    Hey so this is happening in Texas please excuse any spelling errors. This just happened yesterday and I just wanted some opinions on it, I'm already looking into a lawyer as I only have 20 days before my Civil case. My mother left her property to me and my brother after she passed. When she died I had just turned 18 and my brother was 12 . I couldn't care for him so he went to live with my mother's best friends and they became his legal guardians. They tried to force me to sell as soon as they took him in by suing me for his half. My grandma and my father helped me fight them and it never happened. Now he's about to be 18 in a few days so they filed right before his 18th birthday stating I damaged them and want his portion of the property which would be $150,000. We also have a billboard being rented on the property that has been paying the taxes for the last 9 years or so. I've used cashier checks to pay it every time since my mother died. They are suing for half of the billboard as well as back pay for the last 4 years which would roughly be $10,000. They are stating since the billboard is legally under my name that I damaged my brother by not giving him his share even if it was under my name before my mother's death. I never asked them or my brother to pay half of the taxes because we verbally agreed that the billboard would cover it and it always has covered the taxes only leaving maybe a couple dollars which are still in the savings account for the next payment of the taxes that are due. This section confuses me however because they never paid a dime for the taxes, I'm unsure how'd they'd be able to sue for that if they never contributed to the taxes. I just want to know the likelihood of being forced to sell. As my brother will be 18 before the trial happens, I am sure he won't see his money because they filed as his guardians and not with my brother's knowledge. I don't want my brother to lose his inheritance as soon as he hits adulthood. If my brother was the one wanting to sell I'd have no issue with it but he isn't suing me it's his guardians.

    Michigan - Employer enforcing workers to not get the COVID-19 Vaccine or they risk termination

    Posted on behalf of someone in this situation, this person is a stylist at a salon in MI. Their employer said that nobody is allowed to get the vaccine or they risk termination from their job, their reason being they'll have to miss 3 days of work once they get the vaccine. Is this legal?

    Edit: the whole "missing 3 days of work" came directly from this employer, not sure if this even true and I've never heard of anybody having to stay home after getting the vaccine

    Ontario - Landlord showed us a rental house, we signed lease for the house. On move-in day we arrive to find the main floor divided in half, the other half is now for lease as a commercial property. Landlords response is “sorry, we forgot to mention the commercial unit”

    As the title says, we signed a lease for a house after viewing the entire house with the landlord. The lease has a single address, no unit number, and makes no mention of another unit. When we arrived in the first of the month with our keys, a door with a deadbolt has been installed dividing the main floor in two, and a commercial lease sign has been out in the window. The landlord has apologized for their mistake, and offered a 50% discount on one months rent.

    They have cut off 1000sq ft of the house they showed us, and have been dismissive of our problem, saying they are sorry for the mistake, but it is what it is.

    I know the next step is a lawyer, but time and money are short, what can I realistically expect as an outcome? Is it worth the hassle and expense of pursuing?

    FedEx dropped someone else's package on my doorstep and now they want me to give them all my info and arrange a pickup time. I told them I'd leave it on where I found it and they're free to come get it at any time. Do I have any obligation to do anything else with the package?

    It's been sitting on my porch for about three months now. Other FedEx drivers have come to the house to make deliveries. When I tell them about the package, they say they won't/can't take it. When I have contacted FedEx, they want to take all of my contact info and they want me to schedule a pickup time so I can hand the package to a driver. I have told them repeatedly that they can come get it at any time and I'm not taking any additional responsibility for the package.

    When can I just throw it away? I don't want to open it. I'm not sure if the same laws apply to things sent via FedEx the way they would with something sent via USPS. Thanks!

    Bought a rotten flipped home

    My wife and I bought a flipped home in January 2020. The original structure is from the 1880s. We knew the flipper cut some corners (they all do) but got it below market value for the area (Chicago Area). It was supposedly "completely renovated". First red flag after we got it was a call from the builders GC asking us for money. Apparently he stiffed the GC and told him that we were going to make him whole after the purchase (no liens on the house) and haven't heard from him since a week after we closed.

    Since moving in we've had to replace the brand new front porch (~$6,000) that had been improperly installed and leaked water into our basement when it rained hard (they punctured the waterproofing membrane with screws when they put it down and didn't run the waterproofing up under the siding where the porch met the house). We were just planning to eat that cost.

    After the porch there were a few additional discoveries have me questioning whether there is a case to be made for fraud/misrepresentation/whatever the legal term would be.

    In our crawlspace there was a secret/hidden room they had blocked off attached to our crawlspace. Once I cut it through the wall I found an area they had used to literally just dump trash and debris, which they then just sealed off. Several thousand pounds of broken concrete and old pipe makes up most of the mess.

    We recently had the gutters back up due to the snow and flood certain parts of the house (Insurance is covering the water damage), but some very disturbing issues became visible as our mitigation company cut open drywall and removed floorboards that will be on us should we choose to address them.

    Turns out there was a fire in this house at some point as one of the now exposed "studs" in one wall is literally just carbon, looks like it was taken out of a fireplace. Given that we haven't opened that much wall up, its a fair guess that we didn't find the only 2 foot section of wood that looks like this.

    The wood floors have always been uneven, which is normal in houses this old. Once we ripped up a couple of areas we found there is no uniform subfloor, whatever is there is clearly just the old flooring or what was under carpet, in some areas there are just gaps and holes that let you see into the basement below and other areas it looks like they just laid a 1x4 to fill a gap. No idea how the permits were signed off by the city other than to say that's Chicago for you.

    Is there a case?

    employer lied to me and my coworkers about our wage

    i'm 17, i work at a donut/coffee/fast food place (you can guess which) and i've been at my job for about six months. i'm in florida.

    when i has my first interview, i was told i'd be starting at $10/hour, and when i had the second interview, the manager said that the best she could do was $9.50, and i took that.

    a few months later, my manager tells me she put in a $0.50 raise for me, but when i asked what i was making now, she wouldn't answer (but i assumed $10).

    we just got the teamworx app and my coworkers and i checked our wage on it and about half of us found out that we were making less per hour than our manager had told us. i'm only making $9, meaning that i would've been started on minimum wage.

    what should i do?

    Jackson, WY- Person we are subleasing from for 6 months is trying to kick us out 1 month into our lease

    Hello, my boyfriend and I are living in Jackson, Wyoming, and it's extremely difficult to find affordable housing here. Before we subleased from this man, we lived in a motel at a weekly rate. A month into our lease, he tells us he has family coming to live in Jackson and he wants us to leave so they can live in our room. We haven't done anything to break our lease, but he keeps insisting that we must leave in less than 2 weeks. We have pictures of our lease with him as well as screenshots of our messages negotiating the lease. Legally, he can't kick us out right? Should we be concerned? We have no other place to live, and it took us almost 2 months to find this place because of how competitive it is to rent here. Thank you!

    Edit: He also hasn't taken our check for this month. We keep trying to pay him, but he won't accept it. Can he just kick us out by saying we haven't paid rent this month? What should we do?

    Apartment Complex double charged rent. Only offering credit towards next payment.

    As it says in title, Apartment Complex double charged rent(Online pay). I only realized because I received an overdraft notice from my bank. I called the Apt. Office to ask what was going on. They are telling me that because the payment has already started processing, they cannot refund me(I don't believe that), and can only credit me towards next month's rent.

    Luckily I had some money in savings to cover my account before I was charged for overdraft.

    I'm assuming that, because they have taken money that falls outside of our rental agreement, they are legally obligated to return that money to me. Are there steps I should be taking to insure that I get my money back? If so, what are they?

    The DMV rejected my birth certificate, citing that it is 'abbreviated or abstract', but it's the only one I have...

    I am trying to apply for a REAL ID in California, but I am being stonewalled by the DMV saying that they only accept the original, certified birth certificate. I re-ordered my birth certificate from VitalChek, which is where my birth state's registrar website directed me to.

    Two days later, the EXACT SAME birth certificate that I already had came in the mail. What the f---? Is this a joke? How in the world am I supposed to comply if I never had an "original" birth certificate in the first place?

    I just found proof that the former owners knew about a water leak they didn't disclose.

    I have been dealing with a leaky roof in my master closet for the past year or so. We discovered the leak when we eventually found mold on the wall and ceiling behind some shoe boxes that hadn't been touched for a while.

    We had to hire a mold remediation specialist to come rip out the drywall and clean up the mold. We have also had roofers out twice trying to fix the leak in the ceiling but it continues to leak. When we put up new drywall and fresh paint in that space, it didn't take long for the water damage to come back.

    In the seller's disclosure letter, there are no issues noted about the roof. The seller did say that the section of the roof above the master closet was only a year old and that it was in great shape. Nothing in the inspection report came back about water damage in that area so we didn't think anything of this.

    Well yesterday I was looking at older aerial imagery of my property on the city's website and lo and behold, in the imagery from 1 year before we bought the place, there are tarps on the roof of my house in the exact spot where the leak is. My jaw dropped. They said nothing about having any water leaks in any part of the house yet here were are struggling to get this fixed.

    I want to hold the former owner accountable for the cost of the repairs. Do I have recourse here? Any advice would be appreciated.

    Broken engagement woes

    Hi all! This is my first time on Reddit so please let me know if I'm doing anything wrong. I'm actually seeking legal advice preemptively.

    I got engaged last Feb and broke my engagement off this year January. My wedding was initially set for August 2020 but covid happened ( thankfully in hindsight)

    So here's the story: I broke up with him because he basically changed and was emotionally abusive - was super controlling and even yelled at me twice in public. He demands that i text him everyday and if I don't reply within like 2 hours he'll freak out. Basically the one year I was left drained and exhausted and breaking up with him was legit the best decision I have ever made.

    Anyways he demanded back the engagement ring and I gave it to him. But now he is asking back for the gifts he gave to me (two only - a Bracelet and a handbag) and I was going to give it back (just to move on and have him completely out of my life ) but then I found out that he is actually going to sue me for the costs of the wedding - which we rescheduled to March 2021.

    Mind you, I didn't even want to set the wedding yet because of covid but he threw a fit (first incident of yelling at me in public) and demanded to get married in 2021. He also didn't want to get married after June so March was the date we set - but then my cousin was getting married on the same day so we rescheduled to Feb.

    Anyways I spent about $10k on wedding costs and he spent about $28k ( this is inclusive on a down payment on a condo) the condo was something he wanted and he put my name down on it. So now he has to default the payment because according to him he can't take my name out . Keep in mind that I'm unemployed and am a student- so I have no income and he knows this.

    My question is - does he have a case for suing me? For the damages of the wedding cost and for the gifts?

    2 years later I got the bill

    I can't believe this is happening to me. Today I received and email "you owe $X to this hospital". Since I haven't lived in the town that this hospital is in in 6 months and haven't used their facilities in over a year I had no idea what this was for.

    I called their billing department and it's for an accident that happened in 2019. I was broad sided when I woman ran a red light going at least 40mph. I went to the ER just to make sure that I was fine. The drs basically did nothing, gave me pain meds and sent me on my way. The only bill I receive for that was a couple hundred dollars from the Dr and the meds. So when the insurance company finally called to settle, and offered what i remembered was double what I originally paid, I accepted.

    Since then I've undergone a lot of physical therapy and chiro work. Nothing that reached outside of the settlement....until today when I get hit with this massive ER bill. I don't have this money, but the hospital also doesn't have my address, they didn't send me this in two years. Is there some sort of statue of limitations on bills? I don't want to give them my new address for the financial aid form, because I'm worried their just trying to use this to send it to collections or something. Can I just ignore them? I don't have this money and have no idea what to do.

    I just moved in to a Apartment and now the landlord wants to kick us out

    Me and 2 other people moved into a apartment close by to our college 3 days ago and now she wants to kick us out

    Before we moved in we were looking for a 4th person. So we posted an ad for it on Facebook. This was days before we met and talked about the rules and stuff. Once the landlord told us that we can't have a 4th person. We all deleted our ads and turned down any people who showed interest.

    So today we get a text from her saying that she saw the ad I deleted and wants us to get out. But this was days ago that we posted and we didn't know about this until we talked to her which was Feb 27th. We moved in on March 1st and posted our ads days before the 27th and deleted it on the 27th once we learned it

    I'm from California Riverside County if that's necessary

    Please help me I desperately need help Sorry if it doesn't make sense I'm just really freaking out

    Post office wants to know what I do in my free time.

    I'm a mail carrier and lately my local office has been very understaffed for far too long. And instead of actually staffing it, they have resorted to forcing more and more overtime on the existing employees. And have now resorted to taking away our scheduled days off (SDO). This is called mandating. We are unionized and have the NALC union and bylaws. But lately I think they have stepped over the line of actually illegal. Yesterday I was only given about 18 hours of notice that I was going to have my day off mandated away for today. I quickly wrote back my supervisor that I'm completely unavailable as I have a VA doctors appointment. This was acknowledged. But when I returned from delivering my route I still saw my name on the mandate list. So I confirmed with another supervisor that I had a doctors appointment. She also acknowledged this. But then she told me I would need to bring in a slip that confirmed my appointment. This is where I told her that I do not need to bring in appointment slips to prove I have doctors visits on my SDOs as it is my free time. She said I do because I was mandated. Keep in mind they mandate random people on random days. So there is no way to know if you will be mandated on your SDO until pretty much you are leaving for the day before they take your day off. And if I have scheduled doctors appointments in advance to reoccur on my SDOs as to not interfere with my work schedule. That way I do not need to take leave (which I would show appointment slips) to be approved for leave. But since this is not requesting leave I don't think they can ask me to prove I go to doctors appointments in my scheduled free time. She also said I would either at the beginning on each week need to preemptively bring in an appointment slip to show I have one on my day off in the case they might choose to mandate that week. And/or bring in a slip to prove I went to a doctor after the appointment to justify my scheduled day off. I've looked at things like the FMLA and ADA and it states that employers can ask for appointment slips if it is in the case of requesting leave, but no where does it say they can for your free time away from work. I also stated to this supervisor that I do not obtain appointment slips since I'm not required to show them what I do in my off time and I only get emails of confirmation. She stated they would need to see them. But these emails contain more information than a generic appointment slip. Which I'm wondering as well if that violates the privacy act. I have contacted my union president, and he said he would speak to them. But lately they have not been doing much of anything to preserve our rights. Seeing as how it has only gotten worse with our staffing and working conditions over a period of about seven months. Sorry for the very long explanation.     USA - CT: Just gave my two weeks notice and my employer is ignoring my request to exercise my vested options.

    I work for a small private company and as part of my contract I negotiated stock options. That compensation section of my at-will contract defines:

    • The amount of shares (X% of outstanding shares as of Y date)
    • Vesting schedule (Over 3 years)
    • Strike price (Share price as of Y date)
    • The ability to do a 'cashless exercise'
    • "Shall be issued in accordance with the Incentive Option Plan"

    I've asked for the Incentive Option Plan about a dozen times verbally and in writing to HR and the Board, only to be ignored or told 'soon'.

    I fear that the IOP may contain a 'clawback' or similar language. I'm unsure what options I have to force the company to share the IOP /allow me to exercise my options without going to arbitration. I'm working with a lawyer for that but would love your input.

    Most pressingly, if they fail to share the IOP with me, should I continue with my 2-week notice or force the issue/ leave immediately?

    I have reason to believe the IOP did not exist until after my contract was countersigned. Can they add a clawback retroactively?

    Extortion from a vendor using a credit card on file?

    Hello there! Wisconsin resident here. I have an issue with a vendor that I had a short-term contract with. According to our contract, I had given them my credit card to keep on file for incidental charges. The contract was recently canceled, and, not being pleased with their service, I left them a negative review online. They retaliated by threatening to charge my credit card for the portion of my deposit that they had previously refunded (through an informal written agreement, outside of the terms of the contract) if I did not take the review down. I'm sure this has to be illegal in some way, but can anyone explain how? Is it extortion?

    How do I reenter the legal field after four years of unemployment

    Disclaimer: this may not be the right subreddit, looking more for advice from the legal professionals rather than help with a legal problem here.

    The short version of my situation: I used to work at a top 10 biglaw firm in NYC. I started having panic attacks at the office and left while receiving disability insurance payments. I was a second year associate at the time, close to third year. That was four years ago. Now I'm trying to get a job in my local legal market and nobody wants to touch me with a ten foot pole. Understandable, given there's probably dozens of candidates without my questionable history. My question is what can I do to start again?

    Employer not providing a way for me to return company laptop

    I filled out the appropriate form to request a shipping label before the end of my employment.

    I left the job two weeks ago and still have their laptop. I contact them every day to request a shipping label. They say they are working on it and then nothing happens. At the same time they send me threatening automated messages saying I haven't returned the laptop and that they will sue me.

    I'd love to finally get rid of the laptop by returning it to them. It's taking up space in my room and I don't want to be responsible for it, since I am no longer an employee.

    What are my options? Can I tell them that if they don't send a mailing label I will consider it abandoned property?

    I'm in NC, USA if that helps.

    Contract Law with a minor: Can a company wait 2 years until the minor is 18 to sue them?

    Background: two years ago my daughter was in an accident that was deemed her fault. She was 16 and driving her grandmother's vehicle. She and the vehicle were both uninsured. This week I received a letter from a lawyer stating that they are trying to collect damages from herand they wanted me to call them. I called them and they said that they are doing this now because she is 18 now. It doesn't seem like contract law regarding minors would be very effective if they just need to wait for the minor to turn 18?

    Cops torn parts of my privacy fence down..what can/should I do?

    Title basically says it all; I come home from work today, start doing my usually daily routine (let the dogs out to play, feed them, and start on college) after noticing the dogs won't stop barking I take a look outside and notice 3 uniformed officers in my backyard with a K-9 unit and an out of uniform cop watching them (assuming a supervisor) I step outside to grab a book from my car and greet them while trying to stay out of their way. While making my way back to my house I start to hear wood snapping and see one of them ripping boards off my fence how the other two watch. I run up and tell them there's a partially hidden gate about 10 steps away from them (we just bought the house about 6 months ago and haven't cleared the vines off the gate because we never use it). One of them starts to laugh and walks to the gate and shows the other two. The K-9 unit and the officer who found the gate leave through it and the officer who broke the fence gets in his vehicle and leaves. I've already called the city office and am expecting a phone call from the police chief at some point today. But what do I need to say? I'm positive I have the legal right to request my fence be repaired. But when I was able to speak to one of the officer he very specifically said, "we will put you a new board up. One of them was already down so we thought maybe he had gotten through there." I ran my dogs literally 30 minutes before they arrived and would have noticed a hole on my fence. I also remember hearing 3 distinct snaps before I was able to stop them. Like I said we bought the house about 6 months ago and the fence isn't in the best shape, but still worked at keep my dogs inside our property, it will not longer do that and is basically useless now.

    Missing Wife

    Two months ago my wife went missing. Wife has mental disorders like multiple personalities. Nothing value was taken, just plush toys, art supplies, cell phone and passport, not even proper clothing for winter. She took no money or credit/debit cards. Tracked her cell phone from the west coast to Boston, MA. A missing person report had been made to the police. Police closed the case after a call had been made from the wife's cell to the police claiming that she was safe. Wife's cell phone was on a data/text only plan, and she knew this, but a stranger would not know this. Since that call she has not been heard from. She has not logged in to any of her social media, and none of her family has heard from her either. The police will not listen to anything that I tell them, like her mental disorders ect.

    Not sure what to do now.

    Unemployment garnishing Daughter's wages 25% won't negotiate

    They are garnishing wages because unemployment says she was paid too much in 2017. She was working part time at Applebee's and claimed her hours the whole time she worked there. she doesn't have any documents or anything else to go off of other then what they told her when she to called to figure out what was going on. Once she talked to someone they said since she never reached out to set up a payment plan until now they would not work with her and on it. She told her she never received a notice about over payment or garnishment. She is borderline need to file for bankruptcy. Is there any way to stop them or force them to negotiate ?
