Over 2 years ago, I contracted Lowe's to install floors in my house and the experience has been terrible. The original goal was to have them finish before my wife gave birth to my son and 2 years later, my wife is due to give birth to our second son in 2 months. It's worth mentioning that Lowe's contracts delivery of materials to a 3rd party and they contract installation services to a 3rd party - all have been a good source of heart burn for me.

Here are some of the items they have just royally screwed up on.

    • damaged my property before, during and after installation

    • constantly ordering wrong materials, which has resulted in my taking vacation days unnecessarily, as well as losing my weekends

    • terrible project planning - I have been the main point of contact between the companies and planned the work for the installation

    • took so long to fix their issues that my floors are no longer in production which resulted in some parts of my house being different size planks (thank goodness they still sell the same color)

    • and I think I may have lost a few years off of my life from all of the stress... not sure if I can quantify the toll this has put my family through

I want to sue them and get back my lost wages from using vacation days to sit at home and watch them screw things up, as well as have them compensate for damaged property, etc. They did inform me that they will provide some compensation when the project is finished but I am getting the feeling someone is trying to screw me over at Lowe's and this project will never end.

Edit: I forgot to mention that I reside in northern Virginia.

[TX] The people I was boarding my horse with decided to buy my horse from me, but he's not for sale, when I returned to take him they gave me a check and wouldn't let me bring him home

    Posted: 09 Jan 2021 12:13 PM PST

I was in Europe for several months because my grandpa died and I had to deal with all of that. I have a horse and I paid a friend of a friend to board him on their land for the duration of my time away, and I have been paying $200 a week for them to do so. I returned yesterday and went to go see my horse, and I was told that they decided to purchase the horse and given a check refunding the $2200 I had paid for them to board him plus $4000 for the horse. However, my horse is not for sale. When I tried to tell them that I was basically told that my lifestyle is not appropriate for horse ownership and that this is for the best, and to take my check get off their property. I don't know what to do, I am hesitant to call the police because the husband of the lady that I've been dealing with is a deputy sheriff. I want my horse back.

EDIT: She just posted a photo of my horse on Facebook calling him a rescue that she saved from "the previous owner who was ready to send him to slaughter in Mexico" which is just BS

Employer “has no funds” to pay the employees

    Posted: 08 Jan 2021 11:05 PM PST

California My wife works for a nonprofit org and it's been really sketchy. She has worked her way up into management(a supervisor) but still collects hourly.

Employer almost never pays OT (after 80 hours since it's bi-monthly checks) She works weekends from home (can be on the phone/computer for hours) for a fixed rate of 100 per weekend(sat and Sun) She has asked about her missing OT or DT and they say not needed bc they are non-profit so it doesn't apply to them.

Most employees must use their own cellphones for work related purposes(few with company phones) and some even use money out of pocket to cover minor company expenses. (Can't go into detail)

The work week is as follows: 1-15 gets paid on the 25 of that month and 16th-end gets paid on the 10th of the next month.(or the Friday closest to pay date) This weeks pay date is today but the employer didn't issue a check to half of the staff and the other half was told there is no funds so don't cash it until next week.

So I've got a couple questions:

How long can staff go without a paycheck? How do we get them to pay for missing OT/DT and weekend hours? What is the law on personal phone usage for employment purposes? Staff must stay on duty during the whole shift so they don't get a lunch or breaks during the exactly 8 hours (example 9am-5pm) Last question. Some employees were out due to Covid-19 and didn't get Covid pay, any way to recoup lost wages?

I'm sure this should all be taken to a lawyer or something but I would like to know what we are getting into. Any help is greatly appreciated.

    Posted: 09 Jan 2021 12:58 PM PST

If you not seen my original posts please do so.

I wanted to make an update for those curious and thankfully, it is a good one. About an hour ago I got a phone call saying the case has been dismissed. I have to be honest, this is one of the happiest days of my life. The last month or so has been hell for me and my family and I'm very glad all this is over. If you have any other advice or things to note please let me know.

Carer for disabled dad lost $15,000

    Posted: 09 Jan 2021 03:30 AM PST

My dad is disabled and sold something for $30,000 cash. He then entrusted this cash to his primary carer to keep safe and deposit it into his bank account. The carer has now told us when she took it out of wherever she was keeping it in her house to deposit it, there was only $15,000. So now we have $15,000 cash missing and the carer claims she has looked everywhere and couldn't find the rest. She lives in a two bedroom apartment with her son. Is there any legal way of getting the money back or is it gone forever? It doesn't make sense for half to go missing unless it was stolen by her or her son, and we have witnesses that it was indeed $30,000 that was in the bag. Location: Australia NSW

    step mother withholding documents

    Posted: 09 Jan 2021 05:27 AM PST

First time using reddit so I'm not really sure how to format this but I'll try to give the best explanation of my situation that I can.

I (F17) plan on moving out as soon as I can this year (preferably soon after I turn 18) and cut contacts with my step mother. I live with her and 2 younger step brothers who she adores. I'm not allowed cell service (Yet my 12 year old brother is,) she won't let me get a job and makes me babysit both my brothers while she works yet tells me the day I turn 18 she's kicking me out? My dad is incarcerated and my mom lies to my grandmother about me so I can't go to her about anything. I've mentioned moving out last year and she threw a tantrum over it and told me she won't give me anything.

I'm uneducated on what I'd need to do in order to get out of this situation I want to change my name and possibly get a new ssn card? Can my name change be done online? I don't want her to be part of my life or look me up on anything. any advice helps, thank you so much

    Dangerous Dog

    Posted: 09 Jan 2021 09:33 AM PST

I'm new here, please forgive any lapses in protocol.

Ex-wife has custody of our two middle-school aged children. In October, she acquired a rescue dog. It is a large, aggressive, energetic mix breed. The dog was acquired for aesthetics, with no regard given to disposition. The dog was described to me as a "rescue from an abusive home in Texas".

In late November, the dog bit my eldest son. The bite was on his face, and required a visit to the emergency department for sutures.

The ex-wife insisted this was a fluke, and the dog would be "trained".

Over the next several weeks, both children expressed their discomfort with the dog. He frightened them. I saw for myself, through the living room window, this dog take a menacing posture when I would drop my children off after a visit. My youngest son has shown fear when approaching the front door.

This past week, the dog bit my youngest son in the face. The bite was much worse than the first bite on my eldest son.

At this point, I demanded the ex remove the dog from the house. She insisted she "had a plan" to train the dog. From my point of view as a father of two boys whom will carry facial scars for the rest of their lives, I deemed her "plan" insufficient.

I informed her that if the dog was not removed from the home in the next 24 hours, I would be calling animal control. She balked. I called animal control.

The animal control agency sent an investigator to the home, and wrote two citations. The agent, however, did not remove the animal from the home. The agent says this is not in their power.

Well, r/legaladvice, who does have that power? How can I get this dangerous animal out of the home?

This is for Washington state, by the way. Bot scolded me.

Can I sue a company for calling me nonstop?

    Posted: 09 Jan 2021 09:02 AM PST

This seems like a ridiculous issue but I am at my mental breaking point. I'm in the US. Somehow my cell phone number is listed as a restaurant phone number for Doordash. Every Saturday morning I get 10+ calls from Dashers. This has been going on since March 2020. I've reached out to DoorDash support and am always told they will "unsubscribe" me and to give it 7 days to take effect but it never does. I truly don't know what else to do aside from changing my phone number (which I use for my own job and has been tied to me for years). Is there any recourse I can take here? I know suing would be costly, can I send a cease and desist letter? I truly have no clue if there is any legal leg to stand in here.

    Accidentally committed "doctor shopping"?

    Posted: 08 Jan 2021 07:52 PM PST

I live in the Michigan (United States) and I'm in quite the dilemma. I was desperate to get help for my insomnia and my doctor wouldn't listen to me, so I made an appointment with a new doctor and she prescribed me zoloft. My old doctor called me to go over my blood test results, and she ended up prescribing me zoloft too. I was just too nervous to tell her I got it prescribed through someone else already. . . I don't know. I felt like I was cheating on my doctor or something. But now they've both been sent to the pharmacy a few days apart and the app only shows one so I'm sure they've contacted my doctors. Can I call the pharmacy and try to explain it to them? Can I call my doctor and explain it to them? I don't want to go to jail over antidepressants. . .

[OR] Just fired and one of the listed reasons was discussing pay

    Posted: 08 Jan 2021 06:49 PM PST

So I worked for a company for a few months and was fired today. I admit it wasn't a good fit. I've honestly been looking for another job for 2 months now.

Today, I brought up an inconsistency with my paycheck and at the end of the day, I was fired. Suspicious, but not why I'm posting. They gave me a list of ridiculous reasons why I was being fired. Some of them are outright lies, but that's not the point either. The point is— one of the reasons listed is I discussed pay with another coworker and that is "prohibited". I'm sure there's a law against that in Oregon. Can someone with more legal smarts tell me what my next steps should be?

[TN] I was fired shortly after an out-of-state [TX] police detective contacted my boss

    Posted: 09 Jan 2021 01:09 PM PST

I was a member of senior leadership for a company where I worked for nearly four years. Two months ago, I was contacted by an out-of-state police detective who said I was listed as a suspect in a case filed by an ex-girlfriend (also out of state, separated for two years). I had my attorney get in touch with the detective, he said I was not involved, and if the detective had questions they could be sent to my attorney. No charges have been filed, and there was no follow-up from the detective.

One week later, my boss revealed to me that the detective had emailed the company founders asking to talk about the case. They all refused and referred the detective to my attorney. I thanked my boss and apologized for the awkward situation.

One week later (two weeks since initial contact from the detective) I was asked to resign. I asked why, and the company refused to provide cause. I refused to resign and was fired. The closest thing I was given to a reason was that "this has nothing to do with performance, but we have to protect the company." Lips were absolutely sealed after that.

This was two months ago, and still no further contact from the detective and no charges have been made. I'm baffled that this came to me and that it (seemingly) resulted in my firing. It has left me reeling and, not to be dramatic, a bit traumatized.

Is there anything at all that I can do to learn why I was fired?

Is there anything I can do in protest of the damages caused by the detective?

Is there anything I can do learn why I was pulled into the investigation?

Can police contact bosses without charges and without permission? This will obviously result in some level of professional damage — do I have any avenues for complaint?

Employer threatening to tell grad admissions not to accept me

    Posted: 08 Jan 2021 09:28 PM PST

Hey all, seeking some advice if possible. It's a crazy ride so enjoy the tea.

My incredibly toxic employer is attempting to blackmail me. Very long story but I'll attempt to keep it short. I put in my one month's notice of resignation on Monday as I have a new (more stable) job beginning in February, he asked me to give him a second chance to provide the same benefits as them, I neither or agreed nor declined and explained it's simply my time to move on and thanked him for everything. I wrote an incredibly nice letter, thanking him multiple times for encouraging me to pursue grad school, writing me a great letter, etc. and he essentially rejected it. Context: I'm the practice manager of a small psych practice and have been employed there since 6/2019. Everyone leaves because he's manipulative and shitty. I stuck it out b/c pay is great, got promoted, and needed to continue to build my experience/obtain a solid letter of rec. He hires people who have recently graduated college and promises them a letter of rec because he considers his practice a great place to get experience for people pursuing higher ed.

Today, he threatened that if I don't stay to "earn back his trust" until I go graduate (PhD in psychology) school in August (assuming I get accepted) he will email all of the schools I applied to and "retract" his letter of recommendation and tell them not to admit me. He said that's the "ethical" thing to do since I betrayed him by seeking other employment and am "not who he thought I was." He said none of the work I've done has mattered since I'm treating him so horribly after "everything he's done for me." He gave us all a bonus on Christmas and said I used him for that and the letter of rec, and now I'm "leaving to ruin him." He also said the raise he gave me "wasn't appreciated." I thanked him multiple times for that prior to this and also, didn't ask for it. He is attempting to take away my future because I'm moving on and said "if you cared, you would stay. One employee gave me 8 months notice and you blindsided me." I don't see one month's notice as blindsiding. No contracts were signed that I would stay until I left for grad school, nor was a promise made to him.

Long argument ensued, he insulted my character, told me I'm quitting because I'm an angry person determined to ruin his practice. I explained I'm very grateful for everything and would not intentionally hurt anyone or his practice. Over and over again. He's adamant that he doesn't believe me and that he's going to email admissions at the 15 schools I applied to. We didn't come to a conclusion because this clusterfuck lasted until 5 pm and he said we weren't going to solve anything and had different opinions of what was fact (?). Needless to say, I'm not returning. My two coworkers heard all of this from outside of his office (it's a small area) and are both resigning after hearing how he spoke to me today. So he's triplefucked because it's just us three gals.

To say the least, I'm shaken up. This doesn't seem like a big deal maybe, but I've invested so much time and money into grad school applications. It's my future. This is my second go at applying and I'm incredibly worried he will try to hurt this for me. What can I do? Is this extortion? Retaliation? It seems illegal. I reached out to an employment lawyer for some advice. Just wanting to get some other opinions. All of my friends/fam are encouraging me to seek legal counsel and the psychology licensing and ethics board of my state. I am also considering sending an email stating that after his threats I don't feel the work environment is "safe" or "healthy" for me to return - but I need a different word because I'm not being physically threatened.

If you stayed this long, thank you!

    Excessive Noise in Apartment

    Posted: 09 Jan 2021 01:32 PM PST

    Nebraska

I have a new neighbor in my apartment building. Ever since they moved in, I have dealt with excessively loud music on and ongoing basis. It's not even the music I can hear, it's the bass. It's excessive and goes on for hours, during the day and late at night. I have made approximately 10+ complaints to the apartment office, who just say they will continue to talk to this individual. I also called the non-emergency police, who told me to keep following up with the apartment complex.

I'm over this, and want to know if there's any legal action I can take over this. If so, what type of attorney would I even look for? I have lived in my apartment for almost 2 years with no issues. There are other noises I hear, but I'm fine with those because they're temporary and I understand that a certain amount of noise comes with living in an apartment. However, I can hear this person's bass over my vacuum, my hairdryer, my TV, my washing machine, and even my noise-cancelling AirPods. I'm tired of it and tired of complaining every few days to my apartment complex.

Just want to know if I have rights other than asking to break my lease and move out early. That's certainly not off the table entirely, but I'd really like that to be my last resort option as I love everything else about my apartment, location, etc.

Ex-partner is threatening Court action for "money owed" after the breakup

    Posted: 09 Jan 2021 09:06 AM PST

My Ex-girlfriend has threatened to take me to court to claim a fairly large sum of money that she feels entitled to after we had separated in august of 2019, her claim is that she had funded a large part of our relationship (I was a student at the time) and seeks to claim back money for many items I'm fairly sure I can laugh off. some items, for example, include half the value of gifts she purchased, veterinary bills of the pets we had (which she still cares for), Fuel for the drives between college and home during my studies, household goods (cookware and small appliances, which she retained).

when I left, I took my personal effects and a computer and moved back in with my father. the only thing I could possibly see being legally contested is the computer that she had bought while I studied which I had said I would reimburse however after the split she had kept a number of the components herself.

In South Africa, there is no common law marriage or community of property outside of a legally recognized partnership, to my knowledge. I don't ever remember making any sort of formal agreements and I think she already benefited, keeping everything we had accumulated during a 7-year relationship. this obviously adds stress as she has threatened to take me to court so my question is effectively trying to ascertain a best or worst-case scenario or if this is even a possible legal issue

can I press charges against a minors parents?

    Posted: 09 Jan 2021 10:14 AM PST

I live in Virginia, sorry about that.

There is a small group of minors, three of them, roughly 13-14 years old. they terrorize our street. breaking into and trashing people's vehicles is the typical thing they do, but my car was stolen yesterday morning, and ai am fairly certain they are the culprits. if they are caught on the camera where they parked my car after stealing it, am I able to press charges against them or their parents?

there's a lot of other things they've done, including breaking into my vehicle on more than one occasion. middle of the night, middle of the day. they stole my car at 4 in the morning. are constantly walking this street all hours of the day and night. and I'm tired of it. they still have my keys. house & car keys. they stole it after I started it for work in my own driveway, and I went back inside to get my jacket and backpack. I like my home and my area, but these kids are really pissing me off. we're installing a camera tomorrow until I can get my car rekeyed ($1000) we already changed the locks on the house. but this is ridiculous.

    thank you.

Texas Statue of Limitations for child abuse & neglect

    Posted: 09 Jan 2021 12:43 PM PST

I'm posting on this subreddit because all of the information that I've been able to find on the topic online pertains specifically to child sexual abuse and or to the laws of other states.

Long story short, I was the victim of some pretty harrowing psychological and physical abuse by my mother, which occurred on a regular basis from the time I was a toddler until I was about 13/14. I believe I was 17/18 the last time she assaulted me, during which she threatened, with other people as witnesses, to beat me without caring if "we're in public or if the police have to come get me off of you".

I am 20 now and no longer living with or in contact with her. She has previously been investigated by police for suspected abuse of a non-related child in her temporary care who turned up with serious signs of physical abuse. However, I myself was a child when this happened, and though I saw for myself that she was guilty of the abuse and neglect, I don't know what/if anything else happened regarding the investigation. It's safe to assume she simply got away with it.

Initially, I had no intentions of suing for various reasons. One, I do not have the money. Secondly, nobody was ever aware of the extent of the abuse. Not even my father, as he worked long hours. He openly disavowed her corporal punishment but did not know how bad it really was, until I confronted my mother as an adult in front of him (she simply denied everything and said I would be insane and mentally ill by now if it had really happened). And lastly, I grapple with intense emotional pain and embarrassment because of it to this day and feel paralyzed when I try to speak about it, I am still working on overcoming this.

However, I have younger siblings who are about to be at the center of a custody battle between my parents. So I am prepared to persecute and testify about her crimes if it means that they will be spared from living a childhood like mine. My second sister is currently 14, and she is prepared to do the same as she experienced some of the abuse growing up alongside me.

Most importantly, I'd like to know if the statue of limitations has already expired for my case. Also if anybody has some advice about what I can do to strengthen my testimony and potential case, it would be greatly appreciated. I don't have physical evidence of the abuse because of the length of time that has passed, but my sister is witness to some of it (if it's even possible for her to testify as a minor) and my father has heard my confrontation with her and is witness to her threatening me as a 17/18 year old. Of course I would be willing to take a polygraph exam or similar and testify to the best of my recollection under oath. Her character and record also checks out, as mentioned she was previously investigated for child abuse, has had the police called for leaving the children home alone, for destruction of property, domestic altercations etc. drives without a legal license and has several outstanding tickets. She is generally known by our hometown law enforcement at this point, though I don't think she has ever been convicted of anything.

Any advice is very much appreciated, and please let me know if there's any more info I could provide.

Harassing neighbors call animal control on me

    Posted: 09 Jan 2021 10:17 AM PST

    I'm in California, Kern County.

Okay, so our neighbors have been harassing us; purposefully ringing their wind chimes everytime we go in our yard, flood lights into the master bedroom, they throw threaten notes over the fence at us the list goes on) We honestly have no idea why, we have tried talking with them and it just makes it worse. We are dealing with Law enforcement, and they have told us not to speak to them anymore.

The guy has always been kinda crazy. But this all started when we trimmed a dead branch off a tree and they accused us of spying on them (because we used a ladder near the fence)

Three days ago their dog was left outside all day (he never use to do this until he got a new girlfriend) and she was barking her head off for hours! So we called on them for the barking dog. We felt bad for the dog and the barking was making us nuts.

Yesterday I woke up to an animal control officer knocking and he said there was a report that we leave our dogs out 24/7 in the cold and snow with no shelter. (We live up in a mountain community and it's high enough we get snow in the winter.)This has never happened, my dogs sleep in my room with me, they have never slept outside or have been denied access to the house and are both supervised when it snows. They are a golden retriever, a retired service dog, and a 5 month old lab puppy who is my service dog in training. They are well trained (I means the puppy is still in training he's a puppy, but he has a training schedule and he's doing awesome! He just starting to learn his first service dog task).

I was woken up to this, so I was sleepy and groggy and super confused, (I'm disabled and take medication which is part of why I don't wake up well) and home alone the other three family members (all of us are adults) were gone. I went outside and closed the door to talk with the officer and told him what I said above. He said he understood and that I should know I have a complaint against me. And to get a dog house. I didn't think to ask his name because I wasn't quite awake or alert enough to think well.

We are planning on reporting this as part of the harassment. Since it's the weekend we don't expect a call back from animal control until Monday.

My question is this, should we allow the animal control office to come inside the house and yard to see the dog's set up? We are not sure if we should do this or not, but we definitely want proof that we aren't neglecting or abusing my dogs.

*edit: I have four people who are willing to write statements and speak for the dogs care, my other neighbor a retired firefighter, a retired vet technician who also did search and rescue, and handled/trained SR dogs, my dog sitter, and a friend who is a simi-retired dog trainer. They have all known the dogs and me for years and all live very close to me.

[MA] Jogging and police dog became loose during nearby investigation, aggressively approached me. I kicked it in self-defense, injuring it in the process, and then got arrested.

    Posted: 09 Jan 2021 01:39 PM PST

I was jogging earlier this week and I saw three cruisers on a road to my right with cops all about, on the lawn and sidewalk. K9 unit was out. One of the dogs became loose as I was jogging by and aggressively chased me down. I stopped jogging and assumed a defensive stance and police shouted down the dog to no avail. I kicked it in its head as it became in distance and connected pretty well. Regardless, I ended up with bite wounds, taken to the local hospital and then arrested. I'm looking at a class 4 felony for seriously injuring a police dog on top of medical expenses I incurred, which I'm not sure if insurance will even cover.

I ended up fighting the dog off as well as I could to try to lessen it's grip on my leg until officers came sprinting over to remove the dog while arresting me. The whole ordeal lasted just a few seconds.

I'm not even sure where to go from here. As a human, it's my right to not be completely maimed by an animal, regardless of whether it's a service dog or wild coyote. I will be seeing a lawyer on Monday but looking for any additional advice or cases where police dogs attack innocent third parties.

Internet dude looked up my private info utilizing his work's network of information (he's in insurance)

    Posted: 09 Jan 2021 10:14 AM PST

A person who I've known for years, albeit only online, today says they used their insurance computers at work to look up my vehicle identification number, and from that was able to look up information about me and my family. Besides being wildly unethical, is this illegal? I have screenshots of them saying they did exactly this.I've done nothing wrong and I'm not particularly worried about my personal information. I'm essentially a nobody. But I think it's wrong that they claim to have looked up personal information about my mother and father.

(None of this is related to politics. because of the recent news. I feel like I should add that)

I'm located in the United States. Atlanta metro area. He's located in Florida.

Customer claiming to sue us unless we pay him $10,000 for “emotional” damages

Coming to seek legal advice to see if this customer really have grounds to pursue a lawsuit against the automotive repair shop I work at.

Back story is we did some work on a customers car prior to Christmas, he calls the shop on 1/7/21 claiming we left his lug nuts loose and he did not discover it until he was on a road trip about 150miles away. We offered to to warranty all the work at no cost to him and cover his tow bill as settlement but now he's demanding $10,000 for emotional stress/damages.

I told my boss it sounds like this guy is fishing for money but does he actually have any grounds to pursue legal action against our shop? Or should we just warranty the work, pay his tow and tell him to kick rocks or take it up with our lawyer.
