Declared Dead In Error Same Month & Trustee

    Posted: 11 Jun 2021 04:44 AM PDT

My mother passed on 5/26 and I am the sole trustee of estate with upcoming appt on 24th for Trust Administration I found out on June 7 that someone electronically notified Social Security in May 2021 that I was deceased.

This literally happened when trying to make a grief counseling appt and was told that I had no health insurance. CalPERS (I am State retiree) told me that I came up in audit as deceased and asked if my mother ever worked for State or if had same name. My mother never worked for State, but I did for 32 years and my maiden name is my middle name.

The interesting thing is CalPERS never notified my beneficiaries that I was declared deceased. Instead of a supervisor calling me back, I had a very blase and uninterested person call me who said not our problem, not our fault, just get the letter from SS. Zero empathy!

Confirmed with SS that we were both reported dead by someone electronically which they say is done by EDRS within the States. It took me until yesterday morning to get Proof of Life letter from SS and on that side I am resurrected and have online access again with SS.

Right away I faxed and mailed Proof of Life letter certified to CalPERS . I can still only communicate with them via telephone and they are all working from home. Blocked online from my CalPERS account. I no longer have medical/dental/vision/legal insurance so I have postponed all my upcoming appointments.

My gas card closed account (I faxed proof to them as well that I am not dead by SS) so this is now damaging my credit. In process of getting in touch with the credit bureaus.

So far bank accounts not frozen. Dept of Public Health and Funeral Parlor say they didn't report me as dead. Should I call the Coroner? I want to know where this originated.

I am thinking I need attorney but not sure how to proceed. On top of everything else, I am still waiting on my mom's death certificate as I am trustee of my mom's estate.

Neighbor keeps parking in my driveway

    Posted: 11 Jun 2021 10:13 AM PDT

TLDR: Title says it all, south west Portland, if it's relevant.

I started renting the garage this month as an addition to my rental. Put a note on his car with my phone number asking him to move. He texted me two days later asking me if he still wanted me to move. I said yes. He still did nothing. Texted him again the next day and 18 hours later he asked me if I still wanted him to move. I answered yes. A full 10 hours later he moved it during the night after I was already in bed. This morning he parked there again before I got out of bed. What are my options ?

Can I be sued for child support if paternity can’t be proven?

    Posted: 11 Jun 2021 06:57 AM PDT

    Michigan.

I'm an identical twin. About 3 years ago my brother and I went to a party and he had a one night stand with a girl. Since then my brother has passed away but the woman found me and thought I was her brother. She wants me to pay child support and a role in the kid's life. I told her no way it turns out she never got my brother's name before she slept with him and only her friends knew us as the twins not which one was which so she never knew the name of the guy she slept with.

Can I be forced to pay child support? I understand that the DNA may come back to me since my brother and I are identical.

My future ex-wife is collecting sick leave and benefits while actually working a different contract position. Ontario, Canada

    Posted: 11 Jun 2021 03:39 AM PDT

We Separated back in November and she's gone a little off the deep-end since. She's decided to become a social media manager/celebrity. Two months ago she got her doctor to give her a mental health note so she could go on sick leave from her Education Assistant job. She then started her new full time contract job as a social media manager. She's collecting money from her school board (and provided benefits on sick leave) and from her new job. We're in Ontario Canada I feel like this isn't right, but is it illegal? Should I be doing something about this, and would this come back on me if I didn't?

Got told I can get fired for getting jury duty within my 90 day period

    Posted: 11 Jun 2021 06:39 AM PDT

I served jury duty a couple of weeks ago and I noticed today that my paycheck reflected those days as not being paid. I thought jury duty leave was paid, but I wasn't sure so I asked my manager. She then got an attitude and said "No, actually you could've gotten fired because you can't serve jury duty within the first 90 days of employment."

Now my question— is this true? I thought that jury duty pretty much trumped everything which is why I didn't mention the fact I was at a new job to the judge. Thanks guys!

What can I do for my missing brother?

    Posted: 11 Jun 2021 10:39 AM PDT

My brother and I both reside in the state of Michigan, he has been rather successful but introverted. He found a woman who was an illegal alien at the time and held Mexican citizenship. They got married about 2 and half years ago and went to see her family in the city of Juarez. She ends up returning about a week later saying my brother decided to stay with her family a bit longer because he loves the country. We checked in a month later but he was still not back and she claimed he just left her parents home and no one has any idea of where he is.

We of course had contacted the police and they did an initial investigation. They found that 2 transfers were made into a bank account in Juarez in his name in the s of $5,000 (US currency) 9 days apart. They collected her statement as well which was my brother decided to live in Mexico and abandoned her. Two private investigators we hired haven't been able to locate him neither, all leads ending in Juarez.

Since then she has gotten a boyfriend, got pregnant and has been moving to getting a permanent residency card while also trying to take control of his assets since he added her as co-owner on multiple things. The police stated that because those 2 transfers they believe his wife's story and don't want to investigate any further.

Is there anything I can do?

My wife's inheritance was stolen from her and she is wondering if she has grounds to sue

    Posted: 11 Jun 2021 07:29 AM PDT

My wife's mother passed away from cancer about 10 years when she was only 16. For the last year of her mother's life she was her sole caretaker and breadwinner for the household. After her mother passed she was penniless and was evicted from the house she was living in because she was too young to legally rent a place on her own. At the time she was living in Indiana.

After her mother passed her life insurance money was supposed to be split 3 ways between my wife and her 2 brothers. Somehow her older brother, who hadn't been around in over a year and didn't even show up to the funeral was in charge of doling out the money. He took all the money for himself and bought a new house and pickup truck.

At the time my wife (then gf) was stricken with grief and had no means for legal recourse. We were forced to move out of state where my family helped us get back on our feet. She decided to let it go and tried to mend the relationship with her brother.

My wife recieved a call from her mother's old banking institution about a week ago stating that there was still money in her mother's 401k that was supposed to go to my wife and that she had to claim it. When she looked into it she found out that her brother had somehow taken that money as well.

At this point in our lives we are more than capable of hiring a lawyer and she wants to sue his a** off for everything she can. She tried letting it go but this fresh revelation brought up all that resentment and betrayal. We currently live in S.C. and she doesn't know where to begin to start court proceedings or what paperwork she needs to obtain. We also don't know if there's anything that can be done given how long ago this all played out.

Any advice on how to begin would be appreciated!

I'm Being Sued By a Debt Collector For a Debt That Isn't Showing Up on My Credit Report

    Posted: 11 Jun 2021 11:40 AM PDT

Hi, I am being sued for a debt that isn't showing up on my credit report. What should I do? I double checked both TransUnion and Equifax and the debt isn't showing there either. I don't have the financial capability of hiring an attorney. I don't know where to start and I am scared. I don't know if I can post who is suing me. I'm lost and would like to pointed into the direction of where to start. Do I call the courthouse and tell them this information? Do I call the debt collector? What do I do?

    Thank you.

Edit: I am located in Pittsburgh Pennsylvania.

Can I be denied overtime pay if I've taken someone's shift?

    Posted: 11 Jun 2021 09:42 AM PDT

I work at a coffee shop and usually work part time, around 30 hours a week. I was scheduled for 37 hours this week, but then a coworker asked me to take her shift and I accepted so my total worked hours will be 44 for the week. Can my manager deny me overtime pay because I willingly picked up that shift outside my scheduled hours?

My boss has a history of being stingy and has only recently started paying my coworker overtime as she consistently works >40 hours a week. I haven't talked to my boss yet but I have a feeling she will try to fight me if I bring up overtime pay.

Am I entitled to overtime pay?

    Thank you for any help.

An On-line Review of My Business Accuses Two Employees of Sexual Assault

    Posted: 11 Jun 2021 11:22 AM PDT

My wife and I own a massage therapy business in a Southern California vacation destination/tourist town. Four days ago, a husband and wife came in together for a one-hour appointment they had scheduled two days prior with me by phone. The wife seemed pleasant and sociable as I checked them in. The husband never said a word. He seemed a bit sullen. They were provided a Couple's Massage together on side-by-side tables in the same room at the same time by two California Certified Massage Therapists (CMTs) - a female CMT for the wife, and a Male CMT for the husband.

Their session ended after an hour, they checked out with me, paid by credit card, and even added a better than average tip for the two therapists. Again, the wife was chatty and made small talk while her payment was processing. Again the husband was silent and seemed sullen.

It occurred to me that maybe they were having a marital spat.

Two days later I received notification of a new review of our business from one of the business rating and review websites.

The wife of this couple had written a one-star review claiming that both she and her husband were sexually assaulted, separately, while together in the same room laying side-by-side on the massage tables, each by their respective Massage Therapist.

In four years of business, we have never had anything like this. I'm aware that massage businesses have a reputation as occasional providers of illicit sex. Not our shop. My business is legitimate massage, and always has been. There is never anything sexual about it. Ever.

About the two therapists: The female is over 60 yo and very experienced. She's pleasant and professional throughout the workday, although her ability to speak English is limited (I should point out that, except for me, all of the employees of my business, including my wife who is lead therapist and co-owner, are Thai - Naturalized Citizens or US Permanent Residents). This massage therapist has never had a customer complaint in four months working for my wife and I, nor even had a customer who seemed mildly dissatisfied. I checked with the state certification board, and there are no prior complaints on file.

The male therapist is much younger (early 30's, or younger), has a lot less experience (earned massage certification less than a year ago), but has always come across as friendly and professional.

Both these therapists started working for my business during the same week in February 2021, after we were allowed to reopen, after being directed by the state and county health departments to close the business for half of 2020 plus January 2021 due to COVID.

So I reported this review of my business to Customer Support for the business that runs the website. I selected "It doesn't describe a personal consumer experience" as the reason for reporting it. Because if you select "It contains false information" the website replies "Sorry, but we don't take sides during a factual dispute. There is always more than one side to every story" and rejects your attempted report.

This is the website's reply to my report:

    "Hello,

Thank you for reporting (Customer's Name) review of (My Business). We rely on community engagement to help keep (their website name) useful, and we appreciate you bringing it to our attention.

After careful evaluation, we have decided not to remove this content. When reviewing user content, we look at a number of factors, including potential conflicts of interest, threatening or lewd commentary, and whether the content has been posted to the correct business page. If a review falls within the bounds of our tolerance for strong language, appears to meet our guidelines and reflects the user's personal experience and opinions, it is our policy to let the user stand behind their review.

Business owners can address any concerns or misunderstandings via their Business Account by posting a public comment or sending a message to the reviewer.

For further information on using (website), please find answers to frequently asked questions in our Support Center."

I'm unsure how to proceed. I feel my business is being victimized by spiteful slander (though I don't know a reason for the spite) with potentially financially devastating repercussions.

Should I hire an attorney? Sue those customers? Try to force them to take a polygraph as part of a lawsuit. Does the company which owns and runs the particular website have any culpability for slanderous statements posted on their website by other consumers?

I think the worst possible result is also the most likely: this false and slanderous review of my business is never removed and a lingering doubt is left behind, harming my business's previously stellar reputation. Advice and suggestions are much appreciated.

Virginia: i was a victim of hit and run, took a pic of the car as their driving off and got police report but their insurance is denying involvement. What should i do?

    Posted: 11 Jun 2021 01:40 PM PDT

About a month ago, i was stopped at a red light, at a complete stop when a car hit me from behind. The car then pulled up next to me and asked if i was okay. I stated i was fine but my card back bumper was on the ground. They said they'll pull over ahead to not cause traffic. As their pulling ahead, i took a photo of their car. They then made a Uturn and drove off.

I called the police, got a police report and the car was from Maryland so he gave me the information for their insurance and the driver associated with the license plate in the photo I took.

I called my insurance and their insurance. I really would have loved to settle this with their insurance without taking out my deductible. Their insurance contacted the driver and at first they denied their car being in VA. After seeing the photo, they said the car could have been in VA but it wasn't the driver. Their insurance (progressive) gave me an estimate for the cost of damages but their denying fault until they get their driver to accept the fault. Their insurance claims the police report i have is only my side of the story and that i could have reversed into him causing damage on my car. The driver is now no longer answering their calls so their insurance says there's nothing they can do.

I called the cop and he says he has already done what he can with the police report. I contacted Vdot since the intersection has a camera that's theirs. They said the camera only monitors traffic but doesn't record.

What can i do? My new car is messed up and I'm just so upset by all this.. thanks in advance for feedback!

Being asked to move out as renter while under lease - Texas

    Posted: 11 Jun 2021 08:43 AM PDT

Looking for a little guidance on this mess of a situation that was brought to my wife and me yesterday.

Our landlord (the owner of our rented single family home in Texas) called yesterday and has stated that he will be moving forward with selling the property as it is "in the best interest of his family". We signed a 3 year lease in April 2020 so we have a remaining ~20 months remaining.

This is HORRIBLE timing for us as the housing market in the Dallas area is absolutely broken, houses are selling for ~175% of their sale prices last year and up ~25% in the last few months alone. Obviously this is why he is attempting to capitalize on this opportunity however us being able to find ANY home, much less one that meets our needs as our current home does is nearly impossible.

We have reviewed the lease and see no language regarding action during an owner sale or any mention of the owner terminating the lease for anything other than an issue from us as tenants.

We're kind of at a loss right now and looking for where to start to resolve this.

    Thanks in advance all.

Civil Asset Forfeiture - I was working on and airplane. DEA seized it. Said they'd pay my maintenance bill. Never have. This is in Florida

    Posted: 11 Jun 2021 06:56 AM PDT

This goes back a few years, and I never get a reply. I was doing (relatively) extensive work on an airplane, when DEA, CBP and FAA showed up. I was ordered top surrender aircraft logbooks, and told to re-assemble the airplane to make it safe for flight, and that DEA would pay the bill. It's over $7,000, and I've never seen a dime. I have the DEA Case Number, and a letter which says it was referred to "United States Attorney for the Civil Division" in the Southern District of Florida. This put me out of business, and it's been rocky ever since. I cannot afford an attorney. ANY advice appreciated.

Dog was attacked and nearly killed at AirBnB.

    Posted: 11 Jun 2021 12:55 PM PDT

We recently spent 4 nights at an AirBnB in Montana (Friday Night May 28, until Tuesday June 1). It was myself, my wife, my 2 kids (4 & 1), and our two weiner dogs. My parents and my sister were also staying with us.

We had a great first 48 hours. The place was a good fit for us, in good condition etc. We had noticed that there was a camper parked behind the property by the garage, but hadn't thought much of it.

Sunday shortly before noon we were hanging out on the front porch and our dogs were just hanging out on the porch with us. All of a sudden we heard a dog start yelping terribly, and then noticed our one dog was not on a porch. She had been there within the last minute, but had made her way off the porch and around the side of the house.

The property owner had been staying in his camper behind the AirBnB while his house was being worked on. He was watching his girlfriend's dog, a pitbull mix. We were never told that there was anyone else (person or dog) staying on the property.

I ran around to the back of the house and my dog was running away leaving a trail of blood. The property owner immediately said "I'm so sorry, I think he hurt her bad. I'm sorry. I'm sorry.". He was very apologetic. He said "I'm not even supposed to be here. The dog isn't supposed to be here. I'm just watching him for my girlfriend". He also said that the dog "had issues with other dogs". He said that his dog WAS on a double leash (two leashes tied together) connected to his camper. When I turned the corner he was shoving his dog back into his camper, so I don't know 100% if that is true, but I don't have any evidence that it's not.

We were able to get her to the vet. She had numerous puncture wounds, a sucking chest wound, 4 broken ribs, and her lung was sticking out of her body on one side. The vets got her lung back in, sewed up her skin, and prepared her for surgery. They performed a surgery to close her chest cavity, as well as all of her other wounds. After a radiologist viewed her x-rays, they have found out she also has a broken elbow that required a second surgery.

We have so far racked up over $11,000 in vet bills. Thankfully our dog is now recovering quite well, and (if everything keeps going well) only have a couple more follow-up appointments and one more set of x-rays, so probably roughly $1,000 more in bills upcoming. The property owner and the dog owner (again, 2 different people) have said that they will help with the bills, but we haven't been able to iron out any specifics. As time goes on, they seem less and less willing to pay. However, we are meeting with the dog owner over the phone tomorrow.

We know that we are somewhat at fault as our dog was not on a leash. However, we were never made aware that there was anyone else staying on the property, not to mention a dog that they KNEW and admitted was dangerous. What if it had been one of our kids that had turned the corner and ran into that dog?? Also note the following link about potentially dangerous animals on airbnb property. https://www.airbnb.com/help/article/2135/what-are-airbnbs-rules-about-potentially-dangerous-animals

We did talk to the police department's animal control officer, who basically said it wasn't their problem. They said there was no crime committed, so there was nothing they could really do and it's just a civil matter.

We are thankful that our dog is still alive, and thankful to the property owner as he pulled his dog off of our dog. She could have easily been killed right then and there. We are worrying more and more about the vet bills. We know they have offered to help, but again haven't worked out specifics. We feel like the story is only getting worse and more real for us, while for them they can more easily get more distanced and less willing to help out.

We would love to just work this out privately, but are unsure how it will work out.

    What should we do?

    Kaiser Permanente shenanigans

    Posted: 11 Jun 2021 12:45 PM PDT

Kaiser Permanente went back into my e-file and said that I needed psychiatric treatment for drug use when I don't use any drugs and this was after I filed a complaint against them and it was the doctor that I was complaining against it went back into my file and "accidentally" as she says changed it. Is this OK or accepted practice? She said that she had two files open on her desk and wrote that the psychiatric care was needed for me when it was really needed for the other file that was open on her desk. This has caused many problems for me like getting a job so please answer if you have any idea about Kaiser Permanente practices or legal realm of ramifications thank you. I'm in Sacramento.

    Cell company wiped phone

    Posted: 11 Jun 2021 05:12 AM PDT

My mom was having issues with her phone so they went to the cell store. They put a new SIM card in her phone to "fix" the issue. While there they said they should do the same to my dads phone. His phone didn't like the new sim and three different SIM cards and trying different things later they put his old sim back in and gave him his phone back. At some point in trying to make it work with the new SIM card they wiped the phone without asking and he has lost 6 months worth of billable hours for his business as well as all his photo documentation for work and all his personal photos from the last 10 years. Now he is lost. He is 65 and doesn't have the health to make much more money. Does he have any legal recourse in Florida?

My girlfriend lives in peru and we want to get married and live together

    Posted: 11 Jun 2021 01:34 PM PDT

So about a year ago my girlfriend came to the United States on a visitor visa and that's when we met and have been dating since then. Recently she has had to go back to peru. We want to get married and rent a place together in the states but it looks like it takes a year to get a k1 visa which is a super long time and there are a lot of other factors like she can't afford to live in peru because she's a full time student so she's staying with a friend and the beginning of next year I'm getting deployed for a year to Africa so when the visa is approved I won't be here to marry her or get her settled into the states. So basically can she come here on a visitor visa and then we get married will she be allowed to stay and get a permanent residence and work visa or is there something else we can do?? There's just so much information and stuff going on I don't know where to start or what to do

    Instagram Hustle

    Posted: 11 Jun 2021 02:05 PM PDT

Some of my friends do a type of "scam" on instagram which consists in growing a fake instagram page using pictures taken from the internet( usually sexy women) until it reaches a couple thousand followers and then they will reach out to their 50+ male followers ( or they will send my friend a dm), my friend proceeds to talk to them and act as a sex worker and try to arrange a prepaid meeting ( which he will obviously not show up) or sell nude pictures and they're making one third of my country's minimum wage a day.

I was wondering what could happen if the police found out (not sure if they can do anything about it) and how illegal is it and how much better would it be if he only sold nudes.

My Mother Was Exposed to HIV in a Government Facility, No One Will Take Her To See a Doctor

    Posted: 11 Jun 2021 03:03 PM PDT

This is super urgent so sorry if my post is rushed. My mother is in a court-mandated drug rehabilitation program. She was just given a roommate who was going through withdraws. She says her roommate was throwing up hard, and eventually threw up so hard that she was puking blood.

My mother was helping her clean up, and says some blood splashed in her mouth, as well as getting all over an open cut on her hand. This was two days ago. Her roommate is finally regaining some form of mental compensation and told my mother she has HIV. She has been cleaning her blood and bodily fluids for 2 days.

My mother and I have both been calling the facility nonstop, asking for them to please take her to a doctor. The staff have refused. I have called the on-site doctor and local doctors. Local doctors will not be in the office until Monday. The on-site doctor keeps hanging up on me. I know preventative HIV medicine has a 72 hour window of effectiveness, and it can't wait until Monday.

I have called every extension I can think of in this facility, and none of them will answer me. Some hang up, some won't even pick up.

Is there ANYTHING I can do to get my mother this medication, or some use legal right to Force them to treat her? This is Tennessee

Being sued for car accident that happened 2 years ago. (TX)

    Posted: 11 Jun 2021 01:25 PM PDT

So 2 years ago my husband and I got in a tiny "accident" long story short dude slams on his breaks at a yellow light and we tap him. Dude loses his mind and calls the cops to which they show up and the cop is like ummm are you ok and they dudes like yeah I'm fine and he's like ok then just swap info then and leaves.

Dude ends up getting 30,200 dollars. 200 for the "damages" to his vehicle (small scratch) and 30,000 for "medical expenses" the case would be two years old as of June the 5th and on June the 4th the dude files a lawsuit against us. We just got the letter today with this dude suing us for 200,000 dollars for his "severe mental and physical damages"

We've called the insurance company but haven't got a response yet. I'm just wondering what could happen from this? We have a newborn baby and we definitely don't have 200,000 dollars for this crazy guy. Will my husband have to appear in court? Is there a chance we could be responsible for paying this?

(TX) I work as a delivery driver for a pizza chain. Since COVID began the prices the owners have to pay for their ingredients and such has gone up. Because of this, they told us,” y’all have to pay for your mistakes now. You get one mess up but then it comes out of your pay.”

    Posted: 11 Jun 2021 10:09 AM PDT

I was told this in august of 2020 and I've only made one mistake in that time BUT a fellow driver has made multiple mistakes. One night he switched two orders and although it was a very bad thing considering they put the orders together for him, clip boards with the right pizza bags, he managed to somehow switch them(a big really dude? Moment) and they had to replace one order, refund the other. They took it out of his pay and he left that night only earning a total of like 2-3 dollars with hourly, tips, miles compensation everything. I told my mom about it and she said she didn't believe it was legal for them to do this. Is it?

    Renter in Raleigh, NC

    Posted: 11 Jun 2021 07:55 AM PDT

I'm currently renting a home in Raleigh, NC. My lease for the home ends 6/30 this month. Originally, at the start of the lease my landlord told me and my girlfriend, she was intending to knock the house down, and build two houses on the lot. Now, as of this past month, that plan has changed, and she is intending to rent the house again. I have no problem with this, though we have been accommodating in allowing our landlord two showings of the house this past week for the new tenants. Today, we were informed that she wants us to hire carpet cleaners from a company (Zerorez) and will not let us rent a carpet cleaner and clean ourselves.

We had two dogs in the house during this time and she didn't charge us a pet fee/rent at the start of the lease. She is claiming because she didn't charge us pet fees at the start of the lease, she needs us to have the carpet professionally cleaned. Additionally, the new tenants are wanting to move in on 6/26. This isn't a problem since we have been slowly moving into a new house we bought and we are finishing up the changes we wanted to do before fully moving in. But now, this puts a tighter time crunch on having the cleaning done.

My question is are we required, as tenants, to hire professional cleaners for the next tenants or does this responsibility fall on the landlord?

    paternity questions

    Posted: 11 Jun 2021 08:18 AM PDT

Been raising my daughter for 2 years. Turns out, she isn't biologically mine. I was with her mom for 4 years before she got pregnant and turns out she cheated on me. She asked me to get a paternity test and I was like ...okay? And it turns out shes not mine. She is mine, I was there when she was born. I signed the birth certificate. I have been there for everything. We broke up shortly after she was born though. What legal rights do I have? I don't want to lose my daughter. I'm in the US, specifically KY
