We were discussing their violation and retaliation of my FMLA rights. During this meeting I decided to bring up another issue that was never resolved A customer began coming into the store alot when I started working there. ALOT. He seemed lonely and friendly. I was polite and nothing more. Then he began waiting for me on my breaks and I didnt like that. Anyway on my break one day he proceeds to tell me " if I fucked you, I'd kill you." I told my manager and she did nothing. She told me I couldn't do that and allowed the customer back. When I told my district manager her first response is " Well, what were you doing to make him say that?" I was shocked. I was doing my job and on my break. I recently purchased my first home, and I am having a dispute with my water company over water usage. The water company is claiming that I used 33.7 thousand gallons of water between 9/16 and 10/13, which was my first billing cycle. The first reading was 100 gallons, and their last was 33.8K. This is 4 to 5 times our past water usage. After calling the first time, the water company sent someone out for a reread, and confirmed that I do not have any leaks and the meter is operating normally. So, I went back to my construction company and asked for the water bills they paid, which they happily provided me with. They were billed for 0 gallons for two months, with a reading of 100 gallons two months in a row. I called back and told the water company this. They said, and I quote "if the meter says they didn't use any water then they didn't use any water". Obviously there was a mistake made somewhere by the meter techs with this company. My lot has about 7000 sqft of sod that the construction company watered with my sprinkler system for a month, not to mention that my house was the first built in my section, so there were weeks of every construction crew using my houses tap to mix drywall mud, mortar, and other construction water uses. I know this might sound like a small problem, but we just bought a home and found out we are going to be parents soon. I was not expecting to be slapped with a 400 dollar water bill on my first months bill. I am curious what my next steps should be here. I have called the municipal water company 3 time's and they refuse to admit fault. Is there any legal action I can take to get them to admit they misbilled me for the construction companies water? [OH] I am falsely being accused of sexual assault Posted: 05 Nov 2020 06:22 AM PST Last night, I received a message from a girl who I know from growing up (our moms used to be best friends until they had a falling out 10+ years ago). This girl messaged me saying that she wasn't sure if I remembered her, but claimed that I sexually assaulted her when she was 8 or 9 (I don't know how old she is now or remember the age gap, but she is probably 5-6 years younger than me - I am now 30). In her message she briefly described the assault and which house it took place in (the house I lived in from the time of 13-18). She has an accurate description of the house (white house near gas station with a covered front porch), but I have absolutely no idea what she's talking about. I can't even remember a time when she was over at that house (I don't recall seeing her since she was pretty young) let alone a time when we would have been alone and I know without a doubt that I don't remember ever doing such a thing. She said she just wants answers for closure (why I did it, why her, etc.) and that she'll leave me alone once I answer, but I obviously can't answer such questions if this didn't happen. I don't take these things lightly and don't want to respond and come of as dismissive, but I can't stand the thought that she believes I did such a thing to her. I'm not sure if she was actually assaulted and is conflating memories or people, but I just don't know what to do in this situation. Everything in me wants to respond to "clear things up", but I feel as if she won't believe me and I don't know what type of person she is and what lengths she would go to if she genuinely believes this. Posted: 05 Nov 2020 09:53 AM PST (WA) On election night (11/03) my wife and I arrived home to find a man sitting on our couch, high on weed and eating ordered food. Based on the candles he burned and the mess he made, he had clearly been there for hours. The police arrested him and recovered cash and gift cards he had taken from our kitchen table. Besides the mess, the smell, the property damage, and the feeling of being violated, the most distressing part was that the intruder had a working key (and mail key) to our apartment, claiming that it was either his girlfriend's or aunt's apartment, he never settled on either, and one of them had given him the key. My first thought was that the locks were not changed before my wife and I moved in, which the assistant property manager denied when I called her. I did some rudimentary research and found that Washington state landlords are not required to rekey apartments after each tenant moves out, but it is promised in our lease that the apartment will be rekeyed for every new tenant. I've since had two conversations with the main property manager, where they offered to move us into a new unit in the complex. I additionally asked if we could talk about a number of months being rent free, which she indicated that her higher-ups might not be in favor of. Finally, during our second conversation, the manager admitted to me that the only reasonable explanation is that the locks were not changed after the previous tenant left, although they are still confused as to the circumstances, essentially telling me that our lease had been violated and they were potentially at fault for the break-in. I now have the police report, and have emailed a copy to the property manager along with a summary of our last conversation in the hopes that we can follow up today. My question is, beyond what has already been agreed upon, what else should my wife and I expect to be entitled to, should we pursue further legal action? And what specific actions should we take? Neighbor keeps poisoning stray cats what can I do? Posted: 05 Nov 2020 11:28 AM PST To put it short we've had strays in my backyard for several years because of my moms garden. They eat whatever they can get their paws on. Unfortunately this means food that's been rinsed in some type of poison (guessing rat poison) I've only ever seen one cat eating a piece of poisoned food and it was a raw chicken breast. The cat eventually died a few days later. Now I'm wondering, is there anything I could do legally? These cats have been in our backyard for years but they're not registered/vaccinated so would that be a problem? They're ours but they're not at the same time? We just kinda let them do their thing. Well there's currently a cat outside succumbing to the poison and it's tearing my heart and I just wanna help these cats but I don't wanna do it completely blind sided. We live in a small low income town in SW Virginia, where a 3 bedroom older house was only $500 a month. I paid a $500 deposit when I moved in. The carpets were about 2 years old and in fairly good shape but they were the very cheapest thing you can buy in the lightest color. They had just a few spots nothing horrible and looked fairly nice. I'm a single mother of 3 young children and they were HARD on the carpets. I offered upon move out to have the carpets professionally cleaned, I paid OOP for that and thought the carpets looked wonderful. My two youngest's shared bedroom had one really bad spot that didn't come out and I offered for her to keep my deposit due to that to replace the carpet the room itself was 10x10. I never paid my rent late, I also had the yard remulched and landscaped due to her request when moving out. She showed up and let herself in every day of the week I was moving out, packed some of my things that I hadn't packed yet, all before my lease was finished. She called the carpet cleaners I had hired and let them know she was waiting on them at the house, she called the house cleaner I paid to clean the house and asked what all she would be cleaning. She was SO overbearing and I'm thankful we have moved on. She is selling the house, or wants to anyway. Asking price FYI is 39,000 for this house. The day I was getting my last load of things she was in the house when I arrived and immediately told me that the cleaning didn't cut it and they want me to pay $2500 to replace the carpets all through the house. I told her I simply couldn't just agree to that and photographed the carpets which look great other than in the one room. I thought my duty was to leave the home clean, which I did, not to leave it in brand new condition so she can sell quickly. Now she is texting me about the carpet cost wanting to know how I will pay for it. Is this legal? I feel like I went above and beyond to leave the house and exterior in great condition. Do I just tell her no and go to court if it goes that route? Doesn't carpet have a life expectancy and super cheap carpet would only have a few years life anyway if I'm correct of which I wouldn't be responsible for all of the cost? Asked Uncomfortable Question during Accommodations Meeting Posted: 05 Nov 2020 12:27 PM PST So, my company has a policy that when you request an accommodation for medical reasons, they hold a "process meeting" with you, the Benefits coordinator, your direct supervisor, and... I'm not sure what position the fourth person in the meeting holds. Although I work from home, the company headquarters is in Pennsylvania, USA, and thus follows PA labor laws. Although the Benefits coordinator "lost" my accommodations form, she explained the purpose of the meeting was to begin the dialogue of how I could best be assisted in doing my job without hardship to the company. My Accommodation request: change in schedule to an earlier time (reverting to my old schedule before the "company shake-up) because the medication I take for my Restless Legs Syndrome makes me fall asleep. I have severe symptoms, and not taking it in time makes me feel extremely uncomfortable into my legs/arms/chest, and I twitch terribly. My job is phone/computer based and sedentary. During the meeting, I felt like she did not take the condition seriously. I get it; many people do not. The name doesn't help: The part that made me feel particularly uncomfortable - that I'm wondering if it was even legal because it sounded so out of line - was the questioning of "Can you change medications - do you have to take this one?" Since it's physician-prescribed, does she have any right to question my treatment? Should I risk my reputation by reaching out to her supervisor and explaining why this question was inappropriate? So, my friend (Katie) is 20 and has always had a pretty rocky relationship with her parents. She was able to move out at 18 and now shares an apartment with her boyfriend. Unfortunately, her 16 yr old sister (Jen) has become a bit of a problem child. Their mom has kicked Jen out of the house for now. As she doesn't have anywhere to go, Katie is letting Jen stay with her in the apartment. I'm really concerned because Katie doesn't have enough money, support, or time to raise Jen. She's currently in nursing school and working close to full time. I live somewhere else, and can't help as much as I'd like. Katie is really scared to go to CPS as their family is Native American. Historically, they don't trust the government to look after their kids or help them. However, their mom isn't helping at all and refuses to take Jen back. I decided to give 2 weeks notice and be totally transparent as to where I was going and why, however, my current boss went off the rails and told me to leave immediately. I was escorted out of the building and was told by the HR rep that I would receive my last paycheque by mail, with a non disclosure agreement that I MUST sign. Do I actually need to sign it? The competitor that I am going to work for is a new start up and it will be my job to essentially get the business up and running. If the NDA includes "trade secrets" that would obviously affect what tools and techniques I would be employing... despite all businesses in my field use similar techniques, softwares and tools. My question is do I need to sign an NDA (despite already having quit, and with no severance or anything to entice me to sign it)? I just spent 2 months in the remote community of Angurugu and while there lived in a house supplied by the East Arnhem Regional Council. On the 10/9/2020 I had a housing inspection in which I was complemented on maintaining the property well and everything was marked 'satisfactory'. I left the job suddenly on Monday due to a dispute with my (former) boss. She then completed my outgoing tenancy report and marked everything in the house - every wall, door, and fitting - as 'dirty'. She also sent me bills for $680 for interior cleaning and $100 for yard maintenance. I contacted HR and they basically shrugged their shoulders. They sent me photos which show the house in what I see as a completely clean and normal condition. What can I do? I never paid a bond. He owns a 3BR house in an HOA and rents to two tenants on a month-to-month basis. At the beginning of quarantine, he decided to leave his house and spend the summer up north (CT) and leave the house in the care of his two tenants. He has performed his duties as their landlord but has not been physically present in the home. He has decided to remain up north and start a new career here and has decided that he will be transferring the property management to an actual PM company via his realtor. One of his tenants was having difficulty paying the $750/mo rent, so he gave her the option to pay a reduced rent ($500) in exchange for her mowing the lawn once per week. (A lawn service would have been $140/mo) In early September, he received a notice from his HOA that his lawn was unkempt and that he would be fined until he was under compliance. He spoke to the tenant and she apologized but he gave her notice to vacate. The second roommate has been claiming awful things about the non-lawncare roommate. Due to car trouble and other concerns, he was unable to get down to FL until now. He has been at the house the past few days and noticed numerous problems. Most importantly, the second roommate has been allowing her dog to relieve itself in the living room and has been covering it up with a dog bed to hide it. The non-lawncare roommate said that dog poop roommate has been allowing this all summer long. It has caused the floorboards to warp and it now looks like the floor will need to be replaced. Her damages ($1000+) far exceed her damage deposit ($500). There are other damages as well which you might anticipate from someone who's comfortable letting their dog shit everywhere. I think there were also damages to the central air unit. My friend can't really wait it out in FL and oversee their legal eviction and is wondering if there is any faster process based on the damage done to his property and the fact that both roommates have exhausted their deposits. About a year and a half ago my grandmother passed away. Before she passed my father had a stroke. He has aphasia, and cannot feel one side of his body. But when spoken to he can still respond, although the right words do not always come out, anyone who spends time with him knows that he's not just an empty shell and he's still capable of a lot, he just has to communicate differently now. My grandmother was of the belief that the men were entitled to certain things upon her passing and that she simply would not give something like a house to a daughter. My father is the only son and one of only two living children. Upon her passing my father was not notified and we had to find out through facebook. We were also not given the correct time for funeral. Over the approximate year and a half that my grandmother has been gone, my father has received no correspondence with regard to the state of his mother's affairs. Then suddenly my mother, who is his legal guardian, receives correspondence from my aunt's lawyer and it requests that my father renounce his rights and there was also a line about how doing this would mean he would not even be required to be so much as notified about the going's on of his mother's assets. This would leave everything to the aunt who did not tell her brother that his mother had died but instead told his nieces (daughter's of his deceased youngest sister) who then made posts expressing their sadness about the issue on facebook, which my mother just so happened to see. When my mother spoke to the lawyer he told her my father was incapable of handling such a responsibility, he said nothing about why he wasn't even entitled to know what was happening. And he said that he'd fight this in court. I'm wondering what your advice is. My mother has been instructed not to speak to my aunt's lawyer anymore. In our original parenting plan, we shared overnights with 5 nights/wk with me, 2 nights/wk with him, + shared holidays. Over a year ago, our childrens' and family therapists had concerns about his parenting and thought overnights were detrimental to the kids. I was going to start a PRE, but my ex agreed to no overnights/no holidays and signed a new PP my lawyer drew up, which is filed with the court. Current plan is my ex sees the kids 2x week for 3hrs. In 18 months, my ex has never exercised his right to see the kids during those times. I have let the kids go over when his parents were visiting or for birthdays, but they've probably only seen him 4-5 times in 18 months. NOW: My ex is planning on moving out of state. He hasn't said anything about what he envisions visitation to look like. I half expect him to just leave and make no motion to see the kids. He doesn't have the means to take me to court. Is this a form of abandonment? Is there something I should file after a period of time? If he leaves, can I move out of state, too? Now they want me to sign a piece of paper that states "Federal law requires the lender identified above with the appraisal...at least 3 business days prior to the loan closing..." And then it repeats in a paragraph below "By signing below, I/we hereby acknowledge that I/we received a copy of our appraisal 3 business days prior to closing." Can I be sued for a freelance project I cancelled? Posted: 05 Nov 2020 09:34 AM PST The scope of the project was a website design for a presentation for an agency's client. Long story short they had miscommunicated the project scope and also were very abrasive with feedback. I felt it was not a good fit so I sent an email cancelling the contract. My contract states I may cancel at any time for any reason with 7 days prior written notice and in the event of termination the company will pay the freelancer for hours worked. Honestly I used a template another freelancer helped me write and I do not know if I breached my own contract about the 7 days prior part. Does that mean I was supposed to work for them for 7 more days? They did not bring that up and pressure me to do more work for 7 days, but they were very angry i sent in invoice and then I was met with a verbal threat to be sued for "liabilities and damages" I caused their company. I have never heard of this happening and feel it can't hold up, especially that I sent a first draft that was within the first scope of the project and I only worked a few hours. I am interested in whether my report could be interpreted as libelous, if I were to report it to say, the Humane Society, or PETA, or the Dept. of Agriculture or whatever. She also doesn't pay taxes, but I could let that slide to protect myself and not cause shit. I plan to STAY ESTRANGED, which means not talking to her or my family ever again, and I'm wondering also if that's even possible, or if she would be able to find out who is levying these claims. They wouldn't mention me right? Or need me for court? Ugh. I have witnessed with my own eyes my aunt become intoxicated before her female dog was in labor, and I remember one of those dogs not making it because she stuck her finger in it's throat. I remember her striking the dogs when they bark, and them barking nonstop because they've been struck (behavioral issues are common in abused animals, so I hear). My sister (who I love) also remembers her allowing incest between the dogs out of negligence, which if you don't know, can lead to major birth defects, and I'm fairly certain has to be illegal. She doesn't dispose of waste properly, throwing it into the yard (where the dogs play). I'd describe her house (facility) as a puppy mill. I can't prove any of this, but I guarantee she still operates similarly still. I've been estranged for a year. She considers herself a "hobby breeder", which is something the laws do talk about, from what I've read. I'm not a lawyer, tho. Posted: 05 Nov 2020 09:55 AM PST [USA-MARYLAND] As the title says, I work for a company in a seasonal blue collar role. I have been there for just over a month now. Everything was going fine until last week when I did not receive my paycheck, which I get direct deposited weekly. When I called the companies HR support center, they said it is because I have been terminated for over a month now. This is confusing because I have been working this entire time getting shifts, punching in and out at my job, and getting paid weekly with the exception of this past week. I also checked all my email notifications(including spam) and have no letter of termination(mail or email). This is beyond frustrating because I have bills to pay, and my bank has already slapped me with overdraft fees, which would not have occurred if I was paid on time for the work that I have completed. Even worse when I asked my manger in a message if he would be able to send me a transcript of the hours I worked for the first week, that I have not been paid, he later responds in an email that I need to send him the hours that I worked!?!?! Since then I have been taking pictures of my punches with my phone, and documenting everything saving all emails of job specific updates which I am still getting, to make the case that there seems to be a mix up somewhere. It's going on three working weeks without getting paid and with the overdraft fees from my bank I feel that this company is at fault for those fees as well. I'm going back an forth with HR every few days(will start calling everyday), but nothing seems to be happening. I am simply asking for general advice and do not intend to leak anything. So I am a contracted inside sales representative for a start-up company. We sell products to other businesses for them to retail. We also help do sampling at some locations to help push our product. The primary place of work, as stated by the contract, is in the city of LA; however, I typically work from home since there literally is no office. When I'm at home I am cold-calling, emailing, connecting with clients with the goal of setting up meetings with businesses, ultimately so they can buy and house some of the products we make. These meetings are often far. I have been getting paid 55cents per mile and the hours spent driving. My boss has been pushed to a corner as the growth of the business has become stagnant for a couple weeks. I am convinced that funding for business has run dry. I placed my letter of resignation recently and we had a discussion about final pay/commission/expenses. He tells me that time driving should not be counted as billable work hours and wants me to report to him all the unproductive work hours I was paid. I feel like I should be paid for the time I drive to these meetings, which are often not in the city of LA. I do often work during these commutes, whether that be calling/talking to clients, listening to work-related podcasts, and scope out potential business partners( all or which I have been instructed to do). I also pick up business-necessary supplies on the way to these meetings. But I do my fair share of simply driving too. TLDR: Do I get paid for hours driving to meeting clients? I don't have a drivers license and she has my insurance card, I don't even know if it's still good. I don't even have my own bank account or a credit card. The ONLY form of photo ID I have is a student ID from high school, which I graduated from already. I need my shot records, social, and birth certificate in order to be able to apply for school soon. The vital records office told me no cause I don't have any ID, the social security office said no cause I don't have a birth certificate, and the public health department said no cause I don't have a picture ID. I've been running in circles and no one can help. What can I do do get these records or can I make her give them to me somehow, legally? [link] [comments] |
Keep Getting Calls re unknown person Posted: 05 Nov 2020 12:27 PM PST So maybe this is nothing, but it's making me nervous now. Back in Aug., I get a call from an unknown on my cell asking for a female with a first name,last name I don't know. I tell them man I don't know who that is. He then asked, "Is this (my first name, last name). I don't confirm it's me and ask what this is in reference to and he again asks if it's me and that he's calling in regards to this other person. I tell him that this other person is unknown and to not call anymore. He hangs up. It was weird, but I didn't give it much thought after that. This Monday I get another unknown number call, again asking for this person, this time the guy (not sure if it's the same person from August) says it's in regards to legal docs being served and that my name is listed somehow. I repeat that this person is unknown and ask what it's about, he asks if I know this person, which I again deny but he won't give me any info. I again ask whoever it is to remove my number from this since I'm not involved. They hang up. It freaked me out that they mentioned legal docs so I went and checked my credit reports, all clear. Today I get a call from my mother that some one called the house phone (I don't live there anymore but it was my home number for decades) asking for this person and saying that I was listed as a reference. She said we don't know who that person is and they hang up. This is the third call, all from unknown numbers, never giving out much information or answering questions. I asked them to stop calling twice, they still call. I have an LE adjacent job where any kind of legal issues are a huge no no. I don't want any king of legal issues, even in error.
