Auto accident injury - required shoulder surgery - Florida

    Posted: 28 Feb 2021 02:12 AM PST

    Hi all,

I will get to the point:

I was rear ended in Florida while in the back seat of an Uber car and completely totalled (lucky to be alive). Driver that hit us is completely at fault.

I live out of country and I'm not looking at getting a lawyer and batting in court.

The insurance company is trying to settle (Esurance).

I had a neck sprang, and a bicep tendon that was partially torn in my shoulder, that required surgery (over a year from the accident) and 3-6 months off work regular physiotherapy appointments.

My country has free medical, I have no medical bills at all or any financial loss, other than requiring to be off work for 3-6 months, which I assume they will cover that.

I have many many medical appointments resulting fromthe car accident, with everything documented up to needing surgery and 3-6 months off work documented.

Esurance is wanting to settle after all my treatment is complete.

I've done lots of research, and Google shows an average shoulder surgery is worth $92,000, but can be a lot higher or lower.

What can I approximately expect from a settlement from simply a reckless auto accident that required me have surgery?

How much negotiating power does someone have?

The quality of my life was obviously extremely affected, having nearly no use of my arm for 1.5 years and being in constant pain before and after the surgery (3-6 month recovery).

Do insurance companies completely try and rip you off and offer you 30k for example, even though they know you can negotiate up to 100k?

How exactly do they calculate a final payout?

I will mention I spoke to lawyers who require me to fly back to Florida (who keep 33% of the final payout anyway) which I have no interest in, and I'm not looking to fight, I just want a reasonable settlement for my injuries etc.

    Thank you so much!

Im a Handyman looking to get coverage. What's the difference between General Liability and Professional Liability?

    Posted: 27 Feb 2021 06:59 PM PST

So say in theory I'm working on an air conditioner. I make a mistake and damage the equipment. Customer wants to sue. Is professional liability gonna cover that or general? I'm just confused on the difference. Explanations of it seem convoluted when coming from soliciting agents. I'm in California

Literary letter from Oliver Sacks - How do I insure this?

    Posted: 27 Feb 2021 03:35 PM PST

Hi, several years ago I wrote a letter to Dr. Sacks about an interesting visual impairment I was suffering from at the time. He wrote me back a really nice letter, couple of pages long. I know this has some value, especially since he has passed away since. My question is, what do I do now if I want to have it authenticated and insured? I don't know who to call or write. I tried calling some rare books bookstores, and they suggested auction houses in LA. I called a few there, and they said they thought the letter had value but they wouldn't be able to appraise its value unless I wanted to sell it, which I don't. I do have homeowners insurance through Assurant. Do I need to contact them?? I think the letter is probably worth a few hundred bucks or maybe several. I don't know if it would just fall under my homeowners insurance. I'd like to have it authenticated and insured for real as a "literary letter." How do I go about doing this? (And yes, I've seen "Can You Ever Forigive Me?")

Best option for my dental situation?

    Posted: 27 Feb 2021 11:00 PM PST

Thanks to never getting braces as a child, I'm now stuck. I need braces/invisalign,a molar implant and 4 bondings on bottom front teeth. I'm on Medicaid and in Washington State, which means I'm screwed. A front tooth sticking out literally prevents a broken tooth from being repaired too. I am also looking at my employee options. I know Aetna and Delta are options. Shorter delays, the better.

Kaiser HMO vs. Blue Shield PPO in NorCal - Family has cancer history

    Posted: 27 Feb 2021 02:24 PM PST

I am offered a few health insurance options at work and don't know which one to choose from. I would really appreciate some advice.

I am pretty healthy in general. I am in my late 20s, but my mom had stomach cancer and died of the metastasized colon cancer in her early 40s. My grandfather (in his late 80s, my mom's dad) was recently diagnosed with terminal stomach cancer with metastasis to the liver. In the past I rarely visit the hospitals (like once a year) but I think starting from this year, I will schedule more appointments and even do a gastroscopy or a colonoscopy in addition to my regular checkups. I also want to schedule appointments with a therapist or psychiatrist - I've tried Kaiser and it's pretty fast.

Here are the options I have:

    1. HMO Plan: Kaiser Permanente - 0 deductible

    2. PPO 0: Blue Shield - 0 deductible

    3. PPO 750: Blue Shield - 750 deductible

    4. PPO HDHP (HSA) 1800/2800: Blue Shield - 1800 deductible (I also don't know much about HDHP (HSA). Is HSA a separate account? Or do I *have to* choose this plan to get HSA?)

I don't know much about the differences. They cost around $26 to $37 per month. I know Kaiser is pretty efficient for most things, but I heard that PPO is better if you want to see a specialist. However PPO can be very expensive and inefficient. Here in NorCal we only have a few options: Kaiser, Stanford, Sutter Health, UCSF.

In my case, what would be my best option?

Doctor didn't mention a PA was needed. Both PA and MRI were denied by insurance after the fact. Now what?

    Posted: 27 Feb 2021 05:45 PM PST

[This is in SF/California, Cigna insurance]

I haven't gotten an MRI in years and I don't recall my last MRI (one for a tumor in my bile ducts) even needing a PA. I don't see it in my precertifications history for Cigna like I do, but maybe I was just lucky and I did have one (I know that the surgeon for that surgery failed to actually submit the PA for that surgery and that was a nightmare...)

Anyways... For the last few years I have had some really weird things going on with my head. What started as intermittent hearing loss and hyperacusis (weird combination, I know) became more and more frequent until I was two weeks in to an "episode" and it wasn't going back to normal. Obviously I was scared...

Fast forward from a video visit with my primary, to an urgent care visit, to an ENT visit (dude was an ass), to a second video visit with my primary, to an audiologist and hearing test (showed conductive hearing loss) who says to go to an otologist, to a THIRD call with my primary about the otology referral...and then finally the otologist (tldr, this was not just a one visit with no history...which is why I was denied).

Otologist believes that my issue is related to the osteoarthritis in my jaw causing vestibular migraines, hyperacusis, tinnitus, balance issues, vertigo, etc. He refers me to neurology, gives me a list of TMD specialists...and orders an MRI that I needed to get BEFORE I see the neurologist so that she can also see if anything is there and if there's something else maybe causing the hearing loss. That's it. Didn't inform me of anything else (like the PA). Just said to do that. Usually when a PA is needed the doctor tells me to call my insurance or something like that. The Neurologist I ended up seeing told me about the PA on a medicine I need. So if I knew, I wouldn't have just...done what happened next...

So now I have the neurologist's office calling me and UCSF's imaging blowing up my email to schedule the MRI. So I just set everything up, have the MRI (they found something called superior canal dehiscence?), I see the neurologist, he orders balance testing and another hearing test. Everything seems cool...until I get the PA denial in the mail on Wednesday, and then I see today that the claim is denied with an EOB. The reason was "not medically necessary and failure to demonstrate a history of care, tests and visits related to this issue." (which I do have). I let their office know on Wednesday and they said they'll submit it again but what do I do if it ultimately gets denied?

I was hounded by the hospital until I scheduled things and then just did them and now I may get...what? An $11,000 bill that I can't afford? That's how much they charged my insurance so I don't know. It probably said somewhere in the paperwork in some fine print about this, but their offices rushed me, even on the day of the MRI.

Is there anything I can do? Or do I just have to wait. I just got over a 5 month insurance issue with another hospital who submitted wrong codes for a surgery I had and I really can't go through this again. If I'm billed $11,000 I won't be able to afford the care for my jaw, the medication from my neurologist, or the fact that were were planning on moving in two months. I don't even have $11,000 sitting around. I don't think I even have that much left over once rent is taken out for my income over the course of the year! What can I do? I know I sound frantic but I literally just got out of this situation and now it's happening all over again.

    Flood insurance questions

    Posted: 27 Feb 2021 09:27 PM PST

Hi Reddit. I'm sure some of you are cringing at the title already, fear not as I am a south Louisiana native and it is near impossible to find a home in flood zone X after 2016's flood. I am currently looking at purchasing a 325,000 dollar house that is barely on the edge of a flood zone AE. I am curious about rates people are experiencing around this price points and how these rates are calculated. The house has never flooded, even in the 2016 flood. Do previous claims effect rates? I have a friend who happens to have a house that flooded in the 80's as well as the 2016 flood. His house is around 175,000 and currently pays 200 a month in flood insurance. Thank you for your replies in advance.

How do worker's comp cases like this usually pan out?

    Posted: 27 Feb 2021 09:21 PM PST

I'm a warehouse worker at a distribution company. I've been there for 2 years and have been severely overworked for most of that time with lack of help. I had some lumbar pain as far back as December 2019 and figured it was just wear and tear. I also developed autonomic dysfunction issues that started then, as well. Lightheadedness/dizziness when standing/bending in certain postures, blood pressure/heart rate varying rapidly by the second, bladder and bowel pain/malfunction, partial incontinence in bladder and bowels, partial numbness in the groin and erectile dysfunction. Sometimes I pee on myself before I get to the bathroom and have had the same with bowel movements. That usually coincides with my back pain. I went to all kinds of doctors and specialists. They simply came up with random autonomic dysfunction with no medical cause found after tons of virtually every kind of test and scan.

In November 2020, I went to HR because my back pain was way worse and caused me to nearly faint at home and at work a number of times. Filed a report, picked a local clinic that we use for drug testing and they did x-rays there. The sole doctor there said she didn't see any spacing issues. She put me on 10 pounds and under lifting restrictions for 2-3 weeks. I had a few weeks of physical therapy during that time and it didn't help. Then she sent me for an MRI and the translation results were:

"1. There is mild-to-moderate degenerative spondylosis at L4-5 associated with Scheuermann's disease. 2. The L4-5 disc space level demonstrates moderate degenerative spondylosis and narrowing of the disc with prominent Modic changes related to stress response. There is a bulging disc indenting the thecal sac across the midline. In addition there is a left lateral and left foraminal herniated disc protrusion and bone spur measuring 3 x 6mm in size touching the epidural space with minimal extension into the left neural foramen. The right foramen is normal. 3. The L5-S1 disc space level demonstrates a small amount of fluid in the right facet joint. There is no evidence of herniated disc or spinal stenosis. The neural foramina are normal."

She took me off from restrictions, added more physical therapy and that didn't help with my back pain. I went back to her, she put me back on ongoing restrictions of 10 pounds or less plus limited bending. When I first went to her and mentioned the autonomic issues, she kept confusing dysautonomia (autonomic dysfunction) with dystonia (some sort of neck problem) and didn't know the difference. She told me there was nothing else she could do for me and ended my visits. HR gave me a letter from that doctor a couple of days later saying that my back pain was related to my medical issue and not a back injury. They also gave me a letter stopping my worker's comp bucket for treatments. HR wanted me to go see my private doctor and get clearance on my job duties before returning to work. They wanted me to go on FMLA and get my doctor to fill out paperwork about a "serious medical condition" that I haven't been diagnosed with by any doctor.

Sooo I got in touch with a worker's comp lawyer. Within a day or two, the HR manager emailed me through my personal email and said the worker's comp bucket payments had been restored. My lawyer is working with my employer's insurance company to get me a second opinion with a spine surgeon. They've submitted my paperwork and we're waiting on him to look over it to "see if he wants to take over my care." My lawyer told me not to talk to any of them anymore, but before I had the lawyer, the employer's insurance adjuster was offering me a "little settlement if I didn't want to work at my job anymore."

I'm about to start getting weekly worker's comp payments of 2/3rds of my normal paycheck, but they're late on that after 2 weeks.

What are my odds of getting my back fixed and getting a settlement for this afterwards? Will I still be able to keep my job or will they be trying to get rid of me if I go back? I'm not 'suing' them per se. The lawyer is just my mediator and will get 25% of any settlement. Will my settlement be larger if I am still in pain and having issues even after surgery? Apparently it doesn't always restore back completely. I might also just have to find another job if they won't let me come back in a lighter duty position. It seems like my employer is rather negative towards me now. How long do these situations usually take for settlement and such? I'm in the state of Georgia.

    Car Insurance full coverage issue

    Insurance issues...

My coworker got pulled over for spinning a 92 mustang with an engine with aftermarket parts, 5% tint all over, aftermarket tail and headlights, and other shit as well. He got his license revoked and he just now got it back. The issue is, he can't find insurance that is at a good price. Everything he found was $2000 at the least for minimal coverage. Any tips for finding insurance that will cover full in the va area?

Black car hit me with no headlights on at night in a nonlit area, who’s at fault? TX

I was making a left turn on to a street and black jeep with no lights on whatsoever hit me after just completing a turn from one street over. She was literally invisible to me and I filed a claim with her insurance. I don't know which way this is going to fall. She kept apologizing and told me she didn't turn them on so she wouldn't blind anybody but then told the police she forgot to turn them on. I'm scared about this going on my insurance and just want opinions on it

[Georgia] Car insurance quote under 100$ full coverage, have 1 accident in recent 5 years about to end in july

    Posted: 27 Feb 2021 07:37 PM PST

My sister she's single mom 30 years old and carry for my grandmother and her 4 years old baby. She currently using Geico and pay 125.7$ per month. Currently she's looking for a cheaper price option of insurance under 100$, in the past at 2016 she get into an accident by reversing inside parking lot bumping to other car it was so light and cause no scratch and no damage at all, but the owner of the car she bump into and other people also inside the vehicle making a big deal out of it. My sister was still new to driving in 2016 so she freak out and don't call the police about the situation, these two person on other car talking with my sister in threating voice like it serious problem. They said to my sister to give them the insurance and said to my sister that it's her fault and she cannot taking a picture of the damage. According to my sister she said there was no damage at all because she was
reversing and tapping on the brake. After that the other two using my sister insurance and get coverage, they even make up stupid thing like they need insurance to pay for their medical because their body is damage ( i can't find the right word for it basicly they made it up to make it seem like they are hurt). AND because of that my sister now have a record she's looking for new one because she want to save money for the house in the future.

Insurance claim help. Room flooded due to frozen pipes

    Posted: 27 Feb 2021 03:45 PM PST

Q1: The insurance has asked me to make a list of the things that were ruined when my pipe busted in flooded my bathroom and my bedroom. The insurance adjuster has already been out here and has taken care of the structural things. I now need to make a claim for my personal belongings. If 4 out of my 5 bedroom set items were ruined do I only claim the 4 or can I include all 5 since they will never be matching again?

Q2: Is it okay to claim my curling iron, bath mat set, makeup brushes, and toiletries? Do I have to provide receipts for everything (I don't have receipts).?

Is there a way to shop for auto insurance that would show me rates of all the top insurance providers?

    Posted: 27 Feb 2021 06:01 PM PST

It is quite a hassle to go through each providers website to get a quote. It would be helpful if there was a tool or service that can get quotes from all these companies for me. I have 800 credit score and currently pay 120 a month in Texas would love to see if I can get lower.

    CA Planned Non Operation

Let's assume I'm Sam, the owner of a vehicle which is insured and I have an accident. If the insurance deems the car a total loss and pays me the VLF refund, aren't they supposed to file for a PNO since they're now the owner of the vehicle? They don't file and the cars just sit for years collecting late fees and the next person who buys it has to deal with it.

Is it legal Sam or the ins company to neglect obligation so irresponsibly where innocent buyers are blindsided with penalty fees incurred by previous owner(s) ?

Whether it's the insurance company or Sam the owner of the total loss before settlement (not the new owner after the insurance sells the total loss)

Shouldn't settlement and transfer of ownership from Sam to insurance company be accompanied by a PNO filing to stop the car from racking registration fines and fees?

What would you recommend for someone who's a beginner- health or C&P?? I have experience as a store manager at CVS so I'm not sure if that helps me out.

Icbc car insurance took payment early, left me broke

    Posted: 27 Feb 2021 10:59 AM PST

I currently am on a payment plan of $200+ a month for icbc car insurance, I deferred a payment and then asked to defer an additional month to which I was emailed that I could not - however if I wanted to stop the payments from coming out for the additional few months of my term and pay the lump sum upon renewal in June to "respond to this email (accountservices@icbc) or call them" . I chose to stop the payments so I replied to the email saying so. Little did I know I was supposed to open and create a new email to the address and not reply. So now I wake up yesterday morning to $729 taken out leaving me with $-30 for over 2 weeks. I have no credit and no savings, a young child to look after and they have left me screwed. What are my options? Thanks

Edit: I am in bc, insurance through ICBC

    Apartment Lease - Frozen Sprinkler

    Posted: 27 Feb 2021 07:02 AM PST

My Apartment was flooded due to the deep freeze and power outages in Fort Worth, TX last week. I have rental insurance $x,xxx for Loss of Use and $x,xxx for personal belongings.

The unit has been inhabitable since 2/16. The management did not reach out until 2/21 asking about my well being.

My question is I haven't been able to live in the apartment and I will either be moving apartment units or moving out. The management is telling me I am responsible for the energy bill while they are running 8-9 industrial fans in the apartment 24/7 now for the past week.. Wouldn't Their insurance cover any cost's associated with the clean-up / construction / remodel of the unit?

Ideally I want to get out of my lease but I have yet to hear back from an attorney regarding how to go about this. As of now they are saying I can't get out of it because they are willing to offer me another unit.

Any guidance or advice would be great on how to further proceed.

Scratched another person's car while opening the door of my parked car.

    Posted: 27 Feb 2021 02:25 PM PST

Yesterday, when I pulled into a parking spot my buddy opened their door too wide and hit the car next to us, we traded information and I thought nothing of it, easy $100 fix. Later that day he sends me an estimate for the repairs and it's over $1000. This is a small dent in the side of the door no more than an inch in length and 2mm tall. Is this reasonable and what action can I take against it. I'm only 17 so my parents and I are worried my already high rates will increase even higher if we try to settle this through the insurance company. This happened in California.
