My insurance is saying I’m still 25% at-fault even with a police report and witness saying otherwise?

    Posted:

I live in Alabama. I got into a collision with another vehicle at a four-way stop. I had the right of way but the other vehicle kept going and hit me.

I had a witness who stopped and told the other driver she wasn't supposed to go since she was driving in front of her and she had just went (witness' turn, then mine, then the other party behind the witness). She said she seen the collision happen in her rear view mirror and knew the other driver behind her was at fault for following behind her instead of following the law of the stop sign.

Called my insurance company and gave my testimony. Insurance said to use my claim number for hospital bills and they would get paid back by the other party's insurance if they find the other party completely at fault. When asked about handling a car rental, my insurance told me to call their insurance to take care of it. During this time we happen to mention that the other insurance is actually the same insurance as mine (State Farm) so how do we go about the car rental now since we're already on the phone. They say they'll go ahead and listen to the other party's statement and come back with a conclusion.

After an hour, I get a voicemail by the insurance company saying they found both party's at fault 25/75 split. When called back and asked why, they said because I didn't try to avoid the collision. I attested the decision and we waited for the police report. 14 days later and the police report comes in saying the other party did not yield when they should have and that they are the cause of the collision. As party two on the report, it is coded as "no fault" for the collision.

State Farm still stands firm on their decision and doesn't want to change it. Luckily I have full coverage with car rental, and the overall cost out of pocket has been $1,300 for my totaled car. However, it still bothers me that they are pinning blame on me even though I tried to stop. An attorney is now involved and came to the same conclusion that I am not at fault in any way since I tried to stop and spun in the middle of the intersection, meanwhile the other vehicle was going fast enough that they were still able to go straight and stop a ways down the road (they also have a bigger vehicle). The attorney has written a letter to State Farm inform them that they believe they have made a mistake and they included their reasoning as well as the witnesses' statement as to why.

Has anyone dealt with this before? Is it more normal for the insurance company to split blame even with other evidence?

    When to purchase COBRA insurance

    Posted:

I work in employee benefits for a large company (Utah, USA). I get at least one phone call per week from employees who are either leaving another employer to come to our company or vice versa and want to know how to bridge the gap. Here is my advice.

Don't be in a rush to do anything.

Health insurance is expensive. Most employees who get health insurance through their employer don't realize just how expensive insurance is because their costs are subsidized by their employer.

Here is your action plan: Find out what your COBRA coverage will cost. Look at your latest EOB (explanation of benefits) to see if you have met your annual deductible. Then find out the cost of your meds.

Let's say that your meds are $500/month, your deductible hasn't been met yet, and your premium for COBRA is $1,000. If you elect COBRA, you will pay $1,000 to have insurance for the month, but your deductible still hasn't been met yet so you will end up paying for your meds out of pocket.

Now let's say that your deductible has been met and you need the same medication. You pay the $1,000 premium so that you have insurance and you get your medication. Well, it still would have been cheaper to get your medication without COBRA.

Most often, COBRA won't benefit you unless you have a large medical claim while you are covered. Now you may be asking, how can I know if I will have a large medical expense in the next 60 days. To that I respond, be slow in responding to your COBRA offer.

Once your insurance coverage ends, your employer has 30 days to notify the plan administrator that you're no longer employed. The plan administrator then has 14 days to notify you that you're eligible for COBRA. You then have 60 days to notify them that you would like to elect COBRA. Once you notify them that you want to elect it, you have 45 days to make your first payment. Once you pay, your coverage is applied retroactively to the first day you were without coverage.

So here is what I say, don't run off and buy insurance right away. It's probably going to be less expensive to pay for your meds or even an office visit out of pocket.

If you get hospitalized unexpectedly, go back and buy the coverage.

Home insurance canceled after purchasing home (after meeting insurance repair demands)

    Posted:

    Location: Florida

We purchased a home about a month ago. Ahead of activating the home insurance, the home insurance company requested that we make some repairs in order to clean up our 4-point inspection. We paid for the repairs and sent the proof of repairs to our insurance agency who confirmed that they forwarded the docs to the insurance company.

Fast forward to today, I received notice that our insurer is canceling our coverage because we failed to provide proof of repairs. I called my insurance agency who reported that the insurer refuses to reactivate coverage because we have too many repairs to make—we already completed the repairs prior to the home purchase and had active insurance for a month?

In short, what impact does this have moving forward? I'm trying to escalate the issue within the agency company to get more eyes on the case but in regards to my lender, reactivating coverage with this company or another?

Am I stuck purchasing another 4-point inspection to reactivate coverage? Do I need to call my lender to get ahead of this and let them know I am working on coverage?

What's Guaranteed Replacement Cost on a homeowner's policy?

    Posted:

I'm currently shopping around for new homeowner's insurance as mine has increased 40% over the last four years with no claims.

My current policy (Cabrillo Coastal) has a specific dwelling limit of $649k. The agent I'm using just quoted me a different policy (with NatGen) for a slightly lower premium with a dwelling coverage of $750k, and guaranteed replacement cost. He says with the guaranteed replacement cost, the carrier will payout whatever the actual cost to rebuild the home from scratch may be, regardless of if it's over that $750k value.

If that's the case, what's the point in even having the $750k limit in the first place? What relevance does it have? My hurricane deductible is a function of the dwelling coverage, so if they're going to cover the full replacement cost no matter what, I guess I'd ideally like that dwelling coverage to be a low as possible.

Also, my loss of use on my current policy is $193k, whereas on this new policy it's just "reasonable". Is one better than the other?

    Husband's butt broke the wall

    Posted:

Two days ago my husband slipped in the shower and his butt went through the tile shower wall. His butt was fine 🙂 but the wall wasnt.

He took out a couple of pieces of tile and found the drywall behind it was wet and you could tell it had been for sometime. So i know at least one wall in my shower needs replaced.

Would this be something handled under my HO insurance?

    TIA!!

Located in Missouri and we have State Farm.

will canceling then rejoining affect my rate?

    Posted:

    US - Delaware

ive had progressive since 2017, and have now achieved a 3 year clean driving record! so my rates dropped drastically, considering i had to panic buy after finding out my parent lost our joint insurance months prior to me getting a speeding ticket.

currently im think of getting rid of my junk car along with my insurance so that i can save up money to buy a better-not-dying car. id plan to carpool in the meantime. im wondering though if it would affect my rate.

tl;dr : if i am without insurance for an indefinite amount of time while i am not a driver, will my rate be raised when i go back to restart/re-enroll/reinstate it?

Property stolen from local business, what am I entitled to?

    Posted:

    This was in California

My property (bike) was in a local bicycle shop for repair and upgrade

The shop was broken into and bike stolen

The insurance company for the bike shop called me. They valued my bike at $2360. This is a fair estimate IMO.

They said they are sending me a check for $1360, because the bicycle shop had a $1000 deductible. If I want the other $1000, they say I have to get it from the bike shop owner directly.

Is this correct? It seems like the insurance company should pay me the full $2360 value, and collect the $1000 deductible from their insured customer (the bike shop)

Can my parent’s insurance company add me right after i get my license?

    Posted:

I'm in the process of getting my license and my mom told me that her insurance company was going to automatically add me to her insurance right after I got my license whether I have a car or not. I refuse to pay for insurance when I don't even have a car yet so I've been putting it off but I want to drive now. I'm not sure if it matters but I'm like 4 months from being 21 and I live in New Jersey.

    Progressive interview tips, please!

    Posted:

I have a video interview next week with Progressive and I'm hoping for advice from current/former employees. I've passed the assessment tests and the 8 recorded STAR video questions.

The position is for remote customer service rep, but I genuinely want to make Progressive a long-term thing: I'd like to eventually get to claims or even legal since I have a degree in Paralegal Studies. I'm dying to get my foot in the door and want them to know I plan to go far beyond entry level.

I know the STAR format is crucial. I have almost 20 scenarios that I've been practicing. I've read up on the company's history and core values, etc.

Anything else I should take note of? Might there be a second interview beyond this one?

Thanks for any insight & advice.

How often to shop homeowners rates?

    Posted:

I bought my home 6 years ago. I had a policy with a major company and as time eventually went on, it ended up becoming half my mortgage payment, I shopped around last month. I have never filed a claim. I was able to switch to Farmer's. Same exact coverage but my deductible is $500 less and the farmer's policy also covers pipes under my slab (I live in a townhome). The policy is less $839/yr.

How often should I revisit my policy and shopping prices? I don't want to change companies but $839/yr was too good to pass up.

State Farm Drive safe and safe

    Posted:

Hello, So my husband and I are enrolled in this. We just received our beacons and have been monitoring our driving. For the most part we do well but the most shown event is our phone usage. When he drives my car and I am on my phone it causes an event. We also both use our phones for gps which causes events throughout our drives. How will this affect our discount in the long term as it's our most seen negative event?

I have a physicians bill from an out of network emergency room visit (physicians bill) for $1,212. My coinsurance is 10% and my deductible had been met. The insurance only paid me $746.89 because the allowed amount was $808.20. But the hospital still wants me to pay them almost $500.

    Posted:

My insurance won't budge. Is this even legal? I thought an emergency room was covered differently than an out of network provider.

How do I get COBRA from my ex-husbands employer?

    Posted:

I was recently divorced and would like to file for COBRA through my ex-husbands employer. My ex-husband works for a large and well-known company. From my research, it seems like I am eligible for continuation of the health and dental insurance I was receiving. However, I cannot figure out how to get the paperwork.

This company is very hush-hush because people will contact them about the product they make. There is no way to call, email, or contact them online. My husband and I are not on speaking terms, so I don't know if he's even removed me from the benefits yet, although I'm assuming he has.

How do I go about getting the paperwork to file for COBRA? I called the insurance company directly, but they said I have to contact the company. Other than showing up (which wouldn't work because they're all working from home due to COVID), I don't know how to contact them to get them my address.

Where to find good, licensed brokers/agents/CSRs/salespersons for hire?

    Posted:

Hi all! I'm interested in hearing where other independent insurance brokerages find new talent. I am 99% a commercial insurance agent, and I know I'm getting close to the solicitation rule here, so I'm not going to link to my job postings or anything - but I would love to hear your ideas on where the best place is to find solid employees for my small family-owned commercial insurance agency.

We've trained and licensed several people over the years, some who have been with us for over a decade - but I'll just be brutally honest and say we've recently just been a revolving-door of people.

We're finding the talent on Indeed is... lacking. And headhunters and temp agencies... We've been down that road before - it's 99% people just using us as a stepping stone to a bigger agency or a national carrier, etc.

EDIT: I'm in Southern California, but this discussion could apply for anyone / anywhere!

How do I find out who my neighbor’s homeowner’s insurance is with?

    Posted:

Long story short, My neighbor and I haven't been amicable with each other for over a year. His portable basketball hoop fell on my block wall and took a huge chunk off of the cap.. I can't go over there and ask him for his info. Here are the things I've already tried:

    • Reached out to my insurance to see if they can help me find who his insurer is. No luck

    • Called local PD to see if they could assist me in approaching him to get info; they stated they wouldn't get involved..

    • Tried the county's assessor's office to see if I could find anything that would show insurance info - no luck..

This sucks and I do not want to pay a deductible for something that wasn't caused by our own property.. we are in California btw

homeowner's vs builder's risk for renovation

    Posted:

We're adding onto our house and building a detached garage. It's an expensive, but not altogether massive project. Adding a bedroom/bath and then a good sized detached garage. As most of the work is occurring outside the existing living area, we're living in the house during the work.

The builder asks that we have Builder's Risk insurance. However I've now spoke with 4 different insurance agents and have gotten the same answer repeatedly, which is that if we're living in the home during renovation, our Homeowner's insurance policy will provide the needed coverage for construction. Of course, we'll have to increase the coverage on the homeowner's to include the increased value of the dwelling and the new separate structure / garage.

The builder seems uneasy about this... what do others think? When I google it all I find is insurance companies spewing info about builder's risk insurance.

Do most people only get the most basics of the basic coverage for auto insurance?

    Posted:

I'm a pretty good driver, no accidents or any traffic tickets/violations in the 17 years since I bought my first car. This is mainly due to the fact that I've always lived close to school and jobs this whole time. I am also somewhat mechanically inclined so I can fix my cars and because of that I've always owned slightly older cars.

This whole time I always hear from friends/coworkers/relatives how little they pay for their car insurance, yet my insurance is always double what they claim they pay, and again, I drive older cars, no accidents nor tickets.

So a few weeks ago, I actually saw one of my coworkers policy and this mother fucker has 25/50/25 liability coverage, uninsured driver's coverage, and that's it! He drives a 2016 Honda Accord.

And that's when I thought "no shit." I have full coverage on my 2010 Civic along with roadside assistance, medical expense, rental, etc.

This prompted me to ask some of these people who've always claimed they had cheap insurance to see their policies. Lo and behold of the 11 people whose policies I've seen over the last two weeks, no one, not one of them had anything more than liability and uninsured coverage. The oldest car among this group of people is a 2013 Impreza, so it's not like these people are driving cars from the late 80s and early 90s that are worthless..

So, for those of you who work in the insurance industry, is this just an anomaly among my friends/coworkers, or is this true for a lot of people out there? And do these people know the coverage they have won't really cover much?
