Neighbors hoarded my mail and cost me money!

    Posted: 05 Jun 2021 07:56 AM PDT

I live in California in a house that is split into 2 units as a rental property, as such, my address is the the house address with a 1/2 attached, leading to my mail being delivered to the wrong unit occasionally. I recently received a check in the mail from a settlement I was involved in. After reading it I realized it was from May 2020 and the check needed to be deposited by Sept 2020. There was also other old bills from the same time frame put in my mailbox. The other tenants are now moving out and I believe they have had this mail for a year and just now provided it to me. So basically they hoarded my mail for a year and because of this I am out $5000. What recourse do I have? Is small claims courts the only route?

Neighbor Building a Trench through my Property to Access My Comcast Box

    Posted: 04 Jun 2021 04:49 PM PDT

My neighbor reached out to me saying that he was installing Comcast in his newly built house and would be building a trench through my property to access my Comcast box that is on my garage. They would connect to a splitter installed in the Comcast box, so that he can have access. I have a driveway in place as well as other lines that could be impacted by a new trench being built. It seems quite odd that Comcast would require that there be a trench build through my property vs. just installing a box at the new house. My home is in a rural location and Comcast was installed just a couple of years ago. Am I legally required to allow this trench be built through my property? The neighbor has already hired a builder to install this trench and "informed" me today.

My Ex/Coworker Reported False Accusations with HR

    Posted: 05 Jun 2021 06:31 AM PDT

I was dating a coworker about a year ago and though it was an overall nice relationship we ended up breaking it off, mostly because she felt she rushed into the relationship too quickly after having left her previous one. But I could also tell it wasn't going to work out because we had very different perspectives on a lot of things. So we both acknowledged it was for the better. Not long after, she began harassing and bullying me at work which I let roll off my back because I knew she was only being childish. After awhile I couldn't take it anymore and started reporting the instances to HR. Cut too now; My HR spoke with me and said that a coworker had reported "inappropriate, unwanted conduct, with a coworker, with in the past year, outside of work. That could call for criminal charges." Which instantly narrowed it down to my ex. After all that was said it was very clear that she had falsely accused me of sexual assault while we were dating a year ago. This was just recently reported to Hr. And yes, we do still work together.

Help? First, I have no idea what to expect from this. I would have never imagined she would sink so low as to falsely accuse me of something so horrible. The question as to why is beyond me, I've given up on trying to understand. Could I be fired? It's a completely fabricated lie and with no way of legitimately backing the claim. What should I do? I have been told I should file a counter complaint for libel, get an attorney and sue for libel. All I want is to keep my job, because I need it to be able to pay my bills and support my life. I don't want this to harm my reputation at work. And I want the harassment to stop permanently.

OH: We live near a small airport that trains pilots. Planes regularly fly very close to my house. How low is too low for an airplane to fly over a house?

    Posted: 05 Jun 2021 08:11 AM PDT

My wife and I live in rural Ohio, about 15 miles from an airport that offers flying lessons. We regularly have planes flying what appears to be dangerously low above our house.

Part of a pilot's training is to turn the engine off while in mid-air, then restart it before you hit the ground. Since we are surrounded by farm fields and are on a long, straight road, this is a "safe" place for students to practice this maneuver. It's terrifying to hear an engine roar to life a couple hundred feet above your head, and then surge up so it doesn't crash on top of you.

Stunt planes also regularly use the airspace above our house to perform acrobatics. Often they are so low I can read the numbers on the body of the plane. At first it was fun to see (sorta). Now, it's just noise that seems dangerous to us.

How low are planes allowed to fly over a private house?

    Thanks for your help.

MIL has her 50yo son and unwanted 19yo gf living in her backyard in a tent

    Posted: 04 Jun 2021 08:14 PM PDT

    Hello from Florida,

My MIL (retired on fixed income) has her adult child (50M) living in her backyard with his girlfriend (19F). They were living in the woods behind her house, which is not her property, from late September 2020 until the end of March 2021. In March 2021, the owner of the property had the police remove them from the property. My MIL begrudgingly allowed them to move into her backyard as a temporary measure until they could find a more permanent living situation. The plan was to allow them to stay for about 30 days.

My MIL has never collected money from them for food, rent, or utilities. They have somehow gotten a dog and 4 cats, they have an extension cord running up to the house, they use the wifi, occasionally ask for her to wash clothes when they don't feel like going to a laundromat, and constantly ask to borrow money (that never gets repaid).

Some additional background, her son is often violent and verbally abusive. He's robbed my MIL before and steals her medication if its not locked up. The GF is nasty to my MIL and refuses to take care of the piece of the property she is using. Example of nasty, she tossed her cat's waste into the playground my kids use when they go over there while I am at work. They changed their address to my MIL's address and now have packages/mail sent there.

Where we are today and my question. Two nights ago MIL's son got angry and hit his GF, she decided she was going to leave. Today, my MIL overheard the GF on the phone with someone saying my MIL doesn't have the ability to remove her and will need to give 30 day notice.

At this point, she wants them gone and I am personally exhausted dealing with this. Do we need to file a formal eviction notice? Is the GF an "unlawful detainer"? Should we just call the sheriff's office? Are we screwed?

Driveway is split in half by sidewalk, got ticket

    Posted: 05 Jun 2021 07:42 AM PDT

My house is very close to the street. If i park a car at the front of my garage the sidewalk is halfway back. It's impossible to park in my driveway without blocking the sidewalk as there is no room on either side, half of the car will be on it regardless. On both sides of the driveway is my neighbors driveways so I have no street in front of my house to park in technically either. Is it worth going to fight the ticket? I'm worried that they'll keep trying to give me more tickets but thats literally all the driveway I have. Edit. Have lived here ten years and first time this has been an issue.

My professor asked for money so he can keep making lectures, what do I do?

    Posted: 04 Jun 2021 05:35 PM PDT

His lectures are prerecorded and in multiple videos he asks students to visit his patron page and donate so that he can keep making lectures.

I am paying for this course and obviously, don't feel that I should have to pay more for the lectures. My question is, is it illegal for my professor to ask students for money to make the lectures that we are paying the university for? What can I actually do? I have the time stamps and recordings saved of all of the instances where he asks for our money.

I am in British Columbia, Canada, if that makes any difference. Thanks!

Divorce papers weren’t served but my spouse has them (TX)

    Posted: 05 Jun 2021 08:58 AM PDT

Background: my spouse lives in IN and I live in TX. The papers were filed in TX and the sheriff in her county in IN were the ones in charge of serving.

So when I filed for divorce pro se I paid the sheriff to serve them. They attempted four times and on the forth just left the papers on her door. I received an email from her telling me she received the papers.

However, the sheriff filed the documents as not served because he didn't actually hand them to her and there's no way she's going to fill out a legal document saying she got them.

Now she's dragging her feet. I knew she would but I figured she would be served so I could take the case to court and ask for a default but because she wasn't served I can't do that.

Do I get her served again and use a process server just to get it over with so I can get this divorce already? Is that my only option?

Thank you so much in advance.

Wife asking for large percentage of my income in divorce

    Posted: 05 Jun 2021 03:40 AM PDT

[US, Divorce filed in AL (Military, that might be important info)]

Backstory: we got married in Louisiana then the military moved us to Japan. Married total for 9 years. No kids. No house (just rentals), We filed for divorce in AL because that's my home-of-record and where she lives now.

Ex-wife and I lived together in Japan. Before moving back stateside, she agreed to a no-contest divorce. I'd let her keep all of my furniture/ownings, and I'd just start over from the top. She was jobless from 2016-2020 while we were there.

I got moved to Korea and she's still in Alabama. We agreed to file a divorce while we are separated. I've been granted an extra housing allowance to help cover her housing/utilities. I've agreed to pay her this housing allowance until we're divorced and I stop receiving it.

I hired a lawyer just to file my divorce for me.

She's since changed her mind about what she wants out of the divorce.

    1. She wants her fulling housing allowance. (I was inadvertently not paying her enough because the amount that I was being paid for her housing changed. I've already agreed to pay her the difference. ~$2,800)
    2. She wants my GI Bill so she can go to college (I've already transferred this to her, so done)
    3. She wants $1,000/month for 3 years (She's since changed this to $800/month for 3 years)

The issue here is that before I receive my allowances, I only make about $37k a year. My lawyer agrees that this is an obscene amount of money.

Unfortunately, I can't continue to afford my lawyer because the cost to sign a new retainer is $7,500. Due to high cost of living and some crazy high-interest credit card debt that I've been chopping away at, I don't have that much money sitting around.

Is there any recourse that I can take? Is there some type of way to help me afford further legal aid? Can I challenge her without a lawyer from 7,000 miles away?

Idaho: My pregnant niece is wants me to take her to get an abortion without my sister knowing. What are the potential legal issues?

    Posted: 05 Jun 2021 01:27 PM PDT

My 16 year old niece told me she was assaulted by her ex and got pregnant (but didn't do a r*p kit so no proof) and is begging me to take her out of state(potentially to Nevada where parent consent isn't needed) to get an abortion since Idaho requires parental consent from my very pro-file sister who would never agree. I am willing to pay for the operation and drive her but Im worried about the legal issues from my sister if she were to find out (she doesn't know her daughter is pregnant or was assaulted).

My (21m) friend ran away from home to escape his abusive parents. At the moment, his parents are planning to involve the law by issuing a court order.

    Posted: 05 Jun 2021 09:15 AM PDT

    PH.

Not sure if it fits here but, me (20f) and my friends know about his whereabouts and the details of his situation. Basically we are helping him hide from his parents, but the problem is they're looking for him relentlessly, even going as far as visiting each and every one of our homes. They also filed a missing person's case on a nationwide scale, rendering him unable to apply for a job. In addition to this, they are subtly threatening us with the aforementioned court order to view messages between us and our friend, and between our circle as well.

My friend does not want to go back and live with his abusive parents again. He endured years of physical, verbal, and emotional abuse. Me and my friends need some advice on what we can do from here onward, like what can we do against the court order if they actually went through with it?

CA: My sister petitioned and failed to renew a restraining order against her abusive and stalking ex-boyfriend. Now his lawyer sent her a bill for $5200.

    Posted: 05 Jun 2021 11:35 AM PDT

Like the title says, my sister was attempting to renew an existing restraining order against an abusive ex-boyfriend. He lawyered up and attempted making a case that she broke the restraining order by calling him and asking if she were familiar with several phone numbers from call records that she did not know. My sister could not afford a lawyer, and was generally unprepared to make a compelling and comprehensive case despite bringing in printed pictures of past bruises, letters from her ex apologizing for physically abusing her, screenshots of him threatening her and the rest of our family if she were to leave him, and videos of him threatening to kill himself. She suffers from generalized anxiety and PTSD and was like a deer in the headlights when it came time for her to make her case. The judge made a quick decision without looking at her evidence and said that what she brought forward was not sufficient for an order.

Three days later she receives a letter in the mail asking for $5200 to pay for HIS lawyer fees. My questions are: is this legal? Can she be actually held responsible for these costs? If so, what is her best chance of fighting this? If what they're asking is not legally enforceable could she simply ignore the letter?

Thank you ahead of time, this has been a long running and extremely stressful situation for her and our family.

Roommate continuously wakes me up intentionally, would that be considered harrassment?

    Posted: 05 Jun 2021 05:35 AM PDT

    Hello from Florida,

**If this is the wrong place to post this, I apologize. I wasn't sure where to post it.**

This topic sounds crazy, I know, but it feels even more insane to be living with it. I live with someone who constantly wakes me up at night intentionally. They will slam doors, move furniture around (in the middle of the night) and switch out the batteries of the fire alarm so it beeps continuously, all while I'm trying to sleep. It's been ongoing all week and used to happen before my nephew came to live with me, but I guess she couldn't bear to keep him up all night, so she stopped when he was here. I have confronted her about it, but she always acts like she doesn't know what I'm talking about. I know you're going to say I should move or find a different roommate, but our lease is up beginning of July and I am not able to move before then. I will *not* be living with her and she knows this, so why she's doing this to me is the most confusing thing. I've asked her if she's mad or upset or if I've done something unintentionally to upset her, but she always says she's fine. However, I work from home and the lack of sleep and ongoing fire alarm issue is definitely impacting my work performance. It's at the point where I'm wondering if I can report it for harassment. I don't want to go that far, but I don't see any other solution.

    Any advice?

Ex-Girlfriend Sent Picture of Daughter (6 F) in underwear with shirt off, and constantly sexually harrasses me. I'm A Worried Father That Wants My Daughter To Be Safe, What Do I Do?

    Posted: 05 Jun 2021 07:46 AM PDT

Hello, Reddit. Throwaway account, for the following explained. I feel rather nervous posting on here, but I'll give this a go without giving away too much personal information. For some background knowledge, my grandmother and I speak to my daughter on her own account, that can be monitored by her mother given she's only 6 years of age.

I (24 M) have been dealing with the mother of my child (26F) constantly berating me, screaming at me, putting me down in front of my child. I could handle all that, to some extent. My daughter has voiced her concerns about when her mom gets like that, it upsets her. And she, by her own admission said her mom needs anger management issues. No 6 year old should have to speak about something like that, but that's beside the point. My grandmother called my daughter, and had asked her if she can send a picture of herself, or if she can't to ask her mom for help.

I get this picture of her with her shirt not even on her arms, but merely hanging over her chest with her underwear on. I inquired about this with my daughter of why she would send me something like that, even though I could clearly see her hands as it was her full body in the picture. I told her I would like her to put on clothes the next time she sends me a picture as well.

She informs me that her mother had taken the photo and she doesn't know why she did that, since she trusted her mom. I confront her mother on this, and she mentioned that I could send that to her grandmother. A few days pass, and my daughter seems very sad and disheveled when she calls me, I ask her what's wrong and see why soon after. Her mother begins screaming about her asking for toys, as children do. And begins berating me and cussing at me, visibly distressing my daughter. I get her to calm down, and then her mother, my ex for clarification, begins interrupting our phone call pressuring my daughter to ask if she (my ex) can kiss me. As if that wasn't enough, she tries asking my daughter to ask if I can live with them, under the guise of it being from my daughter. My daughter calls her mother out on this and begins having a meltdown from the pressure of being put in the middle of all this. I had to hang up the phone and walk away as I was beginning to shake and have bad anxiety.

This all seems pretty bad as is, but to make matters worse, I'm not even in the same country as them, so I'm not even sure if I could even get custody.

Now, I'm no legal expert of any kind, but I'm not sure of what I can do in this situation, and would like to seek help of any kind. Please, any help you can offer at all would be amazing.

my dad messed up my credit

    Posted: 05 Jun 2021 08:55 AM PDT

At 20 I still lived at home & my dad (who did not and does not have a license) was looking for ways to buy a new car so he could still commute to work & "provide a roof over our house." He had already ruined my stepmother's credit, cheated on her & requested a divorce, so surprisingly she wouldn't agree to sign for a car. I had just gotten an insurance settlement from an unrelated car accident, and he knew I would lend him some if he guilted me. He told me if I didn't help him get a car then my sisters and i would all be homeless and it would be my fault. So of course, naive me goes with him to the car dealership & signed for his new car & paid $4k down for him. He also had his coworker co-sign for him, since I was young and hadn't really established any credit yet. A year later he kicked me out of the house and I hadn't spoken with him since, except for 2 years ago when he called me because he didn't make his payments on time & the car got repossessed. He just decided he was done with the car I guess. Fast forward 5.5 years later and I'm still struggling to fix my credit. I haven't been making any payments on it, and I've read that it'll fall off my credit in 7 years. Is there a better way to fix my credit or should I just keep waiting for that to fall off? Can I sue him for the money? I don't have any proof that the car was for him.

Bought a house from a flipper, was not provided with seller disclosure. Found water damage that the seller attempted to conceal.

    Posted: 05 Jun 2021 10:50 AM PDT

[Georgia] We bought a house from a house flipping company in February. We asked for a seller disclosure, but the seller refused to fill one out because they didn't live in the home. We had an inspection done and the house passed.

A few days ago, we noticed water coming up from the seams of the LVP in our kitchen. We discovered that there was a pipe behind the dishwasher that had began to Crack under the weight of the house because the framing has been completely rotted out by years of water damage.

The seller had to have known about the issue because he had installed new cabinets, a dishwasher, and brand new flooring. He even left a piece of flooring behind the dishwasher right in front of the moldy, rotted wood.

Do we have any recourse or are we SOL? We had been planning on redoing a few things in the kitchen, but now we are looking at a full gut and remodel.

ETA: I will try to answer all questions the best that I can if my post is unclear. We are so stressed and angry about this that it's hard to think straight.

Online store refuses to refund me and is threatening to fine me if I file a dispute

    Posted: 04 Jun 2021 03:26 PM PDT

I recently purchased an item from an online hardware store that was approximately $100. A few days later, this company cancelled the order but did not refund the full amount, instead keeping 5%. This isn't a huge sum of money, but it was enough to make my blood boil. How could they keep my money when THEY are the ones that cancelled the order?

So I reached out, and told them I wanted the full refund or would be disputing with my credit card company. I quickly received a response, and here are the highlights:

"You explicitly agreed to the Terms of Use by electronically signing said document, as a legal and contractual condition of sale. It clearly and concisely states the following:

    3) Handling Fee - 5% of the invoice is a non-refundable Handling Fee for placing the order. This fee is not part of the purchase price of the product and is not refunded upon return or cancellation, including involuntary cancellations.

Therefore, your statement regarding said is false, and your insinuation of illegality is absurd. As previously stated, your order was refunded. The non-refundable Handling Fee for your use of the website and our processing of your order has nothing to do with the product you purchased.

You are certainly welcome to make a big deal out of a few dollars. However, please be advised that any action you take may result in additional fees as per the Terms of Use. I would strongly advise that you read the contract that you electronically signed. Note that we maintain your digital signature, and in fact, no transaction is permitted without manually checking a box stating that you read and agreed to said Terms of Use."

And BTW, the terms of use essentially states that they'll fine me $1000 for disputing and send it to collecitons, among other things.

Tell me Reddit, how TF is this legal? And what can I do about it?

Can’t sell condo bc of another owner

    Posted: 05 Jun 2021 09:00 AM PDT

I have owned a condo in DC, purchased in 2010. It was new and at the time, so like the other buyers, I bought from the builder. Without any good reason except that I he is extremely lazy, a jerk, and very wealthy, he never sold many of the units. They sit empty, unrented and not for sale. He's even had good offers and will sort of respond but not sell. He pays his dues but his empty condos have caused some maintenance issues for the building over the years.

I want to sell my condo, and so some other owners in the building - but because he owns a large percent of the building, buyers can't get regular financing from banks. They would have to make a very large down payment, and find a willing lender. We had an agent to sell who partnered with a lender that does these kinds of loans, and still could not sell- at least without whatever large reduction in price under market value. There just are not enough buyers who can and are willing to make a very large down payment like that.

The bylaws don't address this situation in any way.

Do I have any legal options?

Employer Says I Owe Double My Salary For Breaching Contract After Sending in Resignation

    Posted: 04 Jun 2021 05:43 PM PDT

I submitted a two-weeks notice for an at-will employment job yesterday, and I just received an email saying I was within "several hundred violations of your employment arrangement ... for more than 90 days." This is the first I am hearing of a contract breach. My contract is 4 pages long and contains less than 20 points that I could violate. I am under Florida state law in terms of employment. EDIT: I live in the state of Maryland and WFH, but my contract says I am under Florida law since that is where the company is based out of.

I am an at-will employee. My contract says if I was not performing work properly, my employer could have terminated my employment, but I never received any indication I was ever in breach of contract or that I was in danger of being fired up until today — after I put in my two weeks.

My employer listed three somewhat specific examples of breaches, and they have little to no weight. My employer also says I owe $50,000+ worth of damages. My yearly salary is $51,000, and I have worked for half a year. I am unsure how that $50,000 could be factored in then, and he did not specify where that number came from.

My employer instructed me to "Please let us know prior to Sunday's [at 3:30 p.m.] how you wish to address the failure to follow your contract."

I am unsure how to respond to this request. He has not threatened any legal action. I am unsure what he can do, and I don't know what to say or the best way to respond. I have been exploited and run to the ground by this employer who makes a LOT more money than I do, and I can tell this is just an intimidation tactic to get me to do more work.

Please let me know the best way I can respond, what he can actually do to me, and what I should be mindful of. I can post specifics and answer any questions. Thank you so much.

Can a beaded necklace infringe on a trademark?

    Posted: 05 Jun 2021 08:47 AM PDT

I have a small Etsy shop that makes fan merchandise. I recently uploaded a beaded necklace with the word "SOUR" on it, and got messaged saying I'm infringing on a copyright/trademark (they gave me numbers for both) saying a beaded necklace infringes on these as they own the word sour for merchandising. I have to take it down or they'll take legal action against me. How can someone copyright/trademark the word sour? And is this the end all be all and my shop has to have it taken down?

Instagram and Facebook have no way to get in contact with support or speak to a real person. I messaged the guy on facebook and he blocked me. I messaged him on LinkedIn and I am expecting a block soon. I know he works at Saudi Aramco and am thinking of trying to get access to him by emailing their people... not sure how successful that will be.

Stuff from apartment all thrown out

    Posted: 05 Jun 2021 10:41 AM PDT

    Hi,

I've been staying in an apartment for the past 7 months, and my lease isn't over yet. I recently visited my hometown for a week, and when I got back, all of my stuff from my apartment was thrown out. I assume part of this is my fault- I was using an extra room in the apartment to store my stuff, though I technically wasn't supposed to (the lease is for 1 bedroom in a 3 bedroom apartment, but no one is using one of the other rooms.) That being said, they threw out everything from both rooms- does anyone know if I can get any reimbursement, or am I out of luck?

    Thanks!

Parents Ex Boyfriend won’t let movers come in so they can get their stuff out

    Posted: 05 Jun 2021 08:38 AM PDT

My one friend's mom broke up with her boyfriend and now they are moving out. It's his house and he is not allowing them to get their stuff until next Saturday. They originally wanted to have movers come get their things but the Ex won't allow it. He was only going to allow my friend, her grandfather her mom, myself, and another friend come help move things but now is not letting the grandfather help. He is saying that it's because of covid but he doesn't even believe in it. I'm just wondering if legally she is allowed to have movers help get her stuff or if she does have to listen to him. This is in Canada by the way because I know laws are different from country to country.

    Landlord Forged Cosigners Signature (Kansas)

    Posted: 05 Jun 2021 12:14 PM PDT

So I signed a lease with my mom as my cosigner since it was my first apartment. A few months later I got a dog which apparently broke the original lease. They had to rewrite a new lease and I had to sign it. They copy pasted my moms digital signature on their and never reached out to her about the new lease so she never even had a chance to look at it. I told her about it and she had no communication from them. I'm no longer with that place but have already begun the process of filing a lawsuit for an unrelated issue against them. What are my options with the forged signature?

    Union contract question

    Posted: 05 Jun 2021 07:31 AM PDT

I'm in a nurses' union. We voted in a new contract over a year ago. Before the vote, the hospital and union provided us with one contract per unit to read for a couple weeks before the vote. This wasn't even the finalized contract because changes were made after the contract we were given. The reps held Zoom meetings to explain the details of the contract and answers questions, but they were very misleading and gave incorrect information. The contract somehow passed! Now it is over a year later and we are finally given personal copies of the contract to read. And of course they're made available before we vote for our unions reps. This seems so incredibly illegal.

What makes me most angry is that we were working without a contract for over a year. So no raises were given during that time. We weren't given retroactive pay. Basically the hospital got away with not giving us raises for a year. We did get a $1,000 bonus and a small pay raise. But our health insurance changed and our union dues increased. It kills me that people voted in a contract that increased the cost and decreased the quality of our health insurance without reading it!

Is this normal? It feels so shady.
