Posted: 05 Sep 2020 09:46 PM PDT Yesterday a sheriff in uniform, in a patrol car came to my vacation home and served me with divorce papers, in front of all of my neighbors. I was very upset with my husband because I broke my leg and he left me here alone for three weeks, unable to walk or drive. We did discuss divorce, but I was totally blindsided that he would serve me like that with no warning. I am lost and afraid. I have no idea what to do, where to start. We have been married 34 years. He controls all the money. I have no idea how much we have or where it is. He transferred most of the money from our joint account. I am destitute. We agreed that when we had children I would be a sahm. He got three degrees during our marriage, while I managed the home and did everything to raise the children. I am basically unemployable now, my engineering skills are out of date. Our kids are on their own now. I don't know how to find a good attorney, what to ask for or what to expect. I (28m) live with my fiance P (27m) and our roommate J (28f) in a 2 bedroom apartment in Illinois that we rent. We just renewed our lease. J's mother has a long history of paranoid behavior and yesterday when J was out with her family (mother father and brother) her mother isolated her and accused her (and myself and fiance) of being in an organ harvesting cult organized by the government and run through covid-19 testing sites. She demanded access to J's phone and her messages. J did her best to remove herself from the situation and told her mother a blanket no to any sort of access to her phone and told her mom to seek treatment and went back to our apartment. That would have been the end of it except J's mother has also convinced J's brother M (25m) of this conspiracy and they drove to our apartment complex. There they convinced our downstairs neighbors to let them into the building. Once in the building M opened a hallway window, climbed out to the outside of the building, opened up our balcony door and broke in to our apartment and let their mom inside where they then proceeded to block J in her bedroom and record her while demanding to know what groups she recently joined and tell her they were concerned for her. J was able to get them to leave and has blocked their numbers and gone no contact but it was a pretty terrible scene altogether. Fiance and I have had to contact our immediate families as we have known each other for a while. What are our options here? J would like to involve the police as little as possible. Are police necessary? Can our landlord end our lease over this? How can J ensure that her family doesn't repeat this episode? Any advice on how to proceed would be greatly appreciated. We recently got a new hire at our job and we hit it off really well. While we were talking we realized she makes .50 cents an hour more than me even though I have more responsibility. It's not a problem I'll just ask for a raise. I asked my manager for a raise and he told me it was company policy that we shouldn't have been discussing our pay, refused to give me the raise, and is now punishing me by taking me off of cleaning and putting me back on registers by changing four other peoples schedules. We have been doing well for a couple years now but my dad now decided he wants to help out which was fine at first but now he keeps verbally abusing my employees, trying to force one of them to quit because he feels like they are paid too much for the amount of work they do. He screams at them and calls them multitude of slurs, even at times ripping things away from them to throw around. He won't stop coming down to the shop despite me and my mom explicitly telling both to his face and by text for him to stay away. I even had to physically haul him and throw him out the door myself so we could work in peace. If this continues, I'm worried that one of my employees is going to end up in a fist-fight with my dad. My parents are still married and living together so I'm worried that he may actually have a right to the shop so I was wondering if there is any way I can make sure he stays away from the property and my employees. She saw me in the parking lot and after finding out what I was doing demanded I give her my journal and the key they are locked in. They claim that since they paid for it, they can control who I notarize for and that they can tell me I cannot use my commission outside of work. I presented Texas Atty GA-0723 which states they can restrict who I notarize for during the time I am on the clock but cannot restrict notarial duties outside of work. After sending this email my boss still refuses to give me my notary materials and she also stated the restriction on notary services is a company-wide policy they have implemented and she is merely communicating what she was told. I understand that she is the middleman. But what the company is trying to do is highly illegal. A notary oath is given to your respective state and NOT your employer. Because of this nonsensical policy, I cannot perform notarial duties because they have my journal. Does anyone have any suggestions on what I can do? Out of revere Massachusetts (USA) I've been served with a restraining order last Thursday in revere Massachusetts, after my ex girlfriend got in a fight with me. It started at home in the morning time where she read a text message from someone she didn't like. She punched me when I was asleep. I held her and asked her to stop in which when I let her go she started beating me again. I ran out of my bedroom and she grabbed a knife and tried to attack me. The knife grazed my forearm. Police was called By the building manager and a neighbor. They did not see the knife attacks or her fighting me and me defending myself. I told the cops nothing really happened and that she stole my phone keys and wallet . I was trying to protect her. She threw my wallet in the ocean , went to my belongs and held them hostage all day. I called the police in the areas she went to because I could ping my phone. She ended up being at my mothers house. I had a friend that she's friends with too ( that she beat up prior and she filed a 258E against my ex) help me get to my parents house(Malden MA) to try and retrieve my stuff. She became violent and broke my phone. She then went by me and started banging on my friends passenger window. My friend rolled it down a little, she reached in and hit her in which I told her to stop. She kept engaging and I pushed her off because the girl was fearing for her life. (Police report says this) There's a prior domestic case with her in which she has been arrested against me in Malden MA. I did drop the charges but it was in July 2020. All in all I want this to be vacated because I'm not allowed to go in my own home anymore. I'm pretty much homeless right now. She's contacted me during this restraining order as well and I filed a report on it and the police officer also observed it which helps me but I don't know what to do. I don't have her side of the story and i feel like she's lied to the police because I got served in the city where I live not where my mother lives in which I pushed her to get her off my friend who stated she was in fear of her life. The hearing is September 14th. she & I did not get arrested sept 1st when it occurred She got summonsed for a&b on my friend and malicious destruction of property on me according to our police report. Seven months ago, my landlord tore open a moldy wall in my kitchen and slathered it with Biocide 100 and bleach, WHILE I WAS HOME and left it like that for a week before plastering over it. It made me very sick. He called a mold testing company and only tested the kitchen, which found four kinds of mold, one of them the black toxic kind. I have a twice collapsed lung and autoimmune issues and other health issues. I told him as an accommodation of my disability, as he'd already made me sick once, that he had to hire someone to test the whole building and to remediate the mold properly. Especially during a lung-wrecking pandemic, I can't trust him using chemicals in my apartment that make me ill. He refused. We are currently in a rent strike standoff. I called the City and he got in trouble for few violations. He came to my apartment to work on some of the repairs, and I vacated for Coronavirus reasons and not wanting to deal with him face to face. Stupid mistake. While alone in my apartment, he "cleaned my bathroom ceiling" free of mold, again spraying with Biocide 100 and bleach. It's now four days later, and it still hurts to breathe. Looking up what is in Biocide, and it's ammonia. My landlord was mixing AMMONIA AND BLEACH in my apartment. I have already had a health inspector come today for smaller violations around the building, and I am trying to get in touch with the construction violations office to come and check out the basement apartment my landlord has been illegally building and wiring himself. My landlord clearly wired this whole building himself, as he's cheap as hell and has bragged about being an Electrical Engineer. Being how inept he is, I'm now pretty fearful of what kind of wiring is in the walls. I've had issues of flickering lights and half lights going out and surges and my stove tripping the outlet. One of the violations he got was having my oven on an extension cord. However, he has only a month to complete the repairs dictated by the Housing Code Enforcement. Can I refuse to allow him entry to my home? Is there a way I can get a mold testing company to test the whole building without my landlord? If the basement is deemed unsafely wired, will that make them have to test the whole building? I went to the nearby ER a day after he sprayed my bathroom, but I hadn't yet put together that my landlord had combined bleach and ammonia. The clinic excepts people with insurance and those without insurance may self pay and carry only up to $250 dollars. The written internal policy is patients without insurance cannot continue receiving services if the bill exceeds that $250 limit. Due to a billing software error at our clinic in at the beginning of the year, dozens of clients without insurance have been forced to pay erroneous bills 10 times over our written internal company policy which has always been $250. My aunt is a patient at this clinic and during our weekly phone calls she asked me for help paying her large bill that is due at my clinic. I thought she was going to ask me for $250 dollars, the max amount our clinic allows. She asked me for $2200 dollars! I told her that it was impossible her bill was so high and I would ask our billing staff to review her account. Just a few hours later after asking billing to check, I overheard the billing manager discussing with the practice owner that dozens of clients have been greatly over charged due to the system glitch from the beginning of the year. Both agreed to not inform those clients and said, "we'll just see what we can get out of this." The practice owner knows I made the request for a concerened client, but they do not know the patient is my family member. The billing manager came to me later in the day and let me know the error was fixed for that client and the billing department would let them know that had been accidentally overcharged and would apologize. I was also reminded that our company billing policy is not to be shared with anyone outside the company due to legal reasons and not to say anything to clients about this because I would lose my job. I didn't think much of it at the moment and was happy my Aunt was only going to have to pay $250 max again as our company policy states. After leaving work, I called my aunt to let her know the good news. When I told her that the billing department would be reaching out to her with the corrected amount. Had an incredibly thorough mold test done (ERMI) which tests dust for mold spores and provides a spore count and DNA identification of each mold type found. The score came back very high, with a high spore count for Aspergillus Fumigatus. Brought this to the seller's attention, and they had a standard air test done for mold (air tests are only 56% accurate) and it came back fine. They insisted after a Google search that their test was industry standard, and that our test wasn't intended to be used for this purpose and wasn't accurate. We tried to back out because of the test discrepancy, but we were outside of our timeline where we could have backed out for any reason, and our realtor said we would likely lose our earnest money (thousands) because an arbitrator was likely to side with the sellers since their test is what's typical and no one who isn't very well-researched on mold has ever heard of an ERMI. So we got trapped, closed on the house, got a mold inspector out 3 days later and he found all the mold. It's all over the beams in the basement ceiling inside of the ceiling tiles. It's Aspergillus Fumigatus, just as our test said. This remediation will cost thousands, has delayed our ability to move in because it isn't safe yet, and we have to juggle 2 mortgages now until we can finally move in. Do I have any legal recourse for this? With the sellers? With the company who did the air test that wasn't accurate? With the realtors? I'm so upset that I did my due diligence, found the issue, and was bullied into moving forward because of the looming threat of losing our earnest money, only to find out that I was right all along. Mortgage company let homeowners insurance lapse (NC) Posted: 06 Sep 2020 08:53 AM PDT Hi everyone, looking for some advice. We previously had no problems with our homeowners insurance which was paid by our mortgage company out of our escrow. We recently received a letter from the mortgage company to tell us we no longer had insurance and that unless we purchased a new policy they would purchase one on our behalf. This was the first we heard of any issue. Many phone calls later I found out that the mortgage company issued a check to the insurance company (bulk check for multiple policies), which apparently was never received/cashed by the insurance company. Exactly what happened is unknown to me. However apparently the insurance company send late and cancellation notices - we received nothing. Mortgage company said it does have cancellation notice on file. So it seems this is an oversight by the mortgage company. The problem is that because we were cancelled for more than 60 days the insurance company won't renew/reinstate the old policy, and the new policy is double the amount. I'm unsure of the reason- one person told me it was because we had a claim 2 years earlier (sounds like BS) and the other person told me it was because we had a lapse in coverage. Can't get a straight answer about this. Anyway, it seems unfair that we should have to pay double the premium because the mortgage company made a mistake. He took advantage of me emotionally and financially throughout the lease, so he wasn't one to respect my boundaries in the first place. He convinced his family member to move in without properly addressing the finances and his share of the rent. Lease ends in October. She moved in around the first week of June. I was honestly so afraid of my landlord finding out and evicting all of us, so I tried to make the best out of the situation. She isn't formally on the lease and she already has had a past eviction record. She's also on probation for a DUI and drinks every week. She's also been hosting parties and inviting people over despite COVID, so she's been endangering my health too. When she moved in she paid $300. In July, she paid $500 and coerced me to write a letter to her probation officer that she was giving me "rent" (even though it's not even close to half of the portion), so she wouldn't have to pay so much in probation fees, according to her. I wasn't comfortable with that but she threatened to not pay and send me to eviction. In August, she gave me $500 again, but that was the last straw because she tried to pick a fight with me about finances. I broke down due to the pressure and financial burdens. She makes it unlivable due to her hostile personality and as someone who tries to be fair, I've realized that she takes advantage of me. Not to mention there's a 20 year age gap between us. While I can hold my own, she makes the environment insufferable. My aunt had enough of it, so she helped me "come clean" to the property manager and let him know of the situation. He was pretty understanding and didn't want to deal with her either, so he put a "Demand for Compliance for Unauthorized Occupants". He said that hopefully that will give her a reality check to move out. Waited 10 days and she didn't. He then moved onto the next one, which is written by the landlord's attorneys where they gave her another 10 days to leave, or we will be evicted. He mentioned that he doesn't have to serve it in court, if she leaves. She still hasn't left. I spent all of August in my parent's home, and thankfully they've been providing me a safe room to stay in, but now this issue is really getting out of hand because she still hasn't left. She does have squatter rights, and the property manager made a point that she doesn't have tenant rights due not being on the lease, and not even trying to apply to be on it. Her reason to live there is to help my ex roommate's record, when she has done nothing but try to ruin it. My ex roommate has been harassing me for the past couple of months, but I've blocked his number and all social media because he's not even in the state anymore, and he should be here in person to address the situation. He has also yelled and belittled the property manager for trying to evict his family member, and claims he spoke to the police about it already. He's also claiming that the leasing office is harassing the squatter and "not even trying to put her on the lease". I am legitimately dealing with crazy people. I also blocked the squatter from contacting me further, but I do have proof of her harassing me through messenger. I haven't paid September's rent and there's a late fee now, mostly because I deem the apartment "unlivable" due to the squatter. Ex roommate and squatter are claiming i abandoned the apartment in August, despite the property manager clearly telling them that it wasn't abandoned and he is still in contact with me. I am worried about this being put through eviction proceedings. If it goes to that, I still plan to pay off the remaining amount since there's two months left. I can't even go into my own apartment because I legitimately feel unsafe now going in there. I am wondering how to even fight this? I definitely want to fight off an eviction on my record. tldr; ex roommate abandoned lease, is out of state, made a squatter move in with no formal lease, causing a hostile environment and has put me in multiple non rent payment situations since she has moved in. Serious Legal Advice Needed. Please help.. Posted: 06 Sep 2020 11:05 AM PDT Greetings, One month ago, I joined a Indian call centre. When I initially visited, the boss told me that they were helping people in the United States by providing them with loans and insurance during the interview process. So, I thought it was legit and started working there. ( I am very gullible and stupid so I didn't realize it at the time that it was a scam call centre ) I was instructed to call some numbers given on the list provided to me and tell the people who picked up the call that their loan application was approved upto 10,000$ and if they agreed to take the loan then we were to ask them the loan amount they needed... their routing number, account number and other details which was later used by the boss who asked them to secure their loan amount through a 100$ insurance. Slowly I realized, the list i was given mainly targeted very old people and baited them for loan. The 100$ insurance money was never refunded back to them. This was the opening script that I was made to say on call: https://imgur.com/a/gCP71eh I worked there for a month until I started getting suspicious because the people who were promised loans kept calling back days after the boss said that loans had been given to them and the boss was ignoring their calls after they had send the 100$ or something for insurance. So few days ago, I took phone number of one of the lady whose calls were ignored by the boss and secretly called her today. She said that she got scammed of 1500$ in total. My heart was crushed after listening to her. That was just one customer. I am pretty sure my boss has scammed many old people in there 70s or 80s baiting them into some personal unsecured loan. Now, I am feeling really guilty and angry. I'm planning to report these scammers to the cyber cell. My questions are: (a) Will I get arrested too if I reported the call centre to police because I worked there for a month being ignorant ... I really had no idea it was a scam until today? (b) What evidences do I need? (The lady who got scammed told me she was ready to cooperate incase I needed evidence if I reported to the police) Please guide me. Posted: 06 Sep 2020 10:01 AM PDT TL;DR My wedding vendor did not respond to my queries to postpone for 7 weeks. Within 2 weeks we set another date with info from all other vendors - vendor finally responded today and says they do not have the entire weekend free (wouldn't be able to do wedding or welcome drinks to use deposit). On their state's business page, their LLC is listed as terminated. We paid a $900 non-refundable deposit via Venmo, does their LLC termination nullify our contract and entitle us to the $900 back? Backstory: My wedding was originally supposed to be this past June in Vermont (US) but we obviously didn't have the big wedding for safety reasons. Back in April when we thought COVID would be under control by the end of the summer, we postponed to Halloween. As July rolled around, we postponed to mid-October of 2021 for 1) the safety of guests and 2) because the likelihood of a vaccine being developed in the US by then was higher. Most of my vendors replied to my queries within a week and issued new contracts. Sometimes it can take Vermont vendors longer due to the "Vermont way of life" that's slower. We realize this, and made a decision on a date about 2 weeks after our outreach when most vendors had responded. One vendor (a photo booth in a converted 60s van) was non-responsive. We had an issue with them not responding for 20 days during the first postponement, so I knew they might be a problem and require more follow up. For the first postponement. they already were scheduled for our wedding date, but arranged to transfer services to the day before the wedding during Welcome Drinks instead to save our deposit. Since the wedding was originally postponed to Halloween, we thought it would work out since we invited people to come to Welcome Drinks in costume to get it out of their system. A photo booth van for that seemed to work out well. In July, we realized a big wedding for 2020 would just not be feasible and asked for dates between June-October of 2021 from our vendors to make a decision for a new date. Many responded within a week with dates. Photo booth van did not. We decided on a new date by the end of July based on the greatest availability from our vendors - 10/16/2021. Photo booth van still had not responded. I tried multiple methods of contacting them. This is the log I recorded - if I get access to phone records, there may have been more calls. I'm not entirely sure. July 13- sent email asking about dates July 16 - texted to follow up with dates July 23 - called, went to voicemail July 28 - called, went to voicemail (at this point we had selected a new date) July 29 - emailed July 29 - Sent Instagram DM to their business page August 3 - emailed August 9 - Facebook Message to their business page August 28 - email August 30 - called, went to voicemail September 6- texted, finally received response that they do not have the entire weekend we selected. This is the only applicable text I can find in the original contract. When we postponed, they didn't give a new contract, just an updated invoice. DATE CHANGES AND CANCELLATIONS Any request for a date change must be made thirty (30) days in advance of the original event date. Change is subject to availability of Photo Booth by provider and receipt of a new service contract. If in the event the new date cannot be accommodated all deposits and payments received shall be forfeited. Provider promises to make all reasonable attempts at date changes. However, if the vendor didn't reply for 7 weeks, I feel they did not make all reasonable attempts at date changes and we should be able to get our deposit back. Additionally, I asked a local VT Wedding Vendor group on Facebook if they knew if the vendor was still in service because of the lack of response. Someone found out via Bizfilings.Vermont.gov that the business is listed as terminated. I've been told that if a business is terminated, they're legally supposed to notify clients and "cancel or renegotiate a transfer or substitution of the contracting party for contracts and leases into which the LLC entered". To me this says, if they are unable to provide services, they have to find someone else to do it. This it the only clause in their contract about service discontinuation that's only listed to provide a shield for the vendor if they are in unsafe conditions (i.e. no shelter in inclement weather, guests that try to vandalize their property, or are abusive). SERVICE DISCONTINUATION Provider reserves the right to discontinue services at any such time during the event that the photo booth attendant or Provider feels that the integrity or safety of the Provider and/or Providers equipment is compromised. In the event services are discontinued Client will not receive a refund in part or in full unless other arrangements have been made. A family member who was supposed to stay very temporarily because of Covid related issues, but refused to leave. He's been here 5 months now. He's never paid rent or helped around the house, but he did change his address, which combined with the time stayed, probably makes him a tenant. He's 5 weeks into his 60 day notice to evict. He's been harassing my 11 year old son and being overly, creepily friendly to my 11 year old daughter. He's been threatening to wrestle him till he cries, putting him in a headlock, calling him weak, fat, and a "little bitch". He has repeatedly invited my daughter to come play in his room, watch movies on his bed, teaching her to "wrestle" which conveniently involves touching her a lot. I'm constantly on my guard, keeping my kids close to me, making sure they are never unattended. I've clearly and explicitly told him (not very calmly) to never interact with my children again. So instead, he's going into rooms where they are, crossing his arms and glaring at them. Until they get up and go somewhere else. He's not explicitly using words to threaten them, but he's still threatening them. I've had to take them to stay with their dad and they're scared to return. I'm scared to have them return. Looking at the Georgia requirements, he doesn't seem to meet the requirements for a TPO because he hasn't actually hit anyone. Can anyone offer advice? [link] [comments] |
