myself on the way management has handled this entire situation considering I'd been reporting the harassment for quite some time. I also have witnesses who they won't even get statements from. I did call them today after I was suspended to be wary of saying anything at this point though. I'd rather them not get in my situation. In the event that I do end up losing my job over this I want to know if I'd have any legal recourse. I'm pretty hopeful that this will end in my favor. My statement literally goes back to the start of this to today detailing each incident, managements handling of it, etc. I'm not sure what he can possibly write in his statement to turn this against me. Lies will definitely come out. I do believe a suspension for myself is absolutely unfair. This sets a precedent. I could go out and start shit with another coworker who has done nothing and they could possibly be suspended for nothing. Weird system. Employer "can't" give more hours, but is claiming I must work 40/hrs a week to be eligible for insurance benefits. I've got a fellow employee I work with that's on the spectrum, has a few other conditions it sounds like, and has a stutter that really makes communication difficult when his condition is agitated. He's requested many times to have a regular schedule as having a regular schedule helps him with his condition and keeping his symptoms to a minimum. They schedule him for different hours throughout the week and it changes weekly making it very difficult for him to function. His condo gets agitated and he gets anxious and upset and his stutter tends to take control because of it. Is there any way he would have legal push to get a firm and regular schedule? Company I rent my house through wants to do showing while I still live here. Posted: 05 Aug 2021 01:39 PM PDT I'm renting a house in Indianapolis and am currently month to month. I am moving at the end of this month. The company who I lease through is trying to do showing while I still live here but I can't find any mention of this in my lease. I do not feel comfortable with people in my home while I'm not here. My house is hectic since we are packing, I have animals, I have a 8 month old child and valuables about everywhere. The owner was a crazy cat lady and in the will stipulated that the house could not be sold until the 10 remaining cats die. How enforceable is this? My friend lives in California so she has been going back-and-forth and paying people to take care of these cats. One died of natural causes and she got so paranoid that the lawyer would accuse her of killing the cat to be able to sell the house that she had it cremated and saved it in case anyone suspected her. I feel so bad for her because she is just generally uneducated about any of this. Does she have to keep the cats alive? Can't she just give them away? Or put them in a shelter?
