    (NY/SC) My NY family went to visit my grandfather in SC for Memorial Day weekend for the first time post-COVID. Grandfather died unexpectedly during the trip, and given that they were already in town, the visiting family arranged a quick funeral within four days.

    He leaves behind two daughters and grandkids. No spouse. The elder of the two sisters paid out of pocket to make the arrangements. In the process, we asked if he had left a will in case he had any funeral wishes that should be honored. Relatives tell us that he did, as well as an insurance policy. They say he left a copy with his younger daughter who refused to share a copy of it prior to her arrival for the funeral, and another copy among his belongings, which we no longer have access to.

    When the younger daughter arrived, she stated that the deceased verbally communicated that his wish was for the older sister not to see the will, and that he left nothing to her. She says that he willed his estate to her to manage. There is no one else to corroborate this. She has asked us to submit any funeral receipts to her and she will reimburse us for the costs of what we paid. She has also demanded possession of the keys to his properties and car, stating that she needs to sell it to settle his many debts (as the "tech savvy grandkid," I helped to manage his bill pay and credit karma, and can confirm he died with only small credit card debt). The other sister handed over to avoid conflict.

    This is incredibly distressing to the other sister, for obvious reasons, but also because grandfather had verbally communicated leaving a percentage of property to the eldest sister (which many people can corroborate). We are quite well off and not hoping to inherit anything, but she is upset that the courtesy of closure is not afforded to her. The deceased is the sort of person who would have established a trust if he were attaching conditions to his possessions.

    What can we do next? I am unsure of who his probate lawyer is, though I do have a few messages out awaiting a return. I do know the name of one insurance policy holder, but he owned property in several states. Is there a way to find all of his assets? We would also like to find legal representation to administer the will exactly as it is writ. What are my next steps?

    California - can a mother illegally keep child away from father?

    My ex and I had a written agreement that we would get 50/50 custody. We've had the same agreement for 3 years now. Last weekend I went to our pick up place and she wasn't there. I then texted her asking if she was near, and she texted back saying "I have been advised to keep them from you."

    I was confused because just before the pick up date we were making doctor appts for the boys. I asked her who advised her, and she never responded. I then began calling her and she blocked my number.

    This is completely out of nowhere. She recently moved and I don't know where she lives. I went to her mother's house and they called the cops on me and the cops wrote a report that they're keeping my kids from me, but legally there's nothing they can do since there is no court order, only a written agreement.

    I haven't seen my kids in two weeks. I've started the court custody process, but I miss my kids. I want to know if they're okay. Even if it's just to talk on the phone with them. What can I do? What are my options?

    EDIT- I've called the courts and there is no court order. She hasn't tried to do a custody battle at all. I can't do a wellness check because I don't know her address and they can't force her to give it apparently.

    How do I go about removing an easement and getting my neighbor to stop using my fence?

    Okay, so I have a nightmare neighbor. She is the type that drives everyone out of her life and looks for conflict just to have any interaction at all. Spent 2 years being super nice and doing work for her to help maintain her farm. Eventually had to tell her to stay off my property and leave us alone.

    I have a flagship lot which my farm is on. We have many horse paddocks and a barn. My elderly neighbor has the property next to ours, and we share a long driveway that is on my property. The easement was in place from the previous owners with my neighbor.

    Between the horse paddocks that speperate our two properties, there is a bridal path. The property line is right in the middle of that path.

    I recently spent 40k replacing all my fencing with new fence. My neighbors fence is in need of replacing too. She decided she would just remove her fence, and allow her horses to graze all the way into the bridal path, using my new fence as a boarder for her paddocks. So she is extending her paddocks onto my land, and blocking my access to that side of the fence on my property. On top of that, she is using my fence to contain her horses. I have an electric line on the inside of my fence line to keep the horses from biting the wood and leaning on it to scratch themselves. There is no line on the outside, because there aren't any animals there, or there wasn't until she did this.

    I dont want her horses ruining my new fencing and grading on my land, cutting me off from my half of the bridal path and the ability to maintain my outer fence line.

    I would also like to nullify the easement and have her put in her own driveway. I want her out of my life completely.

    How do I go about doing this? What type of lawyer am I looking for? How do I go about removing her from my life and getting my property back?

    To start off my sons (5) mom has court ordered drug tests. She failed her last test and it came back positive for PCP

    I'm in AZ. There is a court order in place currently and we recently had an evidentiary hearing because the mother filed a petition to modify the existing order. I have not yet received the new order the judge is going to put in place.

    I am not sure what to do and his mom is telling me that I do not have any right to keep my son from her.

    The current court order states that if she fails a drug test, she reverts back to weekly supervised visits. That is what I explained to her but she is telling me that she will simply pick him up from his daycare. She previously failed a drug test back in February, again on May 13, and today was the latest positive result.

    I am not sure if I can simply go to the court and speak with a judge due to Covid. Not sure where to start but I am extremely stressed about the situation. If any additional clarification is needed, just let me know. Thanks for reading any advice would be appreciated.

    [Minnesota] Fired right after I was told that I might have cancer, just before I could find out. Now they are dragging their feet on unemployment.

    I was hospitalized three times. My employer also made me leave work three other times because my face swelled up and they asked me to leave.

    After third hospitalization, I was told they found irregular cells and that it could be cancer.

    I missed work for these hospitalizations, it I was literally unconscious in the hospital from how much pain I was in.

    They fired me the next day after the third hospitalization. Their stated reason was that I was sick too often (though I was never plainly sick, I was hospitalized each time. It's more than just being "sick.")

    I filed for unemployment that next day. This was May 10th.

    It's now June 3rd and I still have a hold on my unemployment. It says they are waiting for some cover letter from the employer. It says they have responded, but doesn't let me see their response.

    I can't believe they can just fire me, cut off my insurance, and now presumably deny me unemployment right before I could confirm if I have cancer or not. I can't even get the biopsy now cause I can't afford Cobra insurance without the unemployment.

    Apparently it's illegal to fire someone with confirmed cancer, but firing someone because they might have cancer is totally cool?

    I don't know what to do anymore.

    a friend of mine (15F) just found out her mom's boyfriend is a level 3 sex offender, what do i do?

    I live in Washington State, I am a minor and so is my friend, we recently found out her mother's boyfriend is a level 3 sex offender while we were just searching up his name. Her mother and herself see him a lot, doesn't that basically mean he isn't allowed around children? (since he is a level 3 offender) I made this account just to get some answers. I am very afraid for my safety and my friends safety, since again, we are minors and all of his charges are related to children.

    I hit a pedestrian and it was completely my fault. What do I do next?

    Last week I was making a left turn from a stop and ran into a pedestrian as he was crossing the road. It was completely my fault, he had the right of way and I wasn't paying close enough attention. I've been feeling absolutely terrible about it, nothing like this has ever happened to me before. Luckily he wasn't badly injured and after an ambulance came to check him out, he was able to walk home from the scene, thank god.

    My question is how do I handle the ticket. My instincts are telling me to just plead guilty to this. I called 911 when it happened and talked to them about the whole thing so they know I did it, and I also don't want to disrespect the person I hit by trying to get out of this. My Dad and therapist agree with me, but my Mom is dead set on me pleading not guilty to try to reduce whatever sentence I get. I'm finding it hard to think straight when it comes to this, the whole event has shaken me up so much, and I'm hoping you guys can give me some clarity. Should I plead guilty like I'm assuming I should or would pleading not guilty be justified somehow? I'll be around to answer any questions if you need more info.

    EDIT: This was in NY, Queens specifically.

    [MA] Friend was terminated from his salaried job but is being offered a contract position for lower pay from same employer - is he eligible for unemployment?

    A friend of mine was terminated from a salaried position with his employer. However, the employer is offering him continued work as a contract employee, for significantly lower pay (when taking into account taxes on contract work).

    He is very reluctant to accept the contract position as it's basically a demotion, but he's also not sure whether he'd be eligible for unemployment if he declines it, since he is being offered some form of continued employment. Would the state view this as him "quitting" his job or being terminated?

    Animal Control keeps coming by, for an Animal i don't own?

    So ill start this off by saying i owned a Rooster, i had it ever since it was a baby, but i had to move recently and the DAY i moved into my new neighborhood it Crowed once or twice, and that was enough for Animal Control to be called on me, apparently its Illegal to own a Rooster in the city limits, which i didn't know. so i tearfully gave my Rooster to the Animal control guy and i thought that's that.

    well today, 5 days later, i got a notice on my front door saying i needed to get rid of my Rooster, that it had been crowing and i was going to be fined if i didn't do something about it. i haven't had the rooster for 5 entire days now, there was NO crowing, apparently the animal control guy is going to come back, i called them and told them the situation, so i have no idea what to do. what would you guys do?

    [VA] Can an NDA prevent someone from going to therapy?

    My adult daughter has trauma from a particular organization that wasn't disclosed until she was an adult. It was horribly mishandled and I regret everything that happened, but the result is that the organization was able to put my daughter under an NDA.

    She now desperately wants to go to therapy to help recover from some of her issues, but is concerned about the organization being able to sue her due to the NDA. I thought it was ridiculous, but then I was able to read it, and I'm not so sure.

    With the way the NDA is written, it seems to her (and I) that she could face legal consequences if she talks about it anywhere with no exceptions, including in therapy. She is deeply traumatized by, well, everything, and I'm horrified to think that in addition to everything they controlled and took from her for years, they can also control and take away her ability to even access mental health care services.

    Roommate Abandonment

All of my roommates things are still there and she has no plans on coming to empty the apartment. All of my things are removed but because we have both signed the lease, we are mutually responsible. We live Virginia. What should I do? What could be the possible consequences?

    Landscaper did extra work and is charging $1,500 extra without approval

    We had our full lawn put in recently, landscaping, grass, irrigation system. There ended up being some pooling in the back yard when they graded for us. They discussed this with me, told me they could just put a French pipe drain system in to connect to our runoff drain. This conversation was casual, seemed like it was just what needed to be done. It was just, "we'll get this done for you." I said that's fine, they came a couple days later and took care of it. They finished installing the grass and now they are asking for the payment, which tacked on $1,500. This was not included in the original agreement we signed, and no price was discussed for this service. I took it as they're just doing it, not as a blank check for them to do whatever. If I'd know it was that much more, I would have found a different solution. What are my options here? With no signed agreement, am I on the hook for the $1,500? I did say for them to do it, which I understand may be my downfall, but the conversation we had was not along the lines of, we can do this for $X amount more. I'd assume I can either just tell them I never signed anything and not pay, or negotiate it down, which I wouldn't be happy about, but may have to do.

    Taxes on hobbies

    Hello, I am an 18 year old from Los Angeles, California, USA. Sorry if this is a little stupid.

    I run a few online game servers that generate around $200-400 a month, with a $200 operating cost. I have a main part-time job.

    I've been doing this when I was younger, but since I am 18 now I figured I should look into reporting this to avoid getting into unnecessary trouble.

    Let's say for convenience I earn $500 a month from the servers, with a $300 operating cost, and I put the $200 back into the game server to grow it. The tricky bit is that I never intended to profit from this and always put most if not all the money back into it. I usually break even with operating costs. It's not a registered business of any kind.

    Would I need to pay tax on:

    1. the full $500
    2. The extra $200 I reinvested
    3. $0 since net profit would be $0

    Side questions:

    1. Is there a certain amount I have to hit before I need to pay taxes on this kind of stuff?
    2. Is it realistic to report online income for whats considered, I guess an "odd job"?
    3. Should I register it as a business anyway?
    4. If I am operating at a loss at some point, do I have to mention this at all on my taxes?

    [MA] I have rented a house from my mother for 25 years. When I moved in, she had the house hooked up to the town sewer system, which sends a quarterly bill. I have never received such a bill, and recently found out that neither has she. What is my liability when I inherit the house?

    To elaborate, the house had a small, definitely not up to code "septic system" (really more of a cesspool) and when I moved in my mother had a professional hook the house up to the town sewer. The town sends a quarterly sewer bill based on water usage, and all these years I had assumed the bill was sent to her at her address as she is the owner on the deed. Recently she was hospitalized in serious condition. I have POA and took over paying her bills. I found out that she has never received a sewer bill for the house I live at, just her own house. All this time I assumed the bill was being sent to her, and she assumed it was being sent to me and I was paying it! It just never came up in conversation.

    She is very elderly and in poor health so unfortunately I may inherit this house sooner than later. What is my liability for this sewer tax? I have no idea when the error occurred as far as the town knowing the house is on sewer. I don't know if the company that hooked it up never notified the town, or if the town never recorded it. If I tell them now, or if I sell the house, will I have to pay the sewer tax for 25 years retroactive?

    [NC] Does a CDL overwrite an existing Class C driver license?

    I had a Class B commercial driver license that expired in July 2020. Fine by me, I wasn't driving commercially anymore. However, with its expiration, my Class C driver license seems to have expired, even though it's supposed to be valid through July 2021. The NC DMV phone system reports that it is expired, and a police officer remarked that it was expired. Both licenses have the same license number.

    Is this a system error, applying the same status to both licenses, or did acquiring the CDL invalidate the Class C license?

    My Ex Boyfriend owes me over $6,000 and I am unsure of how to proceed [INDIANA]

    I am 22, My ex is 25. We got a place together in July of 2020, He illegally changed the locks to our house and kicked me out only 6 weeks after I moved in. My name was on the lease, His name was as well. I paid the entire first months rent ($700) in addition to paying the security deposit in full ($1,250)

    He also kicked my 3 month old kitten in July of 2020, I paid the surgery in full ($4,114) to save his life from the injuries he sustained. I have text messages from my ex admitting he "accidentally" kicked him, although his story doesn't align with my kittens injuries. I also kept receipts from the vet and surgeons. I have proof of everything that has been done to me, including the illegal change of locks to my home without my permission.

    We had been no contact since August of 2020, He recently messaged me apologizing for all of his wrong doings, and said he wanted to get back together. I turned him down, and decided to ask for A PORTION of my security deposit back. I made him an offer that if he will pay half of my security deposit back to me, I wont take him to court for everything else he owes me. He denied my offer and is refusing to refund any of my money. He is stating that I signed a lease with him, and all of MY security deposit money will be awarded to him since my name is no longer on the lease, which is true.

    I am unsure of whether or not I should go to small claims myself and file a claim, or if I would be better off getting legal advice and an attorney first. I am having a very hard time figuring this out. I want to know what my chances are, and what to expect, before I go in blindly.

    NC - DSS has custody of my son (my choice) to protect his younger sister. What's next?

    I posted about a situation a couple months ago, https://www.reddit.com/r/legaladvice/comments/m1mes6/nc_teenage_son_is_doing_whatever_he_wants_younger/

    Since then, he was interviewed by police, confessed to abusing his sister, was arrested and then spent a few weeks in Juvenile Detention. In court I said no to him coming home -- due to risk of further abuse. (He has circumvented every camera, control, lock, safeguard and rule I have put into place and I cannot be awake 24/7 to monitor him.)

    The court then placed him into DSS's custody, and DJJ then found an emergency placement for him and he moved to a temporary group home. I'm still the legal guardian, and am coordinating his appointments, etc. He is not permitted contact with his sister.

    In DSS/CPS situations I've read, it's the caregiver abusing a child. Since that's not the case with my situation, I'm finding it difficult to learn about what to expect.

    They want a CFT meeting and also want to do a post-custody meeting. I've told DSS (aka YFS) that him returning home would make it unsafe again for my daughter. They said that they would never put other children at risk, however said they still have to create a reunification plan as a first goal, but noted that the timeframe can vary.

    He is resistant to therapy, has had multiple other interventions already, and his behavior has never improved over time. I cannot see any circumstance where I would consider it safe for him to return home. No family will take him due to his other behaviors. DSS have said he will difficult to place because of his age, autism diagnosis, and sexual behaviors/history.

    He has a court date coming up eventually to deal with the felony charges. I would prefer him to receive mandated treatment rather than be subject to incarceration. They are not planning to try him as an adult and are aware that he is not neurotypical.

    His social worker has arranged for him to get Medicaid.

    I am not seeking parenting criticism.

    I'm open to general advice, but here are some specific questions too:

    • Are there any resources, support groups or even specific subreddits for someone in my situation? (again, all the online stuff I've found just assumes a child is in DSS custody because of parental abuse)
    • What should I expect, both at these CFT meetings, and for the coming weeks/months?
    • Who gets final say in whether he comes home, and when?
    • Where might he go to live if not? (Someone mentioned therapeutic foster care)
    • Could he end back up in Juvenile Detention if they cannot find a place for him?
    • Is there a possibility that my parental rights will be removed if he does not return home?
    • Would I get any say in what happens to him if found guilty in court?

    I've been told by the professionals that I'll find more out at the CFT meetings, but I want to be more prepared going into it.

    University charging me after refund

    I'm in [Massachusetts], the university is in [Maryland]

    In 2019 I withdrew from the graduate program I was attending. The tuition was $10,000 which was completely covered by a $10,000 federal loan. When I withdrew, financial aid contacted me informing me that based on the point of the semester that I withdrew I would be receiving a partial tuition refund. I double checked their refund policies on the university's website and confirmed this. Since I did not pay anything out of pocket and was paying with a loan, I did not actually receive any money, instead financial aid reduced the borrowed amount to match how much of the tuition I owed. The $10,000 was reduced to $5,500 (a $4,500 refund), I withdrew online, and went in person to sign a withdrawal form. Great I thought, I am okay with this and accept all I have is this $5,500 federal loan that I am currently paying off.

    Fast forward to earlier this week and I have received a letter from a collection agency. The school is stating I have an outstanding student balance of $4,500, the same amount they refunded and lowered my loan by. I had previously emailed the student accounts office (bursar office), as they were the ones that contacted me about the balance, and the reply was essentially yeah it's strange that your loans were reduced but not the tuition, go contact the registrar. So I did but they were no help and just forwarded my email back to student accounts because I "was already working on it with them" ... Yea I was working on it with them and they sent me to you. At this point student accounts never replied to the forwarded email which was similar to the one I previously sent them just geared towards the registrar. After a few weeks of silence I sent another email, more detailed, explaining my previous emails, going to both bursar and registrar, and receiving no help. I once again received no reply and it feels like I'm being ghosted. Now they go and send the bill to a collection agency which has already negatively affected my credit score and I am very upset about.

    So now I have $5,500 federal loan (which I have no problem with) and a $4,500 debt for a total of $10,000, the cost of the full semester. Except I withdrew, was given a refund, and therefore should not be having to pay to the full semester. I believe this has to be a sort of system error. I'm not big on financial terms but the account statement shows (before withdrawal), +10,000 tution, -10,000 federal loan. Charged 10K tuition and paid 10K with a loan. But after withdrawal it just shows +4500 federal loan and nothing else to balance it leaving me with a balance of 4500 that I supposedly owe the school except I do not understand how I owe this. I pointed this out when I first emailed student accounts where they agreed it was strange and they have been quiet ever since.

    What should be my next steps? Continue reaching out? Target specific higher ups since the general office emails are ignoring me? Consult a lawyer for legal action? I plan on submitting a written statement disputing the validity of the debt to the collection agency as the letter states I can do but it feels like the university will just counter with the account statement as proof of the debt.

    (I've seen other posts about tuition refunds and posters not attending classes. I want to clarify I 100% withdrew, I did not simply just stop attending classes so that is not a reason they are trying to get me to pay the full cost)

    Grandma is dying in Brazil, my US passport is in the process of renewing(mailed in). But have my Brazilian passport- can I leave the USA with it?

    Trying to get a flight today or tomorrow- but could use some advice. Im at a loss and would love to see my grandma before she passes.

    Update:
    I got confirmation from United that I can leave with my Brazilian passport ( flights booked for tomorrow)

    I also got confirmation with United that if I have a copy of my old passport(thank gosh I took a pic before sending it in) + Social Card + Birth Certificate - that is enough to enter the plane bound for the US. They mentioned, they are almost positive I will have to go through a secondary inspection.. but that's the least of my worries.

    Paid an attorney 50% of his fee (other half due later) for a case and was just notified today that there is a pre trial hearing in a few days but I have not been able to get in touch with my attorney for days now. What do I do? Do I try to get another attorney on such short notice?

    Aunt is getting audited-wants to 1099 everyone for multiple years

    So my aunt runs a small cash-mostly business. She drastically underreports what she makes and has paid her kids and various family members cash over the years for working for her. Since being audited her first reaction is to 1099 everyone that has ever worked there--going back several years (she is offering to cover everyone's back taxes). She is also including the cash equivalent of any gifts she has ever given us in these 1099s (including money for college for two of the kids). She's really political and thinks that this stuff is ok and that she is not going to get in trouble. The IRS is really moving in on her though and I am worried. They started with 2 years and are now up to 5 years.

    1. Do these actions--the avalanche of 1099s--make her look more guilty? (I do care about her and don't want her to get in more trouble).
    2. If we all go back and add 5 years of 1099s is that going to make us look guilty? These 1099s range from 2,000 to 23,000.

    I want to make sure those getting a bunch of 1099s (most in their 20s now) aren't going to get in trouble, but also want to help my Aunt.

    Tenants threatening to call police over our legal property

    Apologies in advance for any mistakes since this is the first post I've ever made on Reddit.

    Some background... -We're in Canada -Property previously used to be a rental property so both upstairs and downstairs were rented out prior to us purchasing -We evicted downstairs tenants so we could move in (upstairs had been living there for 14+ years so maybe that's where their sense of entitlement comes from?) -When we bought the place 2 sets of washer and dryers (one set in garage/one set in downstairs suit) were legally signed over to us -We signed a new tenancy contract when we took over which did NOT include laundry and parking but we did agree on letting them upstairs have half of the garage for storage

    Now here's where the problems begin... When we were drafting the tenancy contract the upstairs tenants told us that they might occasionally have guests over. What happened instead was that they invited 2 homestays that have been living with them since Nov/Dec of last year and since we split the utilities 50/50 I feel like this is ridiculous. They've effectively doubled their output for utilities and we still have to shell out half while the homestays are essentially paying for their rent... And since we've moved in we found that they've been using our laundry this whole time too.

    We recently given them notice that we want our half of the garage back and would accordingly reduce their rent which also included taking back our laundry machines. The tenants have then filed a complaint with the Tenancy Board and threatened us not to restrict their access to the laundry and garage or they will call the police because they claim that since there is a dispute open we're not allowed to unilaterally take any action until it is resolved.

    Is this even legal since the laundry machines have been our legal property to start with?

    Any advice on how to proceed would be greatly appreciated!

    So I want a quick spot of help

    Im a minor, 16, and live in Canada. I have asked my parents to let me go to therapy, I didn't tell them why but they are letting me because they think my mental health is important.

    I want to go in for sexual confusion and help, I have been obsessing over wanting to be eaten recently and I have a vore fetish. The reason I'm obsessing over it is because its not just purely sexual for me. In simplicity I was wondering if I can mention viewing porn to a therapist because (to my knowledge) it's illegal for minors to consume porn.

    A business I have contract with changed their name without notifying us or rectifying the agreement - does the original contract still hold up?

    The physical business is in the same address with the same owner, but one of the old partners left and took the original business name. Our contract only cites the original business name but is signed by the remaining owner. Does the contract hold up? This owner has been volatile and is generally difficult to deal with, and we're certainly not pleased that changing the business name without notifying us has impacted certain aspects of the agreement. Not quite sure how to proceed as we'd like to wash our hands of this agreement and terminate the contract, so proper transferal of the contract from the old business name to the new business name would be a difficult ask. The business is based in Florida.
