    I want to start by saying that the advice/support I got was not expected and much appreciated. It has been a long two weeks.

    Quick run-down from previous post: I have custody of my step-son because his mother relapsed, we are not and have not been married, he is saying he wants to stay with me, BIO dad not in the picture in a meaningful way.

    This update isn't bad, but it is not ideal. The advice I received was bleek. Never being married to his mother restricts me from certain legal protections that I might enjoy, so the truth is that I will be fighting an uphill battle here.

    After meeting with legal counsel, they recommend to not take legal action at this point in time because it is likely to cause volatility and may result in retaliation from his mother. Why did they suggest this? Each lawyer pointed out that the child is in my care and that his mother has willingly let the child indefinitely stay with me, at least for now. Moreover, my step-son's mother's Aunt & Grandma are discouraging her from getting him back because she has a terrible track record with sobriety and bring men around. So while not legally binding, it is at least some pressure for her to leave him with me, and she does seem to be respecting that, whatever the reason.

    In the way of legal action, I was told by one attorney that I could petition for guardianship. She said that this is not an easy task, especially because I am not of blood relation to the child. I was told it would be invasive to all parties, time consuming, and far from in my favor, though because the child and members of his family are advocating that he stay with me, it is not an impossibility. This simply does not seem practical given it may precipitate backlash.

    All this said, I am going to not take any action at this time. The kid is far too emotionally fragile that I simply cannot risk a bunch of BS happening that causes him more instability and uncertainty. Having his family that is in the picture back me has been huge because they are keeping his mom in check, but it absolutely destroys me to see him cry and ask for normalcy and ask when will he stop stressing and not have that answer for him. I feel helpless, so I can only imagine the level of helpless he's feeling. I am being strong for him. I wish I could make his hurting stop. I remind him when he is uncertain or feeling stressed that I am here to shield him from the noise, he and I will get through this, I am here for him, and that, however unfair it is, he needs to be as strong as he can for me.

    Tried to serve my spouse with divorce papers but the jail won't allow it due to a no contact order imposed by the court as part of the sentence

    The location for this is Texas/United States Federal. I had originally tried just after she was arrested but when I went to serve her she had been moved from a state to a federal facility and I didn't know that. Then I was more focused on gaining custody of our child and her trials. Now that I have custody and the trials have happened. I'm trying again.

    The timeline is: My spouse was arrested in 2019. She went through 2 trials. One federal and one was state level. The totality of her sentences means that her release date is in 2039. At one of her trials the court ordered she was not allowed to contact me or our child. Like I said I don't have a lawyer of my own and while I don't object to the no contact order the judge and the prosecutor did it without asking me, I found this out when she was sentenced. She was pregnant at the time of arrest and the state terminated her rights involuntarily and I passed all the inspections and checks so I was given custody. Again I wasn't the one who asked to terminate her rights though I don't object or disagree. When I attempted to serve her the jail won't accept. The jail says letting me contact her will cause her to be breaking the no contact order imposed by the court. If she is under their custody they can't make her commit a crime because if I contact she has no choice in it. Her letters and calls are monitored, I know this but I just want to serve her with the papers.

    After the jail said no I tried to serve the public defender who worked her state level trial but the public defender said they don't get involved in family matters. So how can I get her served as I'm starting to her frustrated. The jail says even a lawyer doing it for me counts as indirect contact. I've tried 2 times following all the procedures the jail says have to be followed but both times I was tured away.

    My school is trying to take away our Computers. And we were not allowed to get them back, Can they legally take it from us?

    Hi My school recently had an incident (To involve with Pornography) . They decided to get into our Laptops (Most of our computers are brought from home) They also tried to get my Google Account Passwords. I don't think they got into my accounts as I have my laptop, Password locked. I would like to know if this was and is legal and if my school can take this my Laptop from me.     I tried to transfer my portfolio to another broker but instead of sending my portfolio they sent stocks I did not own and are threatening to liquidate my positions because of the stocks they transferred out.

    I tried to transfer my account from robinhood after the debacle last week after they stopped us from buying SNDL shares. Instead of sending my portfolio of SNDL they sent GHSI stocks. Meanwhile SNDL has been gaining value and while I like GHSI for the future I only bought one GHSI to keep track of it. My portfolio was SNDL. Is this legal? Can they send me other stocks other than what's in my portfolio? SNDL is also one of the stocks Robinhood didn't allow its users to purchase last week. What are my options? Are they forcing a sale in the stock because they have a short interest in the stock? The stocks they sent have been losing value while SNDL has been gaining value and they're costing me profits.     My dad had his guns taken, now he wants me to buy guns under my name but he would use them, I wonder if that's legal?

    We're in Tennessee. My dad had his guns taken at the end of last year because he drew a gun and shot at a wall at a party and someone complained (well I think that's the reason, possibly it's something else). He's not happy with this at all though because he likes having guns. He wants me to go to a gun shop and buy a handgun and if possible also a rifle under my name as if they were for me, but I know he would be the one using them. He would give me the money beforehand. I live with him (I'm 17 and in high school) so clearly he would have access to the guns at all time. I'm worried about doing this. He's kind of irresponsible with guns, he shot my dog while drunk and he likes to play with his guns when he drinks. I'm not comfortable with having guns under my name when there's a risk someone could be injured. Tbh I was relieved when he had to surrender his guns. I wonder if it's legal for me to buy guns that he would use? If I can convince him that it's a problem I might not have to do it.

    Surgeon went for wrong size in breast reduction surgery.

    I recently underwent a breast reduction surgery with a plastic surgeon in the US. I paid out of pocket for this procedure. I started as an E cup and requested a small C, and the surgeon said this result was achievable. However, now 5 weeks post-op, I'm at a DD and she informed me I'm not likely to decrease further in size as a result of reduced swelling.

    This is an utterly heartbreaking result, as I'm still able to wear my old bras.

    I asked for all my medical records, and I see that she noted my target size was a small C in my first two consults, however, in the operative notes she indicates that the size she targeted for surgery was a D. This was in a section where she said we reviewed the risks associated with surgery, on of which being "the inability to obtain a D cup". This was never discussed, because you can bet your butt i would have corrected her. I honestly think she mixed me up with another patient for the target reduction amount.

    She says that she can revise without surgery, but I will be seeking a second opinion of another surgeon also. She is suggesting that we take out more tissue in office under local numbing, but i don't think she can get 2 cup sizes down in office.

    I want to know what legal avenues are available to me in this situation. Any advice?

    COVID-19 Positive. Restaurant trying to make wife still work.

    Located in Southern Florida

    I tested positive for Covid-19 and have been the sickest I've experienced in my entire life. The county contacted me and said i can't return to work until 2/5 but that my wife can not return to work until 2/15 due to the fact that she has been my caretaker and could be carrying the virus.

    We have 2 small children who my in-laws usually watch while my wife works nights; however, due to my positive results we are obviously keeping the kids home so we don't expose anyone to this virus.

    5 people at my wives restaurant job have tested positive for Covid but they keep it very hush hush. My wife explained the situation to them and what the county said as far as quarantine and her job is disregarding it and still telling her to come in to work.

    Just need help to know if we have the right to stand our ground here?

    MIL stole my paycheck

    Just as the title says. I left my paycheck unopened at my partner's new apartment. Her mother's boyfriend is the maintenance man, so they've both been in and out. My check was on the couch next to my partner's purse. Her mom said something about leaving stuff laying around and moved the purse. Now, the check is gone. We do not think it was the boyfriend, he's been incredibly respectful and given us money out of the blue just to be nice and helpful. Her mom has a history of sticky fingers. We've looked everywhere, it's not here.

    What do I do? How do I get my money back or a new check or something? We're real tight on money since she just moved. Like, that check was the only money we had left kind of tight.

    Update!!

    So my partner obviously tore the place apart looking for this check right? Including taking all the cushions off the couch. Well, she picked me up this morning to come help figure this out. When we got back the check was in between the cushion and the backing. Very easy to spot and would've fell into view if the cushions were moved. Meaning her mom came in while we were gone and put it there. She for sure stole it. It was already cancelled so I can't cash it now, but at least we know what happened. We aren't sure what to do now. I think my partner is gonna ride it out until she can get somewhere safe and then go NC.

    I screwed up my son's SSN -- how do I fix it?

    Oregon. Long story as short as possible: when I adopted my son 15 years ago, something happened and his biological last name did not transfer to his adopted last name for social security. I didn't realize the problem for years. We were able to get a passport, file taxes, etc. and there was no problem. A few years ago (I think 4), I went to renew his passport and the social security number came up with his old last name. We have nothing official and legal under that last name -- not his school registration, not his approved birth certificate.

    I got out all the adoption paperwork that was now around 10 or 11 years old, found the name of the lawyer who did the adoption (my son was adopted through foster care, and this was a lawyer who was contracted by the state to file the paperwork at the finalization of the adoption, not someone I had much or any contact with). The lawyer had retired and passed away shortly after the adoption. There was no way for me to access the paperwork. Everything I have from him, my son's biological name, etc. is redacted. I know all the information; I just don't have any legal way to prove what it is.

    So, I took my whole big sob story and my mountain of redacted paperwork to the local social security office. Basically from their perspective, I did not have the information to prove that Son (Biological Last Name) was the same person as Son (Adoptive Last Name). However, after lots of bureaucracy, the manager took pity on us and just gave my son a new social security number.

    Here is where I messed up and where I need help. So as not to call attention to myself in Turbo Tax, I kept filing taxes with the old social security number. I shouldn't have done that. Now my son is 18 and we're filling out FAFSA for next year and this is a mess. I'm going to have to rectify both social security numbers somehow: old SSN with biological last name (all taxes paid) and new SSN with adopted last name (FAFSA, etc.) If there is a way for me to do this on my own, please let me know. But I've messed the whole thing up pretty badly. I fear I need to hire a lawyer to help. What kind of lawyer would this be?

    Insane Charges from a landlord

    Virginia tenant law

    I'm a college student dealing with a notorious leasing company who i thought was great until recent events. My roommate and i were renting a 4 bedroom apartment that was price slashed for a deal. We're about to go to court with my old landlord on friday so any advice would be appreciated.

    Here's the deal, our landlord sent us an invoice for $1.4k for "Carpet Damage" when the only place that was stained was a dark patch in the living room where everyone sat. We had an instance where our entire hallway flooded due to a leaking AC unit and was flooded for 5 days until the maintenance man came because we were out of town and had no idea. This was all at fault of the landlord because we had called them before we left and we were under the impression that it was "Fixed" but it actually wasn't. The landlord is well aware of this and is using the excuse of "the living room and the carpet hallways have to be replaced together because they're all one piece. This makes absolutely no sense to me. If anything i feel like they're trying to make us pay for their negligence.

    I would also like to mention that our time here has been awful. We didn't have a running stove for 2 weeks due to them never coming to replace it, the bathrooms/bedrooms had mold and mildew problems which i think aggravated my asthma along with my respiratory disease. Our hallway flooded, and now they're trying to charge us with these insane charges.

    What are our chances of winning in this situation?

    My mom is a WNY landlord and is about to lose everything

    Hey everyone, the family is getting desperate and I don't know where to turn at this point so I thought I'd shoot my shot in here.

    TL;DR: my mom is going to lose her upstate/western NY property (including her own home) due to eviction moratorium, etc and feels she has no other options left. Resources or advice would be greatly appreciated.

    My mom has been a landlord for 15-20 years. She owns two single houses and one double which she rents out, in addition to the house that she currently lives in. She has a tenant in the downstairs unit of her double that she has been trying to evict for roughly two years now. She had trouble at the beginning because NYS had changed some eviction laws that she didn't know about. Then. soon after that, COVID hit and eviction moratoriums began to go in place. This tenant and their friends have threatened my mom with violence on multiple occasions to the point that my mom hasn't been able to even access the property at all.

    Two separate sets of tenants in the upstairs of that same double have moved out because they couldn't handle living with the downstairs tenant. It's a long story and the details don't necessarily matter at this point but she has tried everything and has not been able to get that tenant out and will not be able to until May (unless they extend the moratorium again).

    Additionally, her other tenants (although their work hours, etc have not changed during COVID) haven't been paying their rent. She'll get a couple hundred here and there but not nearly enough to sustain her properties, or her own life for that matter. She is on disability due to complications caused by illness but only gets $1000 a month and is unable to work a 'normal' job due to these complications.

    She called me last night to tell me that her only option left is for her to move into the upstairs apartment of her double and she asked my girlfriend and I to move into her house (my childhood home) because she can't afford to live there anymore and to try and sell her other properties if she's able. Although, she knows this would be difficult because no one wants to buy a property that comes with a tenant they know isn't paying.

    She has been working on this for months, calling everyone she can, writing letters, pleading with lawyers to take her case on but she feels she's exhausted all of her options. I offered her as much money as I would be able to give (which is not much at all as I've been unemployed for the better part of a year myself) but she is 1) too proud to accept help, and 2) knows that even if she accepts money from me it is likely that eviction moratoriums may be extended and she'll be left in the same position.

    Any resources, recommendations, anything at all would be a great help. ALSO, this is not NYC it's more upstate/western NY area in case that matters.

    [New York] I formally resigned from my job 3 months ago but still haven't received my accrued pto. Despite requesting for it twice since I left. What exactly can I do?

    Cops almost spike stripped my car and I dont know why.

    This just happened to me and I am still a little shaken up. I just need advice.

    I was driving down the interstate today and I noticed a cop on the right and left side of the roads. The cop in the center median hopped out of his car and threw this long black tube directly in front of my vehicle. I had/have no idea what is happening but I swerved out of the way to miss them out of pure reaction. Luckily not causing any wrecks as the road was full. He then got back in his vehicle, but never turned on his lights, caught up to me and got on my bumper, and after a few seconds of being there changed lanes and zoomed past me. I am very shaken up about what just happened and I need advice on what to do.

    A cancerous mass was misdiagnosed as benign in 2018; where do I start?

    I guess I'm not asking for legal advice, per se, but moreso just advice about where to start.

    In 2018 I went to my PCP about a lump on my neck. She ordered an ultrasound, which involved a tech coming into the office and doing a (very quick) scan of the lump. A few days later, my PCP called me and told me the lump was a benign cyst and only cosmetic.

    In November of 2020, I went to a different doctor because the lump had grown quite a bit and I wanted a second opinion despite being told it was benign. Turns out it's thyroid cancer that has spread to my lymph node. According to my ENT & my endocrinologist, thyroid cancer would not have spread to a benign cyst; the cyst was caused by the cancer spreading to my lymph node — meaning I've had cancer for over two years, and that the original ultrasound was botched.

    On top of that, apparently any lump on the lymph node should always be biopsied because it can't be ruled as benign otherwise.

    So I had thyroid cancer when I originally went to my former PCP, and she failed to send me to get a biopsy to confirm the cyst was benign. Now that I've had multiple ultrasounds in the past months, I also am realizing that my ultrasound tech in 2018 was either lazy or inexperienced because the ultrasound wasn't done correctly. It was my first ultrasound at the time, so I was unaware that things were weird or incorrect.

    Anyway. So now I've had thyroid cancer growing for at least two years, and the one cyst from 2018 has multiplied to two cysts, one of which (the original one) is so large that the surgery to remove it will affect my jugular vein and also reduce mobility in my arm/shoulder on that side.

    There are more details, mainly how the fatigue caused by this cancer has wrought havoc on my life, but this is the main gist of it. I'm pretty sure I have a decent case, but if I'm wrong and this isn't worth pursuing legal action over please let me know. I have very limited energy both physically and mentally so if this would be a waste of my time I'd rather just not even bother.

    My main question is rly just where to start, but I have a few specific questions as well.

    • What type of lawyer would I reach out to for this? Is there such thing as a medical lawyer? Maybe a cancer-related lawyer?

    • Is it okay if I wait until after my cancer is treated to contact a lawyer? Is there like a time limit as to when I need to act on this?

    • I know (vaguely) that there are lawyers out there who won't charge you unless you win the case. Is this something I should look intro? If not, is there any financial assistance I can apply for to help with lawyer costs & legal fees?

    Can a used car dealer charge a restocking fee for a car that never left their lot and only a deposit was made?

    I'm in California and the contract law says that a fee can be charged at $75 to 1% of the cars fee and that the car has to be returned along with original documents. But I never took possession of the car, never got the title etc, it never left his lot, I just paid a $300 deposit to hold it.

    Purchased a property where the neighbour had previously cut down trees and filled in the land.

    Whoever lives behind me was planning on developing a large neighbourhood so he filled in a bunch of land. One small section he cut and filled was on the property I just purchased. The property markers are still present and must have been placed there by him since they stick out of the gravel. He currently is not using the land as he decided not to develop so there is no issue at the moment but I will be asking him eventually what had happened. The seller had no idea until I mentioned it.

    What advice could you give in this situation? Property is in NB, Canada.

    [VA] Is it legal to evict over a spouse’s arrest?

    EDIT: I now have a copy of the lease and know his specific charges. The lease does specify that tenants are jointly and severally liable, so it appears the answer to my original question is "yes." My new question is whether his arrest is indeed in violation of the lease. The relevant section states that tenants are in default if:

    " (5) you or any occupant is arrested, convicted, or given deferred adjudication for a felony offense involving actual or potential physical harm to a person, or involving possession, manufacture, or delivery of a controlled substance, marijuana, or drug paraphernalia under state statute; "

    His charges are 4 counts of indecent liberties with a child in a custodial or supervisory relationship (this girl has done community theatre with us and he has at times been her director. Obviously it's been over a year since any of that has taken place, so I don't know if these offenses happened long ago, or if the custodial relationship extends beyond times when he is actually supervising her). Would this qualify as "actual or potential physical harm?"

    Also, I just want to be clear that, barring some huge, incredibly unlikely misunderstanding, I'm disgusted with this person and want nothing to do with him. My sole interest is in helping his wife mitigate the damage to her life.

    I'm posting on behalf of someone else (who is extremely overwhelmed and struggling to do the legwork on this situation), so while I will try, I apologize if I can't answer every question as I don't have all the information.

    My friend's husband was arrested last week - I don't know the charge, but I have gathered that it was some form of inappropriate conduct towards a 17 year old girl we know. He is currently in jail and his bond has been denied. Yesterday she was notified that she was being evicted, because apparently an arrest, and not a conviction, is all that is necessary for grounds for eviction. I can understand that, but can my friend really be evicted for someone else's arrest? She was not arrested or questioned - she still hasn't even been told the specifics of the situation. It's not an issue of making rent because she was the sole breadwinner and he was a stay-at-home husband. Naturally, she has a lawyer but he's not returning any of her calls or emails about this. Also, I personally am beginning to doubt that he knows what he's doing due to some prior events. I know she can get a new lawyer but I don't honestly see her doing that right now - she's a complete mess and already deep in the hole financially.

    I've tried googling this question but all I can find is information on evicting one's spouse, and I can't seem to locate any resources besides LegalAid, which I'm fairly certain my friend won't qualify for due to her income. Can anyone tell me whether a spouse can be evicted for her husband's arrest? This is in Fairfax County if that matters.

    My husband received a letter from a legal firm asking for payment of his ex wife's Discover card. She died a few months ago and they had been divorced for about 25 years. Is he responsible for this? We are in Ohio if that matters.

    Forced to work outdoors in a blizzard, slip and fall, then early termination (CT)

    As the title says, I live and work in Connecticut in a field where a lot of my work is outdoors. On Monday, we had a blizzard come through, and the week before we got ~3 inches of snow.

    Monday morning, a project manager insisted we go out to do work on a site, which they did not plow the previous snow fall, so it had become ice. That combined with the fresh snow I had a pretty nasty slip and fall that resulted in my left arm having a bone bruise, and an extremely mild concussion. Thankfully I had my hood up and a wool hat on.

    My project manager had me complete three of the soil testing locations (completed with a large track mounted drill rig called a geoprobe), before he took me to an occupational health center to get checked out. They said I was fine, but had me go back yesterday for xrays, which did not show any breaks or fractures. They recommended I got rest and stayed on office duty for a week.

    This is then also complicated by that I had given my notice to leave Monday the previous week. Now they are forcing me out a week earlier (this Friday), and no one has asked me to complete any other work.

    It is my understanding the work could have been easily delayed a day and all this would have been avoided.

    Is there anything I can do to keep working an extra week until my next job starts, so I don't miss a week of pay? Additionally, is there anything else I can do or is this a open and shut down, because I wasn't seriously hurt?

    I live with my sister and her boyfriend (who's fresh out of prison, doesn't pay rent, smokes pot and meth with her, and constantly trashes the house) the other day I had enough, I called him out on his bullshit for not working or paying rent etc. well since then she's made it clear that I'm no longer wanted and should "have arrangements made to leave by Friday" I've been here for over 30 days, however I haven't received any mail and the only way I can prove it is through our saved texts. I gave her the rent/internet money through Facebook messenger however she's refusing to give it back and wants me out the same week I gave it to here. She's the only one on the lease but I think I qualify for "tenant-at-will". I've asked for the land lords number (it's a house she's renting) and she's refused to give it to me so I can talk with him. She has druggies floating in and out of the house and does meth herself. I'm clean as a whistle and just want my last 30 days or my money back and I'll leave. What can I do? Any advice would be Mitch appreciated!

    Edit: She has not given me but 2 days notice to leave and I've already paid rent. And it was through a text message.

    I have a roommate from hell, I need out!

    My roommate is a drunk and destructive loser and it's going to ruin not only our friendship but our relationship with our landlords.

    I live on the top apartment of a two family home in a two bedroom apartment with a roommate. The landlords who own the home live in the bottom half below us.

    We signed a 12 month lease starting in September until September 2021. I pay my half of the rent on time or early every single month. I work from home and I am a model tenant. I'm quiet I don't drink or smoke and I keep to myself.

    My roommate is a party animal. He drinks every day plays loud music and most recently became destructive and violent. He lost his job last week so he has been on a bender. It's getting to the point where he is starting to get angry and try and break things in the house. I own every piece of furniture or furnishings that we moved in with so they are all my things. He's been loud and disrespectful at night to the point where the landlords text us to be quiet or turn the music down and such and I text them privately saying it's not me please don't involve me. I'm afraid since he lost his job he won't be able to pay his half of the rent soon. What happens then?

    There has also been two instances of violence where he drunkenly entered my locked room where I was sleeping and tried to fight me and then an altercation with his drunk friend who became physical with me. It's to the point where I don't even feel safe in my apartment. I never want to feel like this.

    My question is how can I get out? I just want to remove myself from this situation but I want to make sure I don't lose any money. I want my half of the security deposit back as I have been a model tenant. How can I legally leave my lease? It's the best thing to do I will let him destroy this place and himself by himself.

    Friends Car Stolen from Dealership Service Lot

    [Florida] A friend of mine recently purchased a car from a used car lot. After having the car a few weeks she noticed a few engine issues and dropped it off to be serviced today. A few hours later she receives a call from the police dept that her car has been stolen after the dealership left the keys inside unlocked.

    The police are obviously looking into it but I don't expect much to come of it with their reputation for similar cases. What would you advise as the best course of action under the presumption the vehicle is not found? Would it be filed under her personal vehicle insurance or against the dealerships insurance? Is their grounds for a lawsuit? Thank you in advance

    Az(us) is there a legal time period for a manufacturer to fullfill a warranty claim?

    Item is an electronic/laptop. It's been 4 weeks and they said 2 weeks ago my item had to be replaced as it could not be fixed. They have not yet shipped anything. They do not have the item in stock apparently (direct from manufacturer) not talking to a retailer.

    Normally 4 weeks doesn't seem like a whole lot of time considering the covid crisis. If it were not for another redditors claiming he has not received a replacement since October from the same manufacturer, i wouldn't be terribly worried.
