Kickstarting Before a Business is Officially Created and Registered Posted: 11 Feb 2021 10:44 PM PST I'm hoping to start up an online business, but I want to make sure I'm doing everything legally. So I guess it's storytime. I live in the United States. Late last year, I got a diagnosis for a genetic lung condition, and I was told by my doctor that I am particularly susceptible to permanent lung damage if I get COVID-19. In an abundance of caution, I decided to self-isolate absolutely as much as I could, and I had to quit my job. With all the time I suddenly found myself with, I couldn't stand to be unproductive, and I got to work on an idea that I had had for a while. I ended up designing a product and prototyping it with my 3d printer. Now I'm getting close to having it ready for production, but having not worked for months, I am pretty strapped for cash. I have spoken with lots of people in my target audience, and I'm confident with my ability to fundraise successfully on Kickstarter. But here's where my problem comes in. I fully intend to create a business with this product, but I don't have the money I need to register an LLC. Is it legal for me to use Kickstarter under a business name that isn't registered yet? Or will I have to fundraise under my own name? I intend to put all funds into a separate business account, and all costs for backing rewards will come out of that, and I intend to keep it separate, even if I have to fundraise under my own name. Anyway, I guess my question is this: How do I go about this? I'm sure it varies from state to state, but in general, what should I expect the law to be? What would be the smartest and most appropriate business etiquette? Should I just wait until I can save enough for the registration fee?
