The officer who responded to my initial call wound up calling me yesterday morning to ask for an update on the situation. I told him about the contractors coming by later that afternoon and my plan to sue my neighbor to cover the cost. He said he wanted to take another shot at getting this guy to do the right thing, and came by about an hour later. The neighbor's wife actually wound up answering the door this time, and it seems like her husband had told her a very different story about the situation. Long story short, she came over to apologize and told me that her husband and son would start clearing their shit out within the hour, and she was true to her word. I called the contractor once the dumpster was nearly empty to let him know everything had been sorted out so he wouldn't have to spare a few guys to deal with it, and he was happy to hear that as well. The neighbor's wife actually came by again with a huge plate of homemade cookies as a peace offering a couple of hours later, which was very much appreciated. My parents actually opened up a bakery after my father retired, and my father was already planning on coming up here for the weekend, so he's going to bring a big box of treats for me to give them in return as a "no hard feelings" offering. I'm still not thrilled with this guy's behavior, but his wife is an absolute sweetheart and it looks like the son had sort of been pressed into service by his father. I'd rather maintain a decent relationship with my neighbors if possible either way. As of now I've got a crew of guys working in my garage and they are absolutely bumping some bachata, which makes me feel like I'm back home in the Bronx but with a much bigger backyard. That was running our irrigation 2x a week for 10 minutes per zone. It was new landscaping, and it was pretty under watered. Several trees died. One person in a sunny spot had all their landscaping pass away. A lot of arguments about it. Our commercial irrigation company suggested running 10-15 minutes per zone, 3x a week if 10min, or 2x per week if 15. They ignored this. In the new year we upped the irrigation budget to 15k. This year, the same two board members got mad and started running everything 37 minutes per zone. Then got really pissed and are now running it 1hr and 14 minutes per zone. A resident walked by, and the HOA board member asked if their grass was getting watered enough. They replied yes? Then casually said they "jacked up" the watering times as a "parting gift" and that they are no longer touching or adjusting any of the water. They hold the only keys to the system. I checked the meters, they're running the irrigation for 8hrs a night. People are complaining about water collecting and not draining in their yards. At this rate we will have a 6k+ bill for 4 weeks. Maybe more $$. Our water is metered by the city into 3 expense tiers, more expensive each tier. It's a drought. Maybe not relevant, but our irrigation vendor wants to drop our contract due to how difficult these two board members are about the water. It's our third irrigation vendor in a year. They are effectively a very loose, very deep V neck shirt with a collar. It's a physical job that requires a lot of movement, bending, etc, and the nature of the job plus the cut of the shirt means that it's inevitable that she'll be exposing herself to anyone in the vicinity on a daily basis (in this case, almost always clients) unless she wears a T shirt underneath, which is impractical and inconvenient given the summer heat. Another female employee asked a supervisor why the shirts were so low cut during a meeting and was told something to the effect of "Gotta make sure we stay in business". It's absurd. The choice in uniform could have been innocent, the shirt itself doesn't look like it would be revealing until you actually put it on, but who the hell buys a polo without buttons? And for that matter, who the hell buys polos with buttons as well, but only for the male employees? She's going to ask for a male uniform shirt and doesn't want to cause a stink because she loves her job, but the whole situation to me seems really unethical. Having the standard uniform be so revealing that you're flashing the public every day and having to specifically ask to be given a shirt that actually functions as, you know, a shirt, is ridiculous. My ex-wife and I agreed to joint decision making in all medical decisions. A couple weeks ago she told me she did not want me to vaccinate the girls for covid or the flu. I told her that it was recommended by the CDC and if recommended by their doctor that we should follow their advice. Instead I received papers in the mail of her serving me at the end of the month. What can I do, can I counter serve her? Do I even have a case? Side note, I have a lawyer, we've retained him since September, I've been spending thousands in legal fees and alimony/child support. He asked for a large retainer to go to court and we can't afford it right now. So far, all they've told us is how much the co-pay to see a doctor is and how much it will cost out of our our paychecks for our share of the premium. We have to decide by Friday 6/11 if we want the coverage but they haven't given us any benefit booklets explaining the new plan. This seems really shady and illegal to me. I have asked when we're getting the booklets and all I've been told is "soon". I've been trying to find anything in the state laws regarding this but not having any luck. This is in Washington state. New York state- ACS makes an arrest Posted: 09 Jun 2021 08:09 PM PDT Today ACS came to my home claiming to have an ongoing investigation of child abuse against my mother, which neither one of us was aware of, regarding a mark she left on my little sister (8y). My mother has never been abusive towards my sister, but I am not justifying her impulsive action or way of disciplining her at that moment. ACS claimed because of the size of the mark they have to take my sister to the hospital and that my mother has to accompany them. The next thing I know I'm getting a call from my uncle that my mother has been detained, I have not been able to contact her since and I have no idea where my sister is nor does her father. I am 18 years old and I'm a college student, I don't have a job. My mother is the head of household(the main source of income) and despite knowing this and the fact that there is another minor in the household, they took her away. I did receive a call from a social worker saying they could bring my sister back to me, it's almost midnight and they haven't gotten back to me. Can anyone help me make sense of what's going on? Pretty much at 10:00 PM on a Wednesday night my friends and I were biking around town and saw a construction site. It was surrounded by a gate but one area of the gate was very easy to squeeze through. Without thinking, we went inside and walked around. We did not damage or move anything, and we're there for no more than 10 minutes before cops showed up. We exited very calmly and we're polite and cooperative. The cops got our names, addresses and parents info. They tried calling the owner but got no response. The cops were nice about it and they said in general it's unlikely that the owner would press charges since we didn't break or damage anything. Her husband (my dads brother in law) passed away unexpectedly in January. There was no will/trust found for the items/estate left behind. They had no children either. My Aunt's name is still on things such as the deed to the house and bank accounts despite her being gone for a while now. Another aspect of this is, my Aunt and Dad split the value of the sale of a house they both inherited only 2 months before my Aunt died. My uncle ended up getting all of this money (at least $150k) because she died shortly after this was settled. My dad is the only sibling to my Aunt, my uncle has two siblings. Would my dad be legally entitled to anything since my Aunt's name is still on things within the estate? Or is he not able get anything because my Aunt died first? Thank you in advance for your help. We live in the Cincinnati, Ohio area. Okay, so I have a friend who borrowed a car years ago. Like 2012 or so. While she was using it, the engine caught fire. The fire department said that the car was totalled. Now, all these years later, the owner of the car has repaired it and is demanding that she pays them $9,000. My friend is afraid and can't afford to cover this, plus it was like ten years ago. It wasn't even her fault, she just happened to be driving the car when it caught fire. Anyway, the owner threatening to sue her for the $9,000 and has even had a lawyer send her a letter telling her that she has to pay it. She feels like she has to file for bankruptcy, because she literally barely makes enough to pay for groceries each week, and now she's being threatened into paying for this. What are our options? Does she have to pay it, or is there a way to fight it? Or just ignore it? Probably not that, but I know this is causing her great anxiety and I want to help her as much as I can. This is complicated to explain properly, and I'm not good at summarizing so please stick with me here. Any help or insight is very, very appreciated. My step dad (I call him my step dad but they were not actually married. They were together for 20+ years and he was a big part of my childhood) passed away very suddenly right in the peak of covid. He ran a business out of their home. For tax purposes and whatnot, my mom worked as an employee for him (she handled all the phone calls, paperwork, mail, etc.). He also had two other employees. When he died, he was (just recently) in considerable debt with the irs. They came through and took pretty much everything...bank accounts, investment accounts, half of all shared bank accounts, etc. My mom was left with only what was in her name...namely the house, 2 cars, and not much left in the bank. She immediately sold the house and the vehicles (except for one), took the money and moved into a small, low cost house. The business closed down after my step dad died (it was a very niche area and couldn't be run without him). I'm cutting out a ton of details to try to get to the important part: The machines. But if anyone needs more details just ask. Before he died, my step dad had 2 very large, heavy machines leased through a company. He paid for them monthly. They were in my mom's name. After he died, she called the company to return them, but because they were in my mom's name the company refused to take them back and wanted the money owed on them. The amount is $40,000+ (These machines were critical for the business). Honestly, that's probably more than the amount of money my mom has left after paying off the car she kept and buying a house (she bought it with the money she got selling her old house). The company has been ruthless and my mom isn't in the best head space after losing her partner of the past 20 some years and everything she's known (the home where she raised 6 kids, etc.). It took many phone calls begging for them to come get the machines and us telling them that they were going to be abandoned if no-one came to get them because she sold the house they were in, and they're massive machines that can't be moved without being taken apart (which we'd have no idea what to do). The day before the house closed they showed up and it took two days to remove the machines, which created an issue for the house closing but eventually worked out. ANYWAY, the lease is for another 2 years I believe. They would not give her any money off of the total for breaking the lease (including the extra plan they had stating that if the machines broke they'd come out and fix them...like an insurance/protection plan). They just sent the amount to a debt collector, and the debt collector has just contacted my mom. Please keep in mind that she's been going through a lot (this is by far not the only pot hole that had presented itself) and I realize there might not be anything that can be done. I should add that my mom wasn't even aware these machines were in her name until she found out when returning them. It wasn't uncommon for my step dad (who a very no nonsense, traditional, religious man) to put things in my mom's name. While she loved him very much and I truly believe he loved my mother, the relationship could get tumultuous at times. What can we do? We do not have 40,000+ to pay this debt outright. My mom lost her job, partner, home, etc. and is still reeling. She is worried they will come after her house and the few possessions she has left. I know it is unlikely to get out of this debt, but how can she protect herself/what are her options? Her credit is really good, she's always had very, very good credit. I've been a full time employee for the past 3 years. My job is entirely physical labor and the past few weeks I've been in extreme pain from work & pregnancy. I've been asking my boss if I could just be scheduled part time for the month of June, and she originally said yes, but has still been scheduling me about 38 hours every week. I really can't handle this anymore and I talked to my doctor about it. The doctor said they don't want to give me any work restrictions, but that I can start FMLA whenever I want. I told my boss yesterday (6/8) that I'll be starting my FMLA leave on 6/21, and she told me she can't accommodate that because they have nobody to replace me yet. Is that legal? I have all the paperwork filled out by my doctor for STD and my health benefits. My boss has known about my pregnancy for 6 months. I don't understand why I have to keep killing myself at work because they don't have someone to replace my hours. Just recently she has started receiving tickets for that car upon further investigation it appears she did not fill out the notice of release with the buyers information. Keep in mind my mom has never sold a car before. Also the current owner never registered the car so when he keeps getting tickets they keep mailing them to registered owner still my mom! I called DMV spoke to supervisor who said there's nothing that can be done and she is still responsible for that car until she gets the info of the person she sold it to. This has been over a year ago! She doesn't have his info. My mom thought the new owner would register the car but he hasn't even though registration was due December 2020. My question is: How come the car is not getting towed and ticketed when the registrations is expired? ?How can my mom no longer be responsible for this car? I sarcastically told DMV should she report it stolen? Which they replied she could get arrested for lying cause she sold the car. Okay then how is it fair that she is still responsible for the car yet it is not her car. What can be done? Posted: 09 Jun 2021 04:07 PM PDT I asked for advice here once, so there's more information in my last post if you need it. I own a unit in a condo association in Colorado. The HOA paid for and replaced my old rotting deck a couple months ago. They are responsible for any exterior repairs and maintenance, and the deck falls under "limited common elements" according to the covenants. The HOA hired someone who did a bad job both aesthetically and structurally. The deck is literally held up by a stack of brick "shims". There aren't enough joists so some boards dip when you walk on them. The are no steps, just a two foot drop between levels. Another contractor confirmed how bad the work was and that it doesn't meet code requirements. The HOA refuses to replace/repair the deck and is arguing that because the old deck didn't comply with the codes, this one shouldn't have to. When I posted here last time, I was advised to talk to county inspectors so they could order the HOA to get it up to code in a certain amount of time or face fines. I called the inspectors they were helpful and happy to come out, I would just need to call in a violation. However, I can't report the HOA and can only report myself, the homeowner... I'm worried if I do this, I'm going to get stuck with the citations and fines and the HOA isn't going to take any action. The property manager is taking my dissatisfaction with the contractor's work personally for some reason. I've tried to express my concerns politely, but he just shouts about how "he's seen worse" and I need to deal with it. I could see him being extra difficult in this situation. Right now, reporting myself (or giving up) seems like the only option, but I'm scared of it backfiring and starting a huge fight I can't win. Posted: 10 Jun 2021 12:28 AM PDT So I own a BMW 535i, and I took it to get its turbos replaced because they were running underboss and had rattle. I took it to this mechanic and he agreed to do it for $900. After taking an absurdly long time to do the job (3 weeks), he claims its ready. I go to pick it up and find that the car has a radiator and power steering leak, and the AC no longer works. This freaked me out, but I chalked it up to a little mistake he made. He took the car back and fixed the leaks. So when I go to pick up the car again, I drive a block and my car gives me transmission and drivetrain error messages, then dies out. I call him and tell him what happened. He takes the car for a day, and today he calls me saying that he had to reprogram the car (because it was outside of the engine for weeks) by accessing it's ECU, and that the ECU is corroded due to a previous owner that removed a cover and the car cannot be reprogrammed, what do I do about this? I am not trying to pay any more money to this guy, and I need help on what to do as I feel he has ruined my car. I had no issues with the ECU before, and now all of a sudden there are issues. I have a lifetime powertrain warranty that was included when I purchased the vehicle 10 years ago. Truck has been in for an approved claim for the last 16 days. Additional parts have corroded and needed to be replaced that are not covered under the warranty. I authorized these repairs and the charges. I have not paid any money yet. The dealership misses every milestone and fails to update. yesterday 6/7 promised the truck would be finished and ready by EOB today 6/8. They have not called. When I call, the service manager is not available, they answer then hang up, they lie, they even called me after 12 days and asked me if my truck was there. They constantly dick me around. Last year, it went 9 days of them lying and blaming the warranty company. I called the warranty company and started to raise hell but, learned quickly the dealer was lying and hadn't submitted the proper paperwork (that I had given them) I'm bound by the contract to return to the dealer for all repairs. I begged the dealer and warranty company to waive this one stipulation as it was clear they were incapable, they lied and they had no interest in honoring this contract. Warranty said the dealer has to release me, dealer told me to pound sand. I don't know what to do at this point. They're holding my truck hostage. I do not trust what they're telling me and I'm not sure what other avenues to pursue. I tried to reach out to the counties bar association lawyer referral service and they sent me to criminal defense attorneys. I haven't tried contacting any of them yet because their niche is so far from contract law, that I don't want to get roped in with them. [link] [comments] |
