Legal Advice Neighbor poisoned our trees and tried to pepper spray our dog

Neighbor poisoned our trees and tried to pepper spray our dog

    Posted: 07 Jul 2021 03:01 PM PDT

We just moved into a very rural community (VA). We only have two neighbors but one of them is turning into a nightmare.

It started with her attempting to pepper spray my dog. She was walking in the street while I was out in the front yard. She walked up to our property line and tried to pepper spray our dog who approached her. She then immediately called the sheriff without saying a word to me saying that a "vicious dog attacked her". The sheriff came up to the house, met our dog (a well-trained, friendly, 1-year old pure bred gun dog), and said that we should probably get cameras so next time we could catch her in a lie.

Next, she poisoned a row of trees (~20 trees and thousands of dollars) we have in front of her house. We have dozens or hundreds of this variety of tree planted around the property and only the ones right in front of her house are dying. The rest are healthy as ever. We called the sheriff and were told that there's not much that can be done without more evidence.

This lady has a reputation in our little community of being a troll. The person we bought the house from had a restraining order against her and had her criminally charged with trespassing on his property (he had installed thousands of dollars of cameras). She was also convicted of a misdemeanor for impeding a hunt for sitting outside in her car during hunting season honking her horn near the hunters. One time an HVAC technician came to our house and right before leaving just announced out-of-the-blue that his company had a terrible experience with her.

What can we do? I wanted to let the dog thing slide rather than escalate because I'd rather eat crow than have a hostile neighbor, but then she poisoned the trees. I'm worried that it's only a matter of time before she attempts to poison the dogs or set something on fire.

My current plan is to bite the bullet and load the place up with cameras in case she does anything in the future. Can anything be done about the trees? The only evidence we have is circumstantial (i.e., the trees near her house but no where else are suddenly dying). Even if we sent samples to some labs for testing and they determined it was poison, how could we prove it was her?

Friend inherited a collection of war trophies, is this stuff legal to posses/sell?

    Posted: 07 Jul 2021 03:34 PM PDT

My friend comes from a military family and inhereted an extensive collection of war trophies that were collected by his relatives from WW2 to Vietnam. He wants to get rid of it and is giving it away to anyone willing to haul the entire thing. Some of this stuff seems valuable or cool, some not so much, so I'm wondering if its legal to posses, sell and/or dispose of it as trash.

There are two broad categories of items:

    1) Personal equipment such as uniforms, medals, compasses, canteens, knives, ect... He says some of this stuff has unit or army names on it but no personal names.

No guns, explosives, or anything dangerous like that.

    2) Human remains. He says its mostly skulls but there is some other stuff including a preserved penis in a jar. He thinks they might have been organized by nationality at one point but thinks they're currently mixed up a bit. He says there is nothing else to indicate who this stuff originally belonged to.

Tattoo Artist refuses to return deposit to my sister after telling her he will not do her tattoo or release the design to her because our younger brother owes him money.

    Posted: 07 Jul 2021 01:04 PM PDT

So I live in a small town in Montana, we have a local tattoo artist who is the only shop in town.

For christmas last year, our mother got us all $100 gift cards to the shop. My youngest brother was the first to go and had a lot of work done, getting most of a full arm sleeve done, but he moved away before getting it finished.

My sister contacted him back in february and gave the guy ideas for a design for a half sleeve, he seemed excited to do the work and all seemed well so in March my sister paid him a $200 deposit which he said would be put towards the completion of the tattoo.

Months went by with my sister checking in and him repeatedly telling her he was sorry, he's just been too busy but he would get her an update as soon as he could, all the while my brother had been getting his sleeve finished.

Well my brother met a girl and moved out of town a few weeks ago, and didn't get the tattoo finished.

Which brings us to yesterday when after a long period of silence the guy finally got back to my sister. He e-mailed her telling her that he would not be continuing the work or even considering getting her into a chair because my brother owed him $150, and he wouldn't refund the money for her deposit or release the design to her until little brother paid him.

The $150 was the cost of the final session my brother never had done before he left town.

So my question is how to proceed? My sister asked for the deposit to be returned and in the last email she got from the guy he said "hey if you don't like it sue me."

We have documentation of all the emails sent and received but I've been waiting until I have a cooler head before going and requesting copies of the written agreement she had signed with him, although I feel like it might be less than easy getting him to hand them over.

I received a call from a debt collection agency for a car accident I was not involved in.

    Posted: 07 Jul 2021 03:07 PM PDT

(If this is not the right place for this question, please direct me if there is someplace better.)

    Location - Oklahoma City, Oklahoma

I received a call from a debt collection agency regarding an automobile accident. They claim to represent StateFarm Insurance and are calling to collect $6,000+ for a car accident I was not even aware of, let alone involved in. They claim I was driving a car of a make, model, and color I've never owned or driven before (and isn't even similar). When I attempted to explain this, they seemed confident I was the right person. They invited me to email them proof that I was not in fact driving that car that day, which I'm fairly certain isn't how this works but I'm just an amateur.

At first I assumed this was some sort of bizarre scam, as I had not heard from Statefarm in any capacity, nor my own insurance company, but upon googling their name they seem to be a legitimate debt collection agency with local offices. Is there a way I can determine their legitimacy or dispute this claim if it is legitimate? Or is this something I should probably just ignore? I'm concerned that a claim, even a mistaken one such as this, could go against my credit which I've been working very hard to build.

Neighbors tree hanging over our new home

    Posted: 07 Jul 2021 02:20 PM PDT

Just bought a house in San Jose, CA and we thought to get it fumigated to clear out termites that were present.

The company said we needed to take care of the tree on the side of the house before they can tent. The thing is, it's the neighbors tree. It's right up against the fence on their side, and it's very very tall and the branches drape down over the fence line onto our property and cover a portion of our roof and chimney. Looks like it's responsible for dropping lots of leaves on our roof as well.

I know we can legally trim anything on our side of the fence, but this is a slightly different ask since this tree is so tall and even if I could reach the branches with those long trimming poles I'm hesitant because those branches look like they could do some damage to our roof or fence as they fall. It might be too tall to do myself.

I have the neighbors contact info. I got some estimates from tree trimming services. So now that we want this tree trimmed my question is… is the neighbor responsible for getting this tree trimmed?

Is she 100% responsible for the bill for any tree trimming service? If by chance she doesn't want to do anything, am I basically SOL and have to trim or pay for the services myself?

Sorry to ask but I just couldn't find anything concrete online, such as a statute or ordinance. And I'd like to have my ducks in a row before bugging the neighbor about their tree.

    Thanks in advance :)

Car dealer undercharged me for new car, wants me to come back and pay difference.

    Posted: 07 Jul 2021 12:58 PM PDT

Last week I bought a new car in cash. There was a Toyota discount for $500 for college grads and military veterans. I presented my paperwork and the dealer knocked $500 off the price. I signed, got the keys and drove off the lot in my new car. This week they called me to tell me that the rebate was only if I financed with Toyota and not meant for cash purchases and asked me to come back to make up the difference.

Since they sold me the car, am I legally required to pay up or can I tell them its their mistake and they own it? All I have is a copy of the retail purchase agreement that I signed. I am still waiting for the title to be sent over.

Edit: Location Located in Dallas, TX area.

[Indiana] I sold my car to a scrapper who sold it to someone who got into a car accident. The car is still registered to me and subrogation is after me.

    Posted: 07 Jul 2021 03:40 PM PDT

Title has the gist of the situation. In July 2021, I sold my car to a scrapper. I was 20 at the time and didn't really know what I was doing, so I did not get a bill of sale, the guy paid me in cash, and I left the plates on. I did sign the back of the title, but clearly no one has done anything with that. (Yeah, I totally screwed that up). The scrapper turned around and sold the car via Facebook marketplace to someone. That person got into a hit and run accident (November 2021) and I believe the plates were pulled from a security video. Now, State Farm (the person who was hit 's insurance company) is coming after me since the car is still registered to me.

I have filed a police report against the towing agency. I have filed a report with the Indiana SOS because it is illegal in this state to sell a car without registering it without a dealership license. I have filed a report directly against the business.

I talked to the State Farm specialist in November, I explained the situation. They asked for the business name and number, which I provided and he told me "thanks, you shouldn't hear about this again."

I provided a plethora of evidence that I did not have the car in my possession when this happened. I have the Facebook listing where the guy sold the car which has his name in it (and clearly shows my plates), the name of the company which clearly shows the same guy owns the business, text exchange between myself and the salvager where he texted "omw" July 2021, and then in November he sent me the FB profile of who bought the car, I have a picture of the car being towed, and I have documentation from my place of work showing that I was clocked into work during the time of the accident. This has all been provided to the specialist and subrogation.

Subrogation is basically telling me I could've doctored everything I sent over and that they're coming after me for $12,000 (originally $9,000).

So what legal grounds do I have? I clearly provided evidence that I was not involved in the crash, I do not know who did, but I provided the name of the salvager who can help with that. The salvager will not answer their calls and won't provide me with a statement or bill of sale saying that they bought/sold the car. Can I go to the BMV to get the car out of my name? I spoke my family's lawyer (not sure specialization, but not civil) and they told me that "subrogation can fuck off, they don't have proof". I'm just not sure what to do and I'm terrified that I'm going to get sued over this or something.

Is cleaning raw sewage after a backed up pipe on the landlord?

    Posted: 07 Jul 2021 03:40 PM PDT

I live in an apartment in CA, a few days ago raw sewage flooded our back patio. The landlord sent a plumber to fix the line but has told us to clean the sewage. We obviously don't want to because it's…raw sewage (and our patio has no drainage so i'm unsure how we would even remove it).

The backup was not our fault - the property manager told us that the sewage lines have to get snaked every 6-8mo and the landlord forgot to call a plumber to do it, causing the pipe to get backed up.

In my opinion the landlord should pay someone to come clean it but I want to be sure before getting public health officials involved. Thanks!
