What type of lawyer do I need? Someone wants a gift back and is going to sue me to get it.

    Posted: 05 Jul 2021 06:24 AM PDT

Long story short, I was given a large amount of precious metal a few years ago, with the understanding that it had come from our grandparents estate (long since deceased) and my father was passing it to us to store and keep for our children. Now he wants it all back out of no where, and claims it wasn't a gift and he just wanted us to keep it safe for him. We've been paying for storage under the clear understanding that it is ours fir over half a decade. I have no idea what kind of lawyer to even look for.

High school is going to expell me because someone is pretending to be me on twitter - California

    Posted: 05 Jul 2021 11:37 AM PDT

Throwaway cause I don't want to get in even more trouble.

Last week my dad got a call from my principle saying he had to bring me in for a talk even though its summer break. We go in and the principle says is this your username? I say yes.

Then he shows me a twitter account with that username that is sending racist messages and threats to a black kid in my class. He says is this you? I say no. He says we talked to a bunch of people in your class who said thats your username and you already admitted to it. I say I didn't admit thats my twitter and its not. He says whats your twitter and I honestly told him I don't have one. He says he doesn't believe me.

He said normally they would suspend me for two weeks then expell me but cause its summer they can't suspend me so in two weeks I have to go before the principle and vice principles and if I can't prove its not my twitter they're going to expell me. He also said if I keep tweeting they'll report me to the police.

I have a really unique username I use for cod, roblox, and tiktok and a lot of people in my class know it but I don't have twitter and its not me making the tweets but my parents are siding with the school and telling me I ruined my life and they don't know what to do with me.

I'm going in front of the principles next week how do I prove its not my twitter before then?

Protecting myself as an unmarried partner of 3 children

    Posted: 05 Jul 2021 05:04 AM PDT

My partner tried to kick me out of the house yesterday. We are unmarried and have 3 kids. I have a part time job and almost no money to my name (my paycheck usually gets spent as soon as it comes in). He owns the house (bought before we were together), both cars, and pretty much everything. I know I have put myself in a really bad situation, but the reality of it really hit me yesterday.

He completely lost his shit yesterday and told me to pack a bag and leave. I did but a few hours later asked if I could come back. The details don't really matter, but it was a trivial issue that got completely out of hand. He has an anger issue that he is dealing with in therapy.

I just need to make sure I am protecting myself. When he's in a good place, I can probably tell him I need to have a car put in my name, and maybe even put my name on the house too. He will probably agree to pretty much anything I need him to when his head is clear.

We are not in a place where marriage is appealing, though I would do it if it would legally protect me better.

I recently started my own savings account that I can slowly add money to. I may just start putting my entire paychecks there.

Sellers didn't complete agreed-upon repairs before we took possession of New Home

    Posted: 05 Jul 2021 05:32 AM PDT

(Cincinnati, OH) Hello all, I recently purchased a home and I just had a few questions about issues that have come up after the fact regarding some repairs we asked to be made before the sale. In particular, we asked them to have a professional (spesifically requested a professional) replace some of the cracked tile on the chimney that was discovered during the home inspection. The gentleman who lived there previously saw himself as a handyman. I can tell you that from observations of other work on our home that he was in fact, not a handyman by any stretch of the imagination. In fact, it looks like he just went to home depot and got a new cover for the chimney and didn't replace the tiles as requested at all. We were unable to tell during our final walkthrough as they were still present and packing and well, it's kind of hard to check a chimney from the ground. The work we will now have to do is several thousand dollars and we feel it should have been completed per the contract before we took possession of the home. We bought the home in March, so it has been some time. Am I SOL here? Do I have to go through small claims to try to get some money back? Any advice is greatly appreciated.

Movers raised price of haul by $4000, even though they were given accurate information on how much they would be facing

    Posted: 05 Jul 2021 11:57 AM PDT

I am moving from Arizona to the east coast, and contacted a moving company in my town to help move my furniture. They asked for a description of everything I needed moved, and I gave them this:

    • 5 medium bags of various items
    • 3 bar stools
    • 1 bed headboard
    • 1 queen bed+mattress
    • 25 medium sized boxes
    • 2 armchairs
    • 1 desk
    • 1 dresser
    • 2 patio chairs
    • 1 safe
    • 5 side tables
    • 1 loveseat
    • 1 3-seat sofa
    • 1 medium TV stand
    • 1 flat screen TV
    • 1 table-bar
    • 1 coffee table

They quoted me $6000 for all of the above items. The date for my move was originally June 26 (6/26), but the movers kept pushing the date back due to unavailability. Eventually, I ended up calling the movers myself instead of the company, and they said they had never even seen my move on their schedule. The dispatcher said he could come on July 3 (7/3), and needed a video of the stuff that would be moved. I sent a video of everything listed above, with a few additional small items that I would also need moved (3 medium bags and an air mattress). He confirmed that everything in the video was satisfactory.

Upon arrival the movers claimed that there was a large excess in items and raised the price to $10000 to move everything. They drove away without telling me any of this. On top of lack of communication, they were incredibly unprofessional and repeatedly hit on my friend who was helping me with the moving process. I reached out to the customer service and they showed me this line from the contract:

IF ANY ADDITIONAL PIECES, PACKING SERVICES, WEIGHT OR LABOR SERVICES ARE ADDED AT THE ORIGIN OR DESTINATION TO THOSE QUOTED, THE CUSTOMER SHALL BE CHARGED FOR THESE SERVICES AT THE GOVERNING TARIFF RATES.

I plan on filing a complaint to the Better Business Bureau, but what other actions can I take?

CPS and getting custody of children after their parent died while in foster care -NH

    Posted: 05 Jul 2021 12:43 PM PDT

My sisters children were removed from her care a few months back. I had tried to get custody of the children when they were placed in foster care, but CPS did not want to place them with me as visitation with their mother would be impossible because I live in Texas.

My sister died over the weekend, and I want these children in my home permanently. I just don't want to deal with CPS dragging their feet any more than they have.

Can I file for custody through the courts and name CPS as the respondent? Do I have to go through CPS?

My mother has lived in England the past ten years but will be moving in with me, does she have a better chance of getting custody?

Help please! CPS doesn't open until tomorrow and we are trying to have a game plan to act immediately.

[PA] Home insurance denied claims for roof repair twice. My roof is now leaking into my house and breaking apart.

    Posted: 05 Jul 2021 08:52 AM PDT

So there was a hail storm a couple years back that damaged a bunch of houses in my area including mine. A roofing company inspected my roof, found damage and we filed a claim that was denied.

A second claim was filed using the roofing companies certified HAAG inspector and was again denied. The insurance company stated their HAAG inspector read the report, saw the photos and found no damage. So I have one HAAG inspector saying there is, another saying their isn't and I guess the insurance companies inspector trumps the roofers.

This all happened this year and a week ago there was a storm and water started leaking into my house. There was water dripping down two walls onto my floor, there's clear water stains on my ceiling and part of my ceiling is breaking apart

I took a video and pictures and sent it to my insurance company. This is an area directly under part of the roof where damage was found and reported. I sent an email to my insurance company along with the videos and pictures and am awaiting a response.

Basically I want to know what my options are (if any) if I am denied again.

    Thanks!

[CA] Employer said they were giving a raise, 9 paychecks later, they claim it was all overpayment and want all the money back

    Posted: 04 Jul 2021 04:43 PM PDT

Hello, my brother is recently in an awkward financial situation. He has been working at a company (in California) for over 5 years. Back in February of this year, his boss said he was getting a raise from a pay of 17$ per hour. His pay was bumped to 33$ per hour (since he had finished his 4-year degree during his time working there). After receiving his first paycheck after the raise, my brother confirmed with his boss that the amount was correct because it was such a substantial jump. His boss said yes the amount was correct (only a verbal confirmation, nothing written unfortunately). After 9 paychecks (18 weeks of work), his boss and the human resources department are saying it was an oversight and my brother's pay was only to remain at 17$. His pay has been reduced back to 17$ without any raise. They are stating he now needs to pay back over 11,000$, and have sent him a form to sign to allow them to withhold pay from his check until the company recoups the total amount. He has used the money already to pay off debts, and he used the money under the assumption (and his boss's verbal statement) that his pay increase was because of the promised raise.

I'm not quite sure of the legal process for these kinds of things, especially given that he was promised a raise, and the error in pay was for so long that nobody caught the error earlier. Any advice or insight in how to handle this would be greatly appreciated, thank you!

    The fate of my father

    Posted: 05 Jul 2021 03:06 AM PDT

My little sister claimed that she was getting sexually assaulted by my father. I 100% believed her and so did the rest of the family so my mother filed a police report. (My parents are divorced) After my mother filed the police report, my little sister then admitted that she made up the claims and only wanted attention. My mother still wants to pursue legal action despite the victim admitting that her claims were false. On Tuesday the 6th we have to go to the police station to talk to the officers. (My father will not be there) is there any advice I can tell the police? My Fathet is innocent my little sister admitted to my mother that she was lying. My girlfriend brother and I are all going with to tell the police the truth. I will do anything to get this cleared as my little sister admitted that it didn't happen the location is Arizona, United States

Family mislead me into signing away inheritance.

    Posted: 05 Jul 2021 10:35 AM PDT

    Hi,

I'm a beneficiary of a trust that terminates on my birthday, however in 2017 i was told to sign a paper by my parents that i couldn't understand and i was mislead as to what it contained. I never saw that paper again and was only vaguely aware that i was involved in a trust at the time.

I got an email from a Head Trust Specialist awhile ago, and attached to them was the original trust saying that upon termination the remaining value will be split evenly among the beneficiaries(including me) ,and then there was a "revised" trust saying that my portion will be split among the remaining beneficiaries. (

The "revised" trust was the paper that my family all kept telling me to sign, as the other beneficiaries include my father and all his siblings. I was only 18 at the time and many family members were reaching out to me at the time. I feel stolen from and betrayed and the people i would like to go to for advice are the ones doing it.

I am currently trying to contact local estate lawyers however i am getting only voicemails (it is lunch hour) so I'm writing this as an alternative to going insane until i start getting calls back. If anyone has any advice I would really I appreciate it.

    NYC Tenant Rights Question

    Posted: 05 Jul 2021 01:30 PM PDT

I have lived at my current apartment for about roughly 2 years.

For a while now I have not been able to shower or use the water here. The water makes me sick and bathing in the water causes me to get inflammation on my skin even with a water filter. It was so bad I had to go to the dermatologist and get medicine to deal with it. My relative who lives with me also got an infection from bathing in the water.

Black mold grows often in the shower no matter how much you clean it. Water I used on a few of my wood tools (cutting board, sharpener) sprouted into black mold and became unusable. Whenever washing dishes with the water, it leaves a white film once it dries. Drinking the water just makes you sick.

To shower, I basically have to buy water in Bulk out of pocket to shower, cook and clean. I bathe out of wash basins. I have not deducted the cost of water out of my rent.

I brought these issues up to the landlord for many months, and they have been constantly dodging the issue or making excuses. They eventually ended up getting the water tested at a lab. It tested positive for coliform. Though I think the major issue is mold in the water. They stated that the lab told them it was a "negligible amount" despite the result clearly stating it was an unhealthy amount of coliform.

When asked about repairs or to do additional testing and what not, they acknowledged there's most likely a problem but wouldn't test again. Then said they'd wait until I gave them the okay to come in the apartment for repairs(I was somewhat against them coming in during the height of covid).

These last few months or so I gave them the okay, but they've continued dodging the issue, saying they cant get into contact with a plumber. Landlords plumber who came by in the past to look at the issue, denied there possibly being an issue (They live upstairs so the Plumber said the landlord would be affected too). Landlord also requested that if the plumber came in to examine could I go 50/50 with paying them if plumber doesnt find anything. They also said even if they find an issue with mold, I'll have to probably move out for it to be fixed.

Most recently they said they would get a new plumber and contact me back. That was 2 weeks ago and I havent heard back since and now I have to pay the rent again.

My main question is I basically haven't been able to shower properly for months, and this place is moldy and unsafe. I've talked about these issues with the landlord for quite some time but nothing has been done and I have paid full rent this whole time without missing a payment.

Can I do anything really? I have no idea what my rights are here. Feels like I cant do anything and it really sucks.

I have received a cease and desist! Please help

    Posted: 05 Jul 2021 05:39 AM PDT

10 years ago, a German entity (let's say XYZ GmbH & Co KG) gave me a No Objection to form a sales and support office in my country (India) which allowed me to engage in "Market Development, Sales, Distribution and Customer Support" for the German entity's products under the name of my business entity XYZ India (proprietorship).

After some time 5-6 years ago, this German entity deregistered.

During the time the German entity was operational, I was selling their products by importing it from Germany. After that entity deregistered, I started selling products that were designed by me (in same category as the German entity's products) under the name XYZ India.

Now, some Company, who claims to own the brand name, is asking me to cease and desist my work. What to do?

Stolen license plate, keep getting EZ Pass bills and collections

    Posted: 04 Jul 2021 11:20 PM PDT

Hello, this is my first time ever posting on this sub, so not sure if the flair is correct. Back in May/June of 2020 I sold my minivan to a dude for $600. We weren't able to go to the Secretary of State/DMV to transfer the title over to him at that time for obvious reasons.

Being the naive dumbass I was he was supposed to make an appointment and return the license plate back to me. Idk what I was thinking, I had a lot on my mind at that time and was going thru some stuff so I got his number and let him leave. We signed a bill of sale and I took a pic of the title transferred over and let him leave. Well the car is still registered to me. I'm located in MI, and sold it here.

All year I've been received Toll By Mail for NJ, NY, and now PA. I've sent back proof of sale to them but they keep going to collection. I've paid a few of them but at this point I basically gave my car away for free. The tags are obviously expired, he just keeps driving it around (honestly surprised it's lasted this long, it was a junker). I set up an appointment at the SOS and waited 4 months to see if I could remove the car from my name. The lady said it was impossible to unregister it and "I should have done it at the sos" (I told her I legit couldn't because they were closed.. wtf)

I guess I'm just looking for some advice on what to do. Legally the car is in my name. Do I call the police and report the license plate as stolen? The entire car as stolen? If this guy gets into an accident and drives off I'm on the hook. Granted i'll have a pretty good alibi seeing as I'm in another state. But that's still a huge hassle I don't want to deal with.

If there's more info needed please let me know. What can I do?

My father believes his siblings will commit probate fraud to steal my inheritance

    Posted: 05 Jul 2021 01:03 PM PDT

My (m18) grandmother is in her mid 80s and developing dementia, and I've recently lost direct contact with her as my aunt has supposedly put her in a home. She has always told me that her current home would be given to me and that this is in the will,

My dad hates his siblings and his siblings hate him, to the point of threatening to violently kill each other if they ever see each other again. My uncle is the executor of the will, and my dad is absolutely convinced that my uncle will submit an altered/forged copy of the will, and that he and my aunt will sell the house for their own benefit. My dad also does not believe that they will inform me of her passing, as they all believe she will soon.

I'm not exactly taking him seriously, I've done research on estate law and figured out how to access records such as a death certificate if need be; but I also don't trust my aunt and my dad claims she has previously falsely testified against his in court for an unrelated matter.

I'm a US-Canada duel citizen, I currently live in Canada. Grandmother is a resident of Oregon, aunt lives in Texas, uncle may live in California. Both aunt and uncle are practicing law. My aunt does not seem to want me to talk to my grandmother.

TLDR: My dad thinks my uncle, the executor of the will will work with my aunt to cut my out of it, as I've been promised my grandmother's house.

I think it's a little messed up that my family, none of whom I am close with, is acting like this considering the fact my grandmother is still alive.

Is there any path I should take, or should I consider this a serious possibility?

Car broker is flaking out on sales--what to do?

    Posted: 05 Jul 2021 02:29 PM PDT

TL; DR: I didn't get a contract with a sketchy car broker who's now holding on to the cars rather than selling them for me, neglecting any paperwork, and ignoring my requests. Trying to get some perspective on my options.

Warning: you are about to read a post that describes a contract-free situation. I neglected to get a contract because I am a stupid stupid person and you can tell me that repeatedly; I will agree with you and tell you various ways that you are right. Onward!

About 14 months ago, my elderly father-in-law had about $125k worth of really nice cars (seven in total) that were collecting dust in several storage units and his garage in California. My wife and I approached a car broker here in CA about helping us get the collection down to zero (through a combination of sales to other people, personal purchases by the broker, and auction websites) and, just as important, administering all the paperwork for retitling, etc. We never made a formal contract. Christ. The emails we have are scattered but extensive—not quite the same thing as a contract.

Anyway, the broker came to put the cars on flatbed trucks, then brought them to his lot. He immediately paid off the lease on a really nice one (definitely the choicest of them all) for his own collection. He then paid us about $4,500 for two other fixer-uppers.

But the remainder of the cars, in the past 14 months, have gone nowhere. The broker no longer responds to my texts and emails. It's been four months since he gave us any money (that was $15k of a $42k transaction for two of the cars; no contact from him since) and 8 months since we saw the cars at all. His personality is a really confusing mix of distraction, laziness, bad communication, and some kind of criminality. A few weeks ago, I even came across an auction listing for one of the cars! Yes! Except it had ended without a sale. Basically, the car didn't meet the reserve we'd tossed around long ago, and the broker failed to reach out to us to see if maybe we'd accept a lower bid (by about 10%)—of COURSE we would have accepted it. We just want this debacle to end.

Meanwhile, the paperwork for many or even all of these cars appears to have gone unaddressed. My father-in-law is still getting DMV notices for the first car the broker paid for, which tells me the broker never fully retitled it. I don't know if any more have been sold and he's keeping the money OR he's acting in bad faith OR he's just incompetent, scatterbrained and distracted. Most of these cars are still collecting dust, just in a different city. The accounting is tricky and subjective here, but my father-in-law is missing something like 80k in proceeds from these sales. In today's used-car market, no less!

I've talked with two lawyers (one is a family member, the other is my father-in-law's estate attorney) who have given me a sense of my options, which include:

    1. Sending an itemized, ultra-clear letter that puts the broker on notice—"either we wrap up these transactions between us or we'll call the authorities." But I'm not sure which authorities to report to. I've gotten too close to the situation and have lost the ability to understand if this is Kinda Bad; Really Bad; or Jail-Time Bad. I don't trust that the broker has the ability to follow through on the many complexities of the overall sale/administration, and my good-faith efforts are tiring me out. The authorities in this case seem to be:
    2. Cops—this is clearly theft, just of a non-traditional kind. (There's also a little fraud mixed in—he valued the nicest car at an amount that I was later told was far too low for its condition. We relied on his judgment for that price and accepted it.)
    3. The CA Department of Motor Vehicles (because he's a broker and must follow certain standards; also, he was apparently operating without a brokers' license when we first made contact). The DMV form I've found doesn't seem to suit this kind of case, though. But I wonder if there is another DMV reporting option with more enforcement teeth.
    4. The CA Secretary of State—apparently his business has unpaid back taxes, and we could use this against him—"get this done now or we report you."
    5. In my letter, I also allude to the idea of taking legal action (and were encouraged by the estate attorney to cc his office for some perception of serious legal exposure), but we don't really feel like going this route. We have been told that while we'd easily win, it would cost about 50k…the idea was to get these things out of our lives, rather than let them take over.

I need help deciding which of these options is best, or if there's another way of looking at this I'm not considering. Nothing I've written feels that satisfactory, but now that I've written it all out, I feel like the police route has the most teeth. Is a police report the best option if I just want to resolve the situation and get the cars all sold, with the paperwork all done? He can't even consummate the purchase of one car, let alone seven. I no longer trust this guy to see everything through and manage the intricacies of the situation, so why would I continue to waste my time with him? That's police-time, right? Or what?

I'm new to Reddit and super grateful for the chance to post this here. Asking this question is part of why I joined! Thank you for listening.

Bite by a dog with no lease

    Posted: 04 Jul 2021 09:41 PM PDT

In Illinois U.S.A riding my longboard on the sidewalk a pit bull ran up behind me and bite my calf. I was not on the dog owners property I was across the road. After being bitten I did call police to get a report. Got pictures taken and the officer told me he would be contacting animal control for a report. Although in the town I am from he did say animal control is not mandatory and I would have to sue to have my medical bills paid for. I went to the hospital, got it cleaned, stitched, and they gave me a booster shot for tetanus. I do not know if the dog even has gotten all its shots or not. I did talk to the owner briefly just asking if he would pay for the medical bills because I do not have health insurance. He didn't give me an answer and only said that he was on disability and did not say much else on that. Any advice or suggestions would be greatly appreciated!

Buyer didn't pay me. Just a question on what to do.

    Posted: 05 Jul 2021 01:42 PM PDT

    Greetings, -Also woops, USA-NC

I always perused but never thought I'd be the one posting a question.

TLDR: Sold a PS5 to someone by changing my pickup name (BestBuy) to their name and now they won't pay me for it.

Long Story: Met a dude at a local police department to sell him a PS5. Buyer then asked "Oh have another one? It's for my brother."I said "Yeah but it's 2 hours north I can't go pick it up."-Buyer: Really? My brother can pick it up, he's 15mins away from there.Me: Really? I'll just change the pickup name then and your brother can pick it up and pay me upon acceptance. Just pay me retail since I was gonna just cancel it. Text me everything so I can change it when I get home.-Him: Sounds cool.

Obtained full legal names and phone numbers from him and his brother via text and an agreement to pay. (Bestbuy does an ID check when you pick up so I needed them), changed the pickup name, sent a Zelle request (buyer's preference of payment), and waited. Next day they picked it up (July 4th tho so I get it), no response, texted the Lil' Bro and inquired as to the money, no response on the money either.

Late that night lil' bro: "Hey man it's not working. Gonna return it to bestbuy tomorrow to see what's happening."Me: Okay, then that's up to you, since you have a receipt you can request a replacement, so I'd please like to be paid.Him: Why would I pay for a broken electronic? We'll see if we can get it fixed ASAP tomorrow.

Called original buyer and he promised to meet me the next day at the same PD and hand over cash.

Waited till the morning, texted big bro "Yo we're meeting up? Same place right?"Texted small bro "If there's an actual issue then please, go back to bestbuy and put me on the phone and I'll handle the return."

    No answer.

I texted an hour later (At our meetup time after the original buyer didn't show) and said to both: "Hey <Insert their full legal name>, just a polite heads up, please pay me or I will consider pursuing legal claims."

Immediately got a response back and "You can't come in here and threaten my family like that. You can't conduct yourself like this. Just cuz we don't text back or pickup the phone doesn't mean we're stealing, we're a god fearing family."

My response: Look, it's been two days, I get that you're busy, but our written agreement was 'I get you a PS5, you pay me.' If it doesn't work, then please work with me to get it brought back and I will help as much as possible. You're being silent and you've neglected to meet after we agreed.

GF and friends blew up at me and said I'm extorting them for money since I threatened legal action and dropped their legal names.

Am I in the wrong anywhere here?

-Planning on going to small claims court, or filing a police report, would appreciate any pro tips. Thank you!

Car Deposit not refunded in full (CA)

    Posted: 05 Jul 2021 01:14 PM PDT

Hi all. I was helping my gf buy a used car from a dealer here in California. We put $2000 down amd we signed a 553-CA-ARB for financing. Unfortunately she wasn't approved for the required amount so we needed to get our deposit back. The dealer is saying that they will only give back 1500 because there is a deposit 500 fee. Now this was NOT disclosed to us at all during the time of signing the 553. We also signed an itemized deposit document from the dealer. This document does not say anywhere about a 500 dollar deposit fee. Is this something they can do? I was also looking at VEH 11736 paragraph (c).

It says it is unlwaful for dealers to "Fail to refund any purchase money, including purchase deposits, upon demand by a consumer at any time prior to the consumer's signing of a vehicle purchase agreement with a selling dealer and taking delivery of the vehicle described in the brokering agreement."

What does that mean for us?

[NYS] Boat was stored at a dry marina that closed 2 years ago. Owner has allowed us to keep the vessel there since but the property is sold and the boat is gone

    Posted: 05 Jul 2021 07:38 AM PDT

My partner and I have had a boat stored at the same location since 2017, without contract. The business closed in 2019 but the owner allowed us, with verbal agreement again, to keep the vessel there and we would pay when we took it. Yesterday we drove by to check on it as we usually do and the boat and other items on the property are now gone. My husband contacted the owner this morning who tells him the boat was abandoned and he sold the property, having recyclers come for the boat. He will not "extend any courtesy" to divulge the name of the new owners or the company he supposedly hired to remove the boat.

We acknowledge our mistake was not taking action sooner due to convenience. However, we received no notice of the property sale or an estimate of time in which we had to square up and remove the vessel. We have not moved the boat since 2019. It is on a trailer and estimated value of both is around $4k.

Edited to add what I'm here for!

    1. What are the rules about "abandoned property" in this situation?

    2. Without contracts what would be our logical next step?

    3. The boat is fully insured and registered - should we declare it stolen?

Drone shot down while watching fireworks

    Posted: 05 Jul 2021 11:38 AM PDT

Rancho Santa Margarita, CA. Throwaway for obvious reasons.

Last night my nephew was filming fireworks with a drone and it was shot out of the sky. One second it was filming and the next it was spinning towards the ground and the signal immediately disappeared. It's not apparent in the video what exactly happened, we didn't see any kind of net so we assume it was either some device that interruptsts the signal or an actual projectile. We're inclined to believe it was a projectile considering the drone was still broadcasting video when it was spinning towards the ground.

The drone was at least 500ft away from the fireworks and approximately 75-100ft off the ground. Where it crashed was JUST inside the firework zone, which is likely the reason it was shot down for crossing over into a prohibited area. There were no signs stating drones were prohibited, and a quick Google search yielded nothing useful in regards to whether drones are illegal in this area, but we only spent a few minutes looking.

When he walked over to the crash area, he was greeted by police who obtained his name and address. They did not accuse him of flying but wanted to know why he was in the area. They didnt advise it was illegal even if he had been flying. He did not admit to flying a drone but was told that the fire department was shooting them down which leaves us wondering whether this is legal considering there was no signage to indicate drones were prohibited in that area. He was not ticketed or cited and was free to go afterwards. Admittedly, he might have been a little to close to the fireworks which could have been a problem.

We are looking for some advice and input:

What is the likelihood this is going to come back to bite him in the form of legal charges? Can the police or fire department just shoot down drones without any type of warning or notice? Is there any recourse for this? The drone was an expensive one and now it's gone/destroyed.

Tldr; drone was shot down when there were no signs to indicate it was prohibited but it was probably a little too close to fireworks. Police have my nephew's information but he did not admit to flying in the area. Drone is now gone/destroyed.

How can I find out what my warrant is for in California?

    Posted: 05 Jul 2021 09:47 AM PDT

I was pulled over in Utah and told I have a warrant in California (where I lived until recently). I neglected to ask what county the warrant is in. It's for something like "interfering with a communication device". I lived in the Bay Area. I tried calling around to police stations and court houses, but got the runaround. Most of them won't tell you anything without coming into the police station.

Is there a way to find out what this warrant is for and where it was issued from? I was thinking of maybe trying one of these background check websites, but a lot of them seem kind of scammy. What should be my next step? I'd like to move back to California, but don't want to just wait to get arrested.

Guy r*ped me, faked suicide and admitted it over voicenote but I have no other evidence - will it count for anything?

    Posted: 04 Jul 2021 03:15 PM PDT

WARNING: very graphic and quite a long read.

I (f,20) was raped and sexually assaulted a few times by a 'friend' last year. At the time I downplayed it, told everyone I knew it was fine or didn't tell them at all, and allowed this man to coerce me, hit me, spit me, get me drunk and have violent sex with me whilst I clung to consciousness, multiple times over the space of 4 months. I was new to uni and the area. I was scared, desperate to cling to the new friends I'd just made and had never had a sexual relationship before. I told myself it was the best I would ever get and not worth the trouble of admitting what was going on, so I forced myself to zone out and let it happen. Oh, he also had a long-term girlfriend the entire time.

At one point, he faked a suicide attempt. He'd been embroiled in some drug-related stuff, and previously kicked out of uni, and he apparently considered this a last ditch attempt at worming his way out of it. He supposedly overdosed on pills (he later told a friend he knew it was enough to make him ill but not die) texted me alluding to what he'd done, and waited for me to run two miles to his house, literally break in, hysterically administer CPR, then clean his entire (filthy) flat for him after he'd been taken away by paramedics. Who, by the way, took one look at him and simply told him to get up. He walked out of the flat. An hour later, I got a snapchat from his 'doctor' saying he was in a coma and might not make it. In my naivety and distress, I never stopped to question why a doctor would message me on snapchat. I know, I'm dumb. I didn't sleep for a week, believing it was my fault for not finding him sooner. He turned up out of the blue one day, supposedly free from hospital, but something changed then. The trauma of that incident gave me the courage to distance myself somewhat. He still attempted to sleep with me a couple times after that, and faked a 'tic attack' and destroyed my bedroom when I tried to end things, but eventually I managed to distance myself enough to really see what he'd done to me. I told a few close friends who all believed me and also helped me come to terms with what had happened. This process is like being raped again and again, only this time I'm registering that it happened to me. I have nightmares, a developing drinking problem, and I've pushed away my male friends. I can't afford therapy. I need it so much.

Recently, he confessed to a mutual friend about faking the suicide. He started harassing me, asking why I never spoke to him any more, saying that he might kill himself if he didn't have me as a friend. To this day he doesn't know that I know he faked his original attempt. After a while of being harassed, I messaged him this (it's quite long and graphic, sorry):

"In short, being your 'friend' was terrible for my mental health. I wasn't a confident person when I came to university, I was just finding my feet when I met you. The night you took me to bed was the first time in my life I've ever been sick from drinking and blackout drunk. I don't remember much from that night at all but I do know that I never would have let it happen if I hadn't been literally too drunk to walk home. I should have phoned a taxi. As my alleged friend and the person who was, and I quote, looking after me, you should have called a taxi. Especially if you were having thoughts about sleeping with me. I was incredibly vulnerable and though I think I probably did consent, I was in no position to make that decision for myself. I know how that sounds, and so do you. You sent me an apology text the day after saying you aren't that kind of guy. We both know what kind of guy you were referencing. I said it was fine, we agreed it wouldn't happen again. I cried, talked to my friend, decided it wasn't worth disrupting a brand new friendship group over. It did happen again."

There's more to it - I described how he made me bleed, pressured me, hit me, traumatised me etc etc. In response to this message, he sent a voicenote in which he took full responsibility for all of this and said, and I quote: "I knew exactly what I was doing." (In regards to choosing me because I was vulnerable and wouldn't say anything) "I wanted to exert power over you." (He described how he was struggling mentally and took it out on me) "I am that sort of person." (Directly quoting my message, in which I quote his ouse of 'that sort of person' to allude to a rapist) "I've done it to other girls too."

I know that there's nothing that can be done for me. I was coming to terms with the fact I'll never get justice for what he did - there's no physical evidence for any of it. But that last thing he said, about other girls, made me think that there might be something I can do.

If I submit everything I know, including these messages and his voicenotes etc, to the police, can they store it away? I'd like to think that if another girl comes forward, this might help back up her story a bit and maybe she'll get something like justice.

I'd really just like some advice/guidance/reassurance. I know I should go to the police ASAP (I should have done it immediately) but I was, and am, scared. I'm terrified to open up to someone, knowing that there's nothing that can be done for me or that I'll probably be dismissed. Any guidance etc would be so so appreciated.

    Sorry this is so long!

Moved into an apartment with mold and other filth. I'm not sure what to do.

    Posted: 05 Jul 2021 12:26 PM PDT

Not sure if I am posting this on the right sub, but I feel like it is worth a shot. This is going to be a pretty long post so thank you if you read entirely.

Edit: Forgot to say, this is in Québec, Canada.

So me and two of my friends signed a lease for a 5 1/2 in March. When we visited, the landlord explained to us that the current tenant had a very big family and had been living there for 2 years. The apartment was super crowded and there was a lot of furniture covering up the walls and floors. We saw it was dirty but nothing we couldn't clean once we lived there. The landlord showed us another unit that wasn't for rent, but to show us what it would look like empty. He told us that he would upgrade our kitchen and our bathroom a couple days into our first month. We agreed and signed.

Fast forward to July 1st, and we were disheartened by the state of what we rented. Behind all the furniture was mold, holes in the paint and the walls, bowed floorboards and much more. We took some videos first thing after dropping in my mattress and some of my stuff (we were scared of the rain). You can see the state of the rooms here: Rooms

The apartment was absolutely vile, but our landlord looked like he felt that way too. He came to welcome us after he gave us the keys. He took a look around and looked like he was very angry at the previous tenant for leaving the apartment like this. He guaranteed us that he and his team would take care of it and would remove all the filth as soon as possible. We were relieved, after all, we saw the other units and they were great.

Which brings us to last Friday. My roommate gets a call from the landlord, saying that he has cleaned every bit of mold and filth from the walls and that next week, he would get started on the kitchen and bathroom like he promised and we would have a "good as new" unit in maximum 2 weeks. We were excited, so my roommates and I decided to go check it out.

Here is what the walls looked like after he was done: Walls

We were livid. We haven't had a chance to talk to him yet since he was away this weekend but we feel like he lied to us. He's been adamant for us to pay our rent, which we refused to do since the apartment was absolutely filthy.

Our accommodation company (not sure how it's called in English, "Régie du logement" in French) is absolutely useless and won't answer my calls. I've been reading up a lot on what I could do but I'm unsure of my rights and how to confront my landlord. I'm scared of being manipulated or straight up lied to because I don't really trust my landlord and I have no idea what i can or can't claim.

Any help at all would be appreciated. I've been living at my girlfriends since moving day since the apartment is not possible to live in.

    Thanks a lot.
