Possibly getting sued for tapping a car at a stop sign 2 years ago. What are my options? Posted: 01 Mar 2021 01:26 PM PST So this happened in May 2019 in Philadelphia: I was driving to college (20 years old at the time) to take my finals and headed down a street that merges onto a major road (Roosevelt Boulevard). Usually, there's a line of cars that sit there in a line at the stop sign waiting for their turn to merge (turning right) onto the road. Anyways, I was behind this one car and saw that there were zero cars coming from the major road, so I stupidly assumed she would've already gone by the time I started inching forward. But she inched forward and stopped. At that time, I was already looking to the left to make sure there were no cars, so I could merge right. I let go of my brakes and let my car coast forward while looking on the left and then I felt the tap of my car bumping hers. We both immediately got out of our cars and both confirmed neither cars sustained any damage. My car had gone 5 mph tops. I gave her my insurance card and I was on my way. I know, I should've taken pictures but I didn't. Fast forward to a week later and my insurance calls me telling me the claim has been filed against me. I send them a picture of my car's front bumper and they also see there was zero damage, not even a scratch. From what I saw, she was the only person in her vehicle. We were stopped on the side of the road for a good 10 minutes and nobody ever got out except for her, but she claims there were 4 other passengers and herself in the car who sustained bodily injuries. Well that was almost 2 years ago and I have heard nothing until today. I received a letter in the mail from my insurance company (Progressive) that a lawsuit may soon be filed against me. I called up the agent and she agrees that it's probably nuisance money and they're trying to pull a fast one, but that the plaintiff's investigator has supposedly received medical bills for all of the people and that my insurance may not be able to cover all of the damages. I went to my progressive account and see that the plaintiff has claimed zero damage to her vehicle, but is still pushing for bodily injury claims for all 5 "passengers" and has until May 2, 2021 to file a lawsuit or else the whole thing goes out the window. I'm not sure what my options are, but I've already reiterated to the agent that to my knowledge, the driver was the only one in the vehicle and that her car had sustained zero damages; I am wondering if they still have a case for 4 bodily injuries against them for tapping their car while acknowledging zero car damage. Could they be bluffing about the medical bills and trying to make me settle outside of court and pull a fast one? How bad does this look for me in the courtroom if this were to escalate that far? Help! I don't know why lab tests were not covered by health insurance (GEHA) Posted: 01 Mar 2021 07:46 PM PST The bill is coming up to $1200 and I don't understand why. This is not for me by the way, but someone I know who is coming to me for help. Under GEHA's standard option, lab tests should be covered. There were about 14 tests (one of them ended up being $500 wtf?) and they're all under the procedure code "LABO". We asked about the costs ahead of time (in person, so not on paper) and the person said it was covered under the plan. But now there is a note at the bottom of the claim/bill that says this: u01: Automated labs do not require professional interpretation of the services. Charge is not covered by the plan. What can I do? Why are they doing this? Is there any way to fight this/appeal/get reimbursed? I feel like this is such an enormous scam and I know this person cannot afford to pay such a huge bill. Since Florida is a No fault state, I have no idea how the insurance company is going to handle this. The other party car is totaled, while my front bumper got dented in. I read some posts telling me to call my insurance first, while others tell me to call the other party insurance first for a claim. Should I call my insurance first or the other party insurance first and why? Also, there was a police report, but they didn't give it to me? I only gotten an email about the other party information. Car insurance is telling me I have to settle without a lawyer. Is this true? Posted: 01 Mar 2021 10:54 AM PST In May of 2019 I was in a car accident in Texas in which I was not at fault. I have been receiving treatment since then. Initially, I had x-rays that came back negative so doctors thought it was just a soft tissue injury so I did several rounds of physical therapy and trigger point injections over the past year. After a year with no healing I had an MRI and was diagnosed with cervical discogenic pain, cervical radiculopathy, and displacement of cervical intervertebral disc. To treat this I had a cervical epidural steroid injection that worked for the first couple of months, but now the pain is returning. These injections are sort of a hit or miss, so you never really know if or when you'll need another. With this in mind I was looking to get compensation that would at least ensure I'd be covered for future treatment if I were to need it. However, the car insurance told me they don't pay for future treatment. I figured this was okay and that instead any pain and suffering I get would be applied to this. These shots are billed at $6,000, but with health insurance I paid $150. I anticipate hopefully always having health insurance and while the amount I pay might change I figured even being offered $3,000 would more or less work out. This would cover additional injections, physical therapy, and potential surgery. Surgery has been recommended by my doctor, but as long as I can keep the pain at bay I don't want to go down this route right now. I initially didn't want to get a lawyer involved, because I wanted to keep things simple and straightforward and with my 2 year limit approaching I needed to settle. However, when I went to settle with the car insurance their offer was a little under $11,000. This would be great if I didn't owe my health insurance over $10,000, so this leaves me with less than $500. I don't think this amount is reflective of all I have been through because of this, but the car insurance isn't open to negotiation. I told the adjuster I was going to instead hand the case over to an attorney, but she told me since I had already started the settlement process with them that was no longer an option. Is this really how it works and if so do I have any other options here? TLDR; Tried to settle with car insurance, but I didn't think their offer was fair. Posted: 01 Mar 2021 06:27 PM PST I was stuck behind a car in the left lane, checked my mirrors and blind spot, began to pull around when another vehicle came rushing through. I quickly veered left and hit the brakes, and they also hit the brakes. I didn't feel any collision. They continued on their way ahead of me, and I did as well. After I got home, I noticed that something definitely rubbed against my car on the front right side, near the tire. It is a decently-sized area, but no actual damage occurred. Some kind of clear residue (wax? something from a vinyl wrap?) is stuck on there but it comes off with some elbow grease. No scratches. I'm concerned about the other car and whether they accuse me of intentionally driving away. I actually returned to the area after I discovered the "damage" and couldn't locate them. I contacted my insurance company to share a description of what happened and have the conversation put on record, but they saw no need to file a claim. Can anything happen to me at this point? If all of the above passes the smell test, what about the very occasional usage of each other's vehicles. Leaving Mom's BMW out of the conversation, what if jr takes my car down to the market for a gallon of milk, are we putting ourselves at risk? Occasional question-answerer (primarily in Health Insurance questions), but now with their own question (in Auto Insurance). I lease a car in a premium/all-inclusive program that, amongst its many benefits, includes auto insurance, all for one flat, non-negotiable fee. My question is fending off a "what if" scenario I had pop into my head recently - since accidents, moving violations, other various demerits are a fact of insurance - I know with a personal insurance policy, adverse actions or incidents would result in an increase to my premium at the next renewal. While I had to certify compliance with the Auto's UW guidelines, and be approved under those before being further considered for the car itself, I'm not sure how things would work if I were to get a speeding ticket, have an at-fault accident, or what have you. I know a lot of my state's motor vehicle code include various insurance surcharges for certain violations, but what could happen to me here? Could the auto insurer simply revoke coverage and I'd be required to exit the leasing program (aka return the car)? My father got insurance money to fix the roof but never got someone to fix it. And recently my father decided to leave my mom and me and left the US, no divorce, just left without warning and also took the insurance money. We suspect that hes planned to this from the beginning. My mom doesn't have any idea how to handle this, neither do I. My mom doesn't think calling the insurance company would do anything so I don't know if this can even be fixed so please tell me if there is anything that could be done or are we just screwed with the roof. We are almost 100% certain he is lying about how the damage was caused. Is there any way we can see if he filed a claim on this issue through his insurance? Posted: 01 Mar 2021 09:37 PM PST My wife has a policy with Geico out here in Georgia, US that's been going on for - an extended period of time now, auto renewing and auto paying every month for around $3-400 each month. Earlier this month, like clockwork, she got a text message from Geico about the auto payment and she continued on with her life until yesterday, when Geico decided to (on the last day of the month, during a pandemic): A) charge her nearly $2,500 for a new six month payment plan B) renew her a month (or two?) before her plan was up C) opt her out of cell phone notifications (so that her only news of this was due to her bank notifying her) D) opt her in to a new six month plan that's completely different from her per-month plan that she'd previously agreed to The latter two (C & D) were done without any changes she made on her end. She hasn't logged in to the Geico app to make changes (she confirmed this) for many, many months. So essentially without her/our consent Geico has opted her into making 6 month payments instead of her usual month-to-month payments, and they opted out of notifying her of this and any other changes that might happen to her account. She's spent hours on the phone now getting the run around and hasn't been able to get them to stop the charge nor has she been able to talk to anyone from the finance department. She's gotten a bunch of people who're "terribly sorry" on the line... but essentially the best we're getting is that they'll send us our money back by mail by Wednesday. Maybe. This all REEKS of illegal shit, but I also know that this big corporations can do pretty much anything they want. Do we have any legal recourse? I own a BMW 550i; which seems to be classed as a sports car - so my rates on like 4 vehicles are based on a teenager having access to the key's I'm told. Is there anything I can do to change this picture? When he's 18 he can have his own policy is what I understand but he still has another year minimum at home. Can't I exclude him from some of my cars; I literally keep the keys in a safe and NEVER let him drive the BMW. I am based out of Washington state in the US and I travel all over the world to fix equipment used in the plastic industry. There are times I have to travel with up to $75k in hand tools and metrology equipment. What or who would be the best insurance to get? I've looked into inland marine and I don't think it would be a good fit as I fly to most of my locations. I don't think my company has a policy that would cover my investment so a stand alone policy would be best. Which is the same as retention in that book. While in Wikipedia, Coinsurance is defined as: the splitting or spreading of risk among multiple (insurer) parties. Posted: 01 Mar 2021 10:21 AM PST Hello, I'm following up on a motorcycle accident claim. Long story short, the person responsible for the accident (bad driver, pulled out in front of me after they performed an illegal U-turn and sent me flying, totaled the bike but according to the drs. so far nothing serious as far as physical damage (medical) although I suspect I'll have arthritis for the rest of my life) has an insurance company that wants me to settle for an open ended(?) settlement of 5K for pain and suffering. They have already cut a check for the bike itself and will be paying any and all doctor/er/ambulance bills as well but seems to me the 5K is pretty low. I was under the assumption that P&S should be equal to the medical bills or X's 1-5 depending upon severity of physical damage (wounds) but the adjuster is saying they don't do it that way. I've called a couple of law firms so far (prior to the 5K offer) and they said I should work it out myself. From what I understand even if I did get a lawyer they'd take 1/3rd of the payment anyway so basically I would have to get around 9K or higher to make out marginally better than the first offer. The accident was in Ohio but that insurance co. is based out of Wisconsin if that makes any difference. Any suggestions? Thank you for your time. [link] [comments] |
Whole Life Insurance for HIV+ Spouse (Opportunity?) Posted: 01 Mar 2021 03:48 PM PST Hi all, this is my first post to Reddit! My spouse (34, M) is HIV+, and because of that, we've never been able to obtain life insurance for him except through his jobs (he's a registered nurse). Of course life insurance through his jobs are only in effect while he is employed at said jobs, and if he gets sick one day, he will undoubtedly need to stop working. He recently left his job with a local hospital to become a travel nurse, and we received a notice in the mail saying that he can convert his group life insurance policy through his old job into a whole life policy *with no evidence of insurability required.* From reading many posts about whole life insurance, I realize that most people here tend to be against it. But in our situation, could it be worth it, given that we haven't been able to obtain life insurance elsewhere for him? The premiums will be about $440/month for a $342k benefit. We've had life insurance coverage for me since we were married and have always worried a bit about his not having it, since we still owe over $300k on our house and it would be admittedly hard for either one of us to keep up our bills without the other's help. Furthermore, we also have a long-term care insurance policy on me, but we don't have one for him for the same reason we don't have life insurance on him (no one will insure him because of his HIV+ status). I was thinking that perhaps the cash value of his whole life policy might double as a long-term care policy in the even that he needs it one day. Neither of us has a closeby family network and we've not decided whether we want to commit to having/raising children, so help with long-term care in the event of bad health one day is something that concerns us both. All that said, in our particular situation, should we consider the whole life policy? We only have about 30 days to decide... (By the way, we are based in Florida.
