Legal Advice Update [Fired for following company policy]

Update [Fired for following company policy]

    Posted: 27 Nov 2020 06:49 AM PST

    Quick update to my post.

My colleagues and I were pressured into resigning and again accused of time theft. One of my colleague did resign, but the rest of us decided we would consult an employment lawyer instead. Our employer got wind of that somehow (I suppose one of my colleagues couldn't keep their mouth shut) but it wasn't necessarily a bad thing because they changed their tune completely. We were told that the company doesn't need us anymore, which means we're still losing our jobs, but we're not fired for cause, no accusations of time theft. The VPN thing is now a "lack of communication between departments". I was offered a decent severance package (I don't know about the others, but I think they got it too). That's something at least. I think it still could be argued that there's age discrimination at play here, but I'm not sure if it's a fight worth fighting. Actually I have reasons to suspect that the company isn't doing well at all. Time to dust off that resume I guess.

Legal Drug Seized By CBP (USA/PA)

    Posted: 27 Nov 2020 10:05 AM PST

I recently got a letter from the United States Customs in border patrol that claimed my package valued at $0.50 was sized at JFK Airport under the federal analog act. The package was actually $150 and is 2-FDCK. 100% sure the package is legal and I use the package for research purposes and even got it approved by my doctor as to not pay $1000's of dollars for research treatment and testing. The package again is not regulated by any law that I have found in my extensive research of the substance. I have also consulted with a grad student becoming an attorney a year ago and I understand they are not an attorney as of yet but from weeks of research, he said I was fine. I was wondering what I can do to get my package back without paying extensive legal fees or having to go to court. I appreciate any advice and if more information is required please let me know and I'll be glad to give them in more detail.

My job is telling me that “satanism” is not allowed?

    Posted: 27 Nov 2020 11:47 AM PST

Let me start off by saying, I'm agnostic. I don't have any particularly strong religious views, but I grew up religious and I have nothing against anyone who does. I have several coworkers who are very Christian, their cubicles have tons of crosses, Bible quotes, and other Christian decor. Recently I lost my mom, and I had several coworkers sending me messages that they would be praying for me. Again, this doesn't bother me in the slightest because everyone is entitled to their own religious beliefs. I work in the back office of a credit union and never see any customers. Headquarters is specifically designated for employees. I'm very into taxidermy and Halloween-ish decor. I have a few animal skulls that I've collected and cleaned myself around my desk and some gifts other coworkers have gotten me because they know I like this stuff (a tiny coffin, a mummy figuring, things like that). Well a week ago my sister bought me a very small tapestry (about the size of a sheet of paper) with the words "as above so below." I placed it next to my computer and then received an email from management asking me to taking it down. I was a little off put by this. When I asked why, they said because it was sacreligious and therefore not allowed. I asked if anyone with religious decor would have to take their stuff down and was told no. Can they legally do this? This is not a small business. We're a large credit union with branches in several states and HQ has about 300 people working in it. I'm planning on leaving the job soon since I graduated college and am moving into my field, so I took it down as to not upset anyone I might be wanting to use as a reference, but is this allowed? If I refused to take it down and they fired me would I have a course of action?

Edit// I live in Washington state

Job is basically forcing me to come in to work even though I am COVID positive. I’m an RN. Please give me advice.

    Posted: 26 Nov 2020 06:28 PM PST

    Hello everyone.

I am a 24/F RN based in California. On Thursday last week 11/19 I developed symptoms of covid- body aches, loss of taste and smell, cough, and just generally feeling weak. I work on a COVID unit at my skilled nursing facility so I suppose it came from there even though can't be 100% sure. I told my boss on Thursday of my symptoms and he told me "still come in and get tested next week". I said I just didn't feel very great and they didn't seem to care. I worked last Thursday and Friday, then Saturday I felt very sick and called in, same with Sunday. On Monday I got tested and told my work I was 100% sure I had COVID and that I wasn't feeling good and I wanted to confirm my test results before coming back.

My work called me on Monday evening and said that since my symptoms aren't debilitating and I am physically able to stand and work, that if I choose to stay home sick even if I am positive for COVID, that I will not be awarded major covid sick pay. Meaning, I will not get paid for the 10 days I need off, so I can't afford my rent or bills.

I told them I still feel weak and generally unwell, and they said unless I have a fever or am in the hospital I have to come to work because "there's work that needs to be done on the covid unit and you aren't a threat". I asked them what about my co workers who are negative and they said that as long as we are wearing masks and face shield, we are 100% protected. We also have a few patients on the "covid unit" who are negative but are just here because they need IV treatment. I told my managers I'm not comfortable with taking care of them since I'm now confirmed positive and they said I still need to because no one else can. I have been confirmed positive since Tuesday this week and have been working everyday since Tuesday including right now.

Is this all legal here in California? I'm going to report to HR tomorrow but I just want to know if anyone has experience with this.

TL;DR: confirmed positive covid nurse who is being forced to work.

UPDATE: Thank you all so much for the advice, I really appreciate it. I reached out to my county public health department who took down my complaint and concerns and someone should call me by Monday. I tried to call OSHA and my company's HR director, but both are out until Monday due to the holiday. I'll give another update then. Thank you again for taking the time to comment and help a stranger out. Please stay safe!

Fired by Laboratory that knew my Covid Pos result before I did

    Posted: 27 Nov 2020 12:30 PM PST

I was just fired over the phone by the laboratory I work for. I missed days this week due to strange, painful symptoms. Turns out those symptoms were due to Covid. The laboratory I work for is the testing site for my test in particular and knew my results before I did. What can I do about this? Is this legal?

Ex Brother in Law is trying to take my home in Divorce

    Posted: 27 Nov 2020 07:13 AM PST

Said house in question is a tiny house, we were making payments on a shed, my husband and father converted it into a house. House is on family property. My sister received court papers today and in the papers my soon to be ex brother-in-law filed they have a joint house together, but the house is my house that I am letting my sister stay in during the time that we are stationed in California. They were renting originally, they did not sign papers just verbal agreement that they would make the monthly payment and could stay there as we were out of the state. They only made two payments and then they couldn't so I agreed to just keep making the payments myself and let them stay there. Then they wanted to just out right by it for me I gave them a price and they never came up with the money so My husband took a personal loan and finish paying it off so that we wouldn't have that huge payment. So the paperwork that was sent to us has myself as the sole owner. Is there any chance a judge would actually rule in favor of my ex brother in law and give him the house? We are stationed in California and said drama is happening in Alabama. Sorry for the run on sentences anxiety has kicked in.

    Military Divorce Fiasco

    Posted: 27 Nov 2020 09:43 AM PST

I will apologise up front for terrible formatting as I am on mobile.

So, I have been married for 12 years and 11 months, the thing is though, we've been separated for 11 of those years with no chance of reconciliation. When we separated he was stationed overseas and I moved back to the U.S., he was extremely abusive and my mental state had deteriorated; nonetheless, after I became settled and was able to somewhat support myself I filed for divorce. He refused to sign.

We've been playing this cat and mouse game for the past decade. For awhile, I didn't care because I received a small amount of separation pay from him and it allowed me to not struggle as bad while I worked on my bachelor's degree and worked full time. But I have sunk a small fortune into having 5-6 sets of divorce papers (between 2 states) prepared, notarized, and mailed certified to him now that he's stateside..

In the last year, after massive amounts of therapy with coming to terms with my c-PTSD from the marriage, I started dating someone. He's thankfully very understanding of my weird marital affair but I do want to get my divorce finalized.

The problem I've been told is that since he's military I can't force the divorce and I feel weird about contacting his 1st sergeant to kind of get the ball rolling. I feel stuck between a rock and a hard place.

My ex previously agreed to a 1 year continued separation pay as alimony since my health insurance would be null after the divorce. He agreed to this because he didn't want me going for half his military retirement. Now he's rescinding on this and I don't have the money to get a lawyer. What's the best legal recourse for pushing this through?

Tl;dr: Divorce advice, been married 13 years, separated 11, he's military and unwilling to sign uncontested papers. I'm in Arkansas. He's in New Mexico.

    Issue with Kitchen Company

    Posted: 27 Nov 2020 04:39 AM PST

Hi everyone, I hope you had a happy thanksgiving. I would like some assistance with a kitchen company in Brooklyn, NY

I paid a kitchen company $73,000 on Sept 2, 2020 and they told me that they would have the entire delivery shipped to me in "2 weeks". However, 2 weeks passed and they did not deliver anything. In the beginning of Nov, we received half the order… (approx. $40,000) and have yet to receive the other half.

I tried to reach them on the phone and via email but they do not respond. I used my coworker's phone and they picked up said "they couldn't hear me" and blocked that number. I physically drove and went to the company 2 weeks ago and they said "we have some equipment that we can send to you and we will deliver in 1 week" but no delivery and stopped responding to my emails and calls. We still did not receive $30,000 worth of equipment.

Any recommendations in this situation? Possibly police report? Thanks.

    Electric bill issue

    Posted: 27 Nov 2020 11:02 AM PST

I live in West Virginia and in 2016, I rented my home to a lady who asked if the electricity could be left in my name. I agreed, which was my mistake. She was a great tenant for 2 years, kept the place clean and paid her rent on time. Since the electric was on when I would go there, I assumed it was being paid. Then one day she vanished and left the home. When I arrived at the home, the electricity was shut off. When I called the electric company, I learned that she had not paid one electric bill the entire time she was there...for 2 years. It took them 2 years to shut the electricity off. Thus is unheard of in my area. Now I owe a $5,000 electric bill. I feel like I am not responsible for the majority of this bill because the electricity should have been shut off after a month or two of nonpayment. Now I am trying to get electricity in my name in an apartment and the electric company will not even let me set up a payment plan. They will not give me electric service until the $5,000 is paid in full. I have filed a complaint the PSC in my state, and they said they would contact the electric company but they cannot make them give me service at a new residence. I will be homeless in a few weeks if I can't get electricity in my name. If the electric company would have shut off the power after a month or two of nonpayment, I could have paid that bill, but leaving it on for 2 years and letting a $5,000 bill accrue is more than I can pay in full. Since they are the only option. I have for power, I feel like they are being bullies and can do what they want. Do I have any recourse in this matter?

Farther booted out of house while trying to file for divorce.

    Posted: 27 Nov 2020 10:14 AM PST

I'll try to make this short. My father and mother were together in 2000 when they started renting a house in IL. Years down the road my mother left my dad and moved in with someone else. She than came back a couple years later and moved back in with my dad, however they remained separated. Eventually my moms friend offered to buy the house for her. They did a contract for deed and he paid the payment until his death. After he died, my mom went back with the person she left my dad for and my father took over all the payments, though it was still in my moms name. Years down the road again, she comes back and now the house is paid off. My dad doesn't want her there and files for divorce. She goes back to this guys house and lives in between there and my cousins. Parents argue about the house, it's in my moms name but my dad paid for most of the house, kept it up and lived there for 20 years . My mother signed the house over to my cousin. Dad and her still are married. My cousin sells her house, and boots my dad out. My brother bought him a new house. No eviction, no nothing. She owns the house now, even though we believe my father is entitled to it. Not sure where to go from here.

Being fired for reporting a suicide threat?

    Posted: 27 Nov 2020 01:14 AM PST

On Thanksgiving night, my roomate who is also my supervisor, pulled a gun and threatened to shoot himself. I called police and fled the house. Police said they were taking him for a 24hr psychiatric hold, but he was back a few hours later. In the meantime, I texted our boss, the owner, a quick summary and told them I'd cover my boss's shift until things got figured out. When my boss came home, he threatened to fire me. I turned my phone camera on and recordeda video of him saying that he wanted to fire me for calling the cops. I work as a budtender in Montana for the last 5 months. I absolutely cannot lose this job. How do I protect myself best?

[CA] What to do if other party is dodging being served court papers (custody)

    Posted: 27 Nov 2020 11:52 AM PST

Mediation is Dec 8 and hearing on Dec 30. We got the court papers on Nov 23 and hired a process server on the 24th. Being the holidays, they only just now are trying to serve her.

I know I have to serve her 16 court days prior to the hearing. Plus I have to make her aware of mediation. She is never at home and always at her moms or at her sisters. I gave the home address to the server for now but am worried she is going to try and dodge me (she asked me the other day if I am taking her to court for withholding the kids so I think she knows).

Any advice here? Am I just gonna get screwed and have my court date pushed out more? Should I send out two different process servers? Pay for multiple addresses? Can process servers leave docs with her mom or sister?

Do courts get pissed if the other party dodges the summons?

Semi truck hit me and is now blaming me

    Posted: 27 Nov 2020 11:48 AM PST

I was on my way home from work in the far right lane as my exit was coming up. I had been in the far right lane for a majority of my commute and hadn't merged at all during the time of the accident. Then a semi truck hit me on the freeway on the rear left side of my car above the tire. He didn't seem to notice he hit me at first and kept pushing until I pulled out from his bumper. Luckily no one was hurt and we pulled aside and exchanged information and took photos. He gave me the number to his boss which I thought was his insurance company number and upon calling I figured out they are trying to say that I crashed into him. I've already called my insurance (State Farm) and I only have partial coverage. This is my first car accident and so I'm confused on how to deal with this and just get out with the damages on my car fixed and no point on my record. Do I call his insurance and make a claim so I can be fully covered? Do I get a lawyer? I don't want to be out at fault for something that I absolutely did not do and I cannot believe he's making a claim that I hit his car. Any help would be greatly appreciated!

    Breaking lease with master tenant

    Posted: 27 Nov 2020 10:12 AM PST

Hello! I've been subleasing from a master tenant in a place in SF. However, I am quite sick of living there underneath the master tenant. The master tenant has strange rules and barely gives myself, and my fellow subleasing roomate space. We have also had a feeling we are paying much more than what is fair. I also work at home and my mental health is very unwell has my room has no natural light and my master tenant insists i work in there while she is in the living room.

Recently, I discovered that as a master tenant in SF, you are required to disclose the true overall rent price you are paying to the landlord (found on the housing rights committee of SF http://hrcsf.org/know-your-rights-as-a-tenant-in-sf/roommates-subletting/ )

She has never told us this. My fellow roomate even asked and she has never shown us. We have heard the true rent price from our neighbors and we KNOW she is paying way less than us. She even told us we each had to pay an extra 100 when moving in for utilities when utilities are included in our unit.

Is this enough evidence/bullshit for me to break the lease and not continue paying for the few months I have left? My contract with the master tenant has no penalty however, i do have a lease end date written out in the contract.

Side note: even if we did adjust the rent to what is a fair I don't think she could afford living there.

Management says that they cant do anything about a coworker harassing me, can i be fired for talking about the coworker on social media

    Posted: 27 Nov 2020 08:15 AM PST

My coworker has been harassing me for a few months. This includes spreading rumors about me sleeping with people, talking trash on me, throwing around products in my department, hollaring at me, takes pictures of me for some reason, contacting my boyfriend on social media, threatening to hit me, and telling customers to complain about me.

Its gotten to the point that managers have repeatedly seen me walk off and cry, and they know I'm having to make extra appointments with my mental health team and have been contemplating SH again.

According to management theres nothing that they can do about this and they cant punish her or even stop her or tell her to stay away from me.

Up to this point i hadnt spoken about the situation except to people in person/on the phone/over text, and not to any other employees.

My social media does not state where i work or my job position or anything of the sort and the only person from work i have added on any social media is a manager.

This is in TN and we are a union company.

Can i be fired if i speak about the situation publicly, without naming her or the company or anything

Moving out procedure - Management company wants additional rent (Florida)

    Posted: 27 Nov 2020 02:48 PM PST

    Hi Everyone,

I am moving out of my apartment and into a much better one in every aspect. I went to submit my written notification of non renewal today to management. Because it is within the 60 day notification period, they are seeking an additional month of rent from me. However, according to Florida statute 83.575, they did not provide me written notification of a lease renewal before the 60 day notification period in the lease agreement. The written notice was delivered on November 23rd. Am I liable for an extra payment?

Negligent covid response with confirmed case at work

    Posted: 27 Nov 2020 02:47 PM PST

I'm employed at my first professional job in Illinois, but my experience since starting has been anything but. I was hired on as an hourly employee, where I'm putting in more than 40 hours a week without the equivalent overtime pay. I was promised training on the job, but I've been more or less thrust into projects where I've been made to deal with clients and situations way above my knowledge and ability. I've discussed the unusual practices at my job with my coworkers who have all been with the company, around 5-6 years each, and they all boil down the lack of employee rights as "how it is here".

Given this as my first real job, the job market with the pandemic, and my lack of knowledge concerning employee rights given I'm from out of state, I tolerated it until recently. The incident took place when I came in one morning and had to find out through the grapevine one of my coworkers had tested positive for COVID-19. This coworker had been feeling sick for some time, but it was not enforced they stay home while waiting for their test results back. The higher-ups would only address this after the news had blown up with the rest of my coworkers. I had immediately rushed to inform my own household and schedule my own testing, especially with the holiday the next day, however the supervisors assuredly spoke of having "someone come in and do rapid testing" where "we would get results before the end of the work day". At the time, I was able to find an appointment and schedule it during my shift, but upon confronting my supervisors about having my own testing done during the workday, I was pressured by them to cancel and waiting for the company's own testing to occur. As it was "interrupting the schedule", and implied that should I go attend my own appointment, they wouldn't be covering the costs of my testing.

I canceled my own appointment and waited for their company screening to occur at the scheduled time, however it never came. Going to confront the supervisors, they were no where to be found, and it had to come from the office receptionist that the testing "fell through", the supervisors had left to their own testing appointments, and we were essentially on our own to get tested in the hour before everything, including walk-in COVID-19 testing sites, were to be closed. A couple coworkers and I rushed to wait in line for the COVID-19 testing facility that they originally planned to have someone come in from, and got tested there. Even going to the same place they originally planned for, I couldn't get reassurance I would be reimbursed for the testing by my job.

My job is now trying to get people to come back to work, ensuring that "everyone will now get tested" which was a minimal, dubious response at best. The supervisors at the position have completely ignored the fiasco of throwing everyone under the bus the previous day, acting like nothing happened. I'm certain they won't enforce the testing rules on their employees, as they've even only informed the employee group who found out about the positive COVID case in office. The rest of the company employees in the building are certainly still working right now.

As mad I am about the situation occurring right before a holiday, I'm now more concerned about the practices at my job. It's obvious they didn't and still don't have a COVID response in place for their employees, and my coworkers seem resigned about the whole situation having worked there for so long. I know a couple will just lie about getting tested to not bother with it further and the company will take their word at face value.

How should I approach this? Do I have any legal recourse, or should I first approach higher ups about the situation before going to the extreme? Do I even have any rights as an hourly employee concerning COVID? This company doesn't really have an HR department as a smaller business, however I know they have a string of lawyers, which I'm now guessing is to shush something like this. I don't have any real obligation given this position isn't even relevant to my degree, and I understand the importance of picking one's battles wisely. Is it worth it to pursue further or just be done with it and drop the job all together?

Neighbors leaving tree debris in front of our house on dead end road, and it is piling up

    Posted: 27 Nov 2020 10:50 AM PST

Hello, this is in Alabama, and I hope it does not come across as petty, but it is getting a little ridiculous. Here is a pic to help me explain.

I rent this home on a dead end street. When I moved in a few months ago, that pile of tree debris and whatnot wasnt there (as seen in the photo). It looked nicer and also gave me 10 feet, maybe more, to use to back my vehicles in and out of the driveway. Recently, someone started putting limbs and debris there. Ive seen 2 different people do it. I stopped one guy and asked nicely for him to not put things there, as its an eyesore, and I have to end up pushing it back so I don't scratch up my cars. He ignored me and kept piling limbs up. I guess other people saw this as a chance to move their debris there too because in just a week the pile has doubled and I don't know who is doing it. Now its potentially blocking access to the power pole. Someone even abandoned a bike and a pile of shoes there, so actual garbage is finding its way into the pile.

So I guess my questions may be... is that legal, since its on a public road, although a dead end? Can I stop them if I see them? Am I required to pay someone to move it since its getting in my way, or should my landlord, or even the city be responsible since its on the road? How do I even begin stopping this before it gets out of control? I thought about putting up a polite sign about it, but my conversation with the person I saw didn't go so well, and I doubt anyone would obey a sign anyway.

Edit to add, the road extends past the power pole, so I would assume thats still public road since it is on the asphalt, and multiple people are doing it and attracting litter bugs it seems, just don't want to have it block the drive or continue to grow. I would think thats public roadway.. but may just be a little annoyed.

Tenants abusing our inability to evict (California)

    Posted: 27 Nov 2020 02:32 PM PST

Hi. I'm posting on behalf of a close friend.

We have tenants living with us in our home since last year, and they decided to stop paying rent since January. We were in the process of evicting them in February since they refused to leave, but then the mandate from the governor came out and then we couldn't get a court date.

It is now November. These tenants have been a terror on our lives. They drink, play loud music and yell at each other into the night, leave trash everywhere and let their dog pee and poo everywhere. They yell at my friend and his mother for not cleaning up after them. They smoke on the property and started a fire on the front lawn, but even with a fire department response the police say nothing can be done.

The multiple attorneys we've talked to have said there's nothing we can do "for now". The police we've talked to said there's nothing they can do.

Is there something we're missing about this? Is this simply the life we have to live unless we literally give these sad excuses for human beings our house? Is there ANY options for us to get them out?

Thankful for any advice or input.

Likely to divorce. I want to make sure my spouse is protected.

    Posted: 27 Nov 2020 02:25 PM PST

The writing is on the wall. We've tried everything. We've been together for 5 years and married 3 and a half. I'm 99% percent certain they will agree that we should no longer be together. I love my spouse and without any hesitation or doubt, they truly deserve to be happy after everything they went experienced recently. There's just one minor issue. We got married in New York and with it, my spouse got a green card. I don't want them to lose that if we get a divorce.

I tried searching this subreddit and online but I couldn't find a clear answer if they will be protected or whether or not their status would be jeopardized. I'm also just a bit bogged down and distracted at the moment - trying to handle the emotions of this entire year and our marriage falling apart - I'm sorry if I overlooked an older post. If someone could point me in the right direction of resources to help make the next steps a bit easier? I would really appreciate any advice.

    International companies S.A.R. Hong Kong

    Posted: 27 Nov 2020 02:05 PM PST

Hi, I am facing a difficult situation in which a company with its headquarters in Hong Kong, displaced me from one of their subsidiaries in Austria to another in Spain. Now they decided to close the Spanish one and although I have a contract in Spain, we signed a contract with the managers of both subsidiaries in which says the following: This contract shall governed by and construed in accordance with the laws of S.A.R. Hong Kong and each of the parties hereto submits to the non-exclusive jurisdiction of the courts of S.A.R. Hong Kong. So my question is if a judge in Hong Kong could force the company to pay my severance as per the Spanish law? Of course I better handle it all in Spain, but since they are shutting down the company and the court saturation due to the pandemic I will reach a point in which the company no longer exists in Spain. Please if anyone can give me a hint which kind of lawyer I should get in touch with in Hong Kong, or maybe if anyone knows a good lawyer firm I would highly appreciate!

    Academic misconduct

    Posted: 27 Nov 2020 01:52 PM PST

I went to an early college and my Spanish teacher accused me of academic misconduct and wrote me up. I didn't cheat but nothing else was ever mentioned. I was not charged with anything or sent anything from the deans office. My friends entire class was written up for academic misconduct and she said it was never mentioned to her again. Should I be worried? I'm located in the US and in NC ETA: this happened about a year ago.
