Legal Advice My doctor made me deaf

    My doctor made me deaf

    Posted: 28 Dec 2020 03:51 AM PST

Please please read, I really need help! Hi, I am a 22 (f) this occurred when I was 21. I live in NSW Australia.

Last year in April I woke up one morning with complete profound deafness and loud ringing in my right ear and terrible vertigo and nausea. After vomiting the entire day I went to a doctor the next morning where I informed the doctor of my deafness. She checked my ear for an ear infection and found nothing. She told me that I had a virus, gave me an injection for the nausea and told me to "wait out the virus and my hearing will come back."

When I continued vomiting (couldn't even move my eyes without the room spinning) for the next 3 days, I went to my regular doctor (didn't originally go to her as she was previously unavailable). In the room with me was my house mate and her mum. I told her of my deafness and my vertigo. She told me I had benign vertigo disorder and again I was told that my deafness was a symptom of this virus (one they couldn't give me a name for) and that I needed to wait it out and my hearing will come back.

Because o thought that my hearing would come back, I continued to wait. I ended up going to her 3 more times within the next 2 months, all in which I made her aware of my ear and all she told me to wait it out. On the final appointment with her, she told me that I had a wax build up in that ear and hesitantly gave me a referral to an ENT where he would 'clean my ear out and I would be able to hear again'.

She never told me this appointment was an emergency, therefore when I made an appointment and one was only available on August, I did not tell the receptionist that i needed it sooner.

When I finally got to my ent appointment in August, he gave me an examination and a hearing test where he told me I had nerve damage in the ear and was profoundly deaf. He told me that I was supposed to be referred to him within the first 15 days of deafness so that they could immediately put me on steroids in hopes to bring any hearing back. But since it was so long I only had a 10% chance now of it returning. Which it didn't.

I was in complete shock as I was lead to believe that he would clean my ear out and then I could hear again. And I was also told to 'wait it out' all this time when in fact I had a 15 day window to get this medicated.

Due to this, I made a medical malpractice complaint. To summarise quickly, the response from that was that my doctor had not written any of my hearing loss in my medical records and claimed that I never came to her for hearing loss so I should drop it. They told me to drop it at it was simply 'he said she said'.

I then got my friend and her mom to write 2 witness declarations and threatened them with a lawyer if they didn't take this further. Their response from this then changed to the doctor saying that maybe I did come to her for it and the board said that she now knows her lesson to refer with future patients.

I got zero compensation or a formal apology, both things in which I requested.

My question here is, do I have a case to take this further? I was only 21 when I completely lost my hearing on the right side and the doctors that I went to didn't take care of me properly, and then lied that I came to them for it.

I'm devastated because it's threatening my own livelihood. I can't even waitress as a student now because I can't hear in loud rooms.

Can I take this to a lawyer?

(WV) My mom is killing my step-dad

    Posted: 28 Dec 2020 05:06 AM PST

My stepdad is disabled to a point where he can only walk to our kitchen and back, at the most. My mom is also disabled, but chooses to call herself his caregiver. She doesn't bathe him, change his clothes, and cooks for him rarely. He has one meal a day, and sometimes even less(snacks only). He is eligible to stay at a care center, but my mom refuses to send him because "she loves him". I don't want him to die, but between school and work I can not provide for him. What should I do??

A shop on Instagram used my image in a personalized ad without my permission, is there anything I can do?

    Posted: 28 Dec 2020 06:32 AM PST

Hello! I was scrolling (tapping, I guess) through stories on Instagram and received a personalized ad in the middle, like normal. The personalized ads are setup to look like a normal Instagram story but are personalized like most ads are nowadays. It had three parts and all 3 were photos of people wearing the same hoodie that is sold by this shop. The third photo was of ME- I posted a photo months back of myself wearing this hoodie and tagged the shop in it. I screenshotted it thankfully, because since its a "story ad" you can't get back to it. Does me tagging them in a photo give them permission to use my photo in ads like that? Is there anything I can do about this that involves monetary compensation? I live in MA in the US, and the company is based out of LA in California, not sure if that helps at all. Thank you in advance!

Edit: thank you for the responses so far, I am at work and trying to read what I can when I can! I have zero knowledge about this subject so apologies if I dont understand. When I showed some people in real life, they said "that company can't do that, they have to pay you to use your photo" and I wanted to know if this is true because it seems odd to me that I could supposedly contact the company and say "you used my photo, you owe me money". Was hoping for clarification on that :) thanks!

(ID) Huge odometer rollback. Dealer says law is in his favor. What can i do?

    Posted: 28 Dec 2020 09:45 AM PST

Bought a car 2 years ago with 116,000 mi. Just found out today that it had somewhere in the range of 300,000 when it was rolled back just before i bought it.

Apparently in idaho, cars 10 years or older cant be verified for milage? That's what the dealer is claiming. I lost over $3000 in just the milage discrepancy according to kbb. Is it worth my time to bring this to small claims?

"AND" on title preventing me from registering my truck. I'm in AL & Ex is in PA.

    Posted: 28 Dec 2020 10:27 AM PST

First time asking at r/legaladvice. While I believe my english is good, it's not exactly my main language (I'm deaf and uses sign languages). So apologies in advance for missing anything in this explanation or not being as clear as I should be. Go ahead and ask for any clarification and I will try my best. I am also not terribly familiar with procedures regarding titles and whatnot due to this (I've never really owned many vehicles and most of them was very straightforward in the past). I'm also not sure at all what flair to assign to this post.

My ex and I am still good friend. We currently have a verbal financial agreement that Ex's name will remain on the title until I have paid back Ex's part of the truck's cost (initial purchase and Ex covered some expensive repair in the past). The truck was for me for commuting to work at the time. Due to circumstances regarding work and relationship. I moved down to Alabama just a week before the virus started appearing on the news. I had registered the truck recently before the move hence the late timing of the registration this year. Unfortunately my registration is expired due to this issue so I've been informed of late registration fees and whatnot that I will cover.

I recently tried to register the truck by myself here in Alabama and I was informed that because there was an 'AND' between both of our names, both of us must be present to register the truck here. My ex currently lives in PA. They are immunocompromised and with a disability that makes them highly vulnerable to covid. So they can't just drive down to Alabama to sort this out with me.

I am trying to figure out the best way to change the 'AND' to 'OR' so the ex's name would still be on the title but I can register the truck by myself. If this is not possible, is it possible to assign the ex's name as a leinholder once we formalize the payment agreement on paper or something?

Is there a safe way to mail the title to my ex? I'm worried about the title being lost, destroyed, or stolen in the mail and whatnot. Again, to clarify, my ex is cooperative about this as long as both of us honor our agreements and this is an effort for me to do that while enabling me to be able to legally operate my vehicle from now on.

(KY) Is it possible to apply to stop paying my ex boyfriend child support if he never sees our daughter

    Posted: 27 Dec 2020 07:02 PM PST

When my ex boyfriend and I split up and we worked out child custody before she was born, we have shared custody once I stopped breastfeeding. My lawyer advised me Kentucky has a law that presumes shared custody if there are no aggravating circumstances. My ex boyfriend wasn't abusive and doesn't have a criminal record so we have shared custody. Since I have a job and he was unemployed, I must pay him child support. Our daughter just turned one. He could decide to start taking her every other week even though he's never seen her before but so far he's ignored me.

He has never met our daughter. I told him when I was going to the hospital for the birth. He knows where I live. I've texted him and left voicemails that he's never replied to. I stopped breastfeeding her when she was three months old. I had to go back to work in March and I tried to keep going after I returned to work but I work in a hospital and between the shiftwork and COVID-19 I could not do it.

She has a spot in a daycare for essential workers and that is affordable but I am paying out the nose for childcare when I'm working overnights/weekends/overtime and the daycare is not available. My child support to my ex boyfriend is court ordered so if I stop I'll go into arrears and face legal issues. I'm working so much now but between the childcare and the rent increase at the beginning of the year I'm close to struggling. Not having to pay support would help but I can't afford an attorney to help me with the court case.

Can I apply on my own with the court to have the child support removed since my ex boyfriend refuses to see our daughter?

Boss required me to sign a petition to the government or face not having a job there anymore. Is it legal?

    Posted: 28 Dec 2020 11:26 AM PST

I work at a restaurant in mi,USA and the owner came in today with a petition to the local government saying the we all believe that the COVID regulations are hurting small business and we should be allowed to open bc of a 95.5% survival rate(idk where they got that number or if it's accurate). When I asked if I had to sign it she said "you can no longer have a job here if you want". I sign obviously bc I need a job to live but it seemed pretty sketchy.

Edit: did they do anything wrong?

So I work as a server, Usually work 3-10 with no breaks, no big deal I'm a server and I'm used too it. When I got hired I had to sign a meal break waiver and my boss will use it to avoid letting us take 10s as well and claim we waived all our breaks. Is this legal? I know in the serving world breaks are non existent pretty much but for my own knowledge I'm just curious

    Super-surprise doctor bill

    Posted: 28 Dec 2020 09:00 AM PST

I received a doctor bill in the mail. It has a statement date of this month, and the service date is from 3 months ago. It already went through insurance, insurance paid a portion, and now I have a bill for the remaining amount. This all seems normal, except that I haven't been to this doctor in over a year. I could understand if they were trying to collect on an older visit, but after they messed up billing over a year ago (they billed insurance through an expired contract they had with the insurance and then I ended up having to pay in full for a visit my insurance was supposed to cover), I paid all they claimed was due and have not been back.

I called the insurance company and they said they'll have to get the doctor's office to verify that I didn't go and receive services from them, but if the doctor's office claims that the charges are legitimate, how could I prove that I did not go there nor receive services from them?

(TX) Someone been withdrawing thousands of dollars from my business bank account each month for years forging my signature. What are my legal options?

    Posted: 28 Dec 2020 12:08 PM PST

I am partnered with my father who is not tech savvy and recently in the past few months taught him how to check his bank account online. He had caught a constant monthly withdrawal from his account in the 2000-3000+ range where there were withdrawal slips where it was his name forged but still noticeably different. This was at our local community bank. We tracked it back to this being an issue for the past 3 years. My father never withdraw only deposit. We approach the bank and they confirmed it was stolen from his account only refunded him what was stolen the last two month and would not give up who the thieve was. I called a few lawyer and they mostly dealt in defense and not procecuting. They mentioned to call the police... we have yet to do that yet. Please any advice or reality checks would be greatly appreciated.

Could a P.o. box be used for:

    Posted: 28 Dec 2020 10:09 AM PST

Long story short, I would like to keep my address hidden from an abusive parent (I'm an adult)

The parent is now requesting my address for forms relating to inheritance once they pass away.

(I would just pass on the opportunity, but that money could someday help pay for all the damages they did/psychology appointments relating to their toxic behavior)

Would I be able to use a P.o. box for the address? Not sure if it's legal to do so, any advice is appreciated (New York)

(OK)Roommate ditched. His name is on the lease. Purposely destroyed his room

    Posted: 27 Dec 2020 04:52 PM PST

Friend of mine is dealing with a situation and I am trying to walk him through what he needs to do the best that I can. His roommate(who is on the lease) and that roommate's gf(who is not on the lease) flat out ditched him and said that they are refusing to pay anymore rent. They also flew back to where they lived before in Texas so are no longer in the state. To make matters worse, they peed and pooped on their bed which they left, before leaving.

My friend is going after them for the cost of rent and utilities via small claims court. I suggested also going after them for the cleaning cost of the room. I instructed him to send a certified letter laying out the money owed and date to be paid by as well as paying for them to be served and including each of those cost in the money owed that he is going after them for. I also said he should start printing some transcripts of agreement to pay x% of the utilities, their statement saying they aren't coming back, as well as taking pictures of the room for documentation.

Anything else that he should do beyond this?

[Louisiana] My Grandfather left his gun collection to me in his will and my mother refuses to release them to me.

    Posted: 28 Dec 2020 12:16 PM PST

So my maternal grandfather died in ~2016-2017. In his will he left me his entire collection of guns (a rifle, three pistols and a cleaning kit iirc). I was 16 at the time so I was unable to claim them legally under my name. My mother also had to rebuy them out of a pawn shop he hocked them to to pay some bills before his death. Now that I am 19, I have my own place and I want my guns for defense reasons.

My mother argues that, since she paid to get them out of the pawn shop and that they are "in her name" that she is in no obligation to return them to me from what I perceive as a trust. She also refuses to let me get the rifle my paternal grandfather gave me that isn't in her name, but is in her house. Do I, legally, have a right to the guns. For reference, I know possession of handguns is restricted to those over the age of 18, so they were probably put in a trust until I could own them.

If I have the right to them, what should my steps be to get them back? I figure the first step is listing my rights to her and asking politely. That would be the fastest, cheapest, and easiest option. But should she refuse? Do i get a court order and send the boys in blue to their door?

Any help at all is appreciated.

Apartment won’t let me break the lease (what do I need to bring this to the court?)

    Posted: 28 Dec 2020 11:54 AM PST

Hi long story short I lived in an old apartment located in Northern Virginia that has serious pest problem (mice and roaches) from day 1. There was couple of huge holes behind the wall behind the dishwasher and those are the pathway where mice come in and out. I saw roaches and mice almost every 20 steps I took in that house even though I kept my apt clean. They kept postponed to fix this issue and never did. Also there was a unknown person kicking the door threateningly almost everyday between 1am to 5am but this issue never got solved too. I had to call the police numerous the because of this. The marijuana/cigarette smoking in the apt problem (smelled strongly in my whole apt through the vent 24/7) was also there

So because of all these issues my mental health got bad and I requested them that I want to break the lease and want my deposit back. (I asked them to give my deposit back because I payed general pest control fee every month because it's included in their monthly fee for everyone but pest control service was not provided and the environment was so un safe)

They kept postponing these issues for 3 months (I payed the rent bc they kept postponing) and I couldn't be in that environment anymore so I made another contract to new apartment and moved out.

I talked to the previous apt manager/staffs for 3 months(most likely on phone call but I do have plenty of email exchanged since September) and they say they can't break the lease and they have to talk to their supervisor and will reply me back on 12/11 but again they never responded me and charged me January's lease again on their website.

And new update is I sent the email 2 days ago to the manager who told me he has to talk to his supervisor(never did) and he now said because I empty the apartment early w/o signing a form, I have to pay 60days rent worth of penalty. I asked for the form earlier but he said he have to talk to his supervisor and didn't gave me the form. I empty the house because they kept postponing to solve the mice/roaches/unknown person kicking the door.

Is there anything I can do? To get my deposit back and break the lease? They won't even let me break the lease and remain ignoring at first and now they told me to pay 2 months of penalty and take away my deposits. I'm already paying my new apt's rent.

I have several videos of mice/roaches and people kicking my door, etc.

Do I have to hire a lawyer? I'm not sure if I can afford a lawyer I'm college student and this is the first apt I ever had. I don't have any guardian or parents who can help me.

Somebody told me to get a home inspector and bring it to the claim court. Is that the best way to do? If there's a step I should follow please lemme know Thank you in advance.

Also I want to let the apt manager know that i'm bringing to the court do I send them email??

I'm sorry this post getting longer and longer😭 Thank you in advance.

(IL) Work wrote me up for taking to many sick days. When I mentioned it was due to migraines from the military, they claimed they didn't know anything about it even though I mentioned it on my application.

    Posted: 28 Dec 2020 08:45 AM PST

Basically as my title says. I got written up recently for "taking to many sick days" during the year. I made sure to fill out when asked on my application for the job about my military service and that I had a service connected disability. When talking to me about the reason for the write up I mentioned that it was mainly due to the migraines I get from a TBI in the military, an injury/disability I mentioned in my application for the job. They said they had no idea about that, and that there was some paperwork or something that should have been filed about it when I got hired almost two years ago. I was never informed about that until now. Not sure where to go from here and came her to ask.

    Car sale/dealership question

    Posted: 28 Dec 2020 01:03 PM PST

I sold a 2015 Subaru WRX with aftermarket modifications to a dealership. One of the mods was an e-tune via Accessport. This is a way to change the computer chip on the car, to change gearing and engine performance and so on, and an Accessport is the electronic device to do so.

The sale is a trade in for a new vehicle. The original car's value was applied to the loan on the new vehicle. Papers are signed etc.

Upon sale, I reset the Car's computer chip to default by uninstalling the Accessport. This was at the salesman's request.

The trade in car was in 100% great working condition with zero issues other than some bug marks on the front bumper-some cosmetic paint dings.

Being done with it, I sold the Accessport device on eBay. Mind you, they are $600.

40 days later I get a call from the dealer saying that my car won't pass inspection for the state because it's "running rough". As an aside, I'm not familiar with performance of the car itself being tested for on a TX state inspection, it's mostly safety stuff and emissions.

They ask for me to come back and put the tune back on the car. I told them I already sold the Accessport and I'd get back to them.

I don't believe they have recourse nor do I believe I am obligated to oblige aside from an ethical standpoint.

I'd love your guys' thoughts on the matter and your opinions on where to go from here. I've got a new vehicle financed through this dealer and paid down and made a payment on it already, if that is pertinent.

Federal offense - California 2nd Amendment rights

    Posted: 28 Dec 2020 12:54 PM PST

    Hello all...

Back in October 2000 I pled guilty to Conspiracy to intercept electronic communications, obviously a non-violent crime. I probably could have fought it and won but the cost financially would have been huge (my boss fought it at won but lost his home, vehicles and more because of lawyer costs). I was fined, given 2 years probation, 6 months home detention, but no prison time. All of this happened in the state of Massachusetts but I had just moved to California so I did my probation, home detention in California

I still live in California. This year I registered to vote and they allowed me to vote as I guess the state restores your right to vote after you have completed any sentencing, even federal. However I would also like to purchase a firearm so I can protect my family and home, as we live in the country and the sheriffs department moves at geological speed here (a few weeks ago my spouse accidentally called 911 on her iPhone. 2 hours later they show up for a wellness check. sigh).

Is a presidential pardon my only path to getting my 2nd amendment rights restored or can California do it as they did my right to vote? I've read so many documents on this matter but its like crossing the streams in ghostbusters.

Any insight would be greatly appreciated.

Maybe dramatic, but landlord won’t fix amenities.

    Posted: 28 Dec 2020 12:49 PM PST

    Austin, TX

I rented an apartment in a complex that advertised a pool and hot tub. However, the hot tub has not been functional since moving in (Aug 28-end of year). I've reached out twice asking and they have excuses that their maintenance team is busy, and that the hot tub is old. They also have taken 30+ days for household repairs (toilet not functioning etc).

I signed the lease under the assumption I could use the amenities. Do I have any rights here?

Spouse logged into my individual bank account and transferred the balance to themself without my knowledge or consent. I don't know how they got the password. Passwords have been changed. I am considering separating from my spouse because of this and want to proceed carefully where transfers, etc are considered. Will it come back to bite me if I call the bank and have the full balance transferred back?

[FL] Received Letter that my Infant's SSN was compromised via a 3rd Party Medical Data Company

    Posted: 28 Dec 2020 09:58 AM PST

We received a letter stating that my infant child's information was part of a data breach of medical records, with recommendations that we freeze her credit and monitor it for the rest of her life.

We were super pissed about this, as its a company we have never interacted with (and have no business relationship with). They appear to be a service provider for a doctor or hospital.

I am not one to litigate but being told to just monitor her credit for her life is not a fair accommodation to their breach.

Do we have recourse to pursue damages for the costs associated with credit monitoring without directly pursuing her doctors?

[WA] Litigation from abroad - CW: Revenge porn and rape

    Posted: 27 Dec 2020 10:46 PM PST

I am a Mexican man living in Mexico, I hooked up with two American men here and they filmed me having sex with them. I agreed to penetrate, but not to be penetrated, so one of them held me while the other raped me. They posted the pre-rape pics and videos on Twitter, I asked them to take them down but they didn't. I reported them to the Mexican police for rape and revenge porn but they ran back to the United States (Washington) once the Mexican authorities started searching for them.

Now, they are reposting the videos and pictures. Twitter continues to remove their accounts and tweets, but they keep tweeting and harassing me online, threatening on posting them everywhere even if taken down, asking people to message them directly for the videos. What can I do?

    Need divorce lawyer advice.

    Posted: 28 Dec 2020 12:30 PM PST

Title sums it up. My divorce lawyer has been ghosting me since the hearing where it was ruled I was granted the divorce as well as custody of the kids. She told me it might take a couple weeks for the papers to be filed but to give her a call then. That was back in September. Since then, we have been only able to reach her secretary who has told us various excuses(at doctors appointment, with another client, out for the day, out for christmas) but no official answers. We called the courthouse the other day back and found out that the paperwork hadn't even been filed yet. We called the lawyer up immediately and got in touch with the paralegal who told us she had drafted the paperwork and given it to our kawyer to send in months ago. She scheduled an consultation today at 11:30 with the lawyer. 11:30 comes and we are told she's with another client that's taking longer than expected and that she'd be with us at 1:30. 1:30 comes and... She actually rejects the call when the secretary trys to put us through and he says that she will call us back shortly So here we are. 50 shirt minutes later and fully fed up with these antics. Beyond storming the gates, what can we do besides wait? My ex is an abusive asshole who threatened me and the kids multiple times and I thought this chapter of my life was finally over with. Any advice is appreciated. Edit- I live in Texas in the United States.

(TN) My ceiling is falling in and my landlord keeps brushing off my calls.

    Posted: 28 Dec 2020 10:50 AM PST

We're about 6 months into a one year lease at our apartment.

We had a snowstorm on Christmas, and woke up Christmas morning to our ceiling leaking water quickly, where it meets the wall. This has been "fixed" once before while we've been here, when rain was causing it to leak, and it looks like it's been patched over previous to that.

We called our landlord on Friday (Christmas) and told them what had happened, and they said they probably couldn't get anyone out because of the holiday. We tried calling back Saturday and Sunday and left voicemails but got no answer. It's now Monday and I've had to call them again and ask them to send the maintenance man out. No apology, nothing, just "I'll see if I can get someone out there." I've informed them my ceiling has a leak, it looks like it's about to fall through, and we've had to move our bed and things out of our bedroom and cram it into our son's room so my husband wouldn't have to sleep in a recliner. This is the fourth day we're dealing with this now.

Do we have any kind of recourse here? How long can they wait to fix this? What options do we have? This is not only not allowing us use of our bedroom, but is also potentially dangerous to me as I have allergies to molds and mildews. I just don't know what to do and I don't understand why this wouldn't be something they would quickly want corrected. Does anyone have any advice?
