He kept my sister and their daughter in his grasp by threatening to kill her and the baby if she left him. He beat her regularly while they were in the hotel room. She eventually sent me cryptic messages asking for help, and I was able to get her out of there safely while he was sleeping off one of his drug-induced stupors. Given the situation, she only grabbed my niece and a few things in her rush to get out of there without waking him. Police were alerted and they arrested him, but he attempted to break the window and escape during the arrest. When we returned to the hotel to pick up my sister and niece's belongings, my elderly mother (70's) insisted on coming for support. My mother also needed to use the bathroom once we arrived to the hotel. Because of the COVID precautions, they only wanted to allow my sister in and begrudgingly allowed my mother in because she needed to use the bathroom. I remained in the car. My sister came back crying and said that they won't allow her to collect any of her stuff unless they are paid $700 out of pocket for the damage to the window sustained when he was attempting to flee from the police. This includes my sister and niece's clothing, ID and other personal documentation, birth certificate, medications, etc. And then even worse, my mother forgot her wallet and cellphone in the bathroom, and the staff quickly confiscated those as well to use as leverage to force somebody to pay for the window damage. I have also yet to have the units returned to me, they were promised to be back here first thing in the morning. Not sure what steps to take next. I'm hoping my brand new units have not been damaged. I live in Texas, I'll post below what the leasing contract says about who may enter. The leasing office also left no notice that anybody had been there, I thought I had been robbed at first. My leasing contract states: "28. When We May Enter. If you or any guest or occupant is present, then repairers, servicers, contractors, government representatives, lenders, appraisers, prospective residents or buyers, insurance agents, persons authorized to enter under your rental application, or our representatives may peacefully enter the apartment at reasonable times for reasonable business purposes. Following the suggestions from the thread, today we spoke with the deputy who was the first contact with my sister about this entire situation and he escalated it to his superior. The deputies then went to the hotel to set the manager straight. They essentially told him that he can't keep the belongings as leverage and that he'd have to pursue damages properly in civil court. The hotel staff were very nice and understanding, but the manager's entire demeanor was extremely hostile and unprofessional. Apparently he was very rude to the officers. I did not like the way he spoke to his staff. But we got their stuff back without any major further hassles. Thank you everyone for your suggestions. We are also pursuing additional resources/assistance/counseling for her as a domestic violence victim going forward. She is in contact with a case manager from the local women's shelter. Being a broke high school student soon to start college, I questioned him a bit and asked a few friends what they would do before deciding it is just my feet and I could use the extra money. I send one pic but he asks for another... and another. I have maybe sent 3 when I get a weird feeling about the situation and realize I am never getting any money as he just keeps asking for more and asking for a video now which made me uncomfortable. So I block the insta page. He has not left me alone since. He began to constantly make fake instas and message me or comment on pics. I turned my insta private and deleted any strangers that followed me. He would constantly (and still does) request my insta, even after changing the name, and completely deleting my account for months at a time. A year or so later he got ahold of a girl (that I barely knew at all) from my hometown and asked her to ask my best friend (also lives in my hometown- I moved out of state) for my phone number. For some reason my friend gave my number to her, and ever since he has had my number and will text and call me randomly off of countless different numbers. Sometimes I wont hear from him for a month or so, other times it will be multiple times a week. I never respond, I don't even decline the calls because I know it will make him mad and he will text me more. He never does anything except threaten to text my sister (which he has messaged her, and got one of her friends phone numbers and asked her about me), along with threatening to show up to where I live and more. He got ahold of my best friends number yesterday and told her he would pay her to give him information about me and that he is obsessed with my feet. In the lease, the landlord is supposed to cover utilities up to $600. It's the middle of summer and we just got an electric bill for $1200 (covers two months, total of 5200kwh). We are very diligent about keeping windows closed and lights off. We performed an experiment by checking the meter every day: when the AC was set to 75F, the house used 70kwh; when it was off for an entire day, the house used only 15kwh. We believe the AC is faulty; the landlord is supposed to responsible for repairs but she refuses to pay someone to look at it. I saw that in Whitehouse estates v. Thomson there is some precedent here that AC must be operational; however, our problem is that the AC is operational but extraordinarily inefficient. This is definitely possible: it may be low on coolant, have leaks, old filters, etc. Are we in the right to force the landlord to repair it or otherwise refuse to pay the utilities above 600/mo? I very politely asked him to not feed my dogs any more 2 weeks ago. He became verbal and i ignored it. A week later the other 1 put food inside my tree area in my yard in the dark. I very quickly found out it is the subject of an ongoing civil suit between two ownership parties, and the tenants are split in terms of who they pay rent to: Old Management (OM), or New Management (NM). I have a lease with NM. The man I work with is listed on the property registration form on file with the Dept. of Buildings as the building manager. Old Management has repeatedly harassed me about being an illegal squatter, signing a new lease with them, coming into my apartment when they thought I wasn't home, and this morning they changed the locks on the front door of the apartment building, prohibiting anybody who has a lease with NM from accessing it and our homes. I called the police, as did the person I work with from NM who met them when they arrived. They refused to allow NM to break the new lock, and told them this needed to be resolved in court. Right now, I'm kind of at a loss. I thought prohibiting access to my home would be a straight forward police call but I'm effectively unable to leave my apartment for fear of not being able to get back in. Is there another authority I can contact about this issue if the NYPD won't help? Is there a legal avenue quicker than housing court I can use to ensure I have access to my home? When I finally tracked down the search, I realized it had not been updated after the closing to include the 2 new owners (my husband and family member). It had further not been updated to reflect me being added to the deed, which was done 10 months after we closed. Now, I am finding that the law firm never sent us the original deed and has since split into two new firms. One of them has at least been trying to be helpful, but the other claims they are trying to pass the buck and I'm caught in the middle of their legal drama or whatever. I just want my original deed! They claim to have no record of it being mailed (so if it was, it was not sent via certified mail), and I was never contacted about picking it up. The last communication I have from the law office said,
Obviously they did not let us know. My County Clerk's office has said that the certified copy is just as good as the original but I am very upset that we paid for these services years ago and they never followed through. My husband recently went through a permanent residency process which was very stressful in and of itself, so we are meticulous about keeping records in our fireproof safe and it makes me very nervous for any future potential immigration issues to not have our original. A little one whom I care for has parents in the midst of a custody battle. It is an ugly battle at best with dad lying at every turn about things directly involving me, i.e saying she is filthy when she leaves my home, her basic hygiene is being neglected, etc. And apparently at their last court date he said he has asked to come into my home and was denied entry. This is 100% untrue, he has never once asked. He has never once asked how her day even went. Well on Monday he dropped off the child and while asking if he could come in and look around he entered my home, therefore not giving me the option as he had entered before I even knew what was happening. I told him absolutely not, that he could not enter without my husband present. This is for VERY good reason. He is a convicted felon known for beating the woman he is dating in front of children, it was so bad that mom has a protection order against him. He could do this to me as well were I to invoke his anger I fear. I was the sole adult in my home with 5 children in my home including 1 from another family that I care for. This is important as well because I specifically put in my agreement with parents that there would never be an adult in my home when their children were there that they were not acquainted with without their prior knowledge/permission. After this occurred he left and I was trying to explain my reasoning and he flashed his phone at me and said "I have all I need here". I figured he AUDIO recorded our conversation which is legal in WI as it is a one party consent state. I informed the mother immediately and made a police report about the incident because it was obvious to me that he was intending to provoke me to do something as we were almost chest to chest (we would've been had I not backed up because he alarmed me) and I had not given him permission to enter my home. They took a report and spoke with him. Later, mom informed me that he had in fact video recorded me before and after entering my home. I looked it up and since I had a reasonable expectation of privacy within my home I believe his actions were not legal. SO that brings me to my final questions: Did he commit a crime by recording me in and/or outside my home? I want to write a letter to someone in my company (I don't know who to address) regarding my training at this construction company. Basically, we had a 6-month training program and we were told to immediately sign the day we were orientated and we can't take the papers home to mull it over. We are required to pay cost incurred 92000 should we leave before we complete our mandatory three years of service after completion of our training. The thing is the whole batch of trainees are not happy with our situations. The compensation is terrible. The management is terrible. The work environment is very hostile to newcomers. There is a clause that says 'in case of non-availability of an appropriate placement for you within 6 months after your successful completion of this training program, or after demobilisation from initial assignment but before the completion of the 3-year service period, you will be rendered free from your mandatory service and training cost accountabilities from the company'. And it was explained by the HR that this means if we are not "MOBILIZED"/DEPLOYED to a PROJECT within six months, the contract would be void. Now I asked about this again since we finished training last December 2019 and was assigned to our Main Office since, not necessarily a project where we would do normal responsibilities of our job and the Legal team said that "He's wrong. He has been receiving a salary up to and until May 15, in effect mobilized to HQ/Mother Unit." (Legal) Based from Atty. ----- email, HQ/Mother Unit is also considered a "project assignment" since, after your graduation from the program, you are receiving remuneration for the work you rendered during your assignment at QC HQ (Mother Unit). (HR) And that basically since we are receiving salary, even if it's not a project (he alluded to in our orientation as a site outside main office), this void clause is not applicable as of June 2020. Also they failed to tell us the cost breakdown of our 92000 training cost. I managed to get ahold of this information in another means, and found out that our 12000 monthly training allowance was included. So that's 72000 in total. I researched a bit and it seems that they shouldn't ask us to reimburse the allowance since technically we were learning "on the job" and we have provided service that warrants that "salary". I want to leave but they are hanging this 92000 in my face. And I don't understand why I have to pay for the service I gave them while I was training. I understand having to pay for food and lectures and modules but I worked the hardest even more so during those months compared to the actual hires. I OTed 2 hours everyday unpaid. My dad didn't live there for 5 years prior to the age of 14 as far as I'm aware - I think maybe 3 or 4 years in Arizona, Texas and somewhere else, as his father was USAF and thus stationed in places like the Phillipines, before he abandoned his wife and kids in the UK and went back home. We did look at moving before I was 21 as apparently that's the "age out" point for me, but the last recession was in full swing (am now 30 and a British citizen). Is there any possible route in for myself that I've missed? I've spent a lot of time there and would like to be closer to my uncle in Texas long term as I miss him and my aunt terribly. H was at his grandma's yesterday helping with something. H started talking to his grandma about the election and why he thinks she should change her vote. She has a 24/7 hospice health aide, but she's mentally sharp, and he said she was agreeing with a lot of what he said. So that conversation happened yesterday. This afternoon, H called the elections office just to make sure her mail-in ballot was good to be mailed to her. The person on the phone told him that yesterday someone called to CHANGE HER BALLOT ADDRESS to her neighbor's address. Meaning the ballot would get mailed to the neighbor. This is a neighbor that she has a complicated relationship with, he helps her with some stuff, but he's also really nosy, like goes through her trash, there's been a lot of other red flags that H and his dad have talked about before. H's grandma said she hasn't spoken to him for a couple days. So now we're in conspiracy mode. There are two separate fucked up things potentially happening here. A) it sounds like someone who knew she may change her vote is taking steps to ensure she can't vote at all. And B) how does that person even know? I was suspended for 2 days, the principal told me that even though she started it (the tension between us, not the physical fight) she's "just a girl" who "wants to do well and sees me as competition" and that it "isn't bullying" because "competition can be healthy". They told me that she "admires me", like lmao okay, makes sense. Everyone (meaning my classmates) was angry that she didn't get any punishment but I did. The teachers had completely overlooked the mean names, laughs and insults that she threw at me... But that's school for you I guess. Anyways that was when we were 17. I'm 20 now and have completely forgotten about high school. Moving on and up in life. I'm only reminded of this whole thing when her sister comes on my social media pages to cyber bully me. The first time she did it, I blocked her. Things went quiet until I posted a picture of myself, then she gets on her second account to write mean comments. I deleted the comments and moved on with my life. A month later I post again and she's back, this time with a different insult in my comments section. She doesn't even follow me, so I don't know how she is she keeping track of when I post considering that her comments are made in a timely manner. I'm sick of it so I messaged her saying if she doesn't stop, I'm going to report her to the police. Then I blocked her. I've now received a message from her sister (so the girl who bullied me in high school). She's searched me up on LinkedIn and found my workplace and is threatening to tell them "things about me" that could "impact my career". She wants me to unblock and message her sister to assure her that I'm not going to call the authorities because it is an "empty threat". This message was very passive aggressive. She put quotation marks around "my career" and that I "study law" as if to idk undermine my achievements. anyways, what do I do? :/ I love my job and want to keep working. But I also want the harassment to stop, but don't want to give in to the threat either [link] [comments] |
