    Hello,

    I originally posted this in r/legaladvice and someone suggested I post it here and also follow up with my renter's insurance. Is there any insurance advice that anyone can provide for my situation?

    "Like the title says, the company we are renting from incorrectly marked our apartment as vacated before we had vacated and before our lease was up. We are near Chicago in Illinois. I drove to my apartment after work (4/29/2021) to get the last few items I had at the apartment that we had left there to bring to our house. When I arrived my apartment door was unlocked and the apartment company had let some painters that had been there painting the building that day into my apartment without my permission and were cleaning their brushes/rollers in my kitchen sink.

    I immediately noticed that my two vacuums were no longer in my apartment as well as a sander that I had there. I asked the painter, who again was not allowed into my apartment by myself, where my stuff was and he said he didn't know.

    I called the apartment complex and the woman I had spoken to that morning about how to turn in the keys had said she had made a mistake and marked it as we had already vacated the apartment. Maintenance had shown up and starting throwing away our personal belongings. A lot of items that were thrown away were damaged or destroyed. Several of these items were of significant sentimental value that cannot be replaced.

    The maintenance employee who had been throwing away my stuff said that he had taken several of my items for himself and offered to return them to me, which he did. He also had given one of my vacuums away to one of the painters, who does not work for the apartment complex, that I was luckily able to get back simply because I had arrived and called before he had left with it.

    The employee and I both climbed into the dumpster and sifted through the trash for quite a while trying to recover anything that I could. Several items were damaged and destroyed. There were items that are missing that could not be found within the dumpster. I'm not sure if someone took them or if an employee stole them.

    There was also a large wet spot in the apartment that was not caused by me as I had not been back to the apartment since late Sunday. The damage had obviously occurred that day and likely was caused by someone the apartment complex had let into my apartment without permission. I obviously do not wish to pay for any "damages" in the apartment since they very well could not have been caused by me.

    The manager of the complex offered a very small amount that would not cover even replacing the items damaged and certainly didn't make up for the loss of sentimental value for some of the items. When the incident occurred I did make a police report so that it was documented as well as video and pictures showing the damage and items thrown away.

    I contacted a local lawyer so said that they would charge a $3,000 retainer, $375 per hour of office time and $400 per hour of court time. The low end of the cost of damage I calculated out to be around $2,000, but the issue is that we aren't sure of everything we had in the apartment when it was thrown away so we might later find other items were thrown away or taken.

    The lawyer recommended small claims court and to represent myself. I am not a lawyer and know nothing about law or how to handle this. I don't know that going to court by myself is going to screw up my chances of having this wrong righted. Are there other ways to hire a lawyer or less expensive options? I'm just really looking for advice in this crappy situation. I can answer or provide more details that might be needed."

    What if GAP coverage doesn’t pay the entire difference?

    My car was totaled, I was not at fault. The insurance and GAP together does not pay off the entire loan. I thought the whole point of GAP coverage was to pay the difference, but I guess I have to look at my contract again. I understand I'm still liable for any remaining payments, that's fine. I'll call the insurance company tomorrow when they're open but I'm curious if anyone else has had this problem and how it was handled. If the insurance company doesn't get the title in a certain time frame, they will revoke their payment. Pretty sure they're not going to get the title until I pay off the car, but it's going to take months to come up with an extra 3-4 grand

    Edit 2: the insurance company is Progressive and the GAP coverage is through a company called Safe Guard (which is bundled into my monthly car payments), my lien holder is Hyundai Motor Finance

    Hey all,

    Wanted to update you on what happened here. Since I am currently vacant from my unit, I had a friend go check out and investigate. He found no moisture around the dishwasher, or under the sink, faucet, and refrigerator. He also found no source of moisture around the walls, and confirmed that my unit is not above another unit. I informed my insurance company and they told me that since there is no damage, they will withdrawal my claim and it will be as if I never filed one, unless the owner in the lower unit tries to sue - which case they will have on file that I investigated and found zero evidence of water damage. Looks like this was just the lower neighbor trying to scam me, as the water could have come from anywhere and she refuses to accept my investigation until a contractor tears my unit apart and determines, without a doubt, that my kitchen isn't leaking.

    I will be ignoring her. I am getting the sense she doesn't have the money to fix the unit, and she will either need to get a home improvement loan to make the unit habitable, or need to sell the unit to an investor to fix it up. Either way, this is not my problem.

    Unrepairable vehicle

    March 5th 2021 my husband and children were traveling for dinner for my birthday. On the way I got a huge dog and my car has been in the shop since. They are now telling me the part needed "L1MZ-16138-B radiator support with active shutter" is on national back order with no ETA. Insurance company doesn't really care too much since they've already been told the car would be fixed. I've searched this part on several OEM websites and have found it to be available (not certain it is as I haven't trumped ordering its just showing in stock). Anyway. If this part is in fact not available, is there a something the insurance is supposed to do at this point since the car is essentially not able to be repaired? Am I just a sitting duck? Do I have options???

    BTW this is a 2020 Ford Explorer Platinum purchased new.

    Covered CA Dental PPO

    Does Covered CA Dental PPO has a waiting period for basic service (fillings)? For Delta PPO, it only mentions waiting period for major service, however, in my plan's waiting period summary, it has an effective date to an end date which has total of six month for restorative treatment. That is very confusing... I called Delta customer service and they said no waiting period for filling, but I am still in doubt.

    Help with signing up for insurance from State Farm

    I'm trying to get auto insurance from State Farm. I'm 25, the rep told me if I get only Auto insurance it would be ~$150, but if I got Auto + Life the total drops down to ~$100.
    Does this make sense? I feel like I am being scammed or something. I have always been told my rates would go down once I hit 25 but it still seems like I'm paying the same amount I always have been.

    Is there anything I should be aware of before I sign the documents?

The claim has been resolved, and I'm protected against any future lawsuits as long as cooperate with the underinsured motorist carrier. Panicking and wondering if there is anything I should do to protect myself? Any advice would is welcome.

    A few weeks ago, I got in an accident with a taxi. There was a passenger in the tax, who got hurt and an ambulance was called for them.

    I was at fault.

    The insurance company resolved the issue by paying the person driving the taxi some money for the damages to the car and the passenger got the full amount of the bodily injury limits.

    In the recent letter in the mail arrived informing me of this decision, the letter also said that

    "it is possible that a lawsuit could be filed against you in the future. You are protected by the release, but that protection is contingent upon your duty to cooperate fully with the underinsured motorist carrier...this may include, but is not limited to appearance for a deposition or jury trail"

    While I understand what this means, I'm still a bit more scared. Is there anything I should be doing to further protect myself? Any piece of advice is welcome. Also if anyone has gone through anything similar, I would really appreciate their insight

    I currently don't have anything to my name, except a mortgage and two cars (one paid off and one paying for).

    I was a victim of hit and run car crash and the property damage is just around at my collision deductible. Is my only option to wait for the police to pull the other driver's insurance?

    State is NJ. I was rear ended on the highway in a hit and run in Dec 2020. I had the other driver on dash cam and the police found her and wrote 6 citations. They went through the motor vehicle agency to pull her insurance but the request is backlogged or something into limbo due to covid. The state troopers are very nice when I call every month or so for an update, but they never have anything new.

    I have been trying to make a 3rd party claim with her(other driver's) insurance company (hoping she has liability) damage repair was estimated at $1,020 and my own insurance collision deductible is $1k.

    Is my only option to wait it out for the cops to check insurance info?

    Bill is more than remaining deductible, do I have to pay the whole thing?

    I have met about $550 of a $1000 deductible and have a bill for $910. Can I pay the $450 remaining on the deductible and then not owe the rest? Do I have to meet the out if pocket max before that kicks in? Or can they at least reassess what I owe after I meet the deductible as it applies to coinsurance? I am just really confused by all of this and having trouble finding answers. I am in Illinois.

    Will going to the neurologist affect my insurance?

    So some background information to understand this. I live in the US and am on my mother's Medicaid plan. I'm only 21 and I have had intense headaches and migraines my whole life. My mom has them too so I'm sure it's genetic, but she has medication for it and I've been relying on over the counter pills. Since I've been taking them forever, they're less effective and I have to take a couple to actually get relief. My doctor recently prescribed me sumatriptan but I complained about it because sometimes it would intensify my headache.

    So. He told me I should go to the neurologist and referred me to someone. But I'm concerned about going to the neurologist as a young woman. My mother told me that when she was young she went to the neurologist and her insurance premiums went through the roof even though the neurologist never found anything serious. I guess they had to pay out for the appointment and labeled her as a liability that needed a higher premium.

    Anyway so I'm concerned that going to the neurologist will cause problems for me down the road. I think Medicaid will stop covering me under her plan when I'm like 25? So I'll probably have to start paying for insurance and I don't want this to negatively affect my premiums. I 99.9% sure the issue is genetic because my mother's side of the family all had migraines. So I'm not concerned about actually going to get a possible serious issue checked out. I only would like to go so I can get some actual prescription medication for my head because the pain is just too frustrating to bear on over the counter stuff.

    I am planning to get a BMW X1 utility xdrive 2017 model, I recently moved to the US and got my drivers license at the age of 24, I was searching for auto insurance online. For the year and model that I want online results show all options to be above 500$ a month which I feel is too expensive. I am a graduate student and live in Boston, Massachusetts.     Dual Insurance Coverage?

    I am in Clark County, Nevada. I'm about to start a new job where my wife also works. She has me on her insurance there as a dependent. Once I start work and receive the health benefits, will I be able to stay on as a dependent on hers and still have mine for primary? I tried google but it's an odd question to find an answer for.

    Insurance offers to replace total car but to cover the “take price” of the car.

    Does it sound right that insurance is offering only to cover the take price on a car? I had to look this up. Essentially they are offering money that doesn't cover the average list price. Thus putting my in a hole to negotiate out of with some dealership.

    Is there a time limit on when you can apply to for LTD?

    Family member of mine had a pretty significant stroke and going through some Medicaid planning to have long term care coverage. Due to income restrictions and etc, I've been holding off applying him for his LTD that he has through his employer at the time of stroke.

    Is it possible to still apply and get approved for long term disability 2.5-3 years after the disability occurred?

    Questions on rental car insurance

    Hey guys, I'm wondering if anyone can give me some insights into my case.

    I had an accident on a rental car. Due to the lack of stock of the parts, the rental company couldn't get the repair done until a month later. They charged admin fee as well as downtime. However, my insurance company is not willing to cover this part as they think the agreement I had with the rental company says the renter should pay for damages as well as downtime and admin fee in case of accidents. The agreement doesn't discuss the responsibilities of the insurance company, but my insurance company (TD) insists that it's not their responsibility.

    I have never dealt with this kind of situation before. Is it normal for renters to pay for downtime and admin fee?

    Can you carry OTL and RIBO at the same time?

    Tricky question hoping to get some clarification.

    I left a direct writer not to long ago to join a brokerage and I'm set to write my RIBO equiv exam in the coming weeks.... only thing is I'm not 100% sure I'm sold on working for a brokerage and have a potential offer lined up with another direct writer as an agent which I'm heavily considering.....

    What I'm wondering is if I will need to tell the hiring manager I need an answer by x date or my OTL will turn into a RIBO cert....or is there some sort of grace period? Or can you have both at once?

    Accident covered aggravation of PEC, but new insurer wants cut for all future treatment

    My girlfriend suffers fibromyalgia and was hit making a legal left turn almost five years ago. She was finally awarded a few-thousand-dollar settlement this year, a portion of which reflected the cost of treatment for the exacerbation of her preexisting condition.

    Meanwhile, last fall, she switched from COBRA to Medicare. Her new insurer is insisting a cut of the settlement even though her fibromyalgia has returned to (more or less) the level it was at five years ago, before the accident.

    She is stressed out about basically losing the remainder of her long-awaited settlement, and stress isn't good for fibromyalgia, so I'm reaching out here. Seems to me that whereas, say, a broken knee and ankle would have exacerbated preexisting arthritis for the rest of one's life, such is not the nature of fibromyalgia, and she deserves to hold on to her settlement while also receiving benefits for the future treatments of her preexisting condition she would have required even had the accident never taken place. Am I all wet about this? What must be done to establish our case?

    Carry over of prior authorizations when switching jobs

    Hi- I'm going to be starting a new job with a new employer next month. Both my precious and future employer use Cigna and I carry the insurance for the family. My wife and I are currently in the midst of an IVF cycle and her transfer will take place after I start my new job.

    Are there any standards regarding prior authorization carrying over when we're on the new policy? Do you have any suggestions for ways that I can reach out to Cigna to streamline things so that the impact to us and the timeline is minimized? Anything else I should be checking on/watching out for when we make the change?

    Update: Non Renewal of Condominium Unit Owner's Policy

    Good news! (I think) I have found a policy with an insurer at a reasonable price, with no exclusions, a reasonable deductible... basically coverage that is equivalent to the HO6 policy that will be non-renewed. All of the other brokers I talked to said I would have to settle for California FAIR plan or pay almost $3000 per year for Wholesale insurance because no normal insurer would cover me.

    I found this policy through a broker that I found on Yelp with a perfect 5 star rating and 30+ reviews.

    Normally I would consider this a done deal, take the policy, and go with it, but I am concerned that there might be an issue, so I wanted someone else's take on these details:

    1. I asked the broker whether this policy was issued after the insurer saw my claims history. He said yes.
    2. I specifically asked about coverages, exclusions, deductibles, etc, and everything checks out normally.
    3. The insurer he found is a relatively large company with a decent BBB rating, though not perfect (3.5 stars because customer service is not perfect.)
    4. The broker set the policy issue date for today. I didn't specifically state that I was accepting the policy verbally or in writing. I am still covered by my old insurer until July. This is probably the biggest potential red flag. I haven't paid anyone for the policy at this point either.
    5. There are line items for a sprinkler and burglar alarm system. There is a sprinkler system in my home, but no burglar alarm, and besides, he never asked if I had either of these systems.
    6. Instead of "Dwelling Coverage" it says: "L - Increased Condo Building Items" and then has the proper dwelling coverage amount. Maybe this is the terminology some condo policies use?

    So what's going on here? Am I getting scammed? The price is normal for a condo this size, and despite the irregularities here everything else seems normal. The phone numbers I call reach people that sound professional and like they are working for a real company.

    ELI5 Waiver of Subrogation

    I own a tent rental company and have asked to include a waiver of subrogation for a customer. Ive had my insurance rep explain it to me, but am still a little confused. My understanding is if I waive subrogation any insurance claim would be though my insurance. Even if it is the result of negligence on their part. Any issues or injuries would effect my rating. Am I understanding this correctly?

    Mechanic over fixed minor damage after accident where other person's insurance is paying, advice?

    Hi there, I hope this is an alright place to pose this question, and I hope that y'all can help me out a bit.

    I got into a small accident where the other person was at fault (and readily admitted it), so I took my car into the auto shop recommended by their insurance company. During the damage inspection, I pointed out some already existing damage that I had before the accident and noted that it wasn't part of the accident I was there for. However, when I got my car back, all of the damage had been repaired, including things done where I didn't even know there was damage or any need for repair. I'm worried that the other persons insurance will now overcharge them, and they're nice people who don't deserve that.

    What's the best thing to do here, both for me and for the unfortunate person who hit me? Call their insurance and let them know the mechanic they chose over fixed my car? Will that prompt their insurance to hit me with a bill? Would the extra repairs raise the other person's rates higher than they would go otherwise? That wouldn't be fair, and I'd feel compelled to report this to their insurance to protect them from that cost.

    Homeowners insurance - vines/vegetation growing on structures

    Hey there. My partner and I are in the middle of escrow on our first home and had to get a homeowners insurance quote. The insurance company used Redfin to look at the property and observed that there are two trellises overgrown with wisteria vines. They said they can't insure the property at all unless we get rid of the plant completely. They can't insure any property with vegetation growing on any structure because it's a fire hazard. They won't sell us the insurance without a proof that we've complied.

    I assume this is common. We were planning to cut back the wisteria a lot anyway. But I don't want to get rid of it completely. Does anyone know of an insurer that is ok with well-maintained vegetation on a structure?
