Evicted for having a baby "without permission". [VA] Posted: 30 Apr 2021 07:32 AM PDT I'm posting this on behalf of a friend. My buddy, his very pregnant SO, and his two daughters have this apartment that they've lived in for several years now. The complex is a very old, "historic" building and they've always had problems with the landlord and maintenance. My buddy has been into it with both of them numerous times over fixing things that never get fixed. The biggest example is that they have an entire bathroom that they can't even use anymore because it's in such bad shape. The landlord has kind of been getting away with quite a bit of shady behavior since they've lived there, but "she's old and crazy" so they usually don't try to fight too much. Well, I guess my buddy went and had some words with the landlord again over the fact that they're paying for a two bathroom apartment and can only use one. The property manager was there this time and said something to the effect of "Well, we never gave you permission to bring anyone else in here." Buddy obviously had no idea wtf this guy was talking about until he gestured at his SO and said "She's pregnant, isn't she?" Buddy storms off, once again defeated by this asshole of a property manager and his batshit crazy landlord. Only this time, it was different. A couple of days later, there's an eviction letter on his door. Now, we're pretty sure the real reason for the notice is because they're tired of my friend hassling them to, you know, do their jobs and maintain livable housing conditions. But, they can't say that, so their grounds for eviction is that his unborn child doesn't have permission to live there. At this point, my friend wants out of there bad enough that he doesn't want to fight with them over it and is just looking to get out, which it definitely for the best and he should have gotten out of there long ago. But I wanna know if they can legally do what they did to my friend and his family, and if there's any course of action that can be taken here for the sake of protecting future tenants. Seems really messed up to be able to put a family out of their home just because you don't want to maintain or fix (or pay someone else to fix) the property that they're paying you to live in. EDIT: Hey, everyone. Sorry for not communicating for a while, I got held up with work. So, to clarify some things- •The written notice did not specify that the additional person brought into the home was the baby. This was only verbally brought up during the confrontation between the property manager and my friend. •The only witnesses to the conversation were the actual landlord and my friend's SO herself. •She is on the lease. I don't know if the older two kids are, but I know the landlord is and has always been aware that they're there. They are both under 18. •She is still pregnant and is due in June and they had 60 days to get out. This happened a couple of weeks ago, so I'm thinking she'll likely have the baby before their eviction date, but I'm not entirely sure. •The apartment is 3 beds, 2 baths. All of that aside, you guys have already been so freaking helpful and I can't thank you all enough. I will share all of this info and the resources you guys provided with my friend ASAP! I know he'll appreciate it, too. [link] [comments] |
Posted: 29 Apr 2021 05:19 PM PDT I'm still very upset. So I'll try to keep this level headed. I live in a smaller apartment building, just a few units. My neighbor is moving and my landlord posted their unit on Facebook marketplace or something. However MY unit was posted. A lockbox was installed outside with MY units keys. And when people reach out on the post, they are given the code and directions to my unit. For the landlord's and future tenants safety, in the post apparently "socially distant safe viewing opportunities" is a large selling point. Basically just giving out keys to anyone who wants to see it. The first time I was getting out of the shower (6/7 pm) and thought my boyfriend was home early for the day-nope a family was walking through my front door with keys, no masks, and their Facebook message in hand. Even the neighbors in the actual unit that will be available was confused at what they were doing there. And they left before I could get the keys—as I had to go and actually put on clothes (in my own home). We all instantly began trying to contact the office, but it is after hours so no response. Around 11pm a few men come waltzing in my home with the same information—and drinks and snacks in tow. The pictures in the ad are of an empty unit so I guess they thought they were coming in for a space to party? They left too quickly to get any information from them as well. Because they clearly knew they messed up. Again I'm frantically trying to contact management. Here is where I need the advice. I legally have a gun (permits yada yada). I usually keep it locked up. Not now obviously. After the first instance I told management how their recklessness is putting others in danger-COVID & guns kill! My lease explicitly states that the locks can't be changed without written agreements from both "agents". I broke that and installed new locks after the men came in for a party and I hadn't heard back from management. Still nothing. I come home today to 2 more men trying to force, presumably, my old key into my new locks. I ask them for the key and they say they can't because "they're responsible for them now" and they lock them in the lock box and leave. Still nothing from management. In the many times I have reached out to management about these lease violations I have heard nothing back. I haven't told them I changed the locks because I don't want to be the one to get in trouble for the violation when I'm just responding. Would that be possible? I kept the old ones so I can change them back. Moreover, NJ is very strict on guns being operated by those it's not registered to. My bf then is not legally allowed to use my gun. So even if worse case scenario management still won't do anything and my bf defends himself with my firearm would we have a case? A literal family came in and I reached for the gun because I had no idea who was barging in. What if I shot a kid? I told management the situation. And somehow they can't respond to me but they can still send out strangers to walk in. Would I have grounds to withhold rent for the locks even though I technically broke the lease? How should we go about defending ourself to the people still trying to force themselves in at all times of the night? It is very hard to rent in NJ if you have any legal issues with landlords so I'm nervous on how to proceed. But at this point I think it necessary? Thoughts. [link] [comments] |
Posted: 30 Apr 2021 07:38 AM PDT So I'll start with a little bit of back story. My step dad has always hated our small dog who would have been around 16 years old when she passed. He had no actual reason not to like her. She was good, healthy, slept most of the day (shih tzu breed, they tend to sleep a lot and have long life spans). Any time she would go near him he would stomp his foot on the ground to get her to get away from him. We kept her away, and she just stayed away from him for the most part. Fast forward to a week ago and she started to develop some incontinence problems. This enraged him because he didn't want to be the one to have to clean up after her if no one else was around and she was going to "damage the hard wood floors". Honestly though, it wasn't too bad of an issue and we talked about getting her taken to the vet. After all this could have just been a simple UTI or something minor causing this. He casually mentions having her put down due to her old age and we shut him down pretty quick because at her last vet visit she was healthy and I didn't really want to think about her dying until I have to. He knows how sensitive I am to these kind of things, I was a hot mess when my elderly cat died about a year ago. The same night, everyone is sleeping except for him. He stayed up in the living room until about 1 in the morning and for some reason I was just struggling to sleep so I was playing around on my phone. All of a sudden I heard a loud thump from out in the dining room, I heard my dogs paws so I assumed he stomped at her to get her to move away. But then I heard a really loud thud/slam and my heart stopped. I was way too afraid to go out there since no one else in the house was awake at the time and I've always been scared of the man. Keep in mind though he has never actually hurt the dog or any of our other animals. My daughter and I live with my parents, so the next morning I go upstairs to get her out of her room, bring her down to her changing table which is in the dining room and there I see my dog laying on her side in a strange position, pressed against the changing table. I immediately called my mom and told her what I heard that night and that I found the dog dead. She came home from work and helped me move her because I couldn't bring myself to touch her. It took her about an hour and a half to get home and this whole time my step dad is sitting about 3 feet away from the dog covered up by a towel and doesn't mention anything about her not being around or anything. I didn't say anything about it to him because I knew he did it. When my mom got home he went outside immediately. We moved the dog and found a lot of blood coming from her mouth which only happens in the event of a traumatic death. We contacted the police and they took her for a necropsy. My mom went and got a PFA and he has been removed from the house. We got the results back today and sure enough he did it. Dislocated hip, dislocated shoulder, ruptured lungs, a protruding eye, and blunt force trauma to the head all contributed to her death. I can't stop crying. How sick of a human can you be to do something like this? I guess my question is, what are the possible outcomes for him? We are in PA. The humane officer and police officer are working together right now to press charges but we wont really know anything until they do it. What kind of trouble can he be in for doing this? TLDR; step dad never liked our old dog, waited until he thought everyone in the house was asleep and brutally murdered her and left her right on the floor for me to find the next morning. Georgia - Landlord's Tenant's 8 yr old Son Raped/Molested by Neighbor's 10 year old. What do I do? Posted: 30 Apr 2021 07:34 AM PDT Guys, This story is chock full of bad. I have had a wonderful tenant for multiple years. They just (last week) signed on for another year of the lease. They have been great - handling maintenance, doing landscaping, etc... And then this morning the mother (our primary contact) called me in tears and asked if they could break the lease and cancel the renewal with the news that they have discovered the the neighbor's child (10 year old) had raped and molested their son (8 year old). They obviously don't want to have this go on, and don't want to add more trauma to their child by remaining immediately next door. Obviously that is heartbreaking, and I want to do whatever I can to help my tenant. But what else do I need to be concerned about? Here are some thoughts on the matter:
While note entirely relevant, I am an out of state landlord, which while not relevant to the immediate situation, it does make tenant transitions very difficult, which is why we seek out specific tenants that can perform or manage a lot of things, and our lease states that there are responsibilities of home maintenance that fall to the tenant to be responsible for. Some questions (some of these make me sound like a complete asshole, but I have lots of concerns):
Please let me know your thoughts, as I would appreciate it. [link] [comments] |
Posted: 30 Apr 2021 09:54 AM PDT Hello, Like the title says, the company we are renting from incorrectly marked our apartment as vacated before we had vacated and before our lease was up. We are near Chicago in Illinois. I drove to my apartment after work (4/29/2021) to get the last few items I had at the apartment that we had left there to bring to our house. When I arrived my apartment door was unlocked and the apartment company had let some painters that had been there painting the building that day into my apartment without my permission and were cleaning their brushes/rollers in my kitchen sink. I immediately noticed that my two vacuums were no longer in my apartment as well as a sander that I had there. I asked the painter, who again was not allowed into my apartment by myself, where my stuff was and he said he didn't know. I called the apartment complex and the woman I had spoken to that morning about how to turn in the keys had said she had made a mistake and marked it as we had already vacated the apartment. Maintenance had shown up and starting throwing away our personal belongings. A lot of items that were thrown away were damaged or destroyed. Several of these items were of significant sentimental value that cannot be replaced. The maintenance employee who had been throwing away my stuff said that he had taken several of my items for himself and offered to return them to me, which he did. He also had given one of my vacuums away to one of the painters, who does not work for the apartment complex, that I was luckily able to get back simply because I had arrived and called before he had left with it. The employee and I both climbed into the dumpster and sifted through the trash for quite a while trying to recover anything that I could. Several items were damaged and destroyed. There were items that are missing that could not be found within the dumpster. I'm not sure if someone took them or if an employee stole them. There was also a large wet spot in the apartment that was not caused by me as I had not been back to the apartment since late Sunday. The damage had obviously occurred that day and likely was caused by someone the apartment complex had let into my apartment without permission. I obviously do not wish to pay for any "damages" in the apartment since they very well could not have been caused by me. The manager of the complex offered a very small amount that would not cover even replacing the items damaged and certainly didn't make up for the loss of sentimental value for some of the items. When the incident occurred I did make a police report so that it was documented as well as video and pictures showing the damage and items thrown away. I contacted a local lawyer so said that they would charge a $3,000 retainer, $375 per hour of office time and $400 per hour of court time. The low end of the cost of damage I calculated out to be around $2,000, but the issue is that we aren't sure of everything we had in the apartment when it was thrown away so we might later find other items were thrown away or taken. The lawyer recommended small claims court and to represent myself. I am not a lawyer and know nothing about law or how to handle this. I don't know that going to court by myself is going to screw up my chances of having this wrong righted. Are there other ways to hire a lawyer or less expensive options? I'm just really looking for advice in this crappy situation. I can answer or provide more details that might be needed. [link] [comments] |
Posted: 30 Apr 2021 01:05 PM PDT The neighbor got a quote from a body shop for $6300 to repair car. The tree guy paid the neighbors that amount. Then tree guy told me they filed a report with their car insurance . He said the neighbors also said they would sue me after so their car insurance didn't go up.It looks like they are feeling a little fraudsy. I'm not worried about that because I know he paid them already. I just want to know if that's something that happens. Can the neighbors go after me for the damage caused by the tree people? Neighbors threatening to sell adjacent land Posted: 30 Apr 2021 09:04 AM PDT Long story short I moved to New Hampshire about two years ago and bought a house I love that is on about 2.5 acres in a pretty rural setting. Yesterday the neighbors who live above me who own over 500 acres in this town, contacted me to tell me they need to cross over my land to show a realtor a property behind mine, and that they want to sell it. This land butts up against makes up my "yard" area. I asked if I could come up and talk to them about it and when I went up I basically said I would buy, just to keep everything the way it was. They did not agree and said well we think we want to list it and see what we get. Fair. But there is no access to this lan unless you come up my driveway and walk through my yard. The only other way would be to park along a busy road and climb a steep hill with a fence along it. I agreed to let the neighbors use the driveway access to show the realtor but I am pretty sure I am going to make it clear that it will be the last time anyone is to come up my driveway. I went to town hall and pulled records and I found the deed to the property in question and it states "Lot 5 has Right of First Refusal granted to (me) by (Owner of Land) dated and recorded." So obviously we would have the right to match any offer BUT the kicker is; they transferred or sold this land to the owners wife last year, while I lived here and we did not get the right of first refusal. Do I have a leg to stand on here? I feel like they are playing games with me and want to gouge me for money to buy this land so nothing gets built there, ruining the value of my home. They are an elderly married couple that have PLENTY of money so I am not entirely sure what their angle is. How should I move forward and should I not let them cross my property to show the land? This land really only has value to me unless someone was extremely motivated to build close to me in a rural town, which isn't impossible and it would destroy what I have. I live in lot 8-93-40, and the lot in question is 8-93-40D. Thanks for your help. [link] [comments] |
[Texas] My manager didn’t approve my timesheet and I’m not getting paid. Is this legal? Posted: 30 Apr 2021 12:10 PM PDT Let me give you the story. In 2019 I was diagnosed with a very aggressive type of cancer. I went on short term/long term disability and then I came back to work after a year. During that year the company changed the software we use to track projects- I'm a project controls specialist and I had to learn from scratch, while still going through chemo and having horrible side effects that impaired my memory, concentration and ability to learn. I'm also taking medication for anxiety, depression and ptsd. I tried to get disability from the state and it denied under the premise that even when I was suffering a disability they had different definitions and I didn't qualify. So I slowly tried to get back to work but I haven't been able to successfully come back. I'm a salaried employed, performing sub par if I'm totally honest. A week ago I was told I was getting a final written warning and put me on a PIP. Since 2 weeks ago my timesheets are being rejected, and today for the first time I didn't have a check. My timesheet was once again rejected today. I told my boss that instead of playing this game they should fire me so I can go on unemployment but that not having a check in 2 weeks for a second time is unbearable for me at the moment. I'm a single mom of 2. I'm currently living in a hotel since I was evicted from my apartment a week ago. I was supposed to move to a new apartment tomorrow but since I didn't get paid today I won't have the money to pay the rent and move to the new apartment tomorrow. After work hours I started to do doordash so I could at least have some money in. Is not approving my timesheets and not getting paid legal in Texas? [link] [comments] |
Sellers Refusing to Vacate and Handover Keys for Possession of New Home Posted: 29 Apr 2021 07:28 PM PDT Context: Metro Vancouver Area Apologies if we've posted to the wrong subreddit but hoping we can get guidance on a very stressful situation we are currently in. We're supposed to take possession of our new home tomorrow but today we were informed by our realtors that our sellers are refusing to hand over the keys for possession tomorrow. We've already closed on the property and it is / will be legally ours. We sold our current home and the new buyers are supposed to be given possession of our place two days after we were supposed to move in. We will still be showing up with our realtor at possession time tomorrow very well prepared with the possibility they won't handover the keys at which point we will be going directly to lawyers. Has anyone dealt with something similar or know how lawyers proceed in these situations? This is extremely stressful as we now have to arrange storage and seeking accommodation in a hotel. I really hope no one has to ever deal with a stressful situation like this let alone for the biggest purchase of their lives. Any insights or experiences or guidance is appreciated. Regardless, looking forward to seeing a lawyer tomorrow. Thanks in advance! [link] [comments] |
Neighbors tree has fallen on our fence a second time in a year. PA Posted: 30 Apr 2021 07:08 AM PDT Last year in june a bad storm came through and a large portion of the neighbors tree fell our our fence. It was old so the damage extended to most of it requiring us to buy a whole new fence. We were able to get $1000 from insurance towards the cost of a new fence $10,000. Last night another large portion of the same tree fell on our brand new fence taking out a large portion of it. Would this hold up as negligence in a civil suit so we could get compensation for repairs? Are they at all liable for this if insurance doesn't take care of the entire cost? [link] [comments] |
Someone has been giving my phone number out for years and claiming it's theirs. Posted: 30 Apr 2021 12:02 PM PDT I live in Los Angeles and I have had the same personal cell phone number since 2007. For at least the past three years, I (26F) have been receiving spam texts directed at a man who has a very specific name, nothing like John Smith. Let's say his first name is Samuel. It's always been a huge nuisance to me, but it can be fixed with a spam blocker. I've always wanted to make him stop, but with just a name and no proof of him existing, I wasn't sure of anything I could do. However, today I took my car into a national chain auto company for an oil change, and when I gave them my phone number, the guy looked at me and asked if I was Samuel. That was the first time in three years it has ever crossed from spam texts into real life. He turned the screen and sure enough, this man Samuel had my number listed on file as his, and I was able to get a glimpse at his address when I saw the screen. The man at the chain asked me if I had an alternative phone number I could use, and I said no, this is my only phone number and this man has apparently been stealing it for years. When I got home I called my phone carrier and there wasn't much they could do because he's not a customer of theirs. They suggested I file a police report since I have the guys name and address, and I have documented proof that these spam texts and calls have been happening since at least April 2018. I'm not really sure what the police can do though, and my mom tells me that then my information will be out there and he could potentially harass me more or retaliate against me for reporting him. But even when you google my phone number it comes up attached to this guy's name. My mom says I should just change my phone number, but this has been my phone number for 15 years and I hate that I have to change it because this guy keeps giving out my phone number and claiming it's his. Before I take that measure, I wanted to see if there was anything I could possibly do to make him stop. Thanks so much in advance for your time! Edit: adding location [link] [comments] |
Posted: 30 Apr 2021 01:43 PM PDT Hey everyone. So my lease is ending soon and I got a call from the leasing company I'm renting from telling me they're going to take $700 out of my security deposit to repaint the rooms I painted. That amount might seem like pocket change to some of you but it definitely goes a long way for me. This is what my lease contract states: "ALTERATIONS: Tenant shall make no alterations, decorations, additions, or improvements to the leased premises without first obtaining the express consent of Landlord. Tenant shall not paint any walls without express written consent of Landlord. Any of the above-described work shall become part of the dwelling. " I have written consent in email form from the landlord that I can paint. Not sure what "Any of the above-described work shall become part of the dwelling." means. Does that mean that it's now part of the house and I don't have to pay to return it back to original paint color? Thanks in advance! P.S. I offered to paint it back myself but they told me it has to be professionally done. Again, I don't see that anywhere in the lease… [link] [comments] |
Landlord passed away and a stranger came along with the power of attorney to claim rent Posted: 30 Apr 2021 11:51 AM PDT My long time friend and landlord recently passed away and I feel very uneasy about this whole situation. I am renting the first floor as a small business owner and my landlord lived on the second floor. I've always known her health was rapidly declining due to her stroke a couple years back but she seemed fine for the most part. I thought she would have at least a few more years. She was an only child who lived alone, was never married, and had no kids. Most of her relatives were distant and no one comes to visit her. The only people who are close in her life are her childhood friends and her church group. We had a mutual respectful relationship due to the fact that I am renting her building for more than 20 years now. We would give each other presents for birthdays or if any one of us needs help, we would try to help each other. I would always try to bring the topic of buying her building throughout the years because of her declining health but she would always refuse. I figured it would've been the best for the both of us since she's still living on the second floor and owning the building would help rid her paperwork/maintenance the building may need. I even offered to let her stay for free and I'll take care of everything. Anyways, I've come to this subreddit for some advice. My landlord was admitted to the hospital for some health issues about a month ago and called me to pick her up after she was done. While on the drive back, we've had a conversation about her health and what she was planning to do with her property. I specifically remember her telling me that she does not have any relatives or kins and that if anyone tries to claim that they are, it wasn't true. As the conversation goes on, she tells me to always take care of "our building" and don't let anyone try to take it away from us (because a lot of business owners in the area has been trying to buy her building/kick her out for years). I wasn't sure what that meant because she never mentioned anything about her will or what she was planning to do with her building after her time has passed. A few days later, she was readmitted to the hospital and never came back. I tried reaching out to her but I never got through. I've called countless times but it went straight to voicemail. The following day the hospital called and asked how she was doing and how we should proceed to the next step for hospice care. (I figured if they were calling, she put me down as an emergency contact) I was really confused because I thought she was still in the hospital but apparently she was discharged yesterday. I was told a man picked her up from the hospital yesterday and is currently taking care of her. At this point I was concerned because she wasn't picking up my calls and she told me if anyone came to see her, it was to claim all her property. She mentioned her exboyfriend's son a very long time ago and that it never worked out because they weren't good people. I figured if she didn't have any relatives and no one else knew she was in the hospital, it might've been him who picked her up. The next day, a man showed up during my business hours saying he received the power of attorney from my landlord and he's there to collect the rent. He then threatened me if I didn't pay, in his exact words, "if you give me trouble, I will give you trouble," so I then proceeded to keep my head down and pay the rent. I was confused by it but he claims to be her nephew or someone related to her (this part was kind of fuzzy because it caught me off guard). Over the next few days, he's been showing up and asking for $850k to buy the building from him and told me I had 3 months with this offer, if I didn't agree to it, he will put it up for sale on the open market. Also was confused by this, I kept trying to get in contact with my landlord but did not have any luck. I asked the guy where she was and he said she was staying with him and he was taking care of her. A few more days later, he showed up with the keys to her apartment (upstairs from me) and rented out one of those big dumpster for construction. He hired people to literally clear out my landlord's place and threw everything of hers away. He didn't even take a look at anything and just tossed every single thing. I asked him why he's doing this if she's at your place. I told him she might still want to live at her own place after she feels better. I kept asking when will she be returning to her own place but he keeps dodging the question. As her things were being thrown out, her childhood friends came by and asked what was going on and I told them everything that happened. they were also concerned for the landlord and asked everyone who knew her to help out with this situation. Currently, we do not know who this guy was, where she is, how her health is, or if she is even okay. Her group of childhood friends went to the church to ask the father of he would be able to help out. After many days of trying to contact her, they decided to go a different route and assume the worst. They called all the funeral homes or hospice cares in the area if there was any service provided for her and was told that none of them did. After countless tries, her best friend finally got in contact with the guy and told him when her time comes, she wants to be buried naturally and will have a plot of land waiting next to her mother and father. The guy finally tells her she passed weeks ago (two days after he picked her up from the hospital) and he cremated her. No service was provided and he didn't tell anyone. Her best friend got this news and told me about everything. I felt so hopeless and empty on the inside because for all this time, she was alone and never had the chance to say goodbye. Not only did she not get any service provided for her, he went against her wishes and cremated her. Now that the news has spread, the church she goes to will be providing a proper service in honor of her this upcoming Saturday (tomorrow). I came to this subreddit to ask what are the legal grounds on the property. Is it in his rights to claim her building? I'm still a little off because no one can confirm if he is actually related to her. It seems like he's been planning this for a really long time. For many of my landlord's hospital visits, not once have I seen this person take care of her, provide, or even visit for her. Is there anyway to ask him to prove he is next of kin? P.s. I forgot to add this. When he brought the power of attorney, her signature looks forged. It didn't look like hers at all. I have years of leasing documents that have both of our signatures and can easily tell that it wasn't hers from the start. Edit: I'm currently in Illinois [link] [comments] |

Was given a duckling that we are now certain is a mallard Posted: 30 Apr 2021 12:39 PM PDT I have no idea what to even flair this. Long and short, yesterday a friend found a lone baby duckling wandering a highway, or so I've been told. They brought this duck to me as I live in the country, and have the supplies and space to raise a duck. However, in the time I've had him, we've come to the conclusion that this duck- Gary, as he was named- is almost definitely a mallard. Mallards require permits to keep, at least I think, due to being migratory birds. The problem is that he's only a few days old from his size, and I'm not sure what to do. So here's the question. I live in Lancaster PA, how would I go about getting a permit? How expensive would it be to maintain this bird, and barring the first two, how much of a process will it be to contact the games warden to have him relocated? [link] [comments] |
Strangers account on Amazon was hacked, my husband's name and address was used to send the items to Posted: 30 Apr 2021 11:40 AM PDT My husband and I got a message from a guy on Facebook (not a fake account) that said he noticed his packages was being sent to our address and name. I have no idea why or even how. I told him we will watch out for them and if they are sent here, we will send them back. We don't know a lot about computers and are totally ignorant to anything hacking related. Could this be identity theft? What should we do? We are in Oklahoma, not sure where the guy that got hacked is from. Help! [link] [comments] |
Posted: 30 Apr 2021 10:35 AM PDT I live in NC and the warehouse is in VA. The warehouse is in a town without an airport 4 hours away from where I live. To get home I need to somehow get to the closest airport which is an hour away then get a flight home which this last minute costs over $400 and there are no direct flights so it is going to be an 11 hour flight. This was never mentioned to me when I started working and none of my coworkers said they knew they had to do this either. Do I legally need to bring it back if they are not offering to help me get home? Here is where it talks about the vehicle in the employee agreement contract I signed If the vehicle is returned for any reason, the Driver shall provide all sets of keys and return the vehicle clean, inside and out, without damage and at least one-fourth full of fuel and to the original assignment location. Failure to comply with this requirement could result in the employee paying for cost of key replacement and vehicle cleaning. The Fleet Manager must be made aware of any vehicle driver changes immediately. Vehicle Condition and Return: Drivers are responsible for maintaining the vehicle in good condition at all times. At the time you return the vehicle, you shall provide all sets of keys, fuel card and return the vehicle clean, inside and out, without damage and with a full tank of gas to the original assignment location. The Fleet Manager will make the final inspection. [link] [comments] |
Proper Action To Take When Child Changes Residential Custody Posted: 30 Apr 2021 08:19 AM PDT For the last 4 years, my ex retained full residential custody of my daughter along with full child support. Recently, my ex allowed my daughter to move in with me full time (her reason basically came down to: the benefit of the child). I changed her school to be near me and she's been attending there for a week at this point. My ex agreed that I no longer need to pay child support (and that she'd be open to paying support herself), but there is an existing court agreement indicating the amount I need to pay and my visitation. I believe I am vulnerable unless this existing agreement is addressed, though in a situation like mine (where both parties agree on the change), I'm not exactly sure how to proceed. I'm happy to reach out to a lawyer, but I'm posting on here to align my expectations and to validate what they tell me. Location: Suffolk County, NY [link] [comments] |
Deceptive Used Car Buyer's Inspection Posted: 30 Apr 2021 12:37 PM PDT Hi folks! I bought a used van from the owner in Seattle, WA a few months ago - brought it to a local dealership to have a buyer's inspection. The service manager said it looked great, and gave me a report of the inspection, so I went ahead with the purchase. I brought it back to that same dealer for oil change service today, and the tech said "we also have a record that some transmission work needs to be done." How could that be? He pulled out the buyer's inspection record which lists multiple significant issues, totaling many thousands of dollars of work. They gave me a copy of the report after the inspection - my copy has none of these issues listed! So - I feel that the buyer's inspection was deceptive. I may have chosen not to purchase the vehicle, or I could have negotiated with the seller for a reduce price. Would anyone advise any legal action based on this situation? Or some other way to recover the costs of this deception? Thanks for any input. [link] [comments] |
My brother died with no will, no wife, and no children. What to do about possessions, debts, etc? Posted: 30 Apr 2021 09:00 AM PDT Throw away, just to be cautious. Located in North Carolina. My brother passed away a little more than a month ago. The cause remains unknown because he had health issues, but I'm guessing it was narcotics-related (or at least a contributing factor.) We're still waiting on the toxicology test. My brother was a sort of a secretive person, so I don't know the extent of his possessions and debts. As far as I am aware he does have two cars under his name. I do know he has credit card debt, medical debt. So he definitely had more debt than money to his name. He also had legal issues, so he died before he had to be summoned for his court date (which was rescheduled?), so I have no idea what to do about that. The cops also have his phone, and some of his other belongings in their possession for "investigation". We also don't know the extent of his medical history either... Where do we begin? Posted: 30 Apr 2021 01:19 PM PDT So I just got a letter in the mail today that I am being evicted from the home that I rented for the last 6 years because I refused to get rid of my firearms. I moved to this house in the beginning of 2016. Never late on rent. Respectful to the property and the neighbors. Never caused any issues. Nowhere in the lease agreement does it say that I am not allowed to own firearms or not have the firearms on the property. I never had any issues with my landlord until recently. She came by because she needed to retrieve some personal property from the attic. We scheduled a time for her to come in and get what she needed. She came in through the garage where I have one of my gun safes. She pointed and asked what was in there. I told her it holds my hunting rifles. Her face said it all. She was scowling and then went on to talk about gun violence and how she absolutely does not support it. Furthermore, she goes on to tell me that she doesn't want any guns in her house. She tells me to take them to a storage unit or sell them. I did not engage with her in an argument. I simply asked her to go get what she needed. When she left she said there would be "consequences" if I don't get "those guns" out of her house. A few days go by, she calls me and asks if I have removed the firearms from the premises. I told her I hold no legal obligation to disarm myself in my own home. She goes on to remind me that I am a tenant and that it is her home. Fast forward to today, I receive a letter in my mail. It was not stamped so that means she opened my mailbox and shoved it in there herself. Summary of the letter is as follows: "OP you have been a great tenant all these years but I am sorry to inform you that you have 30 days to move out. I had instructed you to remove all of your firearms from the premises. You ignored those instructions even though you were warned of the consequences. *insert gun violence mumbo jumbo rant here*" I have been looking into other houses in the area for the last 6 hours. There are no suitable properties available. I want to know what are my options here. She is attempting to evict me because of a personal vendetta for firearms that was nowhere stated on the lease agreement. It feels like an unlawful eviction, and I want to know what steps I need to take before I go get an expensive lawyer involved. For legal reference this issue is taking place in Ohio. I am in a yearly lease that ends January 3rd 2022. [link] [comments] |
Posted: 30 Apr 2021 03:05 PM PDT The Reddit post below explains the situation in detail, but in a nutshell, a state licensed electrician performed unsafe and shoddy work. He put my children and my friend's children at direct risk of great injury. I am absolutely livid, but my better half says don't ruin this dude's life, just ask for a refund and move on. But I want him to know if he doesn't give me a refund I'm going to file a complaint against the state licensing board and review is company on every place I've seen him recommended by people. He's also a teacher of electrical work trades at a high school. But I don't want to threaten this if it's illegal or unethical. The job was $980 and included work other than just the two fans that were unsafely installed. I am thinking of asking for a full refund or half refund. I'm in Virginia. [link] [comments] |
I want my name removed from my condo's management board. Posted: 30 Apr 2021 10:04 AM PDT I'm in New York City and I have resigned from my condo's management board since March 2020 but they are still using my name on condo-related documents. The other board members don't want to put their names on these documents. Is there any specific legal action I could take to make this change? I'm worried about potential liability since I'm no longer an active member of the board. [link] [comments] |
