[NYC] Mother's Grave is Occupied... Posted: 01 Dec 2020 06:47 AM PST On Sunday, my mother and brother visited my mother's parents graves in a Brooklyn Cemetery. Next to those graves is a third plot that my mother purchased for herself in the mid 1960's. Upon arrival, they discovered that someone had been buried in my mother's plot. The plot was apparently re-sold in 1998 by the son of the Rabbi who sold the plot to my Mother. Based on the information I received, he had a copy of the deed. I will add more info as I receive it from my mother. edit: She has 3 deeds with original cemetery permits dated December 31, 1962. A second deed for the last plot (hers) was issued by the same society/congregation in July of 1998. In 2020, when whoever was buried there died, the cemetery tried reaching out to congregation for internment, but the phone number was disconnected. The other family then brought their 1998 deed to the cemetery and was granted the plot. I have no experience with this sort of matter, so any advice on getting this sorted out would be greatly appreciated. At the time they estimated they would get to us in early September, but couldn't give a specific date as this time of year their schedule is weather-dependent. They contacted us several times saying they were behind and that they were thinking 2 more weeks, etc., several times. Since they were continuing to push the install date out further and I wanted the new fence sooner rather than later, I ended up just canceling and forfeiting my deposit. I spoke to them on the phone and then sent a follow-up email. A week later I received a check in the mail for my deposit and a note apologizing for the scheduling delays, so it seemed clear that they had handled the cancelation. Meanwhile, I bought materials and beer/pizza for my brother, and we did the labor ourselves, bam, new fence with no delay. Last week I came home from work and found another new fence in my yard. it turns out that the company I had originally scheduled with was owned by a man who wanted to retire, and someone bought his business. When the new owners were given access to the computer scheduling system at the start of the transition process, they printed out the schedule as-is and worked off the paper copies. The old owners continued to update the computer records (like canceling for me) until the sale of the business was finalized, but the new company never looked at the computer system again.. so they brought a crew out, removed old fence and installed new fence, like the initial order stated. The new company was initially apologetic. They have offered my choice of two solutions: (1) Get a discount of 20%, pay for the fence, and keep it or (2) They will come remove the fence and re-use the materials on another job. My issue with (1) Is that I just PAID for a brand new fence already that my brother and I had just installed and they removed and for (2) that will leave me with no fence at all. I have been going back and forth with the owner for a while and at this point he doesn't want to budge. He told me last night to let him know if I want (1) or (2) by Friday and he hasn't responded to me since. Looking for advice on what to do now. Specifically it's a top of the line gaming laptop that retails for over $2000. It was listed for $375 and I assumed it was a scam but I contacted the seller anyway. I asked them to verify the price and the specs, which they did. I said "are you sure because that price is insane" and he said he was selling his 15-year-old son's laptop as punishment. We met at the local police station trading area and I paid cash, and he gave me the laptop. This was in early October. It was in like-new condition and all the specs matched, nothing wrong with it at all. It was barely used. Starting about two weeks ago the seller began reaching out to me asking for the laptop back. At first he demanded it back without a refund and accused me of committing fraud against a minor. I told him no, I bought it from him. Then he said he gave me the wrong specs (he didn't) so that invalidated the deal. I told him the specs were right and told him to stop bothering me. Then he sent ANOTHER message telling me that I "should of" known it was mispriced and he's entitled to take it back without a refund, but he'll be nice and give me money back. I again told him to never contact me again. Today he emailed me a photo of this form filled out demanding $12,500 for the laptop, "aliention from MINOR (sic) child", legal costs, and "pain / suffering". I told him in no uncertain terms that he could go fuck himself and to never contact me again. Well evidently he got ahold of my phone number somehow and my phone has been ringing constantly all day from blocked and spoofed numbers. Apparently I've called myself a dozen times already today. Posted: 01 Dec 2020 03:16 AM PST This is in California. I filled a wage claim way back in May because I had not been paid for 2 months, and after confronting my boss about that, was laid off. I filed a wage claim, and was told by most people that the company (a private language school) would most likely dissolve and I would never see any of the money. I had my initial hearing in September for the claim and my employer didn't even show up. The person handling my claim was very friendly and helpful, although at the time, she was having trouble getting a hold of my employer. Well, about a month or two ago I found out that the school did NOT dissolve and is in fact holding classes again. I have been trying to contact my wage claim case handler but they have not been responding to any emails or texts I have sent. I even tried to make it clear to her that even if she has no news, I would just like to know that the process is still moving forward. I also want to see if she was able to get in touch with my employer, and if not, help do that. Any advice on how to help this process move forward, or at least get an update? We were aware of a large phone/internet providers employees coming and going along the other side of our fence as both of the phone/internet companies around here have boxes there. They apparently dug a giant hole behind the fence and left it there for months. It filed with water during the tropical storm so the ground became soft and took 2 parts of the fence down with it. We called our internet company and they informed us it was the other companies box. Which the other company agreed to. However, rather than coming out to evaluate the problem, they filled the hole and removed the posts they put up as it to pretend it never happened. Now they're claiming it's not their responsibility. Before I start I would like to mention a couple of things. I live in St. Simon's Island, GA. I live 8 hours away from him. I have ADHD and Autism. He set up an account for my sister (18) where either my sister or himself could withdraw money from the account. There is a note on the account that states he must be present for changes to the account to be made. I do not have a good relationship with him. The accounts were set up at Regions bank in Florida when both me and my sister were minors. The money from the account would be going into an Able United account in my name that was created when I was 18 by my mother. I did everything he wanted me to, but when I told him I did he acted like he had never told me to do it. He thinks that someone in my family is putting me up to this or that I just want to spend the money on a video game. Is there any way that I can get the money without him being there? The past few days, I have been getting daily calls from a process server from a Restricted number. The first day, he left a voicemail giving me the information: that this message was intended for the "property owner of [my address]", the he was looking for my mother's name (said incorrectly), and he gave me a number to call back and a "case number". Edit: also, small note, I own my house. It had been converted into apartments, but my wife and I converted it back into a single-family home (practically and legally). The address he gave was for one of the old apartments (which is just my address with a number on the end, so it is technically the "same", but legally I think that's important). Also when he gave the address, he only listed the street name. He did not mention city, state, or zip code. Important note, I don't talk to my mom. She had some drug issues some years ago and we don't have a relationship anymore. We haven't talked in 5+ years. First thing I did was google the number, and I didn't find anything conclusive. No offices, nothing like that. Hesitant, I called the number back. When I said I was calling back with a case number for someone who wasn't me, I was put on hold for a couple of minutes. Then the guy who originally called me picked up. I told him that the person he was looking for did not live at this address, never has, and in fact I live in a completely different city and county than the person he is looking for. He said I was contacted since I was "next of kin according to the state department" and they need me to tell her to contact them so she can be served. I tell him that isn't possible, she isn't in my life and I don't know how to reach her. Guy gets a little snippy with me and says, "my father lives in Spain and if I needed to get him a message I could find a way." Pretty flabbergasted, I told him I think there's a cousin that follows me on Instagram, so I could try to message them to contact her. But who knows how it'll go. And I ended the call. I looked up online information about process server scams but I'm still unsure. I also...don't really care what happens, except the past two days he's called back and left a message again, saying exactly what he said in the first. Today's message, though, he added that they would be serving the papers at my address with or without my consent. So I suppose my question is, what's the over/under on this being a scam, and are there ways I can find out more concretely? If it is likely real, would it even be legal for them to serve papers to my house for someone who is technically a family member but doesn't live anywhere near this county, let alone address, that I am no contact with? The first time he used a loophole because their pizza franchise switched ownership. The second one was sent on Sept. 28 and I just got a notification that the Dept. of Revenue has sent a letter to them again asking why they're not receiving garnished wages. I meant to carry exactly $10,000, however there was $720 in my wallet which I was supposed to deposit to bank before departing. I received US Customs & Border Protection Cafra Seized Asset Claim Form, and I plan to go for Petition to get the money back. Little fortunately, it's little easier for me to prove that the money came from a legal source; I got my car totaled from an accident happened on October this year at the fault of other driver, and I was compensated the residual value of the car, and sent it to my bank account, which I withdrew the money from. I'm still outside the states, and will stay here indefinitely. Would it be strongly recommended to hire attorney for petitioning, especially that I am not in the states now? Or would I still have some strong chance against filing it online myself? While I didn't want to pay $75 a month for 50mbps internet (plus a surprise $100 fee for the installation of a satellite dish... That was already there?), I forked it over and said goodbye to online gaming. However, the past few months have proven that the service is almost entirely unusable. I can't upload a single photo from the Wi-Fi, I can't download anything over a few MBs because it times out. Couldn't even install the "DVD player" app on my Xbox past 1%. I can barely check my email. I can't even download something to my phone and stream it to the Chromecast because it works on wifi as well, even though the show has already been downloaded. Unfortunately, cancellation of the service is apparently $400 for the first 90 days, less $15 for each month after. This is month 5, so I'm sitting at $370 to cancel a service that doesn't work at all. Not even moving to a different house would void the contract, in fact they would just charge me more to transfer the equipment over. Unfortunately, due to a divorce, a move, a car wreck, and my dog being diagnosed with terminal cancer a few weeks ago (and needing emergent surgery), my funds are short. I can't really afford to keep paying for a service that I can't even use, and I can't afford the cancellation fee. Is there any way that I can avoid this fee? Deputy entered my home with no one home/inside after earlier issuing me a speeding ticket Posted: 01 Dec 2020 11:01 AM PST State of Minnesota: Context: I was pulled over for an egregious speeding ticket (87 in a 55) on the rural country road that I live on. I was with my 70 yr old dad on our way to pick up our Christmas tree. I didn't have a reason to be going that fast and certainly my fault for speeding. I was issued a speeding ticket by the jr deputy sheriff, my first violation ever. 3-4 hours later: We brought the tree home, same truck/vehicle was sitting in the driveway. Our front door was unlocked. We do not have a doorbell but we have a note in the window at the front door to please call myself, my dad, or my brothers cell phones if we do not answer. My dad and I live on a farm and we were both working separately around the property away from the house and completely out of view and out of earshot. The deputy apparently made a mistake in issuing my ticket because he did not check the "endangering life or property" box. So he came to my house to issue me a different ticket with that box checked. Of course neither my dad or I were around the house to see what effort he made to knock or see if anyone was inside our house. We do not have any blinds or window coverings so it's extremely easy to look inside to see if anyone is home. I had a missed call from a blocked number on my cell phone, which clearly now I see was the officer. He did not call my dad or brother who are also listed on the note to call if there is no answer. My dad was in the backyard and walked up to the house to see the officer coming out of our kitchen and into our breezeway/four season porch (still in the home, all windows room that connects our garage). This means he would have had to open and enter two different doorways without knocking or anyone greeting him. We do not know how long he was in our home or what he might have looked at/touched. The officer then came outside to explain that he needed to issue me a different ticket. My dad led him out back behind our barns where I was working and the officer explained how he made a mistake and needed to issue me a different ticket with said box checked due to my speed. He told me to shred or discard the original ticket he gave me. He said how he typically will try to let folks off but in this case his hands were tied. Just the same as when he originally pulled me over, I did not argue with him or try to give false excuses. I simply took the new ticket. Additional context: The officer was not wearing a mask. My dad is especially at risk for covid-19 and we did not have thanksgiving with family because of our governors orders to stay at home. He did not have a mask on when he approached me to issue the ticket nor when he was speaking with my dad. We have since spoken with another sr deputy on the department who we are close with who is speaking to their captain about the situation and will be getting back to us. He is being denied a public defender. The reason stated was that he has too many bank accounts and credit cards. The bank accounts have very little money and the credit cards have max limit of $500 or less and most are maxed. The question is: how can they deny a PD? Posted: 01 Dec 2020 12:28 PM PST TL;DR: at the bottom I got COBRA coverage a few months ago because I changed employers, I talked with the company who was handling it, sent the initial payment, and got the insurance instated with coverage backdated (so I would submit a form to be reimbursed for my medications). I've now had insurance for a bit. On the 17th of last month (Nov 17th) I realized I hadn't paid my premium. It wasn't letting me pay it online so I called them. They said I needed to send in a money order since the date to pay has passed. I sent one in the next day. They confirmed that if I did that, my account would not be cancelled. So I sent one on the 19th. Today I'm supposed to pick up my medication and they said that the insurance was showing as terminated. I tried to log in and it said my insurance was cancelled. I called in, got in touch with someone, and they left me on hold for an hour. So I hung up and called back and got someone who was very helpful. They said that it looked like my insurance was actually cancelled on Sept 30th for failure to pay my initial payment. But she also said that it doesn't make any sense because it shows that I did make that initial payment. It also doesn't make sense to me because I talked to someone about two weeks ago about this and they didn't bring up anything about an initial payment or that my account was cancelled. I've been using it successfully since. Another worry of mine is that since Sept 30th, I've had many doctor appointments, a procedure, and picked up a lot of medication. If they backdated the cancellation to Sept 30th then I would owe thousands of dollars. She said she could open a case and suggested that I send in a letter requesting to get it reinstated. She said that the letter is usually for incidents where accounts are in a suspended state - but mine was just outright cancelled, but that the letter still might be helpful ("If it were me personally I would send it"). I'm hesitant to send any letter since this all sounds very wrong. I did get a recording of that conversation just in case I need it in the future. On top of this the DOL and IRS jointly gave a notice on COBRA coverage (if I'm understanding correctly) stating that deadlines for initial payments (usually 45 days) and deadlines for followup monthly premium payments (usually 30 days) are all extended until 60 days after the "Outbreak Period", which means while there is a National Emergency related to the Covid Pandemic. I asked on the phone and they confirmed that they were still cancelling accounts due to non-payment through the outbreak period, but that their process changed so that people would get a notice first. Normally I would purchase the medication out of pocket and wait until it is sorted but I actually don't have enough money to do that. Not only that but I'll soon be running out of some of my other very important yet very expensive medications. I imagine I could have some legal leverage here considering they shouldn't have closed my account, but right now I'm not worried about anything more than getting my medications as quickly as possible and I know legal processes can take a while. What should I do here? Should I send the letter requesting for it to be reinstated and wait patiently for them to respond, or is there something else I could do to speed the process up? He says I have to be out of my apartment by the 30th. He claims my tenancy is month to month but I thought because my lease had a start and end date that it was fixed term. Doctors office withholding blood work results Posted: 01 Dec 2020 12:34 PM PST I received a diagnosis from the emergency room for rhabdomyolosis on 10/9. I was treated and felt back to normal up until two weeks ago when my symptoms returned. I went to my primary care physicians office to have blood work and a urinalysis done to check if my condition had returned. This was on 11/19. I have not received results from my blood work or urinalysis. I have called dozens of times and they simply say "the results have not been signed off on yet" and tell me to wait. If you are unfamiliar with my diagnosis, rhabdomyolosis it is an emergency and if my blood work confirms that I have a recurrence I will need to be admitted for fluids and kidney damage prevention. The fact that I have waited nearly two weeks and still have no results to confirm if I am having a recurrence is potentially causing me to wait blindly while my kidney and liver are damaged. What do I do? I can't keep calling the doctors office and getting told to "keep waiting" but when I ask for my medical records and results they deny my request stating that the tests aren't signed off on so they can't release them. The store is frequently the target of robbery, theft and occasional violence. Employee's have been attacked and robbed, product is stolen on the regular and even with camera's and endless police reports, there is no security, there are no police posted. Just recently The store she works at was hit, her employees were attacked, she had her phone stolen off her person. That same day a group matching the description of these attackers was reported having robbed two women at gunpoint in the parking lot of this same shopping plaza. The company has done nothing to address the problem. The property manager has done nothing to address the problem. Is there any legal recourse for her and her employees? As a group they are becoming traumatized by the constant threats, people are developing pstd like symptoms and in a state of panic and fear all day WORKING AT A FUCKING SHOE STORE. This doesn't seem like it should be passed off as normal, and no retail employee should have to consider the possiblity of being shot over a pair of shoes day to day. I filed a copyright infringement on the item, and just received notice from Etsy legal that they filed a counter claim! Their counter essentially says that they are willing to go to court over this. Here's the tricky part; I am based in the US and they are in the UK. Has anyone dealt with this before? It's not a huge selling design for me, however I feel like the principal of the matter (plus, all of the evidence I can provide showing it's my original design) is important to pursue but should I really hire a lawyer to defend something that's brought in under $100 in profit? We finalized doing business with a legal firm in 2018. We paid upfront every time they requested another quantity of money from us for the next step in working with them. Now almost 3 years later they emailed us stating we owe several thousand dollars they forgot to charge. They did not even itemize the bill. We are requesting an itemized bill, all invoices, receipts, etc, and if any late fees were added. We are waiting to hear back. We are extremely upset about this notice. We did not have a great experience with the firm and this is another example of it. What is the best way to proceed? [link] [comments] |
