    Thank you to everyone who replied to my original post. One or two responders brought up a great point, probate takes a long time. We brought this up with our probate attorney and asked if there was anyway we could contact the buyer telling them probating our fathers estate would take quite some time as a way to encourage them to drop out of buying the house. He told us the probate process could take upwards of six months and he would contact the buyers agent and let them know as much. The buyer was apparently not happy but they agreed to void the contract. Thank you all for the advice, even those who told us we were stuck losing the house.

    The house will remain in the family and be deeded to our younger brother Jimmy for his growing family. We were able to have a happy Thanksgiving together knowing this worry was off our shoulders.

    So I am new to this area, moved in late September. I have not met any of the neighbors, as I am trying to respect their safety with Covid, and honestly, I'm antisocial lol. There's these kids (3-4 of them depending on the day) around the ages of 10/11 a few houses down who are always out riding bikes and doing kid stuff. They've ding dong ditched me a couple times, ride in my yard/driveway daily, and attempt to block my vehicle with their bikes coming to and from my home, I guess as a joke. These aren't major issues for me, I just smile and wave as I am super easy going. Well, yesterday I had a very expensive plumbing job finished up with new concrete poured. Orange caution cones surrounding the repair and everything. Got home that evening and it looked great, was actually excited with how good they did. Woke up this morning to it not exactly ruined, but looks terrible. There's bike tire tracks zig zagging all through it, it was done right at the point the concrete was almost finished drying so it's not deep, just about a quarter inch of the surface is just destroyed. I do not have cameras, but I have a good idea who did it. I also know the parents of the culprits will not care. They enable the behavior by watching and laughing as their kids ride bikes towards moving vehicles. I'm honestly at a loss on this one, I was told not to approach the parent's home in case they claim I am trespassing. I planned to approach them in a very civil and respectful manner, but it's hard knowing they very likely will not care and could actually get me in trouble. I'm 22 years old, first time home owner, and grew up on a farm with no neighbors. This is all new to me, I'm considering just fixing it and crossing my fingers they don't do it again. My fiancé is much less calm about it, she views this as crossing the line, I am also leaning towards this being over the top. My end goal: fix this at my expense but prevent them from doing it again. So...any advice Reddit? Do I call the non emergency line, document it, and hope for the best?

    City sidewalk reconstructed a foot lower than it used to be and no longer level with home entry walkway (Houston, TX)

    They've been doing construction in front of my street for a while now, but recently they've torn out the sidewalk. They've repaved the sidewalk these last few days, but the issue is that it is a whole entire foot lower than it used to be (before, there was no change in incline). Is there anything that I can do? I live in Houston TX and found this municode for Houston, but I'm not familiar with construction terms so I don't know if I'm necessarily out of luck on this one.

    Edit: Included the notification in the gallery. Also, I've called 311 to submit a service request and gave them a WBS and description of the situation. I'm also planning on using u/aaronw22's advice and calling the project manager as well.

    Hi there

    Looking for some advice on how to move forward with my situation where my car was towed and auctioned off by condo property management without adequate notice while I was outside country for my father's medical emergency.

    I am leasing a unit in a condo complex with different owners for different units. Have a covered parking space assigned for my unit as part of the lease. The condo has a HOA and a property management. Landlord pays HOA and lives slightly far away. I had an old car maintained well and in great condition just enough for my needs. No parking tags needed to park in my spot. Landlord and I are in good terms for the last 7 years.

    I flew out due to my father's medical emergency 3 months ago braving travel restrictions and the pandemic. Dealt with various travel, medical expenses, stress and anxiety due to this. Before leaving, I once again gave my email id, phone number to my landlord for any communication. I also gave the keys to my unit and instructions to a friend who lives nearby if there was a need to enter the unit or access my car during my absence.

    Just few days before my return, my friend texted me that my car was not seen in the entire complex and there was another car parked in my spot. I emailed my landlord and also called the towing company (assigned to my complex). The towing company said they can't find my car on their records. Landlord replied that the property management did not tow or remember any towing authorization.

    After I returned, I called the towing company again and they confirmed my car was towed along with 3 other cars and a motorcycle from my complex on the same day about 2 months ago, and the towing was authorized by the property manager. The towing company retrieved last registered owner's physical mailing address and sent me a towing notice through USPS. I had scheduled vacation mail hold with USPS and my paper mails were held at the post office. Subsequently they sent me an auction notice and also auctioned off my car since they didn't receive a response from me. They also sent me an invoice later with additional amount for their towing and storage services not covered by the auction price, which I paid out of pocket.

    Talking to my friends, the department of licensing and researching online suggested I raise this with my landlord and not deal with the property management directly. So I shared my experience with my landlord and mentioned that I lost my car, bear additional towing company charges and potential future expense of few thousand dollars for a replacement car, for no fault of mine.

    My landlord said she talked to the property management and they insisted they can't do anything about it now that it's already past two months. They said they posted notices in the entire property for a pavement project and asked the cars to be moved out of the parking spaces. My landlord said she did not receive any form of communication from the property management – email or phone and so she couldn't relay any communication from the property management to me. She also did not touch on the topic of compensating my lost car value and the towing company expense instead offered to loan a car she isn't using.

    My question for you folks –

    1) Is my landlord responsible for compensating the 1) auction value of my car 2) towing company expense? What if she says she can't do it or similar response?

    2) Could I've done anything different that would've prevented this situation?

    3) Anything else I overlooked or missed?

    Last few years were very stressful for me personally following serious illness of my father and my brother, and managing medical emergencies. This incident just increased my stress level. During this extraordinary Covid times, shouldn't the property management take extra care and diligence in making sure the residents get maintenance notices through all channels possible - phone, email, and not just sticking a notice on the front door assuming there is someone always present?

    Boss wants me on call after he laid me off

    First off I live in Michigan. Now, when I was first hired in my boss told me we get laid off for the winter because we can't do the work we normally do during the winter. But, towards the end of the year he asked me to shovel snow/salt during the winter for him even after I was laid off and collecting unemployment. He has contracts with businesses around our city to plow, shovel and salt for them. He was of course going to pay me for hours worked but he said that if I don't do it for him he would tell unemployment that I wasn't accepting work. My problem is that there is no schedule and he wants me to go in whenever asked, sometimes within a one hour notice at 3am. Then he just told me yesterday he had a job offer, just a small project to do for one maybe two days and expects me to come in, if I say no. He might tell unemployment. He is also pooling our hours until we get 40 then paying us once we get 40. Whether it takes 1 week to 2 months. I don't think it's right he expects me to come in whenever asked once he laid me off, is any of this even legal? Am I supposed to go in for the work? I don't feel like it's considered adequate work.

    (Illinois) Terminated due to "performance" prior to EOY bonus payout. All of my recorded performance discussions have been positive.

    I am in Illinois and have accepted an offer from a competing company in my industry. My background check and employment check have just come back all clear and today I received a termination notification, effective immediately due to "performance".

    All of my performance reviews have been positive. Additionally they are recorded and stored. I have personal copies of these reports as well. I believe I was terminated prior to end of year bonuses because my employer found out I had accepted a job offer at a competitor.

    In my offer letter a 10% bonus was part of my compensation and now I am being told that in order to receive the bonus I need to be an employee of the company "at the time of the bonus payout" which is later this month.

    I think it would be very difficult for my job to prove the cause was for performance when all of my reviews and documented discussions have been positive.

    I think my marriage might be void

    My husband called the courthouse that processed his divorce from his ex in order to obtain a copy of his custody agreement.

    The lady he spoke to told him that his case had been dismissed and she mentioned that it seemed as though they were missing a financial form.

    He and his ex had been separated since 2013. The divorce was supposed to have been finalized in 2016. He moved away during that summer and failed to give the court his forwarding address. However, there was an order to reappear that the court says they mailed out, but we never received it.

    When we looked up his case number, it states that the case was dismissed. We have all the paperwork and they went before a judge and the paperwork is even stamped filed. We got married in 2018, and from what I have read, it appears that our marriage is invalid.

    What is our best bet? Should we file a motion to reopen the case and have the divorce granted retroactively? Is that even possible? Neither of them live in that area anymore and I'm not sure who is at fault here: them or the court, so I don't know if nunc pro tunc could apply in this situation.

    Should he refile for divorce in the area that we live in now? The child from their marriage lives with us (and has for over 6 months) so our area has custody jurisdiction. Currently his relationship with his ex is amicable, so I think she will be cooperative.

    Do I have to annul my marriage and then get remarried to him? I want to remain married to my husband. He has been truthful and forthcoming about the situation and is, by all accounts, a great husband. All parties were under the impression that the divorce was final, though there are circumstantial things that make me wonder if his ex knew that it had not been finalized. I am so crushed. It would be really helpful if someone could give me advice based on this situation.

    Update to add location: we live in the US. State of MN. Separation was filed in 2013 in MN. Divorce was filed in WI. Ex now lives in AR.

    Private school administrator in CA searches students backpacks w/o permission if they forget their hw. Now confiscating phones and searching text messages.

    I'm a first year teacher at a private school in California. Today my students were pretty freaked out because there was a bullying incident reported by a parent that occured via group text message outside of school hours. The administrator (and school co-owner) took a student's phone and searched his texts and has threatened to continue with other students' phones.

    During this, it was revealed that he also searches backpacks when students say they forgot their hw or binder.

    I know it's illegal to search their phones but legal to confiscate them. I'm appalled that the administrator (and owner) is doing this. What can I do?

    Ex says he can take our kid and be out of state in less then two hours....

    I live in Florida. I've been with the father of my son for 6 years now (almost 7). We've fought to the point of about to break up before (pretty much always my fault according to him) and he easily admits he's emotionally abusive to me because he wants to fix me. Last night he told me he spoke to an attorney and can take our son from me and out of the state in 2 hours flat and there's nothing I can do about this. I haven't worked in 5 years because the one time I did have a job he called during every one of my shifts and told me if I dont get home immediately he would leave our infant son at home and take off possibly to never come back. After that any job I tried to find either wasnt good enough, the hours didn't work or him telling me he'd find me a job he was okay with me doing but never did so. Hence I have no money for an attorney and my family doesn't have the money to help me either.

    I'm terrified because he once told me that if he leaves me he will take our boy and put him up for adoption. Can he do that? Can he even take him? Any advice would be welcome.

    As an aside the reason he is so angry with me is the other night we were having sex for damn near two hours and I started falling asleep before he could come (and after he drank a whole bottle of whiskey).

    [NJ] Employer clocking employees because labor is high

    The workplace is in NJ. When my boyfriend got to work this morning he worked for a bit but they were slow (garage job) so his boss required all employees to clock out until they get another car. He is not letting them go home. The boss eventually clocked him back in because he complained enough but what he was doing is highly illegal right? I'm assuming he only did it because he doesn't expect the employees to know any better.

    Also, they do not get paid for overtime. Apparently the boss is giving them an hour of PTO for every hour of OT worked.

    We're looking for another job in the meantime because this place is being so sketchy. I'd just like confirmation that this is definitely illegal right? I'm not sure what to do here besides look for a different job and leave that shady place behind.

    Can a landlord force you to leave the house during a Cleaning Inspection

    Hello! i'm from Maryland i've tried searching this on my own and i've posted on a lawyer q&a site about it and haven't gotten any answers yet, anywho my landlord is trying to sell the property and theres a couple who is interested in it and keeping the tenants in the house.

    Monday my landlord stopped by and told me that possibly Dec 5th but definitely Dec 12th those people might be stopping by the house to do a cleaning inspection. She wrote down that all of the tenants must be out of the house for it, i didn't think anything of it this is my first time renting anywhere my boyfriend however said it was extremely sketchy and wants to know the legality of it

    Girlfriend left But without her Daugther

    in 2010 I met my Girlfriend, she had a 2 years old daughter at the time. 8 months ago she left suddenly and since then I've been taking care of her daughter.

    the situation is that my GF has a History of drug abuse but got clean when she discovered she was pregnant. The father is completely unknown, ma GF's Father died a long time ago, her mother is in a care facility with terminal cancer and there are no siblings.

    2 years ago she had a relapse and started taking drugs again, I tried helping her get treatment and rehab but it ended in the situation that 8 months ago when I was at work and the daughter in school she packed her bags and just left.

    Now I do not want to send the daughter to foster care or give her up at all. I've raised her together with her mother since she was 2 and consider her my daughter as well. But I am not her legal guardian. I have power of attorney in case of a medical emergency because we set that up for school when she was 6 years old.

    This is not a missing person's case we know she is somewhere and alive but neither we nor anyone else can get in contact with her.

    How do I get Guardianship over the daughter, we are both worried (me and the kid) that if we contact the wrong person she will just immediately get removed.

    We are currently getting by on the fact that no one has asked if I am the guardian.

    My question is who do I contact, what kind of layer will I need, or generally if there is even a chance of making that happen with the mother being unavailable and probably on drugs somewhere? How do I get started on this?

    I do not want her to leave and she does not want to leave either.

    Someone abandoned a vehicle on my property, it’s been here a of couple years, I just found the keys and it runs. Is there a way to put a lien on it and get it in my name? The owner doesn’t want anything to do with it and is very hard to get ahold of. (California, USA)

    Also I think there's a bunch of fines attached to the car for skipping tolls in San Francisco, do those follow the vehicle after a salvage title or whatever the car would have after getting it in my name? The owner said something before he left about having to pay the DMV over a thousand dollars to register it because of these fines for not paying the tolls. Any help would be appreciated, I wanted this thing gone but if it runs I might as well use it.

    [CA] Tenant is refusing to move out and is threatening to call lawyers.

    I am currently the landlord for a house in a college town. I have a group of students who have verbally committed to renting the entire house I have for July 2021-July 2022. The current tenants have not told me (despite being asked several times) if they plan to renew their lease for next year. After not getting an answer after 2 weeks, I told the group of students that they could live at the house. I liked this because I would not have to advertise for the house anymore and a lot of stress would be lifted. I had not created leases for them, but I was in the process of doing that.

    But today, one of the current tenants has decided they want to renew their lease and I told them I had already leased the whole property. They told me that I could not kick them out due to the pandemic. He also said his father was a lawyer and has called him and informed him of the situation. I have offered to move him into a room in a nearby property that is about $50 cheaper per month, but he refuses to move.

    The lease ends in June so I am giving him over 6 months of notice. What is his legal standing?

    Im coming to the final hearing of a child arrangement order and the courts have requested the fallowing

    "the parties must by 4.00 pm on the //** send to each other, to the court and CAFFCASS written statements of evidence on which they intend to rely on, this includes the statements of the parties themselves and of any witness they intend to rely on.

    When preparing there statements the parties shall use the witness statement template which shall be provided to then by the court"

    What do they mean by 'written statements of evidence' and ' statements of the parties themselves' ?

    Also any website I cann look into would be gratefully appreciated!

    Just to note I've tryed to get a solicitor but can't get any so I'm representing myself

    Landlord company is telling me about neighbor complaints about smoke [PA]

    I live in a 2 br apartment with my cousin and his girlfriend. The lease is solely in my name. In the lease, smoking inside or within 20 ft of the building is prohibited with penalties of a fine and/or eviction.

    My cousin and his girlfriend smoke. I do not. I told them when moving in that they cannot smoke inside and they have agreed. Neither smoke inside. However, both smoke over a pack a day and you can really smell when they come back in.

    Neighbor posted a note in our mail room calling out "the apartment at the end of the hall" for the smell of smoke. Today (a week later) I got a call from the landlord company saying they got multiple complaints. At absolute worst, my cousin and his girlfriend may not always get 20 ft away from the building, but they never smoke inside and never have. I could tell the woman from the rental office did not believe me.

    I'm sure you all know cigarette smoke clings to people. They aren't breaking rules but they still reek of smoke which is creating a problem with the neighbors and realtor. I'm just worried about getting evicted and losing the remainder of the rent i paid (prepaid a year in August).

    What can I do in this situation to protect ourselves?

    Forced a child patient to wear a mask, now being threatened with lawsuit (Ontario)

    this occurred in a health clinic, I'm aware you are allowed to refuse business if someone won't wear a mask but I had a child patient i was working with and they came in without a mask and they wouldn't put it on so I told them they had to or they would get in trouble. Eventually they wore it but were visibly upset about it. After the child left the room his parent saw him wearing the mask and went ballistic, screaming about lawsuits and child abuse. They posted on facebook about my business saying that I wronged his kid and that his kid is traumatized and will be needing therapy. In my opinion, that's not true at all, obviously.

    It just happened so nothing is official yet, but did I do anything wrong legally?

    Dad’s job trying to fire him in underhanded way/age discrimination

    So my dad is 2 or 3 years away from being able to claim retirement at his job. There is a history at his work of pushing people out before they can claim the full amount. In dad's case they keep giving him bad reviews, have put him on probation and may fire him today after another "bad review". However, before the last few months he only got good reviews and has brought a lot to the company after working there for decades. If they fire him they can hire someone new at a quarter of his salary, so it's obvious why they keep doing this. What can he do to either prevent his firing or fight back if they do fire him, hiding behind these bs "reviews"?

    Receiving calls that I need to be "located"

    I have gotten voicemails two days in a row from someone saying that a lawsuit is going to filed against me in my county and gave me a case number. I called the local court and they said the case number they gave me is not valid.

    In the first voicemail they tell me to call an 833 number and reference this case and I need to speak with them before the case is filed. That case number happens to include a portion of my phone and SS number.

    In the second voicemail he seems more threatening. He said he has exhausted his attempts to contact me and my case would be processed immediately. Told me he that I would be located at my place of work and they would need to speak to my supervisor when they arrive.

    Is there any legitimacy to something like this? I am assuming its a scam. They had some personal information about me in the voicemail they left.

    Refusing to Accep Out of State EBT

    The store I work at accepts EBT. We have a lot of out of state people come in and use cards from other states. Last night a customer came in and used their cash benefit. South Dakota as a state only has one type of EBT and that's food benefit.

    My boss told me not to ever hit the cash benefit button again because we cannot accept it and to refuse people that try using the cash benefit as we can ONLY accept food benefit.

    This does not sound right to me. He also repeatedly negatively talked about EBT customers and how they cause problems.

    I guess is it legal to deny cash benefits but not food benefits?

    I got a Cease and Desist for selling a security screwdriver bit on Amazon do I need to stop?

    I sell a security bit that is basically an allen wrench with a metal dot in the middle so a regular allen wrench doesn't work. A company that uses these security allen screws gave me a Cease and Desist threatening to sue if I don't stop selling. The particular size I sell is the same that they use on their city bicycles and theoretically someone could steal their bikes with my screwdriver bit. I only make a few bucks on them and would like to keep it going but don't want to get sued either!

    Trademark Infringement on an open source project

    Location: Nebraska but state is irrelevant.

    Using a throwaway as the upstream company hosting the source code is belligerent on my other posts.

    I am working with an open source project hosted by a company. I forked the repo to make my own changes to the code to fit my needs. The changes I have made to the code have angered the company with the upstream repo, and are threatening to sue me for using the name of the source repo because my changes don't align with what they have in mind for the project.

    The project is licensed under an MIT license in GitHub. The name of it has a trademark. They also will only do this to people who differ from their ideals of what the project should be for.

    Should I remove all references to the project name in my repo? Another note to mention is they only do this when you change something or do something they don't like. They are fine with other people using their trademarked name, so long as it fits their ideas.

    AT&T holding unfair $1,000+ over me over erroneous duplicate account and locking me from making big changes to my account. Should I pay or take legal action? Would appreciate any insight.

    I opened up an AT&T account in January of 2016 at a best buy mobile store. I chose some phones for me and my family and went through the process of starting my account. I was at a best buy mobile at a local mall. Unfortunately, the computers turned off because I was there towards the end of the day and the computers automatically turn off. Instead of trying to wait until they reboot which would take time and the employees needing to go home, they asked me to come back the next day. So I did. I came back the next day, picked up my 4 phones, for myself and family members and went home.

    3-4 months later, I receive a phone call from a debt collector, requesting I pay over $1,000 for an overdue account for AT&T. I think this is fraud because of all the scams out there, and knowing that i'm up to date on my payments. I ignored it. I get another call later. I get mad at the representative over the phone and call him a fraud. He sounds sincere and I find out this may actually be a real thing. He gives me more information. I call AT&T, give them new info i've found out, and find out that there's an account in my name with $1,185 owed to it for new phones that were taken and new account opened. Apparently, when I opened up my account the first day, they had activated some phones. And now they were charging me for them. Now, I never received these phones. These were phones that stayed at the Best Buy and I had no idea what happened to them. I didn't even think about them for a second.. Until months later and i'm addressing this issue. According to the computer, I picked up those phones and never returned them, therefore, I owe $1,185 to AT&T for them.

    Over the last 4 years, I've called AT&T 20+times and have maybe logged 50-100 hours on the phone trying to resolve this issue. They've transferred me to so many different departments: customer service, loyalty, accounts, fraud.. And then back to the collections agency, no one able to make any meaningful changes to my status. I have been told multiple times over the phone verbally that it was an error and my account will be cleared. I have also had an email sent to me stating that this was an error and that the charges will be removed from my account. But every time I've taken their word for this, I would receive a call from the collections department weeks later asking me for the money and then I'd have to go back to calling AT&T to explain the situation. Every time I call, they initially have no idea of the situation and I exhaustingly rehash the events. The rep understands, and the proceeds to tell me they can't do anything and transfers me to another apartment. I've put in cases with AT&T for dispute and decisions were always made without my input. When I call to ask about the case, they would tell me it was rejected because the phones were never returned. But I NEVER EVEN PICKED UP THE PHONES. I don't understand why they are putting the burden of proof on me. A little bit of background about me, I was a medical student deep into studying for a huge exam when this whole ordeal started 4+ years ago. I put in hours of precious time to spend on the phone to solve the issue without any resolution. I have no interest and the risk/benefit is ridiculous for me to try to steal phones. This past summer, I was offered to clear the charges on my account by the collections agency for $400. I refused on principle, stating that this was not something that was fair or that I owed, and I expected to be cleared from all charges.

    Because of this hanging over my account, I've been unable to start new lines on my phone account. Great deals have come by to get my family members and I great discounts, but I've been unable to do anything due to this issue hangin over my account. I'm tied to a couple contracts for family members who have lines. And my family plan is locked in for an unlimited internet plan that I would rather not lose.

    I have a few questions:

    1. Should I just cut my losses and pay the $400+ collection settlement and move on? Is this worth fighting?
    2. Is this something I can take AT&T to court for? If so, how? What would I have to gain from doing that? Just clear my account? Compensation for my time and emotional distress over this?

    Would appreciate any insight. Thank you.
