I'm planning to call USCIS when it opens to ask, but thought I'd get advice here too. Basically, I'm a US citizen (from NY) and my husband is a Japanese national. We've been married for almost four years, together nearly 6. Our marriage hasn't been perfect, we do fight sometimes, but he's never done anything like this so I'm completely blindsided. About 2 weeks ago, we had the visa interview at the consulate in Japan. He passed, and we were elated. Suddenly, he's saying that he wants to keep the visa and divorce me. He's 100% sure and will not try counseling. This is completely out of left field to me, because we were happy and doing well up until he said this. Now, the legal issue is that I'm pretty sure, since the visa has been issued, it's too late to stop it. But, I'm his financial sponsor for 10 years. If I had known he was just going to divorce me right after we got the visa, I obviously wouldn't have agreed to sponsor him. This is a huge mess and I feel like my life is ruined. What can I do? I read online that it's possible to revoke the sponsorship if both him and I agree and send a letter to USCIS. Posted: 06 Nov 2020 08:29 AM PST So i got rear ended at a red light by a driver. He hit me and then drove away. I followed and called 911 after making the report and getting the car info. While i was still on the phone, driver of the car pulled into a shady neighborhood so i asked the dispatcher what to do, and she told me that i didn't have to follow the car anymore, to just to go my nearest police station to file the report. So i went straight there. Fast Forward to yesterday, i get a call from the insurance saying my claim was denied because the other driver said he was not involved in a crash. I got upset and asked if they asked their client for pictures of the car, because it should have been damaged. She put me on hold to speak to management, then said they would call me back later. i got a voicemail later on in the day from her, saying my claim was denied because their client was not co-operating with them and my police report didn't identify the driver by name. I haven't called back, but i wanted to see what do i do now? I wanted to call them back and dispute that, i feel like if the client is not cooperating, then that isn't my problem. I provided police report, pictures of my truck, estimate, and screenshots of my 911 call. I am willing to take legal action if necessary. My truck is worth about 5-6k, the damage was about 3.2k. He got his fourth or fifth DUI right before coronavirus and he refused a breathalyzer. I have a seven year old son. My brother is working with his lawyer on a plea agreement. His license will be suspended for one year, but there are provisions in the agreement that state he can drive around for special occasions which include medical appointments, AA meetings, etc. Here's where it gets hairy. I was reading through the document, (He drunkenly sent it to me with this part highlighted in red) and I saw that one of the special circumstances is that he was granted permission to pick to his son up once a week. THIS IS A CHILDCARE CLAUSE! He does not have a child. Hell, he doesn't even have a car seat! Under no circumstances would he ever be able to pick up my son from school as he's not on the list. Clear as day I see my son's first and last name along with the address of the school. I do not want my boy's name on any legal document, especially since it's untrue. CHILD CARE: "Petitioner has been granted the special privilege of operating a vehicle for limited purpose of picking up and dropping off his children from the schools they are enrolled in, listed below." I am livid. I called him up right on the spot and expressed my concerns. I understand that he wants more freedom to drive around legally, whether it be to run to the grocery or go get fucked up at a bar. Either way, not relevant. What I'm not OK with is the above information coupled with the fact that if this brother of mine gets pulled over and has been drinking, which is pretty much a guarantee, he will show them this document and the next thing you know DCS comes knocking on my door trying to figure out what's going on. Furthermore, if he were to say hey I'm just picking up my nephew, the document would say children, and he would go to jail anyway. I don't understand the logic. My brother apologized in person and I just received the forwarded document revision from him, via e-mail, from his lawyers. I understand attorney-client privilege, but is there a way for me to obtain proof that this revision is what will be submitted to the courts? For all I know, he could write another email and say, "You know what, never mind. Keep that revision in after all." I am a very concerned parent at this point. I have his lawyers name/place of work/office hours just as an FYI. Do I have any options to obtain certain proof that this change will take affect? Thanks all! At my university, a group of 15-20 students were awarded a scholarship for attending a networking event with large companies. The companies themselves paid money out of their own pockets to give each student a $1,025 scholarship. Each student had to write a thank-you letter to the company for the scholarship. We were supposed to receive the funds on October 8th, 2020. Students in other groups received the scholarship. However, the group of 15-20 students did not, and the financial aid and tuition and billing departments reported that they have no record of any funds ever being sent to these students accounts. I am one of the students, and I have been contacting literally everyone (including the Dean) through e-mail and have not had this resolved yet. My Step Dad Beats me up. Is it my fault? Posted: 06 Nov 2020 08:07 AM PST My stepdad (not even my legal stepdad yet still my mom's boyfriend) beats me every time I do something bad/be disrespectful. This has happened about 3 times now. And when I say beat me, I don't mean the usual belt whooping/spanking. He says this "you wanna act like a grown man you gon get treated like a grown man" And then proceeds to beat me up like we were in a street fight. (I'm 13 btw) Punching, Kneeing, Kicking, Elbowing, Biting, and using vital points to his advantage is what he usually does. And he doesn't hold back on the amount of force he uses on every attack. He tries his hardest to strike me as hard as he can. Beatings usually last around 25 - 45 seconds. Last night towards the end of the beats he put his fingers in my nose and pulled towards my forehead. Pleading to stop or asking for mercy just grants you a bigger beating. He hasn't punched me in the face or anything yet but that's just due to me protecting my face for dear life. In all of the beatings midway he'll try to peel my hands away from my face, and say"why you protecting your face" or "lemme see that face" or something along those lines. The worst part about this whole ordeal is that my mom watches it happen and at the end says "you just brought this upon yourself" one time after a beating we were all talking (about my behavior) and my mom says that she's not whooping me because she's tried it in the past and I've just laughed it off. That's not true. I just wasn't pleading for her to stop because she was using a cloth belt and It hurt very little. But I still stood there and took the belt whooping. I would rather get a whooping from my mom than from him. (I've known him for about 4 years) I don't know if I can take this to CPS because none of the beatings have left me with any bruises, but my ribs still hurt like hell. At one point he was elbowing them So hard it felt like they were about to break or something. He has also threatened to curb stomp me and put me in a hospital. We go downstairs and find my neighbor telling us he hit my car and begging us not to go to the police or insurance and that he will pay for everything. He relies on a CDL for work so we agreed. Neighbor drops off a 2k deposit to the shop and everything seems fine. Next we get a whopping 12.5k estimate and neighbor is mad and calls the shop. I ask for the money up front or tell neighbor I'm going to go through insurance. Neighbor agrees and says he can get me 5k this week and the rest next week. Yesterday neighbor shows up with 4k and a letter saying I've agreed to financial compensation in the form of 2k deposit, 4 k now and the rest next Friday. I look over it and sign. This morning I get an email from the shop saying he's asked for his deposit back and they are no longer comfortable servicing my vehicle. I told neighbor I am returning his money and going through insurance since he broke the contract. He replied to keep the money he'll see me in court. I have no idea what to do now. Branch manager was trying to convince him to follow company policy and wear a mask and the coworker said it wouldn't be necessary since he would be taking "military leave" to travel to Michigan and shoot liberals. Now, the guy is an old, surly hardcore Trumper. I've never seen him directly engage in violent behavior, but he has a history of being intoxicated at work and is pretty low key racist, so I wouldn't put violence outside the realm of possibility. I am concerned of the consequences of going to HR, as he is related to several mid to high level managers, and despite the protections the law ostensibly grants whistleblowers, I'm not willing to put my career prospects in the hands of the law. I've decided to report his actions to law enforcement. The question I have is who do I report to and is there a way to leave tips anonymously? Since this is a case of a citizen of one state threatening violence against citizens of another state, would this fall under the jurisdiction of the FBI or would our local police handle this? Posted: 06 Nov 2020 10:50 AM PST I live in Boston, MA. I have pet insurance. My cat had an oral surgery back in June. His teeth were severely infected so they extracted all his teeth. I paid for full extraction. The receipt, as well as my cat's medical documents show they extracted ALL his teeth (they explicitly selected all teeth in the documents). After the surgery I brought my cat to another vet (due to unrelated reasons) for a check. Vet told me that they probably forgot to extract two small teeth at the back of his mouth. She told me it's "probably ok and doesn't need to be extracted". Now months after, I brought the cat to the vet again today for vaccination and this time they told me those 2 forgotten teeth are infected and extremely painful as well. So the cat needs another surgery. This is terrible because the surgery costed me around $1300 since insurance refused to pay it. Now they're quoting a similar amount $1000 for this surgery. Moreover, my cat was severely traumatized by the surgery. His quality of life was very low for about a month due to surgery. And now he has to endure all that stress again. Although I can afford this surgery, I'm very pissed especially because I know my cat will be traumatized again. I'll call the insurance to see if they can pay this surgery but I'm pretty sure the answer is negative. Is there a possible case against the first hospital that did the surgery? I know it's been very very long time (surgery was in late June 2020, i.e. about 5 months ago) so I don't have hope. But should I lawyer up? Essentially my wife is a very wealthy woman but has been financially controlling (and abusive) and is now withholding funds from me so I can't access legal help. I am an immigrant from the UK and I have provisional permanent residency based on marriage, my wife is my financial sponsor. We have been married since April 2019. I entered the marriage with no assets and could not legally work until I got my employment permit this April. She came into a large inheritance shortly after we married, which I understand is not a marital asset. We used some of it along with a loan from her parents to buy a house which I believed we owned jointly, but I have found out I am not actually listed as an owner. This is where we live. We also used some of it to start a business of buying properties to renovate and sell together. We are a registered LLC and own two properties through that business, one of which recently sold for $1 million. Our plan was to live off the proceeds from this sale while reinvesting the rest into our business. I had given him the number for a one time purchase and I guess he held onto it. I immediately cancelled the card and contacted him. He claimed it was an accident (linked to his PayPal) and he paid me back in payments after me begging for months. He used the card only for Uber eats up to about $500. Yesterday I checked my account and there was $300 worth of Uber eats charges on my account again. I called the company and cancelled the card again and reported the charges as fraud. I'm confident the charges were him as he called me asking for money just a few days ago (right when the charges started). Him doing this maxed my card out which will reflect on my credit score. I'm irrate and confused as to how using the old card number is still working for him (I never gave him the new card number and he hasn't logged onto my account to get the new one). I know these are small amounts and suing someone for money who doesn't have money gets you nothing, but I am wondering if the card company will pursue legal action against him? Should I call the police and report it myself? Should I interrogate my card company on how he got the information? My card company refuses to close this account until the balance I already had is paid, the new card comes in, and the fraud is investigated from their department. They won't even let me transfer the balance to an entirely new account with them. Honestly I'm lost and feeling very violated. The entire relationship was abusive and ended a year ago and he's still finding ways to screw me over. So I need all the rational advice I can get since I'm thinking with my emotions! I bought the last one and know that the site then had the item as "sold out" on other computers after my purchase along with other similar items so it feels like a legit has "stock" situation. Well now it's Nov and I haven't heard anything. If I click the link in the purchase email for my order, it goes to a "page cannot be found" on their website. I've tried reaching out to them through the "contact us" section of the website. From searching the internet, it seems like credit card fraud cases can only be filed about 2 months from the incident which has now passed. Am I just shit out of luck? From googling reviews on the site, it seems like people often have issues of contacting them especially from Covid but people also claim that the products do sometimes come or complain that they're a little beat up from packaging, so I don't think it's entirely "take the money and run" scan either. They detective treated it more like a prank call and called it "annoying harassment" and "just block his number". The thing is, he calls from blocked numbers (and I have to answer all anonymous calls because of my job. And I can't change my number for the same reason. I have a pretty public job so I'm easy to find, by design) though he never threatened my with violence he was very aggressive in ways that would get me banned from this sub. I'm a 120lb female so I know I wouldn't be much to overtake so these calls and threats are really scary to me. Anyways, I'm not even sure I know the guy's real name. Is there anything else I should do besides the police report? Are there any other legal actions I can take? Posted: 06 Nov 2020 09:52 AM PST hi! the title essentially explains the situation, but i really need some advice on what to do. hes a type one diabetic (meaning his body produces almost no insulin on its own, aka insulin-dependent), and hes been struggling to keep his blood sugar down since he was taken off of his blood sugar pump. hes been in and out of dka (a diabetic complication caused by high blood sugar that makes your blood extremely acidic, VERY dangerous condition) for a few months, and almost every time hes gone to the hospital for it, theyve sent him home the same day, with his sugar still in the 300s, his ketones extremely high, him vomiting up anything that he eats or drinks, and him feeling the exact same he did when he left. the last two days, we took him to the er for dka, and he was sent home the same day. the doctor is claiming that all of his symptoms are because he smokes weed for his anxiety and stress. he has smoked since he was 15, with absolutely no symptoms like this, and we havent even had anything to smoke recently, so the entire claim is bullshit. especially considering hes been checking his own sugar and ketones and both are extremely high. we dont really know what to do! we have an hho and can only go to them, and theyre essentially refusing to treat his potentially life-threatening condition properly. i would understand if they claimed the nausea/vomiting was from weed, but his sugar and ketones absolutely say otherwise. im extremely worried if this keeps up hes going to die. what do you do in this situation?? it seems like medical malpractice from my understanding of it, but the addition of him smoking weed makes it more complicated so i really dont know if we even have a case. any tips on what to do going on would be a tremendous help, we just really want to make sure hes safe and healthy, thank you edit: he is in dka, this is not chs. his blood sugar and ketones have been going up over the past few days, even though he had been in the hospital (and discharged the same day) the past two days [link] [comments] |

We were too slow on a beautiful home in an amazing community a few months ago, and couldn't stop thinking about it. Then out of the blue a few weeks ago, another house popped up for sale in that same community! It's absolutely perfect and exact floor plan we want. However in this case, our agent told us that it's been difficult to get in to see the house since the listing agent said there is a tenant renting. We managed to secure a showing, but listing agent hasn't gotten back to us yet about whether or not the tenant is month to month or has time left on the lease. We really love this home (location, size, price, everything!!) but these are uncharted waters and especially because of the pandemic we don't know if we should proceed. My agent says we can put in the terms that property must be vacant before closing. Are there a lot of risks here? We live in Cali so tenants have a lot of rights. A few days ago the manager of the gym called me and said to me "you are behind on your bill I need you to tell me how you are going to take care of it". I ended the conversation and he sent me a follow up email that told me I needed to pay, I owed a fee for my transaction being declined and if I didn't pay soon "my credit would be ruined forever" and "costs would go up" (I am not sure this is legally relevant, I know these are not accurate but I am not sure if the laws of debt collectors lying apply in this case). I have the email from the manager that says my membership would be frozen at my request, and that "when we reopen we will give members the option to extend their freezes." and then another email later where the club manager (on 6/30) says that she will freeze my account for up to three months at my request. The gym than tried to bill me at 10/28 without any notification that they had reopened, or any option to extend my freeze. Overall I think this is a shady company and they lost money during covid and so they restarted memberships without notifying people with the express purpose of collecting some extra membership fees/late fees. In an email exchange with the new club manager he told me that notification was done "Through the state and local media and it is your responsibility to know when the club reopened". He also said (in an email) that "the members that did not return due to covid concerns were aware that "THEY" needed to contact us to re-freeze their memberships again, which is the exact opposite of what the previous manager said. Also, the billing cycle doesn't even match up, as if I froze my membership on 6/30/2020 the three month freeze would have ended on 9/30/2020 and you pay "up front" for your membership so the club waited until 10/28/20 to charge me with no notification or explanation which seems to indicate I could not have visited the gym between 9/30/2020 -10/28/20 (which I should have been able to if my membership was unfrozen) or that they extended the membership freeze beyond their stated time range. Either way it seems like the inconsistency and lack of notification is relevant. Do I have a valid case for small claims court here? It seems like it is a question of if employees of a company give contradictory answers to a question that is not explicitly detailed in the membership contract is the company responsible for that contradiction. Also, I don't expect companies to have laid out details of their policy in response to an event like covid so what are their allowances for developing new policies and implementing them ad hoc? Like if anytime fitness had notified me saying "due to covid we have amended the contract to the following the way you get notices for EULA and that sort of thing I would not presume I have a case here but they did not do that! Finally, in my contract it says that I agree to binding arbitration in the event of a dispute and am liable for attorney costs if that procedure is not followed. If I filed in small claims court would that be a violation of the contract I signed saying I agreed to binding arbitration? If I filed I would be requesting that the company reimburse me the 79 dollar membership/no funds fee from 10/28/20, the 40 dollar filing fee from small claims court as well as to waive or reimburse the next 59.99 gym fee that I will be assessed on 11/28/20 as I have not cancelled my membership within the contacts prescribed 30 day window. I would appreciate any advice and/or direction to any resources that I can utilize if this is something I could proceed on. Posted: 05 Nov 2020 07:35 PM PST I'm taking a company I worked for to small claims court. I was supposed to work two days @ $750 each. I worked one day but had to cancel the other day last minute due to an emergency. They sent me a check for $150 instead of $750. They don't want to pay the full amount so I am taking them to small claims court. They responded to the notice of service yesterday and, in their official answer, justified their action (withholding $600 from my invoice of $750) by claiming they had to pay the person that replaced me $1,500 (double my fee, $750) - it's a lie and it's written on their answer. I found the person they hired to replace me and recorded our phone conversation (we are both in NY) and I also took screenshots of our texts. They confirmed that they were paid $750 for the day that they were hired to replace me, not $1500. I don't want to go to small claims court because it's a pain. Do I email them and tell them the evidence I have in hopes that they settle knowing that it damns them or do I wait and go to court? I'm worried that telling them the knowledge I've acquired will give them an opportunity to strategize against it, although I don't think they have any way to do that. Thoughts? [link] [comments] |
[NYC] Car moved illegally, damaged in process Posted: 06 Nov 2020 02:24 PM PST So, I was parked in a legal spot on the street in Brooklyn. I came back a day later to find it missing. No signs or anything indicating I could not park there. I went inside the restaurant it was parked in front of, and they told me that it was moved down the street by the construction company. Upon going to my car, I noticed new scratches and my back left bumper was damaged. I took pictures and I went back to the restaurant and they informed me it was a private property owner across the street who was having sewage work done. I am wondering, what legal recourse do I have? The fact that it was just moved down the street suggests to me it was not any sort of officials moving it, just a private company that moved it (illegally?) because they were doing work. I "must" go to the office and sign this addendum by Christmas. Is there anything I should know before I go in? I'd prefer to honor our existing lease for now, and sign a new one when it ends, but I don't really want to jeopardize being allowed to sign a new lease here in February. [link] [comments] |
Posted: 06 Nov 2020 09:32 AM PST I live in Florida but this problem is rampant with apartments management companies across the state and apparently nation, as there are two class action lawsuits against other apartments in other states for this exact thing. I live in a large apartment building with over 300 units. It's managed by one of those very big property management companies but owned by a private company. Like many apartments in Florida, the apartment buys their water from the actual water company to the master meter. They then sell us the water to our individual submeters in our apartment. Our rent bill comes from the third party billing company the apartment chose to read our submeters electronically and has our water/sewer usage and charges for the two months before. So November 1 rent bill has water usage for September. It shows first and last of the month meter reading, gallons used, then charges based on those numbers. There is also a $5 processing fee.They are supposed to be using the same rates they pay the water company to buy the water, but these rates aren't on the bill. You also have to pay the water with the rent or you can be evicted. Since residents are not customers of the actual utility company, but the apartment, if water shuts off we have to call the apartment, and we cannot get utility gov assistance or payment plans as we would with a real utility company. The only reason I know all that i wrote above is through a lot of research. The apartment building refused to give any info and purposely and continuously calls the third party billing company (in another state) "the utility company" to mislead residents. My lease says water will be "submetered" for individual usage. Every single water bill I've gotten has inaccurate meter readings and overinflated gallons usage. The first several were just estimated. I take time stamped photos of the meter first and last of the month so I know for a fact. I have tried many times to get the office and property management company to explain the overcharges and refund me the difference and they refuse. I've tried asking them when the meters have actually been tested for accuracy. First, they tried invalidating it was an issue by saying my water usage is comparable to other apartments. Then they tried ignoring me. Then when I persisted, they tried running me around. Now, they are trying to intimidate me by asking if I want a "mutual lease ending" and saying they have investigated and they have determined there are no overcharges so the issue is resolved. But not once have they actually asked for my proof or submitted their own. I have tried to get assistance locally and through the state to no avail. The public utilities commission said they don't regulate the water company the apartment buys the water from and they don't regulate apartments acting like a pseudo utility company. I said who does? They said ask the city you're in and county. I've tried numerous offices in both and each have told me they don't regulate utilities in my city and county and don't know who do. One even told me no one regulates utilities at all because utilities regulate themselves. So I'm wasting my time talking to idiots who don't even know basic facts of their own government. I've tried contacting the water company the apartment buys water from and they said they have no regulations for apartments that buy their water and resell it. I've tried contacting the department of financial regulation and professional real estate licensing to report the property management company, but they said they only regulate structural issues in the buildings. I've tried contacting the consumer department but they said I can make a complaint and they will just send it to the apartment like the bbb with no force to make them do anything. Literally no one cares that this is going on and will help me and it's apparent why the apartment and property management company is so apathetic towards this, because they know they can get away with it! This issue is widespread in Florida with apartments as last year when I was looking for apartments, every single one within the three counties I looked used this "we will bill you for water through a third party company reading the submeter" scheme. My friend in another apartment is also being overcharged and her apartment refuses to do anything, so I have to think this is rampant across the state but no one in gov gives a shit to regulate it. If the utilities companies did this, they'd be fined. I'm sure they'd love to do it if they could the way the apartments are. There is a class action lawsuit going on in Texas over the same issue and another class action lawsuit in another state. I've tried contacting those firms to see if they can give me any helpful hints but they haven't responded yet. At this point, I want to know the avenue I can pursue through government to report it and have it actually looked at. Civilly, I will be suing the apartments and management company for treble charges of all estimated and overcharges in my county small claims court at the end of my lease, but that's not enough. I also want to initiate a class action lawsuit against them. I want to ask other residents if they are being overcharged and I want to write up a synopsis of what the apartment is doing asking them to take photos of their meter first and last of the month and contact me to start a tenant group, print it, and leave it in residents doors but my lease says no solicitation. Right now, my apartment is looking for any excuse to try to evict me for speaking up and all they have are retaliatory reasons which is illegal and I don't want to give them a legit reason. I don't know how to inform the residents and create a group without violating the no soliciting. So I ask legal advice to advise me of the best government agency locally, state, and/or federally to pursue this and also how to inform and gather residents to start a class action suit without violating my lease? Neighbor vandalized their own home and says they were robbed police demanding my camera videos Posted: 05 Nov 2020 05:24 PM PST Edit 2: I had planned to give the video to the local family court but they did not care at all. They had told me to contact police. I was leary of contacting them due to the issues I had with them previously. I don't know if I made the right choice but I gave them what I think is more than enough evidence to show that the robbery/vandalism was faked and the previous neighbor helped her Edit: I had some time to collect my self and have added additional information to give a better idea of the situation I am expirencing. My cameras have rolling memory and delete every xy days when filled should I be concerned? I did however find points of interest that may show that she did the damage her self. I am just concerned that I will end up somehow being pointed at as the person that did it. The old neighbor tried to message my SO on Facebook saying they would pay for the videos. I don't even know how she got her info for fb but she did and is helping the fake victim create a sob story. I think the old neighbor is working with the new one to make sure we did not catch her committing the crime before police do. A year ago my old neighbor hit my car and she knew the police worked with them to cover up the hit and run for her friend did. She moved and subleased her place to a person. That new person vandalized her own place and now is saying she is scared of the cameras and wants them gone I heard this on one of my cameras. After reviewing all of my video I am starting to think two things are happening. The first being that the new neighbor across the street is trying to blame the ex for damaging her residence and two the previous neighbor still owns the property and is subleasing. This may indicate that she might be attempting to commit insurance fraud as well. I have audio of the new neighbor being coached by who I think is the previous neighbor on what to tell the police. As I stated before the previous neighbor used police to get away with a crime. For this reason I am very concerned about turning over anything to police. I also am almost sure I heard someone coaching her in how to get rid of them too. The reason I am worried about working with police or giving video is because I am almost sure I saw the old neighbor remove evidence while the police were distracted and I am afraid that it will some how end up on my property. Lastly if my video does implicate the new neighbor I am concerned for my families safety and potential retaliation.
