This is an update of my previous post: https://www.reddit.com/r/legaladvice/comments/i1sadd/giant_dog_giant_bite_giant_mess/ There was a lot that happened in between that post and now. 4 days after our dog was bitten by the dog, the owner took the pit bull back to the same dog park and bit another dog! The police were called on the aggressive dog. The dog warden that showed up happened to be the one that took my case and statement. He recognized the name and while he was standing there getting the owner's information and statement about both dog bites, the dog bit A THIRD DOG! He then asked the owner not to return and banned them from the park. We did take the owner to court. They argued negligence. We argued liability. They argued that the following dog bites weren't relevant and had an excuse for every bite. They said their dog accidentally caught our dog in the face and wasn't being aggressive and the dog wasn't being aggressive the other two times either. They said that they took responsibility for it and admitted that their dog bit our dog, but that they didn't owe the whole amount. It was 'the principle' of it, according to them. The judge took everything into consideration and said he'd have a judgement in a few days. We got the judgement the next day and the owner owes us the full amount. I'm glad it's done and I hope the owner learns their lesson. Mulitple dog bites within one week means you shouldn't take your dog to the dog park. [link] [comments] |

Washington State Posted: 22 Oct 2020 12:48 PM PDT The band on my engagement ring broke, I took it in to have it repaired at a jewelry shop. They did the work and mailed the ring back to me (I'm not local) but the "diamond" they sent back isn't mine. My stone is a 2ct real diamond with a tiny bit of clouding visible to the naked eye. The stone they sent back is literally perfect. Unfortunately, I don't think they gave me I higher quality diamond I think switched it out for a fake. My diamond is a family heirloom and honestly holds more sentimental value than monetary. I called the store and after talking to like 5 different people I finally got the owner and they insisted that it was my stone but their cleaning process is so good that my stone probably never had clouding I was just shit at cleaning it and joked about me being a Karen. I have the paperwork from when the stone was purchased, it shows the imperfection. I'm taking my stone into another jeweler this afternoon with my paperwork to see if it's the same stone but then what? Do I call the police? Do I call a lawyer? Do I call them back and tell them I know they're full of shit and threaten to post on yelp like a Karen? Edit: The new stone is a fake. Local jeweler called shady jeweler. My stone was miraculous located. They're refunding me and driving the stone here this afternoon to a THIRD jewelry store (jewelry store that verified it was a fake doesn't do this kind of work.) and are paying for the work. [UPDATE] Neighbor is using land for hosting campers (upwards of 200+) Posted: 22 Oct 2020 12:02 PM PDT Previous Post Original Post Link TLDR; the campsite was closed down, internet site removed and there seems to be no moves towards making a new campground! Thank you all for your advice and motivation, the zoning board was contacted by (my count) an upwards of 20+ people within the week following my post. The board updated us saying that this is not the first they have heard of/had to shut down sites that are advertised online and that they would conduct a more formal investigation on-site the following week. The administrator who came to investigate did so that Monday and within 24 hours the site was no longer accessible to the public and all "amenities" were removed from the land, as well. All neighbors have now been provided with some important (non-emergency) numbers to call if anyone sees camping activity in the future. Again, thanks to everyones advice, it gave my neighbors and me some great insight to an issue which seems relatively new! [link] [comments] |

I'm majoring in kinesiology and decided to apply for this job to get experience in the field on the side of taking classes. I usually teach a few classes a week. When I was hired they mentioned that one of my expectations as a trainer was to attend workout sessions of other trainers in both the franchise I work at and other franchises in the area. My boss said I should plan on attending at least two classes every week as a new hire. They mentioned how it helped to build a community with the members and with the other branches. She also said that it would be helpful to learn from the other trainers and the different workout sessions they teach. At first this seemed like it would be a benefit of the job as I would be getting free training which otherwise would cost a good sum of money. However, now with my school work increasing and several other responsibilities I've found it very hard to attend even a couple a month. A little while ago my boss confronted me about not attending more classes and explaining how it was part of my responsibilities as a trainer. Then, just the other day she confronted me again. Even after explaining that these workouts interfere with my powerlifting schedule and school work, she insisted that it's part of the job. She tries to frame it like I'm getting free classes while everyone else there is paying for it. But if it were up to me, I would never want to go to a single one of these classes. I'm starting to realize that by going to these workout sessions, it's pretty much training disguised as perks of the job. To me it feels like nothing more than work training and improving the experience for the customers. Although she never explicitly said I would be fired if I didn't show up to any sessions, it feels as if I'm on thin ice with my boss. I'm wondering if according to US law, this would count as illegal unpaid training or if it falls into a different category because of an exception. I'd appreciate any insight! However, my girlfriend and I messaged him and spoke to him asking him what else he may have done and it turns out that he has been masturbating above us while sleeping, onto our clothing, our socks, our shoes, he touched my penis in my sleep, and he would wear my girlfriends underwear. This was all admitted by him over text and has all been occurring for years without us knowing. Disabled son being sued by a debt collector Posted: 22 Oct 2020 07:41 AM PDT Hello All, My autistic 22 y/o son has been sued by a debt collector. He gets SSI and works in a sheltered workshop (an employment service run by a nonprofit to give disabled people a sense of worth.) He only has one credit card (Walmart, $300 credit limit) that I opened with him a few years ago to teach him some basic life skills. He does not have the capacity to open a CC account on his own or even handle basic financial matters. I handle all of his financial matters. Apparently, someone used his SS# and opened several accounts (I pulled his credit report). All the accounts are closed and derogatory. I've already taken steps to resolve the ID theft. (Filed a police report, disputed with the credit bureaus.) The court papers he was served today have a single credit card statement from Amazon with an address in another state that I don't recognize attached as evidence. How do I handle this lawsuit? I guess I have to hire an attorney? Can I handle this myself? And no, I've never received any paperwork, bills, or statements other than the paperwork served by the Sheriff. I'm in Pennsylvania. We own just over an acre of land, however much of it is under the nexus of two sets of converging power lines, limiting what can be done with the land. There is a large shed on the property beneath one set of power lines. The fact that it violated the easement was brought up when we did our inspection. The former owners assured us that there had never been an issue. I didn't want to take the word of someone trying to sell me something, so I contacted the power company directly. I was bounced around from department to department, put on hold for a combined total of several hours, promised callbacks that never came... pretty much the sort of thing you'd expect from a utility company. I never got an answer. This was the only holdup. The owners sent an email through our realtor that basically said "The shed has been there for 10 years, it's on the official land survey registered with the town, the appropriate permits were pulled when it was constructed. If the electrical company had taken issue, it wouldn't still be standing where it is after 10 years." There seemed to be logic in that. I verified that the shed was listed on the land survey (it was) and at the urging of our realtor, we signed the papers. Last week, the power company sent a cease and desist regarding the shed. Come to find out, it is the eighth cease and desist that has been sent to this address regarding the shed, which we now have 30 days to remove or relocate at our own (significant) expense. The restrictions on the easement (nothing within 100 feet in any direction of power lines/poles) mean that there isn't anywhere on the property where the shed could be relocated, save for the front yard. I am incredibly frustrated. The previous owners lied about having issues, as they had received 7 cease and desist letters. Now we have to spend thousands of dollars to destroy something I don't want destroyed and cram a snow blower, a ride on mower, and everything seasonal into the garage. Contractor drilled into my gas tank Posted: 21 Oct 2020 08:43 PM PDT Need help about what my legal options are. I'm in Oregon. I am renovating a camper van and hired a small company to help build cabinets and install solar panels. A bunch of little things happened along the way that were disappointing, but finally I've reached the last straw. I was quoted $4000 or under for the work, which was fine. I dropped off the van (45 min away from me) and me and the guy discussed everything I wanted. I described the counter tops, the cabinets, and electrical system how I wanted. After a few days, the odd mistakes started happening. I bought all the supplies needed to set up the electrical system, then when I brought them he said they were wrong so I drove all the way back home. He texted me an hour later saying he could actually buy them from me, and then didn't pick up when he said he would. Not sketchy at this point, just annoying and inconvenient. Then, he asked if I wanted the countertops the same height or offset. I said for sure same height, keep them in one piece. He sent me a picture the next day and the counters were offset. I was super disappointed but didn't say anything because the damage had already been done. We also talked in detail about how I wanted the cabinets, which turned out not at all like I had described. He also highly recommend connecting the solar panel system to the actual cars battery. I agreed, and when I came to pick it up he said the part didn't arrive in time so it didn't end up happening. The final amount was $7500. I didn't know what to do except pay him. He said he could show me receipts, but did not. The last straw- yesterday I filled up the gas tank for the first time since I got it back. I started smelling a strong smell of gasoline and started to feel super woozy from the fumes. I figured it just needed to air out? I didn't know. The next morning I went to drive it and it was just as strong as before. I went to a mechanic and they inspected it, and they told me there was a big puncture in the top of the gas tank. So, when the guy installed cabinets he drilled right into the gas tank. The mechanic told me it would be at least an a-thousand dollar fix. I called the guy who installed the cabinets and he said if I brought it up he could take a look at it, or offer me $500. I feel SO taken advantage of, I am a 20 year old woman who obviously didn't know much about cars or carpentry. I at least want the $1k, if not more. What are my rights here? A new neighbor moved in after our old neighbor retired to a community home due to the pandemic. The new neighbor has a small, vicious dog that they refuse to leash, fence or control. My step-mother tried making friends with at first or keeping it at bay. My step-mother reported the dog being loose to animal control after trying (and failing) to communicate with the owners. Animal control did nothing. Several people in the neighborhood (including small children) were chased and bitten. She reported this to animal control. Animal control did nothing. It attacked her pretty badly. She had to pry its teeth from her skin before it would let go and the owner was screaming and cursing at my step-mother. She thoroughly documented the bite wounds and interactions and emailed it to the local animal control as well as called. They finally sent someone out to have a "talk" but lo and behold the dog was out the next day. She was again bitten this month. Once again, she documented and emailed it to animal control. Several of her neighbors have also documented and reported bitings. Animal control continues to do nothing. Because it's a small dog, they aren't taking it seriously. My step-mother has repeatedly asked for the rabies vaccination information from the owners, but they have failed to provide it (and it is not on the dog's tags which I think isn't allowed in Indiana?). At this point, most of the neighborhood and my step-mom are afraid to leave their house. What can they do? tl;dr: Small dog has repeatedly bit step-mother and neighbors (including children). Sob story background: -I bought a cheap car for my friend to use as he was out of a job and needed a way to go to interviews. -Fastfoward, car is stolen. -Car is MIA for 5 months and then the police say they found it and it's at a towyard. -I go to the towyard after work and the already cheap car is damaged beyond repair and the towyard wants $600 to get it out as they've been "holding" it for 2 days, even though I had just got the call that morning. -I refuse to pay as the car can't even be fixed Fast-forward to now, a debt collection agency is asking for $2200 for the storage fees of the stolen car that they have since sold at auction. I'm salty about the whole situation, but my question is what should I do? Should I just pay it? I know my emotions got the best of me as I was pissed when I was told that I had to fork out $600 to get a car, that wasn't even usable nor that I would even be driving, back. Judge Ruled in Favor, now what? Posted: 22 Oct 2020 12:09 PM PDT Howdy, So I ended up taking my old apartment complex to small claims court over excessive fees and claims of false damage. No one from the apt complex showed up today in the courtroom or via zoom. Ha. They had said that I and my pet had heavily damaged the carpets, the paint, and drywall, along with 2 kitchen cabinets. Long story short, showed judge the exact photos the apt complex sent me of the walls and carpets and asked if that constituted charging me $1500+. 1 spot on the carpet was a light boot print from my final walkthrough, and the paint damage were a couple small spots where we missed a mark.Drywall damage was tacks and screw holes. Left the cabinet doors in the wall pantry becuase the screw holes were stripped. They wouldn't come via work order cause covid to drill and screw them back on before we moved out. They charged me $150 for "cabinet damage". I just wanted a few things off, but the Judge took everything off and is giving me my deposit back plus the court fees. The judge had the Proof of Service that says I informed them, and I also had copies of emails from leasing office manager saying they would appear. The Judge said she cannot force them to pay me, and I would have to persue it on my own if I wanted them to cut me a check. What do I do at this point other than go and give them copies of the verdict? Edited for spelling. Edit: My security deposit plus court costs are $270. Origional move out costs were $1664.44. However, I quickly came to realize it wasn't the safest option. I told myself that next quarter I would do online for the safety of myself, my family, and others. However, it is now the new quarter and the school isn't allowing anybody to switch despite 200+ students being quarantined in the last week. In order to switch they are requiring a doctor's note and a diagnosis of a disorder that would make it unsafe to expose yourself to COVID. I had my psych and a general doctor send in notes but the school denied them as legit reasons to switch. I've felt very panicked about having to return as more and more people are being quarantined. Also spoke at length with salesman and finance manager of how I use my vehicle for Doordash. - Read service contract two days ago (11 days after purchase): SERVICE CONTRACT DOES NOT COVER COMMERCIAL VEHICLES USED IN PICKUP/DELIVERY CAPACITY. - Service Contract states that a full refund is granted within 60 days of purchase (as of writing this, 13 days after purchase). - Spoke to finance manager yesterday morning asking how refund would be processed. He said he would call me back in the afternoon. Never called. - Gave him another call this morning. No response. - Gave courtesy call to General Manager this morning as well. No response. Then her actual OB came in and started to do the exam and my wife asked why she had to do it again. Her Doc kept apologizing and freaking out saying she never gave anyone consent to do so. I've recently found out my car was illegally towed and sold by a towing company. At the point of towing I had believed my car was repossessed by the crediting bank back in February, unfortunately I got a call from said bank wanting to settle on the amount owed for the title. I told them I thought the car was repossessed and they informed me they had no knowledge of towing and they didn't issue a repossession. I tracked down the towing company, and when asking for information they said they sold it. I didn't get any notifications from them that they even had the car. When they said they sent two certified letters to me I asked for the address and they would not tell me the address they sent the letters to even though it was supposedly my house. I owe my bank 16k and now don't even have the chance to recover my car. What steps can I take to recover some of the loss and hopefully save someone else from this happening to them. Before things went bad between her and her husband they bought a car that was primarily for his use but only had her name on the title and registration. Some time later they separated and he took the vehicle and sold it in OH without my sister appearing or consenting to the sale. I have no idea how PA/OH law treats marital property but it seems that my sister should have at least had to appear before a notary to sign over the vehicle or at the dealership to authorize the sale of the car. Lot size dispute with new home builder in CA Posted: 22 Oct 2020 11:26 AM PDT Good morning everyone, I was hoping to get some advice on the appropriate course of action with my home builder in California. In January of this year, I put a deposit in on a new house that had yet to be built in Hanford, CA and signed the massive amounts of paperwork associated with that. One of those documents was the site plan with the lot dimensions . I waited many months for the house to be built, closed escrow, and moved in in August. One of the aspects of this house I was excited about was the backyard which (according to the signed site plan) should have been 61.5x65 feet. Unfortunately, upon realizing it was smaller than expected I measured the backyard to find it was actually only 44.5 feet deep vs 61.5. I contacted the management office who put me in contact with the manager of the entire construction company. They got back to me a few days later, apologized and then pointed out that although the backyard dimension is 17 feet short of what is written on my site plane, the OVERALL depth of the lot (at 108') is in fact accurate and it was simply an adding error on their end. They offered me either a free fridge (which I already had) or $1000 (which I felt was well short of what I deserved) to sign a release of liability and go away. They will not budge on this at all. I reread my contract and found a clause about non-adversarial procedures for construction claims (via CA S.B. 800). I'm obviously not a lawyer and trying to read these documents is confusing me to no end. My basic understand is that this CA document covers procedures more for defects in things such as windows, roofs, etc., and not purely a screw up on lot dimensions. Additionally, there is no way they can extend my lot as there are houses immediately behind mine. My main question is whether I should pursue the non-adversarial resolution route, sue them, or take my $1000 and move on if it was simply an oversight on my part to not see their glaring math error on my initial signed site plan? Link to my post in r/homeimprovement, but here's the jist: roofing nail fell into my AC and busted the coil- new unit needed (coils are usually not a 'repairable' thing without totaling the unit). For the discussion, we can assume that they are liable, with no language in the paperwork absolving them in this case. The issue- I had a guy lined up to replace it this morning. The roofing company now wants (needs) a few AC quotes/inspections for their insurance.. but that is pushing back my new installation- I CANNOT go another night without AC, we have a toddler and a newborn, and it's hot as hell in Louisiana (82 in the house last night). Here's the question, do I even NEED to accommodate their insurance? It has been suggested to me that it's their problem to figure out, and that it's not really my problem what they need- I don't want to be a dick, and I'm not super interested in making this a legal battle (though my wife works as a paralegal, but she super hates to ask for legal favors, but I'm sure a strongly worded letter wouldn't be impossible at least), but if I'm just eating this heat for the sake of their own convenience, I'd rather take it a different direction, namely getting my new unit installed, and letting them figure it out from there. Posted: 22 Oct 2020 01:15 PM PDT Hello everyone, I own a 2 year old Mazda which is still under warranty, and brought it in because of an issue affecting the blind spot monitor. When driving on the highway, if someone passes me on the right / passenger side, the blind spot monitor stays on for several minutes after the passing car is gone. Needless to say it can be pretty stressful / dangerous getting a false positive warning on my blind spot monitor while switching lanes on a highway. I brought my car in yesterday, explained the issue in detail, and made sure the written summary of the issue was accurate. Since the car is under warranty they say that the $240 diagnostic fee will be waived if they find something is wrong and it wasn't caused by any fault of my own. Later that afternoon I get a call saying they were unable to replicate the issue, but they would waive the diagnostics fee as a courtesy. They also tell me they can run more tests the following day but I would then have to pay the diagnostics fee, which I decline. 30 min later, they call me back to say they found that the car battery voltage was low and could potentially be the cause of the electronic issues. Since the car is still under warranty, they tell me they will change the battery at no cost to me. This morning I picked up my car, but realized when I got home that the "mileage out" listed on the service invoice is exactly the same as the mileage in. This is weird since the invoice also states they "road tested the vehicle at different speeds" without being able to replicate the issue. My current odometer reading is consistent with the the mileage stated on the invoice plus the drive home, and there is no testing mileage accounted for. On top of that, I looked over my car's dashcam, footage stops after my car was parked by the valet in a neighboring commercial parking garage, and resumes this morning in the shop with the hood open. I don't know what happened to the footage of the car being brought from the garage into the shop. I'm wondering what my options are here, although they did replace my car battery free of charge, I know the odometer doesn't lie and they didn't try to replicate the issue I brought my car in for. I want the issue with my blind spot monitor treated seriously and fixed, and I don't know if calling / confronting the service center is the best course of action, or if I should try and talk to the manufacturer since this probably constitutes fraud? Threatened with a lawsuit by an upset customer Posted: 21 Oct 2020 10:27 PM PDT I'm from Lacey Township in New Jersey. I work midnight shifts at a convenience store, and we have a clear mask policy; if someone is not wearing a mask, they are to be asked to leave. A few minutes ago, I had a customer come in wearing a mask with his nose hanging out over it. When a customer does this, I like to politely ask them to fix it. If they refuse, I politely ask them to leave. I feel I shouldn't have to risk my health because my customers don't want to wear a mask. This customer, however, began filming me. He asked me why I refused him service, and I explained that not covering your nose is fundamentally the same as not wearing a mask at all. He then began to try to stoke an argument (I think he was trying to get me angry). I explained to him that I'm not here to argue with him, and if he doesn't want to leave I will have to call the police. He responded by saying he's going to contact a lawyer and sue me. He also threatened that I'm going to "be famous", which seems to imply he's going to post the video online. I highly doubt the video will "be famous", as I was calm and collected the entire time and did my best to defuse the situation. I live in a fairly Conservative area, in fact there's a resteraunt nearby that has gained some controversy for refusing to enforce mask rules. In other words, I'm used to having to ask customers to leave. But should I be worried about a lawsuit? I've been threatened with one before, but I've never been filmed. [link] [comments] |
