Unemployment Claims from Strangers Posted: 03 Sep 2020 05:06 PM PDT We're a small LLC and recently got two letters from CA Employment Development Department (EDD) notifying us that "employees" were claiming unemployment against our business. In both cases, I've never heard of the claimants. They certainly never worked for us. The notice includes a form I can fill out with information about their employment, reason for separation, etc, but there's no way to say "this person never worked for me." I also can't find anything on the EDD website and it's nearly impossible to talk to them on the phone. Instead, I printed and signed a letter and mailed it back. I know this was not the best decision to make during a pandemic, however my dissatisfaction for my job grew worse everyday to the point I was physically sick walking into work. For the last 10 years I've worked in the Automotive business selling cars, working in the call center and managing the call center. My skill set is great in those areas. I just know I cannot continue to work in that world any longer. I have a small blog that I work on and a YouTube channel. Neither generate me much money at all. I have basic skills in digital marketing, design and seo. I got noticed on social media for a medical condition I YouTubed about and it blew up, I get Instagram and emails messages all the time asking for my advice. I also have done makeup on the side as a licensed makeup artist and did very well pre-covid. I also own my own brand of false lashes that I haven't done much with these past 6 months. So a few things I've thought about jumping into are possibly a VA (but no idea where to promote myself) I am great on the phone, problem solving and setting appointments. I know my skill set is valuable and has done well for me in the sales world. I also enjoy crafting- making t-shirts specifically. I have the opportunity to invest in a circuit to make my own t-shirts but worry about not making any money and investing a ton in supplies. I suffer from adhd so the follow through is tough for me- it's a daily work in progress. So as you see I have plenty of ideas but no direction. I don't know what to do but I know I can't continue the way I'm living. I want to do something fulfilling and be able to spend more time with my children. We struck a preliminary deal with 2 amazing people to run the business for a year in exchange for a small ownership percentage. I know your initial reaction may be to caution us from doing this for various reasons but we feel this is a win/win and necessary. The deal is for 1 year of a certain set of responsibilities for the ownership share. If, at any time they decide they want out, we will pay them X dollars/month to handle those duties. At the end of the year, they are awarded the shares. Question: What kind of document would be sufficient to document this? Also, since this is so unconventional, is it even legal? I am looking for something that can be exported and sold in the country as well. The business should be something that can be done by seniors with zero tech skills (except perhaps using Facebook and email) and should not need any dedicated space like a factory floor to operate. Now, over the course of trying to find such an idea I stumbled upon a few books made by International NGOs. The books are fantastic. They know the situation people in the developing world go through and they address all such relevant points and challenges. The books talk about several ways of doing business whether you have a small investment or a large one and how to grow it etc. An example of such a book would be a few of the growing mushrooms books by FAO of the UN. There was another book on handicrafts by a similar agency but I can't find it now. Anyways my question here is this: Does anyone know of a website or a similar organization where I can find similar books on a wide range of business ideas so that I can choose a business idea that would suit me and my situation? I have a tik tok, Instagram and a depop and I know I should be posting more and more regularly, and I need to update my packaging, but I have such a problem with feeling like I don't want to take up space. I don't want to be too loud, too "look at me", too often reminding people who I am and what I do. I know I am talented, but I can't bring myself to be public like that. I know I should show my face on my tik tok or even use my voice, but for some reason I'm only comfortable with complete anonymity - and even then I don't want to be vocal about who I am or anything about me. He has been freezing some of the items in the menu and delivering in bulk around the city. I had the idea to make it nationwide as it is something with wide demand for a particular ethnic community. What are the legal issues with this? Does he need any other permits or anything similar? Right now he is just packaging items in a ziplock bag, are there other guidelines for packaging or labels? Posted: 03 Sep 2020 06:21 PM PDT Okay so long story short. I had a customer get extremely rude and irate to the point where I was a little worried I might be attacked. I am not going to lie it was not my finest hour as I was having to get loud to be heard over him and I did scream from the front door for him to get out of my store. I ended up having to go get a police officer who was sitting in the parking lot to come and remove this man child from my store. Now I have a one star google review from someone who says they were in the parking lot getting ready to come in and saw me yelling at a family with children (it's not my fault he decided to do this with his children present). I am trying to figure out how to respond. The response I have written starts with "I will take your one star review and wear it with a badge of honor as you are ignorant to the facts..." How should I really respond and why the hell am I having to defend myself when the police were involved? I feel like it should just be removed after I produced the police report. Thanks for the help! Need a functional/practical definition: infringing on a trademark Posted: 03 Sep 2020 11:56 AM PDT I have a small business and someone recently reached out to me claiming that I am infringing on his small business trademark. I did consult an attorney about this and his advice was that I would be likely to lose so I should change my business name. I'm small enough that this is not a problem so I've started the ball rolling. I told the claimant that I have done this and his response was that I need to have it "taken care of" within 90 days to avoid a lawsuit. He asked me to agree to that. I responded to ask him to define "taken care of" because I want to know exactly what has to change in that time period. It's not that I plan to skirt the issue or get away with anything. I'm concerned with technical details: I am not going to tell him my details, but I have purchased a new domain (after carefully checking it and the business name against the trademark database, won't fall into this again). I've already modified my site banner to introduce the new name. Over the next few days/weeks I plan to get new email addresses with the new domain and change my marketing (including site banner) and social media accounts. For a short period I'll have the new domain redirected to the infringing domain and then I'll reverse that. The point of this is to ensure that I don't lose customers who know me by the old name. When it's all transitioned and a reasonable period of my customers getting to know my by the new name passed, then I'll abandon the infringing domain name and email addresses. I'm just not sure if the technical parts of this can be done in 90 days. His response to defining "taken care of" is that I am "no longer infringing on his trademark". Which I don't think is helpful and somewhat circular definition. I even looked up the legal definition and it didn't help me. Is it just the visual branding/marketing and domain name? Is it also email addresses and all the back-end things tied to the domain, like Paypal accounts and such? What about SEO, which takes time to propogate through the internet? [link] [comments] |
