[CA] Canceled family gym membership at start of COVID. Just found out Gym re-actived my membership when Gyms reopened in my area (November) and has been billed my account for over $800 without my permission.

    Posted: 30 Jan 2021 12:58 AM PST

As title states, I canceled my family's gym memberships when the COVID outbreak started and it became clear we would not be going. I've since moved away from the area and as such could was not planning on renewing. Was doing EoY finances when I realized that I'd been being billed by the Gym again starting in November. Immediately contacted them to see what was going and they said that they had reactived my membership when the Gym reopened in November. I was never asked for permission to reactive my account, but they did send an email notifying that they were going to do so in Fall which went to my marketing emails filter. The total charges amount to several hundred dollars since it was three months of membership for multiple household members. They are now trying to only offer me membership credits (which is useless to me since we moved). Checked contract I signed when I signed up and it made no mention of re-activating memberships (only that cancellation requests must be written, which mine was). It seems highly unethical and potentially illegal to have resubscribed me without my consent. Am I screwed? Do I have any options?

The city gave me wrong information about setbacks on my accessory structure and acknowledged it. Now they’re saying I have to move it at my own costs

    Posted: 30 Jan 2021 07:03 AM PST

Hi, new here. I wanted to build an accessory structure in my backyard. Reached out to my city by email (office is close because of covid). A permit technician from the planning department gave me the required information and validated that the placement of my structure was correct based on a plan I provided.

Turns out she didn't know the code so well. A month later, after I'm done with framing and about to cover the roof, a code compliance officer comes by and says the structure violates the code.

After an internal meeting, the city is now apologizing that I received wrong information but is still requiring that I comply with the new placement and is not offering to cover any of the extra cost. My options are to remove the structure (and lose $6,000 in material and labor already invested) or move it (if even possible). Both will add extra costs.

The city is the city of Goleta, CA.

What can I do? Can and should I sue the city?

My cat was killed by the maintenance man in the house I am renting. How can I achieve criminal justice?

    Posted: 30 Jan 2021 09:00 AM PST

[MS] I recently came home from work to find my cat fatally wounded. I recently put in a request to have my leaky sink fixed. It is clear that he was killed by the maintenance man. I have filed a police report. I provided his name and the company he works for in a supplement once I got that information. I took pictures and videos of what I found. I do not have video evidence of the attack, but the company confirmed to me over the phone that he was there that day. There is blood and signs of a chase. Based on the trail of blood and where the cat emptied his bowels, and I can tell the path he took and what happened. I have a necropsy report on letterhead stating the extreme injuries. I am worried that he won't face criminal repercussions. Do you have any tips on how I can achieve criminal justice?

Job Interview Questions such as "Who are your parents?"

    Posted: 30 Jan 2021 09:07 AM PST

I live in a smaller community in the US midwest. I have been working in retail for some time and am trying to change careers. I have had a few interviews and there is one question that keeps coming up. "Who are your parents?"

I do not want to answer this question for a few reasons.

    • Part of my family emigrated from an Eastern Europe nation and our last name stands out against others in this area.
    • I have three parents who all have criminal records.
    • I do not think my parents history should weigh heavier than the details provided in my resume.

I want to know if there is any law providing protection if I want to avoid answering this question. I want to be affible and deflect with something like "I would rather talk today about myself and my own qualifcations."

Any tips or guidance would be appreciated. Thanks!

My apartment is refusing to allow packages to be delivered to the complex. Instead, they are forcing us to use Fetch with an additional $16/month fee.

    Posted: 29 Jan 2021 03:48 PM PST

    Hello everyone,

Just recently, my apartment complex sent out an email saying that they will begin using Fetch delivery service and that they will no longer be allowing packages to be delivered to the complex.

Regarding the fee, here is what the email states:

There will be no charge for this service at this time. However, upon renewal, you will be charged a nominal fee per month of $16.00 for this service.

Here is the notice regarding not allowing packages to be delivered to the complex:

After 2/19/2021, we will no longer allow carriers to deliver packages directly to our community and all packages should go through the Fetch service.

Is this legal? It appears as if they are holding our packages hostage unless we pay a fee. I have been searching my contract for anything regarding package delivery, and there doesn't appear to be anything.

I will be calling management and complaining, but is this even legal?

A doctor performed a procedure on me without my consent. I have no idea what he actually did. I don’t know what to do.

    Posted: 30 Jan 2021 12:04 PM PST

I posted this in a general advice subreddit. Someone suggested I post this here, so here I am.

I went to a proctologist to get checked out. My expectations were to just get an evaluation, plus maybe be presented with some treatment options that we could discuss. Instead, what happened was that while I was turned around and couldn't see anything, I felt something odd. I asked abruptly "what are you doing?"

"I'm injecting you with <insert some jargon here>," said the doctor. Then he said "all done. I'll leave the room so you can get your clothes back on and I'll come back to check up on you."

He never asked if he could do it. He never explained what it was. I have no idea what kind of benefits and risks there are with this treatment. He never presented what other options I have. He just injected me with who knows what.

The doctor never came back. I never got to ask questions. I got slapped with a giant amount of money to pay, despite never being presented a bill. I also never consented to whatever procedure he did. They said they'd email me the bill, but I never got it. They did not hesitate to charge my credit card, though.

This all happened yesterday. I feel pain today.

I contacted my insurance company and they sent me a form to fill out. The first thing it says is to attach my bill. Well, I never got a bill. The insurance company also said they were never sent a claim, but that they'll follow up on Monday.

I tried Googling to see what he could have injected me with. Nothing rang any bells. I have no idea what has been put into my body, no idea what the common side effects are, no idea what kind of drug interactions it might have, and nobody can tell me. I had a panic attack last night over this.

This was the one and only proctologist in my network. When I called my insurance company to tell them about this, they magically found an additional doctor that is in-network, but not publicly listed.

I was never asked for consent. I was never informed. I am not okay with this.

What am I supposed to do?

I'm posting this from an alt account because I'm to embarrassed to ask on my main account. But I assure you all, this is serious. I'm literally losing sleep over it.

    Please, help.

Here's some more info that might help: - I'm 35 years old - Male - Insured - I live in Florida

    Thank you.

Purchased a car 2 months ago and just learned that the lien/contract was rejected by the loan company and my car is not registered to me. Can I take my car back to the dealership and ask for my money back? (AZ)

    Posted: 30 Jan 2021 05:14 AM PST

    Hello!

So the main issue is in the title but here's a little background info that makes this situation even more interesting.

A week after signing the loan paperwork, the dealership calls me and says that they've secured the loan and need me to sign new paperwork. They bring me the new contracts but don't disclose they the interest rate has change. I (an attorney) read through the contract and notice this change. I tell them I'm not signing anything.

I call the dealership, speak with the head of sales, and inform them of their fraudulent practices. He "looks into it" and comes back and says "nothing fraudulent has been done." I argue that because they were unable to perfect the loan, and based on misrepresentation, fraud, and other contract defenses, the original contract is null and void and I'm not bound by the contract. I don't practice contract law so I relied on my knowledge from school. The dealership got pissed, screamed at me saying the contract was valid because they had 30 days to perfect the loan. Because I'm not savvy in K law and never took securities, I decide to drop it. This was around Christmas.

My boyfriend's license plate arrived in the mail the other day. We both purchased cars on the same day. I called the dealership to let them know that I never received my license plates or any kind of welcome package from the loan provider acknowledging the loan and the dealership said that's normal. A few days after I purchased the car, the loan company called me to set up an online account to make payments and I made my first payment on time.

I decided I wanted custom plates and learned that my vehicle is not registered to my name. In fact, the DMV states that the car isn't registered to anyone.

What is my recourse? Can I go to the dealership and demand my down deposit and the value of my trade-in car ? I really hate the sneakiness and fraudulent shit that the dealership tried to get away with and would like to turn the car over and be done with it and get a different car. Also, who can I report the dealership to do they get in trouble for fraudulent practices?

    Thank you in advanced.

EDIT: I re-read my contract and learned that I signed with financial provider A; however, I am making payments to financial provider B. I did not sign a loan with Financial Proivder B, but based on the terms of the loan, the dealership has 30 days to perfect the loan and I understand all that. I don't understand how I can be bound to a K that I didn't sign but I imagine that's the finer points of secured transactions. I called the financial provider B and they confirmed that a deal had been secured with the original terms of the loan. They also informed me that the car has not been registered to me because the dealership has not provided all of the required paperwork for the loan to Financial Provider B. They said they would reach out to the dealership to get the missing information. So I'm not sure what my recourse here is (I don't think there's any) given the loan seems to be secured. I still think the dealership is sketchy AF and I will be making several phone calls.

I am pretty sure a famous composer stole my music

    Posted: 30 Jan 2021 10:29 AM PST

I used to live and work in LA and at one of those jobs I worked for a company that represented film composers and music supervisors. My job was to contact the composers and put together demos for them based on what they and I thought were the best of their cues suited for upcoming projects.

The composer in question is someone I spoke with in person and on the phone about these things, as well as small talk about my own musical career and aspirations.

Flash forward to now. My sister emails me and says, "in case you missed [this show], they stole your [former band of which I was the songwriter] melody.

I figured it was a 'million monkeys on a million typewriters' type thing until I saw the composer's name. It was this guy. It's the same melody. Same key as the most prominent example, even. Not only that, but this melody is in a LOT of the songs from this band, because I was really into leit motif back then. If this composer heard one song from that band, he heard this melody. If he knew my name, he would see that my name has a .com that has had this music freely available since 2006, a year before we worked together and 12 years before he used it.

I have my own lawyer but he doesn't work on weekends and I am shaking right now and would like some form of reassurance that I'm not going crazy. This melody was my favorite thing from this band and this dude totally stole it.

I will provide links for anyone interested, but I do not want to get specific on a public forum for fear it will negatively impact my case.

In a case like this, what must be proven in order to find if one composer has plagiarized another?

I'm being harassed by an mentally unstable person and the police are doing very little about it

    Posted: 30 Jan 2021 09:51 AM PST

A women have been harassing my brother and i, throwing rocks at our windows, threatening violence, slandering our name to our neighbors, stealing our mail, repeatedly coming to our place at odd hours of the night shouting racial slurs and also calling us names and threatening us, saying we did crazy things to her (which we done nothing to this lady)

We called the police on her repeatedly made police reports and even offered to show the police video evidence of her doing all these things which they still haven't given me an email to send them the videos or even just watched the videos off my phone.

She was here last week harassing us so we called the police and asked them to remove her from the property and go back inside only to find out they didn't remove her and she back to harassing us and even pissed on our yard.

We are beyond frustrated, the police told us the court aren't handing out restraining orders at the moment due to covid and told us to go through legal aid and that legal aid most likely won't help us.

I'm at lost on what to do, I'm broke and cannot afford a lawyer and I have recently been busy during business hours so it been hard to find time to even make a phone call, if anyone has any advice please do share because I honestly don't even feel safe in my own house because of this lady

Landlord asking for $1,130 six months after I moved out

    Posted: 30 Jan 2021 11:32 AM PST

Hey legal aficionados, I'd love your input here.

So I moved out of the house I was renting in Indiana along with two other women 6 months ago. It was a college town where the landlords are known for price gauging broke college students. Right after we moved out they sent us a list of charges over email. I responded a week later disputing the charges, detailing why I think we shouldn't have to pay. They never responded, and we never got our security deposit back, so I just dropped it figuring "whatever, they can keep it as long as I don't have to pay the additional charge they're asking for."

Fast forward six months, they're now asking for money on top of our security deposit for those charges I disputed that they never addressed. I found an Indiana law over security deposits that states that if the landlord doesn't send you a detailed list of charges within 45 days of the lease ending, they owe you you're full deposit back. They did send us this list within 45 days, and I disputed immediately, but they never answered. Does this mean they owe me my full deposit back? I've been unable to find laws pertaining to the unanswered dispute issue.

Thank you in advance for your help, really hoping to screw my landlord over, as I rented from them for three years without issue and now they want to screw me in the butt (during a pandemic as a recent grad, might I add). Let me know if you need any other info!

    Parking tickets after private sale

    Posted: 30 Jan 2021 12:32 PM PST

I recently sold my vehicle privately for $800. We agreed and I signed over the title. I have the dates, signatures, and sale price on my MV2928 form (provided by WI DMV). I took both plates off. Two days later I filled out the seller notification with his name, title, date, and sale price.

I just received a delinquent parking ticket for $110 with my license plate #. When I look up my title on WI DMV using the VIN#, it says the title is in my name and last transfer date was when I bought it originally. When I looked up the VIN# under HIS name, it said the VIN is found but not in his name.

How is this possible? My guess is he found a way to use my plate # on new plates and never registered the car in his name? Or they looked up the VIN# and saw my plate # as the most recent owner?

My next step was to contact the DMV, get proof of the seller notification and send that along with my MV2928 proof of sale document to the police dept.

Could use any help to figure out what's going on here and what I can do.

Victim of auto fraud; I am the owner of a title washed vehicle whose odometer was rolled back by a previous owner. How to get rid of this car?

    Posted: 30 Jan 2021 01:34 PM PST

I purchased a vehicle in a private party sale about 3 years ago (California). I recently learned that this vehicle has a salvage title in another state due to a severe collision. I don't believe the car was repaired properly, although it does operate fine.

Also, the odometer was rolled back by a significant amount prior to my purchase.

I'm not interested in going after the perpetrators. Instead, I want to get rid of this vehicle, and I want to do so in a way that does not create liability for me. I think my best option is to sell the car for parts, or even directly to a salvage yard. Is there anything I should do to protect myself before doing so? I would definitely plan to disclose the history of this car to whoever I sell it to.

Accused of sexual assault 3000mi away, what do I do?

    Posted: 30 Jan 2021 01:22 AM PST

So this all just occurred tonight and I found out that I am vastly underprepared for these scenarios.

Just early tonight my mom got a text from my ex girlfriend's mother saying "Please note that if your son ever comes back in ct again, he will be prosecuted as a rapist in our state! They are six girls that will file sexual assault charges against him if he ever coMes into our state again!!!!" What I thought was strange was the grammar and the "6 girls" reference. I no longer live in that state but when I did I hadn't date 6 girls let alone touch anyone. So I found it odd that that was stated.

Secondly this ex girlfriend was broken up with over a year and a half ago. As a result I no longer have text messages from around that time since I have to constantly make room on my phone. I've tried to find the information and back it up onto my phone but I don't seem to have the iMessages backed up. I am a 19 yo male and this relationship happened when me and my ex were both 17. We made sure to communicate with everything as to make sure no steps were crossed, but now I'm just very confused.

I know I did nothing wrong with everything but I'm just very lost and would like some advice as to what I should do.

    Posted: 30 Jan 2021 08:52 AM PST

So for some quick backstory, we were together for 4 years, engaged for the past year. When we started dating, she came with a cat, in 2018, she adopted a 2nd cat, and then last summer I adopted a cat of my own. My name is the only one on his adoption paperwork. My name is the only one on his vaccination records. I just need to know if I stand a chance taking her to court.

[Italy/California] Italian offered a job by a McDonald's in the U.S.; they want me to work for them behind the counter, why?

    Posted: 30 Jan 2021 09:49 AM PST

I'm an Italian working in IT support; I work in Milan.

32-year-old Italian woman living with my girlfriend in Milan.

On my LinkedIn, I had a message from a guy in Los Angeles who wanted me to work for McDonald's, saying he could get me a visa for working there behind the counter and he'd pay for everything and would eventually get me promoted.

I'm sure this is a scam, but he's insistent he wants to hire me on a H1B visa to work for McDonald's. He claims that there's a way McDonald's can hire Europeans like me (especially for behind the counter roles) and he said he'd send me a McDonald's blouse and skirt to my address; I stupidly gave him it via Linkedin.

Apparently the guy is on LinkedIn as a manager of a McDonald's in the Los Angeles area.

I don't know much about your visa system although I did briefly look into working in the US in 2017; I don't think McDonald's can do that can they?

Why would he want to hire me? He didn't elaborate, but I've also had a phone call from him at 8am in the morning asking about if he could get me to come when travel bans on Europeans visiting the USA ends.

He's really insistent about having me work at the McDonald's franchise he's the manager of.

If I was to take the job wouldn't he be breaking your immigration law?

I'm about to start researching anyway since I'd considered working in the US, then covid stopped everything.

If you can help me I'd be grateful.

Hospital system is acting sketchy. I sent an ROI months ago, but it seems they reeaalllyyy don't want anyone to see my records.

    Posted: 30 Jan 2021 11:48 AM PST

Hi. So my medical history is an absolute dumpster fire. To make a long story short, it started when I was diagnosed with leukemia at age 5. I was given what at the time was an experimental strain of chemo, and I had a lot of complications.

Though I have been in remission for 20 years now, I still deal with long-term health problems/disability from the chemo complications. Since my problems are the result of a lab experiment gone wrong, rather than being born with them, doctors have just been throwing treatments at me to see what sticks (and nothing has worked). We're talking dozens of medications, and even a specially tailored brain surgery. And since my original chemo treatment was experimental, my doctor's appointments are more like taking lab notes for said experiment than they are checking in on my quality of life.

As I've gotten older, I've been researching my past treatments and realized a lot of them have been... ethically questionable (one example being, about half of the meds I was given throughout elementary school are now listed as controlled narcotics "not recommended for children"). All of this has been done through the same hospital system.

Fast-forward to now. Thanks to the pandemic I've been out of work for several months. A few months ago I enrolled in a program to work with a job coach, and it's specifically for helping disabled people. As a formality, my job coach needed to see my medical records to confirm that I'm disabled. I submitted the ROI to my hospital in November, and they have yet to hand over my records to my job coach. I've called the hospital several times and their explanations keep getting weirder and weirder, ranging from "we never received your ROI," to claiming they sent my info in a method my job coach has never heard of (and he's previously worked with clients who were treated at this hospital system).

The longer this goes on, the more suspicious it gets. I've looked up malpractice laws in my state (KY), and I'm past the statute of limitations. So they shouldn't be worried about that. It makes me wonder what else they may be trying to hide.

If/When we finally get my full records, I want to have a lawyer look over it. Does anyone have advice of how to find a good medical/disability lawyer? I'd rather not just blindly trust Google with this. Or feel free to tell me I'm just being a conspiracy theorist.

Tldr: my doctors/hospital system has given me ethically questionable "treatments" for the past 20 years since I was a little kid. I'm currently in disability-related job program that needs to see my medical records. Hospital system is acting sketchy and keeps giving strange explanations as to why they won't let job program see my records (sent my ROI months ago). If/when I do get my records I want a lawyer to look over them to see what they may be hiding. Advice for finding a good lawyer for this in KY?

Drug Tested without consent in WA State during routine prenatal appointment - Legal?

    Posted: 29 Jan 2021 04:41 PM PST

I was drug tested without my consent (told I was getting routine blood panel). The test results were not given to me via MyChart, but I discovered through a bill that my insurance didn't cover. Routine drug testing isn't done during pregnancy with this health care system. I understand situations where it could be a medical necessity (e.g. unconscious) to best serve the patient. But, is this legal? To drug test a patient without their consent? It's been over 90 days and the health care system removed the charges but has declined to answer why consent was not requested or if it's legal. No drug history or use and I don't need to see the results to know it was negative for all substances.

Want to Quit Job Without Paying Back Training

    Posted: 30 Jan 2021 08:20 AM PST

    In SC, USA

Want to quit my job, but am concerned with repercussions.

My company paid for my training certificate & failed to have me sign their 2-Year contract for training expenses. I was unaware of the full terms of employment as the contract was never disclosed by management or referenced in the employee handbook.

New coworker informed me of his contract & said the terms stated if he quits in less than 2 years of employment, he will have to pay back the cost of his training (around $1500).

I'm certain the contract terms were around when I signed on, as I later confirmed with a seasoned coworker that he signed the same contract.

Is it better to wait out the whole 2 years or can I argue that I never signed the contract? Do I need legal consultation at this time?

Help… Nephews foster mom is trying to scam money from family. Advise wanted.

    Posted: 30 Jan 2021 08:49 AM PST

Help… Nephews foster mom is trying to scam money from family. Advise wanted.

Ok so some details are blurry so I'm sorry if some parts are confusing. My brother in law was incarcerated in Missouri and pasted away last this week. He wife past last month. Their adopted son is 22 years old and has some mental disabilities, lives in Missouri. He is capable of working and has a job, but also has a foster mom. He has been with her for a very short time. His father had serious medical issues going to prison and died shortly there after. My nephew had medical power of attorney. Durning this time my wife tried to call her nephew and talk to him and console him but this foster mom would not let her speak to my wife for four days. She also handled everything concerning interactions with the prison and hospital. She never listed any of the family with the prison or hospital so we could talk to him or get information. She has also blocked his aunt (adopted moms sister) from contacting on the phone and Facebook. Has also stated that she will be changing his phone number soon.

Now to the scam. Brother in laws body is at the corners office now. This lady called my wife and told her that the funeral home needed $900 by Tuesday for a down payment and the total cost would be $1800. She also stated that my nephew was the only person that would be able to submit the payments and they had to be made in person. So we should send the money to her and she would handle it.

My wife called the funeral home and found out that the down payment is $800 and the total is $1200. And we have until Thursday until his body is sent back to the state. And anyone can can make a payment over the phone. So in the grand scheme of life not a huge scam, but red flags all over place.

Update: Foster mom also told another family member the same story about the funeral home money.

Looks like foster mom may have had nephew sell his dads van. It was supposed to be in probate along with all the other property. She also told my wife that she has no extra money. She is the only one working in the house. She broke her elbow or arm and can't afford the cast. She also stated that she just bought a new Cricut vinyl cutting machine. Starting cost of that is $250.

We are afraid she is going to cut off communication with our nephew if we call her out on this.

So questions I have and please add information you think important.

How do I verify that she is a legitimate foster mom?

Is this something we can report? Currently it's only he said she said stuff.

How can the family maintain contact with my nephew?

    Legal help land contract!

    Posted: 30 Jan 2021 12:33 PM PST

I am posting this because it's Saturday and I need a game plan to what to do Monday morning. My wife and I entered into a land contract 6 years ago, the owners lied about a ton about the house. From what was done professionally, to even when they would be out. The electrical wasn't done professionally and the same for the plumbing (they included in the original real estate post they were new). They also said we would receive some of the furniture and lawn furnishings, which they came back and took. A long story short the owners have after 6 years contacted an investment firm and "sold" the house to them stating we are in default(even though they didn't inform us on being in default or that they were selling the house we now own equity in). I was informed by the owner of the firm that Monday they will acquire the property and are asking me to pay what I've paid for the house again. How is this possible? I have a contract, I haven't been informed of anything? They are literally trying to sell my house to someone stating I need to pay them or get out. What's my options? I live in Ohio. On Monday I was going to make a large payment of the $8,000 left I owe on the property. What's my options?

Planning on evicting a tenant who had taken upon themselves to do some renovations, any legal recourse to be aware of?

    Posted: 30 Jan 2021 12:23 PM PST

So full disclosure, the house is in my moms name. I plan on taking over and renovating much of the house within the year. Everything done at this point is mainly on account of my moms inaction.

So i live in NY, westchester. We have a house with an apartment add on that we have been renting to a guy since June. There are no contracts or any legal documents. My fiance and i plan on taking over the house, and thus doing renovations. Apparently the tenant has been doing work like replacing cabinets and other stuff (of which i am not fully aware of), and basically we will need to gut the apartment, so any work done we need to get rid of.

Now i don't know what was agreed upon, if anything, or if my mom just didn't want to get involved and let the guy do what he wants. But if we were to evict him within 7 months, what sort of legal recourse could be taken against my mom. I know this is a very tricky situation, but i just want to get some advice.

EDIT: so i was very reluctant to mention this, but it is key. The apartment is not legal to the town. All tenants we've rented to have had to been under the table. My plan is to make that apartment legal when I take over, but i need to do so in a way to avoid back taxes. It's a very tricky situation and unfortunately, since nothing has ever happened to my mom so far, she doesn't see an issue with it.
